Three former cabinet ministers take aggressive approach at public accounts committee

They're not exactly rebels, but a trio of backbench Progressive Conservative MLAs have been flexing their independence at the legislature's Public Accounts committee and turning its livestream into must-see political TV.

Last week the three Tories, all former ministers dumped from the PC cabinet last fall, put the spotlight on school construction decisions, slow ambulance response times and unspent climate funds.

All three exchanges were compelling, and all three topics are potentially uncomfortable or awkward for the PC government.

"The goal is not to be quiet and go and hide when you're in government," says one of the MLAs, Jake Stewart, who represents Southwest Miramichi-Bay du Vin. "The goal is to work on behalf of constituents."

Stewart asked Auditor General Kim Adair-MacPherson about her recent conclusion that the Ambulance New Brunswick contract favours urban areas because missed response targets in rural areas get less weight in the calculations.

Stewart's hometown of Blackville was one of the affected communities and he said during the meeting he wants the contract changed.

"That issue is extremely important where I live," Stewart told CBC News. "I don't think it would be possible for me to be there on that committee and not ask those questions."

New Maryland-Sunbury MLA Jeff Carr kicked off the pot-stirring last week when he endorsed Adair-MacPherson's finding that the construction of a new school in the riding of Education Minister Dominic Cardy was not based on evidence.

"I think we have to pay attention to what you offer us and try to make the changes for everybody involved," Carr told her. 

He added that an upgrade to Oromocto High School, which serves his riding, was "pushed way over to the side" when the Hanwell school was able to "jump the queue."

Stewart followed up later the same day with his comments on Ambulance New Brunswick.

"Ambulance coverage is human life. It's life and death," he told Adair-MacPherson.

"The need for a new contract is evident, because we can't allow rural areas of the province to suffer. … That's not acceptable to any taxpayer or any citizen of New Brunswick." 

The next day, Fundy-The Isles-Saint John West MLA Andrea Anderson-Mason used courtroom-style cross-examination questioning to reveal that almost $4 million in carbon tax revenue wasn't spent on climate change projects as required in 2018-19. 

"There's always a risk in terms of not spending the full budget," deputy environment minister Cade Libby acknowledged after a series of rapid-fire questions from the former attorney general.

The three episodes caught the attention of the opposition Liberals.

"Normally that doesn't happen," said Victoria-La Vallée MLA Chuck Chiasson, a veteran of the public accounts committee."Quite honestly, it took me off guard.

"I actually texted one of the other [Liberal] people on the committee … and I said 'Are you giving them these questions?' I thought, 'Gee, those are the questions we need to be asking."

Carr and Anderson-Mason did not respond to interview requests.

Stewart's approach 'nothing new'

Stewart says he wasn't looking for an "aha moment" and his approach was nothing new.

"I think I've always been fairly independent," he says. "I've been accused of it, or guilty of it, for a number of years."

He said backbench MLAs like him can "scream at the top of your lungs," or they can use the committee system to work "in a professional and precise way" raising issues important to their constituencies.

"Public accounts does provide a significant forum to drill down on the issues that really matter," he says. 

All three MLAs were cabinet ministers in Premier Blaine Higgs's minority government. But when the PCs won a majority last September, Higgs shuffled them out in favour of newcomers. 

Stewart was Aboriginal affairs minister before the shuffle and supported calls for an inquiry into systemic racism, putting him at odds with Higgs.

After her demotion, Anderson-Mason complained about the slow pace of government action on broadband internet in her riding, which Higgs labelled "sour grapes."

Chiasson said last week's questions may reflect "a little bit of frustration, a little bit of division" within the PC caucus, but political scientist Jamie Gillies of St. Thomas University says not to read too much into it.

"I don't think I would describe it as even dissent in the caucus or a revolt, but I think what we're seeing is maybe a little bit of an evolution since the election," he says.

"They're feeling a little more comfortable to say, 'You know, we're not down a couple of seats here. We've got a majority and I don't like how this is being treated within caucus,' or 'I agree with the auditor general on this.'"

The Health Department says it continues to discuss a new ambulance contract with Medavie Health Services New Brunswick, which operates the service.

"These discussions are ongoing and no decisions have been made," said spokesperson Bruce Macfarlane.

Education officials also appeared at the committee last week and explained the school ranking formula needed changes to account for rapid population growth in Fredericton and Moncton. That led to the approval of the Hanwell school, they said.

Libby told Anderson-Mason that while the provincial carbon tax deposited $37.4 million in the climate fund in 2018-19 for projects, the government only spent $33.7 million of it. 

It was the first public acknowledgement that $3.7 million wasn't spent the way it was supposed to be spent. Libby said the department hoped the money would be rolled over to be used in 2019-20, but it turned out that would violate federal climate plan requirements.

"The government has committed to spending this particular budget on climate change initiatives," he said.

Non-partisan intent

Gillies says PC MLAs acting more independently "could become a problem if it gets a little bit out of control," but it's normal members no longer in cabinet will become more vocal advocates for their ridings. 

School upgrades and construction are "a good thing to raise if you're looking to get re-elected and you want to voice the concerns of your constituents," he says.

With a minority government, "there's always the pressing issue of whether we can keep the government going," but now that the PCs have a majority, "they can be a little more aggressive in advocating for things."

Chiasson says he hopes for more tough questioning from the three PC MLAs.

"It's always good to see. PAC is supposed to be non-political or non-partisan, but I've never seen it function that way, so yeah, they can bring on more."

The Union of Municipalities of New Brunswick says NB Power needs to
stop raising the rates it charges for street lights.

In fact, executive director Margot Cragg said the utility not only
needs to stop raising rates — it needs to reduce them.

Cragg made a presentation to the Energy and Utilities Board in early
February after the City of Fredericton wrote a letter about the rates
for street lights and the union decided to take on the fight for all
municipalities.

"For Fredericton, the cost in 2017 was over a million dollars," she
said. "For other municipalities in the area, like Oromocto, it was
$340,000 and even for a rural community like Hanwell, it was over
$41,000 … that's a pretty hefty bill."

Cragg said money spent on street lights can't be spent elsewhere.
Another increase

She added the EUB has set a standard to determine the charges to each
rate class.

"So what the EUB has said is that the rate charge for each class
should be about equal to the cost of supply of the service, within a
range of reasonableness."

But Cragg said NB Power is proposing to increase it to 195 per cent of
that cost.

"That's almost double the cost of actually providing the service."

Cragg pointed out the present rate is too high and has been getting
worse year over year. She said in 2015-2016 it was 176 per cent of the
cost of supplying the service.

In 2017-2018 it was 192 per cent of the cost.

"That cost to revenue ratio has been getting worse year over year,"
Cragg said, adding that if the proposed rate is accepted, the ratio
will be even more punitive.
'Optional' service

At its rate hearing last year, NB Power said it considered street
light service optional and not subject to the EUB's fair price
guidelines. It also said the higher prices it charges for street
lights help it to keep prices it charges other customers, such as
homeowners, lower.

At hearings this week, both public intervener Heather Black and EUB
lawyer Ellen Desmond pressed NB Power rate design managers to explain
why they ignore the board's fair price guidelines in setting charges
for both street lights and water heater rentals.

"NB Power doesn't really view street lights as a rate class," said the
utility's rate design specialist Kevin Gibson. But he said it would
follow whatever direction the EUB gives it on the issue.
Follow the standard

Cragg said it's up to the EUB to make NB Power follow the standard it set.

"What the heck, you've set a standard for what should be charged for
each rate class, this is pretty clearly not falling within that, what
are you going to do about it?"

Cragg said the group asked the EUB to set the rate at one that
provides fair pricing for street-lighting services within all
municipalities.

"Any dollar that is spent on excessive pricing for street lighting is
money the municipality can't spend fixing the road, can't spend on the
water services, can't spend on the services and infrastructure you and
I use every single day in our communities," she said.

Premier Blaine Higgs has jettisoned six members of his previous cabinet and has appointed six women as ministers in a sweeping post-election shuffle.

The six Progressive Conservative MLAs who served in Higgs's cabinet from 2018 until they were dropped Tuesday include high-profile members Andrea Anderson-Mason, who was attorney general, Jeff Carr who was at Environment and Local Government, and Jake Stewart who was minister of Aboriginal affairs.

Bill Oliver, Sherry Wilson and Ross Wetmore are also out.

Dorothy Shephard, who oversaw a bitter battle with nursing-home unions through most of 2019, has been promoted to health minister.

Besides the COVID-19 pandemic, Shephard faces pressure for Medicare to fund abortions at Fredericton's Clinic 554, which is on the verge of closing.

Only three hospitals in the province, two in Moncton and one in Bathurst, provide publicly funded abortions.

Shephard has attended pro-life rallies at the legislature in the past but said Tuesday she will put her personal views aside in her new role.

"I don't know that I could ever have an abortion," she said.

"However I would move heaven and earth to get any woman the help that she felt she needed. I think it's a traumatic thing for a woman to have to go through and I think we all need to be compassionate." 

Shephard replaces Ted Flemming at Health. Flemming becomes minister of justice and public safety and attorney-general.

He replaces Anderson-Mason in two of those positions.

The second-term MLA told CBC News on Tuesday she wasn't committing to staying for a full four-year term after the shuffle. Like Higgs himself, Anderson-Mason said, "I didn't do this because I didn't have any other options."

"There's been a significant change in our life in the last few hours, and we're going to reflect as a family and see where this goes." 

'Nothing personal'

Higgs told reporters that dropping six ministers was "nothing personal," and he said his new lineup is what he has "right now," holding out the possibility that reorganizing departments in the coming years could let some MLAs return to cabinet.

"We will look going forward at what needs to change," he said.

In other cabinet moves, Bruce Fitch replaces Shephard as minister of social development, while Education and Early Childhood Development Minister Dominic Cardy remains in that job. Mary Wilson moves from Economic Development to minister of Service New Brunswick. 

Rookie Moncton East MLA Daniel Allain becomes the minister of local government and local government reform.

Allain told reporters the title is a sign that the government considers reform a major priority.

Other first-time MLAs joining cabinet are:

  • Margaret Johnson as minister of agriculture, aquaculture and fisheries.
  • Arlene Dunn as minister responsible for economic development. She is also minister responsible for immigration and minister of Aboriginal affairs.
  • Tammy Scott-Wallace as minister of tourism, heritage and culture and minister responsible for women's equality.
  • Jill Green as minister of transportation and infrastructure.

The six women represented the largest number of women ever in a New Brunswick cabinet.

Hampton MLA Gary Crossman, first elected in 2014, joins cabinet as minister of environment and climate change and minister responsible for the Regional Development Corporation.

Other ministers who took office in 2018 who are staying where they are include:

  • Ernie Steeves as minister of finance and treasury board.
  • Trevor Holder as minister of post-secondary education, training and labour.
  • Glen Savoie as minister responsible for la francophonie.
  • Mike Holland as minister of natural resources and energy development.

There was criticism of Higgs's decision to give the Aboriginal affairs portfolio to Dunn, a minister with several other responsibilities. Stewart was the first minister who had it as his sole responsibility. 

Metepenagiag Chief Bill Ward said he's been in his position for about five years and Dunn will be the fourth minister he has dealt with.

"It seems as though it is by design that we are in a perpetual meet-and-greet mode" with the province, he said in a tweet. "Fun times."

"Tammy Scott-Wallace as minister of tourism, heritage and culture and minister responsible for women's equality."
They lumped women's equality in with tourism and culture... one of the least utilized or effective ministries in the province. Why didn't they just tell her to wait in the car?

Glad to see Andrea Anderson-Mason gone. She was giving terrible legal advice. I feel bad for Jake Stewart. He's probably the only member of that party that I have some respect for. Higgs probably didn't like how he was handling Aborigonal Affairs after he suggested that an inquiry was an idea that he supported. He certainly got thrown under the bus on that one.

He was acting in good faith with our first nations, making progress, how ever slow. Then he said the obvious, that an inquiry into systemic racism was necessary. I don't think that's an outlandish idea. Apparently team Higgs is more interested in maintaining the status quo. They threw Jake under the bus with respect to all the inroads he had made on that file. He was doing the right thing buy calling for an inquiry. Bill Oliver is the ONLY one that I feel bad for. The rest were wiping the red off their lips. Bill Oliver was a good Minister, who cared, and that is something Blaine Higgs does not need in his caucus. He needs people that won't bat an eye closing hospitals. Sounds like Premier Higgs is dumping anyone in Cabinet who did not totally agree with him on every issue ; yet he kept Dominic Cardy who was his weakest Minister . Hopefully these changes don't come back to haunt him as there will probably be a lot of push back on mandatory vaccinations if he decides to let Cardy open that Pandora's box again .

Reply to @Matt Steele: Mr. Cardy actually showed surprising strength in his responses to the COVID file, and gained much respect across the country. Whether he's been the Premier's "weakest minister" is a matter of opinion. He'll probably do fine as he knows how to play the game - anyone who can make a successful jump from the NDP (!!) to the PCs is probably pretty savvy - more thatn just luck.
