Identity of N.L. lawyer in sexual assault case revealed as top court won't hear anonymity bid
Robert Regular argued publishing name would harm his reputation
The curtain has been lifted on the identity of Newfoundland lawyer Robert Regular, after the Supreme Court of Canada declined Thursday to hear an appeal that would allow him to continue shielding his name from publication.
Until now, Regular, 70, has been known on court dockets in Newfoundland and Labrador only by the initials R.R.
He is facing four counts of sexual assault and one of sexual interference, involving the same alleged victim. She was 12 at the time of the first alleged assault two decades ago.
Three of the charges were laid against Regular in June 2021. The other two charges were filed in January.
Last year, Regular was granted an interim ban in Newfoundland and Labrador Supreme Court, to block his name from being published in relation to those criminal proceedings.
CBC News and CTV News intervened, arguing the ban would interfere with the open-court principle and freedom of the press.
N.L. judge cautioned about 'sea change' in criminal law
In March, Justice James Adams sided with the media organizations.
Adams ruled that granting the publication ban would run counter to the open-court principle and would change the law across Canada.
"If a publication ban were to be issued in this case, then almost anyone charged with a criminal offence could claim the same protection," the judge wrote in his decision.
"This would constitute a sea change in the criminal law. The appropriate authority to make such a change is Parliament, not the court."
Adams found that Regular's presumption of innocence is not at risk if no publication ban is granted.
"In protecting the applicant's reputation by issuing a ban on his identity, the court would be seriously impacting the public interest in encouraging persons with relevant information about similar allegations from coming forward," Adams wrote in his decision.
"It would also negatively impact the public's interest in seeing that all individuals charged with criminal offences are treated fairly and equally."
The judge lifted the ban on Regular's name, but stayed that decision pending Regular's bid to have the Supreme Court of Canada hear the matter.

Regular is being represented by well-known St. John's lawyers Rosellen Sullivan and Jerome Kennedy, as well as Scott Hutchison of the high-profile Toronto law firm Henein Hutchison LLP.
They argued that releasing Regular's identity risked his presumption of innocence, privacy, and the reputation of other professionals in his field.
The lawyers contended that publication of his name would cause lasting damage to Regular, even if he is found not guilty.
"The combined effect of an internet that never forgets and social media's present capacity to amplify irrelevant, inaccurate, or outdated information cannot be overstated," they wrote in the application to the court.

Regular has worked in law for more than three decades as a lawyer on Newfoundland's Avalon Peninsula.
The Law Society of Newfoundland and Labrador has sanctioned him five times since the early 1990s for an array of misconduct relating to the profession — none of which was criminal in nature.
Regular had agreed that the ban could be lifted if he is ultimately convicted.
Victims of sexual assault are automatically protected by a publication ban on their identity because of the nature of the crime.
The accused, however, is not protected by such a ban, unless one is needed to conceal the identity of the victim.
Regular has elected trial by judge and jury. A seven-day trial is scheduled to begin at Newfoundland and Labrador Supreme Court on May 29, 2023.

Jerome Kennedy is an associate with Roebothan McKay Marshall, with over 30 years’ legal experience. In his time at our firm, Jerome has built a practice focused on Personal Injury, Civil Litigation, Corporate-Commercial, and Criminal Law. Especially passionate about wrongful convictions, Jerome helped prove the innocence of Ronald Dalton at the 2005 Lamer Inquiry into Wrongful Convictions in Newfoundland and Labrador. was born in St. John’s. She graduated from University of Ottawa in 1995 with a Master’s of Criminology and from Dalhousie Law School in 1998. Rosellen worked with the Department of Justice until 2006. She was Junior Inquiry Counsel to Commissioner Antonio Lamer at the Lamer Inquiry which examined three wrongful convictions in Newfoundland and Labrador. Her work on the Inquiry led to a keen interest criminal defence law, which she pursued in 2006 when she joined Robert Simmonds, QC. She is also a former member of the Board of Regents at Memorial University.
Rosellen appears in all levels of court including the Supreme Court of Canada. Rosellen has been a director of the Canadian Council of Criminal Defence Lawyers (CCCDL) since 2015. The CCCDL is a national body that represents defence counsel and provides a national perspective on Criminal Justice issues. The CCCDL has been granted intervenor status at the Supreme Court of Canada, and routinely appears before the House and Senate Committees on legal and Constitutional issues. The CCCDL is often consulted on matters of national importance.
On behalf of the CCCDL, Rosellen appeared before the Standing Committee on Justice and Human Rights along with other members in relation to Bill c.75 and changes to the Criminal Code.
Rosellen was named Best Lawyer by her peers in 2020 and has become a senior observing member of The Criminal Lawyers Association.

Scott Hutchison

Scott Hutchison is a partner at Henein Hutchison LLP. His practice includes complex civil, criminal, regulatory and constitutional litigation, with a particular interest in white collar crime and appellate advocacy. He is a Fellow of the American College of Trial Lawyers, a member of the Supreme Court Advocacy Institute and has been recognized in Best Lawyers in Canada for Appellate Law and Criminal Defence and for in Chambers Canada in Dispute Resolution. He was appointed by the Attorney General and the Law Foundation of Ontario to the province’s Class Proceedings Committee.
His recent practice has included advising in relation to the defence of complex class actions, advising clients caught up in business crime investigations, and representing individuals and entities in serious criminal cases at all levels of court. He has argued numerous criminal and civil appeals and trials, including hundreds of matters in the Ontario Court of Appeal and more than two dozen cases in the Supreme Court of Canada. He appears regularly before senior professional discipline tribunals, the Ontario Securities Commission and similar tribunals.
Prior to forming Henein Hutchison LLP, Scott was a partner at a top 10 litigation boutique in downtown Toronto, from 2005 to 2012.
From 1989 to 2005, Scott was counsel at the Crown Law Office-Criminal (Ontario) where he represented the Crown at all levels of court, including hundreds of appearances in the Court of Appeal and numerous appeals in the Supreme Court of Canada.
He is the author of a number of frequently cited legal texts, including Search and Seizure Law in Canada (Carswell); Hutchison’s Search Warrant Manual, 2015 (Carswell); Computer Crime in Canada (with Robert Davis); The Law of Traffic Offences (3d ed.) (2011, Carswell) and is a contributing author of McWilliams Canadian Criminal Evidence (4th) (Canada Law Book).
Scott is a member of the faculty of the National Criminal Law Program. He is one of the Co-Chairs of the Osgoode Professional Development Program National Symposium on Search and Seizure Law in Canada. He is a popular speaker on a variety of legal topics. Scott writes and teaches extensively and was a member of the adjunct faculty of Queen’s University Law School where he taught Trial Advocacy and Appellate Advocacy from 2005 to 2013. From 2006 to 2008 he also taught Advanced Evidence at Osgoode Hall Law School. He is a member of The Advocates’ Society, Criminal Lawyers’ Association, and the International Society for the Reform of the Criminal Law.

Right to Know Week 2018
This year Right to Know Week was celebrated in Canada from September 24–30. In recognition of its importance, the OIPC created a number of fun activities including a Word Jumble and Word Search.
The OIPC also hosted a public panel discussion to discuss strengthening the right to know without hindering decision-making processes. The panelists included Commissioner Molloy, Rob Antle (CBC), Associate Professor Kelly Blidook (MUN), and Rosemary Thorne (MUN).
Finally, the OIPC held a public information session on the ATIPPA, 2015 at the Ross King Memorial Library in Mount Pearl.

New Tools on OIPC Website
Several new tools have been added to the OIPC website including:
1) a video tutorial providing instructions on how to make an Access Complaint;
2) an Access to Information Complaint Checker which, through a short series of questions, allows individuals to determine whether the OIPC can investigate their complaint; and
3) an Estimated Response Time Calculator which assists individuals in determining the latest date on which a public body must respond to an access to information or correction of personal information request.
These tools are aimed at the general public but can also serve as a resource for Coordinators when responding to inquiries from applicants.
Practice Tip — Time Extensions and Disregards
We encourage Coordinators to reach out to our Office if they are contemplating submitting an application for a time extension or disregard. We are available to provide guidance as to what is required for each application and, possibly, offer advice which may assist Coordinators in finding alternative courses of action.

An open letter from Osgoode Hall alumni regarding the CUPE 3903 strike
We are a group of Osgoode Hall Law School alumni writing to you in regards to the CUPE 3903 strike at York University. We wish to address both the administration and students in voicing our support for CUPE 3903 and the law students who are refusing to cross the picket lines in solidarity.
Our Message to the Administration of Osgoode Hall Law School
Why we support CUPE 3903 and Osgoode Hall Law students who refuse to cross the picket lines
The members of CUPE 3903 are exercising their constitutionally-protected rights to strike and bargain. Both of these are hard-fought rights which were only achieved through the hard work of lawyers and labour activists working together on picket lines and in the courts. It is not enough for the legal community to achieve these rights on paper—we must demonstrate our support for workers to actually exercise these rights in a meaningful way.
Further, we support CUPE 3903 in their demands for affordable education, fair compensation, and LGBTQ+ equity. The members of CUPE 3903 are demanding justice, fairness, and fighting against discrimination. These are all things which we, as part of the legal community, hold amongst our highest values and we support them in this struggle.
We fully support all Osgoode Hall students who are refusing to cross the picket lines in solidarity with CUPE 3903. We are aware that some students have expressed a desire to return to classes and have now done so. They mention student debt, high tuition fees, and precarious employment prospects as reasons why they must return. However, these are exactly the reasons why the members of CUPE 3903 are on strike.
We recognize that the decision to respect the picket line and to decline to return to class was a difficult decision for some students, especially as many law students and recently-called lawyers are affected by the same injustices to which the strike can be attributed. Their decision has shown courage. Law is a profession which values community service, justice, equality, and at times, selflessness. By refusing to cross the picket lines, these law students have taken the first of many steps in practicing a profession which will frequently require them to prioritize justice. We will be proud to have them join us as fellow lawyers in the near future.
Our request to the Administration of Osgoode Hall Law School
We are heartened to learn that Osgoode Hall Law School has offered accommodations for students who refuse to cross the picket lines. However, we are disappointed in the Osgoode Hall Faculty Council’s decision to seek an exemption to the strike and resume classes. As alumni of Osgoode Hall, we pride ourselves in being graduates of a law school that teaches and values social justice. This decision by the Faculty Council undermines that commitment and undermines the legitimacy of CUPE 3903’s demands as well as their right to strike and right to bargain.
As the decision to resume classes cannot be reversed, we ask the administration of Osgoode Hall to fervently demand that York University Administration negotiate a fair and reasonable collective agreement with CUPE 3903 that fully addresses the concerns and needs of the bargaining unit.
Our message to the students of Osgoode Hall
Finally, to the students of Osgoode Hall who are refusing to cross the picket lines, we wholeheartedly support you. Although we are no longer students, many of us remember the stress that we felt during times of strike while we were at Osgoode.
Those of us who refused to cross the picket lines in the past do not regret our decisions. When questioned by employers why we had “credit” marked on our transcripts instead of letter grades, we simply explained that it was due to our choices during the strike. In interviews, we were able to talk about our involvement in the strike as an example of a time where we did what we knew was the right thing to do, despite pressure to act otherwise. It prepared us to be lawyers who could take positions that advanced the interests of our marginalized clients, even when it made other lawyers, judges, and players in the legal system uncomfortable or angry. The true measure of our principles comes when they are tested by our self-interest. What kind of lawyers would we be if we didn’t stand up for what was right when it was difficult?
