Saint John pastor pleads not guilty to violating COVID restrictions, obstructing peace officer
Philip James Hutchings says he's contemplating a constitutional challenge
Some of the charges stem from what was described as a "packed service" on Oct. 10.
In a sworn affidavit, a peace officer who went to the church that day
to verify compliance with public health restrictions said he was blocked
from entering by two individuals who were wearing tags that said
"security."
Allen Dow said he later observed some 100 people exiting the church and only a few were wearing masks.
Hutchings's defence lawyer, Jonathan Martin, spoke to the court by phone.
Martin later told CBC News that those documents have yet to be filed and he declined to comment further on what kind of argument he was contemplating.
Meanwhile, the judge scheduled a two-day trial for Hutchings starting June 6.
He pleaded not guilty Thursday to obstructing a peace officer.
On Tuesday, LeMesurier is also expected to hear another charge laid against Hutchings.
It's not yet clear what that charge is.
Last Sunday, His Tabernacle Church set up tents on Ashburn Lake Road in Saint John.

New Brunswick's Department of Justice and Public Safety said it had been informed of the service as required by a court undertaking.
And a department spokesperson said Sunday's gathering was being investigated.
Last month, churches in Manitoba tried to argue that a ban on in-person services violated their charter rights, including freedom of religion and freedom to assemble.
However, Court of Queen's Bench Chief Justice Glenn Joyal found the public health orders were reasonable limitations in the context of the pandemic.
While fundamental freedoms should not disappear in a pandemic, Joyal said, he accepted that the Manitoba government had to make swift, decisive decisions in order to regain control of the virus and save lives.
As Hutchings left the courthouse Thursday, he declined to talk about the constitutional case that was mentioned in court.
He said he'd be able to provide more information "very soon."

Judge warns directors they could go to jail if they violate the order
Pastor Philip Hutchings and assistant pastors Cody and Dana Butler all signed the agreement on Friday afternoon.
And just to make sure they understood the gravity of the situation, Justice Hugh McLellan made Cody and Dana Butler read out sections of the agreement.
He told them he didn't want anyone to come back the next time and claim they didn't understand what was expected of them.
"Do you know why we take this stuff so seriously, sir?" McLellan asked Cody Butler.
"To ensure the safety of the public," responded Butler, who's scheduled to appear in criminal court on Nov. 4 for allegedly refusing to allow peace officers in the church to ensure compliance.

"Have you heard about all of these cases around the province and in Saint John? Have you heard about that?" continued the judge.
Butler said that he had.
"Do you get the idea how serious we take this for public safety?" asked McLellan.
The judge also stressed that the directors would be held "personally responsible" if there's "any more foolishness about noncompliance with the COVID rules."
Dana Butler read the same section aloud in court and acknowledged that people can get sick if they don't follow the rules.
"And some are dying," added the judge.
Dana Butler said she knew the Oct. 10 church services did not comply with an Oct. 8 consent order that Hutchings had signed promising to follow the province's pandemic rules for church gatherings.
"Is that going to happen again?" asked McLellan.
"No, sir," she responded.

"Are we clear about that?" the judge pressed.
"Yes, sir," Butler said.
"I want to be clear," McLellan said. "You could end up going to jail if there's a violation of this."
He stressed that the directors were being held personally responsible for the actions of the church. And just to make sure they understood, he made the Butlers initial that section of the already-signed original document.
Hutchings signed a similar agreement last week when he was released from jail after seven days for being in contempt of court for failing to abide by his promise to the court to comply with the rules.
The agreement says all three directors of the church will comply with COVID protocols, including giving Public Safety officials access to church gatherings. They also agreed to not hold any secret services and promised to let Public Safety know if they plan to have services in a different location or at times that differ from regularly scheduled services.
They also agreed to "refrain encouraging harassment of public or government officials."
That agreement will remain in place until the court deals with an application by the province under Section 55 of the Public Health Act. No date has been set.
Social media posts tip off province
According to an 80-page court file, the church first came to the province's attention in September, when Hutchings posted on social media that his church would operate at full capacity and wouldn't require masks or proof of vaccination.
The province's updated emergency order said churches must choose between requiring proof of vaccination or holding services at 50 per cent capacity with distancing, contact tracing lists and no singing. Masks are mandatory with either option.
The emergency order also gives peace officers the authority to enter any building without permission to ensure compliance with the rules.
On Oct. 1, an official with the province contacted Hutchings and explained the rules. He agreed to comply, according to the court file.

Two days later, another official attended Sunday service at the church. According to her affidavit, she was the only person wearing a mask. She said no one asked for proof of immunization, there was no physical distancing, and there was congregational singing.
The officer left after about 10 minutes, saying she was uncomfortable "due to the COVID risks at this service."
Hutchings was then fined for non-compliance on Oct. 6.
On Oct. 8, the province went to court to get an "interlocutory order" to shut down the church for continued non-compliance, but Hutchings signed the consent order, agreeing to "make all reasonable efforts to ensure compliance" with the rules governing faith-based gatherings.
Two days after the agreement was signed, Public Safety visited the church and videotaped people coming and going freely and not wearing masks, including footage of an unmasked Hutchings coming to the door of the church.

Philip Hutchings, of His Tabernacle Family Church, spent seven days in custody after being remanded to jail on Oct. 15 for failing to abide by a court order to follow the province's COVID-19 protocols.
In a brief to the court on Friday, defence lawyer Neil Clements said his client admits to the contempt of court charge, apologizes for it, and promises to comply with the province's mandatory order.
Justice Hugh McLellan seemed reluctant to release Hutchings, saying the pastor had made similar promises to the court on Oct. 8, and within days was videotaped flouting the rules and bragging about it on social media.
McLellan asked Hutchings if he remembered being in court two weeks ago and agreeing to follow the province's mandatory order, noting those words were "pretty simple."
Hutchings acknowledged they were.

Yet, McLellan noted, Hutchings was videotaped two days later in his church without a mask, and his "so-called security" refused to let Public Safety officials inside to ensure compliance.
"Do you see how that affects your credibility?" McLellan asked.
Later that Thanksgiving Sunday, Hutchings took to social media, saying he had a "packed" service somewhere else and didn't tell Public Safety.
"In effect mocking them," McLellan said.
Hutchings said they had the evening service on a greenspace near the Renforth Wharf.
"How do you have a packed service on a lawn?" McLellan asked.
Hutchings said that was "a miscommunication."
He acknowledged he made mistakes and asked for another chance. Using a baseball analogy, he suggested that he wasn't out of strikes yet.
"Quite frankly, he's had a bunch of strikes — a lot more than three in this matter," McLellan told the court before leading Hutchings through a number of missteps along the way.
Those included when his supporters were purported to have hassled the deputy minister of justice.
"Have you considered, sir, that you might be misleading and misdirecting some people?" asked the judge in an unrelenting sequence of challenges, questions and admonishments.

"As I see it, there are a number of problems here, including the negative message that this man has been sending to the public about the COVID rules."
McLellan said he was bothered that Hutchings "can use and abuse social media, saying all sorts of nonsense" and often twisting the truth.
He said Hutchings pretended the laws weren't valid, effectively thumbing his nose at the system and then said, "Oops, I'm sorry. Don't I have three strikes?"
In the end, McLellan agreed to release Hutchings once he signed an undertaking to the court that very clearly states that he will "make all reasonable efforts" to comply with the province's COVID-19 protocols.
Hutchings' undertaking to the court will remain in effect until the province's original application, under Section 55 of the Public Health Act, to shut down the church is heard and a decision rendered, "or upon further order of the court."
Hutchings also promised to allow peace officers access to all services to ensure compliance, and must notify the Department of Justice and Public Safety, at least 24 hours in advance, if the services are held at any venue other than 348 Rockland Rd.
Clements told the court the church no longer has access to that facility.
Hutchings also agreed "to refrain from encouraging harassment of public or government officials."
The proceedings were adjourned until Oct. 29 at 2 p.m., when Hutchings' wife, Jamie, and two other church officials, Cody and Dana Butler, are ordered back to court to deal with the church's part of the contempt of court case.
Hutchings declined comment after leaving the courthouse.

New Brunswick pastor apologizes after week in jail over COVID-19 rule breaches
A New Brunswick pastor is free after spending a week in jail and apologizing to the courts Friday for breaches of COVID-19 public health rules.
Philip James Hutchings, the pastor of His Tabernacle Family Church in Saint John, repeatedly apologized in the Court of Queen's Bench and agreed to sign an undertaking stating he understands the health rules and will comply.
Hutchings was found in contempt for not abiding by a consent order signed Oct. 8 requiring his congregants to follow health orders such as masking.
Lawyers for the province say Hutchings held a service two days later where people were seen leaving the church without masks, and health officials were barred from entering.
"My apologies your honour," Hutchings said in court Friday in a low voice while wearing a mask. "I intend to comply." Justice Hugh McLellan was quick to point out that Hutchings also said he would comply two weeks earlier but didn't.
The judge went on to detail how Hutchings and members of his congregation were seen leaving the church without masks, and enforcement officers were stopped by security guards and not allowed to enter the church. He noted that Hutchings then went on social media and mocked the provincial inspectors and boasted that he and congregants held a "packed service" at a new location.
"Do you see how that affects your credibility?" the judge asked. Hutchings asked for another chance, noting that every batter gets three strikes.
That prompted McLellan to start listing the pastor's actions in recent weeks, quipping "I'm losing track of how many strikes there are." He asked if Hutchings has considered that he may be misleading people -- to which Hutchings apologized again.
The judge said words were not enough and drafted an undertaking for Hutchings to sign to say he understands the provincial rules and will comply with them. New Brunswick public health rules require church congregants to wear masks. The law also requires that congregants either show proof of vaccination or keep socially distanced and that they not sing during services, which can be held at up to 50 per cent capacity.
The judge released a consent order declaring that Hutchings was in contempt of the Oct. 8 order and setting the punishment at seven days imprisonment, which has been served. The pastor had been detained since a court hearing last Friday.
McLellan also wants other officers of the church to be bound by the undertaking and has ordered Hutchings, his wife and two other officers to appear in his courtroom on Oct. 29 to sign a similar consent order.
Hutchings told the court his next few services will be conducted online.
The pastor did not speak with reporters as he left the courthouse or with supporters who waved signs that had images of masks and syringes and read "Be Brave! Do Not Comply with Discriminatory Orders and Mandates." One of the supporters, fellow pastor Ken Gilliard, said he doesn't believe there is a pandemic. "We are preaching freedom," he said.

United Church of Canada Bans Unvaxx’d From All Canadian Church Buildings
Jesus may have once been visited by ten lepers, who he cured and then sent to church, but the modern day United Church of Canada is no longer allowing the unvaccinated to worship in person, enter into, utilize or work within its Canadian owned facilities.
The new policy is outlined on a sign posted on the front door of United Church’s flagship Trinity-St. Paul's United Church and Centre for Faith, Justice and the Arts, in downtown Toronto, Ontario.
The sign outside the church is supported by an internal, September 28th, 2021 memo from Trinity St. Paul's general manager Aaron Dawson. It states:
In keeping with the recommendations of the Province and the United Church of Canada, the Building Management Board and the Church Board of TSP (Trinity Saint Paul’s) have stipulated that all employees of TSP must be fully vaccinated in order to enter the building to work. TSP falls within the categories of venues requiring vaccinations.
To be fully vaccinated everyone must fulfill the requirements as described by the Ontario regulations (O.Reg.645/21,s.1): https://www.ontario.ca/laws/regulation/200364
The Ontario regulations cited in the memo are long, contradictory (perhaps intentionally so), often ambiguous and seemingly intended to encourage overreach by organizations governed under the legislation in an effort to ensure compliance.
Otherwise the bylaw enforcement officers might make daily harassment visits in an effort to shut down the venue, as has happened at numerous other facilities across Canada over the last eighteen months.
It’s even more difficult to thread the compliance needle when you’re attempting to maintain the functions of a multi-use venue like Trinity Saint Paul’s, where until recently worship competed with schooling, exercise classes and twelve step addiction programs for floor space.
The memo then goes on to note that everyone entering the building must have received:
… the full series of a COVID-19 vaccine authorized by Health Canada, or any combination of such vaccines,
one or two doses of a COVID-19 vaccine not authorized by Health Canada, followed by one dose of a COVID-19 mRNA vaccine authorized by Health Canada, or
three doses of a COVID-19 vaccine not authorized by Health
Canada; and
…their final dose of the COVID-19 vaccine at least 14 days before providing the proof of being fully vaccinated.
The memo notes in capital letters that “EMPLOYEES WILL HAVE UNTIL OCTOBER 12, 2021 TO PROVIDE PROOF OF FULL VACCINATION” but also notes that “TSP (Trinity Saint Paul’s) will not be keeping a record of status, but you will be required to show it to enter.”
According to the memo, everyone in the building must provide:
Proof of full vaccination against COVID-19 (as defined above), OR
Written proof of a medical reason that provides a documented reason for not being fully vaccinated against COVID-19 and outlines the time period of the medical reason, and also provide verification of a negative COVID-19 test result obtained within 48 hours of seeking access to the building.
Some, but not many exemptions, are allowed. These include:

Exemptions related to creed or

(Trinity Saint Paul’s) has the discretion to seek information
appropriate in the circumstances.
In essence, an employee of the United Church in Canada is explicitly stating that the Doug Ford provincial government is refusing exceptions related to “creed or religion.”
It’s curious as to why the United Church in not currently up in arms over this rejection of a churches traditional rights under Canadian law.
The memo goes on to note that, while it’s “the discretion of the employee to determine whether they would like to disclose their vaccination status” should you refuse to do so, “you will not be permitted to access TSP (Trinity Saint Paul’s).”
The memo leaves out the obvious fact that it is most assuredly against the law in Ontario for an employer to demand personal health records as a condition of employment.
The memo concludes by noting that.
All efforts to accommodate you will be made within the above described framework, while making every effort to protect the health and safety of everyone using the facilities. Accommodations may include:
A negative COVID-19 test result.
An unpaid leave of absence.
Alternative work arrangements.
I know this is a difficult time for us all.
However, we are in good company as organizations and municipalities, such as the City of Toronto, have already stipulated mandatory proof of vaccinations for staff.

August 20, 2021 that it now “strongly recommends” that employers
implement mandatory proof of vaccinations in their workplace:

While this new policy isn’t explicitly noted on the main United Church website, it is congruent with various policy papers and documents published previously. These papers include:
The undated “Call for Global Vaccine Access for All” which “asks the government to act now” and notes that the pandemic is not over until everyone around the world has been vaccinated.
The undated “Matching Vaccine Donations Announced” which notes that the United Church “Pay It Forward Campaign,” to encourage Canadian’s to buy vaccines from large, affluent mostly US based multinational drug companies for third world nations, “will now be matched by (Canadian) government funds.”
As outlined in the April 15th, 2021 United Church post, “GCE Temporarily Amends Pastoral Relations Policies,” the Executive of the General Council (GCE) of the United Church has “temporarily” amended pastoral relations policies “to allow the governing body, rather than a congregational meeting, to make certain pastoral relations decisions.”
Traditional protestant congregations, including those belonging to the United Church, have been losing power to their central church councils over the last eighteen months as individual church membership dwindles.
Some blame this on the lack of in-person activities caused by church closures blamed on covid-19. Others note that church membership has been declining for decades, even before the pandemic became a thing.
Oddly enough, this decline in church membership has not been happening in the approximately 135 Canadian protestant churches considered to be reformed (or Calvinist).
Those, churches, many of which have taken action to remain open during the pandemic and have had church members arrested and jailed for their efforts, have seen their church membership grow.
Perhaps this is a lesson traditional churches like the United Church have yet to learn. Here’s hoping they figure it out before they’re forced to close their doors permanently.

United Church Responds to Post on "United Church of Canada Bans Unvaxx’d"
The United Church of Canada has formally responded to the October 12th, 2021 FFN post, "United Church of Canada Bans Unvaxx’d From All Canadian Church Buildings," by mostly denying that any existing United Church vaccination policy is reflected in the policy enacted by Toronto Ontario based Trinity Saint Paul's (TSP) United Church.
The original article referenced an internal, September 28th, 2021 memo from Trinity St. Paul's general manager Aaron Dawson to all staff which stated:
...in keeping with the recommendations of the Province and the United Church of Canada, the Building Management Board and the Church Board of TSP (Trinity Saint Paul’s) have stipulated that all employees of TSP must be fully vaccinated in order to enter the building to work. TSP falls within the categories of venues requiring vaccinations.
To be fully vaccinated everyone must fulfill the requirements as described by the Ontario regulations (O.Reg.645/21,s.1): https://www.ontario.ca/laws/regulation/200364
But according to United Church of Canada executive officer for communications Catherine Rodd, who responded via email to this publication, the original story is in error:
... Each congregation sets its own "use of building policy," depending on its context. In our structure, the National church has no authority to dictate to congregations how to use their buildings. That's between the congregation and the next level, the regional council.
Your reporter should have done their homework before extrapolating one church's policy as that of the whole denomination. I also notice, no one contacted the church itself for a comment.
It's worth noting that FFN editor Chuck Black was employed by Trinity Saint Paul's for six years until October 12th, 2021 when he was fired for noncompliance with the TSP vaccination policy. The new policy, announced in the September 28th Dawson memo, requires the disclosure of private and personal health information which Black declined to provide. As a function of his position, Black was in direct, almost daily contact with Dawson and others at TSP.
In her response to this authors query, Rodd avoided providing any specifics on existing United Church policy:
We don't have a comment on this nationally, other than to say, that churches elect their church boards to make these kinds of decisions, and they are ultimately accountable to their members for their decisions. The posting of that notice, says that this is the decision of that congregation's leadership with the support of the congregation.
I would urge you to contact the board chair or the minister for further comment.
Ask for why TSP would explicitly reference the recommendations of the United Church of Canada when outlining its policy, Rodd stated:
I can't speak to that as I wasn't privy to any of the church board's discussions. Please contact the church directly.
Is the United Church of Canada about to throw one of its local congregations "under the bus" in order to avoid controversy?
Only time will tell. This story is ongoing and will be updated as new information becomes available. We're currently attempting to follow-up on Rudd's suggestion by connecting with the TSP board chair and minister.

Pentecostal churches in Atlantic Canada under scrutiny as push to vaccinate ramps up
Religious scholar says Pentecostal faith is not anti-science
"Pentecostals, in my experience today, are not anti-science," said Bradley Noel, chair of the department of Christian ministries at Tyndale University, a private evangelical Christian university in Toronto.
Pentecostalism is a form of Christianity known for its exuberant pastors. Though its numbers are small, the denomination has fallen under scrutiny in Atlantic Canada as governments work to get needles into the arms of the unvaccinated.
In Bishop's Falls, N.L., the First United Pentecostal Church was at the centre of a COVID-19 outbreak this month that ultimately involved 56 infections and killed at least one unvaccinated congregant.
The province described the cluster as being among "a group that is closely socially connected," and Premier Andrew Furey responded by convening a meeting of religious leaders, including Pentecostals, to discuss the importance of the COVID-19 vaccine.
The First United Pentecostal Church's pastor, Leroy Gee, said he complies with whatever public health rules the government introduces, but he worries forced compliance — like requiring vaccination to access services or hold certain jobs — is a sign of increasing control that could have Biblical consequences.
"God doesn't force anybody to serve Him," Gee said in an interview Wednesday. "But we're moving into a time when you're going to be forced to serve the system. And the system is going to be what is known as the tribulation, or the Antichrist system."

In New Brunswick, a Pentecostal church, Amazing Grace, was named as the location of an exposure notification in the northwest of the province on Aug. 29.
Joe Gee, a resident of the nearby town of Carlingford, who is not related to the Newfoundland pastor, said in a recent telephone interview he believes some of his family members were exposed to the virus as a result of its spread in the church, and he wants health officials to investigate what happened.
He said his unvaccinated father died as a result of the outbreak.
Last weekend in Saint John, officials found His Tabernacle Family Church to be violating public health orders.
"Investigations are ongoing, and matters are before the courts," Health Minister Dorothy Shephard told reporters Tuesday.

Phil Hutchings, the Saint John church's founder and lead pastor, posted Sunday to Facebook: "We had a packed service tonight and it was powerful!!! But I forgot to tell Public Safety that we changed locations." This was followed by a laughing emoji.
The church's website says Hutchings, who did not respond to a request for an interview, was trained at the Pentecostal Zion Bible College in Rhode Island.
Leroy Gee said he is vaccinated but he doesn't feel it's his place to tell his congregation in Bishop's Falls to follow suit.
"As a minister, I'm in town here to help people spiritually," he said.
Roy Dee, pastor at Amazing Grace in New Brunswick, said in a recent interview the majority of people in his church are fully vaccinated, and he's never explicitly preached against the practice.
"The only thing I've ever told my parishioners is to be led by peace and to pray about their decisions," Dee said. "That's between them and the Lord."

Noel, who is also a minister with the Pentecostal Assemblies of Newfoundland and Labrador, said that if Pentecostal churches are preaching against vaccination, or breaking public health rules, they're exceptions within the faith.
"Our pastors ... have done their level best to encourage people to follow public health guidelines," he said.
Unlike the Pope, who urged followers to get vaccinated in August, Pentecostal leaders are more likely to stick to spiritual
guidance and tell their congregation to talk to a doctor for COVID-19 advice, he said.
Noel did note that a few Pentecostal churches in Newfoundland are now hosting vaccination clinics.
The faith does have isolationist roots, he acknowledged, and its early members saw themselves as relatively counterculture.

"They believe in angels and demons, they believe in healing. They have a very supernatural world view that they believe is reflected in the Bible."
Both Newfoundland and Labrador and New Brunswick have said churches can choose to use the provinces' vaccine passport systems or they can hold gatherings at 50 per cent capacity, among other restrictions.
Noel said that's a lot to ask any church, Pentecostal or not.
"No pastor wants to turn anyone away at the door who's come out Sunday morning to worship."
Most of Newfoundland and Labrador's Pentecostal churches are in the so-called Bible Belt region, which stretches across central Newfoundland from Gander to the Baie Verte peninsula, Noel said.
The Bible Belt is also home to some of the lowest COVID-19 vaccination rates in the province, government data shows.
But Noel cautioned against drawing a connection.
"Pentecostalism may have done well there because the people were of a reasonably conservative mindset," he said. "That reasonably conservative mindset might be leading them to particular forms of media, and those particular forms of media might be questioning the efficacy of the vaccines."

Pastor of Saint John church jailed for a week after defying COVID rules
Judge calls Philip Hutchings's recent actions during pandemic 'reckless'
Philip Hutchings of His Tabernacle Family Church was remanded to jail until the court proceedings resume next Friday.
But not before he got a tongue-lashing from the judge about flouting the court order he signed a week earlier.
Justice Hugh McLellan of the Court of Queen's Bench said Hutchings essentially "mocked" the order within two days of signing it.
"I have concerns about Mr. Hutchings's personal credibility," McLellan said.
The judge also took Hutchings to task for putting the safety of his congregation in jeopardy by not following the guidelines of Public Health and the rules set out in the province's mandatory order for managing the COVID-19 pandemic.

The judge referred to a four-minute video that was played in court, showing people going into and out of the church without wearing masks. A section of the video clearly showed an unmasked Hutchings coming to the door and standing in the doorway for a short time.
The hearing was held in connection with an application filed by the province to shut down the church for non-compliance.
That was averted On Oct. 8, when Hutchings agreed to comply until a court hearing could be held.
When the parties got to court on Friday afternoon, Hutchings's lawyer, Neil Clements, asked for an adjournment since he had just been retained and wanted a chance to review the file.
The problem, explained McLellan, is that he had already adjourned the case for a week — "a week of non-compliance … and open defiance."
McLellan said it was difficult to put "any weight or credibility" in Hutchings saying he would agree to abide by another court order.
He then invited Jason Caissie, a solicitor for the New Brunswick attorney general, to play the video taken by Public Safety officers outside the Rockland Road church on Thanksgiving on Sunday.
After it played, Caissie said the concern is that Hutchings might hold two services this coming Sunday that could become the province's next "super spreader" events.

"I'm disappointed that he would agree to a consent order to follow the rules on Friday afternoon, and then Sunday, according to that video, breach the rules," McLellan said.
The judge also gave a brief legal lesson on torts and criminal negligence, complete with photocopies of the Criminal Code with applicable sections highlighted.
He told Hutchings that following the guidelines established by the emergency order and Public Health actually protect the church from potential claims if a church-goer tries to sue after contracting COVID-19 at a church event.
He said parishioners look to Hutchings as their protector, "which he has not been to date."
Instead, McLellan said, Hutchings has been "reckless."
The judge then said he'd agree to the adjournment and asked Clements to check his calendar. They agreed on Oct. 22 at 2 p.m.
McLellan said he was still faced with how to protect the public in the meantime. That's when he announced he was going to remand Hutchings into custody.
"Sheriff's officers, take him away," McLellan ordered.
The history
According to an 80-page court file, the church first came to the province's attention in September, when Hutchings posted on social media that his church would not require masks or proof of vaccination and would not impose physical distancing or limit the number of people who attend.
On Sept. 24, the province's updated emergency order said churches must choose between requiring proof of vaccination or holding services at 50 per cent capacity with distancing, contact tracing lists and no singing. Masks are mandatory with either option.
The emergency order also gives peace officers the authority to enter any building without permission to ensure compliance with the rules.

On Oct. 1, an official with the province contacted Hutchings and explained the rules. He agreed to comply, according to the court file.
Two days later, another official attended Sunday service at the church. According to her affidavit, she was the only person wearing a mask. She said no one asked for proof of immunization, there was no physical distancing, and there was congregational singing.
The officer left after about 10 minutes, saying she was uncomfortable "due to the COVID risks at this service."
Hutchings was then fined for non-compliance on Oct. 6.
On Oct. 8, the province went to court to get an "interlocutory order" to shut down the church for continued non-compliance, but Hutchings signed a consent order, agreeing to "make all reasonable efforts to ensure compliance" with the rules governing faith-based gatherings.
But two days after the agreement was signed, Public Safety visited the church and videotaped people coming and going, including the footage that was played in court on Friday.

Pastor Phil Hutchings of His Tabernacle Family Church in Saint John, New Brunswick was arrested today following his refusal to enforce COVID restrictions upon his congregation.
Places of worship in the Atlantic province are required to enforce contact tracing, masking, social distancing, along with a restriction on capacity limits and a prohibition on singing.
Pastor Phil will be held in provincial custody until his next hearing, scheduled for October 22.
His Tabernacle Family Church was ordered closed on Thanksgiving Monday, with some regions in the province being thrown into a 14-day “circuit breaker” lockdown ahead of the holiday long weekend. Another pastor at the church, Cody Butler, was arrested on Thanksgiving Sunday while delivering his sermon.
Butler was later released after agreeing to terms with a court.

Pastor Phil Hutchings of His Tabernacle Church in St. John, New Brunswick spent over 7 days in jail for the crime of allowing his congregation to gather freely in the face of COVID places of worship.
The shocking story of what happened to Phil and his church and his associate pastor Cody Butler has been wildly underreported given the extent of government overreach involved.
The church has been under strict surveillance by authorities, and services were previously disrupted when police and safety officials entered the church to gather evidence.
Hutchings has posted a video and images to his personal Facebook page showing police repeatedly visiting his home.
Attached to the notice of motion to hold Hutchings in contempt was an affidavit of Allen Dow [see below], an inspector with the General Investigation Section of Inspection and Enforcement New Brunswick — a division of the Department of Justice and Public Safety.
The affidavit included a flash drive containing video evidence collected by agents showing the arrest of Butler and individuals leaving the church. The affidavit noted “the vast majority of which are not wearing masks.”
Dow’s affidavit noted that Justice and Public Safety officials were aware that the church may now be worshipping in a secret location. The affidavit from Dow detailed his suspicions of an underground church service in sections 15 and 16.
Attached as Exhibit C is a social media post, from the Facebook account of Respondent Philip James Hutchings account on the evening of October 10, 2021, wherein he states the following “WE HAD A PACKED SERVICE TONIGHT & IT WAS POWERFUL!!! But I forgot to tell Public Safety that we changed locations”.
I have no first-hand knowledge of where this service was held, however, I have heard rumours that the service was held at a location on Rothesay Road where this church had previously been located. I am not aware of the truth of this, however, I have no reason to believe otherwise.

Pastor Tobias Tissen is a Minister of the Church of God in Steinbach Manitoba.
For roughly a year now, he has been at odds with the provincial government over lockdown measures being imposed onto unwilling Manitobans.
The governments restrictions were so tight late last year, that they even shut down drive-in church service. From then on, thousands of dollars in tickets have been issued to Pastor Tobias as well as to his church, and he is still being hunted by local authorities.
Pastor Tobias has a warrant out for his arrest issued by the Manitoba Justice, which can be acted upon by Winnipeg Police at any moment over the next five years.
Not a pleasant feeling to be deemed wanted by the state, I imagine, but life goes on, and he is trying to making the best of the situation, but that's not all he's faced with.
The courts have delayed and delayed and delayed the church's visit to appear before a judge, though currently it is set for October 14, at which point we'll find out about the million dollar fine that could be handed out by the state.
The October 14 court date marks the church's third delayed appearance before the court. But why the delays, and should we expect another?
Considering the Manitoba government's lack of determination in regards to his warrant, and refusing to arrest him at his church when they knew where he would be, perhaps this is all really just about optics, not health.
Lastly I wanted to know, as so many now find their bodily autonomy being infringed upon by governments, employers, and otherwise: what were Pastor Tobias' thoughts in regards to these new vaccine mandates?

Manitoba pastor arrested for violation of health orders
Tobias Tissen, minister at the Church of God in the RM of Hanover, arrested Monday evening in Steinbach
A Manitoba pastor who has openly defied provincial public health orders was arrested Monday evening in Steinbach, Man., the Church of God confirms.
"We ask that Christians would pray for Tobias' strength, wisdom, and release, as well as for his wife and sons," Heinrich Hildebrandt, a pastor at the Steinbach-area church, said in an email to CBC News.
Tobias Tissen, another pastor at the Church of God Restoration near Sarto, Man., in the rural municipality of Hanover, was the subject of an arrest warrant issued earlier this summer for violating public health orders.
Hildebrandt said the arrest was in connection with the outstanding warrant but did not elaborate.
A Twitter account in Tissen's name posted an update Monday evening stating "Tobias will be kept in custody overnight, and is scheduled to appear before a magistrate tomorrow, where he will most likely be asked to sign conditions to obtain his release."
Over the the past year, Tissen and his church have received fines for violating in-person gathering limits.
Tissen is also part of a group of seven rural Manitoba churches fighting the legality of the health order in court.
CBC has reached out to the RCMP to confirm the arrest and is awaiting a response.

Pastor of non-compliant Saint John church scheduled to appear in court Friday afternoon
Philip Hutchings issued $580.50 fine for violating emergency act
Philip Hutchings, of His Tabernacle Family Church, is on the docket for the Court of Queen's Bench division. Exact details were not available from the court, but Hutchings and the church have been accused by Public Safety of flouting the province's emergency order.
According to an 80-page court file, the church first came to the province's attention in September when Hutchings posted on social media that his church would not require masks or proof of vaccination, and would not impose physical distancing or limit the number of attendees.
On Sept. 24, the province's updated emergency order said churches must choose between requiring proof of vaccination or holding services at 50 per cent capacity with distancing, contact tracing lists and no singing. Masks are mandatory with either option.
The emergency order also gives peace officers the authority to enter any building without permission to ensure compliance with the rules.
On Oct. 1, Leanne Becker, an official with the Safer Communities section of Inspection and Enforcement NB, contacted Hutchings and informed him about the rules that were in place governing gatherings and the need for an operational plan.
He agreed to comply, according to the court file.

Two days later, another officer with the Safer Communities section attended Sunday service at the church. According to her affidavit, she was the only person wearing a mask. She said no one asked for proof of immunization, there was no social distancing, and there was congregational singing.
The officer left after about 10 minutes, saying she was uncomfortable "due to the COVID risks at this service."
On Oct. 6, Becker contacted Hutchings again and told him she wanted to serve him with a fine for non-compliance. He said he wouldn't be available until Oct. 12.
Becker then went to Hutchings' home in Quispamsis to give him the ticket in person. She rang the doorbell and, according to her affidavit, she said she could see a child of about three in the window, waving to her, but no one answered the door.
That afternoon, Becker intercepted Hutchings on the street outside the church, but he refused to speak to her when he found out she was from Public Safety. He walked away and into the building.
That evening, Becker and a uniformed peace officer attended the church on Rockland Road, accompanied by members of the Saint John Police Force.
A video posted by a church member shows a man trying to prevent the officers from entering, arguing that they would be trespassing.
The officers explain that, according to the Emergency Measures Act, peace officers are allowed to enter to ensure compliance with New Brunswick's new emergency order.

The officers entered without being invited. A second video shows very few people wearing masks, some are singing, and most aren't staying two metres apart.
As Becker stood with the paperwork extended to Hutchings, he complained to a Saint John police officer that she was harassing him.
When Hutchings wouldn't take the paperwork from her, the police officer said, "Just put it on the floor. He's been served."
A copy of the ticket was provided to the court in the 80-page document. Hutchings was fined $580.50, payable at any Service New Brunswick location by Dec. 1.
On Oct. 8, the province went to court to get an "interlocutory order" to shut down the church. But that afternoon in the Court of Queen's Bench, Hutchings signed a consent order, agreeing to "make all reasonable efforts to ensure compliance" with the rules governing faith-based gatherings.
The agreement was to remain in effect until a hearing on the province's application under Section 55 of the Public Health Act can be heard.
But two days after the agreement was signed, several officials with Public Safety visited the church during Sunday service on Thanksgiving weekend. They videotaped those entering the church and recorded licence plates.
The church appeared to have a tent set up outside to check the names of people arriving, but the vast majority of those entering and exiting the church were not wearing masks or physically distancing.
A post on Hutchings's Facebook page says his associate pastor was arrested. The post was accompanied by a video showing a man telling officers they couldn't enter the church. He was eventually led away by a uniformed officer.
The man was released with a promise to appear in court at a later time.
On Monday, Saint John Cornerstone Properties, the owners of the building at 348 Rockland Rd., were served documents to close the building "to public access until it is determined that His Tabernacle Family Church is willing to comply" with the mandatory order.

Pastor Philip Hutchings has removed post that offended some women
"Dear insecure women … please stop conveniently including your chest in your selfies," wrote Pastor Philip Hutchings, founder of the Higher Life Christian Centre in Sussex.
"Don't need your weird aerial views. We are embarrassed for you ... no ... really ... we are.
"I know you're trying to make up for other losses ... but let's be honest ... the whole pic is a loss. #AgainstBreasties (Breast + Selfies) Please share ... let's save lives!"
Jesse-Lynn Jenkins says the words were hurtful and disappointing, coming from a person who presents himself as a community leader.
"There's a way to inspire people and help people," said Jenkins. "And if shame and guilt is in that, it's just not productive. It's the opposite of what Jesus was trying to teach."
At the church's storefront on Main Street on Friday, Associate Pastor Cody Butler said Hutchings was out of the country and noone else inside the church could comment in his place.
Mixed reactions in community
Out on the sidewalk, Mary Thompson introduced herself as a member of the congregation who wanted to come to Hutchings' defence.
She said her pastor has a point about showing too much skin.
"If it's okay for cleavage to be put all over Facebook, then what's it going to be like in 10 years?" asked the mother of three young children.
"Are my boys not going to be able to go on Facebook without seeing full breasts or full butt shots?"
Thompson said Hutchings might have got the tone wrong, causing him to be misunderstood.
But some, like Ainslie McAllisster, say Hutchings has posted hurtful messages before.
McAllister saved screenshots of previous postings that caused discomfort to her and her friends.
Bodies are beautiful
One was a link to rightwingnews.com, a sight that features columnists such as Anne Coulter and David Limbaugh, brother of American radio commentator Rush Limbaugh.
Hutchings had linked to an article there, entitled "I am not going to your gay wedding."
In another posting, Hutchings wrote: "Is it just me ... or is it going to be against the law to be 'straight' soon. #WhosReallyGettingBullied?"
McAllister says the postings make her angry.
But in the case of the cleavage sermon, she and her friends decided to push back with humour.
They came up with the hashtag #breastiesstrong and encouraged people to send in photos showing some chest.
McAllister, a fitness teacher, says bodies are beautiful and if people feel good about the pictures they put on social media, others shouldn't judge.

Saint John church shut down for non-compliance after Sunday service
UNB law professor says province followed all the rules
The New Brunswick government has shut down a Saint John church it says violated the mandatory order governing religious gatherings.
Officials with Public Safety visited 63 places of worship last weekend, Health Minister Dorothy Shephard said at Tuesday's COVID-19 briefing.
Only one, His Tabernacle Family Church, was non-compliant. She said the investigation is continuing, and the case is before the courts.
Shephard said the Saint John church was one of 600 inspections conducted around the province from Friday to Monday., the Thanksgiving holiday weekend.
She said these included 279 retail stores, 118 restaurants, 137 licensed establishments, five indoor events, a recreational facility, a movie theatre and a gym.
Shephard said officers found "near-total compliance."
His Tabernacle Family Church was ticketed on Oct. 6, for failure to comply with provisions of the mandatory order."

On Oct. 8, Philip James Hutchings, the church's pastor, was in court in Saint John and signed an order agreeing to "make all reasonable efforts to ensure compliance."
On Sunday, several uniformed Public Safety officers attended the Rockland Road church, videotaped those in attendance and recorded licence plates.
A post on Hutchings's Facebook page says his associate pastor was arrested. The post was accompanied by a video showing a man telling officers they couldn't enter the church. He was eventually led away by a uniformed officer.
The man was later released with a promise to appear in court at a later time.
An official letter was sent to Saint John Cornerstone Properties, which is listed as the owner of the property at 348 Rockland Rd., according to the Service New Brunswick website. The letter says that the building will "be closed to public access until it is determined that His Tabernacle Family Church is willing to comply with" the Mandatory order.
Under the province's emergency order, churches have two options. They can choose between requiring proof of vaccination or holding services at 50 per cent capacity with physical distancing, contact tracing lists and no singing. Masks are mandatory with either option.
On Sunday, the church appeared to have a tent set up outside to check the names of people arriving, but the vast majority of people entering and exiting the church were not wearing masks or physically distancing.
The legislation states that peace officers have the power to enter and inspect any business or private dwelling to ensure compliance, and that preventing a peace officer from entering is an offence.
Churches a source of COVID-19 transmission
Premier Blaine Higgs has said churches have played a role in the growth of cases provincially. He said that's why the province stepped up restrictions for churches, after initially not doing so.
During Tuesday's briefing, Shephard said she couldn't be specific about how many of the province's cases are related to faith-based gatherings.
"But what I can say is that we do know that there was a significant number in the month of September that came from church gatherings," although she said the same could be said of any gathering.
At a briefing last month, Public Health epidemiologist Mathieu Chalifoux said about 10 per cent of a "network" of 700 COVID-19 cases in New Brunswick in September were "related to worship-type events."
Shephard said the vast majority of churches have complied with the rules, some even choosing to hold virtual gatherings.
"I am deeply appreciative that nearly every religious leader and faith community in New Brunswick is doing the right thing by keeping their community and their province safe," said Shephard.
"They are requiring proof of vaccination or having smaller, distanced mass gatherings, or they are taking their celebrations online temporarily. These are tough decisions but necessary ones, and I appreciate the leadership that is being shown."

A Sunday evening post by the pastor of His Tabernacle Family Church, meanwhile, seems to indicate that they found a way around the province's rules.
"WE HAD A PACKED SERVICE TONIGHT & IT WAS POWERFUL!!! But I forgot to tell Public Safety that we changed locations … #TheKingdomAlwaysWins."
What the law says
The Emergency Measures Act gives the province the power to authorize such searches in an attempt to ensure compliance with the law, said Kerri Froc, an associate law professor at the University of New Brunswick.
She said "the minister can authorize any person properly identified as authorized to enter any building or on any land without warning."
"And if you obstruct any person in doing so, or they fail to comply with an emergency order, they can be subject to being charged with a provincial offence and there's some fines involved," explained Froc.
She said there are a number of considerations, including whether the Emergency Order is constitutional, because ordinarily, a peace officer would need a warrant in order to enter and search.
Examining all of those issues, and the manner in which the officers entered, Froc says the church has no legal basis to argue against the province's actions.
She said the incident did not violate the Charter of Rights or New Brunswick's laws.
"It's compliant with the statute, it's compliant with the order. So I don't think that the church here has any leg to stand on," said Froc.

NB church pastor arrested, church ordered closed for COVID non-compliance

Phil Hutchings, the founder and lead pastor of His Tabernacle Family Church Canada posted pictures to his personal Facebook page on Thanksgiving Monday morning showing New Brunswick public safety agents issuing a closure notice and affixing it to the doors of the church, with his text that noted: “THEY HAVE OFFICIALLY SHUT DOWN MENTAL HEALTH SERVICES & COMMUNITY OUTREACHES & FEEDING PROGRAMS.”

Sunday evening, images posted to Facebook show police surveilling the church. Last week, authorities interrupted services to inspect for COVID compliance. Hutchings has also posted videos of the police visiting his home on multiple occasions, including once where authorities tried to force the lead pastor to appear in court later on the same afternoon.
New Brunswick is in the middle of a so-called “circuit breaker” extreme lockdown in areas of “high transmission”. The government's last available data on the 132 new cases reported Oct 8 notes: “Of the new cases, 76 – or 58 per cent – are unvaccinated, 15 – or 12 per cent – are partially vaccinated, and 39– or 30 per cent – are fully vaccinated.”
Though the Alberta Government has been particularly harsh in the treatment of pastors during the pandemic, the Maritimes are not far behind. The Weston Christian Fellowship Church is facing over $100,000 in fines to both congregants and the church as an entity after fines were issued over two Sundays in May after a check-stop style police operation was set up outside the church. Weston Christian Fellowship are also Fight The Fines Clients.
Alberta pastors Tim Stephens, Art Pawlowski, Pawlowski's brother Dawid, and James Coates were all arrested for COVID non-compliance. Coates spent 35 days in jail, Stephens served over two weeks. The Pawlowski's spent 3 days and are facing 21 and more, respectively, for contempt of the court order that limited their church. Their sentence will be handed down by Justice Adam Germain on October 13 in Calgary. University of Cambridge has always recognised freedom of speech as a
core value at the heart of its academic endeavour. The University is
also a democratic institution, governed by its academic community, and
guided through the various committees, including the University Council,
to which authority is delegated.

Those two basic principles are important to bear in mind as we navigate our way towards an updated Freedom of Speech Statement, designed to enshrine core values while recognising the need to maintain civility in debate, whether amongst staff, students and visitors or within these groups. Flourishing universities encourage robust debate, challenge accepted norms, scrutinise research findings and work together to discover solutions to global problems. But the growth of social media and the rapid polarisation of our political sphere have demonstrated more than ever that debate in the absence of civility can be not only unproductive but hugely damaging.
For many decades, freedom of expression was an accepted norm at Cambridge, requiring no formal codification. I wish that were still the case. But the growth in recent years of legislation placing additional responsibilities on universities led us, in 2016, to reconfirm our commitment to freedom of speech in a single statement, while recognising new legal duties under the Prevent legislation that could have impinged on that freedom.
It is this statement which is now being updated in light of a changing legal landscape. Concerns have been raised that the original statement did not sufficiently bolster freedom of speech. Some members of our academic community had questioned whether the balance between freedom of speech and legal duties was correctly and clearly enough expressed.
A revised Statement attempting to clarify some of these issues was proposed earlier this year by our Committee on Prevent and Freedom of Speech, a group that includes academics and students. The new wording followed extensive debate within the Committee, and with members of the Council. An amended text was approved by the Council in March 2020 and was reported to the Regent House, the 7000-strong community of academics and members of the University which has the ultimate say on all significant decisions.
As is their right, a number of members of the Regent House have proposed changes to the text put forward by the Council. Given the complexity of the issues, this was not a surprise. The proposed amendments are now subject to vigorous debate within the University, which has spilled over into the public domain. But many public reports have completely misrepresented the context, and misunderstood the process of what is actually going on. As I write, the amendments are open to a vote of the full Regent House and the Council will of course abide by its result, which will be announced on 9th December.
As chair of the University Council, I cannot take sides in the debate but I can take satisfaction from the fact that this open, democratic process is occurring. The very existence of this discussion demonstrates to me that free speech is alive and well at Cambridge.

On 20 September 2021 Professor Stephen J Toope notified the University Council of his decision to complete his term as the University of Cambridge’s Vice-Chancellor at the end of September 2022, after five years in office.
The Vice-Chancellor said: “I take a great deal of pride in our accomplishments, which were built together as a collegiate Cambridge community. I am especially proud of our joint leadership across collegiate Cambridge to deliver on our dual mission of education and research through the unprecedented COVID crisis. We kept the University on track and safe during its hardest years since World War II.”
The Vice-Chancellor continued: “But at the same time, the upheaval of COVID has led me to reassess my own years ahead from a personal perspective. As an expat living far from home, being separated from my children and grandchildren by closed borders has been hard. Being near my own family and friends is more important than ever. It remains of course an extraordinary experience to serve this great University as its Vice-Chancellor, and a tremendous honour to work with colleagues across the collegiate University and beyond – one that I am proud and enthusiastic to continue for another full year.”
“Indeed, there is still much to do through our programme of recovery from the pandemic,” the Vice-Chancellor added. “I am fully committed to focusing on the priorities set by the University Council. The leadership transition next year will not detract from my commitment to the important work we have underway this year. The strength of our senior leadership and all our University community, the guidance of the Council, and the eventual choice of a highly able successor will allow me to pass the baton without missing a beat.”
Under Professor Toope’s leadership, Cambridge established the first-ever Priorities Framework for the University, launched and embedded Cambridge Zero across the University, led the university sector by pushing towards a carbon-neutral endowment fund, widened student access and participation, made remarkable progress on an ambitious £500 million Student Support Initiative, and created a new Foundation Year.
Mark Lewisohn, the Deputy Chair of the University Council, said: “The University Council is deeply grateful to Professor Toope who, as Vice-Chancellor and Chair of the Council, has had a profound impact on the University. Under his leadership, the University has become more transparent and more robust in its processes and has launched several new and exciting research and teaching initiatives. Stephen’s focus on sustainability, which has led to the creation of Cambridge Zero, will be an important part of his legacy, as will his efforts to make Cambridge more accessible to students from all backgrounds. We look forward to working with Professor Toope in the year ahead as we continue to make progress on our agreed priorities.”
Lord Sainsbury of Turville, Chancellor of the University of Cambridge, said: “I totally understand and fully respect Professor Toope’s decision, taken for the best of reasons, to complete his term of office in September 2022. I know this is not a decision he will have made lightly, but he can do it in the knowledge that he has left his mark on the University, and contributed to making it an even better place to study, work and undertake research. His leadership throughout the pandemic has been essential to getting Cambridge through the biggest crisis of our times, and I am grateful for his dedication and commitment over the past four years.”

Cambridge deserves better than Stephen Toope
Regular readers may be aware that in recent months I have been having a running-spat with a Canadian lawyer called Stephen Toope. I am rarely exercised by Canadian lawyers, but this particular one is the current Vice-Chancellor of Cambridge University, and he seems intent on running that crown jewel of an institution into the ground.
Since taking over as Vice-Chancellor, Mr Toope has been responsible for a wide array of anti-free speech initiatives through which, as I recently remarked in the Daily Telegraph, he appears to want to transform Cambridge University into something like the Canadian bar association, but without the thrills, or the pay.
Anyhow – our spat came to a head after Cambridge last month published its new guidance for informers.
The purpose of this new initiative was to allow students and faculty to anonymously inform on each other and report 'micro-aggressions'.
As I accurately wrote in the Telegraph, one of the examples of a micro-aggression offered by Cambridge's website for informers was a member of the university raising an eyebrow while any member of a minority was speaking. In the wake of the negative publicity, Toope had the website for informers taken down, claiming that it had gone off early, that the dog had eaten it, or some such lame excuse.
Anyhow, to my great amusement, Mr Toope has finally found some friends at Cambridge, or at least some suckers-up willing to write a half-arsed defence of him. Thus this letter appeared in the letters pages of the paper at the weekend. Here is the text in full:
Sir -
Douglas Murray has twice made unwarranted and highly personal attacks on the Vice-Chancellor of the University of Cambridge, Professor Stephen J Toope (Comment, May 22 and June 8).
As heads of the University’s six academic schools, we are independent of the central administration, but we cannot stand by as Professor Toope is subject to such gross misrepresentation.
Cambridge is a democratic institution with roots stretching back 800 years. This means that no vice-chancellor can impose their will on the university, and all policy decisions proceed through an intricate and finely balanced committee structure. While we are sure generations of vice-chancellors have found this frustrating, it is a fact of life at Cambridge.
Mr Murray makes the absurd suggestion that Professor Toope wants to limit free speech and push an agenda in which academics can be punished for raising an eyebrow at a student. The reality is more mundane. Errors were made during the launch of a campaign to introduce new policies and procedures covering conduct in the workplace. The campaign website was taken down as soon as the mistakes were spotted and the policy and procedures are now subject to further democratic scrutiny.
Professor Toope is an eminent international lawyer and experienced university leader. He has made clear his commitment both to championing freedom of expression and to making the university a welcoming place for our students and staff, who hail from all over the world. The two aims are complementary, not incompatible. As a leader, he commands respect from across the University and as senior academics we offer him our unwavering support.

Because if this is the best that the case for the defence has, then the defence is indeed what we used to call 'piss-poor'.
Let me take these academics' points one at a time:
First, they say that 'Cambridge is a democratic institution…with a finely balanced committee structure'. But if this is so, why was formal approval not sought from the General Board and Council of the university for all parts of this recent initiative? The reason that Toope himself gave for the website being taken down was that it had not received proper scrutiny.
And if the structure of accountability at the university works so well, why did he not seek approval via the proper democratic mechanism? That would have been done by issuing a 'Publication' in the Cambridge Reporter, which would have to be followed by a 'Discussion' for scrutiny from Regent House before the final 'Grace' (that is, democratic authorisation) was formulated.
These procedures may well be a 'frustrating fact of life' at Cambridge, and it is perfectly possible that VCs have had to suffer through them for centuries. But then why did Toope ignore them completely?
Next the loyal Toopians (or Toopites) claim that my suggestion that Toope wants to limit free speech at Cambridge is 'absurd'. And they add that:
'The campaign website was taken down as soon as the mistakes were spotted, and the policy and procedures are now subject to further democratic scrutiny’.
This is completely ill-informed, and rather surprising from academics of such distinction. For their edification, here is the timeline:
Cambridge's campaign website went live on 17 May. The first Telegraph report on micro-aggressions material was published on 20 May. Yet the Vice Chancellor’s senior official overseeing the campaign (Pro Vice Chancellor Eilis Ferran) defended the campaign website in its entirety and in its original form in a letter to the Telegraph which was published on 24 May.
It was only after this defence that a part of the website was taken down. So Ferran, on Toope's behalf (that's what the 'pro' bit is for), should have known about the disgraceful material because it was what she was responding to in her letter.
The website to encourage snitches and informers in Cambridge University then went back up on 27 May.
Only after that was the entire campaign website taken down – on 7 June, three weeks after it went live, and two weeks after concerns were expressed in public. All this for a campaign that had been in the works for more than two years. Was that not time enough for proper scrutiny by all the relevant university bodies?
A further claim of the Toopians did make me laugh. They say:
'Professor Toope is an eminent international lawyer and experienced university leader’.
Of course 'eminent' and 'experienced' are terms much open to eye-of-the-beholder-ism. But if Toope is so very eminent and experienced, why has he demonstrated such monumental incompetence, not least in the most basic tools of university governance?
Toope permitted the ridiculous materials to be published. Toope failed to respect the democratic mechanisms of Cambridge by ignoring the need for approval from Regent House, the General Board, and the Council. And so, Toope has not only attempted to impose woke and other anti-free speech ideologies on Cambridge University, but he has done so via successive acts of extraordinary incompetence. Where exactly is the experience or eminence on display here?
It goes on. For if Toope is such a very great lawyer, why did he permit what could amount to unlawful changes to the disciplinary regime for all students and staff at the university?
Perhaps the eminent Canadian is simply ignorant of the fact that, for a full week, the university he presides over defined racism in a way that a court might have ruled, not just as unlawful, but as actually, in itself, an act of systemic discrimination against white students and staff on the basis of skin colour.
The definition of racism with which the Cambridge 'Report + Support' begins says that
‘Racism...is a system of advantage that sets whiteness as the norm’.
This definition – by suggesting that racism is a white phenomenon – would surely have fallen foul of section nine of the Equality Act, which Toope could have realised by reading the act. But perhaps it is too much to ask for him to have done so.
The Toope-ites claim that Toope himself 'is committed to championing freedom of expression…As a leader, he commands respect from across the university and as senior academics we offer him our unwavering support.’
But that just reads like the effusions of a few sycophants. If Toope commands such respect and is such a champion of free speech, why did he lose three major votes on his statement on freedom of speech last year? And by some of the biggest margins recorded at Regent House since the Second World War.
Finally, the Toopians claim that defending free expression and being a welcoming place to people from all over the world are 'complementary, not incompatible' aims.
But putting aside for a moment why these dons think Cambridge was ever such an un-welcoming place, their assertion is clearly flat-out wrong. There plainly are contradictions between the two aims and it is stupid to suggest otherwise.
In talking of making a 'welcome environment' and much more, the Toope-ians keep treading on the right to free speech of all members of the university. Only last month, they proposed measures that could regulate the facial movements of Cambridge professors and effectively forbid any challenge of anyone speaking if they are from a particular minority group.
Say that men can't become women and you would absolutely discover the tension that the Toopians claim does not exist. The realm of academia really ought to be able to understand a contradiction such as this.
Anyway, it is worth pointing out how inept the Toope-ites are. Perhaps Toope is glad to have finally found a handful of dons willing to stick up for him. But it is a worthy defence of him, because it is as poor as anything he might have written himself.
If this is the best the case for the defence can do, then Toope is, at some point soon, going to be toast. Rarely has the top brass of any major university been in such total and utter disarray, where every time an academic is sent out to defend their Vice Chancellor they demonstrate, in turn, equal levels of Toope-ian incompetence.
Perhaps it won't last much longer. And I hope that alumni are still withholding their donations for as long as Toope is in charge.
It would be good if this crown jewel of an institution could once again be run by competent adults, who know about academic freedom, and know how to protect it.

Farewell to Cambridge’s disastrous Vice-Chancellor
So farewell then, Stephen Toope. The undistinguished Canadian lawyer who has spent recent years trying to run Cambridge University into the ground has just sent an announcement to all faculty, alumni and students. In it he informs them that he has decided to step down from his position as Vice-Chancellor at the end of this academic year. The reason he gives is that he has decided to spend more time with his family.
You do not have to read between the lines to realise that Toope is leaving because his brief tenure at Cambridge has been an unmitigated disaster, a fact that has become increasingly clear. Among the highlights of his career at Cambridge have been:
- Overseeing the trashing of academic freedom. During Toope’s tenure a mob of ill-informed students succeeded in getting a junior research fellow, Noah Carl, pushed out of his position because of an uninformed campaign claiming his research was ‘racist’. Later Toope defended the humiliating treatment of Prof. Jordan Peterson, who had a non-paying fellowship withdrawn based on an equally ill-informed campaign against him.
- Next the university put forward a new set of standards to be imposed on all academics and students at the university. This included the demand that all students and staff should ‘respect’ the opinions of others. A group of sharp-eyed academics noted where this would lead and ran a campaign to change the wording to an expectation that people should ‘tolerate’ other people’s opinions. When this went to a vote last December the university voted overwhelmingly, and humiliatingly, against the proposal.
- Yet Cambridge then introduced a new initiative that would encourage students and faculty to anonymously inform on each other if they felt that they had suffered a ‘micro-aggression’. The advice published online noted that an example of a micro-aggression would be any member of the university raising an eyebrow while any member of a minority was speaking. After I and others brought some negative publicity to this, Toope claimed that the advice had not been read to him before going out, that it had gone out early or that the dog had eaten it.
- A small number of academics (namely Profs John Dennis, Tim Harper, Patrick Maxwell, Nigel Peake, Anna Philpott and Chris Young) tried to rally to Toope’s defence, arguing that these attacks on free speech were no such thing. As I wrote here in The Spectator at the time, they got nearly all of their facts wrong in the process of defending someone who had got his own idea of academic freedom wrong.
- All the while there was not a woke cause that Toope did not try to import from his native Canada. For instance, in 2019 it was announced that Toope had appointed a committee to examine the university’s historical links to the slave trade. During the height of this ahistorical pandering exercise a bell was removed from one of Cambridge’s colleges because it was suspected of having possibly once been on a plantation.
- Strangely, as The Spectator also revealed in a recent cover piece, while all this was going on Toope led Cambridge deeper and deeper into a highly compromising relationship with the authorities in China. As Ian Williams wrote in July, one of Toope’s first trips on being appointed Vice-Chancellor in 2017 was to the Chinese Embassy in London, where he posed for photographs with the Ambassador. In the months and years since then, Toope worked on deepening the university’s relations with the authoritarian Communist regime, gaining funding from them and allowing this funding to influence the direction of research at the university. Williams concluded that the relationship was at best dictated not just by greed but by naivety. It is a generous interpretation. For a Vice-Chancellor to try to crack down on academic freedom at Cambridge while sucking up to one of the most authoritarian regimes on earth is more than naïve – it is sinister.
There are many other things that could be said of Toope. But there will be time enough for that. In the meantime perhaps I could mention why this matters.
I have occasionally been asked, over the last few years, why I have written about Toope so many times, both here and at the Telegraph. The reason is not just because Toope was clearly so magnificently ill-suited to the job he has now left early. Nor was it simply that I believe he is such a prime example of one of those undistinguished functionaries who falls ever-upwards by parroting and then pushing the latest on-brand dictates of the era. The reason is that – to steal a quote from Evelyn Waugh – watching Stephen Toope in charge of Cambridge University was like watching a Sèvres vase being balanced in the hands of a chimpanzee. He seemed to show no care as he teetered and careered around with it. He seemed, as he particularly showed in his ignominious last year, to have no care of whether or not he dropped and smashed the whole damn thing.
And this is why Toope – and his fall from grace – matter. His rise seemed to demonstrate that there is only a benefit to be gained from trying to get ahead of the new authoritarianism. His fall demonstrates that there can be a cost to it as well.

UPDATED: Church Ordered To Close For Allegedly Violating Mandatory Order
A Saint John church has been ordered to close its doors to the public after allegedly violating the province’s COVID-19 measures.
His Tabernacle Family Church posted a photo to Twitter on Monday of a hand-delivered letter from the Department of Public Safety.
“Public Safety has issued closure of our church doors even after we complied,” lead pastor Phil Hutchings wrote in a Facebook post on Monday.
The letter, dated Oct. 11, said the church violated sections 3 and 15 of the province’s mandatory order and may have breached a recent court order.
Section 3 of the mandatory order requires faith venues to ensure everyone shows proof of full vaccination. If not, they must hold services at 50 per cent capacity, prevent singing, and keep a record of every person attending.
Under Section 15, peace officers are authorized to enter faith venues to ensure compliance with the order, and can serve an order on any person found not in compliance.
“Failure to comply with this order may result in prosecution that may include fines up to $20,400,” said the letter from Public Safety.
Health Minster Dorothy Shephard confirmed Tuesday that the church was the only one of 63 visited by peace officers this weekend that was found to be non-compliant with the mandatory order.
“Investigations are ongoing and matters are before the courts,” Shephard said during a news conference.
The Department of Public Safety sent a nearly identical statement when asked for comment on Tuesday.
The letter to His Tabernacle Family Church came one day after Public Safety officers attended a gathering Sunday at the church, which was operating out of an events venue on Rockland Road.
A video posted by Hutchings shows an officer telling an individual — who is identified as the church’s associate pastor — that they are obstructing by not allowing peace officers into the building and are under arrest.
The individual is then led away from the church by other officers and placed in the front seat of a vehicle.
Officers can be heard asking two other people, including one wearing a “Security” tag around their neck, if they have the ability to allow them into the church. Both individuals said no and one declined to give his name, even though an officer said they are required to identify themselves under the mandatory order.
Our newsroom reached out to Hutchings and the church for comment but did not receive a response.

Peace officers keep watch over Saint John church service
His Tabernacle Family Church ticketed last week for violating province's emergency order
More than 100 people gathered for Sunday morning service at His Tabernacle Family Church in Saint John, where the pastor was ticketed just last week for failing to comply with the province's emergency orders.
The church appeared to have a tent set up outside to check the names of people arriving. But the vast majority of people entering and exiting the church were not wearing masks or physically distancing.
Two uniformed peace officers were on the scene not long before the service was about to start. They left after speaking to people outside.
Under the province's emergency order, peace officers can order a premise be vacated and can detain people under certain conditions.

About 90 minutes later, 10 more officers pulled up in five vehicles outside the church. Some tried to enter but were turned away by parishioners at the door.
After that, the peace officers started recording the licence plate numbers of all vehicles parked in the church's lot. They also filmed people as they left the church.
At one point, one man was taken into one of the peace officer's vehicles, but was later released.
A journalist from another media outlet asked to be allowed inside the church during the service, but was denied. CBC asked to speak to a representative of the church, but no one was made available.

It's unclear whether tickets or fines will be issued as a result of Sunday's service. CBC reached out to the Department of Public Safety for more information.
In an email, a spokesperson said they could "confirm an operation at the location you've identified," but would not discuss details.
Church fined for flouting province's emergency order
On Oct. 6, a ticket was issued to a representative of the church "for failure to comply with provisions of the mandatory order."
Under the mandatory order, a peace officer may issue a fine in the amount of $480 plus surcharge and fees, and in instances where an offence is brought to court, a judge could issue a maximum fine of $20,400, plus surcharge and fees.
Repeat offences will result in pursuit of escalating sanctions, according to the Department of Justice and Public Safety.
On Oct. 8, Philip James Hutchings, the church's pastor, signed an order agreeing to "make all reasonable efforts to ensure compliance" and uphold the rules around faith-based gatherings.
Under the province's emergency orders, churches have two options. They can choose between requiring proof of vaccination or holding services at 50 per cent capacity with distancing, contact tracing lists and no singing. Masks are mandatory with either option.
Churches a source of COVID-19 transmission
Premier Blaine Higgs has said churches have played a role in the growth of cases provincially.
About 10 per cent of a "network" of 700 COVID-19 cases in New Brunswick in September were "related to worship-type events," said Public Health epidemiologist Mathieu Chalifoux at a COVID-19 briefing last month.
The province reported 73 new cases Sunday and two deaths. New Brunswick has announced 173 cases over the past two days.

Saint John church fined for not complying with the emergency order
Social media video shows pastor of Saint John church served papers by peace officers
The ticket was issued to a representative of the church "for failure to comply with provisions of the mandatory order," confirmed Coreen Enos, a spokesperson for the Department of Justice and Public Safety.
She did not name the faith-based venue, but a video posted on Facebook on Wednesday shows two Public Safety officers at the door of His Tabernacle Family Church, on Rockland Road in Saint John, trying to serve papers to the pastor, Philip James Hutchings.
Members of the Saint John Police Force were asked to accompany Public Safety officers to the church Wednesday evening to issue "some paperwork," said police force spokesperson Jim Hennessy.
In the video, a man tries to prevent the officers from entering, arguing it was a private establishment.
The officers explain that, according to the Emergency Measures Act, peace officers are allowed to enter to ensure compliance with New Brunswick's new emergency order.
The officers eventually enter the building without being invited, much to the chagrin of a small, vocal crowd outside the building, which at one time was owned by the Roman Catholic bishop of Saint John, according to records with Service New Brunswick.
