Cash-strapped PCs selling party headquarters in Fredericton

The Regent Street building could be all yours for just $479,000

Inside the Fredericton head office of the Progressive Conservative Party of New Brunswick, there's a countdown clock on the wall tracking the days, hours, minutes and seconds that remain until the next provincial election.

It symbolizes Tory anticipation of the precise moment — Sept. 24 of this year — when the party has a chance to oust Premier Brian Gallant's Liberal party from power.

But the clock's also ticking for the PC party itself, which is facing a cash crunch ahead of this year's campaign.


Indeed, the very office where the clock is located, at 336 Regent St., a few blocks from the New Brunswick legislature, is up for sale.

The party is looking to unload the property as it gears up for an election campaign in which it will be allowed to spend up to $1.1 million, money the party doesn't have at the moment.

Tory documents filed with Elections New Brunswick show the party had just $20,260 in cash on hand as of June 30, 2017.

That compares to the $2,018,278 that the governing Liberals had at the same time, almost 100 times more than the PCs.

Liberal filings also indicate their party had no debt.

The PCs, meanwhile, owed $346,626 midway through 2017, including $233,060 from a 2013 loan that relied on the Regent Street office as collateral.

It's not clear if the party is selling the building to pay down its debts or to secure cash to fund its election campaign. Party officials did not respond Thursday for requests for an explanation.

The Tories acquired the property in 2008.

'Charming features'


The real estate agent is Richard Bragdon with Exit Realty in Fredericton. Bragdon was also the unsuccessful federal Conservative candidate in Tobique-Mactaquac in the 2015 election. Bragdon did not respond to an interview request Thursday.

The listing describes the two-storey structure as a "beautiful heritage home/office space" that could be used as offices or converted into two apartments.

The building has many "charming features," the ad says, adding, "These properties don't come along very often."

The PC party is asking $479,000 for the property, which would clear the party's debts and leave about $133,000 in profit.

The Liberals own a building at 715 Brunswick St., a converted house that it uses as its party headquarters. The party carries no debt or mortgage on the property.

PCs can't keep pace


The Progressive Conservatives, which form the official opposition in the legislature, have not been keeping pace with the governing Liberals in their fundraising.

In 2016, the same year PC members were writing cheques for candidates running for the party leadership race, the party itself raised $467,718. The Liberals raised $868,426.

In the first half of 2017, the last period for which records have been filed, the Liberals raised $659,485, more than double the PC haul of $297,655.

The Liberals have already been using their money advantage: last fall they launched a series of ads attacking PC leader Blaine Higgs. Registered political parties can spend $200,000 per year on advertising outside election periods.

Corporate Donations


One potentially lucrative source of funds, corporate donations, is now off-limits to the Tories, thanks to a legislative manoeuvre last year by Higgs.

The Liberal government introduced legislation in March 2017 to reduce the maximum donation to political parties from $6,000 to $3,000, a cap that would have applied to individuals, corporations and unions.

During debate on March 30, just six days after the PC party held its big annual fundraiser, Higgs moved an amendment to the Liberal bill to ban corporate and union donations altogether.

The Liberals decided to support the amendment, tweaking it to take effect June 1, 2017 — one day after their own $500-per-plate fundraising dinner.

The PCs reported $147,732 in corporate donations in the first half of 2017, while the Liberals reported just $17,026.

At the time the Liberals decided to vote for the PC amendment, Green Party leader David Coon suggested Higgs hadn't been expecting it to pass.

"It kind of felt like an accident, but I'm still trying to process what happened, and I think the Official Opposition may be in the same position," he said.

Elections New Brunswick estimates that, based on its formula, parties that run candidates in all 49 ridings this year will have a maximum spending limit of $1,124,582 this year

Everyone knows that New Brunswick Provincial Politicians never bite the hand that feeds them but they kiss the Ring that leads them. Martine Ouellet was crowned the new leader of the Bloc Quebecois at a
rally in Montreal on Saturday, after running unopposed.

Her only rival, Felix Pinel, had to withdraw from the race last week
after failing to attract the necessary number of signatures on his
nomination papers to run.

The new Bloc leader wasted no time in attacking Prime Minister Justin
Trudeau, who she called a friend of the oil industry. She also called
the proposed Energy East pipeline a threat to Quebec’s fresh water
supply.

The ex-Parti Quebecois MNA, now an independent, plans to keep her seat

October 2018. She will run for the Bloc in the next federal election,

The Bloc’s caucus chair, Louis Plamondon, said that he is happy that a
woman will lead the Bloc for the first time. He thinks she will have
ample time to restructure the party and to tour Quebec to get her name
out to voters.

Plamondon sees no problems with Oullet’s decision to remain in the
provincial legislature, as it falls within the ethics code.

But not everyone is so relaxed about Ouellet’s dual roles. Quebec
premier Philippe Couillard said he objects to her keeping her
provincial seat because it means that funds meant to support members
of the provincial assembly will instead be going towards federal
political activities.

The Bloc Quebecois currently has 10 seats in the House of Commons.

Laval in 1979 and was called to the Barreau du Québec in 1980. He
worked in private practice with the law firm of Lazarovitch, Cannon,
Lemelin & Rourke in Québec City before joining the Legal Services Unit
of the Secretary of State of Canada in 1982. In 1986, he joined the
Department of Justice Canada as a litigator and was appointed Senior
General Counsel in 2006. In that capacity he appeared before all
levels of court.
During his time with the Department of Justice he was designated as
one of a small group of lawyers to represent the Attorney General of
Canada before the Supreme Court of Canada. He was also a member of the
national committee responsible for reviewing all aspects of litigation
before the Supreme Court of Canada involving the government of Canada.
His main area of practice was civil litigation and constitutional law.

Justice LeBlanc has been a frequent conference speaker to his
colleagues at the Department of Justice and has served as a part-time
professor at the University of Ottawa, Faculty of Civil Law. He is
also co-author of a book on the recourses and procedure before the
Federal Courts (Letarte, Veilleux, LeBlanc et Rouillard-Labbé, Recours
et procédure devant les Cours fédérales, Montréal, LexisNexis Canada
Inc., 2013). This book was published in 2013 and is the only
publication in the French language dealing with that subject matter.

NOTICE MOTION FOR AN ORAL HEARING


TAKE NOTICE THAT the Plaintiff, David Raymond Amos pursuant to Rule
359 of the Federal Court Rules will make a motion to the Court on
Monday, April 10th, 2017 at 9:30 am as soon thereafter as the motion
can be heard at the Federal Court in Fredericton, New Brunswick.

THE MOTION IS FOR:

1.      The Plaintiff seeks an order made by a Justice of Federal Court
whom he knows does not have an interest in the outcome of this lawsuit
affirming or denying the conflict of interest he has with the Justices
 Richard Southcott, Catherine Kane, René LeBlanc, Glennys McVeigh,
Alan Diner, Yvan Roy, Martine St-Louis, Henry Brown, Cecily
Strickland, Denis Gascon, George Locke, Keith Boswell, Sylvie Roussel,
Simon Fothergill, Anne Marie McDonald, Yves de Montigny, Wyman Webb,
Donald Rennie, André  Scott, Richard Boivin, David Near and David
Stratas. This order is sought before any hearing of a cross-appeal of
this matter is held within the Federal Court of Appeal

THE GROUNDS FOR THE MOTION ARE:

2.      The aforementioned judges were named by the plaintiff on lists he
provided to the Registry Offices of the Federal Court and the Federal
Court of Appeal, the Canadian Judicial Council and the Commissioner of
Federal Judicial Affairs after Justice B. Richard Bell on December
14th, 2015 made an oral order to recuse himself from hearing this
matter. It is the Plaintiff's opinion that all judges must be held to
the same standard that Justice Bell filed on December 23rd, 2015.

        "At the outset of the hearing, the Plaintiff brought to my attention
a letter dated September 10, 2004, which he sent to me, in my then
capacity as Past President of the New Brunswick Branch of the Canadian
Bar Association, and the then President of the Branch, Kathleen Quigg,
(now a Justice of the New Brunswick Court of Appeal)."

        And

        "In the circumstances, given the threat in 2004 to sue me in my
personal capacity and my past and present relationship with many
potential witnesses and/or potential parties to the litigation, I am
of the view there would be a reasonable apprehension of bias should I
hear this motion. See Justice de Grandpré’s dissenting judgment in
Committee for Justice and Liberty et al v National Energy Board et al,
[1978] 1 SCR 369 at p 394 for the applicable test regarding
allegations of bias. In the circumstances, although neither party has
requested I recuse myself, I consider it appropriate that I do so."

THE FOLLOWING DOCUMENTRY EVIDENCE will be used at the hearing of the
Plaintiff's Motion

1.      True copies of numerous documents that the various solicitors and
agents of the CROWN and the associates of various law firms of the
aforementioned Justices of the Federal Court and the Federal Court of

OVERVIEW

1.      On December 14, 2015.  the Plaintiff/Appellant/Respondent on
Cross-Appeal, David Raymond Amos (AMOS) began his study all the
Justices on the bench in Federal Court and the Federal Court of Appeal
after a hearing of an appeal of this matter before Justice B. Richard
Bell. The judge acted ethically after discussing the issues he read
within the motions and evidence filed by AMOS and counsels to Her
Majesty the Queen (CROWN).  Justice Bell named many parties whom he,
the CROWN and AMOS were familiar with then delivered an oral order for
another hearing of the appeal and recused himself referring to the
applicable test regarding allegations of bias based on Justice de
Grandpré’s dissenting judgment in Committee for Justice and Liberty et
al v National Energy Board et al, [1978] 1 SCR 369 at p 394 for.

2.      AMOS, provided the Registry Office of the Federal Court with a
list of judges with whom he had a conflict of interest over two weeks
before the upcoming hearing on January 11, 2016. The list of Justices
in Federal Court is as follows: Justices Richard F. Southcott, Sylvie
E. Roussel, Catherine M. Kane, Yvan Roy, Cecily Y. Strickland, Glennys
L. McVeigh, George R. Locke, Martine St-Louis, René LeBlanc, Henry S.
Brown, Alan Diner, Keith M. Boswell, Denis Gascon, Simon Fothergill,
Anne Marie McDonald and B. Richard Bell.

3.      On January 11, 2016, AMOS stood before Justice Richard F.
Southcott and did his best to explain why the judge should recuse
himself. Justice Southcott did not agree and stated he would only hear
arguments with regard to the faulty motions made by the CROWN (The
motion to strike named the wrong defendant and the opposition to the
appeal was unsigned and served very late). The judge refused to look
at the plaintiff's motion in opposition to the defendant's motion to
strike or the evidence supporting the appeal of the prothonotary's
decision that Justice Bell had discussed with AMOS and the CROWN one
month earlier. AMOS objected to Justice Southcott's actions and
informed him that whatever he decided would be appealed forthwith.
Justice Southcott reserved his decision.

4.      On February 4, 2016, AMOS filed this appeal of Justice
Southcott's order. In a sincere effort to offset what had occurred
Federal Court with regards to conflicts of interest, the Registry
Office of the Federal Court of Appeal was provided with the list of
Justices of this court whom the plaintiff had issues with before he
filed any documents into the record of this matter. The list of
Justices is as follows: Justices David W. Stratas, Yves de Montigny,
Richard Boivin, André F.J. Scott,  Donald J. Rennie, Wyman W. Webb,
David G. Near and C. Michael Ryer (Who resigned effective May 1, 2016)

5.      On February 12, 2016, this cross appeal was filed by Her
Majesty the Queen thereby making the plaintiff, David Raymond Amos the
respondent. Solicitors of the CROWN continued in their incompetent and
unethical defence by claiming that the Federal Court erred in its
decisions because it did not have jurisdiction to hear the matter.

6.      On January 30, 2017, the CROWN faxed 4 pages of a memorandum
of fact and law of the respondent byway. Whereas AMOS knew he was the
respondent on cross- appeal, he suspected the CROWN had discovered its
error and stopped the fax transmission in order to correct it. On
February 2, 2017, the CROWN sent a fax stating that it had notified
the court of its error and sought directions from the court. The
plaintiff heard nothing further from the court about the mistake made
by the CROWN. Later he received hard copy of a memorandum of fact and
law of the respondent byway of regular Canada Post. The Registry
Office instructed the plaintiff to file a memorandum of fact and law
of the respondent by March 6, 2016 and leave it for the judges of this
court to decide the matter.

7.      The CROWN has filed another faulty document with an incomplete
statement of facts and wishes to argue a recent decision made on
August 31, 2016 by a coram of judges in which a correction was made on
February 23, 2017.

8.      The actions of the CROWN in matter caused it to be subject to
more claims.
PART I – STATEMENT OF FACTS

9.      On September 16, 2015, the Plaintiff filed a statement of
claim (The Claim) against Her Majesty the Queen. The plaintiff when to
great length to explain to the court why his rights under the Canadian
Charter of Rights and Freedoms Sections 2 (s) and (d) had been
breached and why the Federal Court was the only court to have the
jurisdiction to hear this matter.

10.  On October 16, 2015, the plaintiff received a copy of a notice of
a motion that the CROWN filed with a heading falsely stating that the
Claim was against the Attorney General of Canada. The CROWN asked the
court to strike the Claim in its entirety pursuant to Rule 221 (1),
(a) and (c) and to award the defendant the costs of creating its
incompetent motion.

11.  On October 26, 2015, AMOS filed a motion in opposition to the
motion to strike. The plaintiff did not recognize the standing of a
Prothonotary to dismiss a claim seeking eleven million dollars in the
form of relief. The plaintiff sought an oral argument before a Justice
of Federal Court and asked for costs in the creation of his motion in
response.

12.  On November 12, 2015, the Registry Office in Montreal faxed a
redacted copy of the Order of the Prothonotary, Richard Morneau. The
Registry Office of Federal Court  in Montreal would not respond to the
plaintiff's queries as to what was written on the third page of the
court order.

13.   On November 19, 2015, the Registry Office in Ottawa faxed a true
copy of the order of the Prothonotary, Richard Morneau after the
plaintiff had contacted and complained to the Attorney General of
Canada, Federal Court's legal counsel and the Office of Commissioner
of Judicial Affairs amongst others. Once the plaintiff read the third
page of the order he understood why it had been redacted. It stated
"No costs are awarded to the defendant since none were requested by
same". It was obvious that the Registry Office in Montreal acted
fraudulently because the prothonotary had not studied any of the
documents in the record at all.

14.  On November 20, 2015, the plaintiff filed a notice of motion for
hearing on December 14, 2015 in order to appeal the decision to the
prothonotary.

15.  On December 8, 2015, the plaintiff filed a motion record of the
appeal with a supporting affidavit and exhibits. One exhibit was a
true copy of an American police surveillance wiretap tape which is one
of many he has in his possession that all law enforcement authorities
in Canada and the USA he has encountered have refuse to investigate.

16.  On December 14, 2014, Justice B. Richard Bell discussed with the
plaintiff some of the documents on file in the record and their common
concerns then ethically recused himself on his own motion. Another
hearing of the motion to appeal was scheduled for January 11, 2016.

17.  On or about December 22, 2015, the plaintiff provided the
Registry Office a list of all the judges seated in on the bench in
Federal Court that had a conflict of interest with the him in order to
prevent another hearing as had occurred with Justice Bell.

18.  On January 11, 2016, AMOS stood before Justice Richard F.
Southcott and did his best to explain why the judge should recuse
himself. Justice Southcott did not agree and stated he would only hear
arguments with regard to the faulty motions made by the CROWN (The
motion to strike named the wrong defendant and the opposition to the
appeal was unsigned and served very late). The judge refused to look
at the plaintiff's motion in opposition to the defendant's motion to
strike or the evidence supporting the appeal of the prothonotary's
decision that Justice Bell had discussed with AMOS and the CROWN one
month earlier. AMOS objected to Justice Southcott's actions and

19.   On February 4, 2016, the plaintiff filed an appeal of Justice
Southcott's order and the Registry Office of the Federal Court of
Appeal was provided with the list of Justices of this court who have a
conflict of interest with him.

20.  On February 12, 2016, this cross appeal was filed by Her Majesty
the Queen thereby making the plaintiff, David Raymond Amos the
respondent in this memorandum of fact and law.

21.  Solicitors of the CROWN continued in their incompetent and
unethical defence of their client in the Federal Court of Appeal. They
began by by refusing to discuss the contents of the appeal book until
it was too late to do so then faxing a document containing their
demands and quoting the rules of the court.

22.  In April of 2016 after attempting to resolve his longstanding
concerns with the Commissioner of the Royal Canadian Mounted Police,
the Commissioner of Federal Judicial Affairs, the Canadian Judicial
Council, the Commissioner of  Revenue Canada, the Attorney Generals of
the United States and Canada, the plaintiff became aware a of a
webpage hosted by a server based in Sweden about this very lawsuit.
The malicious webpage within the egregious website entitled known as
Encyclopedia Dramatica was supported by a new round of blogs and
YouTube channels based in the USA. In an effort to put a stop to the
malice and bring this matter to a conclusion. The plaintiff requested
an oral hearing of this matter in confidence to this court's judicial
administrator pursuant to Rule 35.

23.  The plaintiff heard nothing back from the Judicial Administrator
of the Federal Court of Appeal. However the confidential letter and
the draft of the motion the judicial administrator had requested was
placed the public record and a copy was sent to the CROWN.

24.  On May 5, 2016 the CROWN docketed a letter addressed to an
unnamed party within the Federal Court of Appeal insulting the
plaintiff and ridiculing his confidential letter to the Judicial
Administrator. The plaintiff heard nothing further from the court on
the topic so he filed a motion seeking case management and directions
from the court about the creation of the appeal book.

25.  On May12, 2016, Justice Trudel made an order denying an oral
hearing and case management and providing directions on the appeal
book.

26.  On June 10, 2016, the plaintiff followed the order of Justice
Trudel and filed a motion about in the creation of the appeal book.

27.  On June 20, 2016, the CROWN responded changing its demands about
the creation of transcripts and opposed the filing of important
documents supporting the plaintiff's claim being recorded within the
appeal book.

28.  On July 4, 2016, Justice David Stratas made the order pertaining
to the creation of the appeal book instead of Justice Trudel. The
plaintiff went forward and created the appeal book so that he would
not be in default. However he could not ethically follow any orders of
judges that he and the court knew he had a conflict of interest with.
Some lawyers working for the Federal government and certain private
lawyers are well aware that the plaintiff has no respect for Justice
Stratas whatsoever. The lack of respect is caused by Justice Stratas'
former partnership with the Heenan Blaikie law firm and his
appointment as a Special Advocate by the Harper government. The
plaintiff diligently attempted to tried resolve his concerns about
Justice Stratas in confidence with the Attorney General of Canada and
the Canadian Judicial Council and was ignored.

29.  On Oct 17, 2016, Justice Pelletier issued an order for a status
review and the plaintiff responded on November 21,2016 which was one
day later due to human error.  The Registry Office did not record the
response in the docket and would not permit the plaintiff to file the
motion that Justice Trudel had stated he could file until further
notice from the court.

30.  On November 30, 2016, CROWN also responded to the status review
stating things that were definitely not true while admitting its
knowledge of police surveillance wiretap tapes and many other things
yet still considered the Claim to be frivolous and vexatious.

31.  On December 19, 2016, three Justices that the Federal Court of
Appeal is well aware that the plaintiff has a conflict of interest
with dismissed the appeal in writing without having to meet him in a
public hearing and deny the conflict.

PART II – ISSUES

32.  The plaintiff considers that the CROWN is being frivolous and
vexatious to claim that the Federal Court does not have jurisdiction
over legislative affairs in the Province of New Brunswick in light of
the fact that New Brunswick has no Constitution whatsoever.
Irrefutable proof is the Constitution Amendment, 1993 (New
Brunswick).The Governor General and Commander-in-Chief was advised by
the Queen's Privy Council to issue a proclamation in order to amend
the Constitution of Canada that was recorded by the Registrar General
of Canada. Therefore the plaintiff has every right to defend his
rights and freedoms under the Constitution Act, 1982 in New Brunswick.
Furthermore the plaintiff has stated several times though out the
documents found in the record of this matter that he has been barred
from access to the House of Commons, the National Capital District,
all provincial legislative properties, the University of New Brunswick
and the Town of Woodstock New Brunswick apparently for the benefit of
his political opponents and their many cohorts.

33.  The Governor General, the Attorney General of Canada, many
parliamentarians, the Commissioner and many members of the Royal
Canadian Mounted Police, many members of the Canadian Forces, the
Canadian Judicial Council, the the Commissioner of Federal Judicial
Affairs, Commissioner of Public Sector Integrity,  the Commissioner of
Revenue Canada, many solicitors acting on behalf of the CROWN at a
Federal and provincial level throughout Canada have continued to
refuse to act within the scope of their employment in dealing with the
plaintiff since he first ran for a seat in the 38th Parliament in
2004.

34.  The Governor General of admitted in writing that she had two sets
of documents and a CD of the plaintiff's (one set was forwarded from
the Lieutenant Governor of New Brunswick) involving public corruption.
All public servants are relying on the actions of the Attorney General
of Canada and the judges of this court to make the plaintiff's
concerns appear to be frivolous, vexatious and without any merit
whatsoever. However not one lawyer is willing to argue the plaintiff.

35.  The plaint must remind the court that since the Claim was filed,
four lawyers three parliamentarians and one former parliamentarian
have responded to the plaintiff in writing. They are Minister of
Heritage Melanie Joly, David McQunity MP, Geoff Regan the Speaker of
the House of Commons and Peter Milliken the former Speaker of the
House of Commons when the plaintiff was barred from that public
property in 2006. The plaintiff has filed their communications to him
in the public record of this matter and the evidence of it has been
ignored.

PART III – SUBMISSIONS

36.  Whereas the CROWN now wishes to argue a recent decision involving
the actions of a prothonotary, the plaintiff to relies on the Rules of
Federal Court Section 50 in particular. It states as follows:

50 (1) A prothonotary may hear, and make any necessary orders relating
to, any motion under these Rules other than a motion

(a) in respect of which these Rules or an Act of Parliament has
expressly conferred jurisdiction on a judge;

(b) in the Federal Court of Appeal;

(c) for summary judgment or summary trial other than

(i) in an action referred to in subsection (2), or

 (2) A prothonotary may hear an action exclusively for monetary
relief, or an action in rem claiming monetary relief, in which no
amount claimed by a

51 (1) An order of a prothonotary may be appealed by a motion to a
judge of the Federal Court.

 (2) Notice of the motion shall be served and filed within 10 days
after the day on which the order under appeal was made and at least
four days before the day fixed for the hearing of the motion.


PART IV – ORDER SOUGHT

The plaintiff therefore asks this court for the following relief:

(a)    A public apology by the Prime Minister and each Premier for the
illegal barring of a citizen from access to parliamentary properties.

(b)   A declaration signed by the Minister of Public Safety and
witnessed by the Governor General stating that the Canadian government
will no longer allow the RCMP and the Canadian Forces to harass the
Plaintiff and his Clan.

(c)    A settlement of eleven million dollars ($11,000,000.00) in the
form of relief and punitive damages for being barred from eleven
parliamentary properties for eleven years.

(d)   Costs to the Plaintiff in bringing this matter before the court

Federal interim Conservative Leader Rona Ambrose was preaching Tory togetherness during a visit to New Brunswick, but the close embrace may put her provincial PC allies in an awkward position.

Ambrose's Friday schedule included a $75-per-person fundraising dinner in Woodstock for the federal party's Tobique-Mactaquac riding association.

Several provincial Progressive Conservative MLAs, including interim leader Bruce Fitch attended the event, even though it's the same kind of fundraiser for which they've been criticizing Premier Brian Gallant.

On Friday afternoon in Fredericton, Ambrose mistakenly said the fundraiser was "a combined event to support both the provincial and the federal party."


Fitch's office quickly corrected that, telling CBC News it was a fundraiser for the federal party only.
But the invitation for the event didn't make that distinction. It featured both the federal and provincial party logos, and photos of both Ambrose and Fitch.

Fundraising event

Fitch's office said the fundraising event in Woodstock was for the federal party.

"Basically it's to show co-operation," Ambrose said Friday afternoon.

"One of the things that I have tried to do is bring the federal party closer to our provincial counterparts. … Bruce Fitch and I are going to have a dinner together and show collaboration."
Fitch's PC opposition at the legislature has relentlessly criticized Gallant for attending fundraisers for the New Brunswick Liberals in Calgary and Vancouver.

Both Liberal fundraisers took place while Gallant was travelling on taxpayer-funded government business.

Gallant has defended gathering party donations on the side, saying "It's a normal thing for any political party to do fundraisers across the country or in the province."

Liberal fundraiser criticized


The PCs have also criticized a New Brunswick Liberal fundraiser held in Fredericton in February.
It featured Gallant, the premiers of Nova Scotia and Prince Edward Island and several federal Liberal cabinet ministers, who were in the city for government meetings.

At the time, Prince Edward Island Premier Wade MacLaughlan and Nova Scotia Premier Stephen McNeil both said they were attending the fundraiser in their spare time, the same explanation Ambrose's office provided Friday.

The federal Conservative leader was attending the Woodstock dinner "on her own time," her communications director Mike Storeshaw said in a Friday email.

He confirmed Ambrose's trip was taxpayer-funded because most of her events were in her role of leader of the Official Opposition in the House of Commons.

That included visiting a Red Cross call centre in Fredericton where employees were helping Fort McMurray residents displaced by the forest fire there and participating in a fundraiser for a family who lost their home in the fire.

Companies still made largest political donations, ahead of ban

Corporate and union donations now banned, but parties pocketed $700K before June 1 deadline outlawed funds

Companies that do significant business with the provincial government once again donated the most money to New Brunswick political parties during the first half of 2017 — one of the reasons the practice is no longer legal.

On June 1, the province officially banned donations to political parties from corporations and unions to eliminate their perceived "influence" over political decisions.

But in a race against the clock, party fundraisers still managed to take in more than $700,000 from the two groups — mostly businesses — before the restriction took effect.
In a rare all-party agreement last spring, MLAs decided the public would be better served if companies and unions with an interest in affecting provincial government decisions be banned from funding political parties in charge of those decisions. Now only individuals can donate.

And as if to make the point of why the change was made, each of the top donors to New Brunswick political parties this year fits the profile of what MLAs said they were concerned about.  All are businesses with a significant financial interest in how the province is governed.

Each of them also got their donations in before the June 1 deadline made them illegal.
In New Brunswick, the maximum legal political donation is $6,000 per contributor, per party, per year. The top 10 in 2017 in order:

1. TD Bank — $12,000 (Liberal: $6,000, PC: $6,000)


The Toronto Dominion bank gave the most money of any political donor this year writing $6,000 cheques to both New Brunswick Liberals and Progressive Conservatives. The multibillion-dollar bank, insurer and financial services company has been a big job creator in the province, but hasn't been shy about accepting government handouts along the way.  In May, it proposed to create 575 customer service jobs in Moncton in 2019 with the help of up to $9 million from the province.

TD says it donates nearly $200,000 a year to provincial political parties in Canada, both government and opposition.

"Our contributions have no political bias, are all on public record and can be accessed at the websites of provincial election offices," says a corporate responsibility statement emailed to CBC News.

2. Acott Construction — $11,000 (Liberal: $6,000, PC: $5,000)


Carleton County paving company Acott Construction does a lot of business with the province, but president Gordon Acott says that's not why he donates to both major parties.

"Anybody who's got enough ambition to get out and ask, I usually give them something," said Acott. "We donate to more than political parties." According to the public accounts, Acott did $5.6 million worth of roadwork for the province in 2015, the latest year for which figures are available

3. J.D. Irving Ltd. — $10,244.20 (Liberal: $5,300.20, PC: $4,944)

J.D. Irving Ltd. is New Brunswick's largest forestry company and one of its most important employers. It's affected financially by a myriad of provincial government policies and decisions and has long been an important donor to multiple political parties. From the pricing of electricity, to the use of Crown forest land, the tax treatment of private timberland, rules around natural gas charges and other issues, there is not a lot the provincial government decides that does not affect J.D. Irving.

4. Emera Inc. — $9,500.20 (Liberal: $5,300.20,  PC: $4,200)


Nova Scotia energy company Emera has important infrastructure in New Brunswick, including a natural gas power plant and pipeline. It also has big hopes to partner with NB Power to sell renewable energy into the United States that would require the construction of hundreds of windmill generators in the province.

5. Insurance Bureau of Canada — $8,660.20 (Liberal: $5,300.20, PC: $3,360)


The Insurance Bureau of Canada (IBC) is an industry association representing home and auto insurance companies operating in New Brunswick. The group was instrumental in convincing the province to restrict benefits to car accident victims back in the early 2000s which led to unprecedented company profits in the province for more than a decade. 

6. Moosehead Breweries — $8,250.05 (Liberal: $2,084.70, PC: $4,200)

Moosehead Breweries has been favoured with millions of dollars in provincial government assistance over the years for expansions and upgrades, but company fortunes are most affected by restrictive rules that govern the sale of beer in the province and give market advantages to the company. Last year, an NB Liquor document surfaced claiming Moosehead had 22 distinct advantages in how it is treated in the province that had cost the liquor corporation $7.1 million in lost revenue.

7. Bell Canada — $8,094.60 (Liberal: $4,734.80, PC: $3,360)


The New Brunswick government is a major customer of Bell, paying the company more than $30 million per year for various services. But the company is also not shy about seeking handouts. In October, the province announced $3.6 million in grants for Bell in exchange for the creation of 150 service jobs in Fredericton.

8. Shoppers Drug Mart — $7,529.40 (Liberal: $4169.40, PC: $3,360)


Shoppers Drug Mart operates 38 stores in New Brunswick and has an interest in provincial government policy decisions on everything from commercial property tax rates to the minimum wage.The company is owned by Loblaw and has also been active in the debate around marijuana legalization with an interest in gaining federal approval to dispense medical marijuana at its pharmacies across the country.

9. St Isidore Asphalt — $6,500 (Liberal: $5,000, PC: $1,500)

St. Isidore Asphalt is one of the largest road builders in northeastern New Brunswick. In 2015, it billed the province $22.8 million on various jobs and like many paving companies has been a major long-term contributor to both main parties for several years.

10. Rogers Communications — $6,470.56 (Liberal: $3,672, PC: $$2,798.56)


Although the New Brunswick government does most of its telecommunications business with Bell, Rogers does have its foot in the door. The company sold $2.8 million worth of services to the province in 2015 (the latest year figures are available) and is almost certainly looking for opportunities to increase that amount.

Other notable donations:

  • Although painting Opposition Leader Blaine Higgs as a friend of big business and the rich, Liberals raised more than $530,000 from corporate donors this year. That's  nearly four times more than Progressive Conservatives. Irving Oil's donation to the Liberal Party ($4,169.40) was five times more than it gave to the PCs ($840) even though Liberals have spent much of 2017 trying to paint Higgs as the Irving Oil-friendly politician because of his long career with the company.
  • Unions also made their final donations to New Brunswick political parties in 2017, but at $28,700, it was a fraction of the money contributed by business. The NDP received 62 per cent of that money, including two maximum $6,000 amounts from the United Steel Workers and the Canadian Union of Public Employees.

Liberals raked in more corporate donations after election than other parties combined

A hard swing of corporate political contributions toward New Brunswick Liberals in 2015 shows why donations like that should be banned in the province, according to Canada's former chief electoral officer.

"Why is that the pattern? What does that tell you about what they are trying to do with their money," said Jean-Pierre Kingsley about corporate donations in New Brunswick tilting heavily toward the governing party.

"People don't put money into something unless they expect that it will have a return."
According to financial filings with Elections NB, New Brunswick Liberals took in $450,754 in corporate donations in 2015, the first full year following their 2014 election victory.

That's 96 per cent of corporate donations reported that year, although the Progressive Conservatives have not yet disclosed donations they received during the second half of 2015.

Still, it's likely the Liberals took in substantially more than 80 per cent of all corporate donations in 2015, in an obvious preference by corporate donors for the party in power that has deep roots in the province.

Since public records began in New Brunswick in 1978, the party in power has enjoyed a four to one average advantage in corporate donations in the first year following their election over all other parties combined.

New Brunswick's Progressive Conservatives received 86.6 per cent of corporate donations in 2011, the first year after their last election win.

Ontario, P.E.I. poised for bans


Last week, Kingsley appeared before an Ontario Legislature committee studying a bill aimed at banning corporate and union donations to political parties in that province, but he says New Brunswick should do the same — especially given the way corporate donors openly favour the governing party.

"It is what is required if we want to live in a democracy where individuals are the ones who vote and are the ones who have an influence on politicians," said Kingsley.
"We all know money matters."

In April, Prime Minister Justin Trudeau applauded moves by the former Chrétien, Martin and Harper governments to ban all but individual donations to political parties and called on provinces like New Brunswick to do the same

"I think banning union and corporate donations as we have done at the federal level is an important step that different provinces should consider," he said.

'Could be detrimental'


Ontario will be the fifth province to ban corporate and union money from politics and in May P.E.I. premier Wade MacLauchlan said that province would introduce similar rules later this year.

But in New Brunswick corporate donations have been such a financial advantage to the party in power there has been little enthusiasm for the idea.

In a discussion paper released by the Gallant government on July 5, the possibility of banning corporate and union donations was raised as something to consider, but with caution.

"With a limited population from which to raise funds, adopting such a ban in New Brunswick could be detrimental to political parties," the document stated.

University of New Brunswick political scientist J.P. Lewis said it is likely businesses feel it is an advantage in dealing with the government in New Brunswick to be donating money to the government party. And although that is an obvious financial advantage to the political party it may not send the right message to voters.

"It fits in to why normally governments have been tentative to change the electoral system because it's rewarding those who are already in power," said Lewis.

"It's a peek into how patronage politics has worked for decades."

Tom Bateman, a political scientist from St. Thomas University, says as long as information on who is donating is public he's not sure banning corporate and union donations is necessary.

"One option short of eliminating these donations is to make sure they are very transparent and the reporting to the public is clear and easy to access," said Bateman.
