Why should we throw our dairy farmers under the bus to secure a deal with a mean spirited president few people like or who few thought NAFTA needed to be changed?

Trump wants a victory before the midterms. Let's deny him that. If he doesn't get a deal lopsided in favour of the U.S. to crow about he still has to sell his intentions to Congress. If he tries to by-pass Congress it will likely wind up in the Supreme Court. Does Trump really want to risk another legal defeat. There's no notwithstanding clause in the U.S. constitution. Maybe he'll even soften his stance to avoid failure.

Of course we risk tariffs in the meantime but that 's better than being stuck permanently with a lousy deal.

Canada's ethics commissioner says Dominic LeBlanc broke conflict of interest rules when he awarded a lucrative Arctic surf clam licence to a company linked to his wife's cousin.

After a four-month investigation, Mario Dion said Gilles Thériault stood to benefit financially from the Arctic surf clam licence being awarded to the Five Nations Clam Company because he was to act as the company's general manager if it landed the licence.

In his report, Dion said LeBlanc was aware of Thériault's "extensive involvement" in the fishing industry — and was also aware of his family relationship to Thériault when he made the decision to grant the licence to the Five Nations Clam Company.

"In fact, Mr. Thériault raised the licensing issue with Mr. LeBlanc prior to the decision and Mr. Thériault's name appeared on the proposal submitted to Fisheries and Oceans Canada and read in full by Mr. LeBlanc," Dion wrote.

The fishing licence — the fourth granted for Arctic surf clams — was for 25 per cent of the total allowable catch and was worth about $24 million in sales in the first year.

Conservative B.C. MP Todd Doherty, the party's fisheries critic, initially raised concerns about the government's move to expand ownership in the fishery by clawing back part of an existing quota held by Clearwater Seafoods and handing it to a group with Indigenous representation.

The Arctic surf clam is a saltwater clam harvested in the Atlantic, primarily for consumption in Asian markets as sushi. Fisheries and Oceans Canada has issued three fishing licences for the species; since 1999, Clearwater Seafoods has held, indirectly or directly, all three.

Conflict of interest rules

LeBlanc selected the Five Nations Clam Company as his preferred licensee in December 2017 and in February 2018 his department announced a licence would be issued to the company. The department later cancelled the process for issuing the licence, but the cancellation had nothing to do with Dion's investigation, the report said.

Under the Conflict of Interest Act, public office holders are in a conflict of interest when they exercise an official power, duty or function that furthers their private interests or those of relatives or friends.

The act defines relatives as spouses and those related by birth, adoption or "affinity," which means relatives acquired through marriage, including in-laws.

During the course of the investigation, LeBlanc insisted that Thériault was not a close or immediate family member and was one of his wife's 60 cousins.

Dion said the definition of 'family' under the act is expansive and not restricted to immediate family members. He found LeBlanc breached a section of the act that prohibits public office holders from making a decision that would place them in a conflict of interest, and another section which requires them to recuse themselves from any discussion, decision, debate or vote on any matter where they could be in a conflict of interest.

The commissioner said the fact that Thériault's name was on the proposal — while no doubt adding to its credibility due to his extensive involvement in the seafood industry and with First Nations in New Brunswick — should have put LeBlanc on his guard about a potential conflict.

"Public office holders are not expected to have knowledge of the private affairs of each of their birth relatives, much less those of relatives by affinity. However, when they are aware of an opportunity to further the private interests of a relative through the exercise of an official power, duty or function, they must be vigilant in taking appropriate action to avoid a conflict of interest," he wrote.

Responding to the report from the Liberal caucus retreat in Saskatoon, LeBlanc said he accepts the commissioner's findings "without reservation" and that he would govern his future behaviour accordingly.

"I accept his determination and I will ensure that going forward we work with the commissioner's office to ensure this doesn't happen again," he said.

LeBlanc went on to say that public office holders have an obligation to follow the act, and must get clarity from the commissioner's office when there is any uncertainty about interpreting the act.

The Conflict of Interest Act does not allow for any sanctions in this case.

"The only direct result of an examination report is shedding light on the activity examined," said Jocelyne Brisebois, a spokeswoman for the commissioner's office.

Trudeau breached conflict rules

Monetary penalties up to $500 can be imposed on office holders who fail to meet reporting requirements, but they are not relevant in this case.

Conservative Leader Andrew Scheer said Dion's report shows that the Liberals bend the rules to their own advantage, and that Trudeau turns a blind eye to his ministers' ethical lapses.

"Ultimately, the penalty should come in 2019 where Canadians vote out a Liberal government that has allowed this culture of entitlement to set in, where Liberal ministers feel it's up to them to interpret the rules," he said.

'Pork barrel politics'

NDP MP Charlie Angus said LeBlanc should have recused himself from discussions on the licence since his wife's cousin stood to benefit. Despite Trudeau's pledge to improve ethics, the Liberals have continued the tradition of "pork barrel politics," he said.

But Angus added he doubts any penalties will be brought in.

"Governments never want to penalize their own members, their own ministers, so the government does not want to take these steps," he said.

In the July 18 cabinet shuffle, LeBlanc was moved from fisheries to take on a new portfolio as minister of Intergovernmental and Northern Affairs and Internal Trade.

Yesterday, LeBlanc's replacement, Fisheries Minister Jonathan Wilkinson, announced that a new process to grant a fourth licence will be launched next spring, so a new participant can begin fishing in 2020. An independent third party will evaluate the submissions received, he said.

The government has not publicly explained why the licence for Five Nations Clam Company was cancelled; Wilkinson himself has cited "commercial confidentiality."

In December 2017, Prime Minister Justin Trudeau apologized for his actions after the former federal ethics watchdog Mary Dawson found he violated some provisions of the Conflict of Interest Act when he vacationed on a private island owned by the Aga Khan over the previous Christmas season and took a private helicopter to get there.


At the time, Trudeau said he believed the conflict rules did not apply because he was the guest of a family friend.

There's been growing calls from both sides of the border for Canada to make concessions on its protected dairy sector in order to finally reach a new North American Free Trade Agreement with the United States.

Many argue that Canada has already made concessions in the sector to secure other trade agreements like the Trans-Pacific Partnership (TPP), and the dairy industry is a relatively small part of the economy.

But even if Canada does give in to U.S. President Donald Trump's repeated attacks on the country's tariffs on dairy imports and its supply management system, some economists south of the border say it will not be enough to seal a new trade deal.

"Even Canadian concessions on dairy may not be enough to make the U.S. keep the current dispute resolutions," said Carlos Capistran and Mingzi Yi, economists at Bank of America Merrill Lynch, in a note.

"Our baseline is that Canada will join the U.S.-Mexico agreement, making concessions on dairy, but that it likely will have to make some concession on dispute resolution as well."

The current NAFTA's dispute resolution mechanism, known as Chapter 19, allows companies that feel their products have been impacted by anti-dumping or countervailing duties to request arbitration.

Prime Minister Justin Trudeau said just last week that the process was needed, because Trump "doesn't always follow the rules."

But U.S. economists argue the dispute resolution is "on the balance."

They think Canada will make concessions on the mechanism to reach a trade deal with the U.S. this month.

However, there are questions over the value of a trade deal without the key resolution mechanism.

"Without Chapter 19, NAFTA is utterly useless as it would subject Canada and Mexico to the vagaries of the U.S. political system and its courts when determining trade policy actions," said Derek Holt, vice-president at Scotiabank Economics, in a note recently.

"Abandoning Chapter 19 is the Trump administration's way of attempting to gut NAFTA."

Holt adds that Mexico has left it entirely to Canada to stand up for a dispute resolution by agreeing to eliminate it, and only keep some safeguards. Canada has the right to oppose such an agreement, he said.

"Prime Minister Trudeau is right in that no deal — and waiting for more reason in future — is better than permanently signing onto a feature that guts NAFTA," Holt said.

Liberal Leader Brian Gallant doubled down Thursday morning on his insistence that he never offered Progressive Conservative Leader Blaine Higgs a position in the Liberal government in 2014.

Gallant released three pages of handwritten notes he says he took at a meeting with Higgs four years ago that he says was convened to see if the former PC finance minister had any useful ideas to offer the new Liberal government.

But Gallant says there was never any job offer, as Higgs claimed in a dramatic moment during Wednesday night's CBC election debate.

"Very clearly, [there are] no notes whatsoever about his joining the Liberal government in any shape or form," Gallant told journalists on his campaign bus Thursday morning.

In fact, Gallant said, "it seemed like he wanted to explore the idea."

Higgs jolted the televised leaders' debate by pulling from his pocket an affidavit he had sworn saying members of Gallant's campaign team spoke to him after the PC defeat in 2014 about becoming either finance minister in Gallant's cabinet or the deputy minister of finance.

Gallant's Thursday morning scrum with reporters aboard his bus reiterated the written statement he released after the debate.

The Liberal leader did not rule out that someone else raised the idea with Higgs, but said he would have vetoed it.

"If there were other people or officials that would have met with him and gave him that impression, it certainly wasn't with my authorization."

Gallant said he spoke Wednesday night with Len Hoyt, the Fredericton lawyer who headed his transition team, and Hoyt "says he does not recall any of that."

The Liberal leader said Higgs appeared to have considered his 2014 meeting with Gallant as a "job interview."

'Absolutely bizarre'

In a Sept. 24, 2014 interview with CBC News, Higgs declared himself open to co-operating with the victorious Liberals.

"I would share my plan with others because I think we need to do that," he said. "We need to build on what each other learns."

But he also said joining the new Gallant government was "not a consideration at this time."

Gallant said Thursday morning it was "absolutely bizarre" that Higgs made the allegation about the job offer in a signed affidavit notarized by Moncton lawyer Robert Goguen, a former Conservative MP.

"He's basically saying, 'Sometimes I fib, sometimes I mislead you, but now I'm willing to sign an affidavit, signed under oath, so now it must be the truth.'"

The PC campaign released a more detailed timeline of the conversations Higgs says he had with Liberals in 2014.

They began with a lunch with Gallant at the Crowne Plaza, then two meetings with other Liberal officials where Higgs discussed and gave a presentation on his budgeting plans.

Higgs had two more meetings with Hoyt at which he offered Higgs the two positions, the campaign said.

The PC leader said he didn't turn down the offer immediately but finally rejected it sometime in November.

Higgs told reporters Thursday he was fed up with Gallant's attacks on his record. "Enough is enough," he said.

Moncton Centre independent candidate Chris Collins backed Higgs's account on Thursday, saying he recalled seeing Gallant and Higgs having lunch at the Crowne Plaza in Fredericton across from the legislature a month or two after the Liberals were sworn in.

Later that day, Collins said, Liberal political staffers told him what the lunch was about. "They said, 'We're talking to Higgs about coming over.' "

Collins, who was ejected from the Liberal caucus earlier this year over allegations he harassed a legislature employee, said bringing Higgs into the fold would have been a good idea.

"I'm kind of surprised the premier would deny it," he said.

The property tax equals another mortgage, it doesn't matter if the home cost less to buy initially. Food is expensive. We've lost approximately 20 per cent of our forest since the year 2000, twice what neighbouring jurisdictions, Maine, Nova Scotia, Quebec, harvest in their forests. NB has virtually no intact forests left for good water, moose, deer or fish. And the glychosphate spraying is good for no one but Irving.

Gallant - can you believe him? He's the same guy who brazenly says he created 4000 new jobs while Statistics Canada says there are now 1500 more jobs in New Brunswick than when Gallant started. We know Gallant is a straight shooter because he's also counting thousands of temporary jobs now gone... a straight shooter given to making kind of crooked claims. In fact he is so dedicated to unreality he is pledging years of frozen rates for NB Power. So when the great volume of debt instruments of the utility mature and have to be re-issued at higher rates than the bargain basement interest rates of the last decade how can NB Power absorb the greater interest costs imposed by the financial markets? And when inflation causes the need for employee wages to increase either by existing contracts or by the good wage market for highly skilled people VITAL to keep lots of old complex technical equipment going?, The cost of fuel goes up? A need to replace aging equipment in a way the prevents unnecessary cost increases in the future? SOLUTION: Gallant's invisible cost lotion. Well maybe they can cut back on tree trimming costs and just hope NB Power can keep its customers in the dark over the service implications of that. The proper functioning of NB Power is crucial to the province's industrial base and risking major damage to its functioning by forcing dangerous economies and preventing necessary investments for the future is the height of foolishness. Politicians are fools when they think than can just decree a time-out on the reality of economics. Maduro in Venezuela is an extreme case but Gallant has all the right instincts for economic disaster: remember the unreality of his property tax scheme? This guy is addicted to unreality and is really bad news to re-elect.

Gallant issued a statement acknowledging he met with Higgs in the fall of 2014 and decided not to offer him the finance minister job. Nowhere does he deny offering him the civil service post of deputy minister of finance. He is still not denying the civil service post. The biggest misconception is that deputy ministers are part of cabinet/the Liberal government. This is not so.

That is factually incorrect. Staples like eggs, milk, bread, meat and vegetables are VASTLY cheaper in Ontario and Quebec. Houses, perhaps, however rent is almost even to the bigger provinces (not talking about studio appartments in downtown Toronto) because of the fact that New-Brunswick charges a double property tax to landlords, causing the landlords to raise their rents in order to recoup the loss.

As a landlord myself, I can confirm that if it weren't for the astronomical property tax I need to pay on my buildings, I could (and would) be able to offer the units 100-200$ a month cheaper. As a tax that is meant to punish those who own multiple properties, unfortunately it gets deferred to the poorest in the province, those who do not have the means to buy their own property.

It's sickening, but I'm already operating on razor-thin margins and I am not absorbing all of this risk to operate at a loss. The day the NB government rolls back double taxation, all of my tenants will get a reduction in rent.

@Marc Martin We pay the highest taxes in Canada, the lowest median income in Canada and we don't pay less for food. The property tax equals another mortgage, it doesn't matter if the home cost less to buy initially. As for the trees we've lost approximately 20 per cent of our forest cover since the year 2000, twice what neighbouring jurisdictions, Maine, Nova Scotia, Quebec, harvest in their forests. New Brunswick has virtually no intact forests left for water, moose, deer or rabbit.

We can debate on milk and eggs and meat because you can get these the same price at COSTCO in Ontario and in and Quebec and in NB.

Meh, leave you home and travel more, I have 2 brothers in Montreal and all my wife's family live in Ontario a cheap app in Hamilton Ontario with bugs and odors goes for around 1200 a month and that in Hamilton Ont. nothing included.

My brother in law lives in Burlington Ont. rent is 1700 for a 2 bed app.nothing included.

My friend live in Kingston Ont. 1200 no bed 600 SF but cable included.

These rents are no where close to us and we are not even talking downtown Ontario lol.

Houses are around 70 000 to 150 000 higher then they sell here.

@Marc Martin NOPE...I am merely saying English is the majority but the government caters to the vocal minority time and time again. Never said a thing about who got them elected you put words in my mouth. English is the majority, it's high time people respected that.
