Alberta premier backs off on promise to seek pardons for COVID-19 health violators

NDP calls for independent investigation into interactions with Crown prosecutors

"The way our system of justice works is we do have an independent justice department and independent Crown prosecutors," Smith told reporters Thursday when asked why she has not followed through on the pardon commitment.

"As we continue to see some of these cases go through — some of them get dropped, some of them fail — (prosecutors) have to consistently recalibrate, but I do want to make sure they have an independent process for assessing that.

"But I ask them on a regular basis, as new cases come out, is it in the public interest to pursue and is there a reasonable likelihood of conviction?"

The Justice Department later issued a statement that appeared to contradict Smith.

"The premier had met to discuss prosecutions at a high level with the attorney general and deputy attorney general," said department spokesman Jason Maloney.

"The premier has never spoken with any Crown prosecutors about any particular court/legal matter they deal with."

Smith's office did not respond to a request for clarification, but she did make similar remarks last month. 

In an interview with Rebel News about COVID-related charges, Smith says the attorney general and the Crown have an independence from the premier's office, but that she continues to ask questions about whether the prosecutions are in the public interest and whether there's a reasonable likelihood of conviction.

"I put it to the prosecutors and I've asked them to do a review of the cases with those two things in mind," she said in the interview posted on the Rebel News website on Dec. 23. 

Opposition NDP justice critic Irfan Sabir labelled Smith's comments Thursday a clear case of judicial interference and called for an independent investigation.

"Danielle Smith is reaching into the Crown prosecution branch and inquiring about a specific case and questioning whether charges are in the public interest, and that certainly constitutes interference," Sabir said.

Smith became premier in October after winning the leadership of the United Conservative Party by leveraging strong member support with promises to redress perceived abuses of individual rights and freedoms during the COVID-19 pandemic.

Soon after being sworn into office, Smith announced she would pursue pardoning non-criminal violators of health restrictions, such as pastors who ignored gathering limits at services and people fined for not wearing masks.

Smith has called the COVID-19 unvaccinated the most discriminated group she has ever seen in her lifetime.

Artur Pawlowski, a Calgary pastor jailed and fined for COVID-19 masking and gathering violations — charges later overturned on appeal — criticized Smith's remarks.

"My friends were voting for her (in the leadership race) because they wanted this prosecution and persecution of Canadians to stop in our province," Pawlowski said in an interview.

"She promised that amnesty would come. That never happened."

Pawlowski still faces charges related to last year's blockade in Coutts, Alta., near the United States border.

He called Smith "Kenney 2.0," referencing to her predecessor, Jason Kenney.

"She is a flip-flopping, political pancake," Pawlowski said. "Whatever works for her, that's what she's going to pursue."

Kenney was effectively voted out of office last year by a branch of the UCP angry over what they called freedom-busting COVID-19 gathering, vaccine and masking rules.

Smith also won the leadership on a promise to change laws to forbid restrictions for people based on their COVID-19 vaccine status. She never introduced the bill as promised last fall, saying more study was needed.

Political scientist Duane Bratt said the confusion leaves Albertans with two unpalatable options.

"Which is worse, political interference in the judicial system or lying about interfering in the judicial system?" said Bratt, with Mount Royal University in Calgary.

Bratt said the comments appear to be a political calculation by Smith to try to appeal to the broad electorate by adhering to the rule of law on COVID-19 cases while simultaneously saying she is taking direct action — rubbing against democratic guardrails in the process — to appease her base.

"That's what happens when you try to appease two different groups. You end up appeasing none of them," said Bratt.

Sabir said there is recent precedent under the UCP for an investigation.

Last February, a third-party report by a retired judge concluded that then-UCP justice minister Kaycee Madu tried to interfere in the administration of justice when he called up Edmonton's police chief to discuss a traffic ticket.

Madu was subsequently moved to a different portfolio under Kenney. He has since been promoted to deputy premier under Smith.

Alberta Crown prosecution felt political pressure about Coutts cases: sources

Premier Smith hasn't contacted Crown prosecutors and has no knowledge of staff doing so, her office says

Editor's note (July 5, 2023): An earlier version of this story, published on Jan. 19, 2023, referred to emails allegedly sent by a staffer in Danielle Smith's office to the Alberta Crown Prosecution Service. Based on testimonies by confidential sources, CBC News at the time described those emails as "challenging prosecutors' assessment and direction on cases stemming from the Coutts border blockades and protests." An editor's note was added the following day to specify that CBC News had not seen the emails.

On May 18, 2023, Alberta's Ethics Commissioner Marguerite Trussler released a report that included an investigation of an "allegation published by CBC that a member of the premier's staff emailed a Crown prosecutor about a case before the courts." Trussler reported that she found "no evidence of such an email," adding she can only come to the conclusion, based on the evidence that she has, that "no Crown prosecutor was emailed directly about any of the cases." At the same time, Trussler found that Danielle Smith had contravened the Conflicts of Interest Act in an interaction with the Minister of Justice and Attorney General in relation to Coutts charges, for which Smith has since apologized.

After the Ethics Commissioner's report was released, CBC News reviewed its journalism and re-interviewed a number of sources and parties to the matter. Confronted with the Commissioner's report, our sources have insisted that Crown prosecutors felt political pressure regarding the Coutts cases, but they are not able to confirm that the emails they originally described were sent directly from the premier's office to the Crown. As such, we have updated this story and related pieces, removing references to direct contact between the premier's office and prosecutors – which the premier has vehemently denied. CBC News regrets reporting direct contact by email.


Alberta Crown Prosecutors felt political pressure around their assessment and direction on cases stemming from the Coutts border blockades and protests, sources say. This comes in the wake of concerns about Premier Danielle Smith's campaign pledges to pardon or pursue amnesty for COVID-19 protesters, remarks on which she later backtracked. Some prosecutors worried about "interference" from Smith. However, there is no evidence of direct contact between the premier's office and prosecutors.

Sources told CBC News about emails from Smith's office regarding Coutts cases, but CBC News was not able to substantiate their content or confirm their existence.

In a statement provided to CBC Thursday evening, the premier's office said Smith has not been in contact with Crown prosecutors and has no knowledge of anyone on her staff doing so.

"This is a serious allegation," reads the statement. "If a staff member has been in touch with a Crown Prosecutor, appropriate action will be taken."

Last winter, more than a dozen people were charged following a blockade at the Canada-U.S. border in protest of COVID-related restrictions and vaccine mandates. Four sets of cases — ranging from weapons and mischief charges to conspiracy to commit murder offences — are currently making their way through the courts in Lethbridge.

Crown's office won't comment on potential emails

CBC News asked Kim Goddard, the assistant deputy minister of the justice department, about alleged email correspondence. Alberta Crown Prosecution Service spokesperson Michelle Davio would not provide a "yes" or "no" answer when asked repeatedly if the assistant deputy minister (ADM) had viewed potential emails. 

The same question was asked of prosecutor Steven Johnston, the deputy chief of specialized prosecutions and the Crown assigned to all Coutts-related cases.

Davio wrote in an email that Goddard did "not recall" viewing emails but said "it is difficult to say with 100 per cent confidence that neither Kim [Goddard] nor Steve [Johnston] have seen the emails that you have described but not provided." 

"As the Alberta Crown Prosecution Service (ACPS) has not been provided with the emails, we are unable to provide a comment," wrote Davio.

Report any communication from political staff: internal email to prosecutors 

CBC News has obtained a copy of an internal email sent last Friday by Goddard to Alberta prosecutors after Smith made comments about being in contact with prosecutors, which her office later clarified as the premier using "imprecise" language. Smith added she'd only spoken with the attorney general and his deputy.

In the email, Goddard reassured prosecutors that she is committed to following the ACPS's code of conduct, which dictates that prosecutorial discretion must be free from improper pressures or influences.

"In the rare occasions that information about a particular prosecution has been requested, the proper processes have been followed," said Goddard.

The ADM went on to say she will only provide information to the attorney general or deputy attorney general.

"I will not brief other elected officials or any political staffers on details involving individual cases," wrote Goddard.

"If you are ever approached by any elected official or political staffer to discuss one of your cases it is imperative that you report such communication to your chief prosecutor or myself immediately."

Tensions and public interest

There has been tension between the ministry of justice and the premier's office when it comes to cases before the courts, multiple sources familiar with the matter told CBC News.

They explained Justice Minister Tyler Shandro and his staff were not involved in alleged emails sent to ACPS lawyers — and the ministry has been trying to reinforce the independence of prosecutorial decisions for months.

Last Friday, Smith said definitively that she had not been in contact with Crown prosecutors. That followed two previous occasions where the premier stated she'd requested a review of the COVID-related cases and asked prosecutors whether it was worth pursuing certain cases.

In a December interview with Rebel News, Smith had questioned whether the cases are in the public interest to pursue and if there is a reasonable likelihood of conviction.

"I've put it to the prosecutors, and I've asked them to do a review of the cases with those two things in mind. And I'm hopeful that we'll see a true turning of the page," she said.

"And so do you continue on in prosecuting one when the public has moved on? That's the big question that the Crown has got to to come to terms with."

Dear Mr. Amos,

Thank you for your follow up e-mail to me today. I was on days off
over the holidays and returned to work this evening. Rest assured I
was not ignoring or procrastinating to respond to your concerns.

As your attachment sent today refers from Premier Graham, our position
is clear on your dead calf issue: Our forensic labs do not process
testing on animals in cases such as yours, they are referred to the
Atlantic Veterinary College in Charlottetown who can provide these
services. If you do not choose to utilize their expertise in this
instance, then that is your decision and nothing more can be done.

As for your other concerns regarding the US Government, false
imprisonment and Federal Court Dates in the US, etc... it is clear
that Federal authorities are aware of your concerns both in Canada and
the US. These issues do not fall into the purvue of Detachment
policing in Petitcodiac, NB.

It was indeed an interesting and informative conversation we had on
December 23rd, and I wish you well in all of your future endeavors.

I host Montana's leading statewide radio talk show "Montana Talks."
Aside from serving in Iraq and Afghanistan with the military, I also
spent over two decades working in Montana politics and broadcasting.
This included a stint as the State Director for Ryan Zinke’s
Congressional offices in Montana, and as communications director for
the gubernatorial campaign of now-Congressman Greg Gianforte. Prior to
that, I grew a statewide radio show in Montana from 10 signals to more
than 20 across the state. My work has been featured nationally by Fox
Business, The Drudge Report, Huffington Post, Politico, and others. As
an officer in the Army National Guard, I served four military tours
overseas including time in Iraq, Afghanistan, the Horn of Africa, and
the Arabian Peninsula. I enjoy combining my real-world background and
Montana roots, to hopefully give listeners a side of the story they
don't get to hear anywhere else.

I'm wondering why anyone would be against a whistleblower telling
everyone about a corrupt Workmen's Comp fund every Canadian pays into

Local author Gertjan Zwiggelaar is a couple steps closer to his goal
of writing a book in every genre.

Local author Gertjan Zwiggelaar is a couple steps closer to his goal
of writing a book in every genre.

With his Journey to the Underside, published in 2012, and his Marty &
Me, Another Pirate’s Tale, published in 2013, Zwiggelaar has
respectively covered the adventure and horror/pirate categories. His
previous books, A Pirate’s Tale and Into the Game, fall into the
swashbuckling and science-fiction genres.

The Red Deer author has also written poetry, historic fiction,
non-fiction, short stories and children’s literature over the years.

While he hasn’t full tackled romance yet, Zwiggelaar feels there are
enough romantic elements in most of his books to make them also
popular with female readers.

The former Lindsay Thurber Comprehensive High School art and drama
teacher has never believed in limiting his scope of his interests to
just art or just writing.

He paints in a wide variety of styles, from abstracts to landscapes to
fantasy images, and has also been writing stories since childhood.

When Zwiggelaar began creating plays for high school students to
perform, he said one of them won a literary award from the Edmonton
Journal in the 1980s and this gave him encouragement.

He began his first big project, The Incredible Adventures of Princess
Kiera and her Friends, as possible successor to the Harry Potter
books. The 240,000-word tome is still being reworked by Zwiggelaar,
who would someday like to publish it.

In 2008, he discovered publisher-on-demand America Star Books, which
accepted his A Pirate’s Tale and the following three books for
publication.

The company doesn’t require authors to pre-order copies of their books
— Zwiggelaar said if the publisher thinks a book will sell, it prints
off some copies and makes them available on Amazon.com and various
other booksellers. Authors get a small royalty for each copy sold.

Zwiggelaar’s most literary output is a sci-fi adventure in the Jules
Verne vein, A Journey to the Underside, as well as Marty & Me, the
second book in a planned pirate’s trilogy. Zwiggelaar intends to put
out the final pirate book, Hanzel Sventska, a Faustian tale of someone
who sells his soul, by this summer.

He believes readers enjoy his plots because the action moves along,
without getting bogged down by small or unnecessary details. “They’re
page turners.”

Ryan Langlois’ lawyer is trying to get the ‘civil disobediance case’
thrown out of court

The lawyer for a Red Deer restaurant owner accused of defying public
health orders is attempting to have the court case thrown out on a
technicality.

Yoav Niv, who’s representing Mom’s Diner owner Wesley Langlois, plans
to make a submission to the judge asserting the Crown did not apply to
have Langlois’ statements declared admissible in court.

This goes against proof of identity and raises questions about whether
Langlois was the person who was ticketed, said Niv.

On Wednesday, three witnesses — a public health inspector and two
community peace officers — took the stand and identified Langlois as
the restaurant owner, who was twice ticketed in January for allowing
eat-in dining in contradiction of public health orders.

But “dock identification is not enough,” Niv maintained during
Langlois’ trial in Red Deer provincial court.

Crown prosecutor Martha O’Connor called this an “artificial argument.”

Provincial court Judge Jim Glass suggested the lawyer and the Crown
each make their own written submissions and he will consider both
sides before ruling on the matter.

Glass’s decision is expected in the latter part of July, although a
date has not yet been confirmed.

If Langlois’ trial continues, the restaurant owner is expected to take
the stand next month.

On Wednesday, the Crown called three witnesses who all testified to
seeing people eating and drinking within Mom’s Diner on Jan. 27, 28
and 30 — despite a provincial health order calling for take-out only
restaurant service during this period to reduce the spread of
COVID-19.

After several complaints about the West Park restaurant defying health
orders, health inspector Quentin Schatz said he went to investigate on
Jan. 27 and found at least 20 people consuming food inside what
appeared to be a “full” diner.

Despite speaking to Langlois about the pubic health order and taping a
closure notice on the diner’s door, Schatz testified that he returned
the next day to again find people eating inside the small restaurant.

Schatz told the court he then posted a formal closure order and
presented a copy to Langlois. Two peace officers later came by to give
the restaurant owner a $1,200 ticket for failing to comply with public
health orders.

The Crown’s next witness, Red Deer community peace officer Kenneth
Chiasson, testified that he told Langlois that he could ticket
everybody eating in his diner for defying health orders, but would
only fine him.

The aim wasn’t to be heavy-handed, said Chiasson, but to stop risky
behaviour: “I didn’t want to disrupt everything, so I started at the
top…. I figured they can’t dine if he isn’t open.”

Peace officer Benjamin Gray testified that he went to check on
activity at Mom’s Diner on Jan. 30 and saw a closed sign and the
health order still posted. But when Gray peered into the window, he
saw at least 12 people eating and drinking inside.

Gray told the court that Langlois told him he wasn’t officially open,
but was serving people who had just been at an anti-restrictions rally
earlier that day.

Gray issued Langlois another violation ticket.

In cross-examination by Niv, Gray was asked whether the diners could
have been ordering food for take-out. Gray responded that it didn’t
appear so, since the people in the restaurant were sitting at tables
and eating and drinking.

All three witnesses recalled getting some jeers and cat-calls from
diners as they performed their duties, but Langlois was unfailingly
polite. “He was completely co-operative — except for following (public
health) orders,” said Schatz.

At the start of Wednesday’s trial, Judge Glass opted to defer the
Constitutional Charter challenge portion of proceedings to allow time
for a higher court to make a ruling on a similar case — Rebecca Marie
Ingram (and two Baptist churches) versus the Medical Officer of
Health.

If Langlois’ trial ever gets to the constitutional level, Niv doesn’t
expect this portion to be dealt with until December or later.

and operating in diverse markets after living and working in almost

His personal and continued commitment to public service prompted his
return to Alberta, where he served as a key member for Jason Kenney’s
