Saint John councillors urge owners of vacant buildings to show some responsibility

'If you can't look after your property, sell it,' says Coun. Paula Radwan

Saint John councillors say they want to see owners of the city's vacant, and in some cases dilapidated, buildings take responsibility for their properties, after voting to demolish a rundown four-unit residential building.

"I feel like if you can't look after your property, somebody will be ready to buy your property," Coun. Paula Radwan said at a council meeting on Monday night.

The building they voted to demolish is three storeys and located in the city's south end on Duke Street near Wentworth Street. It suffers from cracks, tears, mould and other types of damage to its structure, ceilings, floors and walls, both inside and out.

Radwan expressed frustration at the battered state of the property.

"We have a housing crisis," she said. "If you have one of these properties and it's looking something like this, get a hold of a real estate agent if you're not going to do anything with it, because this is costing taxpayers money."

The recommendation to demolish the building was brought before council by Justin Tinker, manager of the city's vacant and dangerous buildings program, who said the property poses a danger to public safety.

"A section of the building, particularly the west load-bearing wall, has separated from the foundation, presenting a risk of failure," he said.

"Several wall and ceiling surfaces have cracked and bulged, and stairwells in the vicinity of the west exterior wall have tilted inward. The building continues to experience water infiltration that further deteriorates the structure."

While the building has been boarded up, Tinker said, it has been broken into and used to provide shelter.

Tinker told council during his presentation that there are roughly 150 vacant properties in the city.

"So far this year the program has resolved 29 cases, with nearly three quarters of those buildings being repaired and reoccupied by owners," he said.

"However, in some cases, it does become necessary for staff to pursue demolition of a vacant building when it becomes a hazard to public safety."

Radwan praised the work being done by the city's staff but said these buildings are a drain on city resources.

"There's no need for it anymore, because somebody is ready to buy a house, to buy any vacant land," she said. "This is totally unacceptable. If you can't look after your property, sell it."

According to a staff report to council, the owner of the Duke Street building vacated it in 2023. The safety concerns, the report says, were identified by the city's minimum property standards program, which enforces standards for maintenance and occupancy of the city's residential buildings.

The report says a notice to comply was sent to the building owner in January, giving them 60 days to demolish the building or submit plans for repairs.

The owner, the report says, determined that the building wasn't salvageable and planned to demolish it and rebuild in its place. The owner, however, missed deadlines, prompting the city to take over.

The property's assessed value is $258,000 according to the staff report. Demolishing it is expected to cost $55,000.

'I think there's a social responsibility here'

Coun. Barry Ogden echoed Radwan, urging owners to take responsibility for their properties and avoid using up staff time and taxpayer money.

"If we're chasing somebody and they don't respond because they don't care, there is an economic cost to that, and it's tax dollars," Ogden said.

These buildings have a negative impact on communities and that these owners are neglecting their social responsibility, he said.

"There is a tremendous good feeling in communities when the buildings are painted or the grass is cut," Ogden said.

"We have people in Saint John who do not do that, and sometimes we have to chase them. But it does deteriorate a community when somebody doesn't paint their building, doesn't cut their grass [and] allows this to happen, so I think there's a social responsibility here."

Benn Purinton, manager of community standards compliance, said in an interview with CBC News after the common council meeting that the city is on track to "resolve" about 60 vacant buildings by the end of the year.

"Last year, we resolved 47," Purinton said. "We're on pace to exceed that number. The target of our program was to hit about 60."

J.D. Irving's efforts to demolish Saint John heritage building one step closer to reality

In a marathon session, Saint John city council tentatively agreed to allow three J.D. Irving properties to be removed from a heritage designation.

The controversial properties at 111-119 King St. East include two vacant lots and a large, dilapidated post-war home.

J.D. Irving purchased the properties in the mid-1990s, and they are adjacent to the company's Saint John headquarters.

The company has been seeking the change since 2016 and wants to demolish the building, which has been vacant, unheated and boarded up for six years.

The company has argued the building, known as the Brown House, does not fit into the streetscape with neighbouring buildings, mostly built in an earlier period, and therefore isn't historically significant.

But the Heritage Preservation Board did not agree with the argument and refused to make the changes.

In the meantime, the building continued to degrade, and in early 2020, Mayor Donna Reardon, who was then a city councillor, questioned the company's motives.

"My concern is that neglect is happening there." Reardon said.

"The building will be lost over time. It looks like there's absolutely no intention of trying to save it or salvage it or do anything with it."

The public hearing on Monday night was to consider a proposal by the company to turn the site of the building into a play park in exchange for the removal of the heritage designations on all three properties.

J.D. Irving would agree to maintain the park for 20 years.

When asked why the company has no interest in selling the property. Irving spokesperson Douglas Dean said it was considered important because of its proximity to its headquarters, and the company did not want to lose control of the land.

Public opposition voiced

There were many people who opposed the project at Monday night's council meeting.

Greg Patterson, a resident landlord, told council he pushed the idea of a heritage area on King Street East starting in 1998, until it became a reality.

"Seven buildings specifically were torn down in King Street East in six years," Patterson said. "So we designated the streetscape in 2005.

"Since that time, there were no demolitions on King Street East. There's been hundreds of thousands of dollars of historic restorations done to properties in my neighbourhood."

Patterson said that if J.D.Irving wants to build a park, the company could do it on the vacant lot it owns next door and fix the building instead.

"So let's do both. Let them keep the property for the restoration and repurpose. Let them build the park."

John Fraser owns property on nearby Princess Street.

He told council he had spoken in favour of the removal of a heritage designation on two different properties, including his own, and was turned down.

"Both of those applicants involved people who restored buildings, people who maintained buildings, people who paid for the electricity, people who kept the heat on, people who housed people who work in the city and pay taxes in the city." Fraser said.

"And now there's a building that someone, because of their own choices has neglected, has become more derelict than it previously was. And they're asking to be let out under special circumstances. To me that is wrong."

Jennifer Brown of Dillon Consulting spoke on behalf of J.D. Irving. Her company was asked to inspect the building.

She said the engineers report deemed the cost of restoration was not feasible, stating the rear section of the building was structurally unsound and the front section, while in somewhat better shape, would have to be stripped to bare timbers to remove mold damage and hazardous materials.

There were others who spoke in favour of the idea, including real estate agent Bob McVicar and historian Harold Wright.

Many councillors expressed concerns and said they could not support the plan.

Coun. David Hickey pointed to a clause in the contract which would allow J.D. Irving to stop maintaining the park if vandalism becomes a big issue.

Council asked staff to take a second look at whether that should remain.

Coun. Paula Radwan said she couldn't support the plan and expressed disappointment at J.D. Irving's handling of the issue.

"You buy a building, you own it, you look after it. If you can't, sell it to somebody who will," she said.

Coun. Joanna Killen, Coun. Greg Norton and Hickey also voted no.

But the slim majority voted in favour.

Coun. Gary Sullivan seemed to sum up what many of the others on that side were thinking.

"We have no power to compel them to do anything with the building except what they are doing with the building right now," he said.

"It's currently a horrible eyesore in a prominent location uptown. Do I as a councillor want to have it sitting there as a dilapidated eyesore for the next X number of years?"

The proposal still has to pass third reading.

Council voted Monday to accept sanctions against Coun. Paula Radwan, with mayor declining to confirm nature of complaint

SAINT JOHN, N.B. — A Saint John councillor has been sanctioned for breaching a code of conduct, council heard Monday, although neither the details of the allegation nor the sanction have been made public.

Saint John common council voted Monday to accept the findings of a March 22 investigator's report regarding a code of conduct complaint against Coun. Paula Radwan. The motion came from the closed committee of the whole meeting that happened beforehand, which also recommended "remedial sanctions" against Radwan, according to the motion.

The motion stipulates "that Coun. Radwan breached sections of the code of conduct bylaw and accepts the remedial sanctions recommended by committee of the whole, including that the details of the sanction imposed remain private," as read aloud by city clerk Jonathan Taylor.

The motion passed 5-0, with Couns. John MacKenzie, Greg Norton, Gary Sullivan, David Hickey and Barry Ogden voting in favour. Radwan left the room before the motion was read, as did Couns. Greg Stewart and Gerry Lowe. Couns. Brent Harris and Joanna Killen did not attend the meeting.

The city's code of conduct bylaw, first passed in 2019 and revised in 2022, governs the roles and responsibilities of council members, including their performance of official duties, how they conduct business with each other and communicate with the public.

It covers everything from directing a councillor not to "impugn or malign a debate or decision or otherwise erode the authority of council" to use of social media, conflicts of interest, sexual harassment, discrimination and bullying.

When asked about the nature of the code of conduct allegation against Radwan, Mayor Donna Reardon said the motion itself "was it," and said no information will be made available.

"What I'll say is, it's an internal document for us," Reardon said. When asked whether council is an internal or public body, she said, "I can't get into that."

When reached by phone Monday night, Radwan acknowledged that she broke the code of conduct and said that while council was "as fair as they can be" in handling the complaint, the process "needs to change."

"I just hope that council can come together and work as a team going forward, and move on from it," Radwan said. "I'm looking forward to pushing the city along in a good direction."

Radwan said she would only address the code of conduct generally, saying it "ends up being a very one-sided thing."

"If someone puts a code of conduct (complaint) in about another person, they can only look at what that one person did, and not the whole situation," Radwan said.

She referred to former Saint John mayor and MP Elsie Wayne, who she described as "well-respected" and "a good fighter for Saint John."

"I think that if Elsie Wayne was around these days, she'd have a heck of a lot of code of conducts against her," Radwan said.

Under the bylaw, formal complaints are received by a council committee, which decides whether to retain an external investigator. The investigator is required to allow 10 days for a written response, explore informal resolution and provide a written report no later than 90 days after the complaint.

Possible sanctions can include a letter of reprimand, exclusion from committees, an apology or a restriction on pay for up to ninety days. The investigator may also recommend no punishment be taken if the breach was trivial, inadvertent, "a genuine error of judgment" or if the council member took steps to prevent it.

In October, Couns. Harris and Killen were stripped of committee roles pending a code of conduct investigation following complaints regarding comments supporting CUPE 486, the union representing the city's inside workers, during a strike.

The pair filed a lawsuit alleging that the councillors were not given chances to respond to the comments before council imposed a sanction, which was settled in January.

At the time, the city said in a statement that there were code of conduct breaches but "no malice or ill will involved," and that the councillors "apologized for any error on their part."

When council accepted the settlement agreement and reinstated the councillors Jan. 22, Radwan spoke to say she would vote against the motion "just because I didn't want to take this step." At the time, she continued to say Killen and Harris "had their best intentions" before Reardon cut her off, with the mayor saying what was in the statement "was what we can state."

Brunswick News has requested comment from the City of Saint John and did not receive a response by press time.

Rothesay resident and local fisher Liz Kramer, a newcomer to municipal
politics, is challenging incumbent mayor Nancy Grant for the mayor's
seat in Rothesay.

Kramer, who describes herself as a mother first, told the
Telegraph-Journal she makes her living fishing in the Saint John
harbour and Kennebecasis River.

While she's never had a seat at the council table, Kramer said she had
successfully petitioned council to re-establish beach access for
residents at Cameron Road in 2019.

"I approach all issues with similar tenacity and I believe the people
of Rothesay know this already," Kramer said.

When it comes to the key issues she sees the town facing in the next
four years, Kramer said she'd like to focus on a new wastewater
treatment facility.

"It would have been nice if someone had taken initiative to get that
project done as soon as it was apparent the spring flood waters would
breach the lagoon," she said. "As a fisher and a resident of the
community that houses the lagoon, it’s a huge concern and no longer
debatable."

Kramer also noted a concern about caps on municipal political
donations, increasing NB Power rates and EMF radiation from smart
meters. She said she also has concerns about 5G technology.

According to the Health Canada website, exposure to radio frequency
electromagnetic fields from smart meters pose no health risks and
exposure is very low.

On the topic of regionalization, Kramer said she does not consider it an option.

"We need to keep our independence and move away from reliance on more
globalization," she said.

This is not Kramer's first foray into the political scene, though.
Last fall she ran in the provincial election as an independent
candidate to represent Rothesay.

She also found herself in the public eye in January after she was
arrested outside of Premier Blaine Higgs's house while protesting the
mandatory COVID-19 public health measures. She received a ticket for
violating the Emergency Measures Act by refusing to wear a mask.

"If you want the straight story, without all the fluff; if you want
someone to listen to your concerns and treat you like the human being
and neighbour that you are; if you’d like discussion and action,
instead of just having your concerns received and filed, I’ll be there
for you," Kramer said.
