Former auxiliary police officer charged with sex assault, possessing child sexual abuse material

A former auxiliary police officer in Fredericton is facing charges related to child sexual abuse material and sexual assault.
Robert Hartlen, 56, of Fredericton, has been charged with two counts of possession of child sexual abuse and exploitation material and one count of indictable sexual assault.
Hartlen was not present for his first appearance in Fredericton court on Thursday.
Defence lawyer Emily Cochrane, acting as an agent for Hartlen’s lawyer, T.J. Burke, requested an adjournment in the matter.
Judge Mélanie Poirier LeBlanc set the case over to June 18 for election and plea.
LeBlanc also imposed a publication ban on any information identifying any children, requested by Crown prosecutor Rachel Anstey.
The Fredericton Police Force said in a news release Wednesday it had laid the charges against Hartlen following an investigation initiated and led by its special crimes unit.
“In our commitment to transparency and accountability, we take all allegations seriously and are committed to ensuring all individuals are held to the same standard under the law,” said Chief Gary Forward.
Hartlen was a volunteer member of the force's auxiliary program from 2010 to 2015. Fredericton police said the alleged offences did not occur during that time.
Hartlen went on to become a police officer with the Kensington Police Service on Prince Edward Island.
In an email, deputy police Chief Jim Gotell said Hartlen "was employed by Kensington Police Service as a Constable from 2016 to 2019."
"This service preceded the allegations for which he has been charged by the Fredericton Police Service," he said.
Fredericton police said additional comments will be limited in order to protect the integrity of the investigation and the privacy of victims.

A Kensington, P.E.I., police officer has apologized for "bullying" Nickelback and removed a Facebook post he says drew a reaction far beyond his expectations.
Last week, Const. Robb Hartlen posted on the police Facebook site that he would force arrested drivers to listen to Nickelback's 2001 album Silver Side Up as a punishment for drinking and driving. It was just his way of using humour to spread an important message, he said.
CBC P.E.I. published a story about the tongue-in-cheek post, as did other media around the world, including Time magazine and CNN.
"At no time did I think it would go as far as it did," Hartlen said.

Hartlen said the message of "Don't drink and drive" began to take a backseat to the "bashing of the band."
"I didn't want to turn this into an anti-Nickelback," he told CBC Friday night. "The more I thought about it and the more I saw the comments and the more I saw people sort of jumping on the 'We love and we love to hate Nickelback' bandwagon, I was like, 'I think we're losing the message here' and I'm sort of feeling a little bad about what was going on."
Sending wrong message
In his new Facebook post, Hartlen said that as a police officer, he was sorry for sending the wrong message to children.
"How could I, later this week, walk into an elementary school classroom in uniform and try to teach the kids that bullying is wrong when I was guilty of the exact thing," he wrote.
Hartlen said Kensington police are working on a new campaign to discourage drinking and driving.
"We're going to work together with a couple people as opposed to making fun of one group," he said.

Saint John police Chief Robert Bruce announces retirement amid conduct complaints
Takes effect in July, 3 years before end of contract
Saint John police Chief Robert Bruce has announced he’s retiring in July, three years before the end of his extended contract.
“I believe I have fulfilled my obligations and commitments to the Board, the citizens of Saint John, and both the civilian and sworn members of the Saint John Police Force,” he said in a written statement Monday afternoon.
It comes amid conduct complaints nine police officers filed against him between June and September last year.
Most of the allegations were dismissed by the Saint John Board of Police Commissioners and New Brunswick Police Commission as being “frivolous, vexatious and/or not made in good faith.”
An independent investigator did confirm some “inappropriate” comments and gestures, but “found no evidence to substantiate any allegations of harassment, bullying or a toxic/poisonous work environment" with respect to any employee.
Eight of the officers are now seeking a judicial review of the dismissals. The ninth has withdrawn since reaching a settlement. None of the allegations have been tested in court.
CBC News requested an interview with Bruce, but he declined through Saint John Police Force spokesperson Staff Sgt. Shawna Fowler.
‘Considerable organizational challenges’
In his retirement announcement, Bruce said that when he accepted the position of Saint John chief in 2021, he committed to a period of three to five years and to lead the organization through “significant transformation."
“My goal was to help ensure the Saint John Police Force evolved into a modern, responsive, and trusted service that our community deserves.
“Over the course of my tenure, I have worked diligently despite considerable organizational challenges, including frequent changes within the senior command team, the absence of a Deputy Chief for much of this period, coupled with systematic resistance to change, and a restrictive collective agreement.
As a result, there were unique operational and leadership demands, with related challenges implementing meaningful change, he said.
“Nevertheless, we have remained steadfast in advancing our mission through accountability, transparency, high standards, structured processes, sound policy, professionalism, and clear communication.”
A challenging mandate, board says
Former chair Tamara Kelly previously told CBC that Bruce was initially appointed July 1, 2021, for a five-year term.
In May 2023, he was granted a three-year extension, which was set to expire on June 30, 2029, she said.
The new board chair, Katelin Dean, could not immediately be reached for an interview Monday on Bruce’s retirement or succession plans.
In a statement, she congratulated Bruce on his “many successes” over the past five years.
When he was hired, the board gave Bruce a challenging mandate "to bring substantial change to the Saint John Police Force,” the statement says.
“Though much work to modernize the SJPF and its governance remains, we are grateful for the groundwork Chief Bruce has laid.”
Union officials could not immediately be reached for comment.
‘Humble and grateful’
In his statement, Bruce said he is proud of the progress achieved in enhancing the service delivery model, strengthening internal support for members, and “fostering a positive impact within the community through increased engagement, visibility, and accessibility.”
He is “humble and grateful” for the opportunity and confident the current senior command team is well-positioned to lead the organization “toward continued growth and future success,” he said.
On May 11, Bruce announced the appointment of Neal Fowler as the new deputy chief, following an “extensive selection process.”
Fowler has more than 22 years of policing experience, according to a news release issued at the time.
Saint John officer who resigned sues police board over alleged retaliation for conduct complaint against chief

The first of nine Saint John police officers who filed conduct complaints against Chief Robert Bruce last year is now suing the police board for alleged breach of contract, “retaliatory conduct” over her complaint and misfeasance in public office.
Samantha McInnis, who is no longer a member of the Saint John Police Force, filed her lawsuit against the Saint John Board of Police Commissioners with the Court of King’s Bench earlier this week.
In her statement of claim, the former superintendent and executive officer to the chief alleges the board “breached its duty of good faith” regarding her contract and is “vicariously liable” for the conduct of Bruce and other employees.
“As a result of the Plaintiff's workplace harassment complaint, the Defendant engaged in retaliatory conduct toward the Plaintiff, through Chief Robert Bruce or his delegates,” the claim alleges.
This conduct, according to the court document, included filing a "bad faith" criminal complaint against her while she was on medical leave for alleged unsafe storage of her firearm and vest in her office.
This was "undertaken without reasonable and probable cause, and was motivated by malice,” claims McInnis, who alleges Bruce called the RCMP a month after he and the board learned of her conduct complaint against him.
Her gun and vest were both locked in cabinets within her locked office within the secure police station and no charges were laid, according to the statement of claim.
Other alleged actions included: threatening legal action, pursuing "arbitrary" Police Act proceedings against her to pursue termination, threatening to and/or ceasing her pension contributions and insurance benefits while she was on sick leave, appealing her WorkSafe benefits approval and issuing “unfounded” negative work performance reviews.
Resigned in February
McInnis, who claims she was demoted to the rank of inspector shortly after starting with the force, and went on medical leave a few months later, could “no longer tolerate the working conditions under Chief Robert Bruce or his designates” by February 2026 and resigned, according to the court document.
Despite her resignation, McInnis contends she was constructively dismissed and that the board, through the chief or his designates, has continued to “harass” her by calling her new employer and professional references and making “disparaging remarks” about her, the claim alleges.
“The Defendant's conduct during the dismissal was unfair, in bad faith and egregious and caused reasonably foreseeable mental distress and harm to the Plaintiff,” the document says.

CBC News requested an interview with board chair Tamara Kelly. Lawyer Jamie Eddy, who represents the board, told CBC News they have not yet been served. “Once they are formally served and have had the opportunity to thoroughly review the allegations, we will provide a response at that time,” he said in an email.
A plaintiff can have up to six months to serve a claim. Defendants then have 30 days to file a statement of defence.
Bruce is not named as a defendant. He did not respond to a request for an interview.
Seeks aggravated, punitive damages
In her statement of claim, McInnis alleges the board’s conduct is “an independently actionable wrong beyond the breach of employment contract itself, and is so malicious, oppressive, and high-handed that the conduct is a marked departure from ordinary standards of decency.”
She is seeking unspecified general damages, aggravated damages and special damages for lost wages, pension and benefits.
She is also seeking punitive damages “to deter similar behaviour in the future, express societal condemnation and, in relation to the breach of employment contract, on the basis that Defendant's conduct is harsh, vindictive, reprehensible, and malicious.”
In addition, McInnis claims “declaratory relief as may be appropriate” related to alleged Charter breaches, costs and any other relief the court deems just.
Officers seek judicial review, decision pending
Nine members of the Saint John Police Force filed conduct complaints against Bruce last year.
Eight of the officers are seeking a judicial review after the Saint John Board of Police Commissioners and the New Brunswick Police Commission fully or partially dismissed their complaints related to allegations of a toxic work environment.
The ninth officer withdrew her application after reaching a settlement.

A board-appointed investigator confirmed some of her allegations, but “found no evidence to substantiate any allegations of harassment, bullying or a toxic/poisonous work environment,” with respect to her or any other employee.
The board opted to pursue an “informal resolution” with Bruce.
In a statement issued last week, Bruce said the majority of the officers’ allegations were dismissed as “vexatious, frivolous, and not made in good faith,” and he “took full responsibility” for any action the board or commission deemed “below the standard expected of the Saint John Police Chief.”
He has also alleged the complaints are “attacks” by the police union, timed to coincide with contract negotiations. The Saint John Police Association has called that a “red herring,” noting two of the complainants are not union members, including McInnis.
Last month, the board and commission argued the officers do not have legal standing to seek a judicial review. Justice Kathryn Gregory reserved her decision.

Bob Davidson of the Saint John Police Association takes aim at mayor, security guard and CAO
A representative of the Saint John Police Association who was forcibly removed from city council chambers last week has filed formal complaints against the mayor, security personnel and the city's chief administrative officer for what he describes as his "sudden attack/assault."
Bob Davidson alleges Mayor Donna Reardon violated "multiple" provisions of the Code of Conduct for Elected Members of the City of Saint John when she instructed a security guard to escort him out of the regularly scheduled meeting Feb. 9.
Davidson attempted to address council that night without being on the agenda. He approached the podium shortly after the meeting started, requesting a "point of order."
He contends he was "attempting to respectfully seek clarification" about why an open letter the association sent to council on Jan. 21 wasn't on the agenda. The letter alleged a "huge waste of tax dollars" by the Saint John Board of Police Commissioners and Chief Robert Bruce on legal fees for "needless arbitration hearings" instead of policing.
According to Davidson, the mayor "overreacted" when she summoned the security guard, whom, he claims, grabbed him by the arm, spun him toward the door, then, with his hands under his armpits, "pushed" him approximately 100 feet out to the foyer.
"The Mayor did not intervene to stop the physical attack/assault on my person by the security guard, saying only 'this is not good,'" Davidson wrote in his complaint to the city clerk.
"Taken together, these actions reflect a failure to uphold the values of honesty, respect, transparency, accountability, leadership in the public interest, and responsible governance."

Council's lack of explanation for excluding the association's letter was "inconsistent with this obligation," he alleged.
'Dignity and respect'
The code also states that council members must treat people with "dignity and respect," Davidson noted.
"The events that unfolded in the chamber, culminating in my sudden attack/assault and physical removal, do not reflect treatment consistent with dignity and respect," he wrote. "These events were set in motion by oral direction of Mayor Reardon."
In addition, council members must not “commit assault of any kind, including making unwanted physical contact,” according to Davidson.
While it was the security guard who physically removed him, it was under the mayor's orders, he wrote.
Wrong complaint form
Davidson asked for the matter to be added to the Feb. 23 council agenda for "discussion and action," but told CBC News the city clerk Jonathan Taylor responded advising him that he hadn't filled out the proper complaint form.
"We're getting some political shuffle about, 'Oh, sorry, I don't think that's on a right form.' So we don't have a lot of hope," Davidson said.
A committee of three councillors handles any complaints against the mayor, he added.
Reardon declined an interview, saying she will let this process take its course.
'Lack of administrative oversight'
Davidson has also filed a separate complaint about the conduct of the security guard and an alleged "lack of administrative oversight" by the chief administrative officer, who is responsible for security services in city facilities, according to Davidson.
In addition to his physical treatment, Davidson contends the guard refused to identify himself or produce his licence, stating he wasn't required to do so, until his supervisor told him he was.
"This interaction demonstrates a concerning lack of knowledge by the guard of his legal obligations under the Private Investigators and Security Services Act, as well as a lack of understanding of the lawful limits surrounding the use of physical force in a civic setting," Davidson wrote.
He requested a review of what training is provided to security guards assigned to council meetings, what policies or procedures govern their conduct and whether those were followed.
He also wants to see corrective measures.
In an emailed response shared with CBC News, the clerk acknowledged receipt of the complaint and advised that the city is in the process of recruiting a new CAO.
"We will bring this matter to the attention of the new CAO, once that person is appointed by Council, for their review," Taylor wrote.
Davidson fired back, calling a deferral unacceptable and "deeply concerning." His complaint should be dealt with immediately by acting the CAO, Kevin Fudge, he said.
"These questions go directly to public safety, legal liability, and public confidence in municipal governance," he wrote, noting the city has launched a two-year pilot, hiring private security guards to patrol the most crime-affected areas, such as the uptown core, Waterloo village and around local shelters.
City spokesperson Lisa Kennedy said only that the city will address the complaints accordingly.

(Nipun Tiwari/CBC)A representative of the Saint John Police Association was forcibly removed from city council chambers by security Monday night after he attempted to address council without being on the agenda.
Bob Davidson approached the podium shortly after Mayor Donna Reardon called the regularly scheduled, live-streamed public meeting to order. Although the microphone wasn't on, Davidson could be heard requesting a "point of order."
He wanted to know why an open letter the association sent to council on Jan. 21, alleging a "huge waste of tax dollars" — money earmarked for police protection being spent instead on "exorbitant legal fees" — wasn't on the agenda.
Reardon told him, "Sorry … you can't," and wasted no time requesting security. "Can you escort our guest out this evening, please?"
A security guard quickly approached Davidson and instructed him to leave, then placed his hands on Davidson's arm, leading him out to the foyer, as Davidson attempted to shrug him off, saying, "Get your hands off me, buddy."
Growing tension
The brief fracas comes amid growing tension between the union, the Saint John Board of Police Commissioners, Chief Robert Bruce and council.
Earlier this month, the board filed with the Court of King's Bench a request for a judicial review of the new contract awarded to officers by an arbitration board in January. The contract, which is retroactive to Jan. 1, 2024, provides a wage hike of 15.42 per cent over three years, maintaining their position as the highest paid municipal force in New Brunswick.
Nine officers are also seeking a judicial review of the dismissal of their conduct complaints against the chief by the Saint John board and the New Brunswick Police Commission.
Meanwhile, the city has asked an independent, third-party consultant to review the policing governance model after Coun. Gerry Lowe proposed the Saint John board be dissolved and the force become a city department instead.

Growing tension between Saint John city council and the union representing Saint John police reached a flashpoint at a recent meeting.Outside the council chambers Monday, Davidson described his forced removal as "unbelievable."
His intention, he told reporters, was to try to get council to explain to the public why the association's letter "pointing out the waste of tax dollars by that silly appeal of the unanimous binding arbitration" on the contract wasn't on the agenda.
"The Saint John Police Association submitted a letter concerning a waste of tax dollars going on at the Saint John Board of Police [Commissioners] and the letter was supposed to be on the agenda and obviously forces within City Hall removed it because there are forces within City Hall and the police commission that are trying to deny council as a body from knowing what's going on," he alleged.
"Police officers of [the] City of Saint John are trying to communicate with the mayor and elected representatives and being denied — and tonight, forcefully denied. It's a spectacle."
City responds
In an emailed statement, Lisa Kennedy, director of external relations for the city, said what occurred at the meeting "was not about silencing anyone or the substance of the issues raised by the Saint John Police Association.
"It was about maintaining order in a public meeting and following the rules that govern how Common Council conducts its business."
Under council’s procedural by-law, the chief administrative officer has the authority to not place correspondence from the public related to labour relations, or matters already referred to staff for a report, on the public agenda, Kennedy said.
Council members have already read the letter from the association and a copy has been provided to the consultant conducting the policing governance review, she said, noting the association is being interviewed as part of that process.

"When he was advised he was out of order and asked to step away from the podium, he declined and remained at the podium such that it interfered with Council’s proceeding," she said. "At that point, in accordance with the provisions of the Council Procedural By-Law, the Mayor directed security to enforce council procedure so the meeting could continue.
"Council takes all matters brought to its attention seriously," Kennedy said. "The concerns raised by the Police Association are not being ignored; they are being addressed through an independent, evidence-based review.
"At the same time, public council meetings must follow clear procedural rules to ensure fairness, safety, and orderly proceedings in support of effective municipal governance for the citizens of Saint John."
Union supports dissolving police board
According to Davidson, when council receives correspondence, "they put it on the agenda and they talk about it.
"But for some reason here they don't want to talk about police matters in the city of Saint John," he alleged.
In the letter, the association argues that many matters have been forced to "needless and expensive" arbitration and that there is "no accountability" to taxpayers under the current police board governance.
The board consists of two council representatives, four citizens appointed by council, one appointed by the province, and the chief as an ex-officio member.
"It is the request of the front-line Saint John police officers that Council correct the present 'disjunctive and wasteful' structural situation at your earliest opportunity," the letter signed by association secretary-treasurer Duane Squires said.
"Failure to do so would mean that the present Mayor and majority of Council support the waste of tax dollars that only the next election can correct."
