This week, U.S. President Donald Trump bashed Amazon both on social media and the podium.

Trump said Amazon's package delivery contract with the U.S. postal service amounts to a "scam." He also accused the company of putting thousands of retailers out of business and not paying its fair share of taxes.

The president then went after the retail giant's CEO, Jeff Bezos, who also owns The Washington Post.
Trump's words sent shockwaves through Amazon's stocks and created a ripple effect in the broader stock market.

Richard Painter, who was the chief ethics lawyer during the Bush administration, has been watching the reaction to Trump's views on Amazon.

He told Day 6 host Brent Bambury that Trump's attack on the company could amount to market manipulation under U.S. securities laws.

What has been your reaction watching President Trump tweet about Amazon this week? 
First of all, he's doing this to retaliate against Jeff Bezos, the owner of The Washington Post. It's not Amazon that he's upset at. It's The Washington Post. But since Mr. Bezos is connected with both companies and he's the founder of Amazon, he wants to attack him personally. So he's going after Amazon, and accusing the company of illegal conduct and other things that are demonstrably false. That's very disturbing because our First Amendment guarantees freedom of the press and he's using his official power as president of the United States to retaliate for what's published in The Washington Post.

And he's doing it by going after a publicly held company. A lot of Americans hold stocks in Amazon, as do many Canadians. What did you make of that?
That's another problem, because this is a publicly held company. People are buying its stocks every day. It is a violation of federal securities laws to knowingly, or with extreme recklessness, make false statements about a publicly held company when you know that that could impact the stock price. So the president may very well be in violation of the securities laws as well as having violated the First Amendment of the constitution. He definitely should not be doing this and it's really unfair to the stockholders who see their stocks gyrating all over the place because of false statements made by the president of the United States.


Do you imagine that the ethics lawyers in the White House now are telling President Trump this?
I don't know if anybody in that White House has the courage or the ability to tell this president what to do or what not to do when it comes to tweeting and shooting his mouth off. He seems to do whatever he wants, when he wants to. He's very impulsive.

But does the president enjoy any immunity from securities law because he is the president of United States?
That might or might not be the case with private lawsuits brought by investors, but I would think that the president should comply with the securities laws, comply with the ethics laws and the United States Constitution just like everyone else. This is a demonstrably false statement, probably made knowingly or with extreme recklessness about a publicly traded security.


In that case, what recourse do you imagine shareholders would have?
They can complain to the FCC (Federal Communications Commission) and see if the Securities Exchange Commission wants to remind the president of the United States that he should not make false statements about public companies. Second, they could talk to Congress. I mean Congress has some responsibility to rein this president in when he engages in illegal conduct. Third, they could try to sue, but there would be difficulties there with respect to demonstrating a loss and a bunch of other factors.

I just want to push back on this idea that the statements are false or reckless. Because among other things, Trump says that Amazon doesn't pay its fair share of taxes, local and state taxes. As president of the country, isn't he within his rights to say that, to allege that?
When he says that they don't pay their fair share, that's a policy statement. But his statements have gone further than that to have alleged what amounts to fraud on the part of Amazon. That's where you get yourself into some very difficult territory, when you're making an accusation against a public company of an illegal conduct. And to the extent he's doing that, that is false. There's no demonstration that Amazon has committed fraud or anything illegal.


You've served as White House ethics lawyer. If you were Mr. Trump's ethics adviser right now, what would you be telling him about his attacks on Amazon?
I tell him to cut it out and stop trying to pick favourites in the private sector, and stop trying to retaliate against people for using the freedom of the press. And once again, I want to get back to what this is all about. It's about The Washington Post, and the fact that Jeff Bezos owns The Washington Post. President Trump doesn't like the coverage he's getting in The Washington Post. That's the core issue here.

President Donald Trump said on Twitter on Wednesday morning that "Amazon is doing great damage to tax paying retailers."

"Towns, cities and states throughout the U.S. are being hurt — many jobs being lost!" he continued.
Amazon stock fell by about 0.5% following the president's tweet.

Amazon has been a frequent target of Trump on Twitter. "Is Fake News Washington Post being used as a lobbyist weapon against Congress to keep Politicians from looking into Amazon no-tax monopoly?" Trump tweeted in July. The Washington Post is owned by Jeff Bezos, the CEO of Amazon.

In 2015, Trump tweeted that if Amazon "ever had to pay fair taxes, its stock would crash and it would crumble like a paper bag."

CNN host Brian Stelter suggested that Trump's most recent attack on Amazon could be related to a headline in The Post.

Trump previously linked Amazon with The Post and claimed that the newspaper lobbied for Amazon.


Yankee must have figured out that Canadians know who to tweet too. Clearly I send my documents etc to Trump and the FBI and many others as well EH?

    Painter, a 56-year-old Illinois native who served as the chief ethics lawyer under President George W. Bush, has frequently appeared on political news broadcasts as an outspoken critic of President Donald Trump, especially on the topic of conflict of interest.

    On Wednesday, Painter announced he’s forming an exploratory committee to help decide whether he will run in the November election for the seat former held by Al Franken.

    Franken resigned in January. The seat is now held by former Lt. Gov. Tina Smith, a Minneapolis Democrat, who has said she will run in November. Minneapolis attorney Nick Leonard is challenging Smith for the party nomination. State Sen. Karin Housley, R-St. Mary’s Point, is the only Republican to announce.

    Painter described himself as a centrist who was a longtime Republican but has supported Democrats and feels aligned with independent-minded voters. He said he’s focused on the influence of money on politics.

    “If I enter this race, it will be to fix the problem of corruption,” he said.

    Markets sell off, Dow plunges over 700 points as wild ride continues

    Roller-coaster afternoon on Wall Street as industrial giants like Boeing see big losses

    North American stock markets plunged in afternoon trading Friday after comments from the White House heightened the prospect of a global trade war and the subsequent risks to the economy.

    The Dow Jones industrial average fell as low as 23,738, dropping more than 700 points, or 3.1 per cent, before paring losses to close at 23,932 — a slide of 573 — or 2.3 per cent.

    The broader S&P 500 index lost 2.2 per cent to 2,604, while the tech-heavy Nasdaq composite fell 2.3 per cent to 6,915 points.

    • Trump wants $100B in more tariffs on China amid trade row

    The Nasdaq was the biggest loser of the week, falling more than two per cent, while the Dow lost 0.7 per cent and the S&P 500 was down 1.4 per cent.

    Markets were down this morning after the Chinese government vowed to "counterattack with great strength" if U.S. President Donald Trump went ahead with plans of tariffs on an additional $100 billion worth of Chinese goods.

    But stocks started to take a steeper slide in the afternoon after White House officials said that there could be some fluctuations in stock markets as a result of the U.S.'s trade dispute with China.

    Industrial giants like Boeing and Caterpillar were among the big losers, both losing over three per cent.

    Trade tensions


    Top economic adviser Larry Kudlow said that a solution to the trade dispute was possible within three months, but the tariffs were not a bluff.

    He added that China's response to the first tariff plan was "highly unsatisfactory."

    Added to that, government data on Friday showed that the U.S. economy created the fewest jobs in six months in March, but rising wage gains pointed to a tightening labour market, which should lead the Federal Reserve to further raise interest rates this year.

    • 'Blame China, don't blame Trump,' for trade war, Kudlow says

    Federal Reserve chairman Jay Powell said it was too soon to know if rising trade tensions would impact the U.S. economy.

    With volatility leading to wild swings in equities again this week, CIBC economist Royce Mendes told CBC that the key thing investors need to keep in mind is that "the stock market is not the economy and the economy is not the stock market."

    "Of course there's volatility, but fundamentally, the Canadian economy and the U.S. economy because it's so important to Canada, remains on solid footing," he said. "As longer term investors, that's something we should take into account when making decisions."

    Oil falls


    Meanwhile, along with the trade tensions, falling oil prices weighed on the Canadian market.

    Benchmark West Texas crude oil fell 2.3 per cent in New York to $62.05 a barrel. Prices have fallen almost five per cent this week as fears rose that growing trade tensions would reduce oil demand as the global economy slowed.

    In Toronto, the S&P/TSX composite index closed down one per cent to 15,207 points, led by declines in materials and energy.

    The Canadian dollar closed at an average of 78.35 cents US, up 0.08 of a cent from Thursday.
