Methink they will still build the houses while the middle men Trump is
taking care of will make more money because of their markups on a higher
priced commodity.
For instance a 10% markup on a ten dollar stick is 25% more than a 15% markup on the same stick that was worth 5 bucks awhile back. Yet the middle man can cry hard times and claim that he had to cut his profit margin by 30% as he laughs all the way to the bank and sends a political donation to the GOP in order to claim a tax deduction against his increased wealth.

1. The Plaintiff/Respondent is grateful for the July 7, 2017
directions of the court permitting his June 26, 2017 submission to be
filed thereby allowing this response to be filed in a timely fashion
pursuant to the June 8, 2017 direction. After filing his brief the
Plaintiff/Respondent became aware that two more lawyers whom he has a
conflict of interest with were appointed to sit on the bench of
Federal Court on the very same day he had been ordered to file his
brief. They are William F. Pentney the very lawyer who has received
all of the filings in this matter until today. The other is John B.
Laskin, a lawyer whom the Plaintiff/Respondent has contacted and
spoken to personally in the past about several different matters. The
Plaintiff/Respondent must update the list of Judges he truly believes
that he has a conflict of interest with.
The list is as follows:
Justices William Pentney, John Laskin, Richard Bell, René LeBlanc,
Henry Brown Catherine Kane, Richard Southcott, Glennys McVeigh, Alan
Diner, Denis Gascon, Martine St-Louis, Cecily Strickland, Sylvie
Roussel, Anne Marie McDonald, George Locke, Simon Fothergill, Keith
Boswell, Yvan Roy, Yves de Montigny, Russel Zinn, Donald Rennie, André
Scott, Richard Boivin, Patrick Gleeson, Mary Gleason, David Near,
Wyman Webb, and David Stratas
2. The Crown counsel, Jan Jensen acting on behalf of Her Majesty the
Queen, the Defendant/Appellant (CROWN) is well aware that the
Plaintiff/Respondent's name is David Raymond Amos (AMOS). He is proud
to the namesake of RAYMOND his Uncle who was killed defending the
CROWN on June 8th, 1944 in Normandy.
3. On AMOS considers the CROWN's argument with his brief as a
fruitless attempt to negate his concerns about a conflict of interest
he has with judges who were in private practice and all the others who
were employed in government service before being appointed to the
Federal Court and the Federal Court of Appeal. Justice David Near
should recall that the AMOS addressed his concerns about a conflict
with him twice during the course of the hearing on May 24, 2017 and
Justice Near did not respond. What the CROWN claims within its
submission is not true.
4. On May 24th, 2017, AMOS during the hearing reminded the Justices at least
twice of rules 5 (4) and 5.1(4) of the Federal Courts Act and did his
best to inform
the judges of a case management teleconference of Federal Court on
April 3, 2017
and strongly suggested that they confer with Justice Leblanc before making any
decision in this matter. The following information was copied from the

April 10, 2017 in Fredericton, New Brunswick, seeking an order
"affirming or denying the conflict of interest he has" with a number
of judges of the Federal Court, is premature and, therefore, adjourned
sine die as the issue of whether the Plaintiff's Statement of Claim
discloses a reasonable cause of action is currently before the Federal
Court of Appeal and could result in the dismissal of Plaintiff's
action. To the extent that the Plaintiff's motion seeks an order
"affirming or denying the conflict of interest he has" with a number
of judges of the Federal Court of Appeal, the said motion is beyond
the jurisdiction of the Federal Court and will not be entertained."

4. Whereas the CROWN with its submission has provided as an authority
a copy of
Committee for Justice and Liberty et al v National Energy Board et al,
[1978] 1 SCR
369, 1976 Can LII2 (SCC), AMOS continues to rely on the decision of
Justice Bell
to support his Appeal of Justice Southcott's actions and every other
judge he has met in court since January 11th, 2016. The portion of
the December 14, 2015 decision of Justice' Bell that should be
considered by all the judges that the Plaintiff/Respondent named
within the first statement of this submission is as follows:
"In the circumstances, given the threat in 2004 to sue me in my
personal capacity and my past and present relationship with many
potential witnesses and/or potential parties to the litigation, I am
of the view there would be a reasonable apprehension of bias should I
hear this motion. See Justice de Grandpré’s dissenting judgment in
Committee for Justice and Liberty et al v National Energy Board et al,
[1978] 1 SCR 369 at p 394 for the applicable test regarding
allegations of bias. In the circumstances, although neither party has
requested I recuse myself, I consider it appropriate that I do so. "
7. The Plaintiff/Respondent pleads that the Federal Court of Appeal
deny the latest
attempt of the CROWN to have this matter dismissed and to revoke its decision
dismissing his appeal of Justice Southcott's actions.
8. AMOS states that this matter is not frivolous or vexatious and that
he has every
right to see his complaint against the CROWN to go forward to trial to
be judged
on its merits and heard by Justices who do not have a conflict of
interest with him.

all the fuss, ah right! the upcoming election, let’s try to revive a
dead horse to win the election. Bottom line since the ATCON fiasco of
2009 there has been one change of government who as well as the former
government didn’t take any action, then back to the current
government. Nothing has changed the money is still gone. The only
winners are the banks who were able to recoup 80%+, New Brunswick was
only able to get back a miserly pittance of 4%.
The ATCON story is not new, it is a common practice of Corporations to
extort money from the government by using the threat loss of jobs, or
the promise of job creation or both, but in the end, they never
deliver.
Like others, Atcon understood the province desperation to keep and
create new Jobs. They looked at the economically depressed Miramachi
and promised that if the government would provide them with the money
they would create new jobs and save the existing jobs. The old
“Streets are paved in gold” sales pitch. In reality what they actually
mean is “Streets paved in charcoal”.
The government of the day took the chance, even though, in the past,
these corporations never followed through with job creation and in
some cases actually closed their operation after getting the money,
but the government took the gamble and lost (again)
Had ATCON been successful, the payoff politically for the government
would have been great, but like rest of the Corporate extortionist
ATCON took the money and ran. The consequence was the liberal
government was replaced with the conservative government, but that
still didn’t change the outcome, the money is gone end of story.
In a report presented by Canada’s conservative think tank the Frazer
institute the reported that Over a period of nearly 20-years, federal,
provincial and local authorities together spent almost $684-billion on
subsidies, mainly to private corporations — and the impact on
consumers was marginal at best. When you calculate in the tax
loopholes and breaks that figure is tremendously higher than stated.

'Unfair, unwarranted and deeply troubling': U.S. sets final import duties on Canadian softwood lumber

CBC News Posted: Nov 02, 2017 12:12 PM ETThe U.S. Commerce Department on Thursday announced it will impose finalized softwood lumber import duties on several Canadian firms.
The U.S. government said Canadian producers were selling into the U.S. market at less than fair value, and said Canada was providing "unfair subsidies" to domestic producers.
"While I am disappointed that a negotiated agreement could not be made between domestic and Canadian softwood producers, the United States is committed to free, fair and reciprocal trade with Canada," said Commerce Secretary Wilbur Ross in a statement.
"This decision is based on a full and unbiased review of the facts in an open and transparent process that defends American workers and businesses from unfair trade practices," Ross said.
In a joint statement, Canadian Minister of Foreign Affairs Chrystia Freeland and Minister of Natural Resources Jim Carr called the U.S. decision against Canada's softwood lumber producers "unfair, unwarranted and deeply troubling."
"We will forcefully defend Canada's softwood lumber industry, including through litigation, and we expect to prevail as we have in the past," Freeland and Carr said. "We are reviewing our options, including legal action through the North American Free Trade Agreement and the World Trade Organization, and we will not delay in taking action."
Prime Minister Justin Trudeau was asked if the softwood decision would affect the ongoing NAFTA negotiations
"We have kept the decisions and the discussions around softwood separate from discussions on NAFTA, but obviously every different aspect of our deep and broad relationship with the United States comes into the conversation that we have regularly," he responded.
Finalized figures
The U.S. government says that exporters from Canada have sold softwood lumber in the U.S. market at 3.20 per cent to 8.89 per cent less than fair value. The Commerce Department also said Canada is providing unfair subsidies to its producers of softwood lumber at rates from 3.34 per cent to 18.19 per cent.
According to the Commerce Department, duties on Canfor and Tolko will be just over 22 per cent, while Resolute will see duties totalling just under 18 per cent. West Fraser will see duties of more than 23 per cent. All other producers will see duties of just under 21 per cent.
Most of the Canadian producers actually saw their duties reduced from a preliminary ruling by the U.S. earlier this year. Resolute Forest Products and J.D. Irving will pay slightly higher duties.
"While the rates are lower, the fact that any duties remain in place is disappointing," said Susan Yurkovich, president of the BC Lumber Trade Council. "As we have consistently said, these duties are unwarranted and this trade action is completely without merit."
Speaking to reporters in Victoria, B.C. Premier John Horgan said, "We will prevail."
Company disappointed
Resolute spokesperson Seth Kursman said the company was also disappointed with the ruling.
"We remain confident that Quebec and Ontario should have nothing less than free unencumbered access to the U.S. market place," he said in a statement to CBC News.
Kursman added: "It's important to keep in mind that the only people who benefit from this are large timber barons in the U.S. It's important to keep in mind that the U.S. can't supply all of its domestic softwood demand. So 30-35 per cent historically has come from Canada."
'Only adds to the burden'
Granger MacDonald, chairman of the National Association of Home Builders in the United States, railed against the decision, saying it could not have come at a worse time.
"Home builders and homeowners are already dealing with the monumental rebuilding efforts in the aftermath of the devastating hurricane season and California wildfires," MacDonald said. "This tariff only adds to the burden by harming housing affordability and artificially boosting the price of lumber."
MacDonald said about one-third of the lumber used in the U.S. last year was imported, with 95 per cent of those imports coming from Canada.
The U.S. Commerce Department said imports of softwood lumber from Canada in 2016 were valued at an estimated $5.66 billion US.
Jason Brochu, co-chair of the U.S. Lumber Coalition, which represents U.S. producers, applauded the decision.
"The massive subsidies the Canadian government provides to their lumber industries have caused real harm to U.S. producers and their workers," he said in a statement.
The Commerce Department's determination must still be approved by the U.S. International Trade Commission, which is scheduled to make its final determinations by Dec. 18, 2017.
If the ITC agrees with Thursday's decision, the Commerce Department will issue orders to collect the duties. If the ITC finds that U.S. producers were not injured by Canadian softwood imports, the Commerce Department's case will be terminated.
