Robert S. Moore PC MP (born May 14, 1974) is a Canadian lawyer, politician, and former Minister of State (ACOA) and Regional Minister for New Brunswick and Newfoundland and Labrador.[1]

Moore was first elected to parliament in the 2004 federal election serving until his defeat in the 2015 federal election. He was re-elected in the 2019 federal election for his former riding of Fundy Royal.

Early life and career

Moore was born in Gander, Newfoundland. He is the son of a Pentecostal minister, R. Douglas Moore (of the Pentecostal Assemblies of Canada) and his wife, Marie. He has two younger sisters and a younger brother. Due to his father's pastoral work, Moore spent time during his childhood living near Syracuse, New York and also spent eight years from late childhood to his mid-teenage years living in Boiling Springs, Pennsylvania. While in Pennsylvania, he attended Bethel Christian Academy, a school in Carlisle, Pennsylvania affiliated with his father's church, Bethel Assembly of God. After completing the 8th grade at Bethel Christian Academy (now called Carlisle Christian Academy), he briefly attended Boiling Springs High School (with the South Middleton School District) in Boiling Springs, PA. His family returned to Canada in the summer of 1989 when his father, a Canadian citizen, started a church.[2] Moore completed his high school education at Kennebecasis Valley High School in 1992.

Moore has a Bachelor of Arts degree in Business Administration and a Bachelor of Laws degree from the University of New Brunswick. He was admitted to the Law Society of New Brunswick in June 2000.

He and his wife Melinda live in Quispamsis with their two daughters, Madeline and Katelyn and son Robert.[3]

Political career

Moore ran in the 2000 federal election for the Canadian Alliance in the New Brunswick riding of Fundy—Royal. He finished third, with 8,392 votes behind John Herron of the Progressive Conservative Party of Canada.

Following the 2003 merger of the Progressive Conservatives and the Canadian Alliance into the new Conservative Party of Canada, Moore ran as the Conservative candidate in the 2004 election in the reshaped riding of Fundy against Herron, who had not supported the merger and ran as the Liberal candidate in the 2004 election. Moore won the rematch.

In the 2006 election, Moore defeated three opponents: Eldon Hunter of the Liberal Party of Canada, Rob Moir of the New Democratic Party, and Patty Donovan of the Green Party of Canada. The Conservatives, led by Stephen Harper, replaced the Liberals' minority government with one of their own in 2006. When the new government was sworn in in February 2006, Moore was appointed Parliamentary Secretary to the Minister of Justice and Attorney General of Canada. Moore's duties as Parliamentary Secretary to the Minister of Justice included representing the Minister in Parliament and in the Standing Committee on Justice and Human Rights.

Harper led the Conservative minority government as Prime Minister of Canada for over two years before the 2008 Canadian federal election after which a coalition threat was narrowly defeated by a combination of delaying tactics and leadership shifts in the Liberal Party of Canada. Moore was personally re-elected.

On January 19, 2010, Harper appointed Moore to cabinet as the Minister of State (Small Business and Tourism).[4] He replaced Diane Ablonczy, who moved to Minister of State (Seniors). He was eventually released from cabinet after the general election in May 2011 (in which the Conservatives won their first majority government since their re-formation under that name). Michael Sona, the only person charged in relation the 2011 Canadian federal election voter suppression scandal, worked for a time as a communications special assistant for Moore after the election.[5]

On July 15, 2013, Moore was reinstated in the cabinet and named Minister of State (ACOA) and Regional Minister for New Brunswick and Newfoundland and Labrador in a cabinet shuffle.[1][6] Moore ran for reelection as the Conservative candidate for Fundy Royal in the 2015 Canadian federal election[7] but lost to Alaina Lockhart, who became only the second Liberal in a century to win what was generally a safe Conservative seat.[8]

On September 15, 2016, Moore was appointed as the Conservative critic for the Atlantic Canada Opportunities Agency (ACOA) by Interim Leader of the Conservative Party, Rona Ambrose, replacing Scott Armstrong.[9] He was the only Conservative Party critic who was not a member of either the Senate of Canada or the House of Commons of Canada.[10]

Moore regained his seat of Fundy Royal, defeating Lockhart, in the 2019 Canadian federal election.[11][12]

Moore endorsed Peter MacKay in the 2020 Conservative Party of Canada leadership election.[13] He was re-elected in the 2021 federal election.

UNB asks Oklahoma court to dismiss lawsuit by alumnus turned Republican senator

Doug Mastriano suing UNB, alleging it leaked his PhD and conspired to discredit his thesis

The University of New Brunswick says a lawsuit launched against it by an alumnus turned U.S. politician contains "disorganized and speculative allegations" and should be thrown out entirely.

The university's motion comes in response to a lawsuit by Pennsylvania Republican state Sen. Doug Mastriano, whose doctoral thesis on American First World War hero Alvin C. York was widely criticized by academics after the university released it publicly despite his requests to have it kept under wraps.

Mastriano's lawsuit alleges UNB and several named academics conspired in a scheme to discredit his work and deprive him of commercial gain he would have enjoyed through book deals, movie deals and speaking gigs based on the doctoral thesis that earned him his PhD from the university.

However, UNB, in a motion filed last month, says Mastriano's lawsuit should be dismissed on the grounds that the Oklahoma court in which he filed the suit lacks jurisdiction over the university and the named co-defendants, including president Paul Mazerolle.

"This is a dispute over academic protocol that should be resolved by an educational committee but instead has been dressed up as an international conspiracy," says the motion, filed by lawyers representing the university.

Lawyers for Mastriano have since filed a counter-motion arguing the court does have jurisdiction to litigate the case against UNB and the other named defendants.

None of the allegations have been tested in court.

Book prompted calls for thesis release

Mastriano is a retired U.S. Army colonel who in May 2019 was elected a state senator for Pennsylvania's 33rd district.

Known for his socially conservative views, he rose to national prominence for his support for former president Donald Trump and the debunked conspiracy theory that the 2020 U.S. presidential election was rigged in favour of President Joe Biden.

Mastriano lawsuit runs counter to principles of academic discourse, researcher says

A researcher who's being sued alongside the University of New Brunswick says the lawsuit brought by Pennsylvania state Sen. Doug Mastriano is an affront to the principles of academic discourse and freedom of speech, and should be dismissed.

With Trump's endorsement, Mastriano ran in 2022 for governor of Pennsylvania but was defeated by Democratic nominee Josh Shapiro.

In 2013, Mastriano received his PhD from UNB, with his thesis focusing on York, who achieved fame for killing 25 Germans on a battlefield in France. York's heroics inspired a Hollywood movie, with actor Gary Cooper in the lead role.

A year later, Mastriano used his thesis as the template for a book he published, even while his thesis remained under wraps, thanks to an unusually lengthy embargo on its release.

That didn't stop other academics, however, from questioning claims in the book, prompting calls for UNB to release his thesis publicly.

In 2022, UNB published the thesis, against Mastriano's request to keep it under embargo until 2030.

Since its release, several academics have said it contains fabricated footnotes and unsubstantiated claims, prompting the university in 2023 to appoint a committee to investigate the allegations of academic fraud.

Under UNB policy, the investigation committee was required to submit its recommendations to the university within 60 days, but any findings the committee might have reached have not been released to the public.

Lawsuit undermines free speech, says academic

Another named defendant in the lawsuit is James Gregory Jr., an American academic who filed the formal complaint that led to the university's investigation into Mastriano's alleged academic misconduct.

Lawyers representing him have also filed a motion asking for parts of the lawsuit against him to be dismissed, arguing they run up against free speech protections afforded in the Constitution of the United States.

"The First Amendment demands that even the most powerful engage their critics in the marketplace of ideas — not the courts," say his lawyers, who are with the Foundation for Individual Rights and Expression.

"Plaintiff Doug Mastriano, a prominent Pennsylvania politician, has dragged a historical debate into this court, suing his critics for defamation and a wild assortment of claims."

Gregory is a PhD student who also took a focus on the story of York's heroics, and had originally relied on details in Mastriano's book for an article he wrote.

But after he published his article, other scholars raised issues with parts of it that tied back to Mastriano's book, prompting him to push UNB to release Mastriano's thesis.

Once it was released, Gregory said he found more than 200 issues, ranging from fictitious citations to unsubstantiated claims, which he included in his 2022 complaint to UNB.

To now be getting sued by Mastriano for doing so runs "completely counter" to the principles of academic discourse and freedom of speech, and could set a troubling precedent, he said.

"This suit, it feels like a [case of] shut up or shell out, you know... and I think that's ridiculous. That's not how academic discourse works," Gregory said.

Gregory's motion asks that the court dismiss all counts against him, award him the attorney's fees he incurred and "sanction" Mastriano for bringing the lawsuit.

Under Mr. Sutton’s leadership, the office led the nation in drug convictions, was second in illegal alien prosecutions, won more than 105 public corruption convictions and sent nearly 400 violent criminal gang members to prison.

In 2003, then-United States Attorney General John Ashcroft appointed Mr. Sutton to the Attorney General’s Advisory Committee—a panel of 17 U.S. Attorneys that advise the General and help carry out the President’s national goals. Mr. Sutton served from 2003 until 2009 and was chairman for nearly two years.

After leading the Bush-Cheney Department of Justice Transition Team in 2000, Mr. Sutton was named Associate Deputy Attorney General. He held the position until becoming U.S. Attorney.

From 1995 to 2000, Mr. Sutton served as the Criminal Justice Policy Director for then-Governor George W. Bush. Mr. Sutton was the chief policy advisor to the Governor on all criminal justice issues.

From 1988 to 1995, Johnny was a prosecutor in the Harris County District Attorney’s Office in Houston, Texas where he successfully tried 17 murder jury trials, including seven for capital murder.

Mr. Sutton attended the University of Texas at Austin on a baseball scholarship where he was a two-year lettermen and the starting left fielder for the 1983 University of Texas National Championship baseball team. Mr. Sutton was voted the Most Valuable Player of the NCAA Central Regional Baseball Tournament in 1983. Mr. Sutton is fluent in Spanish and conversant in Portuguese.

UNB to investigate fraud allegations against former PhD student with ties to Trump

The academic credentials of Republican politician Doug Mastriano were called into question last fall

The academic credentials of Republican politician Doug Mastriano were called into question last fall when several scholars came forward to allege his 2013 doctoral dissertation was plagued by errors, fabrications and omissions.

At the time, the state senator in Pennsylvania was known for his role in the movement to overturn Trump's 2020 election defeat, and he later launched a failed bid to become the state's governor.

Mastriano dismissed the allegations last fall, saying "left-leaning professors" at UNB were unable to deal with his political views.

James Gregory, an American scholar who complained about Mastriano's thesis, confirmed this week that he has received word from UNB that his allegations warrant a formal investigation.

The investigation committee must submit its recommendations to the university within 60 days of its formation, but the
institution's policy says the report will not be released to the public.

University officials declined requests for interviews.

UNB releases controversial U.S. politician's PhD dissertation after months of refusals

Until recently, details of Douglas Mastriano's Canadian doctorate had been under lock and key

After months insisting it was not possible — or even legal — to share a maligned doctoral dissertation by controversial U.S. politician Doug Mastriano, the University of New Brunswick suddenly made the document public in August, in a move that appeared to undermine excuses used to keep it secret in the first place.

Mastriano, the Republican nominee running to be governor of Pennsylvannia, rose to prominence there as an early opponent of mask and vaccine mandates to fight the COVID-19 pandemic, and as an ardent supporter of former president Donald Trump.

A state senator, author and retired army colonel, Mastriano obtained a PhD in history from UNB in 2013, toward the end of his military career.

Numerous attempts to access the dissertation that Mastriano wrote in order to earn the doctorate have, however, been repelled for the last two years.

"The choice to embargo a thesis is at the discretion of the author, not the institution," UNB's Heather Campbell wrote in May, while rejecting a CBC request to access Mastriano's dissertation.

She said an author's reasons for not wanting work shared "are not scrutinized," and an embargo could last indefinitely under university rules.

"It is by default for four years, but an author may request an extension," she wrote.

That is contrary to the policy of many North American universities, which view scholarship as a public good to be shared except in rare circumstances.

For instance, York University in Toronto says on its website that its policy is to allow the embargo of a dissertation for a maximum of three years, and only when it meets certain conditions and is agreed to be necessary by a student's supervisor.

"As a publicly funded institution, York University has an obligation to ensure that research produced by its graduate students is available for the benefit of the public, particularly by making successfully defended theses and dissertations available through York University Libraries and Library and Archives Canada," states the university policy.

'They really divulged nothing'

Nevertheless UNB used its more restrictive policy to deny at least four separate requests since 2020 to view the dissertation. 

Chris Rodkey, a Pennsylvania Democrat running to represent his local district in the state election this fall, made one of those requests. 

Rodkey, who has a PhD himself, was surprised in November 2020 when he could not find a record of Mastriano's dissertation in UNB's library system.

That changed to shock when UNB responded to a formal written request for information by declining to disclose even the title of Mastriano's dissertation.

"Since this request is asking for the personal information of a third-party's educational history, we are obligated to protect the privacy of said individual," UNB's Sarah DeVarenne wrote in a letter responding to Rodkey's request

"They didn't confirm or deny anything, and they really divulged nothing," Rodkey said in an interview this week.

"I thought it was strange that they wouldn't comment or they wouldn't give me any information whatsoever."

Mastriano led hearings in Pennsylvania in November 2020 that gave Trump lawyer Rudy Giuliani a forum to allege widespread fraud in Joe Biden's election win in that state. He also attended the pro-Trump rally in Washington D.C. on Jan. 6, 2021 that devolved into a deadly riot.

"The one guy that supported election integrity and supported me right from the beginning is Doug Mastrianio," reads an endorsement from Donald Trump on Mastriano's social media platforms.

CBC News has not received any replies to Mastriano's campaign for comment. Mastriano has barred reporters from attending his events, garnering national media attention in the U.S. because of it. 

Doctorate has been used to counter criticism

Mastriano cites the UNB doctorate in his campaign materials, and the dissertation has been used to counter criticisms of some of his controversial statements and actions that have emerged during the campaign, like an old photo showing him at an event dressed as a confederate soldier.

"Media MELT DOWN that Mastriano apparently once posed as a civil war historical figure," tweeted campaign legal advisor Jenna Ellis in response to that controversy. "He has a PhD in HISTORY."

As Mastriano's profile grew, a variety of media outlets and other parties attempted to access his heavily criticized dissertation on First World War hero Sgt. Alvin C. York but UNB insisted its policies and privacy laws prohibited it

In addition to Rodkey and the CBC, UNB also rejected requests for Mastriano's dissertation from the Associated Press and from University of Oklahoma graduate student James Gregory, who has become a vocal critic of errors in Mastriano's historical research.

"I don't care about Mastriano's politics. I live in Oklahoma," said Gregory in an interview.

"This had nothing to do with politics. This was just purely due diligence within the field of being a historian."

List of errors given to university

UNB told Gregory in 2021 that Mastriano's dissertation about Sgt. York was largely reprinted as a commercially available book in 2014. Based on that information, Gregory gave the university a list of errors it should check for in the Mastriano dissertation.

The university still did not allow him to view the document but launched a review that led to 21 revisions in Mastriano's original dissertation that were attached in a "corrigendum" in June 2021.

That was not publicly known at the time, however, because of the ongoing embargo on the work enforced by the university.

Gregory wonders if UNB kept Mastriano's dissertation suppressed to protect his privacy rights or to spare itself embarrassment over errors that it had failed to detect and then rewarded with a degree.

"They were going to bury it again under the embargo where no one could double-check it," said Gregory, describing revisions that were made and then also placed under embargo.

"I find it suspicious, at the least, that they would even allow that."

Further questions about whether Mastriano's privacy rights were really behind the embargo emerged again in August when the university suddenly reversed course and released the dissertation after nine years of secrecy, apparently without Mastriano's permission.

The Associated Press reported last week that Drew Rendall, UNB's dean of graduate studies, informed Mastriano the embargo was being lifted and did so without ever hearing back from the candidate.

Rendall did not respond to a request for an interview about whether his ending of the embargo suggests UNB's prior claims — that the decision was up to Mastriano alone — were untrue.

In an unsigned statement that UNB issued Friday, the school claimed it had learned "recently" that a PhD thesis embargo it did not identify had been extended long past its normal four-year maximum.

"We acknowledge that the extended embargo was contrary to the practice and academic principle of scholarly activity and did not adhere to UNB regulations and guidelines for preparing and submitting graduate student thesis, dissertations and reports," said the statement.

The university did not address false statements its representatives made over the past two years claiming the extended embargo was normal and up to Mastriano alone to end.

Gregory said that based on the now-public document and the 21 revisions made as a result of his 2021 complaint about suspected errors in the work, he is preparing a second, larger challenge to Mastriano's research and UNB's awarding of a PhD based on it.

Zabecki) who signed off on it been questioned about their role? They are there to question and catch errors, and if necessary, flunk the candidate. I am not a historian who can evaluate that claim. Far-right candidate Doug Mastriano got a doctorate in New Brunswick. A professor says it was undeserved

One of the most controversial politicians in the United States is causing a stir far north of the campaign trail: at a Canadian university that once granted him a doctorate.

Students at the University of New Brunswick are pushing their university for details about its role in granting Doug Mastriano the crowning academic achievement on his CV in 2013.

A UNB associate professor listed on Doug Mastriano's doctoral dissertation describes it as atrocious academic work and says he can't understand why the paper includes his name. 

"This dissertation has bothered me for nine years," Jeffrey Brown told CBC News in an interview.

"[Mastriano] was awarded a PhD on very shaky grounds."

The famous alumnus is now running for governor of Pennsylvania in next month's midterm elections on a hard-right platform with potentially major implications, far beyond his state.

Election denier could gain power over elections

Election denialism is what made Mastriano nationally famous.

The state lawmaker tried overturning the 2020 election on behalf of Donald Trump; he was at the Capitol as the riot began there on Jan. 6, 2021 and even helped transport protesters to Washington. 

Now he's the Republican nominee for governor of Pennsylvania. The polls show him trailing. But if he happens to win, he would gain new power over national elections.

The Pennsylvania governor will appoint the chief election administrator and also judges who would hear election cases in the critical swing state.

Mastriano's campaign used his doctorate in fending off a recent political controversy. When a photo surfaced showing Mastriano wearing a Confederate uniform at a 2014 educational event, an adviser dismissed it as a smear job against a historian, pointing to his academic credentials.

Mastriano's work was dishonest, sloppy, tinged with religious zealotry, and indifferent to facts that contradicted his claims, said Brown, a scholar of U.S. history at UNB and a U.S.-Canada dual citizen.

He expressed alarm when the university granted the PhD and has provided CBC News with emails he sent colleagues at the time.

Brown lamented that the same traits he denounced back then are materializing in Mastriano's public life: namely the fanaticism and indifference to facts.

"The prospect of Doug Mastriano having any power, anywhere, is horrifying," said Brown, who met and worked with Mastriano on several revisions to his dissertation. 

Eventually, Brown bowed out of the project. Or so he thought.

Thesis subject: a Christian soldier

Mastriano's dissertation involved a legendary American soldier, one of the most highly decorated of the last century.

Alvin York was a deeply religious Army sergeant who described being touched by God before a First World War battle where he killed 25 Germans.

His life story inspired a Gary Cooper movie. Mastriano has a long-running project to spread his story to younger generations, with a website, a doctoral dissertation and then a book.

Yet Mastriano's project was dogged by scrutiny from the start. 

Even before he arrived in New Brunswick, Mastriano, then an Army intelligence officer, made news in 2008 for his work to pinpoint the location of York's heroics on a French battlefield.

Other scholars and a French bureaucrat accused him of sloppy research methods, misidentifying the battle location, ignoring contradictory details, digging without a permit and ruining an archeological site. 

Mastriano dismissed his detractors as jealous and maintained his certainty he'd found the true battle site.

The archeological controversy was the initial reason Brown, the New Brunswick professor, voiced concern with the project. 

Nobody examining Mastriano's work had any archeological expertise, so, he asked, how were they supposed to scrutinize a paper filled with archeological claims, claims being vigorously disputed?

The list of concerns grew with time.

One was the quality of the writing: Brown said it took multiple revisions to correct basic grammar, style and punctuation problems on almost every page. 

A cursory read of the finished paper still turns up basic errors: a colonel's name repeatedly misspelled, an Italian military award misspelled in the introduction, and the wrong release year (1940) for the 1941 Gary Cooper movie.

There were more substantive complaints. 

He said Mastriano offered opinions without facts or attribution to support them, an approach Brown called non-academic.

'That's what God wanted'

In a dramatic example of that, Brown said, Mastriano would make matter-of-fact claims even when referring to heavenly phenomena.

In one example, on Page 260, Mastriano writes: "The idea that York survived the carnage because of Divine Intervention also speaks of a miracle."

Brown said that approach just isn't scholarly.

"It wasn't so much, 'Sergeant York reported that,' or, 'York believed that,' as it was, 'God talked to York,'" Brown said in an interview.

"That's where Mastriano wanted to go with it: that this guy was literally directed by God to begin fighting people. That would be righteous. That's what God wanted."

Faith is central to Mastriano's life, and to his gubernatorial campaign

He's said journalists who appear to mock his faith will be barred from covering his campaign events and has bristled at being described as a "Christian nationalist." 

In the past, he's explained how the Alvin York story fits into his faith. 

In a 2019 speech, he espoused York as an alternative to the pacifist, turn-the-other-cheek philosophy within Christianity, as evidence the faithful can be warriors.

Prayer is a regular part of his campaign events. It was a recurring theme in speeches at a rally last month at the Pennsylvania legislature.

"Lord, you told us to pray for our enemies," one speaker said, in a prayer to open the rally.

"We pray that they would lose." 

The critics amass

Criticism of Mastriano's scholarly work goes back years and spans several countries.

In Oklahoma, a teacher and history PhD candidate wrote last year to the UNB warning that Mastriano's work was rife with academic fraud.

James Gregory, who first encountered Mastriano's work in his published book, says he's since found over 150 problems with the thesis.

It's rampant with fake footnotes, he says, meaning the paper often makes a claim, cites a footnote to back it up, then, when you actually go check the source mentioned in the footnote, it says something else.

He showed CBC News some examples. 

For instance, Mastriano's paper says a journalist first took an interest in York's story because of its religious aspect; a footnote then cites a telegram the journalist, Canadian George Pattullo, sent on Jan. 30, 1919. But Gregory tracked down the telegram and there's nothing about religion, just Pattullo's travel plans and a request for battlefield data. 

"His dissertation is just filled with these issues," Gregory said. "He's making it up."

"It's academic fraud."

Mastriano's dissertation claims York's faith is what first inspired a journalist to write about him. As evidence, it cites this telegram. This telegram doesn't say that. A researcher says Mastriano's work is filled with problems like this. (James Gregory)

Gregory insists he has no political axe to grind. He says he's a registered Republican, in Oklahoma, and doesn't care who the governor of Pennsylvania is.

His gripe, he says, is strictly academic. And somewhat personal. That's because Gregory has also written about York; he cited Mastriano in his work and now he's feeling deceived.

"It's tainted," Gregory said.   

"He was wrong. Therefore my article was wrong. And everyone in the future who cites Mastriano's work, now, their work is tainted.

"It's not just that he's changing history by lying and making things up. He's also ruining everyone else's work that trusts him."

Gregory said he actually had a cordial relationship with Mastriano, exchanging messages online about their shared scholarly interest in York. 

Then, suddenly, Gregory says, when he started spotting details that contradicted Mastriano's work, the politician cut off contact and blocked him on Facebook. 

UNB students concerned, frustrated

Some students in New Brunswick started worrying about reputational taint after the Associated Press first reported on the controversy at their school.

A dozen Master's and PhD students gathered last month to discuss plans to press the university for details about Mastriano's degree.

The students plan to release a letter soon.

"A lot of us vented our frustrations at this.… This reflects on our academic training," said Richard Yeomans, a PhD candidate in the history department.

"This man's credentials are unearned.… It's very clear a vanity degree was granted to him."

Mastriano's thesis supervisor, Marc Milner, a history professor and honorary colonel in the Air Force, did not respond to emails seeking comment.

Multiple efforts to reach current and retired staff at the university, including the communications office, received no response. 

Mastriano, meanwhile, did not respond to requests for comment via phone calls to his three state legislative offices and emails to his legislative and campaign staff.

The school, he says, has a good relationship with the military, and let Mastriano through to avoid disrupting that.

He sent CBC News printouts of email exchanges from 2012 and 2013 laying out his myriad concerns, including one final note. 

In that note, Brown told Milner that, from what he understood, regardless of his complaints, Mastriano would get his degree anyway.

Brown wrote: "I know that I will regret it if I allow my signature to stand on this dissertation."

He says Milner responded that his services were no longer needed because the three-member examining committee already had enough people. 

Brown backed away, after having spent months on the project.

But he just got a surprise.

The university finally released Mastriano's thesis over the summer, amid external pressure after a years-long delay in making it public.

Brown's name is still there, listed on the examining board.

The Plaintiff seeks an appeal de novo, by way of motion pursuant to
the Federal Courts Rules (SOR/98-106), from an Order made on November
12, 2015, in which Prothonotary Morneau struck the Statement of Claim
in its entirety.

At the outset of the hearing, the Plaintiff brought to my attention a
letter dated September 10, 2004, which he sent to me, in my then
capacity as Past President of the New Brunswick Branch of the Canadian
Bar Association, and the then President of the Branch, Kathleen Quigg,
(now a Justice of the New Brunswick Court of Appeal).  In that letter
he stated:

As for your past President, Mr. Bell, may I suggest that you check the
work of Frank McKenna before I sue your entire law firm including you.
You are your brother’s keeper.

Frank McKenna is the former Premier of New Brunswick and a former
colleague of mine at the law firm of McInnes Cooper. In addition to
expressing an intention to sue me, the Plaintiff refers to a number of
people in his Motion Record who he appears to contend may be witnesses
or potential parties to be added. Those individuals who are known to
me personally, include, but are not limited to the former Prime
Minister of Canada, The Right Honourable Stephen Harper; former
Attorney General of Canada and now a Justice of the Manitoba Court of
Queen’s Bench, Vic Toews; former member of Parliament Rob Moore;
former Director of Policing Services, the late Grant Garneau; former
Chief of the Fredericton Police Force, Barry McKnight; former Staff
Sergeant Danny Copp; my former colleagues on the New Brunswick Court
of Appeal, Justices Bradley V. Green and Kathleen Quigg, and, retired
Assistant Commissioner Wayne Lang of the Royal Canadian Mounted
Police.

In the circumstances, given the threat in 2004 to sue me in my
personal capacity and my past and present relationship with many
potential witnesses and/or potential parties to the litigation, I am
of the view there would be a reasonable apprehension of bias should I
hear this motion. See Justice de Grandpré’s dissenting judgment in
Committee for Justice and Liberty et al v National Energy Board et al,
[1978] 1 SCR 369 at p 394 for the applicable test regarding
allegations of bias. In the circumstances, although neither party has
requested I recuse myself, I consider it appropriate that I do so.


AS A RESULT OF MY RECUSAL, THIS COURT ORDERS that the Administrator of
the Court schedule another date for the hearing of the motion.  There
is no order as to costs.

is clear on your dead calf issue: Our forensic labs do not process
testing on animals in cases such as yours, they are referred to the
Atlantic Veterinary College in Charlottetown who can provide these
services. If you do not choose to utilize their expertise in this
instance, then that is your decision and nothing more can be done.

As for your other concerns regarding the US Government, false
imprisonment and Federal Court Dates in the US, etc... it is clear
that Federal authorities are aware of your concerns both in Canada

Little David Amos’ “True History Of War” Canadian Airstrikes And
Stupid Justin Trudeau

Canada’s and Canadians free ride is over. Canada can no longer hide
behind Amerka’s and NATO’s skirts.

When I was still in Canadian Forces then Prime Minister Jean Chretien
actually committed the Canadian Army to deploy in the second campaign
in Iraq, the Coalition of the Willing. This was against or contrary to
the wisdom or advice of those of us Canadian officers that were
involved in the initial planning phases of that operation. There were
significant concern in our planning cell, and NDHQ about of the dearth
of concern for operational guidance, direction, and forces for
operations after the initial occupation of Iraq. At the “last minute”
Prime Minister Chretien and the Liberal government changed its mind.
The Canadian government told our amerkan cousins that we would not
deploy combat troops for the Iraq campaign, but would deploy a
Canadian Battle Group to Afghanistan, enabling our amerkan cousins to
redeploy troops from there to Iraq. The PMO’s thinking that it was
less costly to deploy Canadian Forces to Afghanistan than Iraq. But
alas no one seems to remind the Liberals of Prime Minister Chretien’s
then grossly incorrect assumption. Notwithstanding Jean Chretien’s
incompetence and stupidity, the Canadian Army was heroic,
professional, punched well above it’s weight, and the PPCLI Battle
Group, is credited with “saving Afghanistan” during the Panjway
campaign of 2006.

What Justin Trudeau and the Liberals don’t tell you now, is that then
Liberal Prime Minister Jean Chretien committed, and deployed the
Canadian army to Canada’s longest “war” without the advice, consent,
support, or vote of the Canadian Parliament.

What David Amos and the rest of the ignorant, uneducated, and babbling
chattering classes are too addled to understand is the deployment of
less than 75 special operations troops, and what is known by planners
as a “six pac cell” of fighter aircraft is NOT the same as a
deployment of a Battle Group, nor a “war” make.

The Canadian Government or The Crown unlike our amerkan cousins have
the “constitutional authority” to commit the Canadian nation to war.
That has been recently clearly articulated to the Canadian public by
constitutional scholar Phillippe Legasse. What Parliament can do is
remove “confidence” in The Crown’s Government in a “vote of
non-confidence.” That could not happen to the Chretien Government
regarding deployment to Afghanistan, and it won’t happen in this
instance with the conservative majority in The Commons regarding a
limited Canadian deployment to the Middle East.

President George Bush was quite correct after 911 and the terror
attacks in New York; that the Taliban “occupied” and “failed state”
Afghanistan was the source of logistical support, command and control,
and training for the Al Quaeda war of terror against the world. The
initial defeat, and removal from control of Afghanistan was vital and
essential for the security and tranquility of the developed world. An
ISIS “caliphate,” in the Middle East, no matter how small, is a clear
and present danger to the entire world. This “occupied state,”
or“failed state” will prosecute an unending Islamic inspired war of
terror against not only the “western world,” but Arab states
“moderate” or not, as well. The security, safety, and tranquility of
Canada and Canadians are just at risk now with the emergence of an
ISIS“caliphate” no matter how large or small, as it was with the
Taliban and Al Quaeda “marriage” in Afghanistan.

One of the everlasting “legacies” of the “Trudeau the Elder’s dynasty
was Canada and successive Liberal governments cowering behind the
amerkan’s nuclear and conventional military shield, at the same time
denigrating, insulting them, opposing them, and at the same time
self-aggrandizing ourselves as “peace keepers,” and progenitors of
“world peace.” Canada failed. The United States of Amerka, NATO, the
G7 and or G20 will no longer permit that sort of sanctimonious
behavior from Canada or its government any longer. And Prime Minister
Stephen Harper, Foreign Minister John Baird , and Cabinet are fully
cognizant of that reality. Even if some editorial boards, and pundits
are not.

Justin, Trudeau “the younger” is reprising the time “honoured” liberal
mantra, and tradition of expecting the amerkans or the rest of the
world to do “the heavy lifting.” Justin Trudeau and his “butt buddy”
David Amos are telling Canadians that we can guarantee our security
and safety by expecting other nations to fight for us. That Canada can
and should attempt to guarantee Canadians safety by providing
“humanitarian aid” somewhere, and call a sitting US president a “war
criminal.” This morning Australia announced they too, were sending
tactical aircraft to eliminate the menace of an ISIS “caliphate.”

In one sense Prime Minister Harper is every bit the scoundrel Trudeau
“the elder” and Jean ‘the crook” Chretien was. Just As Trudeau, and
successive Liberal governments delighted in diminishing,
marginalizing, under funding Canadian Forces, and sending Canadian
military men and women to die with inadequate kit and modern
equipment; so too is Prime Minister Stephen Harper. Canada’s F-18s are
antiquated, poorly equipped, and ought to have been replaced five
years ago. But alas, there won’t be single RCAF fighter jock that
won’t go, or won’t want to go, to make Canada safe or safer.

My Grandfather served this country. My father served this country. My
Uncle served this country. And I have served this country. Justin
Trudeau has not served Canada in any way. Thomas Mulcair has not
served this country in any way. Liberals and so called social
democrats haven’t served this country in any way. David Amos, and
other drooling fools have not served this great nation in any way. Yet
these fools are more than prepared to ensure their, our safety to
other nations, and then criticize them for doing so.

Canada must again, now, “do our bit” to guarantee our own security,
and tranquility, but also that of the world. Canada has never before
shirked its responsibility to its citizens and that of the world.

Prime Minister Harper will not permit this country to do so now

I talked to Don Newman earlier this week before the beancounters David
Dodge and Don Drummond now of Queen's gave their spin about Canada's
Health Care system yesterday and Sheila Fraser yapped on and on on
CAPAC during her last days in office as if she were oh so ethical.. To
be fair to him I just called Greg Weston (613-288-6938) I suggested
that he should at least Google SOUCOM and David Amos It would be wise
if he check ALL of CBC's sources before he publishes something else
about the DND EH Don Newman? Lets just say that the fact  that  your
old CBC buddy, Tony Burman is now in charge of Al Jazeera English
never impressed me. The fact that he set up a Canadian office is

"I remember years ago when the debate was on in Canada, about there
being weapons of mass destruction in Iraq. Our American 'friends"
demanded that Canada join into "the Coalition of the Willing. American
"veterans" and sportscasters loudly denounced Canada for NOT buying
into the US policy.

At the time I was serving as a planner at NDHQ and with 24 other of my
colleagues we went to Tampa SOUCOM HQ to be involved in the planning
in the planning stages of the op....and to report to NDHQ, that would
report to the PMO upon the merits of the proposed operation. There was
never at anytime an existing target list of verified sites where there
were deployed WMD.

Coalition assets were more than sufficient for the initial strike and
invasion phase but even at that point in the planning, we were
concerned about the number of "boots on the ground" for the occupation
(and end game) stage of an operation in Iraq. We were also concerned
about the American plans for occupation plans of Iraq because they at
that stage included no contingency for a handing over of civil
authority to a vetted Iraqi government and bureaucracy.

There was no detailed plan for Iraq being "liberated" and returned to
its people...nor a thought to an eventual exit plan. This was contrary
to the lessons of Vietnam but also to current military thought, that
folks like Colin Powell and "Stuffy" Leighton and others elucidated
upon. "What's the mission" how long is the mission, what conditions
are to met before US troop can redeploy?  Prime Minister Jean Chretien
and the PMO were even at the very preliminary planning stages wary of
Canadian involvement in an Iraq operation....History would prove them
correct. The political pressure being applied on the PMO from the
George W Bush administration was onerous

American military assets were extremely overstretched, and Canadian
military assets even more so It was proposed by the PMO that Canadian
naval platforms would deploy to assist in naval quarantine operations
in the Gulf and that Canadian army assets would deploy in Afghanistan
thus permitting US army assets to redeploy for an Iraqi
operation....The PMO thought that "compromise would save Canadian
lives and liberal political capital.. and the priority of which
....not necessarily in that order. "
