He has appeared in the Supreme Court of Canada, the British Columbia Court of Appeal, the Federal Court of Appeal, the Supreme Court of British Columbia, the Federal Court Trial Division, and provincial courts in British Columbia, Alberta, Manitoba and Ontario.
Mr. Buckley has developed expertise in Health Canada litigation and defending regulatory charges under the Food and Drugs Act in the area of natural health products. It is likely that he has defended more charges in this area than any other lawyer in Canada. Most of these cases involved a constitutional challenge.
Mr. Buckley has been called as an expert witness in the area of constitutional law and Food and Drugs Act regulation by committees in both the Senate and the House of Commons. He is routinely invited to lecture concerning the regulation of natural health products by diverse groups such as the Fraser Institute, practitioner groups, consumer groups, and the NHPPA. He was also invited to draft the Charter of Health Freedom.
Prior to entering private practice, Mr. Buckley worked for the Ministry of Advanced Education Training & Technology, the BC Human Rights Council, the Intergovernmental Affairs Branch of the Premier’s Office (which at the time was non-partisan), and Transport Canada. These experiences in government have given him valuable insight in dealing with bureaucracy.
Despite traveling across Canada on legal matters, he is proud to be a Kamloops lawyer.

We should not be surprised that it is the Canadian truckers who
finally said enough is enough. These are our modern-day drawers of
water and hewers of wood whose backs were pushed up against the wall.
They ensure that when we go to the grocery store – or the hardware
store, or anywhere else for that matter – the shelves are full. Yet
most of us have no idea what goes on behind the scenes: when we pick
up that package of fresh spinach, we usually give no thought to the
trucker who left his home one early morning, kissing his precious
children goodbye as they slept. He climbed aboard his rig that was
topped up with fuel and supplies the night before. The coming light
of dawn shone upon his rig as he rolled up to the American border.
Many solitary kilometers lay ahead of him. For the next five days he
would travel to Monterey County, California, where he would pick up a
load of freshly picked spinach bound for the grocery stores of the
greater Toronto area.
He is, in fact, one of scores of trucks every week that carry only
spinach. He is but one in a complex maze that makes our economy run.
It is a complicated business: his reefer must be clean and at the
proper temperature to carry the spinach back during the five-day
return journey to Toronto. Timing and fuel prices are everything. He
must ensure he has the right documentation for his trip and the
handling of the cargo, along with the proper authorizations necessary
to cross the border. There is little to no room for error.
The spinach drivers represent only a small number of the truckers on
our roads. Nearly every aspect of our lives is dependent on their
labour. When we reach for that spinach, it did not just come there by
happenstance. Fresh spinach in January in a Toronto grocery store is a
modern-day miracle. It represents thousands of people engaged in the
fresh produce trade that makes it possible for average Canadians to
live far above the lifestyle of the richest European monarchs only a
hundred years ago. As a society, we are so privileged that we have
lost all comprehension of just how good we have it.
The vaccine crisis brought by the Ottawa bureaucrats, led by the most
polarizing Prime Minister that has ever sat in the PMO, has unleashed
a catastrophic blow to our finely tuned economic miracle that is built
on the backs of the tens of thousands of truckers who deliver our
spinach, our building materials, our automotive parts, our medical
supplies, and everything else that we buy or use on a daily basis.
These men and women who draw our water and hew our wood are now being
chastised, and labelled as terrorists by the same political operatives
who created the problem in the first place.
The Prime Minister’s subsidized press has, of course, condemned the
truckers whose resistance has now turned to one of the most dramatic
protests of Canadian history. These truckers are being dismissed in
the mainstream media for daring to demand accountability from a
government that has raided the financial storehouse of our
grandchildren and demolished the economic miracle that once was a
prosperous Canada.
We are now at a pivotal point where Canadians have to choose whether
to pursue freedom, or be subject to a dictatorial regime that demands
control of our very own bodies.
On Twitter I saw this comment from Andy Lee, whose twitter handle is
@Hannah_Bananaz:
This is not just about truckers.
This is about our parents who died trapped alone in nursing homes.
This is about children who have never played with other children. This
is about lost lives and livelihoods.
This is for them, and more.
This is for justice.
Indeed, the rolling of the trucks across Canada symbolizes the
people’s frustration with draconian and seemingly unending measures
inflicted on Canadians. It is not a convoy of or for the unvaccinated
but a convoy of overburdened Canadians, weary to the breaking point.
And yet, after two years of fear and division, the convoy represents
more than frustration: it is about hope, unity, and courage.
People across the country are lining the highways and the overpasses,
preparing sandwiches, waving flags, showing support to the truckers
who openly challenge the government and media narrative.
Yet, not all Canadians understand the fuss. Perhaps the critical ones
are those who have not felt the pain of the government restrictions.
Some people, after all, have actually profited over the last two
years. Without personal loss they seem to have trouble empathizing
with those who lost jobs, or whose income was interrupted because they
unexpectedly had to look after children sent home from school; who saw
businesses crumble that took generations to build; who were unable to
worship at church; who were not permitted to travel to see their
families because they were denied a seat on a plane, train or ferry;
who, despite the evolving science that confirms the inefficacy of the
vaccines, were branded by the Prime Minister as racist, misogynist,
and anti-science as he wondered if we should “tolerate these people.”
Well, “these people” and their allies are on their way to Ottawa.
They are joined by a huge gathering of the vaccinated and the
unvaccinated. These are people who have, deep within them, a burning
desire for truth and freedom. They are tired of the empty platitudes
of the political suits walking the halls of Parliament; they are tired
of the Ottawa toadies issuing edicts from behind their laptops; they
are tired of the judges that refuse to respect the rights of “these
people” as contained in the written and unwritten constitutional
principles of our legal heritage of freedom.
There is growing, in this country and on our North American continent,
a sense of admiration and respect for those who are willing to speak
truth to power, whether political or pharmaceutical. Hearts of
gratitude are turned to those men and women in their truck convoys,
those drawers of water and hewers of wood that form our economic
backbone. This massive truck convoy is rolling toward Ottawa and
changing the tide of perpetual fear and “othering” that has caused
such division in our country. Never in the field of Canadian politics
was so much owed by so many to so few.
Our hearts go out to these truck drivers for their courage in
confronting government tyranny. Like the Ottawa river, the convoy
keeps rolling along. Let it roll. We could not stop it if we wished.
The Prime Minister cannot stop it. No one can stop it. Let it roll
on full flood, inexorable, irresistible, benignant, to broader lands
and better days without the Prime Minister and his Ottawa minions who
have lost their way. Let it roll. Let truth and freedom roll.

Barry W. Bussey and Gary E. Ainsworth have been in the practice of law
for a long time. Barry was called to the Newfoundland & Labrador Bar
in 1993 and in Ontario in 1996. Gary was called to the Ontario Bar in
1982. Both are from small towns and have lived in the country for much
of their lives. We understand and live the traditions of small-town
life.

problems. Whether it is the real estate deal that needs to be closed,
the estate to be settled, the contract to be signed, or the employment

Barry W. Bussey
has practiced law for 30 years. He began his legal career in 1993 in
St. John’s, Newfoundland in a general practice. Then in 1996 he moved
his legal practice to Ontario where he served as inhouse legal counsel
for different Christian organisations until 2021. In 1997 he moved to
Trent Hills, Ontario and has lived there ever since. He started the
non-profit First Freedoms Foundation in 2021 to advocate for freedom
of speech, religion and conscience, and inviolability of the person.
In 2000 he was the Canadian Alliance Candidate for the federal
election in the city of Oshawa. He also served for over 2 years as a
representative of the International Religious Liberty Association in
Washington, D.C., New York, and Geneva. Over the years Barry served on
many non-profit sector boards including religious charities,
high-schools, university, and government advisory committees.
Legal Practice
His early years was in a general legal practice. Then later, while
serving as inhouse counsel Barry also carried on a busy private
practice for many years. He has extensive experience in Wills &
Estates Law; Employment Law; Domestic Contracts; Real Estate;
Charities; Faith-Based Organizations; Business Law; and Constitutional
Litigation. He has argued before administrative tribunals, various
levels of court including the Federal Court of Canada and the Supreme
Court of Canada. Barry served as intervener counsel in five cases that
were argued at the Supreme Court of Canada.
Legal Scholarship
Barry’s scholarship includes his past appointment as an Adjunct
Associate Professor, University of Notre Dame Australia (Sydney). In
addition to his advocacy work and general legal practice Barry
continued further study in law, political science and peace and
conflict. He is also an author and editor of legal themed works. For
example, he is the editor of The Status of Religion and the Public
Benefit in Charity Law (2020), Anthem Press; co-editor with Angus
Menuge, The Inherence of Human Dignity Volume I: The Conceptual
Foundations of Human Dignity & Volume II: Human Dignity and Religious
Liberty, (2021), Anthem Press; and, co-editor with Iain T. Benson, the
Lexis Nexis publication Religion, Liberty and the Jurisdictional
Limits of Law (2017); in 2012 he was a recipient of the Diamond
Jubilee Medal for religious freedom work in Canada and abroad. You may

Gary E. Ainsworth
Gary has practiced law for over 40 years. Graduating from Western
University’s law school in 1980, he started his career as corporate
counsel for two large international financial institutions based in
Toronto before returning to his hometown of Peterborough in 1988 when
he opened this firm. Over the years Gary has become a stalwart in the
legal community. His clientele recognizes his warm, hospitable, spirit
as he navigates them through their complex legal issues. For Gary,
challenging legal conundrums are an opportunity to bring about
meaningful assistance to clients. Among his legal quiver is his sage
advice on estate and succession planning.
Gary’s public service includes his current position on the allied
professional advisory council for the Peterborough Regional Health
Centre Foundation. He taught students who were taking courses for the
Life Underwriters Association of Canada among other insurance and
investment related courses and also taught the law clerk course at Sir
Sandford Fleming College. He is a former trustee of Peterborough
County Board of Education; a former lawyer member of the Consent and
Capacity Board of Ontario; a member of Human Ethics Committees for the
Peterborough County-City Health Unit and Peterborough Clinic; former
board member of charitable organizations such as the Heart and Stroke
Foundation, Junior Achievement, Good Neighbours Care Centre, advisory

Law Times reported that Superior Court Justice Calum MacLeod, on Feb. 17, issued a Mareva injunction freezing assets linked to bank accounts, fundraisers and cryptocurrency, including Bitcoin, Cardano, Ethereum, Litecoin and Monero in over 120 wallets raised for the freedom convoy protest. The injunction restricted convoy leaders and their fundraisers from selling, removing, dissipating, alienating, transferring, assigning or encumbering any listed assets. Ottawa residents filed a class action against the freedom convoy protesters seeking $306 million in damages for the three-week blockade, which disrupted people’s lives and forced businesses to close. If the lawsuit is successful, the Mareva order secures assets for the courts to reward residents with some of the protest money raised by organizers. Organizers turned to cryptocurrency after the courts froze donations raised by online fundraising sites. In his initial ruling, Justice MacLeod wrote that defendants promoted the use of cryptocurrency under the mistaken belief that it is untraceable and cannot be seized by the courts or legal authority. “It’s a pretty big step today that the cryptocurrency assets are going to be secured in an escrow agent,” says Lenczner Slaght partner Monique Jilesen. Lenczner Slaght acted for Champ & Associates, the law firm representing Ottawa residents in the proposed lawsuit. The firms brought a motion against Patrick King, Tamara Lich, Christopher Garrah, Nicholas St. Louis, Benjamin Ditcher and the non-profit Freedom 2022 Human Rights and Freedoms to demonstrate that they were leaders of the freedom convoy protests. Jilesen says defendants delivered responding materials on whether a Mareva injunction was needed, but arguments were adjourned. The opposing lawyer, Norman Groot, represented all the defendants except for Patrick King, who was not present and did not have a lawyer representing him. The respondents in the injunction are parties in several ongoing criminal investigations related to the protest. “This court proceeding is concerned with potential civil liability for the organizers, funders and participants in the Freedom Convoy to residents, businesses and employees in central Ottawa who were adversely affected. It is independent and separate from any of the criminal processes that may be underway.” Bobby Kofman, president of KSV Advisory, the proposed escrow agent, advised that the injunction was satisfactory, and the firm is prepared to act as an escrow.
