Miramichi Lake cottage owners say they've been left in the dark about pesticide spraying plans
Working group has permit to spray lake to eradicate invasive smallmouth bass
Austin Greenlaw, who has lived on the lake for 30 years, is one of four locals who say they've been against the spraying of pesticide — which they refer to as "poison" — since it started last fall.
There are about 15 cottages around the lake, which covers two square kilometres and is located about 60 kilometres north of Fredericton.
"Nobody's heard a thing," said Greenlaw, calling it a "complete blackout" of information from the organization in charge, the Working Group on Smallmouth Bass Eradication in the Miramichi.
The group, which is made up of six different organizations, has been trying for the past three years to use the pesticide rotenone to kill invasive smallmouth bass before it takes over the habitat of salmon, trout and other species in the lake, and spreads to the Miramichi River.
A spokesperson for the Department of Fisheries and Oceans confirmed the working group's permit for this project is valid until Dec. 31, 2026.
Neville Crabbe, the working group's spokesperson, told CBC News last week there isn't a plan to continue spraying, but the group was "in discussions" about the next step.
When asked if lake residents were well-informed about the spraying, Crabbe said yes. But a group of four cottagers said they feel differently.
Scott Bell, a cottage owner who has lived on the lake his whole life, said when the project first was slated to go ahead in 2021, the working group was in communications with residents for the first year.
"Then they pretty much cut off communications and became very closed-mouth, secretive," Bell said. "We've lost a lot of trust in Neville Crabbe."

Crabbe did not return a request for an interview about the cottager's concerns, but had told CBC News in an email last week that the working group would not be making any more public comments until there was clear direction on the project.
Greenlaw said this summer has been stressful, wondering when and if the spraying will continue.
"It's not the same out here," Greenlaw said, "Knowing that the hammer might be dropping."
Bell has similar sentiments.
"I wake up in the middle of the night, thinking about it," he said. "It's always on your mind."
Call for 'sober second thought'
Greenlaw said he wants to know how many bass, the intended target, were killed in the first round of spraying last September, and how many other species, including salmon, were also killed.
The working group sprayed rotenone on nearby waters, but still hasn't sprayed the lake itself to complete the process.
Greenlaw said the residents aren't anti-salmon, but they'd rather see other prevention measures like containment barriers, netting and electrofishing instead of spraying.
"It's really like brain surgery with an axe to come in here and poison the lake," said Greenlaw.

The cottagers say they are advocating for a "sober second thought," and that the project should be halted.
Greenlaw said he wants the working group's plan to be studied more, adding that property values around the lake will be "decimated."
But, he said, he feels that the group has invested too much to simply walk away.
"I think we all feel that this is going to continue until at some point no permits are signed and the thing just has to be put to bed."

which no one will be responsible for? You might feel differently if I
was given the OK to spraying your surroundings without your consent. You
might want to know about it so you could not be there or sell your
property to some unsuspecting person. When no one has to say a word
people wake up surprised one day.

You’re right they don’t own the lake, but many
have grown up there as I am one of the 5th generations in my family to
be at this lake. The poison could also have the same impact on us
children, adults and our pets as it would on the other wildlife. It's
unknown of how long the poison will roam in the waters, therefore
causing a great negative impact on our lake.

Delegates from six countries and the European Union will gather in
Moncton this week for the annual meeting of the North Atlantic Salmon
Conservation Organization (NASCO), an intergovernmental treaty body. ASF
is calling on Canada, as host, to show leadership at the forum and
follow-through on its commitments to Canadians and the international
community on Atlantic salmon.
NASCO member countries, including Canada and the United States, have resolved to protect and restore Atlantic salmon habitat, reduce or eliminate harms from open net pen salmon aquaculture, and manage fisheries sustainably.

Countries are required to submit plans to NASCO that describe the actions they will take, and annual progress reports. Despite five years of effort, Canada, along with some other countries, has been unable to produce a satisfactory plan.
“Particularly when it comes to the negative effects of open net pen salmon aquaculture, Canada has not put forth any acceptable actions to eliminate escapes and minimize the damage to wild salmon from sea lice,” said Bill Taylor, president of ASF. “The federal government can and must do more, and the meetings in Moncton are an opportunity to show the salmon world that Canada takes Atlantic salmon conservation seriously and will honour its commitments.”
In 2021, NASCO member countries participated in a special session on salmon aquaculture. It concluded that evidence of negative impacts from the industry are overwhelming and irrefutable, and action is needed, not more study.
The Moncton meeting comes amid some positive news for wild Atlantic salmon. Recently released data from the International Council for the Exploration of the Sea, which provides scientific advice and analysis to NASCO, shows more large salmon returned to most North American regions in 2022. The data is summarized in ASF’s latest State of Wild Atlantic Salmon report. Click here to view the report.

Second court challenge in the works against plan to kill fish in Miramichi Lake
Terry Sappier says application for judicial review filed against Fisheries and Oceans Canada
A second court challenge is in the works to stop a planned kill-off of fish in Miramichi Lake, according to a Wolastoqey woman.
Terry Sappier describes herself as a water defender and is one of several members of a group known as the Wolastoqey mothers and grandmothers, which has taken a stance against a plan to release a chemical known as Noxfish II in the lake located near Napadogan.
The chemical is made up petroleum distillates as well as rotenone, which is used as a pesticide.
She said her group applied Wednesday in federal court for a judicial review of a Fisheries and Oceans Canada decision to approve the plan, which is being pursued by a group of non-governmental and First Nations organizations in a bid to kill off the invasive smallmouth bass.

The group, known as the Working Group on Smallmouth Bass Eradication in the Miramichi, says the chemical is the only option left to stop the smallmouth bass from getting into the rest of the Miramichi River watershed and threatening native species such as brook trout and Atlantic salmon, which are prized among anglers.
However, Sappier said Fisheries and Oceans Canada didn't properly consult Indigenous stakeholders before signing off on using the chemical, which would kill all gilled fish in the area where it's applied.
"The federal government of Canada, particularly DFO, the Department of Fisheries and Oceans, has an obligation to consult with the Wolastoqey people on activities or projects that are going to be done on our territory," Sappier said, by phone on Thursday morning.
"And for some reason, DFO doesn't feel like they have to talk to us about it, and that is against reconciliation."

Not all First Nations groups are against the project, however, including Natoaganeg First Nation Chief George Ginnish, who said he wanted to see the work go ahead earlier this month.
CBC News has asked Fisheries and Oceans Canada about its efforts to consult Indigenous peoples on the project and is awaiting a response.
Project blocked by earlier injunction
The Working Group on Smallmouth Bass Eradication in the Miramichi was set to come together last week, along with other partners and volunteers to release the chemical.
But last Tuesday a New Brunswick Court of Queen's Bench judge granted an emergency injunction barring the Working Group from carrying out the project until a lawsuit brought by cottage owners on Miramichi Lake could be heard in court.

That injunction expired on Wednesday afternoon, and the cottage owners' lawsuit was withdrawn, according to Neville Crabbe, a spokesperson for the Working Group.
Sappier said further to the judicial review application filed on Wednesday, her group also plans to seek its own injunction to stop the Working Group from carrying out the project until arguments on their application are heard in court.
Sappier said the request for an injunction would be filed either Thursday or Friday.
CBC News was unable to obtain a copy of the application for a judicial review on Thursday.
In an interview on Wednesday, Crabbe said even if there's no injunction in place at the moment, the large scale of the operation means it can't be implemented on quick notice.

He said the Working Group has approval until Sept. 30 to carry out the release of rotenone, and that the plan is to get it done sometime before then.
Asked about the possibility of the injunction getting denied, Sappier said she'd physically block the project from being carried out.
"I will sit on the water," she said. "That's what I'm going to do. I'm going to sit on that water until they can't do it no more."
The project had to be called off last August after the Wolastoqey mothers and grandmothers canoed onto the lake and refused to leave.

Statement from the Working Group on Smallmouth Bass Eradication in the Miramichi
September 12, 2022
On September 8th, crews completed Phase 1 of the conservation project to remove illegally
introduced, invasive smallmouth bass from the Miramichi watershed. A rotenone product was
applied to Lake Brook and approximately 15 kilometers of the Southwest Miramichi River.
The application took 6-hours and rotenone was deactivated at the downstream extent of the
project area. By late evening on September 10th, testing at our deactivation site indicated that
the rotenone had been completely flushed from the project area and was successfully
deactivated. This ensured that the effects of the project were limited to the treatment area.
Treating Lake Brook and the short stretch of the river where smallmouth bass are known to be
present is a step forward in the effort to eradicate this invasive fish from the Miramichi
watershed. However, the established population of smallmouth bass in Miramichi Lake, which
was the source of smallmouth bass found in the brook and river, continues to threaten the
ecosystem and native species of the Miramichi watershed.
Phase 2 of the project calls for a simultaneous treatment of Miramichi Lake, Lake Brook, and
the 15-km stretch of the Southwest Miramichi River.

The Atlantic Salmon Federation (ASF) had plans to kill an invasive fish at Miramichi Lake after being accused of diminishing the native salmon population, but an agreement reached this week has stalled those plans for the rest of the year.
For 14 years, Miramichi Lake has struggled with smallmouth bass as an invasive species affecting the salmon population. The ASF poured rotenone, a widely-used chemical insecticide and piscicide.
However, the Wolastoqey Nation of New Brunswick questioned the solution, accusing the ASF of killing other species, including salmon fry and parr.
Andrea Polchies, a band counsellor with Woodstock First Nation, filed a preliminary motion, requesting the suspension of activities at Miramichi Lake, which was discussed and approved in a court case on Sept. 20.
“I’m happy that I get to come home and I stopped what they call phase two [of the plan to kill off the invasive species,]” she said. “But I’m very disappointed that I couldn’t stop what they did poison.”
Polchies said the ASF didn’t consult properly with Wolastoqey people. When she heard the ASF released the chemicals on the lake without consultation, she set up camp nearby to check on the waters 24/7.
With the court case, she hopes she doesn’t have to return to patrol the lake.
“I’m an old woman, man!” she said. “I’m just trying to do what we people should be doing and that’s protecting our land and our waters.”
Dennis Paul, the program coordinator at St. Mary’s Fisheries and part of the Wolastoqey Nation, said he went to the camps a few times to bring people food and water. During one of those trips, he used his kayak to go into the brook, where he saw dead fish.
“As soon as I started paddling into that brook, I see nothing but every other kind of species besides the smallmouth bass,” he said. “There was every kind of other species — from salmon parr to fall fish, the perch to the suckerfish — all dead.”

Paul posted pictures of what he saw on Facebook to inform people about what was going on at Miramichi Lake. He tried contacting the ASF, but he received no answer. He said as an Indigenous person who practices his treaty right to fish, these actions are “breaking any kind of bonds” between the Wolastoqey and some companies.
“I feel like they think they’re above the law and I don’t think it’s right at all and pretty much my whole community agrees,” said Paul.
Tracy Glynn, an environment and society professor at St. Thomas University, said a group of organizations — including the ASF — attempted to eradicate the fish before, but a court ruled against them, saying they didn’t consult Indigenous Peoples.
Glynn said from an environmental justice perspective, the group should listen to the perspectives of Indigenous Peoples who live on the land and fish at the lake.
“It all comes back to the fact that these proposals need to be deliberated in a public forum,” she said. “We, as a society, should be discussing when organizations use the courts to put down Indigenous grandmothers.”
Polchies wants the ASF to stop further attempts to continue with the plan and instead work and consult the local Indigenous community.
“Leave the fucking salmon alone,” she said.
The Aquinian contacted Neville Crabbe, director of communications at the Atlantic Salmon Federation, on multiple occasions for comment but did not provide an interview.

Terry Ann Sappier, a Wolastoqi land defender, presented at St. Thomas University’s Environmental Praxis Class on Feb. 28 about her efforts to protect the Miramichi Lake for the last two summers.
In a commentary she wrote for the NB Media Co-Op in July 2022 titled “We are here for the heart of our land,” she emphasized the need to protect the lake.
“My children deserve to have their inheritance. My grandchildren deserve that as well and the next seven generations,” she said in the presentation at STU.
“If we don’t start looking after ourselves in this land, we’re all going to be in pretty bad shape.”
Miramichi Lake has been plagued with smallmouth bass, an invasive species that threatens the salmon population, since 2008. A consortium, which included the Atlantic Salmon Federation (ASF), the Miramichi Salmon Conservation Centre, the New Brunswick Salmon Council, Anqotum Resource Management, the Miramichi Water Management Committee, the NB Wildlife Management Committee and the Northshore Micmac District Council, proposed eliminating the fish with Noxfish Fish Toxicant II, which contains rotenone.
“They could not put the poison in the water if we were in, so we jumped on canoes and kayaks and went out on the water,” said Sappier.
According to Sappier, the six chiefs of the Wolastoqey Nation of New Brunswick were not consulted when the ASF planned the extermination. In late July 2022, she said the community only found out two days before the spraying.
Sappier said the documentation showed that communities were not consulted, instead collaborating with two corporate entities.
The Wolastoqey mothers and grandmothers, a group of which Sappier is a member, were able to reach an agreement through a court case to suspend the project in September 2022. Still, by then, the ASF had already started phase one of the project.

Still, Sappier is frustrated that the group had to go out and protect the lake in the first place.
“We’re not doing it because we enjoy it. Trust me, we would rather be with our kids doing other things,” she said.
Sappier said the issue of the invasive species is still present, but her community has come up with a solution that does not endanger the wildlife of the lake and its surroundings. The solution would involve people snorkelling in the water to destroy smallmouth bass nests.
She said it would maintain the lake’s integrity.
“We offered that plan to [the consortium] and they rejected it because of the cost,” she said.
“It’s all about economics. To eradicate is more cost-effective than to do it in a more gentle and responsible way.”
She said the provincial government is not doing a good job on the reconciliation of Indigenous people in regard to their land and remains unsure about the future of Miramichi Lake.
“It’s our heart and we need to protect it because it keeps us alive,” said Sappier.
