Experts say threats to MPs have escalated since pandemic, convoy protest

The cost of keeping Canada's members of Parliament safe has hit a record high, CBC News has learned.

During the first nine months of this fiscal year, the RCMP spent $2.5 million on security for MPs. If spending continues at the same pace, the cost of MPs' security for this fiscal year could hit $3.4 million — almost double what it cost a year earlier.

Over fiscal 2022/23, the Royal Canadian Mounted Police (RCMP) spent $1.8 million to protect MPs, up from $1.3 million the year before.

The figures obtained from the RCMP do not include the cost of protecting the prime minister. They also don't include spending by other bodies that also provide protection for Canada's 338 members of Parliament, such as local police services, the Parliamentary Protective Service and the House of Commons.

The House of Commons has also taken steps to increase security for MPs but has not said how much it has cost.

While the cost of protecting MPs has been rising, it's still a fraction of the more than $30 million a year it has cost to protect Prime Minister Justin Trudeau and his family over the previous two fiscal years.

Former public safety minister Marco Mendicino said the rising price tag reflects a change in the "threat environment" since the pandemic and the Ottawa convoy protest.

"There's no doubt in my mind that the threat environment has escalated over the last couple of years," he told CBC News. "I think there are a number of reasons for that, one of which is the pervasiveness of disinformation and propaganda online.

"And that has had a real impact when it comes to how people behave, how they mobilize. And so we are seeing threats go up, not only as it relates to ministers, but equally to parliamentarians and, quite frankly, to anyone who serves in public life who has some profile."

RCMP regulations state only a handful of public officials are entitled to RCMP protection "whether or not there is an imminent threat to their security." They include the prime minister, the governor general, Supreme Court justices and cabinet ministers.

The RCMP typically provides protection for political party leaders only during election campaigns. Backbench MPs and parliamentary secretaries usually don't receive RCMP protection.

But the regulations also allow the public safety minister to authorize Mounties to protect any Canadian citizen or permanent resident if the RCMP believes that protection is necessary.

Mendicino said he authorized protection for various MPs as minister and his successor Dominic LeBlanc has continued the practice.

"I was doing it often," said Mendicino, who served as public safety minister from 2021 to 2023. "We were constantly receiving threat assessments, and on the strength of the advice from the public safety agencies, including the RCMP, PPS [Parliamentary Protective Service], sergeant-at-arms, along with the officials that work at Public Safety. This is now very much part of the day-to-day operational environment in which ministers and parliamentarians are offered protection."

While the RCMP won't say who has received protection, NDP Leader Jagmeet Singh is among the MPs who have been spotted accompanied by plainclothes Mounties. RCMP plainclothes officers were seen standing next to Singh during a demonstration on Parliament Hill in September and at the NDP's convention in October. Singh has appeared without security on other occasions.

"We follow the recommendations provided to us by the RCMP regarding security," said Alana Cahill, director of communications for the NDP.

In August 2022, after Deputy Prime Minister Chrystia Freeland was verbally harassed during an event in Grande Prairie, Alta., Conservative Leader Pierre Poilievre said that he had arranged for private security for his family.

"My wife has received so much horrific material directly to her social media account that we have had to hire a private security firm to protect our family against all of that abuse," Poilievre said during a leadership campaign stop.

CBC News has asked the Conservative Party whether Poilievre's family is still being protected by private security, and whether he also benefits from RCMP security. The party has not yet replied.

Bloc Québécois leader Yves-François Blanchet doesn't often get RCMP security, said party spokesperson Joanie Riopel.

"Mr. Blanchet has occasionally benefited from RCMP services, notably during the 2021 election campaign," she said, adding that most of the party's "specific" requests for security protection "are refused." She said the Bloc would like to see the RCMP provide Blanchet with security for what the party considers to be riskier events.

Green Party Co-Leader Elizabeth May said she has only received protection a few times.

"The RCMP only insisted on providing protection once — for the Paris 2015 COP 21, because the terrorist attacks had been so recent," May said in an e-mail response. "They also helped me during the convoy with RCMP help to access West Block. But other than back and forth to the building, they did not stick with me — no need!"

'I've received death threats'

Mendicino said people angry at the government have shown up outside his home.

"I've received death threats," he said. "My family has been the subject of death threats online and I'm not the only one. Many of my colleagues continue to receive threats, are harassed."

He pointed to a recent incident which saw protesters upset with Canada's position on the Israel-Hamas war gather outside Foreign Affairs Minister Mélanie Joly's home in Montreal.

"It is perfectly legitimate for Canadians to protest," Mendicino said. "But once people start to mobilize in front of private residences, and certainly once they move into the space of inciting hatred and violence ... I think that that contributes to the elevated threats that we are seeing towards parliamentarians."

Mendicino said he's also concerned about the effect threatening or abusive emails are having on MPs' staff.

Pierre-Yves Bourduas, a former deputy commissioner of the RCMP and president of P-Y Safety Management, said Mounties are dealing with a threat environment very different from the one that existed only a few years ago.

"Five years ago was a different world than it is today," he told CBC News. "I'm sure you can appreciate that the more polarization you're seeing in Canadian politics, the more there's overt threats against different parties, members that are very vocal."

Bourduas said the pandemic and "public policies that didn't please some" have contributed to the unstable environment the RCMP now has to navigate.

Bourduas said that while the RCMP has taken steps to improve protection and reduce costs, such as centralizing protective policing operations in Ottawa, it's also had to swallow cost increases like a recent 23.7 per cent pay hike for Mounties.

"The cost of policing in our country writ large skyrocketed over the recent past," Bourduas said.

Bourduas and Mendicino agree that costlier security for MPs is likely the new normal.

"Sadly, I don't think this is a one-off or a temporary blip," said Mendicino. "I do think that we are now living in an era where we are beset with disinformation and propaganda and foreign interference and cyberattacks and transnational repression — all of which makes for a very complicated threat environment."

Border workers vote to strike, putting Canada's reopening plans at risk

Canada's reopening plans could be hindered as thousands of border
officers gird themselves for possible strike action.

The two unions representing more than 8,500 Canada Border Services
Agency (CBSA) employees announced this morning that the majority of
their members have given them a strike mandate.

That means they could begin strike action as soon as Aug. 6, mere days
before Canada reopens the border to fully vaccinated U.S. residents,
said the Public Service Alliance of Canada (PSAC) and the Customs and
Immigration Union (CIU) in a news release.

Many border workers would be deemed essential — but the union said
strike action could slow down commercial traffic at the border and
ports of entry, hit international mail and parcel deliveries from
Canada Post and other major shipping companies, and disrupt the
collection of duties and taxes on goods entering Canada.

Prime Minister Justin Trudeau said it has been a tough year for border
guards because, while they have had fewer crossings to process,
they've been tasked with carrying out more stringent checks on
travellers.

"We will be working very closely with the CBSA union to make sure that
we are negotiating, getting to the bargaining table, trying to figure
out a path forward," Trudeau said.

"We recognize that there have been challenges but we're going to work
with them. We're hopeful that there won't be any disruptions."

    Border reopening plan facing roadblock as thousands of border
officials consider strike action

The unions' members — who have been without a contract since June 2018
— include border service officers at airports, land entry points,
marine ports and commercial ports of entry, inland enforcement
officers, intelligence officers, investigators, trade officers,
hearings officers and non-uniformed members.

Their essential services agreement permits 2,600 members to take full
strike action, while essential workers can take work-to-rule actions
in their workplace.
Window to avert strike 'quickly closing'

The unions have been fighting primarily for three things: salary
parity with other law enforcement workers in Canada; better
protections against harassment and discrimination; and a remote work
policy for non-uniformed members.

"Truth be told, the CBSA is a problematic place to work," Mark Weber,
national president of the Customs and Immigration Union, told a news
conference Tuesday.

The union said a number of troubling cases have been forwarded to it
over the past few years — including a report of a male supervisor
physically assaulting a female officer in front of several witnesses
without repercussions and another report of a manager forcing officers
to conduct an illegal strip search of a bus full of students.

government moves to let fully vaccinated tourists visit Canada again.

Chris Aylward, PSAC national president, said the unions are hoping the
government will return to the negotiating table.

"I had a meeting with the prime minister two months ago. I told the
prime minister that if they wanted a smooth reopening of the border,
then they have to come back to the bargaining table with a fair offer,
which we have not seen yet," he said Tuesday.

"Their window to avert a strike is quickly closing."

A spokesperson for the Treasury Board said it believes PSAC rejected a
fair offer.

"We are disappointed that PSAC rejected a fair offer for its members
at the Canada Border Services Agency that included wage adjustments
and provisions in line with recent agreements reached with PSAC and
other bargaining agents that cover over 88 per cent of public
servants," said Geneviève Sicard.

"Going forward, our goal is to take constructive steps to advance
negotiations. We remain open to returning to the bargaining table at
any time."

Last week, when the strike vote was ongoing, the CBSA said the agency
is preparing for a possible work disruption.

action/work disruption in order to maintain the security of our
border, ensure compliance with our laws and facilitate the flow of
legitimate goods and travel," said Louis-Carl Brissette Lesage in an
email to CBC News.

"We expect that our officers will continue to fulfil their duties with
the highest level of integrity and professionalism."

Last week, the federal government announced plans to let fully
vaccinated tourists visit Canada again soon.

Starting Aug. 9 at 12:01 a.m. ET., fully vaccinated U.S. citizens and
permanent residents living in that country will be able to visit
Canada.

The government said it plans to open Canada's borders to fully
vaccinated travellers from all other countries on Sept. 7.

RCMP officers are not immune from criminal liability while doing their jobs, but under the Criminal Code they can get a temporary pass during certain investigations. (CBC)

RCMP officers were given permission to break the law 73 times on the job last year — the highest number on record — according to a new report.

Police officers are not immune from criminal liability while doing their jobs, but a decade-old tweak to the Criminal Code allows for a temporary dispensation during investigations.

The provisions are subject to a legal requirement of reasonableness and proportionality. High-ranking officials can grant permission if they believe breaking the law could save someone's life, protect the identity of an undercover officer or save evidence from being destroyed.          

In 2017, senior officials gave the green light to 94 scenarios, resulting in the 73 committed crimes.

They were mainly linked to organized crime investigations which saw undercover officers taking part in bets, pool-selling, bookmaking and unlawful possession of tobacco products, according to a recent Public Safety report quietly tabled in the House of Commons in late October.

Going back to 2003, the first year the report is available, Mounties have committed just a smattering of green-lit crimes.

On average, they've been authorized to break the law about six times a year, making the 2017 calendar year an anomaly.

Forgery, bribery and other offences


The only other year that saw a spike was 2015, when 20 crimes were committed in the name of anti-corruption and terrorism-related investigations.

That year, the offences ranged from bribery to unauthorized use of a computer and passport forgery.

The crimes vary by year, but often involve forgery and false statements.
During a 2013 terrorism investigation, officers were given authority to provide and make "property or services for terrorist purposes."

Neither Public Safety officials nor the RCMP would explain why 2017 saw a huge spike.

"We are evaluating the increase in the 2016-2017 numbers, but cannot provide any details at this time. We will not speculate on trends related to 2018 statistics," said RCMP spokesperson Sgt. Marie Damian in an email to CBC News.

"RCMP procedures and policies governing undercover activities are continually reviewed to ensure undercover operations are applied pursuant to all laws, procedures, and policies governing undercover operations while not jeopardizing the safety of our members, suspects, their families, or the public."

Bourduas, who now runs PY Public Safety Management Inc., said these operations involve lots of oversight and planning.

"These are highly sensitive cases and operations, and you try to work as many possible scenarios and options, because  this is a very dangerous type of work. Hence the reason why sometimes you ask permission to conduct illegal activities," he said.

"There's also an additional legislative obligation for the officer to report what he's done in the course of his or her investigation because, as we all know, the ultimate consequences, if these officers don't abide by the law, is that a case could be thrown out of court."

Under the law, which was introduced in 2002 after a Supreme Court case, officers are never allowed to cause bodily harm, sexually violate another person or obstruct justice, and an annual report summarizing the crimes has to be tabled in the House of Commons.

During the past 14 years, there has been just one occasion where a designated officer proceeded without a senior official's authorization "due to exigent circumstances."

According to a briefing obtained through access to information, the RCMP asked the federal government to table the 2017 report in June, before Parliament rose for the summer break, but it was put off until late October.

I read the news today about the RCMP lawsuits and just shook my head
at the malicious nonsense but when Guy Versailles laughed at me I got
truly pissed off
