RESPONSE OF APPELLANT TO THE NOTICE OF STATUS
REVIEW ORDERED BY MR. JUSTICE J.D. DENIS PELLETIER
DAVID RAYMOND AMOS (AMOS), the Plaintiff/Appellant states that all
delays in the appeal of this matter were caused by the actions and inactions
of the
attorneys acting on behalf of HER MAJESTY THE QUEEN (CROWN), the
Defendant/Respondent. .
AMOS also states that
he disagrees with the statement of Justice
Pelletier
within his order for a status review in that no requisition for a
hearing had been filed
with this court.
The facts supporting
these statements have been properly recorded within the
docket of this matter. In support thereof the facts of this matter are
as follows:
1. This matter was filed in this
court on February 4, 2016. After wards Amos tried to
confer the CROWN counsel as to the contents of the Appeal Book for 30
days..
2. The CROWN would not respond to
the AMOS as to the contents of the appeal
book either by phone or email until the last day of the 30 day time
period. On
February 24, 2016, the CROWN sent a letter to AMOS on a topic that was
not
dispute but it failed to respond to the appellant's calls and emails
about the appeal
book. AMOS did receive from the CROWN various computer generated
responses
acknowledging his emails but no follow up responses. One response from
the
CROWN counsel, Jan Jensen notified AMOS that he would not be in his
office or
respond to voicemails or emails until March 3, 2016. On March 1, 2016,
the
appellant forwarded the letter from CROWN dated February 24, 2016 to the
Register's Office to be filed in the record because the CROWN did not.
It was done
so in order to support a required motion explaining the delay. On March
3, 2016,
when the Crown counsel Jan Jensen returned the appellant's call, he
refused to
discuss the contents of the appeal book and denied receiving any emails
from AMOS
so the appellant ended the call. As AMOS was preparing to file the
required motion
to explain the delay he received a fax from Jan Jensen quoting rules
about the appeal
book and his demands. On March 8, 2016, the appellant filed the
aforesaid letter
because the CROWN did not.

3. In April of 2016, AMOS was
made aware that this complaint, videos, emails and
other documents including one from the US Department of Homeland
Security had
been published within a very egregious website ENCYCLOPEDIA DRAMATICA
which is hosted by a Swedish server under that country's laws. This
complaint was
also under attack within blogs and YOUTUBE controlled by GOOGLE. The
plaintiff/appellant attempted to bring his concerns before this court as
soon as
possible because the recent round of published libel and hate speech
etc. is also being
directed at Prime Minster Trudeau, President Obama and many of their
associates as
well and the law enforcement authorities in Canada, the United States
and Sweden
would do nothing.
4. In March of 2016 AMOS pursuant
to rule 35(2) of the Federal Court Rules
conferred in confidence with the Judicial Administer of the Federal
Court of Appeal
of his wish to bring a motion before this court as soon as possible.
Shortly thereafter
AMOS became aware of the issues mentioned in paragraph 3 of this
submission.
Whereas three Justices of this court would be in Fredericton NB on April
28th, 2016,
AMOS attempted to have an oral motion heard on an emergency basis. AMOS
did
not protest that he was not allowed to be heard because he had a
conflict of interest
with two of the Justices who sat on the bench that day.
5. On May 5th, 2016 the
plaintiff/appellant was surprised to receive a copy of a
letter from the CROWN counsel, Jan Jensen to some unnamed Registry
Officer in
Halifax discussing what had been sent in confidence to the Judicial
Administer of the
Federal Court of Appeal. It was truly amazing to AMOS that a CROWN
counsel was
requesting case management without upholding the Federal Court Rules and filing a
proper motion record etc. It also should be noted that the
plaintiff/appellant was also
surprised to see that the aforesaid confidential communication was filed
in the public
record of this matter. The plaintiff/appellant does protest this action.
It fact he is truly
grateful for the ethical actions of the Registry office because he
believes in the spirit
of full disclosure within a justice system of a purportedly profound
democracy.
6. On December 14th, 2015, after Justice Bell surprised AMOS with his
appearance
on the bench in the Federal Court, the plaintiff/appellant has disclosed
in confidence
with the Registry Offices the Federal Court and the Federal Court of
Appeal the
names of all the Justices with whom he has a conflict of interest with.
This was done
in order offset another delay in his matter being heard and properly
argued in a
timely fashion pursuant to the Federal
Court Rules. Thus far the plaintiff/appellant
has continued to keep the aforesaid list of judges in confidence.
7. The plaintiff/appellant
states that other than Justice Southcott himself during a
hearing on January11th, 2016, no one involved with the Federal Court
system of
Canada has disputed the list of Judges that AMOS has a conflict of
interest with.
Although AMOS within a submission before this court stated that he
disagreed with
some of statements within the order Justice Trudel dated May12th, 2016,
he is
grateful that there was no conflict of interest her and has followed her
orders. AMOS
will follow section (b) of the aforesaid order after he files this
response to the
Notice of Status Review by Justice Pelletier.
Please view the documents in Exhibit C sourced from docket of this
matter.
8. The plaintiff/appellant has
determined that there is no need to file an affidavit to
verify the accuracy of the exhibits because with the sole exception of
one lettter
within exhibit A which was discussed on the public record during the
hearing in
Federal Court on January 11th, 2016 by Justice Southcott and AMOS all
documents
were printed from the files of this court. As AMOS was preparing to mail
this
document to the CROWN on November 18th, 2016 and file it with the
Registry
Office, he was informed that he was one day late because he had erred by
forgetting
that October has 31 days. Thus the Registry Officer stated he would have
to seek
permission from the court to file this in his records. Hence
plaintiff/appellant has
revised this response to apologize to the human error and wishes to
remind the
CROWN of the words of its counsel on January 11th, 2016 in that nothing
nefarious
was intended by AMOS.
