Chris Lysak of Alberta, Canada has been held in a remand detention center since February, 2022 on charges stemming from the Coutts border protest of state imposed vaccine mandates that were destroying our economy and way of life for countless Canadian citizens.

Chris has two young girls who will be spending their second consecutive Christmas without their father. Chris does not have a criminal record and has been denied bail in a troubling case of public interest that has caught international attention.

Everyone has the right to due process and a fair trial with access to reasonable bail. Chris has been charged with conspiracy to murder law enforcement officers which carries a life sentence if convicted. We do not believe that Chris is guilty of these outrageous accusations and deserves the same kind of spirited, thoughtful and robust defense that is the right of every Canadian man and woman.

Unfortunately, Chris and his family have been stretched to their breaking point in enduring this ongoing legal nightmare. Unable to work and with an elderly father to care for, he is at the mercy of the justice system. If no one comes to his rescue, his chances of success are grim this late into the proceedings.

All is not lost, however. There is a highly capable and well respected legal team ready and waiting to assist. This is a time sensitive matter due to the late stages of proceedings, we are in the 11th hour of retaining effective legal counsel that can deliver a positive outcome and have only days to come up with the necessary retainer.

If we the people do not defend ourselves, what fate do we deserve ?

Chris tried his best to stand for all of us against what he believed was a gross instance of government overreach and persecution. When we were denied access to our own family funerals, stripped of employment, education, our families divided and worse due to the ongoing policy directed from Ottawa, Chris and many others showed up to stand in the way. We must act in kind and protect this man and prove to his daughters and the world that the people of this country he so strongly believed in do not stop at mere words.

Chris needs our help. It's him today. Who is it tomorrow?

(Jack from Toronto) Chris's legal defense fund originally required a retainer of $200,000 for Daniel Song to take the case.  Between the GSG and private donations sent directly to Song's office the original money collected and sent for the $200,000 was $183,000 - which Daniel agreed to take the case even though we were short of the original goal of $200,000.
The way GSG works is there is a 5 day hold on the 1st days donations*, then a 3 day hold on additional days donations. After that waiting time, we can request the payout and that is another 72 hour hold before it is deposited into the bank account specifically set up for Chris's defense fund. Also, note that GSG does take a fee from each of the donations. The fee is 3.5% + $0.30 per donation.  So the totals you see are what was donated, but does not show the fees taken from each donation.

Chris has been extremely grateful and humbled by your generosity. We have a new lawyer, Daniel Song, and because of the caliber of his previous work and the  expertise that he brings to the table we need to retain him at all costs. This is not going to be cheap or easy, but I have faith that this community can come through again. Daniel J. Song, K.C.

Daniel practices as counsel to Pringle Law. He manages the Vancouver office and practices criminal law in Alberta and British Columbia. He is an active member of the law societies of both provinces and travels regularly each month between Vancouver and Edmonton to appear in all levels of court in both provinces.

He has broad experience defending clients faced with serious and complex charges, including murder, attempted murder, criminal organization offences, conspiracies, kidnapping, extortion, drug trafficking, firearms offences, and proceeds of crime.

Daniel has also established a reputation for conducting criminal appeals and appears regularly in the Alberta Court of Appeal and the British Columbia Court of Appeal. He has also appeared as lead counsel in the Supreme Court of Canada on multiple occasions, including as an applicant, appellant, respondent and intervener.

Notable cases in which he has acted as counsel include the Surrey Six murder appeal, the United Nations murder and conspiracy prosecution, British Columbia’s 12-year civil forfeiture action against the properties of an alleged outlaw motorcycle club, and the largest money laundering investigation in British Columbia’s history.

Daniel initially pursued a degree in Aerospace Engineering at the University of Toronto before completing a degree in English Literature at the University of British Columbia in 2003, where he was awarded the Roy Daniells Memorial Prize for the top essay written by a fourth-year student in the English Department. Thereafter, he obtained his law degree from the University of British Columbia in 2006 where he co-authored a publication in the Criminal Reports with Professor Christine Boyle, K.C.

Some of Daniel’s contributions to the legal community have included authoring papers and presenting at seminars for the Legal Education Society of Alberta and the Trial Lawyers Association of British Columbia, writing chapters for the Continuing Legal Education Society of British Columbia, and lecturing on Part VI wiretap authorizations to RCMP officers at the Justice Institute of B.C. He has also volunteered with the UBC Innocence Project whose mandate is to investigate and exonerate the wrongfully convicted.

Daniel holds a black belt in Taekwondo and currently trains in Iaido, the art of drawing the Japanese sword.

“What’s the purpose of being an advocate if it’s not to effect change?”

Daniel J. Song, KC is a Korean-Canadian criminal defence lawyer practicing in Alberta and British Columbia. He has extensive experience as criminal appellate counsel, including at the Supreme Court of Canada. Daniel has made many contributions to the legal community including authoring papers and presenting at seminars for the Legal Education Society of Alberta, the Trial Lawyers Association of British Columbia, the Continuing Legal Education Society of British Columbia and the Provincial Court of British Columbia. He has also volunteered with the Allan McEachern Course in Trial Advocacy, Gale Cup Moot and UBC Innocence Project at the Peter A. Allard School of Law. Daniel was appointed Queen’s Counsel in 2022. Daniel holds a black belt in Taekwondo and trains in Iaido, the art of drawing the Japanese sword.

Daniel’s legal career can be traced back to his grandfather. When Daniel was born, his grandfather gave him his Korean name, Jae-Yul, which contains the Chinese character for “law” (). His grandfather grew up in poverty in South Korea and believed that a lawyer could bring honour and financial stability to their family. “Although my parents never pressured me to become a lawyer, I was told that family story as a young child, and it stuck,” explains Daniel.

Daniel’s sense of justice was inspired by his parents. Daniel says that when his parents moved to Canada, “they struggled to make ends meet, as is often the case with many immigrants.” His father worked tirelessly as an auto-mechanic and his mother stayed home to raise the children until they were old enough for her to operate various small businesses over the years. Daniel remembers his parents frequently feeling despondent, being unable to afford lawyers to assist them in business disputes with wealthier and more privileged individuals: “My father was always a stubborn man of principle. Even without the financial resources to access justice in the courts, he strongly believed that truth and fairness would always prevail. But time and again, the reality was that I watched my parents being exploited by those with power. And that was unquestionably a formative experience for me.”  

Before applying to Allard Law, Daniel’s academic career began in Toronto where he enrolled in the Aerospace Engineering program at the University of Toronto. After two years in the program, Daniel realized he didn’t want to be an engineer and chose to study English Literature at UBC – a somewhat unexpected turn of events. “English was my worst subject in high school — not because I couldn’t excel at it, but because at the time I simply had no interest in reading about old, dead, mostly British men,” Daniel notes. That changed at UBC, where he began to appreciate and value literature, “be it canonical, Victorian or post-colonial.”

Daniel says that reading 25 novels each semester and writing numerous essays during his undergraduate degree were instrumental in developing his written advocacy. He points out that law students don’t need to write like the common-law judgments they read in class. “They need only be themselves and project a tone of authenticity to be persuasive […] and that authenticity should ultimately guide the trajectory of their careers.”

Daniel has appeared before the Supreme Court of Canada more than a dozen times. His first appearance at the Supreme Court was an application for leave to appeal before three justices. He was the only lawyer in the courtroom, given that the Crown chose to appear by video.

The Crown submitted that “appellate courts were hot courts” – which was to say that appeal judges arrived at hearings having already read the parties’ arguments in advance. Daniel recalls witnessing Chief Justice Beverley McLachlin leaning over to Justice Rosalie Abella “with a glint in her eye,” and whispering, “He called us a hot court!” Daniel was granted leave to appeal, but the highlight of the experience was “overhearing that moment of levity in the courtroom.” He says that it calmed his nerves during the hearing.

When asked what he sees as his greatest professional achievement to date, Daniel says, “I’m just getting started.” But he sees it as an achievement to have remained healthy and strong enough to honour and give back to his parents for their lifetime of sacrifice.

Daniel previously published an article titled “An Asian lawyer’s experience with racism” in the Lawyer’s Daily, speaking to the effects of entrenched stereotypes that impact Asian-Canadian lawyers. “I’m heartened to see more Asian lawyers entering the criminal bar,” says Daniel. “But when I started, there were no senior Asian criminal defence lawyers I could look to as role models.” He notes that although more than half of the population in Metro Vancouver identifies as visible minorities, that same level of diversity is not typically present in any given Vancouver courtroom.

But he believes this is changing. Daniel reminds those considering a career in criminal law that the bar needs more “diversity of thought, voices, and perspectives that will help shape the law in ways that will properly reflect the pluralistic values of this country.”

In May 2022, Daniel was appointed Queen’s Counsel – which he describes as an ever-present reminder of his responsibility to exceed expectations. “Other aspiring Asian lawyers may be watching,” he says. “I want them to see a lawyer who leads through the quality of his advocacy, a lawyer who is singularly committed to his craft, and a lawyer whose word the judges trust. They can be that lawyer.”

When asked what advice he would offer to aspiring criminal lawyers, Daniel points out that a criminal defence lawyer is much more than a mouthpiece. “Every moment you stand in court, you can be impactful,” he says. “Words have the power to stand against injustice. And what’s the purpose of being an advocate if it’s not to effect change?"

In September 2023, Daniel was recognized as a Social Change Champion and one of Canadian Lawyer Magazine's Top 25 Most Influential Lawyers for his work in Human Rights, Advocacy, and Criminal Law.

Daniel is a criminal defence lawyer practicing at Pringle Law in Edmonton and Vancouver. He conducts serious and complex criminal trials that engage with the law of search and seizure. ‘I don’t wear a mask in the courtroom,’ Peter Royal tells judge

One of Edmonton's longest-serving and most respected lawyers has been cited for contempt of court after refusing to follow a judge's direct order to wear a mask in her courtroom.

Peter Royal got into a war of words with provincial court Judge Marilena Carminati on July 21 at the start of a three-day sex assault trial.

According to the official transcript, Carminati told Royal he would have to wear a mask. Royal told the judge he wouldn't:

Royal: I don't wear a mask in the courtroom.

Judge: You will have to wear one. We are not spending three days together in a small courtroom in a poorly ventilated building with counsel not wearing a mask. 

Royal: Well I'm not going to wear one, so what are you going to do about that? 

Judge: Well perhaps you can speak to counsel about whether you will be held in contempt of court ... I will adjourn to let you think about it.

Royal: I don't intend to follow your direction. We're more than six feet apart. I've been doubly vaccinated. 

Judge: Are you saying you are free to disobey a ruling of the court or a direction of the court if you think the reasons for it aren't great?

Royal: I do. 

Royal, who has been practising law for nearly half a century, told Carminati he wears a mask inside the courthouse and when he enters the courtroom, but takes it off once he sits at the defence table. 

"Every judge in this courthouse has never directed me to wear a mask once I'm ahead of the bar," Royal said, according to the transcript. "My understanding from Judge [Steven] Bilodeau was when you're ahead of the bar, you have the right to remain maskless." 

Carminati adjourned for a few hours to give Royal time to make written submissions.

"You are putting the court in a very difficult position, Mr. Royal," Carminati said, according to the transcript. "You are senior counsel, you are well respected, but you bring the administration of justice into disrepute when you blatantly disregard a direction from the court without providing any kind of reason or justification for doing so."

Restricted public courthouse access 

In mid-June, the provincial court issued a practice directive outlining procedures for a return to in-person hearings for criminal cases during the COVID-19 pandemic. 

"These measures are designed to gradually resume the safe operation of the court," the directive said. "All safety measures — masking, physical distance, capacity limits and plexiglass remain in place."

When Royal appeared before Carminati again later the same day, still without a mask, he argued that the court's pandemic practice directives had unfairly and illegally restricted public access to the courthouse. 

"In the absence of public accessibility to the courthouse, these directives are simply lacking in constitutional merit," Royal said. "They all deserve to be ignored, in my respectful submission."

Crown prosecutor Kevin Komosky pointed out that the mask debate had stalled the sexual assault trial, which had already been adjourned three times.

Carminati then ordered Royal to wear his mask "so that we can start this trial," the transcript shows:

Royal: And I'm not going to. And, Your Honour, I have to say I was surprised that you took this position. No other judge in this court has taken the position you're taking, none. 

Judge: I have asked if there is any compelling reason for you not to wear the mask. You have provided me only with disrespect.

Carminati said she would order a transcript and provide it to the chief judge for him to decide whether it should be shared with the Law Society of Alberta.

Royal declined comment for this story. The law society and the court's media spokesperson also declined comment, as did Justice Minister Kaycee Madu's press secretary and the president of the Criminal Trial Lawyers' Association. 

Royal's contempt of court citation hearing is set for Sept. 9, using an out-of-town judge and Crown prosecutor.

Under Alberta's rules of court, a person found in civil contempt of court could face up to two years in jail and/or a fine.

Peter Royal was called to the Bar on July 10, 1975. He holds both a
Bachelor of Arts and a Bachelor of Laws degree from the University of
Alberta and a Master of Laws degree from the London School of
Economics and Political Science, University of London.

In 1986, Mr. Royal was appointed Queen’s Counsel. That same year he
was elected as a Bencher for the Law Society of Alberta where he sat

University of Alberta in the Faculty of Law since 1980 – initially
teaching Criminal Trial Procedure and Advocacy, and since 1981, the
Law of Evidence. He was the first recipient of the Law Faculty’s
Sessional Teaching Excellence Award in 2005.

Serving as President of the Criminal Trial Lawyers’ Association from
1982 to 1983, Mr. Royal was awarded the Harradence Prize by the
Association in 2002.

Exclusively a criminal defence practitioner at both the trial and
appellate level, Mr. Royal has  appeared at all levels of court in
Alberta and the Supreme Court of Canada.

Veteran Edmonton defence lawyer cited with contempt for not wearing a mask in court

A prominent Edmonton criminal defence lawyer has been cited with contempt of court for not wearing a face covering during a proceeding.

On Monday, Peter Royal confirmed he is facing a contempt citation for not wearing a mask in court. His office said a hearing on the citation is scheduled for September. 

The exact details of Royal’s citation remain unclear. The Law Society of Alberta said it had no record of any such charges, while search requests for court records were not returned.

While much of the province has done away with COVID-19 mask mandates, Alberta courts continue to require masking in common areas. Whether lawyers are required to wear masks in courtrooms is left to individual judges.

Royal did not elaborate on when and where the alleged contempt occurred, but multiple sources have told Postmedia it happened in provincial court. The provincial court declined to comment, while the Alberta Ministry of Justice said it had no information about the case.

Royal was called to the bar in 1975 and has represented clients in some of Alberta’s highest profile criminal cases. Among his notable former clients are Clifford Sleigh, who in 2005 was convicted of sexually assaulting and murdering six-year-old Corinne “Punky” Gustavson in 1992.

He also served as lawyer for Jason Dix, one of Alberta’s best-known victims of malicious prosecution.

Royal became a Queen’s Counsel in 1986, a distinction awarded to lawyers who have made significant contributions to their fields and their communities. He was a longtime instructor with the University of Alberta law faculty and now lends his name to an award for excellence in sessional teaching.

Royal is married to Mary Moreau, the chief justice of the Alberta Court of Queen’s Bench. Since the start of the pandemic, Moreau has been a proponent of masking, virtual court appearances and COVID-related courtroom remodels.

Contempt hearing begins for Edmonton lawyer who refused to wear mask in court

A leading Edmonton defence lawyer who refused to wear a COVID-19 mask during a trial did not intend to disrespect the judge or the court, his lawyer argued Friday.

Peter Royal was criminally charged with contempt after a July 21 hearing in which Judge Marilena Carminati ordered him to wear a face covering.

Royal told Carminati he was surprised at her stance, and that she was the first judge to require him to wear a mask while speaking.

Caminati nevertheless ordered Royal to put on his mask, stating: “We are not spending three days together in a small courtroom in a poorly ventilated building with counsel not wearing a mask.”

Royal replied: “Well, I’m not going to wear one, so what are you going to do about that?”

He added: “I don’t intend to follow your direction. We’re more than six feet apart, I’ve been doubly vaccinated, we’re surrounded by (layers of Plexiglas).”

At the time of the hearing, Alberta had done away with nearly all COVID-19 restrictions, which have since been reimposed in response to the fourth wave.

Alberta courts, on the other hand, have retained their mask mandate since the beginning, leaving individual judges to decide whether lawyers must mask when speaking.

Judge Bruce Fraser, who was brought in from Calgary to hear Royal’s contempt case, allowed the parties to remove their masks for the duration of Friday’s hearing.

‘Gold standard’

Royal has practised law in Alberta for nearly 50 years. Thousands of lawyers studied evidence with him at the University of Alberta, where his name adorns a prize for excellence in teaching.

Royal is married to Court of Queen’s Bench Chief Justice Mary Moreau, who along with her provincial court and court of appeal counterparts is responsible for setting COVID policy in Alberta courts.

Deborah Hatch, Royal’s lawyer, painted a picture of a venerable legal professional whose actions were ultimately respectful and reasonable.

Hatch submitted affidavits from a who’s who of Edmonton defence lawyers — as well as former Court of Queen’s Bench Justice Joanne Veit — who spoke to Royal’s glittering reputation.

Simon Renouf, a senior Edmonton lawyer, said he could think of no lawyer “who better exemplifies the commitment to the rule of law.” Another colleague called Royal the ethical “gold standard.”

Hatch said reputation does not make Royal “above the law.” Rather, she said the affidavits showed a man who did not intend to disrespect the judge or bring the administration of justice into “disrepute.”

The affidavits also spoke to the lawyers’ experiences with masking during the pandemic.

Daniel Song, a lawyer who submitted evidence on Royal’s behalf, said he has never been denied a request to remove his mask when addressing the court or questioning witnesses.

He added that on July 1, Alberta Premier Jason Kenney lifted almost all pandemic-related restrictions. “The political message to Albertans was unequivocal: the pandemic is over,” he said.

Hatch also disputed Carminati’s claim that courtrooms are unsafe without masking. She said courtrooms have been remodelled since COVID, with reduced capacity limits and semi-enclosed plastic shields around the judge, clerk and counsel tables. Health officials confirmed to her that ventilation in the Edmonton courthouse “meets or exceeds” COVID-related air quality guidelines set out by the chief medical officer of health.

Hatch said that while Royal’s comments could have been worded more “delicately and politely,” they do not betray a disrespect for the court or indicate a case of “public defiance.” She submitted transcripts of the hearing, which were “replete” with “thanks yous” and “your honours.”

Moreover, she noted Royal’s position regarding masking did not derail the trial. The proceeding, a sexual assault trial, took place several days later and resulted in an acquittal for Royal’s client.

“It could have taken place on the day in question in another courtroom, with many other judges who do not have difficulty with masks being removed,” said Hatch.

Contempt is an “extraordinary” power that courts should use with discretion, added Hatch. She pointed to instances in which lawyers and judges have been caught falling asleep, playing computer games, rolling their eyes and even throwing things without attracting contempt charges.

Peter Mackenzie, the Crown prosecutor, made a brief series of submissions lasting just a few minutes.

Fraser reserved his decision for a later date. The matter is next in court Oct. 8 for scheduling.

$2,000 fine imposed on Edmonton lawyer found in contempt for not wearing mask in court

A judge ruled Monday that an Edmonton lawyer who refused to wear a face mask in court during the COVID-19 pandemic acted in contempt and imposed a fine.

Peter Royal, a prominent defence lawyer, was cited with contempt of court after a July 21 hearing in which he refused the orders of Judge Marilena Carminati to wear a face-covering while speaking.

As a result of the incident, that trial was adjourned.

While reading his decision, Judge Bruce Fraser, who was brought in from Calgary for the proceedings, noted that the July hearing was part of a sexual assault trial that had already been adjourned three times.

While Royal was not counsel on the previous trial dates, Fraser said, he was counsel on the July date and either had to know or ought to have known the history of the file, and his defiance interfered with the fair and orderly administration of justice by obstructing the proceedings of that trial.

“Given that history, it was imperative the trial proceed,” Fraser said. “The defiance by the alleged contemner not to wear a mask as directed by the court meant the trial could not proceed, and it did not.”

Fraser also highlighted the fact that Royal not only defied Carminati’s order but challenged the court by saying “What are you going to do about that?” before refusing another masking order five days later, arguing that he was “being consistent.”

“The combination of these actions indicate behaviour that is contumacious,” Fraser added, “meaning willfully stubborn and disobedient conduct that is rebellious, defiant, insubordinate and intractable.”

Addressing the court, Royal apologized for the trouble he caused and said he deeply regrets putting the court through this process, adding that in nearly 46 years of practice, he has never found himself in such a position.

“You have my assurance that I acknowledge my responsibility, and this sort of behaviour will not occur again,” he said.

Satisfied that Royal purged his contempt in a sincere manner, Fraser set the penalty at $2,000 to be paid by the end of the year, noting the punishment was necessary to deter anyone appearing before the court to engage in similar behaviour.

The fine might have been in the range of tens of thousands of dollars, Fraser said, but mitigating factors such as Royal purging his contempt — as well as his reputation as a lawyer known for otherwise respecting the court and the rule of law, and the effect of the COVID-19 pandemic on officers of the court — whittled that figure down.

Back in July, Alberta had scrapped nearly all COVID-19 restrictions, but reintroduced them in response to a fourth wave of infections. Alberta courts, however, have held onto their mask mandate since the beginning, leaving individual judges to decide whether lawyers must mask when speaking.

“In my view, the judge does not have to justify her directions as to how her court will proceed and what measures she will direct within the court,” Fraser said, noting that it is necessary for judges like Carminati to exercise judicial independence. “Once she enters the court, and the proceedings commence, she has full control over the courtroom and its proceedings.”

Court of Appeal quashes contempt conviction for Edmonton lawyer who refused judge's mask order

Alberta’s Court of Appeal quashed a contempt conviction for an Edmonton lawyer who refused to wear a mask in court last year.

Peter Royal, a prominent defence lawyer who has since retired, was cited with contempt of court during a July 2021 hearing after refusing provincial court Judge Marilena Carminati’s order to wear a face covering due to the COVID-19 pandemic. Another provincial court judge held a hearing the following November, found Royal in contempt and ordered him to pay a $2,000 fine.

In a decision issued Tuesday, the Court of Appeal ruled that the second provincial court judge “had no jurisdiction to entertain a proceeding for contempt before another judge,” and set aside the conviction.

Steven Penney, a professor with the University of Alberta’s faculty of law, told Postmedia the decision relies on a fairly obscure and brief Supreme Court of Canada judgment.

“The Alberta Court of Appeal found there was binding Supreme Court of Canada authority holding that — while in some circumstances a provincial court judge hearing a matter can find someone in contempt at that very proceeding — it is beyond the jurisdiction of a provincial court judge to refer a contempt proceeding to another judge of the same court.”

Superior courts, including the Court of King’s Bench in Alberta, have what lawyers call “inherent jurisdiction,” but provincial courts have limited powers governed exclusively by legislation, Penney said.

“According to the Alberta Court of Appeal, the law is clear that — at least as far as the Supreme Court of Canada is concerned — the proper route for dealing with contempt sanctions, where the judge who feels that there may be contempt does not want to rule on it himself or herself, is to refer it to a judge of the superior court.”

While much of the province had lifted masking measures at the time of the citation, Alberta courts continued to require face coverings in common areas and individual judges were left to decide whether or not lawyers were required to wear masks in courtrooms.

Judge Bruce Fraser, who presided over the contempt hearing in November, said at the time that Royal’s refusal to wear a mask was “willfully stubborn and disobedient” given that the lawyer also challenged Carminati by asking her “what are you going to do about that?”

However, Fraser was satisfied that Royal purged his contempt after the latter apologized for the trouble he caused and assured the court that sort of behaviour wouldn’t happen again.

Penney said the Court of Appeal’s decision was based purely on provincial court jurisdiction.

“The appeal does not say a single word about the merits of the decision, whether it was appropriate or inappropriate to find Mr. Royal in contempt,” he said.

Royal is married to Mary Moreau, the chief justice of the Alberta Court of King’s Bench who has been a proponent of masking, virtual court appearances and COVID-related courtroom remodels.

Shameful backlash to lawyers' Indigenous culture course shows why we need it

Ignorance is inexcusable. Lawyers must confront inequities in the legal system

Several Alberta lawyers have publicly questioned the existence of systemic discrimination against Indigenous people in Canada. As a member of the legal profession, I am ashamed of their public statements. 

The petitioners to the Law Society of Alberta characterize their challenge to a mandatory Indigenous course in largely neutral terms; their wish is to eliminate the rule enabling mandatory education. However, the heart of the motion is unquestionably a direct attack on the Law Society's Indigenous cultural competency course called "The Path," as revealed by the petitioners' comments in a CBC article

I offer no opinion on the Law Society's power to mandate training and education. Any honest debate about the scope of the Law Society's authority should be welcomed by a profession that prides itself in embracing independence, autonomy, and democratic values. 

What is not up for debate, however, is the history of disadvantage that Indigenous people in this country have endured for centuries. 

Wokeness?

Some petitioners declare they do not believe Canadian justice has a history of systemic discrimination. One described the Law Society's mandated course on Indigenous cultural competency as "political indoctrination" into "a brand of wokeness called decolonization."

These lawyers had the privilege of receiving a post-secondary legal education in Canada. Having benefited from higher education at accredited law schools, lawyers should be educating the public about the inequities engendered by our legal institutions. 

The assertion that Canada has no history of systemic discrimination and that "The Path" is an insipid offshoot of "wokeness," ranks with the belief that the Holocaust was imaginary, that cigarettes do not cause cancer, and that no one landed on the moon. 

These petitioners' public statements are embarrassingly irresponsible and inexcusably ignorant.

Systemic discrimination against Indigenous people in Canada is a fact. Indigenous people make up less than five per cent of the Canadian population; yet they comprise more than 30 per cent of the inmate population in federal prisons.

Unless we harbour the indefensible belief that Indigenous people are born with a chromosome for criminality, then we must accept that the overincarceration of Indigenous people is a product of systemic bias. 

Indeed, the Supreme Court of Canada has impelled lower courts to take "judicial notice" of the fact that our history of colonialism and displacement has translated into lower educational attainment, lower incomes, and higher rates of substance abuse and violence for Indigenous people. 

Courts take "judicial notice" of facts (without the need for further evidence) when those facts are "(1) so notorious or generally accepted as not to be the subject of debate among reasonable persons, or (2) capable of immediate and accurate demonstration by resort to readily accessible sources of indisputable accuracy." 

Are these legally trained individuals seriously saying that they will close their eyes and thumb their noses at the Supreme Court and the rule of law? 

Slow to embrace change

Indigenous communities do not deserve this assault on their dignity. As lawyers, we have the responsibility to advocate for those who cannot always fend for themselves. 

Indigenous people are often the most vulnerable individuals paraded through our courts. We cannot allow this myopic petition to become emblematic of the legal profession's reputation of being slow to embrace change. 

But I am confident that a large majority of my colleagues will resoundingly vote down this petition — because the petitioners' public statements underscore the need for the Law Society of Alberta to mandate culturally sensitive training for these very lawyers.

Mr. Speaker, it is not every day that we have the opportunity to meet a real Canadian hero, but over the Thanksgiving weekend I did just that when I met Private Brent Ginther from the town of Coaldale in my riding.

This quiet reserved young man had finally arrived home after being seriously injured in Afghanistan on June 12 while serving with the Canadian armed forces. These past months he spent recovering in an Edmonton hospital and has many more months of rehabilitation ahead of him.

Members of the community turned out in force to show their respect and support for Brent. An honour guard greeted him at the airport. A police escort led the limousine procession through the streets lined with yellow ribbons, while hundreds of flag-waving school children and citizens welcomed Brent home. An evening reception put on by the townspeople was organized to support Brent and to thank him for continuing the Canadian tradition of fighting for freedom and protecting those less fortunate.

When I went to his home to pass on the good wishes of the citizens of southern Alberta, he was surrounded by family and friends and was obviously very happy to finally be enjoying the comforts of home.

We all wish Private Ginther a full recovery and thank him for his sacrifice. As Remembrance Day approaches, we will not forget.

Taber-Warner candidates weigh in at Coaldale forum

Candidates for the Taber-Warner riding took part in an election forum hosted by the Coaldale Chamber of Commerce on Thursday at the Gem of the West Museum.

UCP candidate Grant Hunter was joined by Wildrose Loyalty Coalition candidate Paul Hinman, and Brent Ginther of the Solidarity Movement of Alberta. Frank Kast of the Indepence Party, Jazminn Hintz of the NDP and the Green Party’s Joel Hunt did not attend.

Topics of discussion ranged from wind farms in the region to healthcare and Alberta’s relationship with Ottawa.

The candidates began with an introduction to their platform and were granted five minutes each for this portion of the program. The candidates were then asked a series of submitted questions from voters.

On the topic of education, candidates were asked how does their party plan to address class sizes in K-12 education?

Hinman said, “when kids first go to school in grade one they are so excited to get there. The teacher will ask the student to draw a picture of the best part of their summer. They will immediately grab their crayons and they will start drawing a picture and expressing their thoughts by the time they get to grades 4-6, the teacher would ask that same question and the student will say, ‘well what specifically do you want me to do?'(Students) want instructions, and what our system is doing is putting our kids on a conveyor belt and giving them what they are to do and how to do it, rather than letting them be free to learn and to express themselves. We absolutely need to reduce the size of our classes but the truth is that Albertans are over-taxed, we can do better and in fact we send $65 billion to Ottawa and its unacceptable to send that amount of money and then beg for money back whether it is for healthcare or policing or infrastructure.”

Hunter said, “One of the problems that we are trying to address, (is) we have a lot of people entering Alberta, we have net migration coming into Alberta and with that you’re going to have bigger sizes of classrooms. That net migration is because we got back the Alberta Advantage, we did something right again in Alberta with a conservative government. These are good problems to have. They are problems and we will solve them, we will fund them properly but this is something that we have to address because we’re adding the size of Lethbridge every year coming into this province. Yes, the classrooms are getting bigger in certain areas so we need to address that and we will.”

In response to Hunter, Ginther said, “A lot of this net migration that people seem to be happy about there are kids that actually come and don’t speak English. So these new kids come and they aren’t only adding to our numbers, but they are adding to level of difficulty trying to educate.”

On the topic of healthcare the candidates were asked what their party’s solution or strategy would be to address emergency care, ER wait times and doctor shortages.

Hunter said, “In southern Alberta we have struggled to make sure we have doctors stay in rural Alberta and one of the ways we will actually address this issue is to be able to train rural Albertans from rural Alberta to become doctors and then they go back into rural Alberta because their family is there, and that is probably the best way to be able to address that issue. That is a long-term solution to some of the problems we have.” In terms of short term solutions, Hunter spoke about Alternate Physician Remuneration (APR) as a strategy to incentivize rural physicians to practice in southern Alberta.

Hinman: “We don’t have proper care for senior facilities for people who need to get out of the hospital. Our system has been centralized over the decades and centralization is the wrong answer,” and went on to state initial cost estimates to centralize ambulance services was $60 million, but soon doubled to $120 million. “They have no clue of all the volunteerism that went on in rural Alberta. Central government is disconnected, they don’t understand what we have and what we do here in our communities and we need to decentralize. We cannot have Edmontonians making decisions and saying that we don’t understand the system; we do and we need locals doctors to decide their own scope of practice.”

Ginther: “I think the first thing that the government could do is apologize for firing unvaccinated workers and trying to lure some of those back. It would go a long way to incentivizing health care workers to come from other provinces because who in their right mind would pack up their life and move to Alberta to work in an industry where they just fired hundreds of worker for not doing exactly what the government told them? I think another thing we can do is open the system up to some privatization. You can look at something like laser eye surgery which used to cost $20,000 per eye, and now costs about $2,000 per eye. We need some carrots on some sticks to try to lure some doctors to this area because if you are one of the 69,000 people on the surgical waitlist, you don’t really care what the excuses are, you want your doctor.”

The forum lasted for two hours, and the candidates spoke on a wide range of topics from the issue of homelessness to medical assistance in dying (MAID), and the government’s role in conservation.

The provincial election will be held on May 29.

 
 
 

Coaldale teacher on the campaign trail for the Solidarity Movement

Representing the campaign for the Solidarity Movement of Alberta for the Taber-Warner riding, Brent Ginther stands for common sense principles.

“The Solidarity Movement is led by Artur Pawlowski, the pastor from Calgary who keeps getting thrown in jail for when he went down to Coutts there, and giving his sermon. The party stands for a lot of common sense, conservative principles.”

Ginther said he got involved with the Solidarity Movement of Alberta after a purge of the Independence Party of Alberta rescinded the membership of Pawlowski. 

He believes the UCP have a lot to answer for in their handling of the COVID-19 pandemic.

“The main reason I got into this was because Grant Hunter (Taber-Warner UCP) didn’t do the right things during COVID, and go against his party. And so I could not look myself in the mirror and do the exact same thing. He did go along with a party that I knew was doing the wrong thing. So I left them. Art needed 44 people to form the Solidarity Movement. And it was originally kind of intended as a coalition of independence candidates, like nobody’s going to tell you exactly what to say about any issue. And so I threw my name, and I said I’d be one of his 44.”

Ginther hails from Coaldale, where he is currently a school teacher.

“I’m kind of a local guy, been my home since the early ‘90s. When I was in high school, and 9/11 happened, I joined the army right out of high school. I never had any intentions of becoming a teacher. So I went to Afghanistan in 2006, and wound up taking a burst of machine gun fire in the legs and kind of had to come home and start from scratch, square one. So I did a few things. I got a degree in environmental science, and later on a degree in education and eventually became a teacher. And I have my own family here raising my kids. And the rest is history.”

Ginther is convinced the UCP betrayed Albertans in implementing many of the restrictions and mandates during the pandemic.

“The UCP lost me during COVID when they came out with their vaccine passport. I mean, they swore up and down, left and right that they were never going to do that…and Grant Hunter obviously knew that what they were doing was wrong, because he showed up in Coutts with his grandkids to take pictures. But for the one guy who actually had power to do something, and to not do it, I was just not going to let that go without doing something about it. And I originally never had any intention ever of running for politics in my life. I showed up at a couple of constituency association meetings for the Independence Party. They were working to put their name forward to be the candidate and I thought, ‘I’m not just gonna let him go unchallenged and never have anybody say anything about what he’s managed to pull off here and let them just sweep that under the rug and forget about it’.”

Ginther’s main message is that holding your nose and trusting the UCP with your vote won’t initiate any change in the party ranks.

“For me, the central issue is that you can’t trust the UCP party and they can say whatever they want, but we already know that when push comes to shove, they’re going to do whatever the leader of that party tells them to do, and that might not be the right thing. So some of the things that I think are actually really important for Alberta are getting its own police force, and a referendum on independence. So I’m still an independence-minded person, but those, to me, are the two biggest things that we need to push: Alberta’s police force and a referendum on independence.”

“Don’t trust the UCP,” concluded Ginther. “We’ve already seen that they’ll say one thing and do another.”
