Equal access to justice threatened in the Acadian Peninsula, lawyers say

Fundamental rights are jeopardized by closures of courthouses in northeast and elsewhere, groups say

Lawyers say they're worried about the closure of courthouses underway in the province for the last 15 years, with the Acadian Peninsula the latest region to be hit.

This week, the provincial government announced that the courthouse in Caraquet will close Jan. 1, and its caseload will be transferred to Bathurst, about 66 kilometres away. 

The Tracadie courthouse will become a satellite court, opening only one day a week.

Lawyers who spoke with Radio-Canada say they have fears about how this will impact predominantly French-speaking New Brunswickers in the region, who will be forced to travel farther and face additional costs as a result. 

"It seems we have forgotten that access to justice is a fundamental right recognized by the Charter of Rights and Freedoms," said attorney Euclide Lebouthillier, the vice-president of the Association of French Speaking Jurists of New Brunswick.

This right isn't worth much if citizens don't have the means to exercise it, Lebouthillier said.

"Inevitably what's going to happen is that people are going to renounce their rights recognized under the charter," he said.

The two courthouses that deal with criminal cases in provincial court have been operating on reduced hours since the summer of 2020, the Department of Justice and Public Safety said in a news release this week.  

There has also been a decrease in the volume of cases in the region since 2012, the release said.

"These changes will allow us to make the best use of available resources given the current volume of cases," Justice and Public Safety Minister Hugh Flemming said in a statement.

"Since the Bathurst courthouse has the capacity to absorb these cases, making these changes will allow us to relieve workload pressures for staff and better allocate resources in our court system."

In 2012 ,the Caraquet court saw 1,260 cases but this number had fallen to 711 in 2020, according to numbers provided by the government. The Tracadie courthouse saw 1,061 cases in 2012 compared with 478 in 2020.

"The target for occupancy per courtroom is 1,200 charges per year," said the Justice Department. "It's how the province determines how many courtrooms are needed per location to accommodate the volume."

The chief judge of the provincial court was consulted about closures, the province said Wednesday.

People on low incomes may be hurt most 

Several appearances are often necessary in criminal cases, and the costs associated are not insignificant, said Marc Richard, the general director of the Law Society of New Brunswick.

Lawyers charge extra for any additional time they have to spend travelling, which is why the New Brunswick bar has always promoted an equal distribution of courts around the province. 

"Maybe the person is not guilty, but they want to get rid of the case, so they decide to plead guilty instead," Richard said.

Low-income New Brunswickers in particular will bear the brunt of the government's decision to close the courts, the two lawyers said.

These may not own vehicles and will be forced to take more time off work to get to Bathurst.

The closures could discourage sexual assault victims and women experiencing domestic violence from coming forward, the two also said.  

"The woman, who already is a victim, will only become more victimized as a result," LeBouthillier said.

Those who would normally contest tickets they believe are unjustified might also be deterred, he added.

"He will just pay it because it costs too much to go up to Bathurst."

The two lawyers emphasized that it's not just regular citizens who will be disadvantaged but everyone involved in the justice system.

Eighty to 85 per cent of all cases in the province go through provincial courts like the one in Caraquet, LeBouthillier said. 

Since the court also deals with many cases involving municipal bylaw violations, tickets, and violations of laws protecting the environment and wildlife, police officers and fishing officers that have to testify in these cases will be forced to travel more often. 

"When we send our police officers to Bathurst and then elsewhere, it is again the taxpayers who will have to pay, and police won't be on the territory to do the work they are normally paid to do," LeBouthillier said. 

Administrative staff in the Caraquet courthouse will be forced to move out of the region once the courthouse closes to keep their jobs, he added.

"From a social point of view, for the accused it is a loss. But for society, it entails incredible costs and disorganization."

Lawyers will also be discouraged from establishing themselves in communities such as Caraquet because they will constantly have to be on the move to handle their cases.

Numerous closures since 2007

Premier Blaine Higgs's government isn't the first to close courthouses. The Liberal governments under Brian Gallant and Shawn Graham started closing courthouses in 2007. 

The Graham government closed courthouses in Hampton, Richibucto, Shediac, Sackville, Dalhousie, Neguac, Doaktown, Perth, Shippagan and Sussex. The Gallant government closed the Grand Falls and St. Stephen courthouses.

The Charlotte County courthouse in Saint Andrews closed in 2016.

LeBouthillier wants to see elected officials in the region fight against the decision to closures. It's not just Caraquet and Tracadie that have less access to the justice system, but the entire Acadian Peninsula, he said.

MLAs in all three opposition parties have criticized the decision. 

"Access to justice is a principle part of democracy," Isabelle Thériault, the Liberal MLA for Carquet, said in an interview with Radio-Canada.

"The government has just tabled a reform of local governance [under] the pretext that it wants to develop and give more autonomy, and, a few days later, it announces it is cutting services in our rural Francophone, Acadian, and Liberal regions."

Saint John lawyer named provincial court judge

Marco Cloutier will take bench immediately

Saint John lawyer Marco Cloutier has been appointed New Brunswick's newest provincial court judge.

He will serve on the bench in Saint John, effective immediately, Justice Minister and Attorney-General Marie-Claude Blais announced in a statement on Friday.

Cloutier's appointment will "ensure the timely management of court cases," said Blais.

"He is a well-respected lawyer and has extensive legal experience. I am confident that his leadership will serve the public well and he will be a welcome addition to the provincial court," she said.

Cloutier, a partner at McInnes Cooper, has specialized in insurance law, including coverage issues, personal injury, fatalities, and errors and omission claims against professionals, according to the firm's website.

He successfully conducted the first trial held in New Brunswick addressing the legislation for minor personal injuries arising out of motor vehicle accidents, it states.

Cloutier also developed a procedure unique to New Brunswick for preservation of a claimant’s private Facebook and contents.

In 2010, he was recognized as one of the country's leading lawyers under the age of 40 by Lexpert, a business magazine for lawyers.

Recipients are selected based on a range of criteria, including a successful track record with complex cases, a demonstrated value to their law firm or company, community involvement, being a team leader and being adaptable to change.

Now 22 full-time provincial court judges

Cloutier, who is bilingual, will join Saint John's other two full-time judges — Andrew LeMesurier and Henrik Tonning.

The New Brunswick provincial court system now has a total of 22 judges, eight so-called supernumerary judges, who continue to hear cases in semi-retirement and two per diem judges, as well as the chief judge and associate chief

Cloutier was called to the New Brunswick bar in 1998.

He obtained his law degree at the University of Moncton in 1997. He also has a 1994 Bachelor of Education from the University of Moncton.

In order to be appointed to the provincial court, candidates must have been members in good standing of the New Brunswick Bar for at least 10 years and have undergone a screening process conducted by a committee comprised of members of the public, the practicing bar, and the judiciary, according to the provincial government's website.

Provincial Court judges are appointed by the provincial cabinet.

Three new provincial court judges were appointed in April 2012, including Kenneth Oliver of Fredericton, D. Troy Sweet of Moncton and Brigitte Volpé of Saint-Jacques.

LA RÉVISION DE LA LOI SUR LES LANGUES OFFICIELLES DU NOUVEAU-BRUNSWICK

On se rappellera que, le 15 janvier 2021, le gouvernement du Nouveau-Brunswick avait annoncé la nomination de deux commissaires, « qui entreprendront une révision de la Loi sur les langues officielles »[1], laquelle doit être terminée au plus tard le 31 décembre 2021[2]. Cette annonce, qui était tant attendue, nous avait toutefois laissé sur notre appétit et nous avait déçu dans la mesure où nous constations que le premier ministre persistait à y voir l’occasion de « trouver des manières d’améliorer l’accès aux deux langues officielles pour tous les gens du Nouveau-Brunswick ».

En effet, pareille question est contraire à la raison d’être de la Loi, dont le but, nous dit le législateur, la veille de son adoption, « est de permettre aux citoyens du Nouveau-Brunswick de pouvoir vivre dans leur langue, qu’ils soient francophones ou anglophones »[3].

Le 26 février 2021, on apprenait que la province nommait la juge Yvette Finn et John McLaughlin, ancien sous-ministre du ministère de l’Éducation et du Développement de la petite enfance, comme commissaires chargés d’entreprendre une révision de la Loi. Ces nominations ont malgré tout bien été accueillies par les organismes communautaires acadiens et francophones du Nouveau-Brunswick.

Au début du mois de mai 2021, la province a également dévoilé son nouveau site web (www.nbbilingue.ca), qui est maintenant disponible afin que la population néo-brunswickoise puisse participer au processus de consultation publique en lien avec la révision de la Loi. Sur ce site web, on y retrouve diverses informations, telles qu’une présentation des commissaires et leurs rôles, un questionnaire ouvert au public et la chronologie des étapes du processus de consultation.

Afin de demeurer proactif dans ce dossier d’intérêt, nous avons contacté la commissaire Finn au mois de mai afin de lui demander à être entendus en personne dans le cadre du processus de révision de la Loi. Notre demande a immédiatement été acceptée et l’AJEFNB, par l’entremise de son président, Me Florian Arseneault, et de son directeur général, Me Alexandre Vienneau, a eu l’occasion de rencontrer les commissaires par vidéoconférence le 21 juillet 2021.

Au cours de cette rencontre, notre président et notre directeur général ont discuté avec les commissaires des dispositions de la Loi qui, selon l’AJEFNB, nécessitent des changements substantiels. 

Afin de demeurer concis et de ne pas trop nous éloigner de notre champ d’expertise, nos recommandations et commentaires ont principalement porté sur le domaine juridique. Plus précisément, nous avons mis l’accent sur deux enjeux juridiques où l’AJEFNB a déployé plusieurs efforts et ressources au cours des dernières années : 1) les dispositions entourant le mandat, les pouvoirs, les obligations et le processus de nomination du commissaire aux langues officielles; et 2) l’administration de la justice.

Nous avons également discuté brièvement des autres dispositions de la Loi qui nécessitent des changements, telles que celles qui se rattachent à l’effectivité de la Loi, ainsi que des recommandations antérieures émises par l’AJEFNB lors du dernier processus de révision de la Loi en 2012.

En guise de préparation pour cette rencontre, l’AJEFNB a également préparé un mémoire qu’elle a soumis aux commissaires, lequel sera rendu public dans les prochains jours.

Bien entendu, la révision de la Loi constitue un dossier important actuel pour l’AJEFNB, mais également pour l’ensemble des organismes acadiens et francophones de la province. À cet égard, notre directeur général a participé à plusieurs rencontres menées par la SANB, où l’ensemble des organismes acadiens et francophones ont eu la chance d’articuler leur position sur la question. 

À l’issue de ces rencontres, un consensus clair s’est dégagé : en aucun cas une révision « statut quo » ne sera acceptée par la communauté acadienne et francophone en ce qui concerne la révision décennale de la Loi. À cet égard, l’AJEFNB a d’ailleurs été cosignataire d’un communiqué de presse. 

Bref, d’ici la conclusion de la révision de la Loi, l’AJEFNB va continuer de collaborer étroitement avec les autres organismes acadiens et francophones ainsi qu’avec les représentants du gouvernement afin de faire progresser positivement ce dossier, qui revêt d’une importance primordiale pour la communauté de langue officielle minoritaire du Nouveau-Brunswick.

MODERNISATION DE LA LOI SUR LES LANGUES OFFICIELLES DU CANADA

Le 15 juin 2021, la ministre du Développement économique et des Langues officielles du Canada, Mélanie Joly, a finalement déposé le projet de loi C-32 – La Loi modifiant la Loi sur les langues officielles et apportant des modifications connexes et corrélatives à d’autres lois[4]. Après plusieurs années d’attente, l’AJEFNB a accueilli favorablement ce projet de loi et est heureuse de constater que la majorité des revendications avancées au fil des ans par les communautés francophones en situation minoritaire se retrouvent dans ce projet de loi. 

Somme toute, ce projet de loi est très prometteur et comporte très peu de lacunes. Or, étant donné que la chambre des communes est présentement en pause estivale et le fait que de nouvelles élections pourraient avoir lieu dans un avenir rapproché, mentionnons également qu’il apparait évident que ce projet de loi ne sera pas adopté aussitôt. 

En effet, dans ce contexte temporel, il aurait certainement été souhaitable que ce projet de loi soit déposé plus tôt afin que le processus législatif suive son cours habituel et mène à la sanction royale dudit projet de loi. Dans un scénario où le gouvernement libéral ne serait pas reporté au pouvoir, il y a lieu de s’inquiéter que tout ce processus pourrait tomber à l’eau et que tout serait à recommencer. 

L’AJEFNB est toutefois confiante et espère que la bonne volonté politique de tous les partis primera sur la partisanerie politique afin qu’ils collaborent activement dans ce dossier, qui revêt d’une importante primordiale pour l’avancement et le respect des droits linguistiques des communautés minoritaires francophones du Canada. Chose certaine, l’AJEFNB va continuer de collaborer avec tous les partis et tous les intervenants impliqués dans ce dossier afin qu’une modernisation de la Loi sur langues officiellesdu Canada voie enfin le jour.

ASSEMBLÉE GÉNÉRALE ANNUELLE 2021

Le 4 mai 2021, au nom du président de l’AJEFNB, nos membres ont reçu un avis de convocation leur indiquant que notre assemblée générale annuelle aurait lieu le mercredi 9 juin 2021. Malheureusement, le quorum n’a pas été atteint lors de cette assemblée et, par conséquent, elle a dû être remise au mercredi 23 juin 2021.

En vertu de l’article 7.05 de notre Règlement, notre assemblée générale a donc tout de même pu avoir lieu. Nous profitons d’ailleurs de l’occasion pour remercier ceux et celles qui se sont joints à nous, soit lors de la première tentative d’assemblée, ou encore lors de la deuxième. NOMINATION DE MAÎTRE MARIE-EVE NOWLAN AU CA

Dans les semaines qui ont suivi notre AGA, l’AJEFNB a reçu la candidature de Maître Marie-Eve Nowlan pour pourvoir le poste de représentante de la région Westmorland. Puisque Me Nowlan possède toutes les qualités, compétences et connaissances requises pour occuper ce poste, les membres de notre CA ont favorablement accueilli cette candidature, en adoptant à l’unanimité une résolution ayant pour objet d’entériner sa candidature. 

L’AJEFNB est très heureuse d’accueillir Me Nowlan au sein de son conseil d’administration et elle a bien hâte de collaborer avec elle! Le profil complet de Me Nowlan, qui travaille actuellement comme avocate au cabinet Fidelis Law Droit, à Moncton, sera publié dans les prochains mois.

NOMINATION DE L’HONORABLE JUGE MAHMUD JAMAL À LA COUR SUPRÊME DU CANADA

Le 17 juin 2021, le gouvernement du Canada a annoncé la nomination du juge Mahmud Jamal à la Cour suprême du Canada. À ce sujet, l’AJEFNB a publié un communiqué de presse le 22 juin 2021, lequel est disponible sur notre site web. L’AJEFB se réjouit de la nomination du juge Jamal à la Cour suprême du Canada. Cette nomination survient à la suite du départ à la retraite de la juge Rosalie Silberman Abella. La nomination du juge Jamal, un juge bilingue, s’inscrit comme une action essentielle dans le but d’assurer que l’accès équitable à la justice dans les deux langues officielles soit possible au Canada. Au nom de tous ses membres, l’AJEFNB offre ses plus sincères félicitations au juge Mahmud Jamal.

NOMINATION DE MME MARY SIMON COMME GOUVERNEURE GÉNÉRALE

Le 6 juillet 2021, le gouvernement du Canada a annoncé la nomination de Mme Mary Simon à titre de nouvelle gouverneure générale du Canada.

Mme Simon est une leader inuite au parcours et à l’engagement exemplaire. Au cours de sa carrière, elle a, entre autres, été représentante autochtone lors de négociations entourant le rapatriement de la Constitution canadienne, ambassadrice aux affaires circumpolaires et première Inuk à obtenir un poste d’ambassadrice, au Danemark.

Bien que cette nomination soit une étape historique franchie au pays et un pas en avant pour la réconciliation avec les peuples autochtones, l’AJEFNB déplore le fait que le gouvernement de Justin Trudeau ait nommé une personne qui ne parle pas les deux langues officielles. Dans un pays où le français et l’anglais ont un statut et des droits et privilèges égaux, l’AJEFNB soutient qu’il est nécessaire que les postes de haute importance comme celui de gouverneur général du Canada soient occupés par des personnes maîtrisant les deux langues officielles.

Le statut de professeur émérite est décerné́ par l’Université de Moncton aux professeurs à la retraite dont les dossiers démontrent l’excellence en enseignement et en recherche ainsi qu’en services à la collectivité, la création ou le développement. 

L’AJEFNB désire également féliciter Me Basile Chiasson, c.r., qui est devenu, en mai dernier, le rédacteur en chef du Bulletin des avocats. Pendant de nombreuses années avant sa nomination, Me Chiasson était également le président du comité́ des contributions d’articles pour la publication. 

Le Bulletin des avocats est publié trimestriellement par l’Association du Barreau canadien – Division du Nouveau-Brunswick à l’ensemble de ses membres et comprend des textes de doctrine, le message du président, des notes de cas et des sommaires de décisions, des avis de pratique, les faits saillants de la législation ainsi que des articles de fond.

Acting chief judge and new associate chief provincial court judge appointed

FREDERICTON (GNB) – Mary Jane Richards of Fredericton has been appointed acting chief judge of New Brunswick’s provincial court, while Marco Cloutier of Saint John has been appointed associate chief judge. The announcement was made by Justice and Public Safety Minister Hugh J. Flemming.

“I extend my gratitude to Judge Richards for accepting this acting role. She will provide stability to the leadership and operations of the provincial court in the interim,” said Flemming. “I also congratulate Judge Cloutier, who steps into his new role with experience and insight from his eight years serving as a judge of the provincial court.”

Cloutier’s appointment as associate chief judge is for a seven-year term, replacing Richards who has completed her term in the role. She will serve as acting chief judge on an interim basis and will then return to her role as provincial court judge for Fredericton.

Richards is a graduate of the University of New Brunswick’s law program. She is a former chief sheriff and former assistant deputy minister of court services with the provincial government. She was appointed to the provincial court bench in 2005.

Cloutier obtained his law degree at the Université de Moncton and was called to the New Brunswick bar in 1998. Prior to his appointment to the provincial court in 2013, he was a partner with the Saint John office of a major Atlantic Canadian law firm where he gained experience in litigation and insurance law. In 2010, he was recognized by Lexpert as one of Canada's Top 40 Under 40 leading lawyers.

The appointments are effective today.

 


New chief provincial court judge appointed

FREDERICTON (GNB) – Marco Cloutier, a provincial court judge in Saint John, has been appointed chief judge of the provincial court. The announcement was made today by Justice and Public Safety Minister Hugh J. Flemming.

“We thank Chief Judge Cloutier for accepting this role as chief judge of the provincial court of New Brunswick,” said Flemming. “He brings eight years of experience on the bench, most recently serving as associate chief judge.”

The chief judge oversees the provincial court, which consists of the chief judge, the associate chief judge, 22 other full-time judges, 11 supernumerary judges and two per diem judges.

Cloutier, who is currently the associate chief judge, succeeds Judge Jolène Richard, who has retired.

“We thank Chief Judge Richard for the contribution she has made on behalf of the people of New Brunswick through her work on the bench and leading the provincial court,” said Flemming.

Cloutier obtained his law degree at the Université de Moncton and was called to the New Brunswick bar in 1998. Prior to his appointment to the provincial court in 2013, he was a partner with the Saint John office of a major Atlantic Canadian law firm where he gained experience in litigation and insurance law. Council Members

 History

The Law Society was officially created in 1846. The Provincial Legislative Assembly adopted Chapter 48 of the Provincial Statutes which in effect incorporated what was then called the "Barristers' Society" for the "purpose of securing in the Province a learned and honourable legal profession, for establishing order and good conduct among its members and for promoting knowledgeable development and reform of the law".

While the name of the organisation has changed and is now the Law Society of New Brunswick, its original mandate has remained essentially the same.

It is important to note that the Law Society is an independent body, which has as its primary responsibility the protection of the public in the administration of justice.

The Consolidated Law Society Act, 1996 sets out clearly the objects and duties of the Society.

They are as follows:

(a) to uphold and protect the public interest in the administration of justice,

(b) to preserve and protect the rights and freedoms of all persons,

(c) to ensure independence, integrity and honor of its members,

(d) to establish standards of education, professional responsibility and competence of its members and applicants to membership, and

(e) to regulate the legal profession.

Council

Council

Council is the governing body of the Society in governing and administering the affairs of the Society and must ensure that the Society carries out its purposes.

To fulfill its role and its governance responsibilities, Council shall:

  • set the Society's strategic directions following periodic review;
  • approve the Society's strategic plan and activity plans;
  • approve the Society's annual budget, a policy on reserve funds, and receive regular financial reports from the Executive Director;
  • promote and practice effective governance and evaluate its own effectiveness, as well as the individual effectiveness of Council members through self-evaluation;
  • perform all functions assigned to it by the Law Society Act, 1996, the Law Society General Rules and these policies;
  • oversee the development of standards that the Society is required to develop pursuant to Section 5 of the Act;
  • appoint and receive reports from committees, task forces and representatives to outside bodies as required;
  • ensure that the terms of reference for committees and task forces are current and relevant and that volunteers are appropriately engaged in order to assist Council in carrying out its role;
  • hire and oversee the performance of the Executive Director;
  • be fully informed, through briefings and ongoing dialogue with the stakeholders, of the trends affecting the administration of justice and the legal profession and the risks facing the Society;
  • approve any external relations policy, communications policy, or other policies as necessary; and
  • engage the membership with regard to the work of the Society

Equal access to justice threatened in the Acadian Peninsula, lawyers say

Fundamental rights are jeopardized by closures of courthouses in
northeast and elsewhere, groups say

courthouse on Jan. 1 is an attempt to use resources more efficiently.

Lawyers say they're worried about the closure of courthouses underway
in the province for the last 15 years, with the Acadian Peninsula the
latest region to be hit.

This week, the provincial government announced that the courthouse in
Caraquet will close Jan. 1, and its caseload will be transferred to
Bathurst, about 66 kilometres away.

The Tracadie courthouse will become a satellite court, opening only
one day a week.

Lawyers who spoke with Radio-Canada say they have fears about how this
will impact predominantly French-speaking New Brunswickers in the
region, who will be forced to travel farther and face additional costs
as a result.

"It seems we have forgotten that access to justice is a fundamental
right recognized by the Charter of Rights and Freedoms," said attorney
Euclide Lebouthillier, the vice-president of the Association of French
Speaking Jurists of New Brunswick.

This right isn't worth much if citizens don't have the means to
exercise it, Lebouthillier said.

"Inevitably what's going to happen is that people are going to
renounce their rights recognized under the charter," he said.

The two courthouses that deal with criminal cases in provincial court
have been operating on reduced hours since the summer of 2020, the
Department of Justice and Public Safety said in a news release this
week.

There has also been a decrease in the volume of cases in the region
since 2012, the release said.

"These changes will allow us to make the best use of available
resources given the current volume of cases," Justice and Public
Safety Minister Hugh Flemming said in a statement.

"Since the Bathurst courthouse has the capacity to absorb these cases,
making these changes will allow us to relieve workload pressures for
staff and better allocate resources in our court system."

In 2012 ,the Caraquet court saw 1,260 cases but this number had fallen
to 711 in 2020, according to numbers provided by the government. The
Tracadie courthouse saw 1,061 cases in 2012 compared with 478 in 2020.

The Tracadie courthouse has been operating at reduced levels since the

"The target for occupancy per courtroom is 1,200 charges per year,"
said the Justice Department. "It's how the province determines how
many courtrooms are needed per location to accommodate the volume."

The chief judge of the provincial court was consulted about closures,
the province said Wednesday.

People on low incomes may be hurt most

Several appearances are often necessary in criminal cases, and the
costs associated are not insignificant, said Marc Richard, the general
director of the Law Society of New Brunswick.

Lawyers charge extra for any additional time they have to spend
travelling, which is why the New Brunswick bar has always promoted an
equal distribution of courts around the province.

"Maybe the person is not guilty, but they want to get rid of the case,
so they decide to plead guilty instead," Richard said.

Low-income New Brunswickers in particular will bear the brunt of the
government's decision to close the courts, the two lawyers said.

These may not own vehicles and will be forced to take more time off
work to get to Bathurst.

The closures could discourage sexual assault victims and women
experiencing domestic violence from coming forward, the two also said.

"The woman, who already is a victim, will only become more victimized
as a result," LeBouthillier said.

Those who would normally contest tickets they believe are unjustified
might also be deterred, he added.

"He will just pay it because it costs too much to go up to Bathurst."

The two lawyers emphasized that it's not just regular citizens who
will be disadvantaged but everyone involved in the justice system.

Marc Richard, the general director of the Law Society of New
Brunswick, says lawyers charge for travelling time, which is why the
bar opposes reducing the number of courthouses around the province.

Eighty to 85 per cent of all cases in the province go through
provincial courts like the one in Caraquet, LeBouthillier said.

Since the court also deals with many cases involving municipal bylaw
violations, tickets, and violations of laws protecting the environment
and wildlife, police officers and fishing officers that have to
testify in these cases will be forced to travel more often.

"When we send our police officers to Bathurst and then elsewhere, it
is again the taxpayers who will have to pay, and police won't be on
the territory to do the work they are normally paid to do,"
LeBouthillier said.

Administrative staff in the Caraquet courthouse will be forced to move
out of the region once the courthouse closes to keep their jobs, he
added.

"From a social point of view, for the accused it is a loss. But for
society, it entails incredible costs and disorganization."

Lawyers will also be discouraged from establishing themselves in
communities such as Caraquet because they will constantly have to be
on the move to handle their cases.
Numerous closures since 2007

Premier Blaine Higgs's government isn't the first to close
courthouses. The Liberal governments under Brian Gallant and Shawn
Graham started closing courthouses in 2007.

The Graham government closed courthouses in Hampton, Richibucto,
Shediac, Sackville, Dalhousie, Neguac, Doaktown, Perth, Shippagan and
Sussex. The Gallant government closed the Grand Falls and St. Stephen
courthouses.

The Charlotte County courthouse in Saint Andrews closed in 2016.

LeBouthillier wants to see elected officials in the region fight
against the decision to closures. It's not just Caraquet and Tracadie
that have less access to the justice system, but the entire Acadian
Peninsula, he said.

MLAs in all three opposition parties have criticized the decision.

"Access to justice is a principle part of democracy," Isabelle
Thériault, the Liberal MLA for Carquet, said in an interview with
Radio-Canada.

"The government has just tabled a reform of local governance [under]
the pretext that it wants to develop and give more autonomy, and, a
few days later, it announces it is cutting services in our rural
Francophone, Acadian, and Liberal regions."
