money to her from an American who is on Canada's terrorist list.

Two RCMP union officials quit, allege election interference in scathing resignation letter
The dispute follows a court application filed against the union by an individual RCMP member concerning millions in alleged payments to the union’s board of directors.
Two senior officials overseeing elections within the RCMP union have quit the organization and issued a scathing letter of resignation alleging “interference” and “pressure” on the part of the union’s leadership.
Neil Vaid and Jordan Irvine resigned as chair and vice-chair respectively of the National Police Federation’s nominations and elections committee on Monday, March 23, circulating a statement among the membership that alleged the board has been “overtaken by a voting majority determined to control the outcome” of upcoming elections.
Their letter was followed the next morning by a reply from the National Police Federation or NPF.
“The Board has accepted their resignations,” it read. “Their parting statement is factually inaccurate and prejudicial … We will not engage in the personal attacks and hyperbole set out in the statement and on social media.”
The letter and subsequent union rebuttal have not been made public but have been obtained by the Ottawa Citizen.
Both documents offered a rare glimpse into the inner workings of the NPF, which at 20,000 members is Canada’s largest police union and one of the biggest police unions in North America.
The original letter and the union’s reply both alluded to a controversy around the eligibility of candidates, with Vaid and Irvine stating that the “voting majority” on the board “has interfered in the election process in support of what appears to be handpicked candidates aligned with a planned succession of power.”
The letter said that “candidates who were not board-endorsed were being singled out for targeted removal, while others who may have been ineligible were not being examined further.”
The resignations of Vaid and Irvine and the allegations contained in their letter bear a resemblance to a legal matter currently before the courts.
That legal dispute has led both the union and the departing committee heads to decline to comment.
Vaid, who is based in Ottawa and holds the rank of staff sergeant, said he would not discuss his resignation, only confirming that he and Irvine, a corporal, wrote the letter.
“As this matter is currently before the court, I am not in a position to comment further or provide additional context,” Vaid wrote in an email to the Ottawa Citizen.
Irvine, who according to social media accounts is based in Surrey, B.C., did not respond to multiple requests for comment.
The NPF declined a request to make its co-founder and president Brian Sauvé available to comment, referring to the matter before the courts.
Civil filings at the Ottawa courthouse show that legal matter centres on Damon Atwood, an RCMP corporal currently on leave from the force once based in Alberta but now living in Ottawa.
“I can confirm I am the NHQ candidate referred to by the Board in their response,” Atwood wrote in an email.
“Many people are hesitant to criticize the union as it attracts a strong response from passionate members who confuse criticism with disloyalty,” he wrote in a subsequent email in reply to a question about other RCMP members who might be in a position to discuss the dispute.
Atwood, who went to law school while on leave from the RCMP and is now articling, remained active in the RCMP union during his studies and is now preparing to return to the force.
He has also filed two notices of application against the RCMP union.
One, filed on March 17, formed the basis of the union fight about candidate eligibility now underway — and specifically involves his own eligibility to become a candidate for NPF board director.
The eligibility dispute followed an earlier notice of application Atwood filed last year against the union concerning millions in payments to its leadership — a filing that forms part of the backdrop to the conflict between Vaid and Irvine and the NPF board of directors.
That first application, which Atwood filed on behalf of the NPF, sought to recover “approximately $3.39 million” in union dues that Atwood alleged a previous board of directors, including Sauvé and 15 others, paid themselves without alerting the membership. Atwood’s application claimed the directors were looking to cover losses in benefits they believed they suffered after the RCMP chose not to recognize their higher union salaries when calculating their pensions.
The allegations contained in the two applications have not been tested in court, and the union has not yet responded to them.
Atwood’s second application, which outlined his attempts to run as a union board director, accused the NPF of behaving in “a manner oppressive to the applicant.”
According to Atwood’s filing, while preparing to return to the RCMP following his legal studies and while fielding job posts with the force in Ottawa, he submitted nomination materials in support of his application for candidacy to run as a board director for the NPF at national headquarters.
The application says one part of those materials was a “candidate statement expressing a campaign aimed at limiting director remuneration and reducing union dues.”
The application noted that Vaid, as chair of the nominations and elections committee, and tasked with ensuring that elections take place in accordance with the union’s bylaws, wrote Atwood soon after to confirm his eligibility as a candidate.
Atwood alleged the board reversed the nomination and election committee’s decision the following day. The application said Atwood was later informed that the board deemed him ineligible because his most recent union dues data associate him with Alberta and not Ontario.
Vaid and Irvine’s letter noted that the nomination and election committee was designed to include two members who would “exist independently of the board” and who are elected by delegates at AGMs. Instead, by their account, the board began “stripping” them of independence, including suspending their credentials and denying them access to election materials.
“Once an election body cannot publish or execute its own decisions without prior board approval,” Vaid and Irvine wrote, “it is no longer independent in any meaningful sense.”
For their part, the board directors said in their rebuttal letter that they see the courts, now handling the matter in question, as the “ultimate independent adjudicator,” and that they “welcome the opportunity for a full and transparent disclosure of all facts related to the decision” — including the “conduct” of Vaid and Irvine.
“At law, all NPF decision making, including by the (committee), is ultimately the board’s responsibility,” the directors said.
The directors, without naming Atwood but clearly referring to his case, said he was ineligible to run as a director for Ottawa’s national headquarters because his workplace remained in Alberta and he had regularly represented Alberta at union events.
Indeed, Atwood was scheduled to represent Alberta as a delegate at the upcoming AGM this summer.
The board added that the committee decision under Vaid and Irvine deeming Atwood eligible had been made against the advice of another committee member and committee staff.
“(A)n applicant’s eligibility is based on where they work, not where they live,” the board wrote.
Pending the court process, the board has suspended the election for the Ottawa director.

Canada’s Justice for Victims of Terrorism Act Needs a Rewrite

In 2012, Canada enacted the Justice for Victims of Terrorism Act (JVTA) to deter terrorism by opening an avenue of legal liability for victims against state sponsors of terrorist acts. Nearly 12 years later, the Act has proven far less effective than it could or should be.
The JVTA allows victims of terrorism who have suffered loss or damage in or outside of Canada after January 1, 1985 to sue certain foreign states. The precondition for commencing a lawsuit in pursuit of monetary damages is that the loss must be the result of an act or omission of a listed terrorist entity or a foreign state whose immunity is lifted by Canada. The act or omission must be punishable under the terrorism-related provisions in the Criminal Code, even if it took place outside of Canada. As one Canadian court put it, in enacting the JVTA, “[i]t was Parliament’s intention to carve out a new exception to state immunity for the purposes of (i) deterring terrorism and (ii) making it easier for plaintiffs to make claims against states that support terrorism and that have assets in Canada that could assist in satisfying a judgment.”
At first glance, the JVTA appeared promising. It empowered victims of terrorism to pursue legal action for compensation if they could establish a substantial connection to Canada, or if the plaintiff is a Canadian citizen or a permanent resident, even if the conduct did not take place in Canada. Unfortunately, it is now clear that the JVTA lacks the force it was meant to have.
In order to sue a foreign state under the JVTA, the state must be listed as a state supporter of terrorism in the State Immunity Act, which precludes the state from immunity. Under the State Immunity Act, the federal Cabinet can list state supporters of terrorism. To date, only Iran and Syria are listed.
While there is no shortage of terrorism-related offences on the books, they remain relatively sparse in terms of their rate of prosecution compared to other crimes. Victims of terrorism are often left with few mechanisms to seek justice short of a conviction through prosecution. The JVTA is one of few potential avenues.
But the Act has serious shortcomings. For one, it currently pre-supposes that state sponsoring of terrorism is perpetrated in only two countries – Iran and Syria.
The 2015-2016 case of Canadian hostages held by Abu Sayyaf in the Philippines demonstrated this shortcoming exceedingly well. Despite the heinous acts committed by the terrorist group, the victims’ families could not bring a legal claim under the JVTA as the Philippines was not a listed foreign state with lifted immunity. To add to the families’ grievances, after the Canadians were executed, the world-renowned British Special Air Service, in conjunction with the Philippine Army, rescued the British hostages from the same location where the Canadians had been held captive.
In addition, it would be impossible to enforce payment from an elusive terrorist group residing outside Canada. The clear requirement that the entity being sued must be a foreign state or a designated entity under the Criminal Code is limiting. How does one seize assets from an individual or a terrorist entity in any event? Perhaps by going after the country that funds the person or entity, but that has, to some degree, proven to be a dead end too.
The JVTA lacks teeth. Even though courts have recognized and upheld judgments from foreign states and some have been successful seizing Iran’s non-diplomatic assets, at issue is always the execution of judgments.
This process is not to be confused with the forfeiture or seizure of assets under the Justice for Victims of Corrupt Foreign Officials Act (also known as the Sergei Magnitsky Act). That Act empowers the federal Cabinet to prohibit Canadians (in or outside of Canada) from having financial dealings or transacting in property with certain foreign nationals who are responsible for, or have committed, gross human rights violations. However, the Sergei Magnitsky Act has nothing to do with victims seeking justice through monetary means, as compared to the JVTA.
While the JVTA has been employed in Ontario, notably in the case of Zarei v. Iranrelated to the downing of Ukraine International Airlines Flight 752 (PS752), its effectiveness is questionable even where plaintiffs have succeeded in pleading their damages before the courts.
The families in Zarei were successful in establishing that the missile attacks on Flight PS 752 were intentional and directly caused the deaths of all onboard. The court agreed that the attack constituted terrorist activity under the Criminal Code. The families moved to enforce judgment, were successful, and were awarded $107 million plus interest in damages, in addition to their costs for the lawsuit.
They moved to seize the assets of three properties belonging to the Islamic Republic of Iran in Canada, as well as bank accounts at Scotia Bank and the Royal Bank of Canada.
In response, the current Minister of Foreign Affairs issued a certificate pursuant to section 11 of the Foreign Missions and International Organizations Act, to certify that the Iranian property constitutes diplomatic property, which enjoys privileges and immunities (a move which is in stark contrast from the foreign policy statement made by the recent designation of the Iranian Islamic Revolutionary Guard Corps (IRGC)). On behalf of the federal Government, the Attorney General of Canada, also argued that non-diplomatic assets were already seized. As a result, the families were circumvented from seizing all of the assets they were rightfully owed.
In October of 2023, the Court of Appeal for Ontario upheld a ruling confirming that the Iranian assets enjoyed diplomatic immunity. The applicants sought leave to appeal from the Supreme Court of Canada, which was rejected on May 30, 2024, foreclosing any possibility of further recourse to recoup certain assets.
These examples make clear that the JVTA lacks teeth. Even though courts have recognized and upheld judgments from foreign states and some have been successful seizing Iran’s non-diplomatic assets, at issue is always the execution of judgments.
For example, with the designation of the IRGC as a terrorist entity, banks could play a key role in identifying and freezing the accounts of IRGC-affiliates or those who engage in transactions with the IRGC. Frozen or seized assets (either provisioned through the Criminal Code or the Sergei Magnitsky Act) could, as Irwin Cotler and Brandon Silver have previously alluded in Policy, be repurposed for judgment in successful JVTA cases. If there were ever a time to consider this, the time is now.
As Canada grapples with its place on the international stage, it is crucial to revisit and reform the existing JVTA framework. The JVTA’s limitations leave victims without meaningful avenues for compensation. A small glimmer of hope exists through class-action certification but the problem around seizing known assets which the Government can shield under the guise of diplomatic immunity remains. Another, more meaningful change requires a broader examination at the policy level, where we start thinking critically about barriers to recouping damages for victims in this space.
If Canada is truly a leader against terrorism and wishes to support victims, it needs to go back to the drawing board with the JVTA. Without some form of justice, the harsh reality for victims of terrorism remains: “It just is”.

Task Force 2 (JTF2) is an elite special operations unit of the Canadian
Armed Forces, specializing in counter-terrorism and high-risk missions.
Its origins stem from a 1992 recommendation by Deputy Minister of
Defence Robert Fowler to disband the Royal Canadian Mounted Police's
(RCMP) Special Emergency Response Team (SERT) and establish a new
military counter-terrorism capability under the Canadian Armed Forces.
This shift was motivated by the military's larger pool of potential
recruits compared to civilian police forces and public concerns over
police reliance on lethal tactics in counter-terrorism scenarios.

was officially activated on April 1, 1993 (or early 1993 per some

About Michelle Boutin
Michelle was born in Toronto and raised in Belleville, Ontario. After she completed her Diploma in Police Education Studies at Sir Sandford Fleming College, she moved to British Columbia where she began a career in security. She provided security services in a variety of venues including the Tokyo Corporation at the Pan Pacific Hotel, as well as Orca Bay Sports and Entertainment at General Motor Place in Vancouver, B.C. Michelle was hired by the Correctional Services of Canada as a Corrections Officer and was posted at the Kent Maximum Security Penitentiary in Agassiz, B.C. where she was recruited by the RCMP in 1997. After graduating from Depot in 1998, she was posted to Fort McMurray and Sylvan Lake in AB, the Commercial Crime Section as a Corporal Supervisor in Edmonton AB and Calgary AB, Sergeant Detachment Operations NCO in Sylvan Lake AB, Staff Sergeant of the Staff Relations Representative Program and Staff Sergeant North West Region Supervisor of the Member Workplace Services Program.
As an RCMP Member, Michelle became involved in labour relations when she witnessed Members having difficulty resolving workplace issues. She recognized deficiencies in the RCMP’s internal labour relations program and knew positive changes could only be made with the right people in the right positions. When the Supreme Court gave Members the right to choose to be represented by a bargaining agent, she became a voice for RCMP Membership on important issues and communicated the concerns of Members across the country to RCMP management.
In November 2019, she was elected as a Vice President for the National Police Federation and assumed that role in January 2020. Her expertise is primarily in the areas of pay, benefits and compensation where she has done the research and compiled the information necessary to ensure these parts are protected and enhanced in our future Collective Agreement. Michelle is also the Chair of the Member Services and Human Rights Committee, where the National Police Federation will focus service delivery from the Members’ perspective. The Member Service Strategy is aligned to the NPF Strategic Priorities to protect the workplace rights, health, and safety of Members and to enhance appreciation and credibility of NPF. The strategy will contribute to achieving a seamless experience for our Members across our organization.
Key Accomplishments:
- Served as a General Duty RCMP Member in Municipal, Rural and Reserve policing environments as well as Provincial and Federal Sections.
- NPF fully certified in July 2019; elected Nationally as Vice President in November 2019
- Played an integral part in Member negotiations with RCMP management for better understanding and application of Members benefits, pay and compensation entitlements, resulting in hundreds of thousands of dollars being returned to Members.

In the original video the first part was taken from (circa Nov 2016)
Baconfat actually ragequit after being muted by Shangi and never made
another blog post from that day forward until the blog was banhammered
in early 2017. Barry Winters was not arrested until June waaay after
the fact. Why? In my opinion he fucked up when he started attacking
the local Edmonton cops and politicians instead of random people on
the Internet that no one cares about.
While not a big fan of some of his opinions I enjoyed Baconfat's
ability to wind Amos up. To me he was kind of like that kooky uncle
apt to say anything after pounding back a few. Obnoxious but loveable.
Hope they serve Guinness in Heaven pal. Your brand of humour will be
sorely missed.

RCMP Should Drop Harassment Appeal and End Victimization of Sgt. Merrifield
VANCOUVER, April 4, 2017 /CNW/ - "RCMP management should drop its appeal in the case of Sgt. Peter Merrifield, an RCMP member who was subjected to harassment on the job," the Mounted Police Professional Association of Canada (MPPAC) said today.
"The RCMP's leadership has learned absolutely nothing from the recent series of harassment Allegations," said Rob Creasser, Media Liaison for MPPAC. "If it is going to restore the public's faith and its own integrity, the first step would be to drop the appeal and respect the court's order to pay damages to an officer who has been harassed."
In a March 1, 2017 ruling, Justice Mary Vallee described the treatment of Sgt. Merrifield as "outrageous." She awarded him $141,000 for lost wages, delayed advancement, and "harassment and intentional infliction of mental suffering" and ordered the RCMP to pay his legal costs. By appealing, RCMP management is clearly not acting in the public interest.
"Once again public finances, via the Department of Justice, are being used to deal with cases of systemic and egregious harassment within the RCMP," Creasser said. This case reinforces, yet again, the need for RCMP members to have an independent certified union.
"RCMP members have won the right to unionize but have met resistance from successive governments in attempting to exercise this right," Creasser said. "It appears that the Government of Canada and the RCMP have no plans to deal with systemic harassment within the RCMP. Despite the recent class action suit by female victims of harassment and sexual harassment which is estimated to cost more than $100 million - a cost which will be borne by the Canadian taxpayer."
The Mounted Police Professional Association of Canada has represented thousands of members in the past and continues to represent members today. MPPAC continues to support Members who have been intimidated and bullied in the workplace. MPPAC calls for resignation of RCMP Commissioner following privacy breach
OTTAWA, Feb. 26, 2016 /CNW/ - The Mounted Police Professional Association of Canada (MPPAC) is calling for the resignation of the Commissioner of the Royal Canadian Mounted Police (RCMP), Bob Paulson, following an investigation from the Office of the Privacy Commissioner of Canada which found that the release of RCMP members medical information was a "well-founded serious privacy breach." Commissioner Paulson admitted that he authorized the investigation.
"We know that Prime Minister Trudeau has committed to Canadians that they are a transparent and accountable government and we believe that they will make the proper changes to restore our RCMP so that it is greater than it ever was," said MPPAC's President Rae Banwarie who met with Public Safety Minister Ralph Goodale last year regarding making positive changes to the force.
Just this week Commissioner Paulson admitted to authorizing the release of sensitive health information of RCMP officers to the College of Psychologists without their permission.
Canada's Federal Privacy Commissioner concluded that by sharing private medical information without the consent of the officers, the RCMP breached the Privacy Act - A Federal Act of Parliament. If the Commissioner does not resign, MPPAC is calling on the Government of Canada to take appropriate action.
"Canadians do expect professional and exemplary conduct from their national police service, which starts with leadership at the top," said MPPAC spokesperson Rob Creasser. "Under this current leadership, members are afraid to come forward with their complaints for fear their jobs will be put at risk under the Enhancing RCMP Accountability Act. Why is there not a Code of Conduct investigation in this case? Does the Act not apply here?'
Another shocking revelation this week came when the Commissioner could not explain why an individual facing harassment complaints is leading up an investigation about inappropriate behaviour at the Canadian Police College.
The RCMP has repeatedly failed in the effective handling of member harassment and grievance complaints as all processes under this new act are not independent of management control.
MPPAC is encouraging RCMP members to email their concerns and issues to national@mppac.ca. All members' identity, issues and concerns will remain fully confidential.
MPPAC has been successfully fighting for the right to engage in collective bargaining as the independent association on behalf of RCMP regular and civilian members across Canada. The Government of Canada now has until May 16, 2016, to pass legislation that will grant collective bargaining rights to RCMP members, based on the Supreme Court of Canada's ruling last year.

"Some of these men and women have made the ultimate sacrifice and his sweeping generalizations frankly put our officers in harm's way both legally and personally," said Rob Creasser, MPPAC spokesperson. "His comments seem to paint all officers from across the country with the same racist brush. How is the public supposed to respect officers now, after their own Commissioner throws them under the bus?" Creasser said.
From a legal perspective Sebastien Anderson, a labour lawyer who is representing MPPAC membership in various cases, wonders why Paulson hasn't already dealt with racist members if he knows they exist. "If he believes that to be the case or had that belief for some time, the means to deal with it lay at his fingertips," Anderson said. "He has an extensive supervisory structure underneath him to deal with it. My question is: why hasn't he dealt with it before now?"
Police associations across Canada have a long history of working with governments to make sure officers have the training to deal with Canada's uniquely diverse communities. Officers who display racist behaviour on or off duty could be disciplined under the RCMP code of conduct that deals with treating people with respect and not bringing discredit to the force.
MPPAC President Banwarie, who is a visible minority originally from Trinidad and Tobago has suffered and experienced racism first-hand. He is now leading this movement for all RCMP officers to organize and have their rights respected not only as a citizen but as an employee. "MPPAC's drive toward certification is nothing for the Commissioner and management to be afraid of. It is about working together to make the lives of officers safer so that they can provide the level of public safety expected by all Canadians." Banwarie stated.
Coincidently, Commissioner Paulson's comments came just a few days after the Federal government's historic first steps in introducing The Royal Canadian Mounted Police Labour Relations bill, which gives officers the right to unionize. Of the 227 police agencies in Canada, 226 already have collective bargaining rights – the only exception has been the RCMP. The introduction of this bill will come after decades of court challenges culminating with the Supreme Court of Canada's decision earlier this year which found the current RCMP Labour relations program to be unconstitutional.
"We're happy to see the Liberal Government, wants to improve the lives of RCMP officers. We look forward to working with the Liberal Government under Prime Minister Trudeau and seeing the final bill. We hope this legislation will enshrine RCMP member's constitutional rights, the same rights enjoyed by every Canadian," Banwarie said.
The legislation will be introduced no later than the end of Feb. 2016.

"Officials had previously suggested there was a chance a "possible
resolution" could be reached between the national police force and the
Crown.
The RCMP had been scheduled to enter pleas on the charges on April 7,
but Crown prosecutor Paul Adams told the court then that ongoing
discussions were taking place between the parties to work on a
possible resolution and more time was needed.
Adams didn't elaborate on what he meant by "possible resolution."

Outside the court on Thursday, Adams declined to discuss the matter.

Defence lawyer Ian Carter, who represented the RCMP in court on April
7, had said they were working at "narrowing the issues."
Mark Ertle, who appeared on behalf of the RCMP during Thursday's
proceedings, had little to say to reporters.
"The matter is going to trial and the RCMP is going to contest the
allegations," he said.
Asked to respond to McKee's allegations of it being a stalling tactic,
Ertle said, "Even if it was, I wouldn't be able to comment.
"The matter is before the courts now, a not guilty plea has been
entered, and that means the matter is proceeding to trial and we've
set a date for trial."

126. (1) Every one who, without lawful excuse, contravenes an Act of
Parliament by wilfully doing anything that it forbids or by wilfully
omitting to do anything that it requires to be done is, unless a
punishment is expressly provided by law, guilty of an indictable
offence and liable to imprisonment for a term not exceeding two years.
2) Any proceedings in respect of a contravention of or conspiracy to
contravene an Act mentioned in subsection (1), other than this Act,
may be instituted at the instance of the Government of Canada and
conducted by or on behalf of that Government.

"The lawsuit was filed in fall 2012 by the group that claims the New
Veterans Charter is unconstitutional and violates the Charter of
Rights and Freedoms. It was approved by a unanimous vote of Parliament
in 2006 and amended in 2011 as a result of public outcry.
Current and former Canadian Forces members are appalled that the
lifetime disability pension for disabled soldiers has been replaced by
lump-sum payments.
Inside court, government lawyer Paul Vickery told a three-judge panel
the appeal was necessary because the soldiers’ claims could negatively
impact fundamental democratic principles.
He told court that while the government readily acknowledges the great
value and sacrifice of the soldiers, Parliament is the “only
appropriate forum” for resolving the claims made in the lawsuit.
“The appeal which the attorney general brings before you is not
brought out of any lack of appreciation of those services,” Vickery
said.
A second federal lawyer then attacked the plaintiffs’ main argument
that they deserve benefits in line with the previous regime, the
Pension Act, based on historical promises. He did not dispute that the
new scheme is “less generous.”

As your attachment sent today refers from Premier Graham, our position
is clear on your dead calf issue: Our forensic labs do not process
testing on animals in cases such as yours, they are referred to the
Atlantic Veterinary College in Charlottetown who can provide these
services. If you do not choose to utilize their expertise in this
instance, then that is your decision and nothing more can be done.
As for your other concerns regarding the US Government, false
imprisonment and Federal Court Dates in the US, etc... it is clear
that Federal authorities are aware of your concerns both in Canada and
the US. These issues do not fall into the purvue of Detachment
policing in Petitcodiac, NB.
It was indeed an interesting and informative conversation we had on
December 23rd, and I wish you well in all of your future endeavors.
