This week, Paul discusses some unexpected, and knowledgeable, visitors he had who came to discuss his book, and the podcast. Paul and Adam also discuss a central figure in the Government of Nova Scotia's response to the policing review, Executive Director of Public Safety, Haley Crichton. A witness for the government of NS at the Mass Casualty Commission, Ms. Crichton has been involved in decision making on policing in Nova Scotia in recent years. Paul examines her connections to the RCMP, which calls into question some of the policy decisions being made. 
 
Curt Allen had been expected to join the discussion, but made a Godot-like performance for this episode. He will be making an appearance in the coming weeks.

Province to Conduct Comprehensive Policing Review

The Province will conduct a comprehensive review of the policing structure in Nova Scotia and potentially recommend changes for how policing services are delivered.

“We are committed to making our communities safer, and a big part of that work is ensuring our policing services are effective, efficient and structured in a way that best serves Nova Scotians,” said Attorney General and Justice Minister Brad Johns. “I’m pleased that this important work will include a committee of people representing the diversity of our communities, ensuring that local voices are reflected in this review.”

A request for proposals for an external consultant to conduct the comprehensive, technical review of policing was issued today, September 29.

The selected consultant will work closely with a police review advisory committee, which will include people from equity-deserving groups, the provincial government, police agencies, subject matter experts and diverse community representatives.

The committee is co-chaired by Clare MacLellan, retired Nova Scotia Supreme Court justice, and Hayley Crichton, Executive Director of Public Safety and Security with the Department of Justice. Letters have been sent to policing agencies and community organizations seeking nominations for committee members. Other police review advisory committee members will be announced at a later date.

Putting the ‘public’ back in public engagement

As 2024 draws to a close, the provincial justice department is midway through a review of policing services with a report due in the spring of 2025. 

The province is policed by approximately 2,000 officers serving in 10 municipal forces and the RCMP through a contract which expires in 2032.

A thorough review of how policing is conducted in Nova Scotia was a key recommendation in ‘Turning The Tide Together,’ the report filed in March 2023 by the Mass Casualty Commission (MCC) appointed to investigate the circumstances surrounding the murder of 22 people by a gunman with a history of firearms violations and intimate partner violence. 

By all accounts, including an apology from the most senior officer with the RCMP, police failed when it came to identifying a potential threat and in apprehending the killer sooner. In March of this year, former justice minister Brad Johns announced a two-pronged review of police services in keeping with this recommendation from the MCC’s report:

The Commission recommends the Province meet with municipal police chiefs, the RCMP, and interested groups within six months to discuss what type of policing arrangement Nova Scotia could put in place when the current RCMP contract expires in 2032.

The province hired the firm Deloitte to conduct a “technical review” of the costs and benefits associated with the status quo – a combination of municipal forces in urban communities and the federal force in suburban and rural areas. (In at least two counties, the continuation of the RCMP contract is being actively debated by municipal councils). 

Public engagement committee

Johns also appointed a “public engagement committee” of 16 community leaders to advise the government on how to obtain feedback from citizens that will help inform what changes should be made and how policing should operate in the future.

The committee included advocates for Mi’kmaq, African Nova Scotians, victims of intimate partner violence, youth, 2SLGBTQIA+, people with mental health issues, as well as a number of police representatives.

The committee was co-chaired by Hayley Crichton, the executive director of public safety for the Department of Justice, and former HRM city councillor Lindell Smith.

Considerable public interest

On July 10, after Barbara Adams replaced Brad Johns as the justice minister, the province issued a news release announcing the public could participate in the review of police services through an online survey that would run until July 31. “In person” engagement sessions were promised for the late summer and early fall.

The future of policing was clearly a topic of considerable public interest. The anonymous online survey received 7,000 responses during three weeks in the middle of the summer. As a point of comparison, the online survey that was part of the public consultation on coastal protection drew 4,000 responses. 

The questions were succinct and the survey also provided an opportunity for citizens to submit their own written comments.

Survey Questions:

  1. On a scale from 1 to 5, how do you rate the overall effectiveness of policing in your community?
  2. On a scale of 1 to 5, how would you rate your overall satisfaction with the local police services?
  3. Overall, how safe do you feel in your community?
  4. How often do you see police presence in your area?
  5. Do you feel that the police in your community are approachable and willing to listen to community concerns?
  6. If you have ever reported a crime or suspicious activity, were you satisfied with the response and handling of the situation by police?
  7. What changes would you like to see to policing in Nova Scotia?
  8. What does good policing look like in your community?
  9. Use the space below to provide any additional thoughts, concerns, or suggestions regarding community policing that have not been addressed by this survey.

‘In person’ public consultations 

The “in person” part of the public engagement process took longer to get off the ground and was largely invisible. The Halifax Examiner was unaware of any public meetings or public sessions held to discuss the review of policing services.

According to Hayley Crichton, the Department of Justice official who co-chaired the public engagement committee, there were 33 meetings held between mid-August and mid-October that attracted about 240 people. Crichton said the participants were recruited through community organizations recommended by the members of the public engagement committee.

“We did choose to go through trusted community leaders to ensure they were speaking to their communities in ways that were respectful and most appropriate,” Crichton said. “Policing is a sensitive topic and depending on people’s interaction, we wanted people to feel safe and open in those meetings.” 

Facilitators running these small group meetings were provided a conversation guide and a training session on note-taking. Participants were asked the same questions contained in the online survey.

Crichton said the community organizations tapped by members of the public engagement committee used their own social media channels through Facebook or X to advertise the sessions. 

Unaware whether media were invited

Crichton said she is “unaware” of whether any media were invited to these “in person” public sessions on policing. She insisted the sessions were open, despite the fact neither the Department of Justice nor the public engagement committee provided reporters with dates or locations for the meetings. Nor were these sessions advertised to the public through the radio or the Nova Scotia government’s Facebook page. 

The Examiner asked if there had been any discussion of broadening the net to include members of the general public during the “in person” portion of the public consultation. 

Perhaps a public meeting format that would encourage independent reporting on the policing discussion, rather than a “trust us” summary provided by the government, as Nova Scotians experienced during the review of Northwood following 53 deaths in the early days of COVID-19. And then again with the “black box” of comments that allegedly convinced Tim Houston’s government “a majority” of citizens didn’t want provincial regulation of the coastline.

Consultation ‘truly public’

Crichton told the Examiner the consultation process was truly public. 

“The invitations weren’t just to people the community organizations work with. They were broader, to the entire community where these organizations were located, so it was really location based,” Crichton said. 

“Based on the survey responses and participation in the public engagement sessions, we know policing is an important topic for Nova Scotians. We are encouraged by the number of people who stepped forward to share their experiences.”

Crichton insists there was no intent to exclude the media from reporting on these meetings.

“All these sessions were open. The decision about the engagement method went through the public engagement committee,” Crichton said. 

“We would never have precluded media from participating in the sessions if they received information from the community organizations hosting the meeting.”

Unfortunately, invitations to media don’t appear to have been issued by the community organizations chosen to participate. So Nova Scotians will have to wait until spring, when the report will tell us what the survey respondents and hand picked members of the public expect to see from the police force(s) of the future.

Health Organizations, Unions push Harper on Asbestos Ban

“Put people’s lives ahead of politics, Mr Harper,” groups urge.

In an open letter sent today, over twenty health, union and
environmental organisations call on Prime Minister Harper to end his
support for the asbestos trade.
Harper is today holding his second rally in Asbestos, Quebec
(population around 7,000 in a country of 33 million), seeking votes by
promoting himself as the political leader most dedicated to the
asbestos industry.
“We call on you to put people’s lives ahead of politics,” said Dr
Kapil Khatter of the Canadian Association of Physicians for the
Environment. “Canada’s leading medical authorities have all told you
that the export of asbestos is medically and morally indefensible and
will lead to an epidemic of asbestos-related disease and death
overseas.”
Canada was the world’s biggest asbestos exporter in the last century,
but the asbestos industry is now bankrupt and about to die out. The
last operating asbestos mine in Canada is in Thetford Mines, Quebec.
It is under bankruptcy protection and is laying off some of its 350
workers because its asbestos deposit will soon be exhausted.
“Public policy should be based on science, not on politics,” said
Christian Simard, executive director, Nature Québec. “The science is
indisputable that all forms of asbestos are deadly. Not a single
reputable authority supports P.M. Harper’s policy that asbestos can be
safely used.
“Canada is becoming known as an immoral asbestos pusher and as an
enemy of global public health,” said Kathleen Ruff, senior human
rights adviser to the Rideau Institute. “This is not the role
Canadians want to play in the world.”
Harper has promised to block an upcoming meeting of the U.N.
Environmental Convention (Rotterdam Convention) so as to prevent
chrysotile asbestos being listed as a hazardous substance. Chrysotile
asbestos represents 100% of the global asbestos trade.
“P.M. Harper is the only national leader in Canada and in the Western
world to promote asbestos,” said Dr Khatter. “This election is about
trust and integrity. We are urgently pleading with P.M. Harper: Show
integrity by respecting the science and put human life ahead of
partisan political interests. We hope he will listen.”

One of our alleged sources, a young US intelligence analyst, Bradley
Manning, has been detained and shipped to a US military prison in
Kuwait, where he is being held without trail. Mr. Manning is alleged
to have acted according to his conscious and leaked to us the
Collateral Murder video and the video of a massacre that took place in
Afghanistan last year at Garani.

The Garani massacre, which we are still working on, killed over 100
people, mostly children.

Mr. Manning allegedly also sent us 260,000 classified US Department
cables, reporting on the actions of US Embassy's engaging in abusive
actions all over the world. We have denied the allegation, but the US
government is acting as if the allegation is true and we do have a lot
of other material that exposes human rights abuses by the United
States government.

Mr. Manning was allegedly exposed after talking to an unrelated
"journalist" who then worked with the US government to detain him.

Mary Ann Coleman – Southwest Region

Mary Ann Coleman has been a lifelong advocate of environmental
awareness and stewardship.  She was instrumental in launching the New
Brunswick Environmental Network in 1991.  Under her leadership, the
network has developed into the fourth largest provincial environmental
network in Canada with a membership of over 80 New Brunswick
environmental groups.  In this capacity, she has developed an
extensive network of contacts in Atlantic Canada and across the
country.

In the past, she served as chair of the Waterford Local Service
District Advisory Committee and as their representative on the Kings
County Solid Waste Committee. Currently, she is a member of a
provincial advisory committee for the Minister of the Department of
Natural Resources and is also a member of the board for Recycle NB.

Ms. Coleman has been actively involved in a number of environmental
and other non-profit groups, always working to make her community a
better place to live. She is actively working towards the development
of a New Brunswick strategy to reduce children’s exposure to
environmental contaminants that are known to cause health concerns.

Ms. Coleman was the 1999 recipient of the Milton F. Gregg Conservation
Award, presented by the Conservation Council of New Brunswick.

While on assignment on the reserve near Perth-Andover, a band security
officer, a pleasant-mannered man named Stephen Perley, informed me
that Chief Stewart Paul had decided I was not permitted on the reserve
- under any circumstances.
"I was instructed by my chief," Perley said firmly, "not to let you
into the community."
The security officer explained the chief put the ban into effect
following a series of stories in the Telegraph-Journal this fall about
the finances of Tobique First Nation. Those stories detailed
long-standing and serious financial "deficiencies" in record-keeping
practices and the management of public funds in the aboriginal
community of 1,600 people.
With a crippling $45-million debt - some of which is money the band
can't account for - Tobique faces some long-term challenges.
Unemployment is as high as 80 per cent.
Efforts to rein in the debt load has affected some of the community's
weakest individuals - including 88-year-old Lillian Deveau, who had
her home care cut.
The series of stories detailed:
* that more than $400,000 earmarked for child protection services on
the reserve has gone missing;
* how auditors going through annual financial statements for the band
found "significant deficiencies" - including instances of fraud and
theft of band money dating back to 2007;
* that more than $500,000 earmarked for the construction of a
rehabilitation centre on the reserve is unaccounted for;
* how a forensic audit of Tobique's finances was stalled this summer
because, auditors said, financial documents were missing and native
leaders weren't co-operating.
Both the current chief and the previous chief, Gerald Bear, have told
me that they did cooperate with forensic auditors and that they have
no knowledge of the misuse of funds.
The security man, Stephen Perley, described the series outlining these
issues as "negative" and said that the community "doesn't need the bad
publicity" about its affairs.
He had been called, he said, to ask photographer David Smith and I to
leave the community after we had visited various public offices in
Tobique looking to speak with band officials. He had been told what
type of car we were driving and the licence plate number.
The security man caught up with Smith at about 4 p.m. Thursday while
he was alone taking pictures near the community gas station. I had
left the reserve and was on my way back when Smith called to say he
had been stopped by security.
He was told to inform me that I was barred from entering Tobique First Nation.
The security man threatened to confiscate photographer Smith's gear,
but later relented and invited him to remain in the community, under
band supervision, to take pictures of "positive" local projects,
including a new health centre, a school under construction and a youth
centre.
I called Perley on his cellphone to find out exactly why I was being
banned. He did not waiver.
"We're allowing the photographer," he said. "Don't come here. You only
write negative stories."
The truth is, I've written countless stories about New Brunswick's
native reserves that didn't detail financial "deficiencies" or the
misuse of funds. Last winter, I spent five weeks on the road
travelling to each of the province's 15 First Nations and then wrote a
lengthy profile on each.
The Tobique profile highlighted the fact that fewer than 10 per cent
of the people in the community still speak their native Maliseet
language. It also detailed various local efforts to save their
language from extinction.
Since then, the newspaper had followed up with several other stories
about initiatives designed to bolster the Maliseet language.
Nonetheless, the security man told me this week that people in the
community didn't want a reporter hanging around asking questions.
Former Tobique First Nation band councillor David Perley said that
just isn't true and was surprised to hear that a Telegraph-Journal
reporter had been barred from entering the community because certain
individuals in the community didn't approve of the newspaper coverage.
"I'm shocked that they would go to these extremes of banning you from
the community," he told me after I had reached him by phone.
Perley said he's disappointed that Chief Stewart Paul would block the
freedom of the press.
"That doesn't happen in a democracy," he said. "This is a
dictatorship. I just can't get over it. I just can't believe it, not
this day in age. (The band leadership) is ignoring the drug dealers.
There is such a drug problem in Tobique - and (they are) banning
people who try to get the truth out."
Perley said the band is required to convene a meeting and pass a
resolution in order to ban an individual from the community.
"If they don't have that," he said, "whatever they're doing is illegal."
Perley isn't aware of any meeting that has taken place to pass such a
resolution.
"The chief has no authority to do that on his own," he said.
Stewart Paul, a lawyer, has been chief for 13 of the past 20 years and
was re-elected in band election earlier this month. I tried reaching
him, without success. My messages were left unanswered.
I did reach Daniel Theriault, a Fredericton lawyer who specializes in
aboriginal law and treaty rights. He agreed that the Indian Act does
contain a provision that gives chief and council the right to ban an
individual from a reserve, but that a resolution or bylaw has to be
passed first.
"The bottom line is, yes, in my opinion, they do have the right to ban
people from the reserve," Theriault said. "However, it's generally
used to stop a criminal element from frequenting or residing on the
reserve."
According to the Indian Act, a band council may pass a bylaw for the
"removal or punishment of persons trespassing or frequenting the
reserve for prohibitive reasons."
A ban, Theriault said, would extend to any public roads built on
reserve land - including Route 105 that cuts through Tobique First
Nation on the way north to Grand Falls.
The band is required to notify the department of Indian and Northern
Affairs if it passes a bylaw prohibiting someone from the reserve, he
said. He had never heard of a band barring a member of the media.
I asked Indian and Northern Affairs if a band council and chief had
the right to prohibit an individual from entering a reserve.
Spokeswoman Margot Geduld referred to section 30 of the Indian Act,
which states "a person who trespasses on a reserve is guilty of an
offence."
The issue, she added, is that "trespass" isn't defined in the act.
"A court of law would have to determine that," Geduld said.
Security man Stephen Perley cited the Indian Act to photographer Dave
Smith when he threatened to confiscate his camera equipment. Perley
made no mention of trespassing or of a band council resolution.
The newspaper stories that have apparently caused me to be banned
relied heavily on audit documents that had been sent to the newspaper
by concerned citizens - people who live in Tobique.
After those stories were published, residents posted them on the
bulletin board inside the gaming facility for all to see.
In the days following those reports, band members have continued to
contact the newspaper.
Throughout my reporting for stories about Tobique's social conditions
and financial affairs, I knocked on many doors in the community.
Most residents didn't want to publicly voice their concerns. They said
they didn't want to be quoted in the newspaper because they were
afraid. Some declined to be interviewed out fear of losing their band
jobs; others were afraid of losing their house or any benefit overseen
by the band.
My stories have attempted to give those residents a voice.

Pozen can check my work in the dockets of the various courts around
Boston they are a matter of Public Record my files are not. As you can

criminal matters first before filing civil complaints in the USA. As I
told you when you called a lot has been happening. I have made a lot
of cops mad at me and I don't trust them a bit particularly after the
Police Commission is willing to check their work so i have been busy
watching my back and covering my butt. However that does not mean that
I have not thought about our conversation and was curious about a few
things.

I was glad to receive your call and impressed by the fact that you
were more than willing to receive the material and a copy of the
wiretap tape in particular. Your stated willingness to uphold the law
was a rare statement to me. However I was curious why you only
mentioned my voicemail to Mr. Pozen and not the email to your company
and the news program that it owns. Did they not inform you as well? If
they didn't I am not surprised because I have some other rather
interesting denials from the Media. the most interesting would have to
be from the PBS program called Frontline when I introduced its
producer Michael Sullivan to the US Attorney Michael J. Sullivan. Now
that is a story well worth W5 telling. Too bad they showed me their
ass. As a courtesy to you and a further act of good faith, I will not
forward this email to anyone else until after I return to the USA and
nothing has been resolved between BCE and I and I am compelled to name
it in my complaint. I would find it very hard to believe that Mr,
