On 13 occasions in the House of Commons, at various committees during media reports to the press and television, he indicated that law enforcement including the OPP specifically asked for the invocation of the Emergencies Act. He perpetuated this lie by indicating that not only did you request it, that he received advice either from the OPP Commissioner, or a member of your legal team that the Government of Canada had met the threshold to invoke the Emergencies Act. (Adrian Wyld/Canadian Press) The head of the Royal Canadian Mounted Police was caught by surprise last year when the Higgs government asked for the removal of the head of the force's J Division in New Brunswick. Commissioner Brenda Lucki told the province's public safety minister it was "unfortunate" that no one told her or her senior management team that they had "concerns" about assistant commissioner Larry Tremblay. "There may have been an opportunity to proactively address some of the issues you've raised," Lucki wrote to then-minister Ted Flemming in a July 29, 2021 letter obtained by CBC News. Flemming had written to Lucki two weeks earlier, invoking a section of the province's policing contract with the RCMP that allowed him to ask the force to replace Tremblay. Ted Flemming was public safety minister when New Brunswick pushed for the removal of Larry Tremblay as assistant commissioner of the RCMP's J Division. That section says the minister can request a replacement if the commissioner is convinced "sufficient cause" exists that the head of J division "no longer commands the confidence" of the provincial government. Flemming's letter opened by saying "as you are aware," Tremblay "no longer commands my confidence" to act on drug crime and be accountable to local communities. In her response, Lucki said "neither I, nor my management, were aware of any concerns" about Tremblay before Flemming's letter. "We have no additional comment on this matter," said spokesperson Geoffrey Downey. Lucki's letter said she hoped the RCMP could work with the province to reach "a positive resolution that will ensure all parties involved are treated with respect and dignity" without having to invoke Article 7.4. When CBC first revealed Tremblay's removal last year, J Division spokesperson Angela Chang claimed Article 7.4 hadn't been invoked and Tremblay made a "personal decision" to retire at the end of October. Chang later withdraw the assertion the article hadn't been invoked. Spokesperson Robin Percival repeated that Tremblay had made a personal decision to retire effective Oct. 31, 2021. CBC News obtained Lucki's letter to Flemming this week through an access to information request to the RCMP. In his letter to Lucki, Flemming complained that Tremblay did not help the Higgs government "drive significant change" in policing, especially on drug crime. The minister said in an interview last October that J Division was "not having the kind of leadership that we felt we needed" and the situation was "out of control." He said the province wanted to "declare war" on drug dealers. Tremblay was removed from the job in J Division last year after a request from the province. (Ed Hunter/CBC) Opposition Liberal MLA Rob McKee says Flemming often speaks about the independence of the justice and policing system but his decision to push out Tremblay "demonstrated just the opposite." "The fact that now it's coming back that he did not even raise concerns with them is even more concerning," McKee said. "I think this shows that after the fact, Lucki is saying that she felt due process wasn't respected in this case." The province provided an extra $2.3 million for J Division's crime reduction unit last year to try to reduce drug crime, part of a five year addiction and mental health action plan. This year's budget added another $3.3 million. Tremblay was named assistant commissioner of the RCMP for New Brunswick in 2016. Three days after CBC News revealed Flemming's push to remove him, the RCMP said it had decided "to not proceed" with appointing Chief Superintendent Kevin Leahy, head of the Parliamentary Protective Service in Ottawa, as his replacement. Carleton MLA Bill Hogan took over the role of public safety minister in the Higgs cabinet earlier this year, assuming the role held by Ted Flemming, who remains justice minister and attorney-general. Premier Blaine Higgs shuffled Carleton MLA Bill Hogan into the position in February, saying it would help "ramp up our intensity" in fighting drug crime. He said it wasn't a reflection on Flemming, who remains attorney general and justice minister. "I don't think it's a case of Minister Flemming not being able to continue," Higgs said. "I think it's a situation where we're putting an emphasis on public safety and rural communities and communities throughout our province that have continued to face crime issues." "There may have been an opportunity to proactively address some of the issues you've raised," Lucki wrote to then-minister Ted Flemming in a July 29, 2021 letter obtained by CBC News. Flemming had written to Lucki two weeks earlier, invoking a section of the province's policing contract with the RCMP that allowed him to ask the force to replace Tremblay. Lucki's letter said she hoped the RCMP could work with the province to reach "a positive resolution that will ensure all parties involved are treated with respect and dignity" without having to invoke Article 7.4. When CBC first revealed Tremblay's removal last year, J Division spokesperson Angela Chang claimed Article 7.4 hadn't been invoked and Tremblay made a "personal decision" to retire at the end of October. Chang later withdraw the assertion the article hadn't been invoked. CBC News obtained Lucki's letter to Flemming this week through an access to information request to the RCMP. In his letter to Lucki, Flemming complained that Tremblay did not help the Higgs government "drive significant change" in policing, especially on drug crime. The minister said in an interview last October that J Division was "not having the kind of leadership that we felt we needed" and the situation was "out of control." He said the province wanted to "declare war" on drug dealers. Tremblay was removed from the job in J Division last year after a request from the province. "The fact that now it's coming back that he did not even raise concerns with them is even more concerning," McKee said. "I think this shows that after the fact, Lucki is saying that she felt due process wasn't respected in this case." The province provided an extra $2.3 million for J Division's crime reduction unit last year to try to reduce drug crime, part of a five year addiction and mental health action plan. This year's budget added another $3.3 million. Tremblay was named assistant commissioner of the RCMP for New Brunswick in 2016. Three days after CBC News revealed Flemming's push to remove him, the RCMP said it had decided "to not proceed" with appointing Chief Superintendent Kevin Leahy, head of the Parliamentary Protective Service in Ottawa, as his replacement. Carleton MLA Bill Hogan took over the role of public safety minister in the Higgs cabinet earlier this year, assuming the role held by Ted Flemming, who remains justice minister and attorney-general. Premier Blaine Higgs shuffled Carleton MLA Bill Hogan into the position in February, saying it would help "ramp up our intensity" in fighting drug crime. He said it wasn't a reflection on Flemming, who remains attorney general and justice minister. "I don't think it's a case of Minister Flemming not being able to continue," Higgs said. "I think it's a situation where we're putting an emphasis on public safety and rural communities and communities throughout our province that have continued to face crime issues." Two organizers of the "Freedom Convoy" say they don't have enough money to defend a potential class-action lawsuit against them and want a court to unfreeze donations made to the convoy so they can pay for lawyers.
Benjamin Dichter and Chris Garrah want the Superior Court of Justice of Ontario to release $200,000 of the more than $5 million in funds given by convoy supporters that is currently held in escrow, pending the resolution of litigation launched on behalf of Ottawa residents and businesses.
“The $200,000 amount sought as an initial retainer is reasonable in the context of a $300-million class proceeding,” Dichter and Garrah claim in a motion record before the court.
The documents says $200,000 is the amount required as a retainer for their new law firm, Jim Karahalios Professional Corporation, but it notes that more money might be needed in future to defend the potentially complicated and lengthy case.
The lawsuit was launched in February by Ottawa public servant Zexi Li on behalf of residents of Ottawa's downtown core, alleging damages caused by the sustained noise of truck horns and diesel fumes.
Lawyer Paul Champ later expanded the potential class of plaintiffs to include Ottawa businesses affected by the three-week occupation of the city and employees who lost wages.
The lawsuit names a list of convoy organizers as defendants but Champ wants to add two “defendant classes,” making any trucker who participated in the protest or anyone who gave donations potentially liable for damages.
In the course of the lawsuit, Champ successfully obtained court orders to freeze money donated to the convoy through sites such as GoFundMe and GiveSendGo, as well as email transfers and cryptocurrency payments.
Neither Dichter nor Garrah can personally afford their legal representation in the case, their motion record says, as both have limited income and minimal assets.
Dichter, the record says, is a truck driver and a podcast producer who lives in a rental apartment, and owns no real estate and has no material savings.
“Aside from the truck he uses to generate income, which is worth approximately $40,000 to $50,000 with $15,000 in corresponding financing charges, he drives a modest personal vehicle,” the motion record says.
“His 2021 income was approximately $10,000 with a further $7,000 in corporate net income. He was unable to earn material income for six months in 2022 due to a broken foot.”
Garrah also has limited income from his work as a general contractor, selling windows and doors, according to the court filing. He had net income of approximately $15,000 in 2021 and his wife owns their family home, valued at approximately $400,000. His only other assets are tools for work and two trucks, one of which isn't working, the motion record says.
The plaintiffs in the Li case are resisting the motion to release the funds, arguing that Dichter and Garrah must prove they have no other assets available before applying to release funds from escrow.
“In the present case, the Moving Parties are not wealthy but they are not impecunious,” the plaintiffs responded. “Both are gainfully employed and have assets.”
The plaintiffs' response notes that both Dichter and Garrah own vehicles and have income. Dichter, it says, receives income from his podcast and just published a book about the convoy, which could generate more income.
The court had previously agreed to unfreeze $100,000 of the donations to pay legal fees for another group of defendants to the lawsuit involved with Freedom Corp. 2022, the not-for-profit set up to receive the donations.
Freedom Corp. is also opposing the motion, saying it received the money from the escrow only after agreeing not to challenge the court orders freezing the donations, called Mareva orders.
“The funds that Garrah and Dichter seek access to are donations that were intended to vest with the Freedom Corp.,” the corporation's response says.
“Freedom Corp. has a fiduciary duty as the intended trustee of donated funds to ensure they are used effectively and efficiently.”
The Ontario Ministry of Attorney-General also filed a brief in the case, saying it intends to seize $3.4 million of the funds donated through GiveSendGo as “offence-related property,” should convoy organizers Tamara Lich or Christopher Barber be found guilty on the criminal charges they face.
A hearing on the Dichter and Garrah motion is scheduled for Tuesday morning.
All 'Freedom Convoy' truckers, donors could be drawn into class-action lawsuit over protest disruption
The lawyer leading a potential class-action lawsuit against the Freedom Convoy wants to expand the list of defendants to include all truckers who occupied Ottawa earlier this year, as well as anyone who donated to the fund the protest.
If successful, the legal manoeuvre could make the owners of approximately 400 trucks and tens of thousands of donors financially liable for a share of $300 million in damages the lawsuit claims.
Lawyer Paul Champ first filed the litigation in February, naming public servant Zexi Li, who lives in downtown Ottawa, as a representative of a class of residents who claim they suffered from the noise and disruption caused by hundreds of trucks parked on city streets for three weeks.
Champ later added representatives plaintiffs of two Ottawa businesses and employees of other downtown businesses as additional classes of plaintiffs — meaning they could share the damages should the court certify the classes, and if the litigation succeeded.
The lawsuit initially named Tamara Lich, Tom Marazzo, Chris Barber and other convoy organizers as defendants, along with unnamed “John Doe” and “Jane Doe” truckers and donors.
Now Champ has brought an unusual motion to add two defendant classes to the litigation, potentially making liable anyone who brought their truck to the Ottawa protest or contributed financially through crowdfunding sites like GiveSendGo or GoFundMe.
In an application filed in Ontario Superior Court, Champ identifies the operator of an Ontario trucking company and a New Brunswick businessman as representatives of the two defendant classes.
The motion identifies Brad Howland, of Kars, N.B., as a representative defendant of a potential donor class. He owns owns Easy Kleen Pressure Systems Ltd., which donated “$75,000 USD on or about February 9, 2022, to GiveSendGo to support, encourage and facilitate” the protest, the motion alleges.
Howland confirmed to CTV News that his company had donated to the convoy but he says he isn’t sure where it ended up.
“The money was to support and pay for expenses for the people that were giving up so much time to put their voice forward and their time forward to explain how we want freedom in the country,” he said.
Howland said he had heard rumours he might be drawn into the litigation but wasn’t certain until contacted by CTV News.
The motion also seeks to add Harold Jonker of Caistor Centre, Ont., as the representative defendant. It claims his company, Jonker Trucking, “owned at least 11 semi-tractor trucks that were driven to Ottawa and used to participate in the tortious activities of the Freedom Convoy protest.”
Jonker could not immediately be reached for comment Wednesday.
Many of the convoy defendants to the lawsuit are testifying before the Public Order Emergency Commission currently studying the federal government’s use of the Emergencies Act to end the protests.
Champ is also appearing at the inquiry on behalf of a coalition of downtown Ottawa residents and businesses. Li testified during the first week of the inquiry hearings.
None of the defendants named in the lawsuit have filed statements-of-defence yet, and none of the allegations have been proved in court.
Champ and other lawyers working on the case have successfully frozen millions of dollars donated through crowdfunding sites. The money is held in escrow pending resolution of the case.
Champ also used the Li lawsuit to successfully obtain an injunction to stop the truckers from blowing truck and train horns.
The plaintiffs still face major legal hurdles, to certify about 24,000 downtown residents as a class, and now, to certify the additional defendant classes.
Even if the plaintiffs eventually win a judgment in court, to collect damages, they will have to prove individuals belong to the defendants classes.
The plaintiffs are expected to rely on the enormous number of pictures and video posted to social media to identify individual truckers who participated in the protests. They could also use donor records from crowdsourcing platforms to identify members of the donor defendant class.

In a written statement Monday afternoon, Brad Howland called the protest "a beautiful, legal, peaceful protest" that he visited on the weekend.
"To see the love, peace, and unity that many of us have longed for, for a long time — It was an experience of a lifetime," he wrote.
"This will go down in the history books of our nation."
In fact, the protest has forced many downtown businesses to close and violates several laws.
It's now the subject of the federal Emergencies Act, which Prime Minister Justin Trudeau invoked on Monday.
CBC News has reviewed information that appears to identify tens of thousands of Freedom Convoy donors to the website GiveSendGo.
The data, hacked and released briefly on its front page, includes names, locations, dollar amounts, personal email addresses, even the credit card companies used for each transaction.
CBC has not been able to independently confirm if the people on the list did in fact donate to the Freedom Convoy.
Howland confirmed to CBC News that his donation was $75,000.
A database from GiveSendGo released publicly lists that as the second-highest amount of all donations.
A sign supporting truckers was visible at Easy Kleen's property near a Highway 1 off-ramp earlier this month.
Howland said in his statement that Easy Kleen has been in business for more than 40 years and has relied on truckers for deliveries to and from the factory.

Records from the federal government show that Easy Kleen has received funding from the Canada Emergency Wage Subsidy program, set up to help employers who have "seen a drop in revenue during the COVID-19 pandemic."
It's not clear how much the company received, but when asked about the subsidy, Howland said it was spent on wages at the beginning of the pandemic in 2020.
Howland has also donated thousands of dollars to the provincial Progressive Conservatives and the federal Conservative Party since 2018, according to public records.
Distrust of vaccines
On Facebook, Howland has posted support for former U.S. president Donald Trump and about his distrust of vaccines.
"They say the Democrats are worried about outside interference in USA elections," he wrote in August 2020, in a post that was no longer public as of Monday afternoon. "They should be, from the country of Lowest of Kars we are doing just that."
On Feb. 11, Howland posted that "a truck load of us" from Kars, a community about 50 kilometres from Sussex, would be heading to Ottawa.
"It is about time we act like we own it and show them who calls the shoots [sic] and determines mandates," Howland wrote on Jan. 25, in a post that is also no longer public. "That is the people. Governments got people in fear."
In 2009, Howland received a conditional discharge after he threatened the principal of a New Brunswick elementary school when they stopped daily singing of O Canada.
CBC reported at the time that Howland threatened to beat the principal senseless, but Howland said he meant it as a figure of speech rather than a threat.
"Other provinces adopted playing the anthem because of this situation in my life arose, which worked out very well in the end for thousands for children playing the anthem in their schools," Howland wrote to CBC when asked about the court case this week.
In total, the database shows donations from more than 500 people who used New Brunswick postal codes, but CBC cannot verify whether those individuals actually live in the province.

O Canada threat case results in discharge
A New Brunswick man has received a conditional discharge for threatening a school principal who scaled back the daily singing of O Canada at his daughter's school.
Bradley Howland, 43, of Hatfield Point was also ordered Friday to stay away from Erik Millett and Millett's partner, and not to go near the school for eight months unless accompanied by his wife.
"Educators have a tough enough job without being subjected to this type of harangue," provincial court Judge Henrik Tonning said during sentencing in Sussex.
Howland, who had about a dozen supporters with him in the courtroom, showed little reaction to the sentence. But he did apologize to Millett and asked for his forgiveness.
Millett told reporters outside the courthouse that he was satisfied with the sentence.
He also announced plans to file a lawsuit against two people for public comments they made about him during the storm of controversy. One of them is Minister of Veterans Affairs Greg Thompson, who is also MP for New Brunswick Southwest.
"If he fails to hold a press conference and apologize for his statements, which were defamatory towards me, if he fails to do that, I call upon the Prime Minister to fire him from cabinet," said Millett.
He also wants a letter of apology from Susan Boyd, the Belleisle parent who initially raised concerns about the anthem, he said.
Neither Thompson nor Boyd were available for comment Friday.
Guilty of uttering threats
Howland was found guilty last month of uttering threats to cause serious bodily harm to Millet, who was at the time the principal of Belleisle Elementary School, and causing Millett to fear personal injury.
Millett, who has since left his post, told the court Howland threatened to "beat [him] senseless."
Millett stepped down as principal after a countrywide controversy erupted in January over his decision to reserve the singing of the national anthem for monthly assemblies. Two families had complained for religious reasons about O Canada being sung daily over the school's PA system.
Tonning said it was "regrettable" the case had to come this far. The judge described the case as "serious," but said he didn't think Howland’s comments were "malicious." The judge noted that Howland’s friends, in letters of support to the court, said he "often becomes disengaged with his mouth" and that his passion for this issue "misguided his words."
Tonning said he believes Howland, who owns several businesses, is an upstanding citizen who "now understands the principle of keeping one's mouth shut."
But he had to consider the principle of deterrence in sentencing, he said. People need to know it’s not acceptable to threaten educators.
Howland was also ordered to pay Millett $500 toward the cost of counselling that he and his partner have received since the threat.

The New Brunswick businessman who donated $75,000 to the "freedom convoy" in Ottawa says he doesn't think there will be ramifications from what he did, and that business has never been better.
On Thursday, Brad Howland, president of Sussex Corner-based Easy-Kleen Pressure Systems Ltd., told Brunswick News that his bank accounts were never frozen by the federal government, and that he
doesn't expect to be among the people left with a permanent "mark" on their bank accounts for donating to the convoy.
He says that's because he donated before the feds invoked the Emergencies Act, which gave Ottawa sweeping powers to end the convoy.
Howland said as far as he knows, the money he donated is still in the GiveSendGo account frozen by the federal government.
Earlier this week, according to Blacklock's Reporter, the Canadian Bankers Association said that convoy supporters who had their accounts frozen will permanently have their files marked. “We primarily relied upon the names provided by the RCMP, but there were obligations under the order separate that required banks to make their own determinations. We did not rely on external information,” Angelina Mason, general counsel for the Bankers Association, said at the Commons finance committee, according to Blacklock's.
Mason also confirmed that the names of frozen accounts were given by the banks to the RCMP.
Asked whether he's worried, Howland shrugged it off, accusing the ruling federal Liberals of being "small" people "casting big shadows." "I'm quite shocked, as a Canadian citizen, that they would talk like this, or even consider it," he said. "You hear the words 'cancel culture,' or 'disinformation,' or 'misinformation' ... [the threat of permanent marks on bank accounts] is according to who?
"It's a serious thing that these fellas are infringing upon."
According to the federal online registry, Easy-Kleen received pandemic relief funds through Ottawa’s Canada Emergency Wage Subsidy.
Howland, a self-professed champion of "freedom" and a fan of former U.S. president Donald Trump, then compared the idea of permanent marks being put on convoy supporters' bank accounts to policies used by the Chinese government.
He added that he's been tracking what "the government" has said during the pandemic, and believes the promises that were made to
Canadians if they followed the rules were never fulfilled. "Not much of [what was said] was true ... the government is not always right," Howland said. "Just because the government says something doesn't mean it's true, or correct."
Howland said since he made the donation and visited the convoy – which he said was misrepresented after "one person" carried a flag with a swastika, and a few flew confederate flags – he's received calls and letters of support from across Canada and the U.S. – and donations. And some companies want to do business with Easy-Kleen because of his participation in the convoy, Howland added.
"Our business has never been better," he said.
"People that buy our kind of equipment, they're all industry people and we're [all] of like minds.
"Some people said, 'Oh my goodness, Easy-Kleen is gonna go down the tubes because of this,' but listen, we're on the right side. When you're for freedom, you're on the right side of it. And if you're on the right side, it's gonna come around to you."
Howland said Easy-Kleen's business is "way up."
"We have people buying machines just to buy machines. We have oil companies out West calling us and saying, 'We're buying from you guys, because you guys are supporting freedom.'"
He also said he's received what he jokingly calls "love mail": donations, and gift cards.
So no worries about what he did?
"I'll never regret it," Howland said.
