I got kinda sorta a rather precious phone call with the kind of response I Love from a tough talking cop. Need I say I treasure them? At least that arsehole does not hide his malice towars me. He was trying hard to seem nice to me by making small talk in asking me who I knew and whether or not I was from Doaktown etc as I over heard what his lady dispatcher pal was telling him what to do with me. Cpl Randy Reilly was even too chicken to back you his own malice when he read a few of the letter sent to me years ago. He had the kid cop write me the tickets and sign them so that he would not be involved. However I do have a video of Cpl Randy Reilly inviting me to sue him. Don't I?
It was another of Fat Fred City's Finest showing me his nasty arse in a far more stylish way that made today kinda special as he tried hard to scare me with his tough talking cop demands. In answer to Cpl Stevey Boy Horsman's malicious questions on the record, I do declare that I am not within his jurisdiction. So he can go to Hell or go climb another mountain or play some more basketball for all I care.
Also for the record I was calling the Fat Fred City Finest earlier today because I last week after nobody would tell me whether or not I was to come to court or whether or not my name was called or even if there was a docket with my name on it, I had commissioned a very decent man who has my Durable Power of Attorney pursuant to M.G.L. 201b last to act in my name place and stead. I asked him to go pick up my old Harley and pay what ever malicious fees the crook Alan MacFee demanded before the scumbag found some way to claim I was in default of reclaiming my property and sized it for himself.
Now it appears that I must sue everybody to get my old bike back EH? WHY? My old bike is legally registered in the "Live Free or Die" State of New Hampshire and insurance is not required. It is most definitely the fault of the Depts of Public Safety in Canada and New Hampshire that I have no been able to return to the USA and pay whatever fees the Town Clerk in Acworth requires to bring my road taxes up to date in that State. i cannot renew my registerations by mail in New Hampshire dummies. I will be the dummbest man alive to return to the USA before Peter MacKay act like a proper Minister of Foreign Affairs. DOES ANYONE GET IT NOW?
When I was informed today that the Fat Fred City's Finest associate, Alan MacFee had refused my friend my right to my property for reasons that he constantly dreams up for the benefit of the Fat Fred City Finest and his own sister no doubt, I came up with a brand new plan. Since my wife and kids are coming to Canada shortly, I would send her to get our property. Thus I opted to call Fat Fred City Finest once again to sse if the corrupt cops thought it was ok for my Yankee wife to pick up our property. Cpl Charlie (the only one in the Force he says) denid me that right without hesitation so I tried to talked to the Chief Barry MacKnight once again and then as you know called you Billy Boy Corby for the last time I might add.

P.S. I was tried of writing so I just clicked send. I don't bother with spell check in Yahoo Depupty Dog and I don't have a proof reader anymore. I have a more important one to send before the midnight hour in Yankee Doodleland that you are somewhat curious about no doubt. I gave you all a clue last night it has to do with another man the IRS falsely imprisoned for their own benefit. Today is the day to point out how I can help with his plight. If you don't like my writing stlye, tough titty. It is just one of those things I do that nobody seems to appreciate. Ask me if I care. Like the Latter Day Saint (in my book anyway not Mitt Romney's ) old Will Rogers broke every snotty rule there was when it came to writing or speaking and ordinary folks like me loved him to death and some of us even after death. If he can do it and get away with it so can I. It is just that simple. My hat is off to men such he. Will Rogers lived life to the fullest and died too soon for any man. But at least he had more fun and did more good than any ten men who lived twice as long as he. The best part of Will Rogers was that although he made everybody laugh at the awful truth about themselves, he was a dedicated family man. He was a true artist and one hell of a man as well. Will Rogers seed should be proud of their forefather forever.
(Did ya notice I had his book beside my bed Depupty Dog? If ya stole it along with my tools and my children's beds you should have read it too. Maybe some of old Will's goodness would have rubbed off and soothed your nasty Yankee soul. at least you did this old world a favour and left no clones of you. I repeat stay away from my kids Yankee. I do not agree with old Will's most famous words)

Attorney General Eleven New Brunswick lawyers honoured at Legislative Assembly (04/12/06) NB 1405 Dec. 6, 2003
FREDERICTON (CNB) - A total of 11 New Brunswickers received the title of Queen's Counsel during a ceremony in the Legislative Assembly chamber today. Lt.-Gov. Herménégilde Chiasson participated in the event, only the second time a lieutenant-governor has done so. Among the recipients were three women and three graduates of the Université de Moncton.

The unanimous recommendation to the lieutenant-governor for this year's Queen's Counsel was made by a committee chaired by New Brunswick Chief Justice J. Ernest Drapeau. Committee members include Attorney General Brad Green and New Brunswick Law Society President Bruce Noble.

Premier to announce 50 new jobs

FREDERICTON - Premier Shawn Graham is scheduled to be in Moncton
tomorrow for a job announcement.
Graham is expected to announce funding for First Canadian Title, a
business that handles land title insurance for residential and
commercial real estate transactions.
The funding will help create 50 jobs, adding to its workforce of 28
employees, the Times & Transcript has learned.
It's unknown how much money the provincial government is giving the company.
The expansion of the Moncton office is a result of meetings Graham held in Toronto with company officials over the past few months, according to a government official.
First Canadian Title is owned by First American Corporation, a
publicly-traded company in the United States. The company has 16,000 customers across Canada, including lawyers and major banks.
Then there was this last week but everybody seems to forget about how
much T.J. Burke yapped about mean old me with saying my name not long
after the Cops in Fat Fred City stole my old Harley.

Remarks were 'careless,' underline need for public inquiry, says wife
of Erin Walsh

An alleged conversation between Justice Minister T.J. Burke and a
University of New Brunswick law student concerning the wrongful
conviction of Erin Michael Walsh is renewing calls for a full public
inquiry into the 1975 case.
Joel Payne, a third-year student, said he heard the justice minister
speak to students on March 17 at an event during which he was asked
about the Walsh case and why the government hadn't cut a deal on
financial compensation for the wrongful conviction.
Walsh has a civil case pending against the government, and is seeking compensation.
After the presentation, according to an affidavit sworn by Payne in
Fredericton on March 31, Payne attended a reception with Burke where he spoke about the Walsh case again. He said Burke urged him to look at the Walsh court file and told him that Walsh had been in Saint John, at the time of the murder, for a drug deal.
"The attorney general then added that Walsh had killed before or that he suspected that Walsh had killed before," Payne said in the
affidavit.
Separate affidavits filed by two other second-year law students, Dave Steele and Shane Martinez, alleged they, too, asked Burke about the Walsh case during his presentation, but did not hear the remarks Payne said he made at the reception afterward regarding Walsh's alleged involvement in another murder.
Both Steele, who said he only knew Payne by his first name, and
Martinez said Payne approached them in the library and told them about his conversation with the justice minister, and they subsequently wrote down the conversations as they remembered them.
All three students volunteered to swear affidavits — in Fredericton on March 31 — detailing what they heard or were told. None of those
affidavits has been filed in court.
Burke's office has declined to comment on the allegations because the matter is before the courts.
Late Wednesday, however, Premier Shawn Graham's office issued a
release saying that in light of the allegations, Graham was
transferring responsibility for the Walsh case from Burke to Business New Brunswick Minister Greg Byrne.
"Byrne served as attorney general and minister of justice from 1997 to 1999," the brief release noted.
Walsh's wife calls for public inquiry Walsh's wife, Angie, was unavailable for an interview, but in a statement, she lashed out at Burke's alleged comments.
"For the attorney general to act in such a careless way should tell
the people of New Brunswick he is not competent to serve in this
office," her statement said.
"The government should do the right thing and conduct an independent public inquiry … to settle this thing. It is obvious that there will be no justice for our family as long as this is in the hands of the politicians. My husband is dying, and we are beside ourselves waiting
for a conclusion and peace."
Sean MacDonald, a lawyer for Walsh, said if the affidavit is accurate, it underscores the need for a public inquiry into the case.
New Brunswick Conservative Leader David Alward also said Burke should
do the right thing and resign while this controversy is still hanging over him.
"I believe it is important for the minister of justice to temporarily
step aside until the situation is completely reviewed," Alward said.
Walsh, who was diagnosed with colon cancer in March, maintained his innocence of the 1975 murder for 32 years and in March 2008, was
acquitted of the crime by the New Brunswick Court of Appeal.
He served close to 10 years in jail for the murder before being
granted day-parole in 1984 and full parole in 1986. A string of crimes has seen him in and out of prison since that time. He is currently out of jail on compassionate parole, granted after his cancer diagnosis.
Walsh's family has not said how much money it is seeking in the civil case.
By comparison, Steven Truscott received $6.5 million for his wrongful conviction for a 1959 murder.
Considering Erin Walsh's failing health, a provision in the Survivor
of Actions Act in New Brunswick is worrying the family. The clause
stipulates that if Walsh dies before his civil case is resolved, any financial settlement could be severely reduced.
Under the law, the only damages that can be awarded are for an actual loss to the person or their estate and cannot include payments for "loss of expectation of life, pain and suffering."
Walsh originally convicted in 1975
Walsh was convicted of murdering Melvin (Chi Chi) Peters in August
1975. At the time, Walsh, who has a long criminal record, was
travelling from Toronto when he arrived in Saint John and joined a
group of people, including Peters, for drinks at a beach in the city's
south end. When leaving the area, a struggle took place in a car, a
shotgun went off, and Peters was killed.
At Walsh's trial in 1975, prosecutors presented the case as open and shut. The jury took only one hour to convict him of second-degree murder, and he received a life sentence. Earlier appeals to the New Brunswick Court of Appeal in July 1982 and November 1982 were
dismissed.
In February 2008, Federal Justice Minister Robert Nicholson ordered
the conviction be reviewed in light of new evidence.
The evidence, obtained by Walsh as part of a 2005 access to
information request, included a report of jailhouse conversations that suggested someone else shot Peters.
The 1975 police report from Saint John police Det. Douglas Titus said
Titus overheard a jail cell conversation soon after the murder between two people Walsh had been travelling with. David Walton asked Don McMillan why he shot Peters, according to the report, which noted that the men appeared to be drunk.
The report was not disclosed to Walsh's lawyers at the time.
The appeal court heard that the former Crown prosecutor, William
McCarroll, later told an investigator working on Walsh's case he didn't disclose the report because he considered the conversation to
be "drunken jabbering" the defence wouldn't have used in their case.

As your attachment sent today refers from Premier Graham, our position is clear on your dead calf issue: Our forensic labs do not process testing on animals in cases such as yours, they are referred to the Atlantic Veterinary College in Charlottetown who can provide these
services. If you do not choose to utilize their expertise in this
instance, then that is your decision and nothing more can be done.
As for your other concerns regarding the US Government, false
imprisonment and Federal Court Dates in the US, etc... it is clear
that Federal authorities are aware of your concerns both in Canada and
theUS. These issues do not fall into the purvue of Detachment policing in Petitcodiac, NB.

Threat against Burke taken seriously

An RCMP security detail has been guarding Justice Minister and
Attorney General T.J. Burke because of threats made against him
recently.
Burke, the Liberal MLA for Fredericton-Fort Nashwaaksis, wouldn't
explain the nature of the threats.
"I have had a particular individual or individuals who have made specific overtures about causing harm towards me," he told reporters Wednesday.
"The RCMP has provided security to me recently by accompanying me to a
couple of public functions where the individual is known to reside or have family members in the area," said Burke. "It is nice to have some added protection and that added comfort."
The RCMP provides protection to the premier and MLAs with its VIP security unit.
Burke didn't say when the threat was made but it's believed to have
been in recent weeks.
"When a threat is posed to you and it is a credible threat, you have
to be cautious about where you go and who you are around," he said.
"But again, I am more concerned about my family as opposed to my own personal safety."
Burke said he doesn't feel any differently and he has not changed his pattern of activity.
"It doesn't bother me one bit," he said. "It makes my wife feel awful nervous."
Burke served in an elite American military unit before becoming a
lawyer and going into politics in New Brunswick.
"(I) have taken my own precautions and what I have to do to ensure my
family's safety," he said. "I am a very cautious person in general due
to my background and training.
"I am comfortable with defending myself or my family if it ever had to happen."
Burke said it is not uncommon for politicians to have security concerns.
"We do live unfortunately in an age and in a society now where threats have to be taken pretty seriously," he said.
Since the terrorism attacks in the United States on Sept. 11, 2001,
security in New Brunswick has been
beefed up.
Metal detectors were recently installed in the legislature and all visitors are screened.
The position of attorney general is often referred to as the
province's "top cop."
Burke said sometimes people do not differentiate between his role as
the manager of the justice system and the individual who actually
prosecutes them.
"With the job sometimes comes threats," he said. "I have had numerous threats since Day 1 in office."
Burke said he hopes his First Nations heritage has nothing to do with it.
"I think it is more of an issue where people get fixated on a matter and they believe you are personally responsible for assigning them their punishment or their sanction," he said.
Is the threat from someone who was recently incarcerated?
"I probably shouldn't answer that," he replied.
Reporters asked when the threat would be over.
"I don't think a threat ever passes once it has been made," said
Burke. "You have to consider the credibility of the source."
Bruce Fitch, former justice minister in the Conservative government, said "every now and again there would be e-mails that were not complimentary."
"I did have a meeting with the RCMP who are in charge of the security of the MLAs and ministers," said Fitch.
"They look at each and every situation."
Fitch said he never had bodyguards assigned to him although former
premier Bernard Lord and former health minister Elvy Robichaud did
have extra security staff assigned on occasion.
He said if any MLA felt threatened, he or she would discuss it with the RCMP.

Legal profession — Practice by unauthorized persons — The
plaintiffs sought a declaration that a section of the New Brunswick
Standards for the practice of Real Property Law was invalid — Law
Society opposed the claim and counter-claimed, alleging the plaintiffs were illegally practicing law — Action allowed and counter-claim dismissed — Services provided by the plaintiff were functions that included the practice of law — They were performed under the supervision of lawyers who were practicing members of the Law Society
in good standing.
Real property law — Title — Establishing title —
The plaintiffs sought a declaration that a section of the New Brunswick Standards for
the practice of Real Property Law was invalid
— Action allowed —
Impugned provision of the Standards restricted a lawyer to only accept the Form 2 Affidavit sworn before a notary public which conflicted with what was authorized and provided for in the Land Titles Act and the Regulations under that Act — The Law Society did not have the
authority under its Act to restrict or change what was authorized and expressly allowed under the Land Titles Act
— Land Titles Act and
Regulations, s. 52.1(h).
The plaintiffs, FCT Insurance, carrying on business as First
Canadian Title, and First Canadian Title Ltd., sought a declaration
that a provision in the New Brunswick Standards for the practice of Real Property Law was invalid. The Law Society opposed the claim and counter-claimed, alleging that the plaintiffs were illegally practicing law. Section 1 of the Land Titles Act set out the intent and purpose of the Act, being to provide a system for the registration of land in the province and related instruments, and to provide statutory authority for guaranteed land title. For a guarantee to apply, the land owner had to apply to change the title of his property from the Registry System to the new Land Titles System. The Form 2 affidavit of the applicant prescribed in the Land Titles Act regulation indicated that it may be sworn before a Commissioner of
Oaths. It was not required that one be a lawyer to become a
Commissioner of Oaths in New Brunswick. Approximately one year
after the start of the Land Titles System, part III of the Law
Society Standards for the practice of Real Estate Law came into
effect. Under s. 52.1(h) of the Standards, the owner of a parcel of
land being converted to the Land Titles System had to attend before a notary public to swear the accompanying Form 2 affidavit to the application. Under the standard the notary public had to explain the affidavit and the first registration of title (AFR) to that person and complete a form indicating that that had been done and explain to the deponent in person. Only lawyers were notary publics in New Brunswick.
The issues that arose were whether s. 52.1(h) of the Standards adopted
by the Law Society was illegal and unenforceable and, with respect to
the counter-claim, whether the plaintiffs were illegally practicing law.
HELD: Action allowed. The counter-claim was dismissed. The impugned provision of the Standards which restricted a lawyer to only accept the Form 2 Affidavit sworn before a notary public clearly conflicted
with what was authorized and provided for in the Land Titles Act and the Regulations. It purported to prevent what the enabling and governing legislation permitted. The Law Society did not have the authority under its Act to restrict or change what was authorized and expressly allowed under the Land Titles Act and the Regulations. The impugned provision was ultra vires in that it was inconsistent with, and conflicted with the procedures provided for in the Land Titles Act and the Regulations. With respect to the counter-claim, the services offered and provided by the plaintiffs were not prohibited by the Law Society Act nor did they constitute the illegal practice of law. The services provided by the plaintiff were functions that included the practice of law. They were performed under the supervision of lawyers who were practicing members of the Law Society in good standing.
