Brad Howland, who gave $75,000 to the convoy that paralyzed downtown Ottawa last winter, is named in a motion to designate him as the representative of everyone who gave money to support the protest.
It's part of a broader class-action lawsuit filed on behalf of downtown Ottawa residents, businesses and employees who say the convoy disrupted their lives.
The suit wants the Ontario Superior Court of Justice to add Howland on behalf of a "donor class" of defendants.

The motion says Howland and other donors "knew or ought to have known" that the Freedom Convoy protesters were breaking the law and disrupting the lives of residents and workers in the downtown by blasting their truck horns and spewing diesel fumes.
Those who donated money online did so "with the intention of encouraging and facilitating those acts," lawyer Paul Champ argues in his motion.
The motion will be heard in court in Ottawa Jan. 24-25.
The allegations have not been proven in court, and James Manson, a lawyer for Howland and other potential defendants, argues that the lawsuit and the attempt to add Howland are not backed up by any evidence about specific defendants.
"The plaintiffs have, in fact, improperly sued a crowd of people without identifying who was in the crowd, or which people did what things," his motion says.
Manson argues it's unreasonable to try to sue "thousands of random people around the world who merely donated money to a political cause."
"That would be impossible."
The convoy began parking trucks in downtown Ottawa last Jan. 28, and the protest continued until police broke it up on Feb. 19-20.
Most participants wanted the federal government to end vaccine mandates for truckers, though some also called for the removal of the Trudeau government from power.

He travelled to Ottawa to "participate" in the convoy on Feb. 11-12, according to the motion by the plaintiffs.
Howland confirmed in a statement to CBC News last year that he had been to the protest and called it "a beautiful, legal, peaceful protest that overwhelmed us with emotion."
The business owner said his company relied on truckers, and it was important to support them.
"Our company and my family are proud to stand with these men and women as they uphold the Charter of Rights and Freedoms of our great nation," he said.
Howland's assistant said in an email Thursday he was not available to comment on the court filings.
Champ argues in his motion that financial donations such as Howland's "emboldened and incited" convoy participants as they made "as much noise as possible to cause discomfort and distress" for local residents "in order to coerce political leaders."
But Manson calls the claim "both ridiculous and incapable of proof.
"There is quite simply no way for the plaintiffs to ever demonstrate that all of the people who donated funds to the 'Freedom Convoy' protest 'knew or ought to have known' that those funds" would be used to fund wrongful actions, he argues.
Champ is seeking a total of $290 million in general, special and punitive damages from all of the defendants, which include several high-profile leaders of the movement.
Champ says in his motion that Howland's company, Easy Kleen, has a 7,400-square-metre manufacturing plant and 165 employees. It operates seven offices across Canada and ships equipment worldwide.

Photo by Ashley Fraser /Postmedia The lawyer spearheading a proposed class action lawsuit over the “Freedom Convoy” is looking to add five new defendants to the case, including a former Niagara Region politician who says he was the first protestor to park a rig on Wellington Street last winter.
In a notice of motion filed with the Superior Court of Justice, lawyer Paul Champ said he is asking the court to add trucker Harold Jonker to the lawsuit — which was filed on behalf of residents, businesses and workers it claims were negatively affected by the convoy protest — as a “representative defendant,” meaning someone who could act on behalf of the estimated 400 truckers who parked rigs on downtown streets.
“Jonker clearly understood what they were doing, he fully supported the issue, and he also supported the tactics that we feel were unlawful,” Champ argued in an interview Tuesday.
Champ said he’s collected evidence from social media to show truckers were aware of the harm he claims they were inflicting on the people of Ottawa.
“It wasn’t simply about raising their issues to Parliament,” he said. “Their objective was to make life miserable for the people of downtown Ottawa to apply pressure on the federal government.”
Jonker, 49, did not return emails requesting comment Tuesday.
Jonker was a councillor for West Lincoln Township when he joined the “Freedom Convoy” that descended upon Ottawa last winter. Jonker told reporters he was the first one to park a rig on Wellington Street on Jan. 28.
“My wife and I made history being the first truck in,” he said.
Jonker is part of a family-run trucking business, Jonker Trucking — which Champ is also seeking to add to the suit as a defendant, and has been active in politics both as a local councillor and as a federal candidate for the Christian Heritage Party (CHP). The CHP bills itself as Canada’s only pro-life federal political party.
A father of 13 children, Jonker said he joined the convoy to reclaim the freedom of choice taken from him by government COVID-19 vaccine mandates, mask mandates and lockdowns. He helped organize truckers from Niagara Region who wanted to join the convoy, and his trucking firm had at least 10 rigs parked in Ottawa, according to court documents.
Two weeks into the protest, Jonker insisted it had been unfairly portrayed in the mainstream media.
“It’s been phenomenal, it’s been beautiful,” he told The Niagara Independent. “The more people come up and give hugs to the truckers, give high-fives, tell you you’re doing a great job, it just hardens your resolve. We’re not going anywhere.”
In an interview with Fox News, conducted on the day police began clearing trucks from downtown streets, Jonker said he was shocked at the government’s tactics.
“It saddens us and discourages us that the government is using the police, who have been sworn to protect and serve us, that they’re using them aggressively to suppress something that has been peaceful.”
Two of his firm’s trucks were towed and impounded by police, according to a news report cited in the court filing.
In July, West Lincoln town council reprimanded Jonker for taking part in the protest and fined him 30 days’ pay based on an integrity commissioner’s report. The commissioner said Jonker breached the township’s code of conduct by participating in the protest after it had been deemed illegal.
Jonker has since challenged that decision in court.
In his notice of motion, Champ said he is seeking to add as defendants GiveSendGo, a crowdfunding platform that hosted a fundraiser for the “Freedom Convoy,” and its co-founder, Jacob Wells.
Champ also wants to add Brad Howland, a businessman from New Brunswick, as a representative defendant for other donors to the “Freedom Convoy.” Through his company, Howland donated US$75,000 to the truckers and travelled to Ottawa to see the protest for himself.
“Anyone who donated after February 4 knew or ought to have known they were donating to support illegal activities that were harming the people of downtown Ottawa,” Champ argued.
Class action lawsuits usually pit a large group of plaintiffs against a government or corporation, but Ontario’s Class Proceedings Act also allows the court to impose representative defendants to act for groups of people with common issues.
The rarely used measure is designed to make large class actions lawsuit more efficient.
The “Freedom Convoy” protest was unprecedented in many ways, Champ said, so “it’s not surprising we’re getting into areas of the law that are a little unexplored.”
“There’s no question that the people of downtown Ottawa were terrorized for three weeks,” he argued.
“This protest, we will argue, went far beyond the normal disruption that might be associated with freedom of association and freedom of assembly — the truck horns going all day and night; the trucks idling 24 hours a day; the blocking of streets for weeks on end.”
Protest organizers can't use convoy donations to fund legal defence: court
Two organizers of the “Freedom Convoy” have lost a bid to use money raised during the protest to defend against a class action lawsuit brought on behalf of the citizens of Ottawa.
In a recent ruling, Superior Court Justice Calum MacLeod denied a request made by two defendants for access to $200,000 of the “Freedom Convoy” funds frozen by the court on Feb. 17.
The ruling represents a significant setback for those defending the $306 million class action lawsuit launched on behalf of aggrieved business owners and residents of downtown Ottawa.
The lawsuit, brought by Ottawa lawyer Paul Champ, targets the millions raised to support the protest. Some of the funds were in bank accounts and some in the form of cryptocurrency.
The statement of claim names as defendants convoy organizers Tamara Lich, Benjamin Dichter, Chris Barber, Pat King, James Bauder and a host of others.
The class action has yet to be certified by the court — a necessary step for it to proceed — but if it does go ahead, the lawsuit promises to be complex.
As MacLeod noted in his ruling: “Assuming the action is certified, it will ultimately pit the right of the plaintiffs to seek tort damages against the rights of the defendants to engage in what they assert to have been a lawful and constitutionally protected exercise of freedom of speech and freedom of assembly.”
In affidavits, the defendants have argued they cannot be held legally responsible for the actions of other protesters who may have blasted their horns.
Champ has argued the occupation was illegal, and was planned and conducted in such a way as to intentionally inflict harm on local residents, making organizers legally liable for those damages.
The two defendants seeking access to the escrow funds, Chris Garrah and Benjamin Dichter, told court they’ve been “kicked out” of the Freedom Corporation, a non-profit launched early this year to receive donations in support of the convoy. The corporation’s seven directors are all named as defendants in the class action lawsuit.
Dichter, a truck driver, and Garrah, a general contractor, told court they have modest incomes and cannot afford to retain lawyers to defend themselves in the case.
But MacLeod said neither man presented the kind of detailed financial disclosures necessary for the court to find they’re unable to afford a defence.
To permit easy access to the money held in escrow, the judge said, would be to run the risk of similar, repeated requests by other defendants. “Access to the frozen funds should not be granted lightly,” he said, “because it would effectively subject the frozen funds to the ‘death of a thousand cuts.’”
Still, MacLeod said he remained conscious of the need for fairness since the allegations in the case remain unproven.
“The court must be alert to ensure the litigation is not simply a means to terrorize, persecute or punish the convoy organizers,” MacLeod said. “This motion for release of funds to fund the defence must be taken seriously, but the moving parties must demonstrate that their access to justice is imperilled. This requires more than bald statements that they cannot afford counsel.”
More motions in the case are to be argued in late January. Champ will ask the court to expand the size of the “occupation zone,” making more people eligible to join the class action; he’ll also seek to add new defendants, including the fundraising platform, GiveSendGo.
Jim Karahalios, the lawyer representing Dichter and Garrah, said they were disappointed at the judge’s decision, particularly since the escrow fund had been used previously to pay for $100,000 worth of legal fees in the case.
“It puts anyone who’s a defendant in this class action in a bit of a predicament,” he said. “It’s hard to get counsel to represent you in a complicated class action if you don’t have the means to pay for it.”
Karahalios said his clients are now considering an appeal of the judge’s decision.

GiveSendGo CFO Jacob Wells says he was shocked by misinformation spread by NDP MP Matthew Green.
His comments follow his testimony at the Special Joint Committee on the Declaration of the Emergencies Act earlier this month.
“This is the second time I’ve appeared before a parliamentary committee up there, and the lack of factual accuracy around some of the statements from parliamentary members is just astounding to me,” Wells told The Counter Signal.
“Absolute mischaracterizations or outright lies and mistruths around events and things that happened, so it was very interesting. I tried to keep my composure,” he continued.
During the hearing, Green attempted to discredit the Christian crowdfunding platform by claiming it supported malicious actors. For example, Green said the platform hosted a fundraiser for January 6 protesters who later murdered a police officer.
No police officers died during the January 6 Capitol riot. One police officer, Brian Sicknick, died one to two days later of natural causes, as per an autopsy. Several mainstream media outlets had falsely stated Sicknick was murdered during the Capitol riot.
Green’s statement confused the CFO, who asked the Canadian MP for clarification.
“Was an officer not murdered?” Geen said. “I’m sorry, sir, I’m not from the United States.”
Wells said it was his understanding that no officers were killed.
“Well, perhaps we have better access to your media than you do,” Green replied.
Wells said that he wished he’d corrected Green on the spot.
“What I should have done in hindsight is broke it all down and said, ‘That’s not true and here’s what the truth is. You’re repeating lies again.’”
Green also called Kyle Rittenhouse, a young American man exonerated by courts for killing two Black Lives Matter rioters, a “multiple serial killer.”
Wells said it’s “pretty ridiculous” that a member of parliament can make “such outrageous claims like that and defame somebody.”
“That statement was a complete disrespect to the American judicial system that found Kyle not guilty of being a serial killer — that found him innocent,” he added.

OTTAWA - An investigation has found that most of the $25 million raised by the "Freedom Convoy" was either returned to donors or ended up in an escrow account awaiting the results of a civil lawsuit.
The Public Order Emergency Commission, the public inquiry tasked with looking into the federal government's use of the Emergencies Act during the protests, investigated what happened to donations made through e-transfers, cryptocurrency and fundraising platforms such as GiveSendGo and GoFundMe.
A report released by the commission Thursday shows that only about $1 million was actually spent by the convoy's various organizers.
One of the convoy's leaders told the commission in an interview that they distributed $20,000 in donations to truckers each day of the protest, often by handing out envelopes of $2,000 in cash.
Approximately $18 million was refunded to donors, while the rest was confiscated and put into a third-party fund pending civil court cases.
The $6.2 million that is now in escrow mostly came from online fundraisers by Tamara Lich, one of the protest's main organizers, and cryptocurrency captured by authorities.
Crowdfunding efforts led by Lich raised nearly $10.1 million from more than 120,000 donors before donations were suspended by GoFundMe and returned.
GoFundMe raised concerns about the fundraiser almost immediately because money was coming in so fast. The company was particularly concerned about whether the organizers could abide by its terms, which stipulated that funds needed to be distributed quickly according to the description provided to donors.
Later, the company communicated with Ottawa's mayor and then-deputy police chief, and both contested the legality of the protest.
"All refunds were initiated via our payment processing partner, including all transaction processing fees and tips, and those funds were returned to donors in the subsequent days," GoFundMe said in a written statement in early February.
More than $12 million was raised for the protesters via fundraisers on the platform GiveSendGo. However, its co-founder and chief financial officer, Jacob Wells, said during a March 9 court appearance that those donations would also be returned. The commission’s report says the majority of donations were indeed refunded.
About $800,000 worth of bitcoins were distributed to protesters. About half of what was raised was moved into escrow between March 7 and 22, but authorities have not been able to recover the rest.
Lich also solicited donations by e-transfer. She told the commission Thursday that most of the money that was spent was used to purchase fuel.
A summary of an interview with "Freedom Convoy" treasurer Chad Eros, which was submitted into evidence at the commission, says the idea to create a non-profit organization to accept donations came from former Conservative Party of Canada MP Russell Hiebert.
Eros helped create the "Freedom 2022 Human Rights and Freedoms" group to collect payments so that donations would no longer land in Lich’s personal bank account. He also worked with Wells to establish the fundraiser on GiveSendGo.
Because convoy organizers were having difficulty setting up their own accounts to collect donations, Wells then agreed to use his own payment processing services, promising to transfer the funds back to organizers, he said in court.
Keith Wilson, a lawyer working with the Justice Centre for Constitutional Freedoms who was supporting the organizers, agreed to use his own trust account to collect payments in Canada, the commission's report says.
But a payment processor prevented money from being transferred into Wilson’s trust account, and ultimately a civil injunction stopped the funds from moving altogether.
The commission also investigated whether any of the money came from foreign sources.
It found that 86 per cent of the donations to the main GoFundMe campaign originated in Canada, and 11 per cent came from the United States.
Of the nearly US$10 million raised through the main GiveSendGo campaign, 47 per cent originated in Canada and 47 per cent in the United States.
According to information provided by GiveSendGo, the "Freedom Convoy 2022" campaign had 113,152 donors.
More than half of donations to that campaign — 59 per cent — were from the United States, and about 35 per cent were from Canada.
More than 6,300 donations, making up more than half a million dollars, came from other countries.

A Calgary Police Service spokesperson said it assisted in Carpay's arrest but deferred other questions to Winnipeg police. Carpay's decision to hire a private investigator to follow Joyal, chief justice of what was then Manitoba's Court of Queen's Bench, came to light in July 2021 during a hearing for a case against pandemic rules brought forward by seven rural Manitoba churches who were represented by Carpay's organization.
Joyal told the hearing he had been tailed by a private investigator in an attempt to catch him breaking COVID-19 rules in order to embarrass him while he presided over the court challenge. At the time, Carpay's organization also apologized to Joyal and said it condemned the lawyer's actions. Joyal said the surveillance would not influence his decision in the case — in which he later ruled Manitoba's pandemic restrictions were not a violation of charter rights — but noted the intrusion of privacy raised serious concerns about the safety of judges generally. Joyal also said that this type of activity could be seen as obstruction of justice and that Winnipeg police were investigating. In its statement on Sunday, the Justice Centre for Constitutional Freedoms called the charge against the lawyer "unexpected and without explanation." It also said it was "deeply disappointed" in the decision to charge Carpay over a year after the events in question, which the organization said "are already being dealt with appropriately." After Carpay apologized for hiring the private investigators — which he said was to hold government officials accountable, not to influence the decision in the Manitoba case — the board of his organization said he would take an indefinite leave as its president. The organization said on Sunday that leave of absence lasted seven weeks, during which time its board "took appropriate steps to strengthen governance and oversight." It also said Carpay co-operated with an investigation conducted by the Law Society of Manitoba, which is separate from the police matter. Professional misconduct chargesA spokesperson for the Law Society of Manitoba said its investigation is complete and charges of professional misconduct have been authorized against Carpay. The Law Society of Manitoba's website says the three-day hearing for Carpay's case is scheduled to begin Feb. 8. Carpay is accused of breach of integrity, undermining public respect for the administration of justice and failing to treat court with candour, fairness, courtesy and respect, the website says. A lawyer found guilty of professional misconduct can face consequences including being fined, suspended or disbarred, Manitoba's Legal Profession Act says. In a statement, a spokesperson for Manitoba Courts characterized the allegation as an "unprecedented surveillance of a sitting judge of this court." But neither the court nor the chief justice would comment further, the statement added. Ottawa human rights lawyer Richard Warman, who filed complaints with the law societies of Manitoba and Alberta, said he, too, thinks the case is unprecedented in terms of professional misconduct by a lawyer. "I'm unable to remember any lawyer going so far off the rails as to hire a private investigator to stalk the chief justice who's presiding over a case that they're appearing in," he said on Monday. "I have no doubt that it will be studied for years to come as a prime example of professional misconduct. And when you have extreme conduct, it calls for extreme sanction." Warman said he's relieved to hear Carpay would also be charged criminally, but wondered why it took so long — especially since the case involved an admission of guilt in open court. Given that factor, he said it comes off as "naive in the extreme" that Carpay's organization says the charge against the lawyer was unexpected. Other supporters, meanwhile, contradicted Bauder's assertions. Another organizer who announced the convoy 2.0 plan for Winnipeg alongside Bauder claimed the event will move ahead. "Multiple people and groups are involved. The world unity convoy 2023 is not cancelled," Ron Clark wrote in an email to CBC. Likewise, Tyson Billings — also known as "Freedom George" — said he still plans to attend a convoy gathering in Winnipeg next month. "I don't know if there's something still going to Ottawa or not," he said. "But the main convoy — the World Unity Convoy — is about unity and it's about bringing the people together." Fractures emerge in movementThe mixed messaging comes as the Freedom Convoy movement, which began as protests against COVID-19 vaccination passports, masks and other health mandates, appears to be losing steam. Infighting between members has led to a fracturing of the movement, resulting in disagreements over details ranging from the name of the event to its main goals. Bauder is among the dozens of protesters and supporters facing charges for their involvement in the original convoy protest.
