N.B., P.E.I., Ottawa join N.S. court case on Chignecto Isthmus costs — but local MLA left out

Court of Appeal will decide who is responsible for cost of isthmus repairs

This summer, the Nova Scotia government asked the court to rule on a constitutional question of who must cover the cost to shore up infrastructure on the isthmus, which is vulnerable to catastrophic flooding.

The work is estimated to cost hundreds of millions of dollars. A 2022 report commissioned by Nova Scotia, New Brunswick and Ottawa offered three blueprints ranging in price from $189 million to $300 million. More recently, New Brunswick received an estimate that suggests the costs could reach $650 million.

The governments of Nova Scotia and New Brunswick want Ottawa to foot the entire bill, while Ottawa wants a cost-sharing deal.

The other Maritime provinces, Ottawa and Smith-McCrossin — whose riding, Cumberland North, includes the Isthmus — all applied for intervenor status in the case. Justice David Farrar considered their bids at a hearing Thursday morning.

Before making a ruling, Farrar asked the legal team for Nova Scotia's attorney general for its opinion on each of the possible intervenors.

Other parties rejected MLA's application

Lawyer Jeremy Smith said the province consented to the intervention of each of the other governments, but didn't think Smith-McCrossin's position on the matter was distinct from that of the provincial governments.

Lawyers for Ottawa, New Brunswick and P.E.I. each echoed Smith, saying they doubted Smith-McCrossin's presence as an intervenor would add to the proceedings.

At the end of the brief hearing, Farrar decided to let the three governments join the case as intervenors, but he rejected Smith-McCrossin's application.

"It's not necessary to make the determination that this court needs to make on the constitutional question," he said of Smith-McCrossin's participation in the case.

Worried about delays

Smith-McCrossin said she was disappointed but respected the decision.

"The people that live on or near the Chignecto Isthmus have very real concerns: flooding, the risk to their lives and property. And I wanted to ensure that the people there are truly represented in this case," she said in an interview following the hearing.

She said her constituents are worried the court proceedings could drag on, delaying the start of work to repair the centuries-old dikes that hold back the ocean tides.

"We can't afford any delays in getting the dikes raised and getting the work done. This work should have started years ago, to be honest."

The critical transportation corridor is becoming increasingly vulnerable to flooding as the condition of the aging dikes continues to decline, and extreme weather events increase in frequency due to climate change.

Senate bill would make feds responsible for Chignecto Isthmus work

Cost to protect strip of land linking N.B. and N.S. estimated at $650 million

New Brunswick Sen. Jim Quinn says he introduced the Chignecto Isthmus Dykeland System Act to draw attention to the issue after years of discussion about how to protect the Chignecto Isthmus.

"We have to look to see what is the right thing to do and how do we get it underway as soon as possible so that we don't run into situations that could be disastrous," Quinn said in an interview Tuesday morning before the bill was introduced.

The isthmus is a low-lying strip of land with a rail line, highway, fibre optic line, and power lines protected by dikes built centuries ago. An estimated $35 billion in trade each year crosses the isthmus, which studies have said is at risk of flooding and halting that trade.

Isthmus bill is ‘in the general interest of Canada,’ senator says

Duration 0:52
New Brunswick Sen. Jim Quinn is proposing legislation to protect the low-lying Chignecto Isthmus from flooding.

A report released last year looked at three options to protect the isthmus, with the options costing tens of millions of dollars. This year, the New Brunswick government said the estimated cost is now closer to $650 million.

The bill would invoke section 92(10) of the Constitution, which allows the federal government to take jurisdiction of undertakings that are in the national interest.

It's something Quinn said was done in 2014 when the federal government paid for a new Champlain Bridge in Montreal, as well as a new international bridge in Windsor to the United States.

"There's no doubt that the road and rail and communication infrastructure that flows through the isthmus is definitely in the general interest of Canada," Quinn said.

'Key transportation logistics point,' says Quinn

Quinn said he's interested in the issue in part because of his previous job as CEO of Port Saint John and the impact of trade on the broader economy.

"It's a key transportation logistics point for our Canadian economy," Quinn said of the isthmus.

"There's been discussions for decades on this issue. And I kind of thought, well, enough discussion. There's time now to raise this so that it's more in the eyes of the federal government."

A map of the Chignecto Isthmus that connects New Brunswick and Nova Scotia The Chignecto Isthmus connects Nova Scotia with the rest of Canada. (CBC News)

The provinces and federal government have publicly squabbled about who should pay for the work.

The federal government has offered to pay for half of the work, while the provinces argue the federal government should cover the full cost.

The two provinces reluctantly submitted an application for funding this summer for federal funding while also asking Nova Scotia's Appeal Court to rule on whether Ottawa has exclusive responsibility to maintain the dikes and other structures.

New Brunswick Premier Blaine Higgs was asked about the bill during a news conference on an unrelated topic Tuesday morning. Higgs said there are past examples where the federal government has paid the full cost.

"So I think that Sen. Quinn has a very valid argument to make," Higgs said.

The bill goes for second reading in the Senate Thursday. Quinn said he hopes it will be sent to a committee for further discussion. However, he said he knows it won't be easy to get the bill passed.

"Hopefully we'll move forward and it will have a measure of success that will allow this thing to be addressed," Quinn said.

Storm anxiety

In the border town of Tantramar, Mayor Andrew Black welcomes the bill particularly after post-tropical storm Lee put the risk back in the spotlight.

"It seems like every big storm that comes our way, people get more and more anxious," Black said in an interview. "You know, is this going to be the storm that cuts us off from Nova Scotia?"

Community leaders have feared a storm coming up the Bay of Fundy at high tide would cause the dikes to fail, cutting off Nova Scotia.

Black said they were fortunate the conditions weren't right with Lee.

Quinn puts it more bluntly.

"We dodged a bullet yet again," he said.

Obviously this issue is clearly a federal responsibility (regardless of the political stripe in power), and would be a non-issue if it was a main link between Ontario and Quebec.

The Trudeau government, has usual, has chosen to make it political and impose their own edict from the Ottawa throne (the sunny ways myth continues).

Dominic LeBlanc, as usual, is doing nothing for the province he supposedly represents.

PEI had to pay for their own bridge. They are still paying for it. It
isn't a Trudeau issue although that doesn't suit your narrative.

Come on now Dominic is busy collecting money for his re election campaign. That is all he does all day .

The two are totally comparable, you mean. It is a continuous link between provinces via the Trans-Canada Highway.

Don Corey

Reply to Anne Bochan
The Northumberland Strait is not a "continuous link". The Chignecto Isthmus most definitely is.

David Amos
Reply to Don Corey
The line was drawn by the Crown across the Chignecto Isthmus in 1784 creating New Brunswick yet we still don't have a Constitution to this very day. We must rely on amending the Federal Charter to make changes such as creating a Language Commissioner etc. Hence IMHO everything involving New Brunswick is a Federal issue whether Dominic LeBlanc and his cohorts like it or not

Maritime moose sex corridor gets land donation

'When you conjure it up, you can only smile at the imagery'

The Canadian Press · Posted: Jun 25, 2013 12:23 PM ADT

A New Brunswick has donated land to the Nature Conservancy to help promote cross-border moose mating.

The Nature Conservancy of Canada has received 316 hectares of private land from a former top diplomat to promote cross-border moose love along the Nova Scotia-New Brunswick boundary.

The land conservation organization has been attempting to assemble a corridor of land on the Chignecto Isthmus between the two provinces as part of its so-called Moose Sex Project.

Derek Burney, former Canadian ambassador to the United States and chief of staff to Brian Mulroney when he was prime minister, said when he heard of the project he was amused and inspired.

Before anyone listening to Senator Quinn remember he was the guy that brought AIM to Saint John. Now look at the mess the City is left with while he sits in Ottawa . He does not even live in the CIty. What does he have to say about AIM now? How in the world does funding this project help Saint John in any way? It helps the Port of Halifax. It also greatly helps CN Rail since it is their rail line that runs out of Halifax. CN is very very profitable so why are they not kicking in money. This guy really should not be a Senator and should apologize to the citizens of Saint John .

In this episode of the Freedom Update, Christine gives a critical
update about our case challenging the federal government’s use of the
Emergencies Act. The government had previously fought the Canadian
Constitution Foundation’s challenge, including be claiming that they
had to keep documents that reveal the reason for invoking the act
secret.

The government has now changed their position, and is releasing those
documents to us. This is a huge breakthrough in our case, and our team
of lawyers will now be going through the documents to make sure the
government isn’t hiding anything. And if they are, we will be heading
back to court.

Our main challenge to the federal government’s use of the Emergencies
Act will now be heard in October, and we are gearing up for a big
fight.
