Gallant government abandons school bus duality court case

Education Minister Brian Kenny says decision on school busing will be left up to school districts

The Liberal government is abandoning its constitutional court case on dual school busing and will instead leave decisions on student transportation to individual district education councils.

It's a stunning reversal for a government that said last year it wanted the New Brunswick Court of Appeal to clarify whether dual bus systems for English and French school systems were required by the Constitution.
But the court said in a procedural decision last month it still wasn't persuaded it should even hear the case at all.

Wednesday the Liberals said given that hesitation, they would abandon the reference case and instead let DECs decide for themselves on school busing.

That means a francophone and an anglophone district could choose to share buses, Education Minister Brian Kenny told reporters.

"The districts were set up to have local autonomy," he said. "It's up to the districts."

Kenny said the Court of Appeal clearly had "reservations" about ruling in the case. "I wanted to make sure that we provided clarity on this."

He pointed out that DECs are made up of parents and representatives elected by parents.
Section 23 of the Charter of Rights and Freedoms guarantees minority-language parents the right to govern their own schools, so by leaving the bus decision up to education councils — the mechanism for that governance — the province can argue it's complying with the charter, even if the councils decide to share buses.

Difficult for districts


But Michel Doucet, a law professor and language rights expert at the University of Moncton, says a francophone district that decides to share a bus route with an anglophone district would have to show that it's not violating the language rights of students.

"It would be difficult for them … and if they would do it without justifying it under Section 23, they would open the door to a legal challenge."

Doucet says he expects the new policy means nothing will change and the two busing systems will continue to operate. He pointed out all three francophone districts in the province have adopted resolutions opposing shared, so-called bilingual busing.

"So basically we're just back to where we were a year and a half ago, before the reference was made to the Court of Appeal," he said.

Reference ruling sought last year


The Gallant government decided to send the dual busing issue to the Court of Appeal for a reference ruling last year, after weeks of controversy.

The tipping point came when then-Education Minister Serge Rousselle told the two school districts in Kent County, one English and one French, that their sharing of a school bus run wasn't allowed.

That prompted a backlash and the Liberals decided to send the case to the courts, even though they were adamant the Constitution required them to provide two bus systems.

Kenny said Wednesday the new policy will allow the two school districts in Kent County to resume their sharing arrangement if the two education councils choose to do so.

Higgs reacts

Progressive Conservative Opposition Leader Blaine Higgs said "We'll wait to see the impact of this policy, but if the districts will be given more decision-making power, we'd suggest they be able to decide the entry point for early French immersion. I know of at least two districts that would make good use of that power."

Higgs has relentlessly criticized the Liberals over the last two weeks for deciding to move the entry point for French immersion from Grade 3 back to Grade 1.

What really took the cake for me year later was when I was running in the Election of the 38th Parliament the French lawyer Bernie Lord had the Prima Donna artsy fartsy French Lt Governor and the French Sgt at Arms who was ex RCMP/GRC member who found the dope in Hatfield's baggage when he was traveling with the Queen bar me for parliamentary properties.

Trust thatI wrote a letter to the Lt Governor of New Brunswick and made it a point to remind that snobby French man of what Louis Riel wrote in his diary before the RCMP/GRC had him hung. Old Louie the Metis warned us that the French would take back Canada without out firing a shot.

@David Raymond Amos FYI Way back in the early eighties after Trudeau "The Elder" did in the folks living in "The Pace To BE" with a Charter he and his buddy Jean Chretien created to screw the English with I became a card carrying member of an Anglophone Society in NB for valid reasons. It was after my mother in law whom I dearly and truly loved (Imagine that?) had to retire early from the RCMP/GRC because she could not speak French even though she had done her job just fine since 1954 ( I believe I still have that old membership card somewhere in box of mementos along with a picture of a very fine lady)

That said in looking back in the over 30 years since, I must confess that the average French taxpayer in New Brunswick have been screwed every bit as much as the English ones. The only French people making a big score work for the government while the rest of the the French and English folks pay their way byway of more and more taxes as our services are constantly cut.

A lot of French people who made the big score came down here from Quebec. Among the first to come were members of the RCMP/GRC. (Did anybody notice that Quebeckers are wise enough not employ that very corrupt Federal Para-Military Force?) Anyway most the the French GRC members would only speak their lingo to us as they pummeled us with speeding tickets etc. Hence the creation of the New Brunswick Highway Patrol, Anglophone Societies and the COR party.

@Michael McFadden The Crown doesn't think that way when the citizens it purportedly serves and protects sue it. Trust that I know from personal experience. Long ago I came to an understanding that the democracy and justice are myths. If someone is dumb enough to believe that there are ethical lawyers and politicians then don't tell them about Santa or the Easter Bunny or they will get mad at ya.

On the other hand I find fun in poking holes in the stuffed shirts as I dice with the smiling bastards in the political arena and in the courts. Its kinda comical that nobody will dare talk about my legal and political actions particularly the Crown Corp commonly known as the CBC.

The Crown's MO is as follows. It enlists mindless lawyers on staff or hires certain buddies as outside counsel use our resources to swamp the citizen with mindless and very flawed motions that the judges try to support in order to delay the matter at least until there is a new governmental mandate and the new political boss can blame the past boss for being incompetent. .

In the "Mean" time the Crown keeps asking for costs to be awarded to it for their lawyers motions from the political cronies it appointed to be judges. If all else fails the Crown attorneys simply delay deny and lie as they wait til you either give up or run out of money or crawl away and die.

As for I am like a dog with a bone and won't let go of the simple truth about the rampant public corruption. Like the energizer bunny I keep going and going but I have grown old doing so and look a lot like Santa these days.

Hmmmm. I attended middle school in Rosemere just outside Montreal Quebec and took a school bus that transported both English and French students and we all got along just fine. I have a hard time understanding why this became an issue in the first place for NB.

When I went to the High school English kids where taking our bus, the kid even went to the same high school, but because of the English parents that requested their own school and bus it changed everything for the province. That year the English highschool St Marys graduated 12 kid....This problem was not created by the French population.

* By placing the decision-making back in the hands of districts and parents - it does not clarify the constitutionality, and instead reopens the matter for arguments and resentment.
* It does not address section 4(6) of the New Brunswick Education Act which prohibits the sharing of programs and services
* It re-opens the potential for legal challenge
* Higgs makes a good point in relation to more decision-making by the Districts in regards to Immersion programming
* At the end of the day - it is unlikely districts will share busing on any significant scale, being as new buses were purchased to provide additional and maintain segregation after Serge Rousselle started this
* Regardless of what happens now - the tax payers are still out over 107,000 (plus unknown expenses, and those incurred since our Right to Information Request on costs was received in August) ... and still does not have a definitive answer to this controversial question

These pursuits by them have never seriously been challenged, because the opposite position are not organized and cannot get the funding to challenge them.
