Preston Manning announces citizens' inquiry into federal COVID-19 response – November 2, 2022
In Ottawa, former Reform Party leader Preston Manning announces that a citizens group chaired by him is working to establish an independent, citizen-led inquiry into the federal government’s response to the COVID-19 pandemic. Former federal Official Opposition leader and veteran politician Preston Manning announced Nov. 2 that he will spearhead a National Citizens’ Inquiry (NCI) into the government’s handling of COVID-19.
Lockdowns were unprecedented in nature and magnitude, Manning told The Epoch Times.
In a national opinion survey conducted by the NCI in mid-October and published Nov. 1, three out of four respondents reported being hurt or injured by health protection measures put in place by governments during COVID.
“These were not people hurt by COVID,” he said. “They were hurt by lockdowns.”
The survey of more than 1,500 Canadians suggested that isolation was the top harm respondents selected. Twenty-five percent of those polled said they were affected by government restrictions, citing examples such as being prohibited from attending a funeral, being unable to visit sick or other loved ones, education impacts on students, and increased divorce and marital disharmony.
“Canadians want an inquiry into what went right and what went wrong during COVID [and] what lessons were learned that will mean better management of a future national crisis,” said Manning.
He added that a disturbing response emerged from the surveys.
“People saw the link between lockdowns and how it affected the economy, mental health, and social well-being, but the disruption of people’s rights and freedoms was a connection harder for people to see,” he said.
“When your freedoms and rights are limited, it affects all other areas.”
A news release issued Nov. 2 by the National Citizens’ Inquiry stated: “The policy, legal, economic, and health authority interventions into the lives of Canadian families, businesses, and communities … impacted the physical and mental health, civil liberties, fundamental freedoms, livelihoods, and overall social and economic well-being of all Canadians.”
The organization lists “profound” social impacts, business bankruptcies, delayed health care, and avoidable deaths, attributed to lockdowns, restrictions, and mandates.
11,000 Sign Petition Supporting Inquiry
Manning acknowledged that Canadians might expect it would be the government that commissions such an inquiry, but in this case, his organization suggests that any commission that has a primary purpose of investigating the government response would lack credibility and integrity if conducted by the government.
He said a citizen-led inquiry has proven to be a popular idea. Over 11,000 individuals have gone to the NCI website to sign the petition supporting an inquiry.
A not-for-profit, federally incorporated organization has been set up to take donations and fund the inquiry. The public is being asked to make submissions with names of potential commissioners who could be trusted to be part of such an initiative, which would begin in early 2023.
The inquiry is tentatively set to be two to three days for each hearing, in cities across the country, with a final summary hearing in Ottawa. Citizens would be able to participate both in-person and remotely, and give testimony about how COVID-19 government responses affected their lives.
The inquiry says similar examples of the types of testimony Canadians might expect at the NCI can be found at A Citizens’ Hearing, which held public hearings for citizens June 22–24 in Toronto. The three-day event invited, among others, participation from families who lost loved ones, students who missed educational opportunities, business owners who had to shut their doors, and experts who had criticisms of the government’s lockdown response.
Manning says the inquiry will invite submissions from ordinary people, plus testimony (all under oath) from experts in medicine, law, society, and constitutional rights, with the overall theme being submissions on the impact of COVID public health measures on Canadians.
Manning led the Reform Party of Canada for more than a decade. His late father, Ernest Manning, served as premier of Alberta for 25 years, beginning in 1943.

I think it’s excellent that Mr. Manning has organized this. I’ve signed up to support it, both financially and as a volunteer. The stories need to be told and documented, regardless of what the state chooses to do about it. People are getting the message, thanks in part to initiatives like this.
The “Citizens’ Hearing” will take place at the next election. With all respect to Preston Manning, another boring, tedious “hearing” will accomplish little.

Ok, but… Where were leaders like Preston Manning and Stephen Harper while Trudeau was persecuting us? People lost their jobs, their homes, their families because of the demonic leaders of our country! Come to find out Jason Kenney had an agreement with the WEF? He was the conservatives’ bright and shining star at one point. I devoted a lot of my time and energy fighting for conservative values, so I feel entirely betrayed by these people. It’s safer now for them to speak up, but they left so much of the heavy lifting to people who had far less of a platform. Former Premier Brian Peckford brought a freedom of movement case to the Supreme Court and even though that freedom and others are enshrined in our Charter, the justice called the case moot because the mandate wasn’t presently in place. What a coward! The brave truckers were vilified by Trudeau and the media. These commissions on the Emergency Act are clearly demonstrating that the liberals with NDP support used the EA for political gain. It’s all so disgusting. Daniel Smith and hopefully others are moving in the right direction finally, but more Canadians need to wake up. The government is not here to help. As Canadians, we pay very high taxes for very little return. If the last few years taught us anything, let it be that government leaders and the permanent bureaucracy serve themselves and require constant public accountability and mechanisms that lead personal consequences when they overreach or cause harms. If any of them could be held personally liable for their laws, policies, mandates, requirements, they would be much more sober and less likely to be drunk on power.

Politicians, bureaucrats and public-health officials etc. have to be
severely punished for their decisions that caused all of those harms –

YouTube deletes anti-lockdown video by prominent Canadian legal group
April 14, 2021 (LifeSiteNews) – YouTube has deleted a powerful new video blasting COVID lockdowns and the negative social and mental effects they have caused. The video was released by prominent Canadian legal group Justice Centre for Constitutional Freedoms (JCCF).
The banned video, titled, “Covid: The Political Pandemic,” was released on April 10 on the group’s YouTube channel. Within minutes, the video was taken down for allegedly violating YouTube’s terms of service.
The JCCF was able to post the video to a Rumble account in short order, however, and to date, it has over 21,000 views.
Marnie Cathcart, Director of Communications for the JCCF, told LifeSiteNews that the video was “flagged” by YouTube “under the category of ‘medical misinformation’ because it had information contrary to WHO official statements surrounding social distancing.”
The video included comments by Dr. Anthony Fauci and other health officials regarding “social distancing” in which they make contradictory statements about social distancing lengths.
The video shows clips of Fauci’s flip-flop on “social distancing” rules, where he said that a 3-foot distance was now acceptable as opposed to the original 6-foot length championed by health authorities worldwide.
Cathcart said the JCCF is appealing the removal of the video to YouTube.

The banned video begins with a narrative highlighting the JCCF’s concerns surrounding the damage done by COVID lockdowns in Canada which have been imposed by provincial governments.
The video also goes over how Canadians’ rights, notably the freedom to worship, have been trampled on: “Canadians are entering the 13th month of government restrictions that are managing and dictating every aspect of our lives. The 13th month of daily and ongoing violations of our human rights and fundamental freedoms. In just one year, government orders have forced stores deemed non-essential to close, shut down restaurants for months at a time, as well as museums and libraries, closed schools and universities for in-person learning, canceled cultural activities, throwing a pastor in jail for over 30 days for holding Sunday church service, and outright banned faith groups from in-person worship.”
“Because the government has decided religion is a non-essential activity, governments across Canada are preventing Christians from worshiping together in person, as they have for over two thousand years. Church in the new Canada is illegal.”
Through video clips, the JCCF video highlights the narratives used by health officials Canada-wide to justify COVID lockdown orders, which for most parts of the country have resulted in families being banned to see each other for months.
The video narrator highlights the COVID health orders, which now “forbid visitors to your own private home,” and to have family dinners on important holidays.
The video blasts the imposition of mask-wearing on children at schools, stating how kids are now “being taught” that sitting with their friends from another classroom at lunch is bad, and “that they must live in fear that singing and laughing can spread deadly germs and kill grandma and grandpa.”
“Young children who have a greater chance of being hit by lightning than of dying of COVID are being forced to wear a mask all day just to attend school,” says the video narrator. “Depending on the province, it is forbidden to spend time with friends to work out at the gym, to be with an aging sick parent, to go out for dinner, to play a game of hockey on an outdoor rink, to leave the house after eight p.m., or to leave the house at all — unless it is considered essential by the government.”
The JCCF is currently involved in many COVID-related legal cases in Alberta, and Canada-wide, representing people and groups fighting fines and charges.
The group represents Grace Life Church, which was recently barricaded by police for defying coronavirus health rules.
Its pastor, James Coates, had refused to comply with draconian coronavirus regulations and was jailed for 35 days. Grace Life members have now gone underground to worship.
The video includes clips from Fox News host Tucker Carlson, in particular from a show where he talks about how health officials have used the term “science” to justify the constant changing of COVID-related health rules.
The video highlights the apparent hypocrisy of world leaders such as Canada’s Prime Minister Justin Trudeau, who last year attended a Black Lives Matter protest.
A clip shows Carlson blast leaders who publicly supported BLM protests along with “exempting” them from COVID rules because they support the cause, while anti-lockdown protests have been targeted as super spreader events.
The JCCF video also includes a portion of a show from March where Carlson talks about COVID jabs and their effectiveness and safety. Many countries have temporarily halted the use of some COVID jabs due to adverse health effects.

Towards the end of the video, an audio clip from Canadian Dr. Roger Hodkinson is played. Hodkinson has blasted COVID as the “greatest hoax ever perpetrated on an unsuspecting public.”
“There is absolutely unfounded public hysteria driven by the media and politicians. It’s outrageous. This is the greatest hoax ever perpetrated on an unsuspecting public. There is absolutely nothing that can be done to contain this virus. This is not Ebola. It’s not SARS. It’s politics playing medicine. And that’s a very dangerous game,” said Hodkinson.
In conclusion, the video narrator states that no “government in Canadian history has recklessly shut down restaurants, tourism, hotels, hospitality, and entertainment, forcing millions of families into unemployment, poverty, increased mental illness, skyrocketing drug overdoses, increased suicide attempts, alcoholism, and eating disorders.”
“Today, politics and fear are the driving force continuing the most extreme and severe restrictions on freedoms and individual liberties in Canadian history. For the first time in history, Canadians are being conditioned to believe that their freedom is selfish and suffering is for the good of all.”

Ontario Catholic hospital invokes Pope Francis to deny Catholic nurse religious exemption for COVID jab
(LifeSiteNews) – A nurse was suspended without pay by a Catholic hospital for not submitting to the abortion-tainted COVID jab. Agnes Sibiga raised moral objections to the vaccine mandate but was denied religious exemption by the hospital administration who cited Pope Francis.
I spoke with Sibiga about her stance for freedom and the right to conscience, even if it meant losing her job. She told me how she was convinced not to take the injection “from the beginning” even before it was made mandatory by the hospital.
What’s even worse is that the Chief Operating Officer (COO) of this so-called Catholic hospital based the mandate and refusal of religious exemptions on the fact that Pope Francis took the jab so all of us should too.
“The biggest argument was that Pope Francis was in a way promoting it, and saying that it’s okay for us to take it,” Sibiga said.
But what about the letter from the Congregation for the Doctrine of Faith, which, though it grants moral liceity to the abortion-tainted injections and was contended by Bishop Athanasius Schneider and other faithful clergy, spoke out against mandates?
Sibiga encouraged every Catholic “to be true to themselves” and their faith, and not accept this immoral so-called vaccine and the immoral mandates for them.

We founded TBOF in 2021 genuinely believing that justice would prevail and that the immoral, unethical, and unconstitutional vaccine mandates would be swiftly repealed. Even more so, when the Freedom Convoy arrived in Ottawa, we again believed that, surely, now with clear popular dissent and international peers abandoning such policies, our mission would soon be accomplished.
Now, nearly a full year since government started segregating Canadians by medical status, two things have become crystal clear to TBOF:
(1) the COVID-19 policies were merely a symptom of the greater malaise in Canadian society; and
(2) that safeguarding against future government overreach requires re-empowering Canadians to hold public officials and institutions accountable.
The federal Government’s recent capitulations to “suspend” the mandates only reinforced these revelations and helped us understand our path forward: TBOF must transform into a permanent organization capable of taking on the generational struggle to preserve liberty, democracy, and the rule of law.
Therefore, we are pleased to unveil TBOF’s new mandate as recently developed by our Board of Directors, with input from our volunteers across Canada (full details here).
Going forward, TBOF’s mission shall be to engage, educate, and empower Canadians to become catalysts for challenging their institutions, holding their representatives personally accountable, and reclaiming their inalienable rights and freedoms.
Central to our new strategy is collaborating with other organizations to develop a freedom ecosystem and network that proliferates the values of human rights and the rule of law, gives platforms to and supports our leaders, and unapologetically challenge the corrosive and divisive narratives and ideas that have seeped into all elements of our public and private institutions.
- For example, recently, we partnered with We Unify Canada and Vaccine Choice Canada to plan the first Reclaim Canada Conference, bringing together scientific, legal, and civic leaders together to begin charting where our movement goes from here.
- This month, we are supporting Canada Marches and Veterans 4 Freedom with James Topps’ ~4,500 kilometer march from BC to Ottawa in an effort to inspire dialogue and understanding between Members of Parliament and the Canadians they serve and calling on the federal Government to permanently repeal all vaccine mandates.
As TBOF moves forward into this new chapter for the freedom movement, we wish to again thank you and all of our supporters, volunteers, and donors. Your contributions and commitment enable us to continue the fight for restoring our democracy and reclaiming our institutions.

Preston Manning warns Conservative campaigns that personal attacks could 'poison' the part
Former Reform leader says attacks will exacerbate divisions, the 'Achilles heel of the party for some time'
In a letter to the leadership campaigns obtained by CBC News, Manning, an elder statesman in conservative circles, said he fears such attacks will "deepen divisions within the federal conservative camp" — cleavages he said have been the "Achilles heel of the party for some time."
He said a particularly nasty campaign could pit eastern conservatives against their western counterparts, "old PC-oriented conservatives versus Reform-oriented conservatives," "secular" conservatives against "religious conservatives" and fiscal and economic conservatives against social conservatives.
Manning said the leadership race should instead focus on policy differences to avoid splintering the party and handing Liberal and NDP operatives the gift of pre-written attack lines that can be used against whoever wins the leadership.
"As I'm sure you know, both the Liberals and the NDP have researchers whose sole job is to record every derogatory statement made by one conservative leadership candidate against another, or made by overly zealous followers," Manning said.
"Then, when the leader is eventually chosen, Liberal/NDP spokespersons will hurl these back at that leader, especially in the House … 'Let me read to the new leader of the CPC what some of the leader's own party members really think about him/her.'
"Stay away from the personal attacks that only poison the party well and reinforce the public's negative perception of party politics."
Manning led the Reform Party from the late 1980s to 2000, through an era when the conservative movement was divided into two competing parties — Reform/Canadian Alliance and the Progressive Conservatives. The fractured conservative vote helped the Liberal Party secure large majority governments in the 1990s.
To avoid a repeat of that sort of vote splintering, Manning said he and "a number of other party 'seniors'" are prepared to help "heal any divisions" that may emerge as a result of this leadership contest.
Manning said it's important for the party to stay united so that the new leader is well-positioned "to defeat the Liberal/NDP coalition in the next federal election" — a reference to the confidence-and-supply agreement the two parties signed earlier this year.
Manning said he will not be endorsing any candidate in this leadership race. He said he'll send "helpful ideas" to campaign managers throughout the contest to "advance the interests of the party and the country."
Manning did not single out any contender by name — but like virtually all leadership campaigns, this one has seen a fair amount of personal sniping.
For example, candidate Patrick Brown, mayor of Brampton, Ont., has accused frontrunner Pierre Poilievre of pushing "discriminatory policies" and standing against immigrants because of his past support for a niqab ban at citizenship ceremonies.
That prompted Poilievre to return fire by calling Brown a liar who distorts the truth for political advantage.

Leadership candidate and former Quebec premier Jean Charest has accused Poilievre of seeking the endorsement of "people breaking the law" by supporting truckers and others that were part of the Freedom Convoy protest in Ottawa.
"You can't be a leader of a party and the chief legislator of the country, as prime minister, and support people breaking the laws. That disqualifies you," Charest said of Poilievre in an interview with CTV News earlier this month.
Poilievre's camp has in turn dismissed Charest as someone who is not a "real" Conservative while mocking the smaller crowds his campaign has attracted to its events.

Manning Centre to change its name as founder Preston Manning announces retirement
It won't have his name for much longer: the Manning Centre for Building Democracy has announced a rebranding effort for the the organization and the high-profile conferences it organizes.
Manning Centre president Troy Lanigan told CBC News that the 78-year-old former MP, who founded the organization in 2005, is leaving the centre behind so he can spend more time with his family.
Lanigan said the centre is changing its name because Manning himself believes that will leave it free to chart its own course.
"He feels too many things are named after politicians and doesn't feel he needs that legacy," said Lanigan. "Its legacy is its mission."
Lanigan said the centre will continue to pursue the mission that Manning set out to accomplish, which he described as "breaking down silos and getting conservatives to work together and work strategically to create opportunities for success."
CBC News has been unable to reach Manning, who is vacationing in Australia.
Former Reform MP and Conservative cabinet minister Chuck Strahl told CBC News that before the Manning Centre came along, conservatives from different provincial parties seldom met with their federal counterparts, or each other, to exchange ideas and propose policy initiatives.
"It's kind of easy to forget that there wasn't a networking opportunity for what Preston always called the 'conservative movement,' as opposed to political parties," Strahl said.
"Preston is of the opinion that the conservative movement benefits from getting together, in all of its facets, and without having the party hierarchy managing it or overlooking it. This was the best way to get the best conservative ideas."
A long goodbye
Manning will step back from the centre's work over the coming year, said Lanigan, adding that Manning himself will address his decision during the promotional tour for his coming book.
The centre has launched a survey to solicit supporters for ideas for a new name.
Strahl said that, no matter what name it ends up with, he hopes the centre will continue to provide a venue where conservative ideas can be discussed and debated.
"It's a better idea to get together and talk about things in a safe place rather than wait until there's a crisis of some sort," he said.
"It doesn't always come off perfectly but at least there's a place to do it. And I think there will be, regardless of what name it's given going forward."

Manning was the founder and sole leader of the Reform Party, which later became the Canadian Alliance before merging with the Progressive Conservatives to form the current Conservative Party of Canada.
Manning served as the MP for Calgary Southwest from 1993 until 2002, and as leader of the Official Opposition from 1997 to 2000.
Manning started the Manning Centre after leaving the House of Commons. The centre organizes the annual Manning Networking Conference, now entering its 12th year.
The Manning Centre has made donations to registered third parties such as Canada Strong and Proud, which was linked to a number of robocalls and text messages sent out in June asking Canadians about their voting intentions and their position on pipelines.
Some complained that they received the calls without having given permission for political advocacy groups to contact them.
The group got at least $240,000 from the Manning Centre during the last federal election campaign for a series of anti-Trudeau and anti-Liberal campaign ads.
The Manning Centre also gave $4,500 to Newfoundland and Labrador Strong and another $11,200 to Nova Scotia Strong, according to Elections Canada.
The full financial returns for third party groups will not be due at Elections Canada until next month.

Harper Government Solidifies Partnership With Canada's Professional Accountants
New CRA-CPA Framework Agreement will strengthen collaboration on
priority issues, including red tape reduction, service, and compliance
OTTAWA, ONTARIO--(Marketwired - Nov. 26, 2014) - Canada Revenue Agency
The Honourable Kerry-Lynne D. Findlay, P.C., Q.C., M.P., Minister of
National Revenue, today announced the signing of a first-ever
agreement with Canada's chartered professional accountant community,
signaling a new era of information and collaboration in improving tax
administration in Canada and better serving Canada's taxpayers.
The new Canada Revenue Agency (CRA)-Chartered Professional Accountants
of Canada (CPA Canada) Framework Agreement was formally signed by
Andrew Treusch, Commissioner of Revenue and Chief Executive Officer of
the CRA, and Kevin Dancey, President and CEO of the CPA, during the
Financial Management Institute's Professional Development Week, being
held in Ottawa from November 25 to 28. The Framework Agreement
recognizes the important relationship between the CRA and CPA Canada
in the successful administration of Canada's tax system, and promotes
regular dialogue between the two organizations on tax-related matters
of common interest. It will also ensure that input from Canada's
accounting professionals is considered as the CRA moves forward with
its change agenda.
A central part of the Framework Agreement includes the creation of
seven committees, each co-chaired by a senior representative from both
the CRA and CPA Canada, to focus on seven priority areas:
Services;
Compliance;
Tax Administration;
Scientific Research and Experimental Development;
Commodity Tax;
Red Tape Reduction; and
Training
The agreement is a key element in the CRA's efforts to build strong
relationships with the Canadian accounting community and tax service
providers so that Canada continues to have a well-functioning and
world-class tax system that benefits all Canadians.

CICA Just Wants Its Members to Feel Like They’ve Been Heard
The Canadian Institute of Chartered Accountants (CICA) doesn’t really
care what its members think of the CA/CMA/CGA merger. It just wants
them to feel like they’ve been heard.
Look at the e-mail Heather Whyte (VP of Communications and External
Relations at CICA) accidentally sent to a member when she hit “reply

What do you mean by you have not heard from many members? Your first

today's email was to provide additional information so that members

Dear Nora Murrant, Peter McLean, Kevin Dancey, Bill MacKinnon:
I am writing on several issues that are gravely disturbing to me as a
CA (ICAO #317839). I have called the CICA and have been advised to
contact you directly.
1) I have not received the below e-mail from the CICA nor the ICAO.
I received this communication through a colleague. Please confirm
immediately why I am not receiving these communications directly. I
find the selective distribution extremely unprofessional and a
disgrace to the record keeping of the CICA as I am currently signed up
to receive all merger related communication electronically and have
filled in a survey indicating that I want to receive all merger
communication via e-mail. This profession demands integrity and
reliability, yet you cannot even distribute e-mails to your full
member population. Having spoken to the CICA receptionist, she
mentioned she is receiving a large volume of calls indicating that
other CA's are also upset since they are not receiving these
communications so there are clearly errors with your distribution
list. Please confirm asap the reason I did not receive the below
communication.
2) CMA's have received the attached e-mail on September 5th regarding
the merger urging them to complete the survey. Again, I am extremely
upset that I as a CA did not receive this same communication directly
via e-mail. This is unprofessional. Please confirm why CA's were
excluded from this same communication in the same format? It appears
to me as though the CMA's are sending out these direct targeted
communications that are completely one-sided to encourage them to
provide positive feedback on the merger so that results can be
portrayed as being in favour of the merger even though CA's are
clearly against this merger. The CICA is not sending direct
communication (or rather to a select sample of CA's) and rather
posting information on a website without directing them to the
information which I find personally underhanded.
3) Kevin/Bill - your note below is extremely disturbing. In the
first paragraph, you recognize that the feedback during the
exploratory phase you have received from CA's whom you are to both
represent is clearly opposed to the merger. Yet, you disagree with
the body of CAs and proceed to push your views upon the CA's that are
clearly against this. What is the point of requesting feedback and
having an exploratory phase to determine if you will proceed with the
merger when you are completely ignoring the negative feedback and
pursing ahead anyways? I am appalled that my member fees are being
put towards individuals that have no regard for the members feedback
and do not wish to represent them as they want. I have read every
single piece of information on this merger that is posted on the
website (Case for Change/Merger Update/Position Paper/etc.), and could
not disagree more with this merger after reading all of the
information presented. There is no further education required - the
only requirement is for you to listen and represent CA's as requested
which is to oppose this merger. The one-sided approach to this merger
is truly disheartening and almost unlawful. There is no confusion in
the marketplace - a CA is a CA and CMA is a CMA and CGA is a CGA - and
people who need to know understand what those differences are and they
are not equal. You are 100% diluting the CA brand by proposing this
merger rather than protecting it.
4) When is the vote for this merger going to take place? As you
state below, CA's are clearly against this merger and it will clearly
be a repeat of 2004 when a merger was proposed and there was a
resounding "NO" from CA's despite the "YES" from the CMA's. I will
encourage each and every single CA and their network to vote and I can
assure you that I have not had one positive vote for this merger from
the vast number of CA's that I am in contact with.
5) I attach the feedback I presented to Nora Murrant via e-mail in
regards to the merger. Please accept this as my formal feedback as
being 100% against this merger.
To quote Nora Murrant in her attached e-mail "We are exploring the
merits and feasibility of a merger. As outlined in the position
paper, we feel that the rationale for change is clear; however, before
proceeding any further, we are seeking input from our members,
registered students, governments and other stakeholders. In
particular, we want to know if members agree or disagree with the
issues presented in the position paper and any additional critical
issues that they believe should be considered. Once we secure that
feedback, we will decide on how to proceed." From the feedback
received, it should be clear that CA members disagree as you confirm
in your below communication. Hence, if the CICA/ICAO decide to
proceed with next steps with merging, this is in direct contradiction
to the wishes of your members and it is your duty to represent us.

FREDERICTON - The New Brunswick government has launched a lawsuit
against an accounting firm in an effort to recover $50 million
provided as loan guarantees to the Miramichi-based Atcon group of
companies.
The lawsuit filed with the Court of Queen's Bench in Saint John
alleges that Grant Thornton was in breach of its duties to the
province in an inspection of the financial books of the Atcon group of
companies.
The former Liberal government of then premier Shawn Graham provided
the loan guarantees to the companies in 2009.
The statement of claim alleges the government approved the loan
guarantees as a result of financial reports from Grant Thornton.
"But for the Grant Thornton opinions and representations, the province
would not have sustained a loss in excess of $50 million," the
document asserts.
It says the accounting firm "failed to exercise the care, diligence,
and skill of an auditor of reasonable competence and prudence."
None of the allegations contained in the statement of claim have been
proven in court.
Atcon, based in Miramichi, went bankrupt in April 2010.
Grant Thornton LLP, Grant Thornton International and a chartered
accountant who works for the company are named as the defendants. They
have not filed a statement of defence and the accountant named in the
statement of claim could not be reached for comment.
Norm Raynard, managing partner in New Brunswick for Grant Thornton,
said in an emailed statement that the company would not offer specific
comments on the lawsuit because they are still reviewing the court
documents.
"We will vigorously defend ourselves against this action," he wrote.
"Our initial reaction is that this timing has much to do with the
political calendar in the province."
The next provincial election is set for Sept. 22.
Attorney General Hugh Flemming said the timing is not political.
"This is not a time schedule which in any way was influenced by the
government and it is not a political issue," he said Tuesday.
He said the government had no choice but to take the matter to court
because of the $50 million that was spent.
"The government owes a duty to the people of New Brunswick to do what
they can to recover this," Flemming said.

Canadian Securities Regulators Publish Discussion Paper on Mutual Fund Fees
Toronto – The Canadian Securities Administrators (CSA) today published
for comment CSA Discussion Paper 81-407 Mutual Fund Fees, which
examines the mutual fund fee structure in Canada and identifies
potential investor protection issues arising from that structure. The
Discussion Paper sets out various topics for discussion in order to
evaluate the appropriate structure for Canada.
Canada's mutual fund fees have been the subject of much debate in
recent years. Some research studies examining Canada's mutual fund
fees, along with international reforms, have prompted greater interest
in reviewing the issue of mutual fund fees in Canada.
"Mutual funds are a key investment in the portfolios of many
Canadians," said Bill Rice, Chair of the CSA and Chair and CEO of the
Alberta Securities Commission. "It is important that we look at
Canada's mutual fund fee structure carefully in determining what
changes could or should be considered to enhance investor protection
and foster confidence in our market."
To date, the CSA has focused its efforts on enhancing the transparency
of mutual fund fees and commissions through initiatives such as the
Point of Sale, and Cost Disclosure and Performance Reporting projects.
While these initiatives remain a priority on behalf of investors, the
CSA has determined that it is also necessary to consult extensively
with investors and market participants to explore whether further
issues remain.
The CSA welcomes feedback on the Discussion Paper, which can be found
on CSA members' websites. The comment period is open until April 12,
2013. All comments will be considered in the CSA's decision and next
steps, and also assist in the development of a roundtable the CSA
plans to hold with investors and industry participants in 2013.
The CSA, the council of the securities regulators of Canada's
provinces and territories, coordinates and harmonizes regulation for
the Canadian capital markets.

is clear on your dead calf issue: Our forensic labs do not process
testing on animals in cases such as yours, they are referred to the
Atlantic Veterinary College in Charlottetown who can provide these
services. If you do not choose to utilize their expertise in this
instance, then that is your decision and nothing more can be done.
As for your other concerns regarding the US Government, false
imprisonment and Federal Court Dates in the US, etc... it is clear
that Federal authorities are aware of your concerns both in Canada and
theUS. These issues do not fall into the purvue of Detachment policing
in Petitcodiac, NB.

PM invokes immunity to avoid testifying at ex-candidate's libel trial

Prime Minister Stephen Harper is claiming parliamentary immunity to
avoid giving evidence in a libel lawsuit launched by a prominent
Ottawa lawyer who stepped aside as an election candidate to make way
for sponsorship whistleblower Allan Cutler.
Mr. Harper's lawyer, Richard Dearden, told court yesterday sections of
the Constitution and the Parliament of Canada Act prevent the prime
minister from being compelled to testify in the legal action by lawyer
Alan Riddell as long as Parliament is in session.
Mr. Dearden served notice of the immunity claim in legal documents he
filed before he and a lawyer for the Conservative party, Robert
Houston, convinced a judge yesterday to postpone a trial that was to
begin this week on a claim related to the libel action.
"It's absolute," Mr. Dearden said after presenting his arguments to
Justice Monique Metivier.
"Any member of Parliament can invoke parliamentary privilege when
Parliament is in session. No reasons need be given."
Allan Riddell has sued Mr. Harper and Don Plett, the president of the
Conservative party, over their claims in November 2005 there was no
agreement between Mr. Riddell and the party for him to step aside to
let Mr. Cutler run in the campaign that fall.
The agreement, which a Superior Court judge ruled last year had been
reached between Mr. Riddell and the Conservatives, included a promise
that Mr. Riddell would be compensated for expenses he incurred while
campaigning for the Conservative nomination in Ottawa South.
But the Conservative party claims the agreement also included an
unstated term of confidentiality, which it says Mr. Riddell breached
when he publicly disclosed its existence.
The trial Judge Metivier postponed to an unscheduled date was to have
decided whether the agreement included a clause of confidentiality.
Superior Court Justice Denis Power ruled last year that, even if there
was a confidentiality clause, the agreement continued to exist even
though Mr. Riddell disclosed its existence. The trial of Mr. Riddell's
libel claims against Mr. Harper and Mr. Plett is not scheduled to
begin until February.
But the acrimonious atmosphere of the legal proceedings that have
taken place behind close doors so far, primarily in examinations of
discovery to gather evidence, surfaced as Mr. Houston, Mr. Dearden and
Tom Conway, Mr. Riddell's lawyer, exchanged barbs before the judge.
Mr. Dearden told Judge Metivier he had been "ambushed" by Mr. Conway
with last-minute information.
Meanwhile, Mr. Houston reacted angrily to statements Mr. Conway made
about the Conservative party's wish to keep the agreement with Riddell
"a secret."
Mr. Conway claimed the Conservatives wanted to delay the trial over
the confidentiality clause because they had "painted themselves in a
corner."
The claim of secrecy creates an unwholesome image of "cigar-smoking
backroom boys" cutting a political deal behind closed doors, Mr.
Conway said.

An RCMP security detail has been guarding Justice Minister and
Attorney General T.J. Burke because of threats made against him
recently.
Burke, the Liberal MLA for Fredericton-Fort Nashwaaksis, wouldn't
explain the nature of the threats.
"I have had a particular individual or individuals who have made
specific overtures about causing harm towards me," he told reporters
Wednesday.
"The RCMP has provided security to me recently by accompanying me to a
couple of public functions where the individual is known to reside or
have family members in the area," said Burke. "It is nice to have some
added protection and that added comfort."
The RCMP provides protection to the premier and MLAs with its VIP security unit.
Burke didn't say when the threat was made but it's believed to have
been in recent weeks.
"When a threat is posed to you and it is a credible threat, you have
to be cautious about where you go and who you are around," he said.
"But again, I am more concerned about my family as opposed to my own
personal safety."
Burke said he doesn't feel any differently and he has not changed his
pattern of activity.
"It doesn't bother me one bit," he said. "It makes my wife feel awful nervous."
Burke served in an elite American military unit before becoming a
lawyer and going into politics in New Brunswick.
"(I) have taken my own precautions and what I have to do to ensure my
family's safety," he said. "I am a very cautious person in general due
to my background and training.
"I am comfortable with defending myself or my family if it ever had to happen."
Burke said it is not uncommon for politicians to have security concerns.
"We do live unfortunately in an age and in a society now where threats
have to be taken pretty seriously," he said.
Since the terrorism attacks in the United States on Sept. 11, 2001,
security in New Brunswick has been
beefed up.
Metal detectors were recently installed in the legislature and all
visitors are screened.
The position of attorney general is often referred to as the
province's "top cop."
Burke said sometimes people do not differentiate between his role as
the manager of the justice system and the individual who actually
prosecutes them.
"With the job sometimes comes threats," he said. "I have had numerous
threats since Day 1 in office."
Burke said he hopes his First Nations heritage has nothing to do with it.
"I think it is more of an issue where people get fixated on a matter
and they believe you are personally responsible for assigning them
their punishment or their sanction," he said.
Is the threat from someone who was recently incarcerated?
"I probably shouldn't answer that," he replied.
Reporters asked when the threat would be over.
"I don't think a threat ever passes once it has been made," said
Burke. "You have to consider the credibility of the source."
Bruce Fitch, former justice minister in the Conservative government,
said "every now and again there would be e-mails that were not
complimentary."
"I did have a meeting with the RCMP who are in charge of the security
of the MLAs and ministers," said Fitch.
"They look at each and every situation."
Fitch said he never had bodyguards assigned to him although former
premier Bernard Lord and former health minister Elvy Robichaud did
have extra security staff assigned on occasion.
He said if any MLA felt threatened, he or she would discuss it with the RCMP.
