Can it be? Republicans standing up and speaking out for our REPUBLIC! Join me as we welcome a new, BETTER year!!

Today, members of the PA House and Senate request that Sen Mitch McConnell and Rep Kevin McCarthy dispute the PA election results until an investigation is conducted into the numerous claims of fraud. Until this is completed, the hastily certified results can’t be trusted (pt 1)

Thank you for contacting my office. I appreciate hearing your
thoughts, concerns and ideas.

If you are reaching out to my office about COVID-19, you can find the
most accurate, current information about the status of COVID-19 in
Wisconsin at the Wisconsin Department of Health Services’ website
(https://www.dhs.wisconsin.gov/covid-19/index.htm). As governor, it is
my top priority to ensure folks across our state have access to the
most up-to-date information available so you have the resources you
need to make informed decisions to keep yourself, your family, and our
neighbors and communities safe.

The best way to prevent illness is to avoid being exposed to this
virus. Please follow guidance from the Centers for Disease Control and
Prevention (CDC), current as of April 16, 2020, to help take
preventative steps that will limit your exposure and protect yourself
from COVID-19:
•       Stay home as much as possible and avoid close contact with others
•       Wear a cloth face covering that covers your nose and mouth in public settings
•       Clean and disinfect frequently touched objects and surfaces
•       Wash your hands often with soap and water for at least 20 seconds,
especially after going to the bathroom; before eating; and after
blowing your nose, coughing, or sneezing.
o       If soap and water are not readily available, use an alcohol-based
hand sanitizer with at least 60% alcohol. Always wash your hands with
soap and water if they are visibly dirty.
o       For information about handwashing, see the CDC’s Handwashing website.
o       For information specific to healthcare providers, see the CDC’s Hand
Hygiene in Healthcare Settings.
•       Stay home if you are sick, except to get medical care.
My office receives thousands of letters, emails, and phone calls every
day, but I want you to know that we are working on responding to your
message.

Again, thank you for contacting my office. It is an honor to serve you
and to represent the people of our state.

Governor

At the time much of the content on DeepCapture.com was written, the
Great Financial Crisis of 2008 was either on the verge of happening or
had just occurred. In those days, emotions among this publication’s
contributors were raw and, in an effort to get their warnings noticed
and appropriate blame placed, occasionally hyperbolic language and
shocking imagery were employed. Were we to write these entries today,
a different tone would prevail.

Yet, being a record of a pivotal time in our global economic history,
we’ve decided to leave the rawness unedited, with the proviso that
readers take the context of the creation of certain posts into
account, and that those easily offended re-consider the decision to
read them.

Remember what it was like to think dangerously? When expression and
thought weren't throttled. When we questioned everything.

Here’s the news. I’ve a new channel. A new platform. A new paid
subscription membership
(https://lionelmedia.com/membership-account/membership-levels/) . It’s
not on any social media platform. It’s LionelMedia
(https://lionelmedia.com/) . New and improved. Remember when thinking
was dangerous and unregulated? You know. Freedom of speech. Freedom of
thought, expression, belief. Unfettered, unencumbered, unplugged.
Remember? Sounds too good to be true. But it’s happening. Here
(https://lionelmedia.com/membership-account/membership-levels/) .
Countering the deep state, police state, intel state, shadow
government and ruling class #BigTech fascists. Ahem.

My story. Tuesday morning, 11 September 2001 CE. Redpilled. Big time.
Everything changed for me and I haven’t been the same since. I was in
NYC and couldn’t believe what I was seeing. And then I couldn’t
believe what I was reading and seeing on TV. But the truth was online.
This was before social media and Twatter, Fecesbook and that other
thing. It was Wild West Internet. The theories and hypotheses were
exploding. Many daft, many deranged and many spot-on and deadly
accurate. Perfect. We were called Truthers. Translation: People who
didn’t believe the official account (for a variety of reasons).
Imagine that, derided for wanting the truth. And it was fun and cool
and dangerous. And great.

But wait, there’s more. If you want to question vaccine safety
especially as to kids and you’re not RFK Jr. with Kennedy immunity,
you’re an Anti-Vaxxer and you’re off social media. Remember in 2016
when tough guy wannabe and overrated actor Bobby De Niro dared to
screen “Vaxxed: From Cover-Up to Catastrophe”? Seems that tough guy
Bobby got whacked and backed down. As the NYT reported
(https://www.nytimes.com/2016/03/27/movies/robert-de-niro-pulls-anti-vaccine-documentary-from-tribeca-film-festival.html)
: “Facing a storm of criticism over its plan to show a documentary
about the widely debunked link between vaccines and autism, the
Tribeca Film Festival on Saturday pulled the film from its schedule
next month.” Did you catch that? Widely debunked link between vaccines
and autism. You’d better say it’s debunked or you’ll go the way of
Jenny McCarthy. Who? (Precisely.)

I said there was more. Doubt that UBL was dispatched in a gun battle
in Abbottabad and tossed into the drink à la Luca Brasi with not one
single morgue shot available and question the seemingly endless
passels of ex-Navy SEALs who swear they single-handedly plugged Osama
bin Forgotten, you’re a Deather. Ditto for questioning Saddam’s phone
cam dispatch. Unsure as to Barry O’s provenance (and you can think
Hillary C for that one), you’re a Birther (and a racist). Think that
masks don’t work (as Fauci said repeatedly) other than to steam up
glasses and perpetuate the culture of anonymity, you’re a Masker. (OK,
I made that one up). Bottom line, if you don’t regurgitate the pap,
the story line, you’re on your own. And for most folks they couldn’t
care less. Just let them pose half nude in front of a bathroom mirror
or perseverate the illusion and fantasy of hotness via beauty app and
they’re fine. That’s the way it works. Addict folks to social media
and then demand that they abide by the
rules of insipidity or lose their exhibitionist license. Sorry,
Sparky, not for me.

Then, it all changed. After social media hooked everyone with an
unlimited narcissism stage it changed the rules. Don’t talk at all of
the aforementioned or anything about hydroxychloroquine, stolen
elections, Biden’s profligate son, China, geoengineering, the
conspiracy theory du jour, pro-Trump ideations, “hate speech” and any
of the forbidden phobias or Poof! Off you go. Be gone. Demonetization,
shadow-banning, prohibition in toto, suspension, exceptions, labeling,
cautionary warnings. Systematic destruction of random and erstwhile
protected thought. You will be relegated and exiled in social media
Elba.

I need my own platform. I'm being second-guessed, sanctioned,
penalized, throttled, demonetized. And for what exactly? Especially
now with a spate of ex-Mafia made channels regaling you with lurid
tales of hits and murder and "the life." (Whither omertà?) That’s OK.
But dare to discuss COVID therapeutics and you’re Elvis. Sorry. Look,
there’s nothing wrong with making money from the dissemination of
opinion and analysis. We’re capitalists, after all. (That’s still
legal. Right, AOC?) I want to say what I want and share it with the
world for comments and reactions and reasonable pecuniary support.
It’s what I’ve been doing professionally for 33 years inter alia.
Heritage MSM news platforms are dead. Shock jocks are dinosaurs.
Nothing shocks anymore. Other than the level of censorship. The only
thing available of any informational truth value is citizen/civilian,
alternative and foreign media. And this.

Overstock's colorful founder has tales to tell about the Russia hoax
By Andrea Widburg

Patrick Byrne, Overstock's founder, has long suspected that Obama set
up a police intelligence state that's been calling the shots in
American politics since 2015.  On Sunday, he pushed back against those
of Trump's legal advisers demanding surrender.  On Tuesday, he claimed
that Obama had blackmailed Hillary Clinton to own her politically.  If
that's true, what Byrne is saying can upend the American political
scene.

The New Yorker profiled Byrne early in December.  Sheelah Kolhatkar,
who wrote the profile, thinks Byrne is probably as crazy as John
McAfee, with both given over to life-destroying conspiracy theories.
Kolhatkar plays fair, though, and cannot deny his brilliance.

    Former employees describe a memory trick he likes to perform, in
which he studies a deck of cards for a few minutes and then recites
back the order of the cards, one by one. "When he's on, he's smart,
charming, complex, and brilliant," Marc Cohodes, who was once a critic
of Overstock and is now an investor in the company, told me.

While Byrne may be eccentric, he's often right.  He was the first to
realize that investment firms and stock traders were colluding to
drive stock prices down.  He was accused of being paranoid, but the
financial crisis proved he was correct.  Additionally, while Byrne's
tales about his adventures sound like fiction, that doesn't mean they
are:

    David Luban, a professor of law at Georgetown University who has
known Byrne since teaching him as an undergraduate, observed that
improbable things seem to happen to Byrne with remarkable frequency.
"He's a hard man to bet against," Luban said. "So many of his stories
that have seemed utterly incredible turn out to be true."

Byrne's biggest adventure was his relationship with Maria Butina, who
was later convicted of acting as an unregistered Russian foreign
agent.  When she approached him, he was worried enough to report that
fact to the FBI and was surprised when the Fibbies were unconcerned.
Throughout their one-and-a-half-year affair, Byrne kept the FBI
apprised.

Eventually, Byrne decided that the FBI were the baddies, and were
setting up Butina, who was arrested in July 2018:

    By then, Byrne's suspicions about the F.B.I. had crystallized into
a belief that he had been part of a plot by high-ranking members of
the Obama Administration to commit political espionage, in an attempt
to control the next President.

Byrne also claims that the Obama administration planned the Russia
hoax as early as 2015:

    According to the government's version of events, the F.B.I. opened
Crossfire Hurricane, its investigation into possible ties between the
Trump campaign and the Russian government, on July 31, 2016, after it
found out that the Trump campaign adviser George Papadopoulos had told
an Australian diplomat that he'd heard that Russians had compromising
information about Hillary Clinton. Byrne claims that it all really
started a year earlier, when the F.B.I. became aware of his
relationship with Butina.

We know that the government's account — that they opened the
investigation on July 31, 2016 — is a lie.  A July 28, 2016 Peter
Strzok text to Lisa Page refers to already open counter-intelligence
investigations.  Moreover, Clinton and the DNC had hired Fusion GPS in
April 2016 to investigate Trump's alleged Russian ties.  Byrne thinks
Strzok was an architect of the Russia hoax and used Byrne's
relationship with Butina to further it.

Strzok denies all knowledge of Bryne and Butina.  As a reminder, this is Strzok:

Peter Strzok's creepy smirks freak out Twitter audience

On Sunday, Bryne spoke about a meeting in the Oval Office and claimed
that Trump's legal advisers are betraying him by urging him not to
fight massive election fraud:

Now Byrne has gone on record to say that he was part of a 2015 sting
operation that saw Hillary accept multi-million-dollar bribes from
foreign governments.  Byrne thought the sting was to reveal Hillary's
criminality, only to discover that it was to give Obama a hold over
her when (as everyone assumed) she entered the White House.  You can
see the video clip here in which Byrne explains that Obama had used
the Deep State to set up a blackmail operation.

The big question is whether Byrne is a fabulist, whose utterances we
should ignore — or is he, instead, a brilliant, successful, connected,
often prescient man who's currently a voice in the wilderness and
should be taken very seriously?  I don't have an answer for that, but
his statements seem consistent with what we know about Hillary's
corruption and the Obama Deep State, including the FBI.

***Please be advised that this email address is no longer in use***

Thank you for taking the time to write to me. Feedback from the people
we represent is always extremely valuable for members of parliament,
and especially valuable to me as Prime Minister.

However as you can imagine I receive a very large, sometimes
dauntingly large, amount of correspondence and it is important that we
do everything we can to respond to it as quickly and effectively as
possible.

So to help us best direct your enquiry and respond to it, please
complete this contact form. If you have written a detailed message in
your email, just cut and paste it into the contact form and complete
the details requested.

If you would like to invite me or Lucy to an event, please forward the
invitation to pminvites@pmc.gov.au.

If you are a Wentworth constituent, please make us aware of this and
my electorate office team in Edgecliff will be in touch.

Regards,

Malcolm Turnbull

>>> REASONS FOR JUDGMENT BY THE COURT
>>>
>>> I.                    Introduction
>>>
>>> [1]               On September 16, 2015, David Raymond Amos (Mr. Amos)
>>> filed a 53-page Statement of Claim (the Claim) in Federal Court
>>> against Her Majesty the Queen (the Crown). Mr. Amos claims $11 million
>>> in damages and a public apology from the Prime Minister and Provincial
>>> Premiers for being illegally barred from accessing parliamentary
>>> properties and seeks a declaration from the Minister of Public Safety
>>> that the Canadian Government will no longer allow the Royal Canadian
>>> Mounted Police (RCMP) and Canadian Forces to harass him and his clan
>>> (Claim at para. 96).
>>>
>>> [2]               On November 12, 2015 (Docket T-1557-15), by way of a
>>> motion brought by the Crown, a prothonotary of the Federal Court (the
>>> Prothonotary) struck the Claim in its entirety, without leave to
>>> amend, on the basis that it was plain and obvious that the Claim
>>> disclosed no reasonable claim, the Claim was fundamentally vexatious,
>>> and the Claim could not be salvaged by way of further amendment (the
>>> Prothontary’s Order).
>>>
>>>
>>> [3]               On January 25, 2016 (2016 FC 93), by way of Mr.
>>> Amos’ appeal from the Prothonotary’s Order, a judge of the Federal
>>> Court (the Judge), reviewing the matter de novo, struck all of Mr.
>>> Amos’ claims for relief with the exception of the claim for damages
>>> for being barred by the RCMP from the New Brunswick legislature in
>>> 2004 (the Federal Court Judgment).
>>>
>>>
>>> [4]               Mr. Amos appealed and the Crown cross-appealed the
>>> Federal Court Judgment. Further to the issuance of a Notice of Status
>>> Review, Mr. Amos’ appeal was dismissed for delay on December 19, 2016.
>>> As such, the only matter before this Court is the Crown’s
>>> cross-appeal.
>>>
>>>
>>> II.                 Preliminary Matter
>>>
>>> [5]               Mr. Amos, in his memorandum of fact and law in
>>> relation to the cross-appeal that was filed with this Court on March
>>> 6, 2017, indicated that several judges of this Court, including two of
>>> the judges of this panel, had a conflict of interest in this appeal.
>>> This was the first time that he identified the judges whom he believed
>>> had a conflict of interest in a document that was filed with this
>>> Court. In his notice of appeal he had alluded to a conflict with
>>> several judges but did not name those judges.
>>>
>>> [6]               Mr. Amos was of the view that he did not have to
>>> identify the judges in any document filed with this Court because he
>>> had identified the judges in various documents that had been filed
>>> with the Federal Court. In his view the Federal Court and the Federal
>>> Court of Appeal are the same court and therefore any document filed in
>>> the Federal Court would be filed in this Court. This view is based on
>>> subsections 5(4) and 5.1(4) of the Federal Courts Act, R.S.C., 1985,
>>> c. F-7:
>>>
>>>
>>> 5(4) Every judge of the Federal Court is, by virtue of his or her
>>> office, a judge of the Federal Court of Appeal and has all the
>>> jurisdiction, power and authority of a judge of the Federal Court of
>>> Appeal.
>>> […]
>>>
>>> 5(4) Les juges de la Cour fédérale sont d’office juges de la Cour
>>> d’appel fédérale et ont la même compétence et les mêmes pouvoirs que
>>> les juges de la Cour d’appel fédérale.
>>> […]
>>> 5.1(4) Every judge of the Federal Court of Appeal is, by virtue of
>>> that office, a judge of the Federal Court and has all the
>>> jurisdiction, power and authority of a judge of the Federal Court.
>>>
>>> 5.1(4) Les juges de la Cour d’appel fédérale sont d’office juges de la
>>> Cour fédérale et ont la même compétence et les mêmes pouvoirs que les
>>> juges de la Cour fédérale.
>>>
>>>
>>> [7]               However, these subsections only provide that the
>>> judges of the Federal Court are also judges of this Court (and vice
>>> versa). It does not mean that there is only one court. If the Federal
>>> Court and this Court were one Court, there would be no need for this
>>> section.
>>> [8]               Sections 3 and 4 of the Federal Courts Act provide
>>> that:
>>> 3 The division of the Federal Court of Canada called the Federal Court
>>> — Appeal Division is continued under the name “Federal Court of
>>> Appeal” in English and “Cour d’appel fédérale” in French. It is
>>> continued as an additional court of law, equity and admiralty in and
>>> for Canada, for the better administration of the laws of Canada and as
>>> a superior court of record having civil and criminal jurisdiction.
>>>
>>> 3 La Section d’appel, aussi appelée la Cour d’appel ou la Cour d’appel
>>> fédérale, est maintenue et dénommée « Cour d’appel fédérale » en
>>> français et « Federal Court of Appeal » en anglais. Elle est maintenue
>>> à titre de tribunal additionnel de droit, d’equity et d’amirauté du
>>> Canada, propre à améliorer l’application du droit canadien, et
>>> continue d’être une cour supérieure d’archives ayant compétence en
>>> matière civile et pénale.
>>> 4 The division of the Federal Court of Canada called the Federal Court
>>> — Trial Division is continued under the name “Federal Court” in
>>> English and “Cour fédérale” in French. It is continued as an
>>> additional court of law, equity and admiralty in and for Canada, for
>>> the better administration of the laws of Canada and as a superior
>>> court of record having civil and criminal jurisdiction.
>>>
>>> 4 La section de la Cour fédérale du Canada, appelée la Section de
>>> première instance de la Cour fédérale, est maintenue et dénommée «
>>> Cour fédérale » en français et « Federal Court » en anglais. Elle est
>>> maintenue à titre de tribunal additionnel de droit, d’equity et
>>> d’amirauté du Canada, propre à améliorer l’application du droit
>>> canadien, et continue d’être une cour supérieure d’archives ayant
>>> compétence en matière civile et pénale.
>>>
>>>
>>> [9]               Sections 3 and 4 of the Federal Courts Act create
>>> two separate courts – this Court (section 3) and the Federal Court
>>> (section 4). If, as Mr. Amos suggests, documents filed in the Federal
>>> Court were automatically also filed in this Court, then there would no
>>> need for the parties to prepare and file appeal books as required by
>>> Rules 343 to 345 of the Federal Courts Rules, SOR/98-106 in relation
>>> to any appeal from a decision of the Federal Court. The requirement to
>>> file an appeal book with this Court in relation to an appeal from a
>>> decision of the Federal Court makes it clear that the only documents
>>> that will be before this Court are the documents that are part of that
>>> appeal book.
>>>
>>>
>>> [10]           Therefore, the memorandum of fact and law filed on
>>> March 6, 2017 is the first document, filed with this Court, in which
>>> Mr. Amos identified the particular judges that he submits have a
>>> conflict in any matter related to him.
>>>
>>>
>>> [11]           On April 3, 2017, Mr. Amos attempted to bring a motion
>>> before the Federal Court seeking an order “affirming or denying the
>>> conflict of interest he has” with a number of judges of the Federal
>>> Court. A judge of the Federal Court issued a direction noting that if
>>> Mr. Amos was seeking this order in relation to judges of the Federal
>>> Court of Appeal, it was beyond the jurisdiction of the Federal Court.
>>> Mr. Amos raised the Federal Court motion at the hearing of this
>>> cross-appeal. The Federal Court motion is not a motion before this
>>> Court and, as such, the submissions filed before the Federal Court
>>> will not be entertained. As well, since this was a motion brought
>>> before the Federal Court (and not this Court), any documents filed in
>>> relation to that motion are not part of the record of this Court.
>>>
>>>
>>> [12]           During the hearing of the appeal Mr. Amos alleged that
>>> the third member of this panel also had a conflict of interest and
>>> submitted some documents that, in his view, supported his claim of a
>>> conflict. Mr. Amos, following the hearing of his appeal, was also
>>> afforded the opportunity to provide a brief summary of the conflict
>>> that he was alleging and to file additional documents that, in his
>>> view, supported his allegations. Mr. Amos submitted several pages of
>>> documents in relation to the alleged conflicts. He organized the
>>> documents by submitting a copy of the biography of the particular
>>> judge and then, immediately following that biography, by including
>>> copies of the documents that, in his view, supported his claim that
>>> such judge had a conflict.
>>>
>>>
>>> [13]           The nature of the alleged conflict of Justice Webb is
>>> that before he was appointed as a Judge of the Tax Court of Canada in
>>> 2006, he was a partner with the law firm Patterson Law, and before
>>> that with Patterson Palmer in Nova Scotia. Mr. Amos submitted that he
>>> had a number of disputes with Patterson Palmer and Patterson Law and
>>> therefore Justice Webb has a conflict simply because he was a partner
>>> of these firms. Mr. Amos is not alleging that Justice Webb was
>>> personally involved in or had any knowledge of any matter in which Mr.
>>> Amos was involved with Justice Webb’s former law firm – only that he
>>> was a member of such firm.
>>>
>>>
>>> [14]           During his oral submissions at the hearing of his
>>> appeal Mr. Amos, in relation to the alleged conflict for Justice Webb,
>>> focused on dealings between himself and a particular lawyer at
>>> Patterson Law. However, none of the documents submitted by Mr. Amos at
>>> the hearing or subsequently related to any dealings with this
>>> particular lawyer nor is it clear when Mr. Amos was dealing with this
>>> lawyer. In particular, it is far from clear whether such dealings were
>>> after the time that Justice Webb was appointed as a Judge of the Tax
>>> Court of Canada over 10 years ago.
>>>
>>>
>>> [15]           The documents that he submitted in relation to the
>>> alleged conflict for Justice Webb largely relate to dealings between
>>> Byron Prior and the St. John’s Newfoundland and Labrador office of
>>> Patterson Palmer, which is not in the same province where Justice Webb
>>> practiced law. The only document that indicates any dealing between
>>> Mr. Amos and Patterson Palmer is a copy of an affidavit of Stephen May
>>> who was a partner in the St. John’s NL office of Patterson Palmer. The
>>> affidavit is dated January 24, 2005 and refers to a number of e-mails
>>> that were sent by Mr. Amos to Stephen May. Mr. Amos also included a
>>> letter that is addressed to four individuals, one of whom is John
>>> Crosbie who was counsel to the St. John’s NL office of Patterson
>>> Palmer. The letter is dated September 2, 2004 and is addressed to
>>> “John Crosbie, c/o Greg G. Byrne, Suite 502, 570 Queen Street,
>>> Fredericton, NB E3B 5E3”. In this letter Mr. Amos alludes to a
>>> possible lawsuit against Patterson Palmer.
>>> [16]           Mr. Amos’ position is that simply because Justice Webb
>>> was a lawyer with Patterson Palmer, he now has a conflict. In Wewaykum
>>> Indian Band v. Her Majesty the Queen, 2003 SCC 45, [2003] 2 S.C.R.
>>> 259, the Supreme Court of Canada noted that disqualification of a
>>> judge is to be determined based on whether there is a reasonable
>>> apprehension of bias:
>>> 60        In Canadian law, one standard has now emerged as the
>>> criterion for disqualification. The criterion, as expressed by de
>>> Grandpré J. in Committee for Justice and Liberty v. National Energy
>>> Board, …[[1978] 1 S.C.R. 369, 68 D.L.R. (3d) 716], at p. 394, is the
>>> reasonable apprehension of bias:
>>> … the apprehension of bias must be a reasonable one, held by
>>> reasonable and right minded persons, applying themselves to the
>>> question and obtaining thereon the required information. In the words
>>> of the Court of Appeal, that test is "what would an informed person,
>>> viewing the matter realistically and practically -- and having thought
>>> the matter through -- conclude. Would he think that it is more likely
>>> than not that [the decision-maker], whether consciously or
>>> unconsciously, would not decide fairly."
>>>
>>> [17]           The issue to be determined is whether an informed
>>> person, viewing the matter realistically and practically, and having
>>> thought the matter through, would conclude that Mr. Amos’ allegations
>>> give rise to a reasonable apprehension of bias. As this Court has
>>> previously remarked, “there is a strong presumption that judges will
>>> administer justice impartially” and this presumption will not be
>>> rebutted in the absence of “convincing evidence” of bias (Collins v.
>>> Canada, 2011 FCA 140 at para. 7, [2011] 4 C.T.C. 157 [Collins]. See
>>> also R. v. S. (R.D.), [1997] 3 S.C.R. 484 at para. 32, 151 D.L.R.
>>> (4th) 193).
>>>
>>> [18]           The Ontario Court of Appeal in Rando Drugs Ltd. v.
>>> Scott, 2007 ONCA 553, 86 O.R. (3d) 653 (leave to appeal to the Supreme
>>> Court of Canada refused, 32285 (August 1, 2007)), addressed the
>>> particular issue of whether a judge is disqualified from hearing a
>>> case simply because he had been a member of a law firm that was
>>> involved in the litigation that was now before that judge. The Ontario
>>> Court of Appeal determined that the judge was not disqualified if the
>>> judge had no involvement with the person or the matter when he was a
>>> lawyer. The Ontario Court of Appeal also explained that the rules for
>>> determining whether a judge is disqualified are different from the
>>> rules to determine whether a lawyer has a conflict:
>>> 27        Thus, disqualification is not the natural corollary to a
>>> finding that a trial judge has had some involvement in a case over
>>> which he or she is now presiding. Where the judge had no involvement,
>>> as here, it cannot be said that the judge is disqualified.
>>>
>>>
>>> 28        The point can rightly be made that had Mr. Patterson been
>>> asked to represent the appellant as counsel before his appointment to
>>> the bench, the conflict rules would likely have prevented him from
>>> taking the case because his firm had formerly represented one of the
>>> defendants in the case. Thus, it is argued how is it that as a trial
>>> judge Patterson J. can hear the case? This issue was considered by the
>>> Court of Appeal (Civil Division) in Locabail (U.K.) Ltd. v. Bayfield
>>> Properties Ltd., [2000] Q.B. 451. The court held, at para. 58, that
>>> there is no inflexible rule governing the disqualification of a judge
>>> and that, "[e]verything depends on the circumstances."
>>>
>>>
>>> 29        It seems to me that what appears at first sight to be an
>>> inconsistency in application of rules can be explained by the
>>> different contexts and in particular, the strong presumption of
>>> judicial impartiality that applies in the context of disqualification
>>> of a judge. There is no such presumption in cases of allegations of
>>> conflict of interest against a lawyer because of a firm's previous
>>> involvement in the case. To the contrary, as explained by Sopinka J.
>>> in MacDonald Estate v. Martin (1990), 77 D.L.R. (4th) 249 (S.C.C.),
>>> for sound policy reasons there is a presumption of a disqualifying
>>> interest that can rarely be overcome. In particular, a conclusory
>>> statement from the lawyer that he or she had no confidential
>>> information about the case will never be sufficient. The case is the
>>> opposite where the allegation of bias is made against a trial judge.
>>> His or her statement that he or she knew nothing about the case and
>>> had no involvement in it will ordinarily be accepted at face value
>>> unless there is good reason to doubt it: see Locabail, at para. 19.
>>>
>>>
>>> 30        That brings me then to consider the particular circumstances
>>> of this case and whether there are serious grounds to find a
>>> disqualifying conflict of interest in this case. In my view, there are
>>> two significant factors that justify the trial judge's decision not to
>>> recuse himself. The first is his statement, which all parties accept,
>>> that he knew nothing of the case when it was in his former firm and
>>> that he had nothing to do with it. The second is the long passage of
>>> time. As was said in Wewaykum, at para. 85:
>>>             To us, one significant factor stands out, and must inform
>>> the perspective of the reasonable person assessing the impact of this
>>> involvement on Binnie J.'s impartiality in the appeals. That factor is
>>> the passage of time. Most arguments for disqualification rest on
>>> circumstances that are either contemporaneous to the decision-making,
>>> or that occurred within a short time prior to the decision-making.
>>> 31        There are other factors that inform the issue. The Wilson
>>> Walker firm no longer acted for any of the parties by the time of
>>> trial. More importantly, at the time of the motion, Patterson J. had
>>> been a judge for six years and thus had not had a relationship with
>>> his former firm for a considerable period of time.
>>>
>>>
>>> 32        In my view, a reasonable person, viewing the matter
>>> realistically would conclude that the trial judge could deal fairly
>>> and impartially with this case. I take this view principally because
>>> of the long passage of time and the trial judge's lack of involvement
>>> in or knowledge of the case when the Wilson Walker firm had carriage.
>>> In these circumstances it cannot be reasonably contended that the
>>> trial judge could not remain impartial in the case. The mere fact that
>>> his name appears on the letterhead of some correspondence from over a
>>> decade ago would not lead a reasonable person to believe that he would
>>> either consciously or unconsciously favour his former firm's former
>>> client. It is simply not realistic to think that a judge would throw
>>> off his mantle of impartiality, ignore his oath of office and favour a
>>> client - about whom he knew nothing - of a firm that he left six years
>>> earlier and that no longer acts for the client, in a case involving
>>> events from over a decade ago.
>>> (emphasis added)
>>>
>>> [19]           Justice Webb had no involvement with any matter
>>> involving Mr. Amos while he was a member of Patterson Palmer or
>>> Patterson Law, nor does Mr. Amos suggest that he did. Mr. Amos made it
>>> clear during the hearing of this matter that the only reason for the
>>> alleged conflict for Justice Webb was that he was a member of
>>> Patterson Law and Patterson Palmer. This is simply not enough for
>>> Justice Webb to be disqualified. Any involvement of Mr. Amos with
>>> Patterson Law while Justice Webb was a member of that firm would have
>>> had to occur over 10 years ago and even longer for the time when he
>>> was a member of Patterson Palmer. In addition to the lack of any
>>> involvement on his part with any matter or dispute that Mr. Amos had
>>> with Patterson Law or Patterson Palmer (which in and of itself is
>>> sufficient to dispose of this matter), the length of time since
>>> Justice Webb was a member of Patterson Law or Patterson Palmer would
>>> also result in the same finding – that there is no conflict in Justice
>>> Webb hearing this appeal.
>>>
>>> [20]           Similarly in R. v. Bagot, 2000 MBCA 30, 145 Man. R.
>>> (2d) 260, the Manitoba Court of Appeal found that there was no
>>> reasonable apprehension of bias when a judge, who had been a member of
>>> the law firm that had been retained by the accused, had no involvement
>>> with the accused while he was a lawyer with that firm.
>>>
>>> [21]           In Del Zotto v. Minister of National Revenue, [2000] 4
>>> F.C. 321, 257 N.R. 96, this court did find that there would be a
>>> reasonable apprehension of bias where a judge, who while he was a
>>> lawyer, had recorded time on a matter involving the same person who
>>> was before that judge. However, this case can be distinguished as
>>> Justice Webb did not have any time recorded on any files involving Mr.
>>> Amos while he was a lawyer with Patterson Palmer or Patterson Law.
>>>
>>> [22]           Mr. Amos also included with his submissions a CD. He
>>> stated in his affidavit dated June 26, 2017 that there is a “true copy
>>> of an American police surveillance wiretap entitled 139” on this CD.
>>> He has also indicated that he has “provided a true copy of the CD
>>> entitled 139 to many American and Canadian law enforcement authorities
>>> and not one of the police forces or officers of the court are willing
>>> to investigate it”. Since he has indicated that this is an “American
>>> police surveillance wiretap”, this is a matter for the American law
>>> enforcement authorities and cannot create, as Mr. Amos suggests, a
>>> conflict of interest for any judge to whom he provides a copy.
>>>
>>> [23]           As a result, there is no conflict or reasonable
>>> apprehension of bias for Justice Webb and therefore, no reason for him
>>> to recuse himself.
>>>
>>> [24]           Mr. Amos alleged that Justice Near’s past professional
>>> experience with the government created a “quasi-conflict” in deciding
>>> the cross-appeal. Mr. Amos provided no details and Justice Near
>>> confirmed that he had no prior knowledge of the matters alleged in the
>>> Claim. Justice Near sees no reason to recuse himself.
>>>
>>> [25]           Insofar as it is possible to glean the basis for Mr.
>>> Amos’ allegations against Justice Gleason, it appears that he alleges
>>> that she is incapable of hearing this appeal because he says he wrote
>>> a letter to Brian Mulroney and Jean Chrétien in 2004. At that time,
>>> both Justice Gleason and Mr. Mulroney were partners in the law firm
>>> Ogilvy Renault, LLP. The letter in question, which is rude and angry,
>>> begins with “Hey you two Evil Old Smiling Bastards” and “Re: me suing
>>> you and your little dogs too”. There is no indication that the letter
>>> was ever responded to or that a law suit was ever commenced by Mr.
>>> Amos against Mr. Mulroney. In the circumstances, there is no reason
>>> for Justice Gleason to recuse herself as the letter in question does
>>> not give rise to a reasonable apprehension of bias.
>>>
>>>
>>> III.               Issue
>>>
>>> [26]           The issue on the cross-appeal is as follows: Did the
>>> Judge err in setting aside the Prothonotary’s Order striking the Claim
>>> in its entirety without leave to amend and in determining that Mr.
>>> Amos’ allegation that the RCMP barred him from the New Brunswick
>>> legislature in 2004 was capable of supporting a cause of action?
>>>
>>> IV.              Analysis
>>>
>>> A.                 Standard of Review
>>>
>>> [27]           Following the Judge’s decision to set aside the
>>> Prothonotary’s Order, this Court revisited the standard of review to
>>> be applied to discretionary decisions of prothonotaries and decisions
>>> made by judges on appeals of prothonotaries’ decisions in Hospira
>>> Healthcare Corp. v. Kennedy Institute of Rheumatology, 2016 FCA 215,
>>> 402 D.L.R. (4th) 497 [Hospira]. In Hospira, a five-member panel of
>>> this Court replaced the Aqua-Gem standard of review with that
>>> articulated in Housen v. Nikolaisen, 2002 SCC 33, [2002] 2 S.C.R. 235
>>> [Housen]. As a result, it is no longer appropriate for the Federal
>>> Court to conduct a de novo review of a discretionary order made by a
>>> prothonotary in regard to questions vital to the final issue of the
>>> case. Rather, a Federal Court judge can only intervene on appeal if
>>> the prothonotary made an error of law or a palpable and overriding
>>> error in determining a question of fact or question of mixed fact and
>>> law (Hospira at para. 79). Further, this Court can only interfere with
>>> a Federal Court judge’s review of a prothonotary’s discretionary order
>>> if the judge made an error of law or palpable and overriding error in
>>> determining a question of fact or question of mixed fact and law
>>> (Hospira at paras. 82-83).
>>>
>>> [28]           In the case at bar, the Judge substituted his own
>>> assessment of Mr. Amos’ Claim for that of the Prothonotary. This Court
>>> must look to the Prothonotary’s Order to determine whether the Judge
>>> erred in law or made a palpable and overriding error in choosing to
>>> interfere.
>>>
>>>
>>> B.                 Did the Judge err in interfering with the
>>> Prothonotary’s Order?
>>>
>>> [29]           The Prothontoary’s Order accepted the following
>>> paragraphs from the Crown’s submissions as the basis for striking the
>>> Claim in its entirety without leave to amend:
>>>
>>> 17.       Within the 96 paragraph Statement of Claim, the Plaintiff

Northern Michigan judge gives Benson OK to intervene in Antrim County election case

Beth LeBlanc
The Detroit News Published December 10, 2020

A Northern Michigan judge granted Secretary of State Jocelyn Benson permission to intervene in a case questioning results in Antrim County and the security of tabulators used there on Nov. 3.

Judge Kevin Elsenheimer ruled Thursday that Attorney General Dana Nessel's office could intervene on behalf of Benson, who had argued she had supervisory control over the Antrim County clerk, had an interest in any audit discussions the case may raise and was party to the county's contract with Dominion Voting Systems.

The Secretary of State's office is concerned particularly with forensic imaging performed on Antrim County's 22 Dominion tabulators earlier this week by a Village of Central Lake resident and Allied Security Operations Group, said Assistant Attorney General Heather Meingast.

"We’d like to know more about what was obtained, what the intent is for the use of the images obtained," Meingast said, noting the disclosure of some elements of the tabulators could compromise their security in future elections.

Antrim County Judge Kevin Elsenheimer granted Secretary of State Jocelyn Benson permission to intervene in a lawsuit challenging the county's election results on Thursday, Dec. 10, 2020.

Elsenheimer, a Republican former lawmaker and member of former Gov. Rick Snyder's administration, granted Meingast's request but warned the case would proceed in haste.

"I intend to move this matter quickly, aggressively," Elsenheimer said.

Benson shouldn't be allowed to intervene because she had missed the opportunity to do so earlier and did not have direct involvement in local elections, said Matthew DePerno, a lawyer for Antrim County resident William Bailey.

In fact, a state Court of Claims judge earlier this month dismissed a case against Benson on those grounds, DePerno said.

"The court concluded there was no relief to be granted because elections are local and run by local officials," he said.

DePerno said the investigation is ongoing and data are being reviewed. But based on what had been reviewed so far, Bailey would move to decertify the Antrim County certification and push the issue to the GOP-led Legislature, he said.

"We think there are serious issues, and we’re preparing right now a motion to seek relief from the court from the protective order," DePerno said.

Elsenheimer last week granted Bailey's request to take take forensic images of 22 tabulators and review those along with flash drives, software and a "master tabulator" that the county said does not exist. Bailey and members of the Allied Securities Operation Group spent about eight hours on Sunday at county offices obtaining the material.

Allied Security Operations Group's Russell Ramsland, Jr. was listed in a lawsuit filed by lawyer Sidney Powell last month in Michigan seeking to overturn Democratic President-elect Joe Biden's 154,000-vote win in Michigan over Republican President Donald Trump. Ramsland raised concerns about spikes in votes tallied for Biden after 2 a.m. the day after the election.

The spike was expected since more Republicans tended to vote on Election Day than Democrats, in part due to warnings about mail-in voting from Trump. Absentee ballots generally took longer to process and often showed up in vote tallies late on Nov. 3 or the day after.

In an affidavit filed in a Georgia case, Ramsland also appeared to make a mistake by confusing townships in Minnesota with townships in Michigan, according to national media reports.

In his lawsuit, Bailey said he was one of the first people to notice a vote reporting error in Antrim County that put Biden thousands of votes ahead of Trump in the Republican-leaning county.

Bailey alerted a local election official and the votes were pulled down to fix the error. Trump later was shown to have a more than 5,000 vote lead in a county where about 16,000 votes were cast.

Bailey alerted a local election official and the votes were pulled down to fix the error. Trump later was shown to have a more than 5,000 vote lead in a county where about 16,000 votes were cast.

In his initial complaint, Bailey alleged that the Antrim County presidential election "lacked all accuracy and integrity." But Elsenheimer in last week's order focused on a proposed marijuana retailer ordinance in the Village of Central Lake, where a 262-262 tie was overturned by one vote after a Nov. 6 retabulation.

Three ballots were alleged to have been damaged, then reproduced to allow for retabulation. Bailey argued those ballots don't show up in the final count.

The issue with Antrim County's presidential results occurred after county Clerk Sheryl Guy failed to update Election Source software on all tabulators after performing an update to two of them. The failure caused the machines to transpose results as they were sent to the county's main software.

The issue pushed Dominion Voting Systems into the national spotlight and made it subject to several unproven claims of fraud.

Guy told lawmakers the county would have caught the issue during canvassing if it hadn't been brought to their attention earlier by comparing tabulator tapes to the unofficial results on the main software.

Threat against Wayne Co. canvasser leads to federal charges for N.H. woman

Robert Snell
The Detroit News Published December 23, 2020

Detroit — Federal prosecutors Wednesday filed charges against a New Hampshire woman accused of texting threats to the chairwoman of the Wayne County Board of Canvassers following the presidential election and sending photos of a bloody mutilated female body.

Katelyn Jones, 23, a former Olivet resident who lives in Epping, was charged with threatening violence through interstate commerce following an FBI investigation that probed lingering fallout from President Donald Trump's defeat and baseless allegations about voting irregularities.

William Hartmann, left, and chairwoman Monica Palmer at the Wayne County Board of Canvassers meeting, which addressed the certification of the Nov. 3 election in Detroit on Nov. 17, 2020.

The criminal complaint and an FBI affidavit filed in federal court describe threats made against Monica Palmer, chairwoman of the Wayne County Board of Canvassers, after the Republican canvasser voted against certifying the election results. Palmer faced intense scrutiny over her decision to decline certification, then certify and then attempt to rescind her vote on the final certification of roughly 878,000 votes in Michigan's largest county.

"The allegations in this case should make all of us disgusted,” U.S. Attorney Matthew Schneider said in a statement. “There is simply no place in Michigan, or in the United States, for chilling threats like this to people who are simply doing what they believe is correct.”

Palmer declined to comment Wednesday.

The alleged threats come amid a period of extreme behavior directed toward public figures and elected leaders stemming from the election and anger over state restrictions on travel and business during the COVID-19 pandemic.

Jones was charged two months after FBI agents say they thwarted an alleged plot to kidnap Gov. Gretchen Whitmer and kill police officers.

In all, 14 people have been charged in the alleged kidnapping plot with state and federal crimes. Authorities say the plot involved training and planning by a militia group known as the Wolverine Watchmen to kidnap Whitmer and storm Michigan's Capitol in Lansing.

Jones was released on bond Wednesday after a brief appearance during a videoconference in federal court in New Hampshire. She said little beyond answering standard questions from U.S. Magistrate Judge Andrea Johnstone, who barred her from having any contact with victims or potential witnesses in the case.

She is expected to attend a Jan. 13 videoconference in federal court in Detroit.

The threat charge filed against Jones is punishable by up to 20 years in federal prison and a $250,000 fine.

Jeff Levin, her court-appointed lawyer, declined comment.

On Nov. 18, Palmer received multiple threatening texts from an unknown person who utilized a cellphone with a 269 area code.

"Damn it was not hard finding all of your information disgusting racist b----," one text read. "I don't tolerate people like you, in fact I consider you to be a terrorist and do you know what happens to terrorist," the text read, adding Palmer's name.

“The messages were immediately followed by two graphic photographs of a bloody, deceased, nude, mutilated woman, lying on the ground,” FBI Special Agent Emily Munchiando wrote in the affidavit.

Investigators traced the phone number to the app TextMe Inc. Company records showed the 269 phone number account was created 10 minutes before Palmer received the first threatening message.

FBI agents tracked the IP address used to create the TextMe account. The IP address subscriber was Jones' mother, Linda Jones, in New Hampshire, according to the affidavit.

"Therefore, the account that used (269) xxx-xx68 that sent threatening text messages to (Palmer) was created at Linda Jones' residence," the FBI agent wrote.

Palmer also received threatening messages on her Instagram page on Nov. 18 from a user named "_etfere." The user posted Palmer's address, phone number and husband's phone number.

"Feel free to leave these disgusting racist (sic) a nice little message on their voicemail or for more fun stop by their house," the post read.

"Racist terrorist b----," read another post.

"Your daughter is beautiful," read another post that included a photo of Palmer, her daughter and husband. "I'd (sic) be a shame if something happened to her. Hmmm I'd (sic) be a shame if something happened to your daughter at school."

The FBI agent concluded the texts messages and Instagram posts were sent by the same person because they used similar terms, including the words terrorist and racist, and identified Palmer's daughter and husband.

"Both threatened harm to (Palmer's) daughter," the agent wrote.

Investigators discovered the Instagram account was linked to a second account that featured photographs of a woman. Agents concluded the photos were of Jones based on the number of photos and other information and the pictures matched her Michigan driver's license photo, according to the affidavit.

USA V. JONES (CMP)(CMC)
December 22, 2020

The FBI started surveilling Katelyn Jones on Dec. 10, almost one month after the threats against Palmer.

That morning, outside Linda Jones' home, an FBI agent spotted a white woman wearing a blue hooded sweatshirt with the hood covering her face. The woman appeared to be Katelyn Jones, according to the affidavit.

Agents raided the New Hampshire home Tuesday and found Katelyn Jones inside the house.

She admitted creating the TextMe account and using it to send the threatening texts, according to the affidavit.

Katelyn Jones also said she was the only person who used the Instagram account and admitted posting threats because Palmer was "interfering with the election," according to the FBI agent.

After the election, Palmer revealed that she had received threatening messages that she forwarded to Grosse Pointe Woods police and the FBI.

"Not only has my home and my family been threatened, my employer has been threatened," Palmer said. "There are businesses that I shared a Tweet months ago for a giveaway for a wedding dress. That bridal shop is being harassed and threatened at this point. Where does it end?"

Michigan Supreme Court vacates ruling that declared ballot petition rules unconstitutional

Michigan Supreme Court

Emily Lawler | MLive.com

LANSING, MI -- The Michigan Supreme Court nullified the ruling of a lower court regarding the constitutionality of requirements for ballot petition drives.

In a 4-3 ruling issued Tuesday, the Supreme Court concluded a lawsuit challenging a 2018 lame-duck law is moot because the plaintiff is no longer seeking a ballot initiative. The court vacated lower court decisions that deemed parts of the law unconstitutional and ordered the case to be dismissed.

The law, passed on former Gov. Rick Snyder’s last day in office, included three measures regarding voter-led ballot initiatives. It created a check-box requirement to verify whether the circulator was paid or a volunteer, required paid circulators to file an affidavit with the Secretary of State and put a 15% limit on signatures from one congressional district.

Secretary of State Jocelyn Benson sought Attorney General Dana Nessel’s opinion on the constitutionality of the law in 2019. Nessel determined several parts of the law, including the cap on valid signatures from each congressional district, to be unconstitutional.

Nessel’s opinion sparked legal challenges from The League of Women Voters and Michigan’s Republican-led House and Senate, which also filed a lawsuit against the Secretary of State seeking to affirm the law as constitutional.

The League of Women Voters, Michiganders for Fair and Transparent Elections and three voters challenged the 2018 law, arguing it disenfranchises voters. MFTE had sought to circulate petitions for a ballot question when the case was initially filed but since put those plans on hold.

The lawsuits were consolidated in the Court of Claims, which ruled in September 2019 that two of the three provisions are unconstitutional. The Michigan Court of Appeals in January upheld the ruling, finding all three provisions are unconstitutional, but the Legislature sought an appeal in the Supreme Court.

Justices David Viviano, writing on behalf of the majority, wrote that the Legislature has legal standing to defend state laws against a constitutional challenge when the Attorney General is unwilling to do so. However, the case was determined to be moot because MFTE dropped its petition drive.

Viviano wrote that MFTE doesn’t “have anything at stake in this dispute” and the court failed to find any case involving ballot initiatives that don’t concern an actual ballot initiative. The court’s majority also ruled that the LWV and other plaintiffs couldn’t prove a “present legal controversy rather than a hypothetical or anticipated one.”

“Plaintiffs only ask for a declaratory judgment because it perhaps may be needed in the future should they decide to sign some initiative,” Viviano wrote. “They have no plans now to sign any.”

The court also ruled that the Legislature had no standing to pursue its original case challenging Nessel’s opinion. Therefore, the court decided to vacate the lower-court decisions and order that the case be dismissed.

Three justices dissented with the ruling for various reasons.

Justice Stephen Markman and Justice Brian Zahra said they would have denied the Legislature’s motion to intervene in the LWV lawsuit but allowed the Legislature to bring its own lawsuit against the Secretary of State.

Markman and Zahra argued the ruling left unresolved questions about the 2018 law, possibly creating confusion for citizens concerned about the proper procedures for placing constitutional and legislative measures on the ballot.

Zahra also wrote that the issues presented in the case were of great public significance and should receive judicial review.

Justice Elizabeth Clement dissented from the court’s decision to conclude the dispute was moot, arguing that allegations made by LWV and its co-plaintiffs “remained live concerns that needed judicial resolution.”
