Danielle Smith's UCP leadership test: here's what history says about how safe she is
A simple pass isn't enough to survive a leadership review. Even 70% support doesn't mean future is solid
If history is anything to go by, Premier Danielle Smith's job should be safe after her leadership review — as long as more than seven in 10 United Conservative Party members vote to endorse her.
That could be asking a lot of a party grassroots that pushed out their last leader.
Only 51.4 per cent of members backed Jason Kenney two years ago, and there are activists looking to undermine Smith's support this week in Red Deer.
A group named the 1905 Committee (the year Alberta became a province) sent thousands of party members an email this week criticizing Smith's changes to the Bill of Rights — changes she appears to have tailored to her party's wishes.
The letter said the attempt to "appease freedom-minded base" didn't go far enough, and may actually weaken individual freedoms in Alberta.
"Is this what you expected from our premier? Is this how she plans on keeping all of her promises?" wrote Nadine Wellwood, leader of the 1905 Committee. "You be the judge and cast your decision at the AGM."
Meanwhile six MLAs and cabinet ministers recorded a finish-each-others'-sentences video in praise of their boss that the UCP caucus posted online this week.
"At our AGM in Red Deer this November, I'm voting for Danielle Smith…" Forestry Minister Todd Loewen began. Chestermere-Strathmore backbencher Chantelle de Jonge finished: "... to continue leading our United Conservative family. Stand with me."
And that's just the party machinations visible above the surface. As there are with all party leadership reviews, there is likely more jostling, cajoling, rumour-mongering and scheming that occurs in private.

How will this vote Saturday in Red Deer go down?
CBC News asked that question of 20 UCP and government insiders with a sense of the party's mood — including some who remain loyal and others pushing for Smith's ouster.
Given the unpredictability of the UCP membership (Kenney's low score was a stunner to his inner circle), few were certain about the outcome; many of the people contacted gave an estimated range.
Only one predicted an outright loss for Smith, and nobody guessed the leader would get higher than 85 per cent support. The average of the predictions was 69 per cent.
That score may put Smith in a perilous, uncertain zone.
With a couple of short-lived exceptions, most Canadian political leaders who have scored below 70 per cent wound up resigning, be they in opposition or government, in provincial or federal politics.
A higher score is no guarantee of a long political life, but every extra percentage point Smith gets means fewer internal detractors and would-be backstabbers in her own ranks.
Here's a brief history of leadership reviews and outcomes, which we've broken down into tiers of survivability for the leader.
90-100%: All together now level
There are some leaders that get near-unanimous affection from their party, as though it was a Halloween convention and kids were being asked to yea or nay for "free candy."
In 2016, a year after Rachel Notley became premier, 97.8 per cent of the Alberta NDP endorsed her in a review. Even in 2021, after she lost government, she still won 98.2 per cent support as Opposition leader, enough for her to remain atop the party as long as she wished.
Saskatchewan Premier Scott Moe got a similarly ringing endorsement last year, when 97 per cent of Saskatchewan Party members backed him in a review. That cleared the path for him to be undisputed leader heading into this past week's election, where he won a second majority.

In Manitoba Wab Kinew lost his first election as NDP leader in 2019, but two years later he notched 93 per cent support from party members. The wager on Kinew paid off, and he became premier in 2023.
Danielle Smith herself has reached this lofty plateau before. She cleared 90 per cent backing when she was Wildrose Party leader in 2013, a year after losing a seemingly close election to Alison Redford's governing Tories. That gave her leadership solid footing — for a while, until Redford was replaced a year later, a string of Wildrose losses in byelections, Smith requested another leadership review, and then she quit the Wildrose for the Tory benches.
80-89%: Solid state (or Still the one)
At this level, more than one-tenth of a leader's party still doesn't want them, but those naysayers remain a relative rump.
One brass ring for Smith to aspire toward is 86 per cent, which is the percentage of votes her now-rival Naheed Nenshi received — not in a leadership review, but in the four-candidate contest to become Alberta NDP leader this spring.
In 2021, federal New Democrats gave leader Jagmeet Singh 87 per cent, a sturdy mandate to lead the party into that fall's election with few doubters. It wasn't quite the 90.7 he'd scored in his first review in 2018, nor was it the less sturdy 81 per cent vote of confidence party delegates gave him at last year's gathering — but these were solid enough results to head off any vocal "dump Singh" movement.

In 2012, Ontario's third-term Premier Dalton McGuinty was smarting from union unrest and voters recently paring his majority government into a minority. Provincial Liberals registered little quarrel with his leadership, giving him an 85.8 per cent backing.
However, external pressures and poor polls weighed on McGuinty, and he announced a couple of weeks later that he'd resign, even if his Liberals weren't pushing him out the door.
75-79%: Good enough (for now)
The figure 77 per cent has a special place in Alberta political lore. It's the leadership review support Tory Premier Ed Stelmach received in 2009, as did successor Alison Redford in 2013.
These results quelled immediate pressure on these leaders, but did foretell the party unrest that would prompt Stelmach and Redford to each resign before facing another general election.

In 2000, federal Reform Party Leader Preston Manning won support from 75 per cent of convention attendees, a perceived endorsement of his bid to unite Canada's right. But job security was elusive: after Reform became the Canadian Alliance later that year, Manning lost a leadership contest to Stockwell Day.
Bernard Landry notched a bit higher as Parti Québécois Opposition leader in 2005, with 76.2 per cent. It was a level he'd said before the vote that he could live with. Instead, the former premier took it as a cue to quickly depart, and told convention-goers that day.
61-75%: Sixty-six shades of grey
While there are few political leaders who've received confidence votes in this range, 66 per cent is a notorious and oddly recurring number.
Joe Clark had gotten roughly that score at the federal Progressive Conservative convention in 1981, a year after losing his short-lived prime ministership to the Liberals. He stayed on.
But at the dramatic 1983 PC convention, Clark scrapped to 66.9. To the delegates' surprise, Clark announced he didn't believe that was enough of a mandate, and called for a leadership contest.

Flash forward to 2008, and the Ontario PCs. John Tory's leadership review brought him 66.9 per cent, too. "Conventional wisdom says, if you're asking supporters for the right to keep your job and only 60 per cent or less say yes, you've probably got to go," TVO's Steven Paikin wrote at the time.
But this was a greyer area, Paikin added — good enough for Clark once, but not twice. Tory didn't declare his decision at that weekend convention, but would stay on… for a while. He lost a byelection in his bid for a seat in 2009, and took that as his cue to go.
50-60%: Getting the message
A leader can technically stay on if she or he gets more than half of the votes in a yes-or-no leadership review. But in reality, this is the point of no political return.
"While 51 per cent of the vote passes the constitutional threshold of a majority, it clearly is not adequate support to continue on as leader," Jason Kenney said the night his review came in. It was the death knell to his premiership.

It had happened before to an Alberta premier. Ralph Klein was shocked by his 55.4 per cent level of support at the 2006 PC convention, and quickly said he'd resign once a replacement was picked that year, instead of his planned departure in 2008.
This level spells doom for Opposition leaders, too. In 2005, Manitoba Tory head Stuart Murray took a 55 per cent review vote as a clear signal he should pass the torch, and the same went for the Nova Scotia Liberals' Vince MacLean in 1992 (51.5 per cent).
Sub-50%: It's been decided for you
Often in politics, a leader will sense looming unrest and leave before party delegates embarrass him or her.
Tom Mulcair did no such thing in 2016.
At the federal NDP's convention, one year after his party lost more than half its seats and Official Opposition status, he made history. In a terse announcement made only in French at the Edmonton convention, an official announced Mulcair's outright loss — only 48 per cent backed him, and 52 per cent voted for a leadership election.
It could be worse. It could be Martine Ouellet, rejected after barely one year as Bloc Québécois leader with only 32 per cent support in her review.
Don't ask, don't tell
There is another way out of peril, aside from getting a bulletproof result at a leadership review.
Many parties don't test their leaders at reviews, especially if they've won an election.
That's why Prime Minister Justin Trudeau has never been subject to a vote of Liberal members in his nine years in government, and his Conservative predecessor Stephen Harper wasn't, either.
But Alberta's UCP is big on grassroots empowerment. The members who will number nearly 6,000 at this weekend's convention may jealously guard their right to weigh in on — and potentially lop off — their party's head.

Alberta premier wins leadership review with 91.5 per cent approval
'Our conservative movement is stronger than it's ever been': Danielle Smith
Alberta Premier Danielle Smith received 91.5 per cent support for her leadership from members of her United Conservative Party who voted in Red Deer, Alta., on Saturday.
"I'm truly humbled and honoured by the overwhelming support of our party members in your vote of confidence in my leadership," Smith told the cheering crowd after the result was announced.
"Our conservative movement is stronger than it's ever been. Our party is more united than it has ever been."
The party said 4,633 ballots were cast in the vote. The result solidifies Smith's leadership of Alberta's governing party and confirms party members agree with the direction she has taken the province since she took over the party two years ago.
UCP member Rhonda Grenier said she was happy with the result, as she is impressed with Smith's performance as UCP leader.
"She's articulate. She stands behind what she says," Grenier said. "She's trying. And she will admit her faults."
Grenier said Smith's critics should give her more time.
"Nothing good happens fast," Grenier said.

Rose Huebschwerlen was also pleased with the vote, which she called a "resounding success."
"I absolutely believe in Danielle," she said. "She is the lady who will get it done."
'On the right path'
Earlier Saturday, Smith made her pitch to continue as leader by reminding the 6,000 members at the annual general meeting that the party needs to stay united in order make the province better.
"We are on the right path," Smith told a packed Westerner Centre earlier Saturday morning. "And we've only just begun.
"So let us remain united as a party and as a movement — but let us not sink to the level of our opponents by attacking and vilifying one another, or breaking into factions."
Unity, she said, will help fend off challenges from federal and provincial parties on the other side of the political spectrum.
"Our opponents — whether that be in the NDP in Alberta, or the Liberals in Ottawa — have no chance to defeat us when we as a party are strong, unified and boldly governing our province," she said in her keynote address Saturday morning.
Smith's speech Saturday morning was punctuated by resounding applause from the crowd. However, two groups mounted campaigns to vote against her.
The 1905 Committee and Take Back Alberta believe Smith hasn't gone far enough in her campaign promises from the 2023 election. They say she hasn't done enough to seek accountability for vaccine mandates and COVID-related business closures during the pandemic.

David Parker of Take Back Alberta said he accepted the result, as it represented the will of party members.
"I think that she should have probably got a little bit of a worse grade," he said. "But at the end of the day, if this is how the party feels about her, this is how the party feels about her."
Parker said Smith helped herself with her blitz of town halls with UCP members all across the province over the last few months.
"I think people want unity right now, they don't want conflict," Parker said. "It's been a very hard five years for the people in this room, and they just want someone who they believe is going to be their champion."
Time to unite, minister says
Jason Nixon, the minister for seniors, community and social services, said Smith's high approval rating didn't surprise him, as he hears similar favourable comments from his constituents.
"This is Danielle Smith's party," he said. "We're strongly united behind our leader."

As for the groups who opposed her leadership, Nixon asked them to heed what Smith said in her victory speech.
"It's time for us to go back to being a united party, focus on what unites us and stop focusing on what divides us," he said.
"Clearly that's where the majority of our membership is at."
The party passed all 35 policy resolutions slated for debate this year by a wide margin — in many cases, with near-unanimous support.
The resolutions included several dealing with transgender Albertans, including restricting "exclusively female spaces" like washrooms and change rooms to "biological females who were female at conception," and designating gender-affirming procedures like top and bottom surgery as "elective cosmetic procedures" that are not covered by Alberta medicare.
Party members also passed a resolution to abandon net-zero targets, and to recognize CO2 as a "foundational nutrient for all life on Earth" and not a pollutant.

"Smith’s speech Saturday morning came just hours before voting closes on her mandatory leadership review.
Immediately after the speech, in a scrum with reporters, Smith denounced an email circulating at the convention that claimed a “yes” vote for Smith was a vote for Islamic shariah law, calling it “dirty tactics.”
“It’s disappointing to see it from some members within our own party,” Smith said. “I have always said that we have so much in common with our various faith communities on the issue of individual freedom, faith and family.”

One day before a vote on her leadership, Alberta Premier Danielle Smith received loud and boisterous applause from United Conservative Party members at the party's annual general meeting in Red Deer Friday.
Smith and members of her cabinet kicked off the two-day convention with a 'bear pit' question and answer session.
Smith received loud outbursts of applause from the crowd at several points. The party says about 6,000 members have registered to attend the Red Deer convention.
Smith won the leadership of the party two years ago and led the party to a second consecutive majority government last year. According to party rules, she faces a vote on her record on Saturday.
Cabinet ministers and party members were spotted wearing buttons supporting Smith's continued leadership.
Not everyone happy as convention gets underway
But groups like Take Back Alberta and the 1905 Committee are unhappy Smith hasn't implemented some of the promises made during the campaign and plan to vote against her.
Take Back Alberta distributed a "UCP Report Card" on the convention floor Friday. The document gives Smith an overall grade of D on issues like seeking accountability from the previous provincial leaders for implementing vaccine mandates and restrictions during the COVID-19 pandemic and not implementing the warnings they feel are required before allowing children to receive vaccines.
Marco van Huigenbos, a former Smith supporter, plans to vote against her leadership on Saturday. He is unhappy Smith hasn't met the promises she made on pandemic accountability.
While the UCP government introduced bills in the legislature to add vaccine refusal to the Alberta Bill of Rights and restrict gender-affirming care for minors, Van Huigenbos says a sizeable portion of party members are disillusioned because Smith's measures don't go far enough.
"What will this party do to ensure that the demographic that is being abandoned, that is looking for accountability, that's looking for government to come clean with certain aspects of how they handled the province and the ministries during that time," he said.
"How will they connect with these Albertans? Because if they don't, it's only a matter of time before we see a legitimate new party challenge the current establishment."

'A wonderful job,' says supporter
Other party members think Smith is doing a great job. Bill Crawford, a UCP member from Crossfield, came to Red Deer to vote in favour of her leadership.
"She's had a few bumps in the road but other than that she's doing a wonderful job so I really want to support her," he said.
Crawford is not impressed with the groups trying to push her out. He said a premier needs to govern for the entire province, not just a small part of the UCP membership.
"It seems like the conservatives that like to eat their own," he said.

"And I say, no, no, no, she's doing a great job. Who's going to do better?"
Smith will make her pitch to the 6,000 party members who are in Red Deer on Saturday morning. Members will also discuss policy resolutions on Saturday.

Viliam Makis was seeking to appeal the order, which sealed certain confidential information and directed him to destroy other confidential medical information in his and his corporation’s possession.
In a ruling published Tuesday, Justice Frans Slatter ruled Makis’ appeal was without merit and imposed more than $5,600 in court costs on Makis to be paid to Alberta Health Services and the College of Physicians and Surgeons.
Makis had called the costs “threats,” “extortion” and “conspiracy,” the ruling reads, which also notes he had accused Alberta Health Services and the college, along with their lawyers and a dozen judges, of engaging in criminal conduct.
“These arguments are frivolous. There is nothing unlawful about pursuing steps in civil litigation,” Slatter’s ruling states.
Slatter concurred with an earlier ruling that found Makis to be in contempt for violating an order preventing him from filing or attempting to file complaints with any police service without prior permission.
“No arguable error has been shown that would justify an appeal.”
Makis was a nuclear medicine physician at the Cross Cancer Institute until October 2016. His employment was terminated after complaints of professional misconduct, including an incident where he was accused of confronting a colleague — accusing her of lying to a college investigator and threatening her.
His medical services agreement was not renewed, and the college subsequently cancelled his practice permit in 2019.
Makis later sued AHS for wrongful dismissal, but his case was dismissed and he was declared by the court to be a vexatious litigant.
Makis has since made unsubstantiated accusations of pedophiles and child sex traffickers working within the health-care system, falsely claimed that the COVID-19 vaccine killed 80 doctors, and accused without merit medical professionals of covering up sudden deaths caused by the same vaccine.
More recently, he was also among the speakers at the anti-vaccine Injection of Truth town hall put on by Calgary-Lougheed UCP MLA Eric Bouchard in June and has also co-authored a paper positing that the anti-parasitic drug Ivermectin can treat cancer.

Case Summary
The Appellant, Dr. Makis, was a practicing doctor who was terminated after professional complaints were made against him. In turn, he sued the Respondent, Alberta Health Services (“AHS”), for wrongful termination and other physicians for a number of torts related to the complaints. He also alleged a wide-ranging criminal conspiracy involving the Respondents, legal counsel, and the judiciary.
Dr. Makis unsuccessfully applied to have the Respondents declared vexatious litigants. The Respondents successfully applied to strike or summarily dismiss Dr. Makis’ Actions. Dr. Makis was also found to be a vexatious litigant. As a result of that Order, Dr. Makis was required to obtain permission to Appeal the Respondents’ Applications, pursuant to Rule 14.5(1)(j).
The Court considered whether there was an important question of law or precedent, with a reasonable chance of success, and which would not unduly hinder the progress of the Action or cause undue prejudice.
On the Application to have the Respondents declared vexatious litigants, Justice Pentelechuk found that the Appeal lacked a reasonable chance of success. In particular, the Court noted that the Respondents were Defendants in the Action and the proper remedy for unnecessary litigation by a Defendant is a Costs Award.
On the Applications to have Dr. Makis’ Actions dismissed, Justice Pentelechuk granted Dr. Makis leave to Appeal. The Court noted that Dr. Makis failed to attend the proceedings wherein the Applications to summarily dismiss his Actions were heard. However, Justice Pentelechuk stated that the Respondents were not entitled to Summary Judgment by default, and were it not for the vexatious litigant Order, Dr. Makis would be entitled to an Appeal as of right. Leave was therefore granted to Appeal. However, Security for Costs was Ordered against Dr. Makis as a condition of Appeal.

14.5: Appeals only with permission
The Applicant, Dr. Viliam Makis (the “Applicant”), sought permission to Appeal a Decision of the Court of Queen’s Bench dismissing an Application for Judicial Review of the decision of the Complaint Review Committee of the College of Physicians and Surgeons of Alberta (the “College”).The Applicant had filed two complaints with the College pursuant to the Health Professions Act, RSA 2000, c H-7, alleging harassment, abuse, and career sabotage (the “Complaints”). The Complaints Director determined there was insufficient evidence of unprofessional conduct and dismissed the Complaints.
On Application for Judicial Review, the Chambers Judge determined that the Applicant did not have standing to challenge the reasonableness of the Complaint Review Committee’s decision. Further, the Chambers Justice determined that the Applicant was bound by jurisprudence which held that a person who complains to a professional regulatory body has the same interest as any member of the public.
On Appeal, the College did not oppose the Application for permission to Appeal, but did submit that the Applicant’s right to Appeal should be limited to issues of procedural fairness. Khullar J.A. reviewed Rule 14.5 pertaining to permission to Appeal and noted that the test for permission to Appeal may manifest itself differently depending on the subject matter of the Appeal and the overall context of the Appeal. Her Ladyship emphasized that, fundamentally, if the Court is convinced the Appeal has no chance of success, permission to Appeal should not be granted.
Justice Khullar reviewed each of the Applicant’s arguments and found that there was no reasonable chance of success in any of the arguments save for the ones grounded in procedural fairness. Noting that the College’s position on this issue and the relatively low threshold for an arguable case on this basis, Justice Khullar granted the Applicant permission to Appeal limited to the question of procedural fairness.
Calgary lawyer sues Alberta Law Society for professional independence from DIE agenda
Calgary lawyer Roger Song, who has filed a public-interest lawsuit against the Alberta Law Society to defend the profession’s independence from “cultural competence” objectives, draws parallels in the situation to Mao Zedong's China.
Re-education initiatives by the Law Society include Cultural Competence DIE (Diversity Inclusion Equity) and Truth and Reconciliation, with the former focusing on “how systemic inequalities and barriers affect individuals and groups.”
“I was shocked that in order to practice law in Canada I was, just as in China, being compelled to submit to re-education in matters of law, history, politics, society, economics, morality, spirituality and culture,” Song said.
“I found myself captured in the jaws from which I had escaped.”
Song was born in China just before the 1966 Cultural Revolution. Later he taught international law at Peking University, where his students participated in the Tiananmen Square protests of 1989. He immigrated to Alberta in 2000 and began practicing law here in 2014.
Supported by the Council of Alberta Lawyers (CAL,) Song and his lawyer Glenn Blackett filed suit on October 7.
It alleges the law society, established to ensure the public has “access to loyal and competent legal counsel,” has violated the rule of law by assuming a political objective with a prejudice against core Canadian constitutional principles.
There are “two major parts to it,” Blackett told the Western Standard. “One is professional independence. And the other is freedom of conscience.”
He explained professional independence is “a recognized principle in common law jurisdictions that lawyers have a primary duty of loyalty to their clients.”
“And things which interfere with that duty of loyalty are to be avoided, if at all possible,” he said, expanding there are reasonable limits to because some things do “appropriately interfere,” such as the obligation to comply with the law.
“But one of the most significant risks to a lawyer's independence would be to interfere with a lawyer politically,” Blackett said. “To politically interfere with the lawyer so that you try to influence a lawyer to comply with political requests.”
The new cultural conditioning guidance the law society gives its lawyers is "framed fairly broadly,” he said, offering the example of anti-racism.
“The question then becomes, what’s that? If you know your woke ideology, you know that this is a person who is an adherent to critical race theory and believes that you must pursue equity through the dismantling of systemic discrimination.”
A lawyer now has to "adapt [their] communication for enumerated groups," Blackett explained to the Western Standard. "Like how to be culturally competent when [dealing] with Indigenous people."
The new rules mean operating under the assumption the group is “intergenerationally traumatized," he said. Certain “terms are used” and “it's not exactly clear necessarily what those terms mean.”
The Alberta Law Society now wants lawyers like Song and Blackett to implement "inclusive" practices at their office, which probably means things like "asking them about their white privilege when they come in for a job interview."
"When you really employ inclusive hiring, retention, and promotion practices, that seems to mean that you should hire on a quota basis looking at, for example, people's skin color...but it may mean that you hire, retain, and promote people who are ideologically compliant."
The lawsuit argues the law society’s move to require professionals to undergo social re-education training violates Canada’s constitutional principles of parliamentary sovereignty, democracy (including freedom of conscience and expression.) constitutionalism and the rule of law, recognition of the inherent and equal dignity of each individual, personal freedom and respect for minorities (including religious minorities,) and reason (including objectivity and science.)
Song’s lawsuit further alleges the objectives violate “freedoms of religion, conscience, and expression guaranteed under the Canadian Charter of Rights and Freedoms” for professionals, including Song, who believe “that God, and not political ideology, is the supreme source of universal truth and morality.”
Those who uphold this truth believe “people have inherent individual dignity and worth, and that people are essentially the same, regardless of race.”
“My whole life I had been indoctrinated into socialist ideology,” Song said. “It made me a follower of the CCP. But the freedom of conscience I enjoyed in Canada led me to the greatest gift of my life. In 2004 I became a follower of Jesus Christ.”
Song, whose father Xin Ziling wrote books exposing Mao’s Great Leap Forward after serving as a veteran member of the CCP and PLA (People’s Liberation Army), believes politically driven ideology like critical race theory, gender theory, and post-colonialism are “hostile to liberal democracy.”
Blackett pointed out that the federal and provincial legislation governing the judiciary specify a “growing requirement on judges to become educated.”
“Judicial education requirements on judges is now in statute,” he told the Western Standard. “Before a judge can be appointed to the bench they have to complete, or undertake to complete, continuing education related to sexual assault law and social context,” which includes “systemic racism and systemic discrimination.”
"And systemic discrimination is, so far as I understand it, just a loaded word meaning the opposite of equity," he said. ". But you don't really know what kind of education judges are getting, because that's behind closed doors. It isn't public information, per se, even though it would be [paid for by] tax dollars.”
“But nonetheless, it's my law society telling me what I need to do in order to be safe, effective and sustainable.”
Blackett said Song is concerned of the term "entryism," applying to Canada as it does in China, where "you have you have the people and the enemy of the people."
"The people are peasant labourers toiling in the fields," he said. "But if you're a peasant, who says, 'I don't like communism, you've just become the enemy of the state."
“He lived in China, he knows that, basically, you can have all the laws you want. But if you have a political objective floating over the law, that political objective is going to just dissolve the law.”
“There might as well be no laws, ‘just the party line.’”
In China the constitution “says you have free speech, but you don't, because the party line is the more important objective to consider when you're applying the ‘law.’
“So he came to Canada and he sees the same. He sees the same corrosive political objective now being forced on him through his law society. So one of his interests is, I would say, saving Canada from the fate that befell China.”

The Plaintiff seeks an appeal de novo, by way of motion pursuant to
the Federal Courts Rules (SOR/98-106), from an Order made on November
12, 2015, in which Prothonotary Morneau struck the Statement of Claim
in its entirety.
At the outset of the hearing, the Plaintiff brought to my attention a
letter dated September 10, 2004, which he sent to me, in my then
capacity as Past President of the New Brunswick Branch of the Canadian
Bar Association, and the then President of the Branch, Kathleen Quigg,
(now a Justice of the New Brunswick Court of Appeal). In that letter
he stated:
As for your past President, Mr. Bell, may I suggest that you check the
work of Frank McKenna before I sue your entire law firm including you.
You are your brother’s keeper.
Frank McKenna is the former Premier of New Brunswick and a former
colleague of mine at the law firm of McInnes Cooper. In addition to
expressing an intention to sue me, the Plaintiff refers to a number of
people in his Motion Record who he appears to contend may be witnesses
or potential parties to be added. Those individuals who are known to
me personally, include, but are not limited to the former Prime
Minister of Canada, The Right Honourable Stephen Harper; former
Attorney General of Canada and now a Justice of the Manitoba Court of
Queen’s Bench, Vic Toews; former member of Parliament Rob Moore;
former Director of Policing Services, the late Grant Garneau; former
Chief of the Fredericton Police Force, Barry McKnight; former Staff
Sergeant Danny Copp; my former colleagues on the New Brunswick Court
of Appeal, Justices Bradley V. Green and Kathleen Quigg, and, retired
Assistant Commissioner Wayne Lang of the Royal Canadian Mounted
Police.
In the circumstances, given the threat in 2004 to sue me in my
personal capacity and my past and present relationship with many
potential witnesses and/or potential parties to the litigation, I am
of the view there would be a reasonable apprehension of bias should I
hear this motion. See Justice de Grandpré’s dissenting judgment in
Committee for Justice and Liberty et al v National Energy Board et al,
[1978] 1 SCR 369 at p 394 for the applicable test regarding
allegations of bias. In the circumstances, although neither party has
requested I recuse myself, I consider it appropriate that I do so.
AS A RESULT OF MY RECUSAL, THIS COURT ORDERS that the Administrator of
the Court schedule another date for the hearing of the motion. There
is no order as to costs.

Hundreds gather to support ‘Freedom Convoy’ protesters charged with mischief

LETHBRIDGE, AB – A large crowd formed outside of the Lethbridge
Courthouse on Friday, November 4, 2022, showing their support for
three people charged in connection to alleged events at the Coutts
border blockade in February 2022.
The rally was held to show support for Marco Van Huigenbos, 32, of
Fort Macleod; Alex Van Herk, 53, of Fort Macleod; and Gerhard (George)
Janzen, 43, of Taber. They are each charged with one count of mischief
over $5,000.
Benita Pedersen helped with the rally and says she was “blown away” by
how many people showed up and the level of enthusiasm they displayed.
“I am so happy with this turnout, just amazing. An amazing show of
support for Alex, Marco, and George,” says Pedersen. “It just warms my
heart to see all of these people, and what warms my heart even more is
how the people came with a positive attitude of peace and love.”
Members of the Lethbridge Police Service (LPS) attended the rally to
ensure everyone there remained safe.
Officers counted approximately 500 people at the event.
LPS says there were no major issues to report.
“With the exception of a few parking challenges as a result of the
influx of people and vehicles, the gathering was peaceful and no
police action was required,” reads a media release from LPS.
Peter Van Liere also spoke at the rally, saying that when COVID-19
restrictions were first enacted in March 2020, he felt like he was
alone, but the freedom convoy protests restored his faith that things
would get better.
Following their appearance in Lethbridge Provincial Court, the three
men accused made brief remarks to those in attendance at the rally.
Van Herk thanked everyone who came out to show their support, and said
he hopes the court proceedings will be over quickly.
“I think this thing needs to end as soon as possible,” says Van Herk.
Chad Williamson, the lawyer representing Janzen, provided an update on
the courtroom proceedings.
He said that although today’s appearance in Lethbridge Provincial
Court was brief, it was an important one.
Williamson explained that lawyers for both the crown and defense have
decided to proceed by indictment, which gives them the right to be
tried by a judge and jury.
“We believe that 12 randomly-chosen representative jurors reflects the
common-sense, the values, and the conscious of this community and is
very important in this case,” said Williamson. “Once disclosure has
been properly received, we’ll proceed to trial by jury immediately.
There will be no deals and no concessions of any kind.”
The next court appearance for Van Huigenbos, Van Herk, and Janzen is
scheduled for December 12, 2022.

announced Nov. 1 he is no longer seeking a second term.
Livingstone-Macleod MLA Roger Reid has removed himself for the
constituency's United Conservative Party nomination race.
In a post to the constituency association's Facebook page Tuesday,
Reid said he made the decision "after much personal wrestling."
Reid was elected to his first term in 2019, and despite submitting his
papers ahead of the nomination deadline, said he no longer feels it is
possible for him to seek another term.
"The last couple of years have been particularly challenging for our
province," he wrote. "Neither I, nor our government have been perfect,
but I believe the work we have done has put Alberta back on track.
"We are stronger and in a better position to weather the current
storms than we were four years ago."
The MLA will stay in his position until the next election in the
spring and said he will ensure that the concerns and needs of his
constituents are "kept in front of our Premier and her cabinet" until
that time.
During her leadership campaign, Premier Danielle Smith said she
intended to run for the UCP seat in her home riding of

CLARESHOLM, AB – A new MLA will represent the Livingstone-Macleod
riding following the 2023 Alberta provincial election.
MLA Roger Reid has announced that he will not run for re-election and
he is withdrawing his name from the United Conservative Party (UCP)
nomination.
“While I hoped to serve a second term, I no longer feel it is possible
for me to do so,” Reid said in a Facebook post on the
Livingstone-Macleod UCP Constituency Association page.
In an updated statement to LNN, Reid says he would rather focus his
efforts on advancing the many pressing issues in his riding and across
the province than running a re-election campaign.
Some of the issues he says he believes are important to the people of
Livingstone-Macleod include inflation and the rising cost of living,
the availability of ambulance services, and the shortage of family
doctors.
“Because these are important issues for Livingstone Macleod and for
Alberta, I have chosen to put my energies into assisting the Premier
and her Cabinet to ensure real solutions move from discussion to
action,” says Reid in a statement to LNN.
Reid continues, “To ensure this happens, my time and energy is better
spent on these than a nomination race or even an election campaign.
Actually solving these issues and bringing real relief to Albertans is
more important to me than my nomination and political future, and they
will be my focus for the remainder of my term.”
He adds that the last couple of years have been particularly
challenging for the province, and while he nor the provincial
government have been perfect, he believes the UCP government has
successfully put Alberta on track for a strong economic recovery.
The MLA says it has been a privilege to meet with constituents, who
span communities including High River, Claresholm, Fort Macleod,
Pincher Creek, and Crowsnest Pass.
Reid is currently serving his first term as MLA after winning the 2019
vote with over 70% support.
The 31st Alberta general election is scheduled to be held on May 29, 2023.

While other UCP leadership candidates talk to voters, Todd Loewen says
he prefers to listen.
“I was able to hear a lot of people and hear their concerns,” he said
of his campaign in an interview last Friday.
“I always say that I’ve never learned anything while I was talking,
only when I’m listening.”
The Central Peace-Notley MLA hasn’t drawn the attention of the other
candidates for the premier’s job, but insists reflecting the views of
those who elected him is most important to him.
“I plan on living in my community the rest of my life,” Loewen said.
“I hope I can look people in my community in the eye and feel like
I’ve done my best and they feel the same way.”
What those people have told him is at the centre of his leadership
effort, and what he calls a consistent set of concerns he’s heard from
around Alberta.
He says those he’s met with have cited the performance of Alberta
Health Services, the province’s relationship with the federal
government, the UCP’s response to COVID-19 and the rising cost of
living as issues of note.
“I’ve met a lot of really good people and was able to listen to a lot
of people.”
Veteran backbencher
Loewen, 56, has run for office four times, first as a Wildrose
Alliance candidate in 2008.
He was first elected in 2015 as a Wildrose MLA and was re-elected as a
UCP member four years later.
Perhaps once best known for endearing himself to colleagues by making
and serving waffles throughout late-night legislative debates, Loewen
emerged as an unlikely catalyst that ultimately sparked the current
leadership contest.
After publicly criticizing the government’s COVID-19 response, he
resigned as caucus chief in May of last year and posted a public
letter calling on Premier Jason Kenney to resign, “so that we can
begin to put the province back together.”
He and fellow government MLA Drew Barnes were both expelled from the
party’s caucus soon after and have since sat as independent MLAs.
Seventeen months later, he says he has “not even a little bit” of
regret over speaking out.
“The night I got kicked out of caucus I had the best night’s sleep ever.”
‘We wait and we accept what happens’
He says Kenney’s imminent departure helps the party come together
after splintering over the past year.
“Him leaving alone should help a lot of the divisiveness right there.”
Loewen says he has no expectations ahead of Thursday’s results and
hasn’t instructed his supporters on who else to vote for on the
ranked-choice ballot.
“(I’m) just looking forward to hearing what the voters have said. Just
like any other election, we wait and we accept what happens.”
Most pollsters forecast him finishing between fourth and last place
among the seven leadership candidates, though ranked ballot contests
are notoriously unpredictable.
Regardless of the outcome, he hopes his approach is one that can win
the party back the public belief that’s eroded over the prior years.
“The next election will be fought on the issue of trust,” he said.
“Albertans need to choose a leader that they can trust and can build
the trust of other Albertans.”

The UCP only exist because they knew that there's no "united" in
conservatives here and that they could only win by merging parties.

What's to agree with the UCP, given how they have only carried on with
the fiscal ineptitude and poor planning that the Alberta PCs did, ever
since Don Getty was premier of Alberta, by doing well over $60 billion
in very costly debacles and mistakes, giving Alberta a mammoth debt of
well over $100 billion? Giving Alberta the most per capita rate of
people with covid in Canada, many times, and the most per capita rate
of people with covid in all of North America, in May of 2021, also
isn't something to brag about. Neither is treating the vulnerable,
seniors, medical professionals, teachers, students and rural property
owners badly, any good. Alberta can do without the UCP.

Amisk is a village in east central Alberta, Canada in the M.D. of

Carhartts. Sounds like the adult in the room but is connected to a

exploratory committee.
“[W]hat this race needs right now is just not more of the same,”
Sawhney told reporters in a statement.
Children’s Services Minister and Calgary-Shaw MLA Rebecca Schultz
isn’t in the race yet but already has an endorsement from former
Saskatchewan premier Brad Wall. Schultz worked for Wall’s government
before she moved to Alberta in 2016.
Government House leader and chief Kenney lieutenant Jason Nixon is
rumoured to be thinking about running.
So are former cabinet ministers Leela Aheer and Devin Dreeshen.
And Calgary Conservative MP Michelle Rempel Garner is rumoured to be
testing the waters. She would be an interesting addition to the race,
though recent history has not been kind to federal politicians jumping
into provincial politics in Alberta.
The party has appointed a committee that is expected to release rules,
entry requirements and timelines for the leadership race before the
beginning of summer.
UDPATE! Village of Amisk mayor Bill Rock has registered with Elections
Alberta to run in the UCP leadership race. Rock was the Wildrose Party
candidate in the Wetaskiwin-Camrose riding in the 2015 election. He
was parachuted into the riding after previously nominated candidate
Gordon Hatch withdrew from the race and endorsed PC MLA Verlyn Olson
following Danielle Smith‘s floor-crossing.
Note: Registering as a candidate with Elections Alberta does not mean
automatic approval as a candidate by the UCP. Registering with
Election Alberta allows the candidates to fundraise under Alberta’s
current political finance rules.

Minister Toews was elected to the Legislative Assembly of Alberta on
April 16, 2019, as the MLA for Grande Prairie-Wapiti.
A lifelong resident of Alberta, Toews and his wife live in the Grande
Prairie region and have three children and eight grandchildren. He has
considerable business experience, and holds a CPA, CMA accounting
designation and, prior to pursuing business interests, spent twelve

Bernard Bailey Kerik (born September 4, 1955) is an American former
police officer, consultant, 40th Commissioner of the New York Police
Department and convicted felon (tax fraud) for which he obtained the
presidential pardon in 2020.[1]
Kerik joined the New York Police Department (NYPD) in 1986. He is
perhaps best known for his 1998–2000 tenure as commissioner of the New
York City Department of Correction and his 2000–01 tenure as New York
City Police Commissioner, during which he oversaw the police response
to the September 11 attacks. Kerik conducted two extramarital affairs
simultaneously, using a Battery Park City apartment that had been set
aside for first responders at ground zero.[2]
After the 2003 invasion of Iraq, President George W. Bush appointed
Kerik as the interior minister of the Iraqi Coalition Provisional
Authority. In 2004, Bush nominated Kerik to lead the Department of
Homeland Security. However, Kerik soon withdrew his candidacy,
explaining that he had employed an undocumented immigrant as a nanny.
His admission touched off state and federal investigations. In 2006,
Kerik pleaded guilty in Bronx Supreme Court to two unrelated
misdemeanor ethics violations and was ordered to pay $221,000 in
fines. In 2009, Kerik pleaded guilty in the Southern District of New
York to eight federal felony charges, and in February 2010, he was
sentenced to four years in federal prison.[3][4] On February 18, 2020,
President Donald Trump granted Kerik a full pardon.[5] On November 7,
2020, Kerik stood behind Trump's personal lawyer, Rudy Giuliani,
during the Four Seasons Total Landscaping press conference in
Philadelphia, Pennsylvania.[6]

Powell’s legal team in a $1.3 billion defamation lawsuit brought by
Dominion Voting Systems, even as the pro-Trump lawyer faces the threat
of litigation for spreading baseless conspiracy theories about the
company’s voting machines.

Key Facts
Dominion is suing Powell for spreading a baseless conspiracy theory
alleging its voting machines fraudulently flipped votes to Joe Biden.
Wood said on Telegram Friday that Powell called him Thursday night and
asked him to serve as her lead counsel in the case, adding, “I quickly
accepted.”
Powell’s attorney Howard Kleinhendler confirmed to Forbes in an email
that Wood will be joining the legal team.
“Sidney and I will not be intimidated,” Wood wrote, claiming he and
Powell “will not go quietly into the night.”
Wood frequently appeared alongside Powell after the election to push
the Dominion fraud claims and was involved with her lawsuits aimed at
overturning the results of the election.
Dominion has sent a letter to Wood warning it may bring a defamation
lawsuit against him, asked social media networks to preserve his posts
and singled out Wood in its lawsuit against Rudy Giuliani as being
particularly “determined to promote” the conspiracy theory against
them (the company declined to comment on Wood’s involvement in
Powell’s case).

“Get ready to rumble, Dominion,” Wood wrote on Telegram. “You made a
mistake suing Sidney. You are going to pay a heavy price.”
What To Watch For
Wood is facing wide-ranging consequences for spreading conspiracy
theories since the election, which included outlandish claims
involving former Vice President Mike Pence and U.S. Supreme Court
Chief Justice John Roberts. He has been removed from an unrelated
Delaware case over his conduct, and attorneys for MSNBC host Joy Reid
have asked him to be removed as attorney in a separate defamation
case. The Georgia State Bar has also confirmed it is moving forward
with an inquiry into Wood’s mental health in light of his
post-election behavior, which could result in his license to practice
law potentially being revoked.

Wood’s defense of Powell comes after he recently tried to distance
himself from her post-election lawsuits in Wisconsin, Michigan and
Arizona in a court filing in the defamation case against Reid. After
the MSNBC host’s attorney pointed to Wood’s appearance with Powell as
co-counsel in the suits as a reason for him to be removed from her
case, he noted that he was “not counsel of record” in those cases and
did not try to seek privileges to argue the case in court. He did
acknowledge having a larger involvement in Powell’s Georgia lawsuit.

Dominion has launched a large-scale legal effort to seek damages for
the right-wing conspiracy smears it has faced, suing Powell and
Giuliani and vowing subsequent lawsuits that could potentially target
conservative media outlets, Trump allies and potentially even former
President Donald Trump himself. Powell has also been sued by Dominion
competitor Smartmatic over similar claims waged against that company’s
machines, in a $2.7 billion lawsuit that also targets Giuliani, Fox
News and several of its anchors.
