This notice is to inform the press and the public at large, that today the President, Secretary and Chief Human Resources Officer of the Treasury Board (the official employer of federal public servants) have been served with a Cease and Desist letter regarding the federal vaccination mandate for public servants.
Today, January 26th 2022, the lawyers for Feds For Freedom, a not-for-profit advocacy organization for public servants, served The Honorable Mona Fortier, Peter Wallace, Christine Donughue along with all Departmental Ministers of the Core Public Service Administration under the Treasury Board Secretariat. These documents put the individuals served on notice that the federal vaccine mandates are unjustifiable, unconstitutional and criminal in nature. Feds For Freedom maintains that bodily autonomy and informed consent, free of coercion, intimidation or bullying are fundamental rights that are inviolable. The consequences laid out by legal counsel include, but are not limited to:
- Numerous charter rights challenges;
- Legal action against the Government of Canada; and
- Applications seeking injunctive relief and punitive damages.
As federal public servants, we have had our livelihoods stripped from us; we have endured unprecedented amounts stress and hardships. We have been harassed, ridiculed, mocked and had hatred and violence incited against us. This type of abusive behavior cannot and will not be tolerated; we expect and request an expeditious response.

I held her to our contract and advised she should send the bill to JCCF. This is the 5th or 6th time documented she do so, and the first time "Sure, I can approach JCCF." she did? The answer came at 5:59 am this morning that JCCF was going to pay "the outstanding balance" and make a media release. I waited all day and none was made and still advertising my image with a donate button. The reason I was waiting is because she arbitrarily used my trust without me releasing it to her "if it was needed". Then I noticed your email was also sent to John Carpay. I have no worries because no matter what they will be paying the entire amount and not just the remainder. I do want to see how they handle this before this portion is shared. Will they admit the mental distress they have placed on me during this crucial trial I was headed to? Why did my lawyer not follow her contract in so many ways? I was constantly pressed to take deals. I could have used trust to travel and my stay for court and every donor would vouch they would be happy with that as I have the list she sent me and know everyone on it. No media release was made and no contact from JCCF. Monick says it is up to I to "take it up with her" meaning Eva Chipiuk. The problem for Monick is now that I do not give my number out at that time and could only be found in our secure contract that was shared with JCCF as Eva was still working for JCCF. If she would have called about my case I probably would or could not have an issue. That is not the case though and did document with an email and a call to Monick within 10 minutes. Please give it a day to see how they respond. Because it is cross border legal services with many contractual violations and ethics violations this is now a King's bench matter. I will be preparing a file for the complaints. I noticed that Vincent Gircys has decided to not read nor understand the importance of taking a few minutes to review. William "Bill" Matthews (born July 22, 1947 in Grand Bank, Newfoundland) is a Canadian politician. Matthews was a Progressive Conservative member of the Newfoundland and Labrador House of Assembly from 1982 to 1996. During this time, he was a cabinet minister, as Minister of Culture, Recreation and Youth from 1985 to 1988 and Minister of Career Development and Advanced Studies from 1988 to 1989. Matthews was later elected to the House of Commons of Canada in 1997 as a member of the Progressive Conservative Party of Canada, representing the riding of Burin—St. George's. He crossed the floor to the Liberals in 1999, and continued to represent the riding until 2004. In that year's federal election, he was elected to the newly redistributed district of Random—Burin—St. George's, which he represented until 2008. Matthews is a former teacher. He is a former Parliamentary Secretary to the Queen's Privy Council for Canada and Minister of Intergovernmental Affairs, Deputy House Leader of the Progressive Conservative Party, and Progressive Conservative critic of Fisheries and Oceans. After 10 years in the House of Commons, Matthews called Prime Minister Harper a "liar",[1] and was not permitted by Speaker of the House Peter Milliken to rise in the House for the final 14 months of his political career.[2] Matthews did not run for reelection in the 2008 election. (Randall McKenzie/CBC) People gathered at a Winnipeg hotel Thursday to hear witnesses air grievances and share concerns over Canada's COVID-19 response as part of a citizen-led, cross-Canada inquiry that aims to examine how governments and institutions reacted to the pandemic. "This is a unique inquiry in many ways. It is citizen run, it is citizen funded," said Michelle Leduc Catlin, a spokesperson for the National Citizens Inquiry into Canada's Response to COVID-19. "There is no one funder. This is done through people in Canada who want to hear what Canadians have experienced." Hearings held so far have included testimony from expert witnesses and members of the public on pandemic policies. The inquiry started in Truro, N.S., before moving to Toronto and now to Winnipeg, where the first of three days of hearings took place at the Holiday Inn Airport West Hotel on Thursday. Witnesses questioned the decision-making and science behind public health measures such as vaccine mandates, restrictions on in-person gatherings and school closures. The inquiry was originally launched by former Reform Party leader Preston Manning, who organizers said has since stepped aside as spokesperson. During one exchange, commissioner Ken Drysdale asked Stanford University health policy Prof. Jay Bhattacharya whether risk assessments on implementing policies such as remote learning gave enough consideration to the consequences. "You would think about a whole wide range of outcomes from a policy, not just simply the putative benefits of a policy before you adopt it," said Bhattacharya, a critic of lockdown measures in the U.S. and a co-author of the controversial Great Barrington Declaration. It suggested building up herd immunity by allowing the coronavirus that causes COVID-19 to spread naturally, and encouraged focused protection of people at higher risk of dying from the illness. "I think so many of those principles were thrown aside in the decision-making around COVID and COVID policy," said Bhattacharya, who also testified as a witness during a 2021 court challenge against Manitoba's COVID-19 restrictions launched by seven Manitoba churches. In a statement to CBC, the province said Roussin receives a number of invitations and declined this one. Decisions on COVID-19 restrictions "were made based on the best available medical advice," the province said in an email. Bylsma spoke at the rally on April 10, 2021 and was later told to appear at the provincial offences court in Welland to answer to two charges: failing to comply with an order made during a declared emergency and failing to comply with a continued 7.0.2 order, which prevented people from attending certain gatherings of 10 or more people. Since he was charged, the case has been adjourned around 10 times, and faced its latest delay on Oct. 25, one day after Bylsma lost his bid for re-election as mayor. At a hearing at the Welland Provincial Offences court, Sandra Pollock, the legal representative for Bylsma, successfully argued that the case should be deferred until a case going through the Ontario Superior Court system reaches its conclusion. The outcome of that case could impact Bylsma’s, since they are about similar issues. In that case, Randy Hillier is taking on the Province of Ontario after he was charged under the Provincial Offences Act for his role in protests in Brockville and Cornwall in spring 2021. The former member of provincial Parliament for Lanark — Frontenac — Kingston was charged by the province with breaching the stay-at-home orders as an organizer of the protests. According to the Justice Centre for Constitutional Freedoms (JCCF), whose lawyers are representing him, Hillier was charged under the Reopening Ontario Act for failing to comply with an order. If found guilty, he could be fined up to $100,000 and spend one year in prison. “In addition, Mr. Hillier was charged with hosting and organizing a public event where the number of those in attendance exceeded the number permitted under an Order, for which the minimum penalty is $10,000,” read a statement put out by the JCCF on Oct. 20. However, Hillier’s court case argues that the stay-at-home orders unjustifiably infringed rights and freedoms guaranteed under the Charter and therefore has “no force or effect.” “Although the Stay-at-Home Order and Outdoor Gathering Restrictions are no longer in effect, the consequences of these authoritative measures continue to exist for Ontarians, who are faced with fines and potential imprisonment as a result of the offence provisions contained in the Reopening Ontario Act,” said the JCCF statement. “As part of the court challenge, the lawyers will argue that the Stay-at-Home Order, Outdoor Gathering Restrictions, and Offence Provisions violated Charter-protected rights, such as the right to assemble peacefully and the right to free expression.” The outcome of that case could set a precedent about the stay-at-home orders, as if the Hillier case finds that the stay-at-home orders were unconstitutional then the provincial regulation could be struck down. A lawsuit was filed on Sept. 23 by the Justice Centre for Constitutional Freedoms (JCCF) on behalf of Jonker, disputing the recommendation of the Integrity Commissioner, which was published on July 12. That report found that, through his role in the “Freedom Convoy” protest in Ottawa earlier this year, Jonker breached two sections of the code of conduct. The investigation, carried out by Toronto law firm Aird & Berlis LLP, found the councillor was a vocal representative and leader of the convoy, including after the point the protest was deemed unlawful, meaning the councillor was no longer able to fulfil his duty of loyalty to residents. At a council meeting on July 18, councillors voted to receive the report and penalize Jonker by stripping him of 30 days pay and asked him to account for all donations he received during the protest and repay that amount. Now, the JCCF announced that it has submitted the lawsuit on behalf of the councillor, aiming to reverse the decision to financially penalize Jonker. In a statement, the JCCF said it is arguing that the decision was invalid due to “procedural irregularities, factual errors and flawed findings” in the commissioner’s report, particularly that Jonker participated in an illegal protest. JCCF also asserts that Jonker’s charter rights to freedom of expression were violated by the decision. Jonker said that he is pursuing the lawsuit since he believes council’s decision was incorrect. “Town council punished me for legally protesting, and so challenging this decision is the right thing to do,” he said. “I was punished for exercising my democratic rights. “(I hope to gain) a court decision that makes it clear that codes of conduct cannot be used to attempt to silence dissent.” Jorge Pineda, the lawyer for Jonker, said the JCCF was funding the lawsuit and they believed that Jonker was punished for engaging in a peaceful protest. “It is our view that Mr. Jonker has been punished by West Lincoln council for engaging in peaceful political protest, which is a violation of the Constitution,” said Pineda. “The claim that Mr. Jonker participated in illegal activity is a suggestion that is not supported by the facts,” said Pineda in a statement. “It is also bewildering that the Integrity Commissioner found that Mr. Jonker, who is a trucker, was in Ottawa in connection with his duties as a town councillor, rather than as a trucker and Canadian citizen peacefully protesting federal and provincial mandates,” he said. JCCF lawyers will bring this case to Hamilton Divisional Court on a date to be announced, the statement said. According to Pineda, the JCCF is a non-partisan charity that funds public-interest charter litigation across Canada using a network of JCCF-affiliated lawyers. Harold Jonker broke the code of conduct during his role in the "freedom" convoy in Ottawa earlier this year. The report, published on July 12, found that Jonker broke two sections of the code of conduct: one requiring a duty of loyalty to residents, and another regarding the acceptance of gifts or benefits. On Monday, July 18, West Lincoln council received the report and voted to penalize Jonker for his actions. The investigation, carried out by Toronto law firm Aird & Berlis LLP, found the councillor was a vocal representative and leader of the convoy, including after the point the protest was deemed unlawful, meaning the councillor was no longer able to fulfil his duty of loyalty to residents. It found that Jonker was described as the head of the Niagara convoy and claimed he was among the first group of trucks to reach Parliament Hill on Jan. 28. Jonker said he did not go to Ottawa as a councillor, but rather as a truck driver and company owner to support what he believed to be a peaceful, lawful demonstration. “If you’re a member of council, you’re a representative, at all times, of the council,” said John Mascarin, partner at Aird & Berlis LLP. Responding to the investigation, Jonker wrote: “As a representative I choose to represent the residents who are being negatively affected by the lockdowns and mandates.” The investigation chose to accept that meant he was a representative of the township. Jonker was also deemed to have breached the section of the code that prohibits the acceptance of gifts or benefits. In comments to media at the time, the councillor confirmed he accepted gifts of fuel and food during the demonstration. The investigation invited Jonker to outline the gifts or benefits he received, but he did not reply, allowing the investigation to find that the councillor did accept the gifts or benefits. Jonker said that he missed the email, sent to his township email account, and criticized the investigators for not following up to check he received it before accepting that the lack of response was his fault. However, Mascarin said that it was convenient that Jonker was only raising the missed email in the council meeting and was attempting to undermine their process and procedure, which was correctly followed. “If he’s missing emails, it’s a big problem … I’ll be honest, I thought he was ignoring us,” said Mascarin. At the council meeting, Jonker claimed he did not receive any gifts or benefits as part of his role as a councillor, but rather as a truck driver. He did not personally receive any lodging or fuel, but received coffee, hamburgers and bacon and eggs. He said it would be impossible for him to quantify the amount of food he received during the demonstration, which Mascarin countered by saying that as a councillor, he should have kept track. In closing, Jonker asked: “Do we want to live in a country where we are not allowed to protest, or some of us are not allowed to protest, against what we believe and understand to be wrong and harmful for our country?” “It’s still heart-wrenching and very tough for me when people come up to me, still to this day, and thank me as a truck driver for saving their life, for giving them hope,” he continued. Law Times reported that Superior Court Justice Calum MacLeod, on Feb. 17, issued a Mareva injunction freezing assets linked to bank accounts, fundraisers and cryptocurrency, including Bitcoin, Cardano, Ethereum, Litecoin and Monero in over 120 wallets raised for the freedom convoy protest. The injunction restricted convoy leaders and their fundraisers from selling, removing, dissipating, alienating, transferring, assigning or encumbering any listed assets. Ottawa residents filed a class action against the freedom convoy protesters seeking $306 million in damages for the three-week blockade, which disrupted people’s lives and forced businesses to close. If the lawsuit is successful, the Mareva order secures assets for the courts to reward residents with some of the protest money raised by organizers. Organizers turned to cryptocurrency after the courts froze donations raised by online fundraising sites. In his initial ruling, Justice MacLeod wrote that defendants promoted the use of cryptocurrency under the mistaken belief that it is untraceable and cannot be seized by the courts or legal authority. “It’s a pretty big step today that the cryptocurrency assets are going to be secured in an escrow agent,” says Lenczner Slaght partner Monique Jilesen. Lenczner Slaght acted for Champ & Associates, the law firm representing Ottawa residents in the proposed lawsuit. The firms brought a motion against Patrick King, Tamara Lich, Christopher Garrah, Nicholas St. Louis, Benjamin Ditcher and the non-profit Freedom 2022 Human Rights and Freedoms to demonstrate that they were leaders of the freedom convoy protests. Jilesen says defendants delivered responding materials on whether a Mareva injunction was needed, but arguments were adjourned. The opposing lawyer, Norman Groot, represented all the defendants except for Patrick King, who was not present and did not have a lawyer representing him. It is independent and separate from any of the criminal processes that may be underway.” Bobby Kofman, president of KSV Advisory, the proposed escrow agent, advised that the injunction was satisfactory, and the firm is prepared to act as an escrow. The Lawsuit
This is a proposed class action lawsuit seeking compensation for the serious harms and losses experienced by the residents, businesses, and workers in downtown Ottawa due to the Freedom Convoy occupation.
Why?
The Defendants deliberately planned and coordinated tactics to block all the streets and roadways around Parliament Hill and the surrounding neighbourhoods, and to make as much noise and air pollution as possible to cause discomfort and distress to Ottawa residents, business, and workers to coerce governments to comply with their demands.
The non-stop blaring horns, diesel fumes, unexpected fireworks, and loud sound systems blasting music have caused the residents unbearable torment in the sanctity of their own homes.
The Defendants are aware or ought to be aware that these tactics can cause permanent physical damage and psychological harm. The Defendants have acted with wanton disregard towards the residents, businesses, and workers of Ottawa.
Canada is a free and democratic society with a long tradition of peaceful protest and assemblies. The Defendants have abused those freedoms to cause serious harm to others, innocent bystanders to the Defendants’ pursuit of their misguided political goals.
