NOTICE OF A MOTION TO APPEAL THE ORDER OF

MR. PROTHONOTARY MORNEAU AND REQUEST AN ORAL HEARING OF THE DEFENDANT’S MOTION TO DISMISS

TAKE NOTICE THAT the Plaintiff, David Raymond Amos pursuant to Rules 30(1)(a)(2), 50(2)(5) and 51(1)(2) of the Federal Court Rules moves that the court to set aside the order of Mr. Prothonotary Morneau striking out the Plaintiff’s Statement of Claim of against the Defendant, HER MAJESTY THE QUEEN in its entirety, without leave to amend and requests an oral hearing to discuss the evidence and the merits of this matter before a Judge of Federal Court in Fredericton, NB on December 14^th, 2015 at 9:30 am for a duration of 2 hours.

THE APPEAL IS FOR:

1. The Plaintiff sued the Queen of England. The Deputy Attorney General named the Attorney General as the Defendant in his motion to dismiss this matter pursuant to Rules 221(1)(a) of the Federal Court Rules instead of HER MAJESTY THE QUEEN (CROWN) then named her as the Defendant in the Court Order he had composed for a Prothonotary to dismiss the Statement of Claim in its entirety, without leave to amend before the Plaintiff could file the evidence to support his claim against the CROWN seeking eleven million dollars and proper apologies for its offences against his rights under the Canadian Charter of Rights and Freedoms (Charter) that could be appealed to the Supreme Court of Canada if necessary.

2. Mr. Prothonotary Morneau is not an infant or incompetent. He should had understood Rule 50(2)(5) of the Federal Court Rules in that he had no authority to strike a statement of claim seeking eleven million dollars in monetary relief in light of the fact that no consent was given by the Plaintiff for any prothonotary to render a final judgment in this matter. The objection filed by the Plaintiff on October 26, 2015 to the vexatious Motion to Dismiss by the Attorney General of Canada clearly states that the Plaintiff requests an oral hearing before a Judge of Federal Court. No consent was expressed or implied in order to allow a prothonotary to ignore the Federal Court Rules.

THE GROUNDS TO APPEAL THE ORDER OF MR. PROTHONOTARY MORNEAU AND THE REQUEST AN ORAL HEARING OF THE DEFENDANT’S MOTION TO DISMISS ARE:

The Attorney General of Canada and Mr. Prothonotary Morneau have falsely claimed that the Plaintiff discloses no reasonable cause of action despite the fact that the CROWN admitted within its Motion to Dismiss that the Plaintiff had stated that the CROWN had breached his right to peaceful assembly and association pursuant to section 2(c) and (d) of the Canadian Charter of Rights and Freedoms. The facts are the Plaintiff is still barred today from access to parliamentary properties and public records buildings and that the Queen of England rules over every jurisdiction in Canada. The Federal Court of Canada does have the jurisdiction to hear this matter and the Plaintiff did file his statement of claim against the CROWN in a timely fashion because he is still barred from the most important public properties in all of Canada.

Due process of law entitles the Plaintiff, to provide the Federal Court with the evidence to support his Statement of Claim and to be heard rather than be summarily dismissed in writing by a prothonotary because the counsel for the Defendant makes allegations that his actions in defence of his rights and freedoms under the Charter are frivolous and vexations or that the Federal Court does not have the jurisdiction to hear a claim against the CROWN.

THE OBJECTION IS FOR:

1. The Plaintiff sued the Queen of England. 2. The Deputy Attorney General, William F. Pentney QC is not an infant or incompetent. He serves the Plaintiff on the last day pursuant to the Federal Court Rules a vexatious motion in lieu of filing a Statement of Defence then seeks an extension of time to answer if he fails.

WRITTEN REPRESENTATIONS

The Plaintiff opposes the statements of the Deputy Attorney General’s Motion to Dismiss as counsel to the Defendant, HER MAJESTY THE QUEEN in the same order that the statements were served on him.

OVERVIEW

The Defendant has no grounds to seek an order to strike the Plaintiff’s Statement of Claim. In paragraph 6 of the Defendant’s written representation the CROWN admits that the Plaintiff stated that on June 24, 2004 the CROWN began its breach of his right to peaceful assembly and association pursuant to section 2(c) and (d) of the Canadian Charter of Rights and Freedoms (Charter). However, the Defendant fails to acknowledge that the Plaintiff is still barred from all parliamentary properties to this very day.

The allegation is obviously false. The party named in this Statement of Claim is HER MAJESTY THE QUEEN as the Plaintiff stated in paragraph 89 of the Statement of Claim , the Federal Court has the jurisdiction to hear this matter pursuant to section 17 (1) of the Federal Courts Act which states as follows:

“17. (1) Except as otherwise provided in this Act or any other Act of Parliament, the Federal Court has concurrent original jurisdiction in all cases in which relief is claimed against the Crown”

3. The Plaintiff strongly objects for reasons stated within paragraph 2.

4. The Plaintiff states that after the court reads and listens to the evidence then hears the Plaintiff’s arguments during a hearing of this motion in support of his Statement of Claim, the Defendant should consider making an offer to settle with the Plaintiff rather than attempting to write another frivolous defence in order to waste more of the Federal Court’s time.

PART I--FACTS

5. The first part of this stated “fact” is not true. The Plaintiff is not a resident of New Brunswick. He is in fact still a permanent resident of the United States of America (USA) although he has been homeless for over ten years. The CROWN cancelled the Plaintiff’s social insurance number many years ago at about the same time that he was issued an American social security number. A recent act of Parliament does not allow the Plaintiff to vote because of his standing as a non-resident but does not deny him to run for a seat in Parliament. In further support the Plaintiff states that he has not paid income taxes in Canada since 1987 and he does not have a Medicare card issued from any province. In 2010 the CROWN went so far as to refuse to renew his Canadian drivers licence in Nova Scotia for no stated reason whatsoever other than to have unnamed bureaucrats tell him on the phone to take his problems back to New Brunswick or to sue Nova Scotia. The second part of the Defendant’s “fact” is almost true. The Plaintiff did name HER MAJESTY THE QUEEN as the defendant in his Statement of Claim on September 16, 2015. However it is comprised of 53 pages not 52.

8. Not True. The Plaintiff has been trying to resolve this matter since 2004 but the Plaintiff only explained in paragraph 11 of his Statement of Claim what had occurred on June 16, 2004. He did not state that he was “too busy”. The deeply troubling private family matters were the reason for the delay and the Plaintiff will explain that in a lawsuit following the action.

The Defendant should review statement 13 of the Motion to Dismiss. The Plaintiff has lots of evidence to provide the court to support what he has stated is true. The onus is upon the Defendant to prove he is a liar in order to have the Statement of Claim dismissed. False allegations won’t do within a just court of law. It is the facts and the evidence that support this claim. Many words and the same false allegations support by nothing but references to the law by the Defendant have no merit whatsoever.

Not True the Plaintiff is still barred today and the harassment is ongoing as well. In fact the malicious work that the RCMP allowed Barry Winters to publish over the past year is truly astounding.

He truly feels it was just a delay tactic served upon him in the last working hours before polling day of the 42nd Parliament. The Plaintiff ran in the election of the 42nd Parliament and the CROWN Corp known as the CBC ignored its mandate and denied the candidate equal access to be heard. He prays that the Federal Court does not behave like the CBC did. In 2004 the Plaintiff was barred by a Conservative provincial mandate government within days of his debating the Conservative lawyer Rob Moore and crossing paths with Stephen Harper. After Harper won a mandate in 2006, the Plaintiff was barred from all parliamentary properties.
The Plaintiff states that it is not plain and obvious that his claim cannot succeed. It is only the Deputy Attorney General’s stated opinion without revealing all the facts to Federal Court. For instance while the Plaintiff was running in the election of the 42^nd Parliament he sent many emails to many people containing a true copy of this Statement of his Claim. The CROWN should not deny that Peter MacKay the outgoing Attorney General, his Deputy Minister William Pentney and the local Justice Dept lawyer David Hansen received the emails found below during the time of the election of the 42^nd Parliament. In the concluding statement of the Defendant, the Deputy Attorney General expresses his concern that his request for relief may not be granted and seeks an extension of time for filing a Defence that doubles the time allowed by the Federal Court Rules after having the additional ten days the Plaintiff was allowed to file an opposition to his Motion to Dismiss and whatever period of time before the court hears the oral argument to his motion. The Defendant has already had forty days to compose a Statement of Defense and it may not be until the next year that the oral argument to the Plaintiff is requesting is heard. Thus the Defendant’s counsel has ample time to compose a Statement of Defense on the ground that the claim is without merit in case the court does not grant HER MAJESTY THE QUEEN the relief her counsel seeks. The Plaintiff knows for a fact that by the time an oral argument to the Defendant’s motion is heard Canada will have a new Attorney General sworn in and more than likely the Deputy Attorney General will be replaced shortly thereafter. The Plaintiff believes that the Defendant’s frivolous motion is just another malicious Conservative political action to delay his matters until the outgoing Attorney General and the current Prime Minister no longer has to account for their actions against the Plaintiff and the Canadian electorate as a whole.

The Plaintiff contacted the office of the Deputy Attorney General before filing this complaint because he had read the affidavit of William F. Pentney filed in the Edgar Schmidt versus the Attorney (Court file no. T-225-12). He must have noticed the former Deputy Speaker Denise Savoie, the Solicitor General and the Privy Council Office within the email within paragraph 33.
