RCMP head told feds police had not used 'all available tools' hours before Emergencies Act was invoked

'Charges could be laid under existing authorities,' Commissioner Lucki told government official

In the early hours of Feb. 14, RCMP Commissioner Brenda Lucki wrote to Mike Jones, chief of staff to Public Safety Minister Marco Mendicino, about the measures the national police force would find useful if the act was invoked.

"That said, I am of the view that we have not yet exhausted all available tools that are already available through the existing legislation," she wrote just before 1 a.m.

"There are instances where charges could be laid under existing authorities for various Criminal Code offences occurring right now in the context of the protest."

Her email said the recently announced Ontario state of emergency also provided police with helpful deterrent measures.

"These existing tools are considered in our existing plans and will be used in due course as necessary," Lucki wrote.

Later that day, Prime Minister Justin Trudeau announced that the government was invoking the act. 

The email was raised as Brendan Miller, a lawyer for the convoy organizers, questioned interim Ottawa police chief Steve Bell.

"I do believe there could have been other opportunities," said Bell.

The Public Order Emergency Commission is holding an inquiry into the federal government's use of the Emergencies Act to quell the protests that gridlocked parts of downtown Ottawa for weeks.

'We had a plan': Bell

On Feb. 12, the Ottawa Police Service and the Ontario Provincial Police set up an Integrated Command Centre to coordinate enforcement.

"We had a plan, we were going to execute a plan" said Bell.

By that point, protesters had gridlocked parts of downtown Ottawa for three weeks 

Bell also has told the inquiry the Emergencies Act was "significantly beneficial" as his officers leveraged the emergency powers to clear the streets over the weekend of Feb. 20.

Lucki's email to Jones includes a list of measures the force would find useful if the act were to be invoked, including banning travel to prohibited areas and and blocking protesters from carrying gas and diesel to the protest zone.

Lucki has repeatedly stated her support for invoking the act.

"We used it as a big deterrent for people to come into the area," Lucki told MPs on a parliamentary committee in February.

"We did use the measures that were put in the Emergencies Act, along with other authorities that we had."

Today, October 24, is a short summary of Day 8 of the hearings for the Public Order Emergency Commission, also known as the Rouleau Commission. This is the long anticipated public inquiry into the federal government’s first ever invocation of the Emergencies Act in response to the 2022 Freedom Convoy. #POEC 
 
I also discuss a wild development in the Rouleau Commission. Following a letter sent to the Commission by the CCF on October 20 with 2 other groups, the Commission has issued a summons to Premier Ford and Former Solicitor General Sylvia Jones. They have relevant evidence to give the Commission. 
 
However, Ford and Jones have refused the summons and are challenging it in court. We are very disappointed that Premier Ford and Minister Jones are forcing the Commission to go to court. They have relevant evidence and should testify before the Commission as soon as possible. In this video I also briefly summarize the evidence provided by acting Ottawa Chief of Police Steve Bell.

Commission says it sent Ford 'repeated invitations' to testify

Ontario Premier Doug Ford has been summoned to testify at the Emergencies Act inquiry — but his government says he'll be challenging the summons in court.

The inquiry is looking into the federal government's use of the Emergencies Act in response to the protest convoy that descended on Ottawa and a number of border crossings last winter.

Ford and Ontario Health Minister Sylvia Jones — who was the province's solicitor general during the protests — have been asked by the commission to appear a number of times, according to a letter from the commission's legal counsel which was provided to CBC.

"It was our hope that Premier Ford and Minister Jones would agree to appear before the Commission voluntarily," the letter reads.

"However, given that the repeated invitations were all declined, the Commission has issued summons this day to Premier Ford and Minister Jones."

The commission has the legal authority to call witnesses to testify before the inquiry. A spokesperson for the Ontario attorney general's office said the government will be challenging the summons, arguing that Jones and the premier are covered by parliamentary privilege.

"Overall, our view has always been that this was a policing matter and the police witnesses that are testifying can best provide the commission with the evidence it needs," the spokesperson said in an email.

The Canadian Civil Liberties Association, an advocacy group participating in the inquiry, called Ford's decision to challenge the summons "disappointing."

"The fact that the province of Ontario would go this far to ensure that the premier and former solicitor general Jones don't have to appear in person and give evidence is quite striking," said Laura Berger, a lawyer with the association. "It's disappointing and it seems like yet another attempt to evade accountability and transparency."

Lawyer Paul Champ, who is representing a coalition of community associations and business improvement areas in downtown Ottawa before the inquiry, said Ford's testimony is "the missing piece" and called on the premier to reconsider his court challenge.

"[Parliamentary privilege] is usually, in my experience, just when a politician doesn't want to answer questions in court," Champ said.

The letter said Ford and Jones were asked to sit for private interviews with the commission's legal counsel as early as Sept. 19. The commission said it later asked them them to testify voluntarily; it did not say when that request was made.

At an unrelated press conference last Monday, a reporter asked Ford why he wouldn't be testifying at the inquiry.

"I have not been asked," Ford said in response.

Evidence presented to the commission during the public hearings suggests that Ottawa had been asking the province for more police resources during the protests.

In a Feb. 7 letter sent to Jones, Mayor Jim Watson asked Queen's Park to help fill Ottawa's request for 1,800 officers and called the situation in Ottawa "tantamount to psychological warfare."

During his testimony last week, Watson told the commission he was frustrated by Ford's refusal to participate in a meeting between the three levels of government to discuss the situation in his city.

Watson suggested Ford was staying away "because of politics" and called Jones's claim that Ontario was providing 1,500 officers "disingenuous" during a Feb. 8 call with Prime Minister Justin Trudeau.

"We are fighting a losing battle, it's like whack-a-mole," Watson said, according to a rough transcript of the call.

Ottawa Mayor Jim Watson pleaded with the Ontario government for help to deal with the ‘lawlessness’ caused by the protest convoy, but grew frustrated with the lack of response, a public inquiry into the federal government’s use of the Emergencies Act heard.

Trudeau commiserated over Ontario's response during that call.

"Doug Ford has been hiding from his responsibility on it for political reasons," Trudeau said, according to the transcript. "And [it's] important that we don't let them get away from that."

Watson's testimony and the accompanying evidence came the day after he attended an unrelated press conference with Ford and Trudeau.

During that press conference, Ford said he supported the federal government's use of the Emergencies Act, adding he "stood shoulder to shoulder with the prime minister."

On Feb. 14, the federal government invoked the Emergencies Act in response to the convoy protest's occupation of downtown Ottawa. That gave authorities new powers to freeze the finances of those connected to blockades and protests, ban travel to protest zones, prohibit people from bringing minors to unlawful assemblies and commandeer tow trucks.

The commission has been directed to examine the circumstances that led to the declaration of a public emergency, including the actions of police prior to and after the declaration.

Criminal Intelligence Bureaus

CISC Central Bureau: CISC Central Bureau is responsible for the
delivery of criminal intelligence products and services to the
national law enforcement community and other stakeholders responsible
for public safety. It also oversees the maintenance of a criminal
intelligence databank on organized crime used by the CISC membership
across Canada. CISC Central Bureau is part of National Police
Services, which consists of a number of different and specialized
programs and services stewarded by the RCMP.

Provincial Bureaus: The ten provincial bureaus operate independently
while maintaining national service delivery standards. They focus on
activities within their respective provinces and guide the collection,
analysis and production of criminal intelligence products and services
at the provincial level. The intelligence collected and analyzed
through the provincial bureaus is instrumental in the creation of the
national intelligence products and services delivered by CISC Central
Bureau.
Governance

National Executive Committee: CISC's strategic direction is governed
by a Constitution and by the National Executive Committee (NEC). As
CISC's governing body, the NEC provides strategic leadership to ensure
that CISC is able to fulfill its mandate. Meeting annually, the
committee is comprised of approximately 25 ex-officio members who are
leaders from Canada's law enforcement community at the municipal,
provincial and federal levels.

Provincial Executive Committees: The ten provincial criminal
intelligence service bureaus receive strategic direction from their
Provincial Executive Committee (PEC). Each of the PEC Chairs is an
ex-officio member of the National Executive Committee.
National Collaboration

The Criminal Intelligence Network: CISC member agencies exchange
information and intelligence on organized criminal activity. CISC
Central Bureau classifies member agencies into three categories:

    Category I – Police Agency: The agency has full police officer
authority provided under a Canadian federal or provincial police act.
The primary role of the agency is law enforcement and the agency
contributes to the criminal intelligence process.
    Category II – Agency with Specific Law Enforcement Role: The
agency has specific but limited law enforcement responsibilities. Its
authority is provided under specific federal or provincial legislation
(e.g. Customs Act, Immigration Act, Provincial Wildlife Act). Category
II Membership may be granted to a foreign law enforcement or
intelligence agency if, as determined by the respective Provincial
Executive Committee, it is deemed to be in the best interest of the
broader criminal intelligence community.
    Category III – Agency with Role Complementary to Law Enforcement:
The agency has no direct law enforcement authority but provides
assistance to law enforcement agencies.

Clients, Partners and Stakeholders: CISC is an active member of the
Canadian Association of Chiefs of Police's Organized Crime Committee
and the Canadian Integrated Response to Organized Crime (CIROC). In
addition, CISC is a member of both the National and Regional
Co-ordinating Committees' National Work Plan to Combat Organized
Crime, operated by the Federal, Provincial and Territorial Ministers
responsible for Justice and Public Safety.

Canadian Law Enforcement Strategy to Combat Organized Crime: The
Canadian Law Enforcement Strategy embodies the partnership between the
functions of intelligence and operations across all jurisdictions of
law enforcement. This agreement enables the integration and
cooperation of intelligence and operations through CISC and the
Canadian Integrated Response to Organized Crime (CIROC) – under the
governance of the National Executive Committee and each Provincial
Executive Committee. Participating agencies commit to: contributing
information to a common, national intelligence database; collecting
and sharing information for the production of an annual, integrated
threat assessment; and, using the resulting threat assessments for
enforcement priority setting.


Criminal Intelligence Service of New Brunswick helping to combat crime

FREDERICTON (CNB) - The Criminal Intelligence Service New Brunswick
(CISNB) opened its new office in Fredericton today.
CISNB stems from the Criminal Intelligence Service Canada (CISC),
which is an organization that provides the facilities to unite the
criminal intelligence units of Canadian law enforcement agencies in
the fight against organized crime in Canada.
CISNB will work in close partnership with CISC, the RCMP, municipal
and regional police forces and federal and provincial enforcement
agencies. "It will support law enforcement in the prevention, control
and investigation of organized crime while enhancing public safety,"
CISNB Director Mike Connolly said. "The service will help further the
efforts of law enforcement to collect and analyze criminal information
and set priorities more effectively in order to combat organized
crime."
Public Safety Minister Wayne Steeves is pleased the Province has
invested in this project. "In recognition of the direct link between
safety and security, and intelligence, we increased our support for
Criminal Intelligence Service New Brunswick," the minister said. "Led
by the policing community, this service will help ensure better
coordination of all law enforcement efforts to gather and share
criminal intelligence in order to combat organized crime, serious
crime, and terrorist activity."

CISNB releases first report on organized and serious crime in N.B. (04/10/13)

FREDERICTON (CNB) - The Criminal Intelligence Service New Brunswick
(CISNB) has released its first public report on Organized and Serious
Crime in New Brunswick.

The release took place today during the opening of the16th annual
Atlantic Criminal Intelligence Workshop. Taking part in the opening
were Public Safety Minister Wayne Steeves, the director of CISNB, Mike
Connolly; Chief Mac Carlisle of the Fredericton Police Force, and
Deputy Chief Al Bodechon, the chair of CISNB's Provincial Committee.
More than 70 representatives from federal, provincial and municipal
law enforcement agencies are attending the workshop.

"This report highlights the nature and scope of organized crime in our
province," Steeves said. "While New Brunswick's crime rate is among
the lowest in the country, it is important for people to realize that
organized crime is becoming more common throughout Canada. It poses a
serious long-term threat to our institutions, society, economy, and to
our quality of life. People need to know that these groups exist. They
need to know that they should not support them and that they should
report any suspicious activity to the police."

The report covers analysis on several aspects of organized crime in
New Brunswick, including cybercrime, drugs, economic crime, gang
activity, motor vehicle crime, outlaw motorcycle gangs, organized
crime at the border, ports, and airports, sexual exploitation of
children, and wood theft.

Among the report's findings is an increase in marijuana grow
operations, a rapid increase in fraud in New Brunswick to one of the
highest levels in Canada, a significant problem with motor vehicle
thefts, and the proliferation of local organized crime groups in
illegally harvesting wood. The report also indicates increased
influence and control of crime in New Brunswick by organized crime
from outside the province.

"We hope this report will raise the awareness of the public that
organized crime does exist here in New Brunswick," Connolly said. "If
the public is more vigilant about noticing organized crime and passing
the information on to police, law enforcement agencies will be in a
better position to tackle this growing problem."

The CISNB is one of nine provincial bureaus of the Criminal
Intelligence Service Canada (CISC). Located in Fredericton, CISNB
supports law enforcement through the collection, analysis and
dissemination of criminal intelligence.

REASONS FOR JUDGMENT BY THE COURT

I.                    Introduction

[1]               On September 16, 2015, David Raymond Amos (Mr. Amos)
filed a 53-page Statement of Claim (the Claim) in Federal Court
against Her Majesty the Queen (the Crown). Mr. Amos claims $11 million
in damages and a public apology from the Prime Minister and Provincial
Premiers for being illegally barred from accessing parliamentary
properties and seeks a declaration from the Minister of Public Safety
that the Canadian Government will no longer allow the Royal Canadian
Mounted Police (RCMP) and Canadian Forces to harass him and his clan
(Claim at para. 96).

[2]               On November 12, 2015 (Docket T-1557-15), by way of a
motion brought by the Crown, a prothonotary of the Federal Court (the
Prothonotary) struck the Claim in its entirety, without leave to
amend, on the basis that it was plain and obvious that the Claim
disclosed no reasonable claim, the Claim was fundamentally vexatious,
and the Claim could not be salvaged by way of further amendment (the
Prothontary’s Order).


[3]               On January 25, 2016 (2016 FC 93), by way of Mr.
Amos’ appeal from the Prothonotary’s Order, a judge of the Federal
Court (the Judge), reviewing the matter de novo, struck all of Mr.
Amos’ claims for relief with the exception of the claim for damages
for being barred by the RCMP from the New Brunswick legislature in
2004 (the Federal Court Judgment).


[4]               Mr. Amos appealed and the Crown cross-appealed the
Federal Court Judgment. Further to the issuance of a Notice of Status
Review, Mr. Amos’ appeal was dismissed for delay on December 19, 2016.
As such, the only matter before this Court is the Crown’s
cross-appeal.


II.                 Preliminary Matter

[5]               Mr. Amos, in his memorandum of fact and law in
relation to the cross-appeal that was filed with this Court on March
6, 2017, indicated that several judges of this Court, including two of
the judges of this panel, had a conflict of interest in this appeal.
This was the first time that he identified the judges whom he believed
had a conflict of interest in a document that was filed with this
Court. In his notice of appeal he had alluded to a conflict with
several judges but did not name those judges.

[6]               Mr. Amos was of the view that he did not have to
identify the judges in any document filed with this Court because he
had identified the judges in various documents that had been filed
with the Federal Court. In his view the Federal Court and the Federal
Court of Appeal are the same court and therefore any document filed in
the Federal Court would be filed in this Court. This view is based on
subsections 5(4) and 5.1(4) of the Federal Courts Act, R.S.C., 1985,
c. F-7:


5(4) Every judge of the Federal Court is, by virtue of his or her
office, a judge of the Federal Court of Appeal and has all the
jurisdiction, power and authority of a judge of the Federal Court of
Appeal.

[7]               However, these subsections only provide that the
judges of the Federal Court are also judges of this Court (and vice
versa). It does not mean that there is only one court. If the Federal
Court and this Court were one Court, there would be no need for this
section.
[8]               Sections 3 and 4 of the Federal Courts Act provide that:

[9]               Sections 3 and 4 of the Federal Courts Act create
two separate courts – this Court (section 3) and the Federal Court
(section 4). If, as Mr. Amos suggests, documents filed in the Federal
Court were automatically also filed in this Court, then there would no
need for the parties to prepare and file appeal books as required by
Rules 343 to 345 of the Federal Courts Rules, SOR/98-106 in relation
to any appeal from a decision of the Federal Court. The requirement to
file an appeal book with this Court in relation to an appeal from a
decision of the Federal Court makes it clear that the only documents
that will be before this Court are the documents that are part of that
appeal book.


[10]           Therefore, the memorandum of fact and law filed on
March 6, 2017 is the first document, filed with this Court, in which
Mr. Amos identified the particular judges that he submits have a
conflict in any matter related to him.


[11]           On April 3, 2017, Mr. Amos attempted to bring a motion
before the Federal Court seeking an order “affirming or denying the
conflict of interest he has” with a number of judges of the Federal
Court. A judge of the Federal Court issued a direction noting that if
Mr. Amos was seeking this order in relation to judges of the Federal
Court of Appeal, it was beyond the jurisdiction of the Federal Court.
Mr. Amos raised the Federal Court motion at the hearing of this
cross-appeal. The Federal Court motion is not a motion before this
Court and, as such, the submissions filed before the Federal Court
will not be entertained. As well, since this was a motion brought
before the Federal Court (and not this Court), any documents filed in
relation to that motion are not part of the record of this Court.


[12]           During the hearing of the appeal Mr. Amos alleged that
the third member of this panel also had a conflict of interest and
submitted some documents that, in his view, supported his claim of a
conflict. Mr. Amos, following the hearing of his appeal, was also
afforded the opportunity to provide a brief summary of the conflict
that he was alleging and to file additional documents that, in his
view, supported his allegations. Mr. Amos submitted several pages of
documents in relation to the alleged conflicts. He organized the
documents by submitting a copy of the biography of the particular
judge and then, immediately following that biography, by including
copies of the documents that, in his view, supported his claim that
such judge had a conflict.


[13]           The nature of the alleged conflict of Justice Webb is
that before he was appointed as a Judge of the Tax Court of Canada in
2006, he was a partner with the law firm Patterson Law, and before
that with Patterson Palmer in Nova Scotia. Mr. Amos submitted that he
had a number of disputes with Patterson Palmer and Patterson Law and
therefore Justice Webb has a conflict simply because he was a partner
of these firms. Mr. Amos is not alleging that Justice Webb was
personally involved in or had any knowledge of any matter in which Mr.
Amos was involved with Justice Webb’s former law firm – only that he
was a member of such firm.


[14]           During his oral submissions at the hearing of his
appeal Mr. Amos, in relation to the alleged conflict for Justice Webb,
focused on dealings between himself and a particular lawyer at
Patterson Law. However, none of the documents submitted by Mr. Amos at
the hearing or subsequently related to any dealings with this
particular lawyer nor is it clear when Mr. Amos was dealing with this
lawyer. In particular, it is far from clear whether such dealings were
after the time that Justice Webb was appointed as a Judge of the Tax
Court of Canada over 10 years ago.


[15]           The documents that he submitted in relation to the
alleged conflict for Justice Webb largely relate to dealings between
Byron Prior and the St. John’s Newfoundland and Labrador office of
Patterson Palmer, which is not in the same province where Justice Webb
practiced law. The only document that indicates any dealing between
Mr. Amos and Patterson Palmer is a copy of an affidavit of Stephen May
who was a partner in the St. John’s NL office of Patterson Palmer. The
affidavit is dated January 24, 2005 and refers to a number of e-mails
that were sent by Mr. Amos to Stephen May. Mr. Amos also included a
letter that is addressed to four individuals, one of whom is John
Crosbie who was counsel to the St. John’s NL office of Patterson
Palmer. The letter is dated September 2, 2004 and is addressed to
“John Crosbie, c/o Greg G. Byrne, Suite 502, 570 Queen Street,
Fredericton, NB E3B 5E3”. In this letter Mr. Amos alludes to a
possible lawsuit against Patterson Palmer.
[16]           Mr. Amos’ position is that simply because Justice Webb
was a lawyer with Patterson Palmer, he now has a conflict. In Wewaykum
Indian Band v. Her Majesty the Queen, 2003 SCC 45, [2003] 2 S.C.R.
259, the Supreme Court of Canada noted that disqualification of a
judge is to be determined based on whether there is a reasonable
apprehension of bias:
60        In Canadian law, one standard has now emerged as the
criterion for disqualification. The criterion, as expressed by de
Grandpré J. in Committee for Justice and Liberty v. National Energy
Board, …[[1978] 1 S.C.R. 369, 68 D.L.R. (3d) 716], at p. 394, is the
reasonable apprehension of bias:
… the apprehension of bias must be a reasonable one, held by
reasonable and right minded persons, applying themselves to the
question and obtaining thereon the required information. In the words
of the Court of Appeal, that test is "what would an informed person,
viewing the matter realistically and practically -- and having thought
the matter through -- conclude. Would he think that it is more likely
than not that [the decision-maker], whether consciously or
unconsciously, would not decide fairly."

[17]           The issue to be determined is whether an informed
person, viewing the matter realistically and practically, and having
thought the matter through, would conclude that Mr. Amos’ allegations
give rise to a reasonable apprehension of bias. As this Court has
previously remarked, “there is a strong presumption that judges will
administer justice impartially” and this presumption will not be
rebutted in the absence of “convincing evidence” of bias (Collins v.
Canada, 2011 FCA 140 at para. 7, [2011] 4 C.T.C. 157 [Collins]. See
also R. v. S. (R.D.), [1997] 3 S.C.R. 484 at para. 32, 151 D.L.R.
(4th) 193).

[18]           The Ontario Court of Appeal in Rando Drugs Ltd. v.
Scott, 2007 ONCA 553, 86 O.R. (3d) 653 (leave to appeal to the Supreme
Court of Canada refused, 32285 (August 1, 2007)), addressed the
particular issue of whether a judge is disqualified from hearing a
case simply because he had been a member of a law firm that was
involved in the litigation that was now before that judge. The Ontario
Court of Appeal determined that the judge was not disqualified if the
judge had no involvement with the person or the matter when he was a
lawyer. The Ontario Court of Appeal also explained that the rules for
determining whether a judge is disqualified are different from the
rules to determine whether a lawyer has a conflict:
27        Thus, disqualification is not the natural corollary to a
finding that a trial judge has had some involvement in a case over
which he or she is now presiding. Where the judge had no involvement,
as here, it cannot be said that the judge is disqualified.


28        The point can rightly be made that had Mr. Patterson been
asked to represent the appellant as counsel before his appointment to
the bench, the conflict rules would likely have prevented him from
taking the case because his firm had formerly represented one of the
defendants in the case. Thus, it is argued how is it that as a trial
judge Patterson J. can hear the case? This issue was considered by the
Court of Appeal (Civil Division) in Locabail (U.K.) Ltd. v. Bayfield
Properties Ltd., [2000] Q.B. 451. The court held, at para. 58, that
there is no inflexible rule governing the disqualification of a judge
and that, "[e]verything depends on the circumstances."


29        It seems to me that what appears at first sight to be an
inconsistency in application of rules can be explained by the
different contexts and in particular, the strong presumption of
judicial impartiality that applies in the context of disqualification
of a judge. There is no such presumption in cases of allegations of
conflict of interest against a lawyer because of a firm's previous
involvement in the case. To the contrary, as explained by Sopinka J.
in MacDonald Estate v. Martin (1990), 77 D.L.R. (4th) 249 (S.C.C.),
for sound policy reasons there is a presumption of a disqualifying
interest that can rarely be overcome. In particular, a conclusory
statement from the lawyer that he or she had no confidential
information about the case will never be sufficient. The case is the
opposite where the allegation of bias is made against a trial judge.
His or her statement that he or she knew nothing about the case and
had no involvement in it will ordinarily be accepted at face value
unless there is good reason to doubt it: see Locabail, at para. 19.


30        That brings me then to consider the particular circumstances
of this case and whether there are serious grounds to find a
disqualifying conflict of interest in this case. In my view, there are
two significant factors that justify the trial judge's decision not to
recuse himself. The first is his statement, which all parties accept,
that he knew nothing of the case when it was in his former firm and
that he had nothing to do with it. The second is the long passage of
time. As was said in Wewaykum, at para. 85:
            To us, one significant factor stands out, and must inform
the perspective of the reasonable person assessing the impact of this
involvement on Binnie J.'s impartiality in the appeals. That factor is
the passage of time. Most arguments for disqualification rest on
circumstances that are either contemporaneous to the decision-making,
or that occurred within a short time prior to the decision-making.
31        There are other factors that inform the issue. The Wilson
Walker firm no longer acted for any of the parties by the time of
trial. More importantly, at the time of the motion, Patterson J. had
been a judge for six years and thus had not had a relationship with
his former firm for a considerable period of time.


32        In my view, a reasonable person, viewing the matter
realistically would conclude that the trial judge could deal fairly
and impartially with this case. I take this view principally because
of the long passage of time and the trial judge's lack of involvement
in or knowledge of the case when the Wilson Walker firm had carriage.
In these circumstances it cannot be reasonably contended that the
trial judge could not remain impartial in the case. The mere fact that
his name appears on the letterhead of some correspondence from over a
decade ago would not lead a reasonable person to believe that he would
either consciously or unconsciously favour his former firm's former
client. It is simply not realistic to think that a judge would throw
off his mantle of impartiality, ignore his oath of office and favour a
client - about whom he knew nothing - of a firm that he left six years
earlier and that no longer acts for the client, in a case involving
events from over a decade ago.
(emphasis added)

[19]           Justice Webb had no involvement with any matter
involving Mr. Amos while he was a member of Patterson Palmer or
Patterson Law, nor does Mr. Amos suggest that he did. Mr. Amos made it
clear during the hearing of this matter that the only reason for the
alleged conflict for Justice Webb was that he was a member of
Patterson Law and Patterson Palmer. This is simply not enough for
Justice Webb to be disqualified. Any involvement of Mr. Amos with
Patterson Law while Justice Webb was a member of that firm would have
had to occur over 10 years ago and even longer for the time when he
was a member of Patterson Palmer. In addition to the lack of any
involvement on his part with any matter or dispute that Mr. Amos had
with Patterson Law or Patterson Palmer (which in and of itself is
sufficient to dispose of this matter), the length of time since
Justice Webb was a member of Patterson Law or Patterson Palmer would
also result in the same finding – that there is no conflict in Justice
Webb hearing this appeal.

[20]           Similarly in R. v. Bagot, 2000 MBCA 30, 145 Man. R.
(2d) 260, the Manitoba Court of Appeal found that there was no
reasonable apprehension of bias when a judge, who had been a member of
the law firm that had been retained by the accused, had no involvement
with the accused while he was a lawyer with that firm.

[21]           In Del Zotto v. Minister of National Revenue, [2000] 4
F.C. 321, 257 N.R. 96, this court did find that there would be a
reasonable apprehension of bias where a judge, who while he was a
lawyer, had recorded time on a matter involving the same person who
was before that judge. However, this case can be distinguished as
Justice Webb did not have any time recorded on any files involving Mr.
Amos while he was a lawyer with Patterson Palmer or Patterson Law.

[22]           Mr. Amos also included with his submissions a CD. He
stated in his affidavit dated June 26, 2017 that there is a “true copy
of an American police surveillance wiretap entitled 139” on this CD.
He has also indicated that he has “provided a true copy of the CD
entitled 139 to many American and Canadian law enforcement authorities
and not one of the police forces or officers of the court are willing
to investigate it”. Since he has indicated that this is an “American
police surveillance wiretap”, this is a matter for the American law
enforcement authorities and cannot create, as Mr. Amos suggests, a
conflict of interest for any judge to whom he provides a copy.

[23]           As a result, there is no conflict or reasonable
apprehension of bias for Justice Webb and therefore, no reason for him
to recuse himself.

[24]           Mr. Amos alleged that Justice Near’s past professional
experience with the government created a “quasi-conflict” in deciding
the cross-appeal. Mr. Amos provided no details and Justice Near
confirmed that he had no prior knowledge of the matters alleged in the
Claim. Justice Near sees no reason to recuse himself.

[25]           Insofar as it is possible to glean the basis for Mr.
Amos’ allegations against Justice Gleason, it appears that he alleges
that she is incapable of hearing this appeal because he says he wrote
a letter to Brian Mulroney and Jean Chrétien in 2004. At that time,
both Justice Gleason and Mr. Mulroney were partners in the law firm
Ogilvy Renault, LLP. The letter in question, which is rude and angry,
begins with “Hey you two Evil Old Smiling Bastards” and “Re: me suing
you and your little dogs too”. There is no indication that the letter
was ever responded to or that a law suit was ever commenced by Mr.
Amos against Mr. Mulroney. In the circumstances, there is no reason
for Justice Gleason to recuse herself as the letter in question does
not give rise to a reasonable apprehension of bias.


III.               Issue

[26]           The issue on the cross-appeal is as follows: Did the
Judge err in setting aside the Prothonotary’s Order striking the Claim
in its entirety without leave to amend and in determining that Mr.
Amos’ allegation that the RCMP barred him from the New Brunswick
legislature in 2004 was capable of supporting a cause of action?

IV.              Analysis

A.                 Standard of Review

[27]           Following the Judge’s decision to set aside the
Prothonotary’s Order, this Court revisited the standard of review to
be applied to discretionary decisions of prothonotaries and decisions
made by judges on appeals of prothonotaries’ decisions in Hospira
Healthcare Corp. v. Kennedy Institute of Rheumatology, 2016 FCA 215,
402 D.L.R. (4th) 497 [Hospira]. In Hospira, a five-member panel of
this Court replaced the Aqua-Gem standard of review with that
articulated in Housen v. Nikolaisen, 2002 SCC 33, [2002] 2 S.C.R. 235
[Housen]. As a result, it is no longer appropriate for the Federal
Court to conduct a de novo review of a discretionary order made by a
prothonotary in regard to questions vital to the final issue of the
case. Rather, a Federal Court judge can only intervene on appeal if
the prothonotary made an error of law or a palpable and overriding
error in determining a question of fact or question of mixed fact and
law (Hospira at para. 79). Further, this Court can only interfere with
a Federal Court judge’s review of a prothonotary’s discretionary order
if the judge made an error of law or palpable and overriding error in
determining a question of fact or question of mixed fact and law
(Hospira at paras. 82-83).

[28]           In the case at bar, the Judge substituted his own
assessment of Mr. Amos’ Claim for that of the Prothonotary. This Court
must look to the Prothonotary’s Order to determine whether the Judge
erred in law or made a palpable and overriding error in choosing to
interfere.


B.                 Did the Judge err in interfering with the
Prothonotary’s Order?

[29]           The Prothontoary’s Order accepted the following
paragraphs from the Crown’s submissions as the basis for striking the
Claim in its entirety without leave to amend:

17.       Within the 96 paragraph Statement of Claim, the Plaintiff
addresses his complaint in paragraphs 14-24, inclusive. All but four
of those paragraphs are dedicated to an incident that occurred in 2006
in and around the legislature in New Brunswick. The jurisdiction of
the Federal Court does not extend to Her Majesty the Queen in right of
the Provinces. In any event, the Plaintiff hasn’t named the Province
or provincial actors as parties to this action. The incident alleged
does not give rise to a justiciable cause of action in this Court.

21.       The few paragraphs that directly address the Defendant
provide no details as to the individuals involved or the location of
the alleged incidents or other details sufficient to allow the
Defendant to respond. As a result, it is difficult or impossible to
determine the causes of action the Plaintiff is attempting to advance.
A generous reading of the Statement of Claim allows the Defendant to
only speculate as to the true and/or intended cause of action. At
best, the Plaintiff’s action may possibly be summarized as: he
suspects he is barred from the House of Commons.

[30]           The Judge determined that he could not strike the Claim
on the same jurisdictional basis as the Prothonotary. The Judge noted
that the Federal Court has jurisdiction over claims based on the
liability of Federal Crown servants like the RCMP and that the actors
who barred Mr. Amos from the New Brunswick legislature in 2004
included the RCMP (Federal Court Judgment at para. 23). In considering
the viability of these allegations de novo, the Judge identified
paragraph 14 of the Claim as containing “some precision” as it
identifies the date of the event and a RCMP officer acting as
Aide-de-Camp to the Lieutenant Governor (Federal Court Judgment at
para. 27).


[31]           The Judge noted that the 2004 event could support a
cause of action in the tort of misfeasance in public office and
identified the elements of the tort as excerpted from Meigs v. Canada,
2013 FC 389, 431 F.T.R. 111:


[13]      As in both the cases of Odhavji Estate v Woodhouse, 2003 SCC
69 [Odhavji] and Lewis v Canada, 2012 FC 1514 [Lewis], I must
determine whether the plaintiffs’ statement of claim pleads each
element of the alleged tort of misfeasance in public office:

a) The public officer must have engaged in deliberate and unlawful
conduct in his or her capacity as public officer;

b) The public officer must have been aware both that his or her
conduct was unlawful and that it was likely to harm the plaintiff; and

c) There must be an element of bad faith or dishonesty by the public
officer and knowledge of harm alone is insufficient to conclude that a
public officer acted in bad faith or dishonestly.

(Federal Court Judgment at para. 28).

[32]           The Judge determined that Mr. Amos disclosed sufficient
material facts to meet the elements of the tort of misfeasance in
public office because the actors, who barred him from the New
Brunswick legislature in 2004, including the RCMP, did so for
“political reasons” (Federal Court Judgment at para. 29).

[33]           This Court’s discussion of the sufficiency of pleadings
in Merchant Law Group v. Canada (Revenue Agency), 2010 FCA 184, 321
D.L.R (4th) 301 is particularly apt:

…When pleading bad faith or abuse of power, it is not enough to
assert, baldly, conclusory phrases such as “deliberately or
negligently,” “callous disregard,” or “by fraud and theft did steal”.
“The bare assertion of a conclusion upon which the court is called
upon to pronounce is not an allegation of material fact”. Making bald,
conclusory allegations without any evidentiary foundation is an abuse
of process…

To this, I would add that the tort of misfeasance in public office
requires a particular state of mind of a public officer in carrying
out the impunged action, i.e., deliberate conduct which the public
officer knows to be inconsistent with the obligations of his or her
office. For this tort, particularization of the allegations is
mandatory. Rule 181 specifically requires particularization of
allegations of “breach of trust,” “wilful default,” “state of mind of
a person,” “malice” or “fraudulent intention.”
(at paras. 34-35, citations omitted).

[34]           Applying the Housen standard of review to the
Prothonotary’s Order, we are of the view that the Judge interfered
absent a legal or palpable and overriding error.

[35]           The Prothonotary determined that Mr. Amos’ Claim
disclosed no reasonable claim and was fundamentally vexatious on the
basis of jurisdictional concerns and the absence of material facts to
ground a cause of action. Paragraph 14 of the Claim, which addresses
the 2004 event, pleads no material facts as to how the RCMP officer
engaged in deliberate and unlawful conduct, knew that his or her
conduct was unlawful and likely to harm Mr. Amos, and acted in bad
faith. While the Claim alleges elsewhere that Mr. Amos was barred from
the New Brunswick legislature for political and/or malicious reasons,
these allegations are not particularized and are directed against
non-federal actors, such as the Sergeant-at-Arms of the Legislative
Assembly of New Brunswick and the Fredericton Police Force. As such,
the Judge erred in determining that Mr. Amos’ allegation that the RCMP
barred him from the New Brunswick legislature in 2004 was capable of
supporting a cause of action.

[36]           In our view, the Claim is made up entirely of bare
allegations, devoid of any detail, such that it discloses no
reasonable cause of action within the jurisdiction of the Federal
Courts. Therefore, the Judge erred in interfering to set aside the
Prothonotary’s Order striking the claim in its entirety. Further, we
find that the Prothonotary made no error in denying leave to amend.
The deficiencies in Mr. Amos’ pleadings are so extensive such that
amendment could not cure them (see Collins at para. 26).

V.                 Conclusion
[37]           For the foregoing reasons, we would allow the Crown’s
cross-appeal, with costs, setting aside the Federal Court Judgment,
dated January 25, 2016 and restoring the Prothonotary’s Order, dated
November 12, 2015, which struck Mr. Amos’ Claim in its entirety
without leave to amend.

Vernon Darryl White (born February 21, 1959) is a Canadian former senator and former chief of the Ottawa Police Service.[1]

Education

White holds a professional doctorate degree in police leadership from Charles Sturt University, a Master of Arts degree in conflict studies from Royal Roads University, a Bachelor of Arts degree in sociology and psychology from Acadia University, and a diploma in Business Administration.[2]

Police career

Before becoming chief of police for the Durham Regional Police Service, he served 24 years in the ranks of the Royal Canadian Mounted Police, including as Assistant Commissioner for Information and Identification, in the Ottawa region. White also has experience in various communities across Canada. As chief, he was responsible for community law enforcement in Canada's national capital city. He had been chief of police for the Durham Regional Police Service and succeeded Vince Bevan on May 22, 2007.[2]

Political career

On January 6, 2012, Prime Minister Stephen Harper announced White's appointment to the Senate; his appointment came into effect on February 20, 2012, in order to allow him to complete his term as Ottawa police chief.[3][4] Like the other senators appointed at the time, White pledged to support the government's efforts on senate reform.[4] White said that, even if term limits were not enacted, he would step down voluntarily after nine years (no later than February 20, 2021).[5]

On November 4, 2019, Senator White joined the Canadian Senators Group and, since the CSG, like the ISG requires non-partisanship and refraining from all political party activities, left the Conservative Party of Canada.[6]

In January 2021, White confirmed that he travelled to Finland to visit his spouse's parents on December 28, 2020, contrary to public health advice to avoid international travel amid the COVID-19 pandemic in Canada. White said that he was quarantining for 10 days and getting two COVID-19 tests per Finland's pandemic guidelines.[7]

In June 2021, it was reported that while White was the Chief of the Ottawa Police Service (OPS), Const. Kimberly Cadarette brought directly to White's attention sexual harassment and bullying occurring against her by other members of the OPS. In response, Cadarette said the manager of health and safety and a recruiter informed her that the chief wanted her firearm to be taken away and for her to be put on desk duty until she was evaluated by a psychologist. They told Cadarette her handgun was being removed from her locker as they spoke. She was ordered to see a person who was later revealed to be impersonating Dr. Ron Frey, a certified psychologist, to determine her fitness for duty. Cadarette met the real Dr. Ron Frey in 2021 and the Ottawa Police Service will launch a criminal investigation, however, staff working with the OPS wellness program had known about the possible fraud for eight months, but there was no apparent move toward an investigation until CBC made inquiries. When reached for comment, in White said he remembers Cadarette's name but does not recall meeting her in person. White said it's unlikely he would have asked two civilian employees to tell an officer their sidearm was being removed, saying that's the responsibility of senior officers. He also said it's the force's doctor that recommends mental health assessments, not the chief.[8]

On September 29, 2022, White announced he would be resigning from the Senate and moving to Finland, where his family has a home. The resignation took effect on October 2.[9]

White, 63, will officially leave the Senate on October 2.

Then-prime minister Stephen Harper appointed White in 2012 as a Conservative representing Ontario. White has been sitting with the non-partisan Canadian Senators Group since 2019.

White said he always intended to resign before reaching the Senate's retirement age.

The resignation was first reported by The Hill Times.

"When I came to the Senate … I said I felt it would be a six- to nine-year job," White said.

"I never thought I'd serve until 75 like some people speak about. I always felt it would be a term, like I've done with most of my jobs."

White says he's moving to Finland, where his daughter is going to school and his family has a home.

White travelled to the country in 2021 to visit his spouse's family, even though officials were warning against any non-essential travel due to the pandemic.

White was a police officer before his appointment. He joined the RCMP in 1981 as a constable. He rose to the rank of assistant commissioner before retiring from the Mounties in 2005.

He then became chief of the Durham Regional Police Service before being named Ottawa's chief of police in 2007. He served in that position until his Senate appointment in 2012.

Senator preferred policing over Parliament

White said that while he enjoyed some of his work in the Senate and will miss his colleagues there, he liked policing more than Parliament.

"I won't miss the Senate as such. From my perspective, it's not a place I fell in love with. Policing I probably loved, I never fell in love with the Senate," White said.

"In law enforcement I felt you could make a difference quickly ... I felt the Senate — as one senator told me — you nudge things forward. I've never been great at nudging."

The Canadian Senators Group was created in 2019 and White was one of its founding members. The group formed with the goal of focusing on regional interests in Parliament and taking a research-based, non-partisan approach to legislation.

White said working in a non-partisan group allowed him to focus on areas he's passionate about, such as addressing drug addiction and the opioid epidemic.

"I do feel that we were able to pursue our own areas of interest," White said.

"For me it was around opioids, in particular in the last four or five years, and the need for a dramatic shift in how we deal with opioid addiction and overdoses."

White, a former Conservative senator, said more Conservative senators may cross the floor to one of the chamber's non-partisan groups in the future.

"I think it will depend on how the Conservative Party moves forward over the next year or two," he said.

"If there's a movement, I think it will be bigger than the Senate. I think it'll be a movement of Canadians trying to find a place if they don't feel the Conservative Party is their voice."

Conservative Party members chose long-time member of Parliament Pierre Poilievre as leader earlier this month. Alain Rayes, a Quebec MP, left the party shortly after, citing conflicts with Poilievre's ideals and values. Rayes now sits as an independent.

Earlier this year, a new organization — "Centre Ice Conservatives" — emerged as a voice for centrist Conservatives who are unsatisfied with the party's direction. The group is now known as Centre Ice Canadians.

White's departure from the Senate will create a vacancy on the government-appointed National Security and Intelligence Committee of Parliamentarians (NSICOP).

White said he's looking forward to new opportunities.

"I'm still humbled and honoured to have had an opportunity to serve in the Canadian Senate," White said.

"I'm leaving with good thoughts. I'm looking for my next big adventure more than anything else."

Senior Ottawa police officer suspended in misconduct probe

Supt. Mark Patterson was suspended with pay on Wednesday

A senior Ottawa police officer has been suspended from duty amid an ongoing misconduct investigation, CBC News has learned.

Supt. Mark Patterson was suspended on Wednesday, according to a force-wide email sent by interim police chief Steve Bell that was obtained by CBC.

"We take this very seriously, and the matter is being fully investigated by the Professional Standards Unit," Bell wrote in the email.

Ottawa police will not comment on the nature of the allegations, nor did they reveal the scope of the investigation to officers, but sources say it involves multiple complainants.

Patterson has been a public-facing senior officer responsible at times for recruiting, intelligence and major police incidents. (CBC)

At the time of his suspension, Patterson was superintendent of the intelligence directorate and was overseeing units such as intelligence and surveillance. He has previously been a public-facing senior officer in charge of recruiting new cops to the service.

Patterson served as one of the incident commanders during the weeks-long Freedom Convoy occupation earlier this year, before he was removed by then chief Peter Sloly. 

"While the investigation continues, it is important that we respect the process and await the findings before drawing any conclusions," Bell said in the email. "Wellness supports are being put in place for the individuals involved in this investigation."

Patterson's suspension came on the same day he was scheduled to deliver a disciplinary decision in an unrelated misconduct case. Patterson is a disciplinary hearing officer and adjudicates cases of officer misconduct for the service.

The other appearance was cancelled on Wednesday morning. Patterson was suspended around the same time.

Ottawa police began investigating the alleged misconduct themselves, but have since asked the Ontario Provincial Police to take on the investigation. Typically, the force asks outside police agencies to investigate officers of rank for the sake of transparency and accountability.

Patterson's suspension comes with pay.

Eric Stubbs from RCMP will become Ottawa's next police chief

Deputy chief Steve Bell has been serving as interim chief since Peter Sloly resigned amid convoy protest

Eric Stubbs, an assistant commissioner with the RCMP in British Columbia, was named the new chief of the Ottawa Police Service on Friday afternoon, as a federal inquiry drags on into the protest that resulted in the former chief's resignation and the complete overhaul of the police oversight board.

For the past five years Stubbs has served as Criminal Operations Officer in charge of core policing for the B.C. Mounties.

His leadership of the national capital's police service will take effect Nov. 17, 2022.

"We are confident he will earn the trust, confidence and the heart of members of the Ottawa Police Service, as well as the ... community," said Eli El-Chantiry, the current chair of the Ottawa Police Services Board, in a virtual news conference Friday announcing the hire.

The hiring team was impressed by Stubbs's ability to connect with people, El-Chantiry added.

Peter Sloly resigned as chief more than eight months ago at the height of the convoy occupation in the city's downtown core.

Deputy chief Steve Bell had been serving as interim chief since then.

El-Chantiry thanked Bell for his service Friday, saying "he has done a great job" leading the force through the end of the protest, the subsequent Rolling Thunder protest, big events like St. Patrick's Day and Canada Day, and May's fatal derecho windstorm.

Stubbs — who recently caught COVID and was unable to travel to Ottawa for Friday's announcement — said the appointment is "truly an honour" and that he's "humbled" to serve in the capital. He also thanked Bell for his work as interim chief, calling him a "true leader" and adding that he's "respected [Bell] from afar" for a number of months.

"I don't take this role lightly, and the road ahead will be challenging. And ... we will strive to meet those expectations every day," Stubbs said.

Timing remains under scrutiny

Earlier this week, mayoral candidates Bob Chiarelli and Catherine McKenney wrote to the Ontario Civilian Police Commission asking that it look into the board's decision to hire a new chief before the new city council is sworn in on Nov. 15.

In a letter to the civilian police oversight body, they asked that the commission investigate a "potential conflict:" that the board chair is an honourary co-chair of Mark Sutcliffe's campaign, and that Sutcliffe is the only leading mayoral candidate in favour of hiring a new chief before Monday's municipal election.

The Ottawa Police Services Board disputes that characterization of the move.

"The board takes this opportunity to remind the candidates, and clarify for the public, that the Police Services Board is a distinct and separate body from City Council, created by …the Police Services Act," a news release from the board said on Thursday.

El-Chantiry has pointed out that it is the board's statutory obligation to hire a new chief and the new board likely wouldn't convene until late 2022 or early 2023, which would make hiring a new chief before the spring unlikely. 

He added Friday that other municipalities are looking for new police chiefs, and Ottawa "wanted to get ahead of that." He also said the board had been working hard "non-stop" since late July to find a replacement, and that it would be "unacceptable" to expect residents to wait longer.

Faces a 'massive challenge' 

Michael Kempa, an associate professor of criminology at the University of Ottawa, said Stubbs is walking into a "massive challenge" given what has been revealed at the ongoing public inquiry into the federal government's use of the Emergencies Act, which includes inner police "dysfunction" during the convoy protest.

"We hope that he turns out to be perhaps the greatest chief that we've seen in Ottawa's history. We're going to need one," Kempa said. 

Coming from outside Ottawa may make it more difficult for Stubbs to effect change, he added. 

Kempa alluded to the uneasy relationship between the Ottawa Police Association and Sloly, the police's first Black chief who entered the job with a mandate to change the internal culture of the force. Sloly himself, in recent testimony before a parliamentary committee, spoke to those tensions. 

"He's going to have to get used to, as an RCMP officer, working with a very well-developed union here in Ottawa that will chew up an outsider whose agenda they don't agree with," Kempa said of Stubbs. 

Biography

Stubbs first became an RCMP officer in 1993, serving in six B.C. communities, including Prince George.

In 2014 he moved to RCMP headquarters in Ottawa as director general of national criminal operations, where he remained until 2017 with a portfolio including national use of force policy, operational policy, traffic services and the operational research unit.

In 2017 he returned to B.C. to head the overall strategic direction, leadership, and operations of Core Policing functions in the province.

It's a portfolio that includes overseeing 125 RCMP detachments and specialized units such as Emergency Response Teams, Indigenous policing, highway patrol and more.

Move to hire interim chief in February ended badly

Briefly in February, the Ottawa Police Services Board was poised to bring in a new interim chief, but that process ended in a dramatic overhaul of the board and the candidate withdrawing.

That event has been dissected this week at the ongoing public inquiry.

Following Sloly's resignation, Coun. Diane Deans was removed from her role as chair of the board after offering the job to an outside candidate without consulting council.

FREDERICTON - The New Brunswick government has launched a lawsuit
against an accounting firm in an effort to recover $50 million
provided as loan guarantees to the Miramichi-based Atcon group of
companies.

The lawsuit filed with the Court of Queen's Bench in Saint John
alleges that Grant Thornton was in breach of its duties to the
province in an inspection of the financial books of the Atcon group of
companies.

The former Liberal government of then premier Shawn Graham provided
the loan guarantees to the companies in 2009.

The statement of claim alleges the government approved the loan
guarantees as a result of financial reports from Grant Thornton.

"But for the Grant Thornton opinions and representations, the province
would not have sustained a loss in excess of $50 million," the
document asserts.

It says the accounting firm "failed to exercise the care, diligence,
and skill of an auditor of reasonable competence and prudence."

None of the allegations contained in the statement of claim have been
proven in court.

Atcon, based in Miramichi, went bankrupt in April 2010.

Grant Thornton LLP, Grant Thornton International and a chartered
accountant who works for the company are named as the defendants. They
have not filed a statement of defence and the accountant named in the
statement of claim could not be reached for comment.

Norm Raynard, managing partner in New Brunswick for Grant Thornton,
said in an emailed statement that the company would not offer specific
comments on the lawsuit because they are still reviewing the court
documents.

"We will vigorously defend ourselves against this action," he wrote.

"Our initial reaction is that this timing has much to do with the
political calendar in the province."

The next provincial election is set for Sept. 22.

Attorney General Hugh Flemming said the timing is not political.

"This is not a time schedule which in any way was influenced by the
government and it is not a political issue," he said Tuesday.

He said the government had no choice but to take the matter to court
because of the $50 million that was spent.

"The government owes a duty to the people of New Brunswick to do what
they can to recover this," Flemming said.

'Strong suspects' but no charges in Highway of Tears cases: RCMP

VANCOUVER - The Mountie overseeing the investigation into the murders
and disappearances of women and girls along British Columbia's
so-called Highway of Tears says his officers have a number of "strong
suspects," but they have yet to uncover enough evidence to lay charges
nearly two years after the last major break in the case.

Staff-Sgt. Wayne Clary leads project E-PANA, which has spent years
investigating the deaths and disappearances of 18 women and girls
along three highways in the province's north.

Roughly 60 officers were assigned to the case at the height of the
investigation, though Clary said that number has dropped to between 12
and 15, who spend most of their time on the project. Still, he said
E-PANA is very much an active investigation.

"It has scaled down, because we've pounded through a lot of work, but
there's still enough work in front of us to keep going," Clary told
The Canadian Press.

"There's more than one investigation where we have strong suspects or
persons of interest, and we're clearly focusing on those. ... I'd like
nothing more than to sit down with the families and say, 'We've got
the guy."'

Clary declined to offer details about how many suspects the RCMP have
identified or in which specific cases, though he said the suspects
they have in mind are located in Canada.

The last significant development came in September 2012, when
investigators said they believed a dead American convict named Bobby
Jack Fowler was responsible for killing as many as three of the women.

The RCMP said investigators had uncovered DNA evidence linking Fowler,
who died in an Oregon prison in 2006, to Colleen MacMillen, who was
murdered in 1974. They also said they believed Fowler may have been
involved in the deaths of Gale Weys and Pamela Darlington, both 19,
who were killed in the mid-1970s.

Clary said the force doesn't have the same kind of direct evidence
tying Fowler to Weys and Darlington, but he added: "Personally, I
think it's him in the other two."

Clary said E-PANA hasn't come up with evidence to suggest any of the
other women and girls were linked together, meaning there could be 15
different suspects for the 15 remaining cases.

"If we have a strong suspect, absolutely we're looking for crossed
lines, but right now we're not seeing that," he said.

E-PANA was launched in 2005 amid growing concern about the number of
women and girls who vanished or were found dead along highways in the
province's north. It also came several years after serial killer
Robert Pickton was arrested in the Vancouver area - a case that Clary
worked on as part of Project Evenhanded.

The Highway of Tears often refers to a remote stretch of Highway 16
between Prince Rupert and Prince George, but E-PANA also includes
cases along the adjacent Highways 97 and 5.

Investigators identified 18 women and girls who were involved in
hitchhiking or other high-risk behaviour and were last seen within a
couple of kilometres of those highways. The final list included cases
between 1969 and 2006.

Investigators once held annual group meetings, but Clary said they now
contact each family individually, either in person or by telephone.

After three years as the top cop in Prince George and a combined 14
years in Northern BC, Superintendent Eric Stubbs is leaving Prince
George and province.

Friday June 27, marks the final day Superintendent Stubbs will be in
charge of the RCMP’s Municipal Detachment in Prince George, a position
he held since arriving in June 2011. During his time here,
Superintendent Stubbs has reduced crime in nearly every category,
created a unit dedicated to combating domestic violence, and was a
catalyst in the transformation of the Community Policing Section to a
new model with focuses on youth and enforcement. Of course, he was
also the detachment commander leading up to, during and following the
move to the new City of Prince George Municipal Detachment.

“I would like to thank Superintendent Stubbs for his excellent service
to Prince George and northern B.C.,” said Mayor Shari Green of Prince
George, in a press release. “Among the many achievements on his watch,
I’d like to point out his dedication to reducing domestic violence,
the continued support of the Downtown Enforcement Unit, and his
essential role in the Mayor’s Task Force on Crime. I wish
Superintendent Stubbs every success in this next exciting phase of his
service to Canadians.”

Stubbs will be taking on a new role as National Criminal Operations
Officer in Ottawa; a role that comes with a promotion to Chief
Superintendent.

Superintendent Stubbs has provided a tremendous service to the
citizens of northern BC through his work in four communities over 14
years said Supt. Lesley Bain, acting officer in charge of the RCMP in
northern B.C. He has had a significant impact in each community he has
policed, none more than Prince George. He will be greatly missed and
we wish him the best in his new role in Ottawa.

Inspector Brad Anderson, the Detachment’s Operations officer, will
take over command of the detachment until such time that a successor
is named.

On behalf of the members, staff and volunteers of the Prince George
RCMP, I want to extend a thank you to Eric for his leadership over the
past three years said Anderson. It has been a pleasure working for him
in such a positive environment.

KPMG  obviously had to do with their fraudulent auditing of the
Brookline Bancorp etc (Putnam Investments is now owned by Power Corp
BTW) while many Yankees, the USDOJ and the US Treasury Dept attacked
my family and I in order to cover up their many wrongs. Meanwhile the

Canadian Securities Regulators Publish Discussion Paper on Mutual Fund Fees

Toronto – The Canadian Securities Administrators (CSA) today published
for comment CSA Discussion Paper 81-407 Mutual Fund Fees, which
examines the mutual fund fee structure in Canada and identifies
potential investor protection issues arising from that structure. The
Discussion Paper sets out various topics for discussion in order to
evaluate the appropriate structure for Canada.

Canada’s mutual fund fees have been the subject of much debate in
recent years. Some research studies examining Canada’s mutual fund
fees, along with international reforms, have prompted greater interest
in reviewing the issue of mutual fund fees in Canada.

“Mutual funds are a key investment in the portfolios of many
Canadians,” said Bill Rice, Chair of the CSA and Chair and CEO of the
Alberta Securities Commission. “It is important that we look at
Canada’s mutual fund fee structure carefully in determining what
changes could or should be considered to enhance investor protection
and foster confidence in our market.”

To date, the CSA has focused its efforts on enhancing the transparency
of mutual fund fees and commissions through initiatives such as the
Point of Sale, and Cost Disclosure and Performance Reporting projects.
While these initiatives remain a priority on behalf of investors, the
CSA has determined that it is also necessary to consult extensively
with investors and market participants to explore whether further
issues remain.

The CSA welcomes feedback on the Discussion Paper, which can be found
on CSA members’ websites. The comment period is open until April 12,
2013. All comments will be considered in the CSA’s decision and next
steps, and also assist in the development of a roundtable the CSA
plans to hold with investors and industry participants in 2013.

The CSA, the council of the securities regulators of Canada’s
provinces and territories, coordinates and harmonizes regulation for
the Canadian capital markets.

As your attachment sent today refers from Premier Graham, our position
is clear on your dead calf issue: Our forensic labs do not process
testing on animals in cases such as yours, they are referred to the
Atlantic Veterinary College in Charlottetown who can provide these
services. If you do not choose to utilize their expertise in this
instance, then that is your decision and nothing more can be done.

As for your other concerns regarding the US Government, false
imprisonment and Federal Court Dates in the US, etc... it is clear
that Federal authorities are aware of your concerns both in Canada and
theUS. These issues do not fall into the purvue of Detachment policing
in Petitcodiac, NB.

It was indeed an interesting and informative conversation we had on

PM invokes immunity to avoid testifying at ex-candidate's libel trial

Prime Minister Stephen Harper is claiming parliamentary immunity to
avoid giving evidence in a libel lawsuit launched by a prominent
Ottawa lawyer who stepped aside as an election candidate to make way
for sponsorship whistleblower Allan Cutler.

Mr. Harper's lawyer, Richard Dearden, told court yesterday sections of
the Constitution and the Parliament of Canada Act prevent the prime
minister from being compelled to testify in the legal action by lawyer
Alan Riddell as long as Parliament is in session.
Mr. Dearden served notice of the immunity claim in legal documents he
filed before he and a lawyer for the Conservative party, Robert
Houston, convinced a judge yesterday to postpone a trial that was to
begin this week on a claim related to the libel action.
"It's absolute," Mr. Dearden said after presenting his arguments to
Justice Monique Metivier.

"Any member of Parliament can invoke parliamentary privilege when
Parliament is in session. No reasons need be given."

Allan Riddell has sued Mr. Harper and Don Plett, the president of the
Conservative party, over their claims in November 2005 there was no
agreement between Mr. Riddell and the party for him to step aside to
let Mr. Cutler run in the campaign that fall.

The agreement, which a Superior Court judge ruled last year had been
reached between Mr. Riddell and the Conservatives, included a promise
that Mr. Riddell would be compensated for expenses he incurred while
campaigning for the Conservative nomination in Ottawa South.

But the Conservative party claims the agreement also included an
unstated term of confidentiality, which it says Mr. Riddell breached
when he publicly disclosed its existence.

The trial Judge Metivier postponed to an unscheduled date was to have
decided whether the agreement included a clause of confidentiality.

Superior Court Justice Denis Power ruled last year that, even if there
was a confidentiality clause, the agreement continued to exist even
though Mr. Riddell disclosed its existence. The trial of Mr. Riddell's
libel claims against Mr. Harper and Mr. Plett is not scheduled to
begin until February.

But the acrimonious atmosphere of the legal proceedings that have
taken place behind close doors so far, primarily in examinations of
discovery to gather evidence, surfaced as Mr. Houston, Mr. Dearden and
Tom Conway, Mr. Riddell's lawyer, exchanged barbs before the judge.

Mr. Dearden told Judge Metivier he had been "ambushed" by Mr. Conway
with last-minute information.

Meanwhile, Mr. Houston reacted angrily to statements Mr. Conway made

the confidentiality clause because they had "painted themselves in a

The claim of secrecy creates an unwholesome image of "cigar-smoking
backroom boys" cutting a political deal behind closed doors, Mr.

Threat against Burke taken seriously

An RCMP security detail has been guarding Justice Minister and
Attorney General T.J. Burke because of threats made against him
recently.

Burke, the Liberal MLA for Fredericton-Fort Nashwaaksis, wouldn't
explain the nature of the threats.

"I have had a particular individual or individuals who have made
specific overtures about causing harm towards me," he told reporters
Wednesday.

"The RCMP has provided security to me recently by accompanying me to a
couple of public functions where the individual is known to reside or
have family members in the area," said Burke. "It is nice to have some
added protection and that added comfort."

The RCMP provides protection to the premier and MLAs with its VIP security unit.

Burke didn't say when the threat was made but it's believed to have
been in recent weeks.

"When a threat is posed to you and it is a credible threat, you have
to be cautious about where you go and who you are around," he said.
"But again, I am more concerned about my family as opposed to my own
personal safety."

Burke said he doesn't feel any differently and he has not changed his
pattern of activity.

"It doesn't bother me one bit," he said. "It makes my wife feel awful nervous."

Burke served in an elite American military unit before becoming a
lawyer and going into politics in New Brunswick.

"(I) have taken my own precautions and what I have to do to ensure my
family's safety," he said. "I am a very cautious person in general due
to my background and training.

"I am comfortable with defending myself or my family if it ever had to happen."

Burke said it is not uncommon for politicians to have security concerns.

"We do live unfortunately in an age and in a society now where threats
have to be taken pretty seriously," he said.

Since the terrorism attacks in the United States on Sept. 11, 2001,
security in New Brunswick has been

beefed up.

Metal detectors were recently installed in the legislature and all
visitors are screened.

The position of attorney general is often referred to as the
province's "top cop."

Burke said sometimes people do not differentiate between his role as
the manager of the justice system and the individual who actually
prosecutes them.

"With the job sometimes comes threats," he said. "I have had numerous
threats since Day 1 in office."

Burke said he hopes his First Nations heritage has nothing to do with it.

"I think it is more of an issue where people get fixated on a matter
and they believe you are personally responsible for assigning them
their punishment or their sanction," he said.

Is the threat from someone who was recently incarcerated?

"I probably shouldn't answer that," he replied.

Reporters asked when the threat would be over.

"I don't think a threat ever passes once it has been made," said
Burke. "You have to consider the credibility of the source."

Bruce Fitch, former justice minister in the Conservative government,
said "every now and again there would be e-mails that were not
complimentary."

"I did have a meeting with the RCMP who are in charge of the security
of the MLAs and ministers," said Fitch.

"They look at each and every situation."

Fitch said he never had bodyguards assigned to him although former
premier Bernard Lord and former health minister Elvy Robichaud did
have extra security staff assigned on occasion.

He said if any MLA felt threatened, he or she would discuss it with the RCMP.

complaint concerning the conduct of a member of the RCMP in the
performance of his or her duties, please submit it to the Commission
by Canada Post only.  As of now, your e-mails will be deleted unread.
