Conservative MP Ted Falk tabled a bill in June that would make Central Bank Digital Currencies illegal in Canada. CBDC's, if implemented, will be used in conjunction with social credit scores to control where we can go, what we can buy, and even our right to basics like medical care.

We must stop CBDCs!

"Bill C-400, the Framework on the Access to and Use of Cash Act, successfully passed its first reading on June 13, 2024. The bill’s sponsor, MP Ted Falk, explained that Bill C-400 would create a national framework to protect the access and use of cash in Canada. The bill would also amend the Currency Act to limit the finance minister’s ability to unilaterally call in bank notes and amend the Bank of Canada Act, prohibiting the bank from creating a digital currency."

Bill C-400 states clearly that part of its intent is to make it illegal for the Bank of Canada to issue a CBDC.

8 Section 23 of the Bank of Canada Act is renumbered as subsection 23(1) and is amended by adding the following:

Prohibition — central bank digital currency 

(2) The Bank shall not issue a digital form of the dollar.

Cash Protected

It furthermore protects the rights of Canadians to continue to use cash, regardless of what digital currencies might be available:

4.2 (b) protect the ability of persons in Canada to continue to use cash despite the availability of digital currencies, including cryptocurrencies;

Finally, both of these things are spelled out in the summary:

Summary of Bill

This enactment provides for the development and implementation of a framework to ensure that cash continues to be available throughout Canada.

It also amends the Currency Act and the Bank of Canada Act to remove the Governor in Council’s power to call in coins and notes. Finally, it amends the Bank of Canada Act to prohibit the Bank of Canada from issuing a digital form of the dollar.

Deputy Prime Minister Chrystia Freeland defended her government's
decision to invoke the emergency powers now being used to clear
downtown Ottawa, saying Canada's economy and democracy are being
threatened.

"A liberal democracy must be prepared to defend itself," she told a
news conference Friday as police continued to take into custody
protesters demanding the elimination of all pandemic measures who have
gridlocked the capital city for nearly three weeks.

The federal government triggered the Emergencies Act earlier this week
for the first time in the legislation's history. It brought in new
measures prohibiting public assemblies that disrupt the movement of
people, goods and trade, or that support the "threat or use of acts of
serious violence against persons or property."

In a dramatic show of force, a line of police officers — some armed
with weapons, face shields and gas masks — has been moving along
Rideau Street, pushing protesters west and making arrests along the
way.

Police started arresting protesters and towing trucks on Friday as
part of an operation to end a three-week blockade of Ottawa by
hundreds of truck drivers that paralyzed the nation's capital and
prompted the prime minister to invoke emergency powers. (Evan

As of 3:53 p.m. ET, police had taken 70 people into custody and towed
21 vehicles.

At one point, officers smashed the window of an orange vehicle and
arrested the occupant after he locked himself in.

Armoured tactical vehicles were spotted moving up Rideau — a major
downtown artery — with a group of mounted officers nearby.

"When this crisis is over, all of us will need to work hard to heal
our country," Freeland told the news conference.

"But today, our economy and our democracy are facing a serious and
foreign-funded threat. These illegal blockades and occupation cannot
be allowed to usurp the authority of democratically elected
governments."

Some of the protesters on the streets linked arms and sang the
national anthem. Others sat down or kneeled on the ground, refusing to
move.

On Wellington Street, home of the National War Memorial and Parliament
Hill, protesters used shovels and orange and white pylons to build up
a wall of snow.

"You will face severe penalties if you do not cease further unlawful
activity and remove your vehicle and/or property immediately from all
unlawful protest sites," Ottawa police tweeted Friday morning.

Freeland said she takes no satisfaction in seeing the arrests.

"For me this is a day of real sorrow, but also determination," she said.

"And it is a day, I think, where everyone in our government is very resolute."

The government published its reasons for triggering the Emergencies
Act late Wednesday, calling the situation across the country
"concerning, volatile and unpredictable."

"The protesters have varying ideological grievances, with demands
ranging from an end to all public health restrictions to the overthrow
of the elected government," the government statement reads.

"Ideologically motivated violent extremism adherents may feel
empowered by the level of disorder resulting from the protests."

The statement also said border blockades threaten Canada's economic security.

"The impact on important trade corridors and the risk to the
reputation of Canada as a stable, predictable and reliable location
for investment may be jeopardized if disruptions continue," it reads.

For six days last week, protesters blocked access to the Ambassador
Bridge which connects Windsor and Detroit. The vital trade link was
reopened to traffic on Sunday after police moved in.

On Friday, an Ontario judge granted an extension to the injunction
that prohibits anyone from blocking access to the Ambassador Bridge.
The previous order was set to expire Monday.
Debate delayed

A debate in the House of Commons on the government's controversial
decision to invoke the Emergencies Act has been temporarily suspended
as the police operation continues on the parliamentary precinct's
doorstep.

House leaders previously reached a deal to debate the use of the
Emergencies Act on Friday and throughout the weekend, from 7 a.m. ET
to midnight, with a vote planned for Monday.

The extraordinary powers provided by the legislation have been in
effect since Monday, but the Emergencies Act stipulates that the
federal government also must go before Parliament to seek approval
from MPs and senators.

Government House Leader Mark Holland tweeted that he hopes the debate
can resume Saturday.

"We are closely monitoring the police operation in downtown Ottawa
today and will await further advice from security officials on
Parliament Hill on when the House can reopen," he wrote.

A note sent to senators on Friday morning asks them to stay away from
the downtown core.

The Conservatives have argued the government has not backed up its
claim that the demonstrations pose a serious threat to Canada and
can't be dealt with through existing laws.

"We want to lower the temperature across the country. The prime
minister clearly wants to raise it," interim Conservative leader
Candice Bergen said in the House Thursday.

"This is not a game. It comes at the cost to Canadians' rights and freedoms."

The Canadian Civil Liberties Association (CCLA) announced Thursday
that it plans to sue the federal government over its decision to
invoke the Emergencies Act.

"Emergency powers cannot and must not be normalized," said CCLA
executive director Noa Mendelsohn.

NDP Leader Jagmeet Singh said his party plans to support the
Emergencies Act declaration — which would carry it through the
minority Parliament — but is ready to pull its support if the measures
are no longer necessary or if the government takes on additional
powers.

"This is not a protest. It is not peaceful," Singh said during
Thursday's debate.

"The organizers of this illegal occupation have been clear from the
beginning. They came here to overthrow a democratically elected
government."
Downtown Ottawa locked down

Interim Ottawa police chief Steve Bell said the Emergencies Act and
the provincial state of emergency provided police with the resources
they needed to push back and end the demonstration.

"The three levels of government that have come together to support our
efforts in this have led us to be able to have the success we're
starting to see right now," he said Friday.

"Without the authorities provided to us through these pieces of
legislation, we wouldn't be able to be doing the work we are today."

Ottawa's downtown core remains locked down Friday morning, with about
100 checkpoints preventing protesters from entering the zone.

They act also prohibit people from bringing minors near unlawful
assemblies and authorize banks and insurance companies to freeze
participants' accounts and cancel their vehicle insurance.

On Friday, police escorted at least one tearful family with
school-aged children away from the scene.

    Canadian Civil Liberties Association to sue federal government
over Emergencies Act

    Truckers say they'll face arrests peacefully — but will defend their rights

On Thursday, police arrested Chris Barber and Tamara Lich, key
organizers of the protest convoy that began as a demonstration against
vaccine mandates and other pandemic restrictions.

Both are expected to make court appearances on Friday.

According to police, Barber is charged with counselling to commit the
offence of mischief, counselling to commit the offence of disobeying a
court order and counselling to commit the offence of obstructing
police.

Lich has been charged with counselling to commit the offence of
mischief, police said.

CBC News has confirmed another of the convoy leaders, Pat King, was
among those arrested Friday.

It also amends the Currency Act and the Bank of Canada Act to remove the Governor in Council’s power to call in coins and notes. Finally, it amends the Bank of Canada Act to prohibit the Bank of Canada from issuing a digital form of the dollar.

Preamble

Whereas the use of cash is significantly more prevalent among vulnerable population groups such as seniors, Indigenous Peoples, newcomers to Canada and persons with low-income, including those living in poverty or who rely on income assistance programs;

Whereas non-profit organizations and community organizations rely on cash for charitable fundraising activities;

And whereas cash as a form of payment provides a higher level of privacy than digital alternatives and that Canadians’ right to privacy is enshrined in the Canadian Charter of Rights and Freedoms and the Privacy Act, as well as provincial privacy legislation;

Now, therefore, His Majesty, by and with the advice and consent of the Senate and House of Commons of Canada, enacts as follows:

Short Title

Short title

1This Act may be cited as the Framework on the Access to and Use of Cash Act.

Interpretation

Definitions

2The following definitions apply in this Act.

cash means coins and notes referred to in subsection 8(1) of the Currency Act.‍ (espèces)

Minister means the Minister of Finance.‍ (ministre)

Comprehensive Review

Review by Minister

3Within 90 days after the day on which this Act comes into force, the Minister must undertake a comprehensive review of existing legislation, regulations and policies in relation to the availability of cash within financial institutions.

Framework

Development

4(1)The Minister must develop and implement a framework to ensure continued access to cash in Canada.

Contents

(2)The framework must include measures to

  • (a)ensure that all persons in Canada have access to cash by ensuring, among other things, that the necessary infrastructure is present across Canada to allow cash withdrawals and deposits, and determining a reasonable distance for people to travel to withdraw or deposit cash;

  • (b)protect the ability of persons in Canada to continue to use cash despite the availability of digital currencies, including cryptocurrencies;

  • (c)incentivize businesses and creditors to accept payments made in cash;

  • (d)remove barriers and disincentives in relation to donations made in cash to non-profit organizations and community organizations, without compromising efforts to curtail money laundering, fraud and other financial crimes; and

  • (e)ensure the long-term viability of Canada’s cash infrastructure — which includes the equipment and facilities required for the sorting, storing and distribution of cash — by ensuring that it remains effective, resilient and sustainable.

Reports to Parliament

Tabling of framework

5(1)Within 18 months after the day on which this Act comes into force, the Minister must prepare a report setting out the framework and any recommendations related to its development and implementation and cause the report to be tabled in each House of Parliament on any of the first 15 days on which that House is sitting after it is completed.

Publication

(2)The Minister must publish the report on the website of the Department of Finance within 10 days after the report has been tabled in both Houses of Parliament.

Review

6Within three years after the report referred to in section 5 has been tabled in both Houses of Parliament, the Minister must, in consultation with the parties referred to in subsection 4(2), undertake a review of the implementation, effectiveness and social and economic impacts of the framework, prepare a report setting out any findings and recommendations and cause the report to be tabled in each House of Parliament on any of the first 15 days on which that House is sitting after it is completed.

Fair use is one of the limitations to copyright intended to balance the interests of copyright holders with the public interest in the wider distribution and use of creative works by allowing as a defense to copyright infringement claims certain limited uses that might otherwise be considered infringement.[1] The U.S. "fair use doctrine" is generally broader than the "fair dealing" rights known in most countries that inherited English Common Law. The fair use right is a general exception that applies to all different kinds of uses with all types of works. In the U.S., fair use right/exception is based on a flexible proportionality test that examines the purpose of the use, the amount used, and the impact on the market of the original work.

CLAIM
1. The plaintiff, Csaba Vizi, claims against the defendants, the Attorney General of
Canada, Justin Trudeau, Chrystia Freeland, David Lametti, Dominic Leblanc, Bill Blair,
and Marco Mendicino (collectively, the “Government Defendants”):
a) A Declaration pursuant to section 24(1) of the Charter of Rights and Freedoms
that the actions of the Government Defendants unjustifiably violated the
plaintiff’s rights and freedoms, in particular sections 2(b) and (c), 7, 8, 9, and
15.1 of the Charter;
b) damages pursuant to s. 24(1) of the Canadian Charter of Rights and Freedoms;
and
c) general and special damages for malicious prosecution, negligence, and
breach of a fiduciary duty.
2. The plaintiff, Csaba Vizi, claims against the defendants, Royal Canadian Mounted
Police, Mike Duheme, Brenda Lucki, Ontario Provincial Police, Thomas Carrique, Ottawa
Police Service, Ottawa Police Services Board, Eric Stubbs (the “Police Services”), John
Doe 1, John Doe 2, and John Doe 3 (collectively, the “Police Defendants”):
a) A Declaration pursuant to section 24(1) of the Charter of Rights and Freedoms
that the actions of the Police Defendants unjustifiably violated the plaintiff’s
rights and freedoms, in particular sections 2(b) and (c), 7, 8, 9, and 15.1 of the
Charter;

negligence, false imprisonment, and negligent training and supervision, in the
amount of $2,000,000.00; and
3. The plaintiff, Csaba Vizi, claims against all defendants:
a) special damages, including a claim for past and future income loss, a reduced
earning capacity, early retirement, loss of competitive advantage, and also a
claim for homecare, home maintenance, housekeeping, caregiving,
transportation, assistive devices, past and future care costs, psychological and
psychiatric treatment, as well as any other related expenses not paid or
covered by OHIP in the amount of $3,000,000.00;
b) general damages, including those damages that are for pain and suffering,
injury to health, loss of ability to enjoy the normal amenities of life, and personal
inconvenience which flow naturally from the injuries that were sustained in the
incident described in this claim in the sum of $1,000,000.00;
c) Punitive damages in an amount this Honourable Court deems just;
d) pre-judgment interest in accordance with section 128 of the Courts of Justice
Act, RSO 1990, c C42, as amended;
e) post-judgment interest in accordance with section 129 of the Courts of Justice
Act, RSO 1990, c C42, as amended;
f) costs of this action; and
g) such further and other relief as the plaintiff may request and as this Honourable
Court may deem just.

OVERVIEW
4. The plaintiff, a career truck driver, attended the Freedom Convoy in Ottawa and
sustained serious injuries to his wrist, neck, and back when he was violently taken to the
ground and arrested by three unidentified police officers.
5. The injuries have had a devastating impact on the plaintiff’s ability to earn an
income as a truck driver, and he will require care into the future.
6. The defendants are responsible for the damages that flow from the plaintiff’s
injuries.
PARTIES
7. The plaintiff, Mr. Csaba Vizi, is a 52-year-old truck driver who resides in Windsor,
Ontario.
8. The Attorney General of Canada is responsible for administering the justice system
of Canada and protecting the safety of all Canadian citizens.
9. The defendant, Justin Trudeau, is the Prime Minister of Canada. Prime Minister
Trudeau was responsible for enacting the laws and authorizations which led to the
plaintiff’s injuries. Mr. Trudeau’s government was responsible for invoking the
Emergencies Act R.S.C., 1985, c. 22 for the first time in Canadian History.
10. The defendant, Chrystia Freeland, is, and was at all material times, the Deputy
Prime Minister of Canada.
11. The defendant, David Lametti, served as Minister of Justice and Attorney General
of Canada from 2019 to 2023. As such, he was responsible for the Department of Justice

and was responsible for litigating on behalf of the Crown, serving as chief legal advisor to
the Government of Canada.
12. The defendant, Bill Blair, served as Minister of Emergency Preparedness and was
responsible for overseeing and administering the Department of Public Safety and
Emergency Preparedness. Mr. Blair was responsible for ensuring the country was
prepared for true emergencies and that any and all actions taken to advance Canada’s
preparedness to emergencies are done pursuant to all Canadians’ rights.
13. The defendant, Marco Mendicino, was the Minister of Public Safety between
October 2021 and July 2023. Mr. Mendicino was responsible for ensuring public safety in
Canada.
14. The defendant, Royal Canadian Mounted Police (“RCMP”), is the national police
force of Canada and an agency of the Government of Canada. The RCMP, in consort
with other police forces, was one of the police forces that took part in the violent
crackdown on peaceful protesters at the Freedom Convoy.
15. The defendant, Commissioner Mike Duheme, is the current Commissioner of the
RCMP. As such, he is responsible at law for the selection, supervision, training, direction,
and control of all police officers employed by the RCMP.
16. The defendant, Commissioner Brenda Lucki, was the Commissioner of the RCMP
between April 2018 to March 2023, including the time of the incidents that give rise to this
claim. As such, she was responsible at law for the selection, supervision, training,
direction, and control of all police officers employed by the RCMP.
17. The defendant, Ontario Provincial Police (“OPP”), is the provincial police service
of Ontario. The OPP was one of the police forces that took part in the violent crackdown
on peaceful protesters at the Freedom Convoy. Pursuant to section 50(1) of the Police
Services Act, R.S.O. 1990, c.P.15 as amended, and the common law, the OPP is liable

in respect of torts and violations of the Canadian Charter of Rights and Freedoms
committed by employees of the OPP, including the Police Defendants.
18. The defendant, Thomas Carrique, is, and was at all material times, the
Commissioner of the OPP. As such, he is responsible at law for the selection, supervision,
training, direction, and control of all police officers employed by the OPP.
19. The defendant, Ottawa Police Service (“OPS”), is the police service of Ottawa. The
OPS was one of the police forces that took part in the violent crackdown on peaceful
protesters at the Freedom Convoy.
20. The defendant, Ottawa Police Services Board (“OPS Board”), is the governing
body of the OPS and was, at all material times, responsible for the provision of police
services, law enforcement and crime prevention in the City of Ottawa. The OPS Board,
by virtue of section 50(1) of the Police Services Act, R.S.O. 1990, c.P.15 as amended,
and the common law, is liable in respect of torts and violations of the Canadian Charter
of Rights and Freedoms committed by employees of the Ottawa Police Service.
21. The defendant, Eric Stubbs, is the police chief of the Ottawa Police Service. As
such, he is responsible at law for the selection, supervision, training, direction, and control
of all police officers employed by the OPS.
22. The defendants, John Doe 1, John Doe 2, and John Doe 3 (the “Unidentified
Officers”), whose identity is unknown to the plaintiff but is within the unique knowledge
of the Police Defendants, are likely residents of the Province of Ontario. These
defendants were, at all material times, police officers employed with either the RCMP,
OPP, or OPS and were the officers who took down the plaintiff in a violent and
unconstitutional arrest, causing the injuries. The Unidentified Officers may continue to be
employed by the RCMP, OPP, or OPS Board.

BACKGROUND
23. The plaintiff, Csaba (pronounced “Cha-bah”) Vizi is a hard-working Canadian truck
driver. He is one of approximately 120,000 truck drivers who cross the Canada/United
States border each day.
24. In or around January of 2022, Csaba attended the nation’s capital to voice his
concern and disagreement with the government’s then recently imposed requirement to
be twice vaccinated against COVID-19 to cross the border.
25. As a truck driver from Windsor, the border was a near daily travel route for Csaba.
In an instant, he and his colleagues faced the prospect of being unable to work, put food
on the table, or pay the bills necessary to support their families.
26. In response to these unprecedented restrictions on travel, Csaba and thousands
of other truck drivers and Canadians drove to Parliament Hill for a peaceful protest, known
collectively as the ‘Freedom Convoy’. The Freedom Convoy was the largest peaceful
protest in Canada’s history and united citizens across the country.
UNCONSTITUTIONAL CRACK DOWN ON PROTESTERS
27. The peaceful protest ought to have given the federal government pause on its
unprecedented actions in the face of COVID-19. Instead, the government developed an
animus towards the Convoy. The Government Defendants labelled the protest as an
“illegal and dangerous activity”. At press conferences and through statements to the
media the Government Defendants regularly used language designed to turn the
Canadian public against the protest.
28. On February 14, 2022, the Government Defendants, lead by Prime Minister
Trudeau, authorized the invocation of the Emergencies Act; the first time it was enacted
since 1988. Mr. Trudeau and the Government Defendants justified use of the Act,
claiming that the protest was “an illegal occupation”.

29. Under the Emergencies Act, the police services overseeing the Freedom Convoy
were given additional powers to fine and imprison anyone they deemed to be in violation
of municipal by-laws.
30. On January 23, 2024, the Federal Court of Canada ruled that the federal
government’s invocation of the Emergencies Act was unconstitutional and unjustified.
31. The unconstitutional powers and the divisive rhetoric used by the Government
Defendants emboldened police officers to use excessive force on protesters, including
Csaba.
32. On February 19, 2022, at 9:30 a.m., police officers from the RCMP, the OPP, and
the OPS descended on the peaceful protest with now unconstitutional authority to arrest
protestors.
33. As police approached the area where Csaba had parked his truck, Csaba followed
all instructions given to him. He got out of his truck, knelt in front of it, and put his hands
on his head.
34. Suddenly and without warning, Csaba was violently tackled by Unidentified
Officers. The Unidentified Officers forced Csaba to the ground, keeping him face down
in the snow. One of the Unidentified Officers pinned Csaba down, while the other two
unleashed a flurry of punches and knees to Csaba’s stomach, ribs, and back. Csaba was
completely defenceless to the brutal and excessive use of force by the still Unidentified
Officers.
35. Csaba’s arrest and the violence used by the officers was captured on video. The
video ultimately went viral and is still used by media today as an example of the abuse of
power that took place across Parliament Hill in answer to the Freedom Convoy.

36. Once the Unidentified Officers were satisfied with the beating given to Csaba, they
arrested him. Csaba was taken to a warehouse at an unknown location where he was
searched, questioned, and booked for his charges. Hours later, Csaba was released from
the warehouse, in an unknown location, with no means of contacting anyone or of getting
back to safety.
37. Csaba took a guess at which way he should start walking, and after one and a half
hours, he finally came across a person who was willing to help him with directions.
38. Csaba eventually made it back to his hotel room. It was only then that the extent
of his injuries became apparent. His left wrist was in excruciating pain as was his entire
body. Csaba knew something was terribly wrong when he urinated blood. He immediately
went to the Hospital.
39. On February 21, 2022, Csaba went to an emergency room in Ottawa. Csaba was
exhibiting signs of serious injuries, complaining of the blood in his urine, chronic breathing
problems, and pains in his back. He also suffered a fracture to his left wrist that will require
internal fixation surgery to repair and will leave its use extremely limited. Once Csaba
advised the Hospital staff of how he sustained his injuries, he was treated like a second-
class citizen. He was eventually discharged that same day.
40. Csaba’s injuries were caused by the Police Defendants who were emboldened to
act aggressively, violently, and without regard to public safety by the Government
Defendants’ careless and negligent reaction to the peaceful Freedom Convoy.
LIABILITY OF ALL DEFENDANTS
Breach of the plaintiffs’ Charter Rights
41. The plaintiff states that the defendants are liable for violations of his rights pursuant
to sections 7, 8, 9 and 10 of the Canadian Charter of Rights and Freedoms, by virtue of

the facts pleaded. Moreover, these infringements cannot be justified in a free and
democratic society.
Malicious Prosecution
42. The prosecution of Csaba was carried out maliciously, without reasonable and
probable grounds, and for the unlawful purpose of causing injury and damages to him.
The misconduct by all defendants was deliberate and actuated by malice.
43. Without restricting the generality of the unreasonable and malicious conduct of the
defendants, the conduct includes the following:
a) The Police and Government Defendants harboured an animus towards Csaba
due to his disapproval of the Government’s vaccine mandates and his
association with a Freedom Convoy they wrongly perceived to be an “illegal
occupation”;
b) The arrest and subsequent charges against Csaba were initiated and continued
in the absence of reasonable and probable grounds;
c) The arrest of Csaba was actuated by malice; and
d) Csaba suffered embarrassment and loss of reputation, was deprived of his
liberty and experienced financial loss, and the loss of enjoyment of life.
LIABILITY OF THE GOVERNMENT DEFENDANTS
Negligence and Breach of Fiduciary Duty
44. The Government Defendants are liable to the plaintiff for negligence and breach
of a fiduciary duty.
45. All Canadians have an expectation that the Government Defendants, in their roles
as public servants, serve their communities and the public interest without bias, and will
implement laws in a fair and reasonable way. This is a fiduciary duty that the Government
Defendants breached in their response to the Freedom Convoy and the invocation of the
Emergencies Act.

46. The Government Defendants were negligent in invoking the Emergencies Act
because it put lawful and peaceful protesters in danger by giving the Police Defendants
expanded powers which were used to brutalise protesters. Suck a risk was a reasonably
foreseeable outcome and ought to have been avoided.
47. The Emergencies Act defines a national emergency as an urgent and critical
situation that seriously endangers the lives, health or safety of Canadians and is of such
proportions or nature as to exceed the capacity or authority of a province to deal with it,
or seriously threatens the ability of the Government of Canada to preserve the
sovereignty, security, and territorial integrity of Canada. No such national emergency
existed in Ottawa in February 2022 and the Government Defendants knew or ought to
have known this.
Negligence
48. The Government Defendants were negligent in responding to Freedom Convoy
and invoking the Emergencies Act in that:
a) The Government Defendants owed a duty of care to the peaceful protesters
who attended the Freedom Convoy;
b) The Government Defendants fell below its standard of care for peaceful
protesters by authorizing a violent show of force by the police and using the
Emergencies Act unconstitutionally.
c) The Government Defendants breach the duty of care owed to Csaba because
the Government Defendants acted in a way that they knew or ought to have
known would cause an excessive use of force to be shown by police, creating
a foreseeable risk of harm and injury to Csaba and other peaceful protestors.

d) The Government Defendants failed to conduct an adequate security
assessment of the Freedom Convoy to get an accurate understanding of any
real risks posed by the protest when there were, in fact, no risks at all.
LIABILITY OF THE POLICE DEFENDANTS
Abuse of Public Office
49. The Police Defendants are holders of public office. Csaba repeats and relies upon
the facts as set out above and states that the officers deliberately violated the law in failing
to recognize the obvious lack of reasonable grounds for the way they brutalised Csaba
prior to his arrest. In the alternative, the officers were reckless and/or wilfully blind to
whether their actions could be justified in accordance with the law. As holders of public
office, the Police Defendants have a duty to act competently and solely in the public
interest.
50. The conduct of the Police Defendants, as detailed in the above paragraphs, was
deliberate, unlawful conduct done in bad faith in the exercise of public functions. The
Police Defendants were aware or were reckless to the fact that their conduct was unlawful
or was likely to cause injury to Csaba. The Police Defendants acted with malice and/or
for an improper purpose during the arrest of Csaba, and used an extreme amount of force
in executing the arrest.
51. In addition, the Police Defendants failed to act in accordance with the duties
outlined in section 42 of the Police Services Act and engaged in misconduct as defined
in section 80(1) of the Police Services Act.
False Imprisonment
52. The Police Defendants, individually and/or collectively falsely imprisoned Csaba
by intentionally confining him or instructing other officers to confine him on February 19,
2022. The imprisonment constituted an intentional restriction against movement by the

Police Defendants that was against Csaba’s will and the Police Defendants had no legal
justification to detain or imprison Csaba.
Negligent Training and Supervision
53. The defendant Police Services, owed a duty of care to Csaba to ensure that the
Unidentified Officers were properly trained for, and supervised in respect of, their duties
as police officers.
54. The Police Services breached this duty of care and were negligent in supervising
the Unidentified Officers. The negligent actions and/or inaction of the Police Services
caused injury to Csaba, a consequence that these defendants knew or ought to have
known would occur because of their negligence.
55. Without restricting the generality of the foregoing, some of the particulars of the
negligence of the Police Services are as follows:
a) They knew or ought to have known that the Unidentified Officers were
insufficiently trained to be dealing with members of the public;
b) They knew or ought to have known that the Unidentified Officers suffered from
psychological and/or psychiatric problems rendering them unfit to be police
officers;
c) They knew or ought to have known that the Unidentified Officers were unfit to
perform duties reasonably expected of police officers;
d) They failed to ensure that the Unidentified Officers carried out their duties in
accordance with the provisions of the Police Services Act;
e) They failed to maintain appropriate supervision and control over the
Unidentified Officers; and
f) They knew or ought to have known that the Unidentified Officers were
incompetent/and or insufficiently skilled police officers having regard to their
training and experience.

Vicarious Liability of the Guelph Police Services Board
56. The defendants the Royal Canadian Mounted Police, Ontario Provincial Police,
Ottawa Police Service, and Ottawa Police Services Board are responsible for the torts
and Charter breaches committed by the John Doe Officers, as pleaded, by virtue of
subsection 50(1) of the Police Services Act, R.S.O. 1990, c. P.15 as amended, and at
common law.
DAMAGES
Loss of Income
57. As a result of the injuries that Csaba sustained at the hands of the defendants,
Csaba’s competitive position and advantage in the labour market has been compromised
and reduced. Csaba was unable to work for the ten months following his injuries. He is
unable to work as a truck driver now because he cannot sit for prolonged periods of time
or put any pressure or weight on his left hand, particularly to steer and otherwise operate
his truck. He has difficulty lifting things. Csaba will continue to suffer a diminution of
income on a permanent basis and, as such, he claims from the defendants economic loss
suffered, as a result of his injuries, as follows:
a) future loss of income, wages or salaries;
b) loss of economic opportunity;
c) loss of marketability in the job marketplace;
d) loss of competitive advantage at future employment;
e) loss of earning capacity for future income; and
f) loss of insurability for workplace disability coverage.
Future Care Costs
58. As a result of the effects of his injuries on the activities of his daily living, Csaba,
will require considerable future costs for medical, house and home care assistance.

59. Csaba has been unable to carry out his normal tsks of living and has suffered a
loss of enjoyment of life. He will continue to suffer from the effects of his injuries and will
lost enjoyment of live for the balance of his natural life.
60. Csaba is unable to perform household and handyman chores to the extent that he
was able to do so before his arrest and resultant injuries and will require assistance in the
future to complete such chores. Csaba claims the cost of same from the defendants.
Pain and Suffering
61. Csaba has sustained and will continue to sustain pain and suffering, loss of
enjoyment of life and loss of amenities. Csaba is unable to participate in those
recreational, social, household, and athletic activities to the extent to which he
participated in such activities prior to his injuries.
Charter Damages
62. The plaintiff pleads and relies upon the Canadian Charter of Rights and Freedoms,
in particular section 24(1), and state that the plaintiff is additionally entitled to a remedy
that this Honourable Court considers appropriate and just in the circumstances.
Punitive Damages
63. By reason of the facts set out herein and the highhanded, shocking, contemptuous
conduct of the defendants, the plaintiff claims exemplary, aggravated and/or punitive
damages.
64. The plaintiff further pleads that the conduct of the defendants, as described above,
was, among other things, high-handed, vindictive, arrogant, malicious, and reprehensible,
and constituted a complete disregard for the plaintiff’s safety. The plaintiff seeks an award
of punitive and exemplary damages.
LOCATION OF TRIAL
65. The plaintiff requests that the trial of this action take place in Windsor, Ontario.
