Turning trade deal into Republican ammo?
Editor's note: On August 21 in Ottawa, the Standing Committee on
International Trade heard a U.S. trade lawyer damn the proposed
softwood lumber agreement as a terrible deal for Canadians. Elliot J.
Feldman of Baker & Hostetler LLP argued that Canada caved at a moment
of strength, given that international rulings continued to land firmly
on our side. Instead, Feldman argued, this deal will kill the NAFTA
process which has favoured Canada's position, and forfeit at least a
billion dollars plus hundreds of millions of dollars more in interest
that would have come our way had our negotiators hung tough.
Feldman, who is based in Washington, D.C., offered one more bit of
startling analysis, excerpted below. The deal, he said, will funnel
nearly half a billion dollars directly to George Bush's White House,
creating a political "slush fund" available to the Republicans and the
U.S. timber industry for waging future campaigns.]
Honorable members, responsibility for this deal ultimately resides
with the government and with you, not the industry. It has been forced
on the industry for political reasons. No one in the industry likes
it, but many believe they have no choice and, therefore, many have
already accepted it.
I want to talk for a few minutes about the genesis of this agreement
and one of its most important and least discussed elements. There is a
bit of Watergate in this story and, as in Watergate, it is essential
to follow the money. Back before Christmas, David Emerson, then
minister in a Liberal government, and his ambassador in Washington,
Frank McKenna, were asking what it would cost to buy peace in softwood
lumber. They were adhering to all of the usual Canadian negotiating
positions on this subject: protecting Chapter 19 in NAFTA, fending off
onerous anti-circumvention clauses, protecting Canadian prerogatives.
But, unlike any previous dispute, this one involved the accumulation
of over 4 billion, now 5 billion, dollars. And there was the Byrd
Amendment, which led the U.S. industry to believe that if it could
just stall long enough to wear down the Canadians, while claiming
title to all of the money, they could settle for a lot of it. They
knew the Canadians had brought a case in U.S. courts that could
prohibit them from claiming any of the money pursuant to the Byrd
Amendment. They demanded a 60/40 split back at Christmas.
Messieurs Emerson and McKenna negotiated to 50/50 and then asked
industry. Industry calculated net present value against litigation
prospects, and said "no." But, in the process, Messieurs McKenna and
Emerson asked what would be enough. At that time, under those
circumstances, they were told 70 per cent. Think, then of how
impressed Mr. Emerson was with himself when in April, he could tell
industry that he got 80 per cent. But, there were at least four huge
problems, and he had neglected all of them.
'Legally entitled to not a penny'
First, on April 7, the United States Court of International Trade
ruled that the U.S. industry was entitled legally to no money. None of
it. It was not surprising then, that 20 days later, the U.S. coalition
said that it would take $500 million. It was hardly a negotiating
triumph to persuade them to take $500 million, when they had become
legally entitled to not a penny.
Second, net present value at the end of April was not the same as it
was at Christmas, especially as the pot kept growing. Canadian
industry had in mind a fixed sum for the coalition, maybe as much as
$150 million, not half a billion. Third, it was not quite as obvious
in the two and a half page term sheet of April 27, that Canada would
give away everything that the previous government had been defending
in order to complete a deal, because political priorities had changed
so radically. And fourth, the term sheet promised a major joint
initiative to improve North American competitiveness. The "remainder"
-- that was the word the terms said -- would go to so-called
"meritorious initiatives" in the United States.
Industry was troubled by this last development. It wondered why it was
providing foreign aid to the United States, but it was also reassured
that the sum would be small. More impressively, Minister Emerson told
CEOs that, as long as they were getting back 80 per cent of their
money, it was none of their business what would happen to the rest. He
was, by all accounts, very blunt on this subject. And, meanwhile, we
were advised by negotiators that the White House had taken a direct
and active interest in this money, but that Canadian industry ought to
focus on other things. As the minister had said, it was not really
their concern.
The "remainder," then, became $450 out of $500 million dollars.
'Gift of $450 million to the president'
That, honorable members, is a colossal sum of money. It certainly got
the U.S. government, as well as the coalition getting the other $500
million, committed to the deal. It is astonishing how little, nothing
really, the Canadian Government got in exchange for it. And let's
understand this money -- the $500 million -- not the coalition's
money, about which you heard some on July 31, but the rest.
Some perspective. At the height of the Watergate scandal, focus was on
an illegal slush fund available to the Committee to Re-Elect the
President, that was thought to be tipping the balance of American
politics. The fund never exceeded $20 million. One of the articles of
impeachment against Richard Nixon was that he received foreign
campaign donations, perhaps as much as $50,000. Both by statute and by
the United States Constitution, gifts of money to the United States
must go to the treasury and be appropriated by Congress. The lone,
aberrant and still controversial exception has been money donated in
the immediate aftermath of the emergency created by Hurricane Katrina,
and the sums involved were very small.
So, here we have the government of Canada requiring that Canadian
private parties sign over $450 million to an escrow fund slated to be
conveyed to the White House. The agreement does not mention Congress,
and the Bush administration says that Congress will not be involved in
any way with this agreement. The government of Canada thus is making a
gift of $450 million to be spent by the president. That was more than
a belt buckle, even more than a stetson, on July 6th. There is only
one date certain in the deal: that the planned expenditure of the $450
million must be determined by September 1.
Political blowback?
Curious, that date, which traditionally is the kick-off for campaigns
in the United States in election years. Yes, it's an election year,
and the Republican control of Congress is considered in trouble. The
entire Republican campaign war chest is less than $300 million. Canada
will add to it by 150 per cent in funds to be expended for
"meritorious initiatives." It does not require much imagination to
foresee the strategic places where this money will be spent.
This peace on softwood lumber will probably not improve Canada's
relations with the United States, because this colossal sum of money
is going to the White House, not the U.S. Treasury. When the
Democratic party learns of it and understands it, it's not likely to
be pleased, and it's possible that, despite the infusion of such
money, the Democrats nevertheless will win in November. Canada may
then have much improved relations with the Republican party but not
with the United States.
During questions following Feldman's presentation, NDP MP Peter Julian
(New Westminster/Burnaby) noted the "quite a staggering revelation
that the funding of $450 million would be, if I understand it, under
the control of the White House; Congress would have no say and Canada
would have no say as to the use of that money. And, hence, in a
mid-term election year we would be giving $450 million to a massive
political fund." Feldman responded:
This is in my view an historic, unprecedented, astounding intrusion
into American politics. We searched all the way back to the Revolution
and found nothing like it in American history. And the question that I
came this morning to put is, "Will the Parliament of Canada accept
responsibility for possibly tipping the balance in American politics
in preserving the control of Congress by the president's party?" This
softwood lumber agreement is an historic moment in part because of
that proposition, and it's up to this Parliament to decide whether it

and, indeed, that money inevitably will go to shore up the electoral
aspirations of the Republican party through the president -- it's not
going to be touched by Congress -- it's going through an escrow fund.
And these are questions that could impact American politics for
generations and impact relations between Canada and the United States
for generations to come. And that is entirely in the hands of this
Parliament.
Mr. Julian: So what you're saying is that we are not only providing
money to the coalition to fight further legal victories, for further
legal battles -- giving half a billion dollars to them -- but we're
also providing money that may go to political purposes for the
re-election of Republicans, many of whom have been the most adamant
against allowing free trade in lumber. It is ridiculous.
Mr. Feldman: The provision in Article 13.A.2 of the agreement, which
recites the meritorious initiatives, is language which could be
defined only as a slush fund for the president.

Canadian Mounted Police in 1985 from Montreal, Quebec. Prior to
joining the Force, he served nearly four years in the Royal Canadian
Navy.
A/Commr. Tremblay began his RCMP career in New Brunswick, where he
spent 11 years occupying positions in general duty, covert operations
and drug enforcement across the province. Prior to joining the
executive ranks in 2002 with A Division's (Ottawa Region) Combined
Forces Special Enforcement Unit/Drug Section, he completed a series of
assignments related to federal enforcement and specialized services in
Regina, Milton, Ontario and Ottawa.
Between 2004 and 2008, A/Commr. Tremblay had the unique opportunity to
be seconded to CSIS, where he developed expertise in counter
proliferation and terrorism. Upon his return to the RCMP, he was
assigned to Federal Policing Criminal Operations as the Director
General responsible for National Security, Financial Crimes and
Serious Organized Crime investigations until 2014. Following this
role, he became the Criminal Operations and Protective officer at
National Division (Ottawa Region), where he was responsible for
sensitive and international investigations as well as the security of
Canada's Prime Minister, Governor General and Parliament Hill.
In 2015, A/Commr. Tremblay returned to Headquarters as Assistant
Commissioner of Federal Policing Strategic Policy & External
Relations. In this strategic advisor role, he led initiatives aimed at
maximizing the impact of RCMP programs, enhancing relationships with
domestic and international partners, as well as prevention
initiatives.
In 2016, A/Commr. Tremblay was appointed the 30th Commanding Officer
of the RCMP in New Brunswick.
A/Commr. Tremblay has received several medals and commendations
throughout his career for his dedication to excellence in policing. He
was granted The Order of Merit of the Police Forces from the Governor

Coralee Cusack-Smith made the appeal a day after a correctional investigator's report revealed new details about the death of Matthew Hines, a Cape Breton man who was beaten and pepper sprayed by guards at Dorchester Penitentiary in New Brunswick.
Like Cusack-Smith's daughter, Hines struggled with mental health issues. His family has said he never got the diagnosis or treatment he needed.

"My heart is broken for that family," Cusack-Smith said in an interview from her Dartmouth home.
"I know what they are going to go through."
Smith, Hines struggled to find help
Cusack-Smith's daughter was 19 when she took her own life at the Grand Valley Institution for Women in Kitchener, Ont., after a lifetime of struggling with mental illness.
Guards stood outside the Moncton, N.B., woman's cell and watched as she tied a cloth around her neck, a coroner's inquest jury heard. Guards had been ordered by senior staff not to intervene as long as Smith was breathing.
Both Hines and Smith struggled to get proper mental health treatment in small Maritime cities. Their families believe they wouldn't have been in the criminal justice system if they had gotten help.
"The family wonders why nothing was learned from the Ashley Smith case," said Julie Kirkpatrick, a lawyer for Hines's family.
A history of mental health issues
Matthew Hines died in custody at the Dorchester Penitentiary on May 27, 2015. (CBC)
Hines, he wrote, had a history of mental health issues, including psychotic episodes, but was undiagnosed and untreated.
The 33-year-old had been dealing with mental health and substance abuse issues from the time he was a teenager.
Just one month before his death, Hines had his parole revoked after police were called to his parents' home.
His family believes Hines was having a psychotic episode at the time. They called police because they were worried for his safety, according to Kirkpatrick.
She said Hines's family was told he would get help for his mental illness when he returned to Dorchester Penitentiary to serve the remainder of a five-year sentence for robbery.
"That obviously was not the case," said Kirkpatrick.
Hines's family believes he may have been having a mental health emergency before his death. They also believe he would have calmed down if officers hadn't moved so quickly to use force.
"What the family knows of Matthew is sometimes he just needed a little bit of time," said Kirkpatrick.
"In their opinion, it would have definitely changed everything."
'A really serious problem'
Ashley Smith took her own life in custody at
the Grand Valley Institution in Kitchener, Ont., in 2007. She was 19.

Catherine Latimer, executive director of the John Howard Society, said progress has been slow.
"The resources and ability to be able to effectively deal with the people who are suffering from mental health issues in the prisons is really limited," Latimer told CBC News.
"And I think it's a really serious problem."
In its response to Zinger's report, Correctional Service Canada said it plans to develop training that places "more emphasis on non-physical intervention" when dealing with inmates who show signs of mental health distress.
Staff will also be trained to consider how an offender's state of mental health may affect their understanding of a situation during a crisis.
Cusack-Smith said moving quickly to improve conditions for inmates with mental illness starts with someone taking ownership of the issue — something she doesn't believe the current federal government has done.
"It seems like no one is willing to step up and really be held accountable," she said.
"In Ashley's case, no one was accountable. I don't know what's going to happen here."

Charles, David Amos had been picked up by the RCMP, upon false accusations, and put into the Chalmers Hospital.
This is a fate that is looming at the horizon for anybody who does not put up with the corruption in this country and especially in "the place to be". The dictators are running a tight ship, and they dont like it, when someone points out to them, that underneath that picturesque veneer is a big mess hidden.
Yesterday it was me and many others, today it is David, and tomorrow it can be You, and me again. Lets put petty bickering aside, and speak out against the real foe. Short before the mighty sowjet empire crumbled and fell, they used the same tactics, putting opponents into loonybins, people who did not appreciate their benevolent rulership, must be something wrong with their head. Think about it.

Thanx for defending me in chucky's blog.
And Thanx for blogging about my false imprisoment once again but this time it was the corrupt smiling bastards in my native land that did it to me. However I don't it is going to work out to well for them in the end than to one honest Doctor, a host of damned decent friends, one very Honourable Farmer friend, Werner Bock and some newfound blogger friends around the world.

Why not call the number and find out Charles? You may not be a 'fan', but you two have a lot in common. There was a post at Spinks last night that could be him, it was posted anonymously, but he's the only guy who calls people 'boy'.
You are always offering conspiracy stories about people out to get you, his actually make even more sense as he keeps evidence and talks about using the court system-even runs for parliament. By that token he's more 'dangerous' than you, and doesn't have a popular blog to keep him in the limelight enough to protect him.

The media is certainly not going to cover it, you are far better known and like you say, the media wouldn't cover your arrest at all. Fighting for people's rights is never 'done'. There are some people who did work for residential tenants acts and about YOUR ban. Ironically Mr. Amos' last blog was a link to www.charlesin thehouse.com asking why YOU got all the attention.
I seem to recall lots of blogs with pictures about the clown who was banned, but maybe past posters are right, and its only people who are nice to you that get any attention. Let's just hope people don't have the same attitude if it does happen that YOU get arrested. Whether you like somebody or not is irrelevant.
I don't know what Mr. Amos' story is and have never been able to follow it, but we certainly know from Charles' treatment and Bonnie O'dea's case that just about anything is possible.

Charles, don't mean to be contrary but virtually everything you've said about him has been said numerous times HERE about YOU. On numerous issues people have posted saying 'you just can't reason with the guy'. I don't particularly like being called 'mikey boy' and was often a target of Mr. Amos' criticism myself.
And like I said, if YOU were arrested there are lots who would say exactly the same thing as the above-'he needs help, I hope he gets it' and then move on.
The issue is not the PERSON, in order to raise the ire of lawyers, police, etc., you HAVE to be a bit of a malcontent. Most of us would just cry in our coffee and try to move on. The only reason Mr. Amos (and you I dare say) continue to tilt at windmills is BECAUSE you are belligerent, somewhat cantankerous SOB's.
I've heard Mr. Amos' called crazy, but then I've also heard YOU called crazy by a lot more people. We don't know the issue behind this, perhaps he IS crazy and maybe he was throwing rocks through people's windows.
You SHOULD blame the media, how many people tell YOU that they don't blame the media for ignoring all your letters? It's not pleasant is it? All it takes is a phone call to the DECH or the police station. Can you honestly say that if you get hauled away you wouldn't want people to put at least SOME effort into helping you? Will people just be going over to Spinks blog and saying 'well, he didn't give a rats ass about David Amos so why should we care about him?' I seem to recall a lot of effort in talking to Bonnie O'dea-was it just because she was nice to you and Mr. Amos wasn't? What the hell is the point of all that buddhist bullshit you keep posting when you don't even seem to pay attention to it. Sorry guy, don't mean to be belligerent, but being a blogger sometimes means rising above pettiness. It is simply NOT TRUE, as Mikel suggests, that a person can be commited to a mental health facility on the basis of a phone call to hospital or police. That may have been true in 1950, but not today! If Mr. Amos has been hospitalized, it's on the basis of reliable evidence.
btw, I've had dealings with Mr. Amos. He very sincerely believes not only that all lawyers and all politicians and all cops and all civil servants are corrupt, but also that there is a massive conspiracy against him, involving all these people, and the CIA, which he belives is actively trying to kill him, and the media, and Charles, and many many many others. Everybody wants to forget that I sued the entire Massachusetts
Commission Judicial Conduct twice in 2002 and that that crooked
lawyer was appointed to be a judge and take me on in Probate in order
to cover up for their malice and bankrupt my family. this year they
did the same for him. Rest assured I am on a mission to bankrupt that
Yankee bastard and the other judges and lawyers he was playing his nasty games with against my innocent family. If American Title
Insurance and the Fidelity Finamcial people wish to stand with them and against me so be it.
However may I humbly suggest that the publicly held Titile Insurance
dudes settle with me ASAP? Before my son in the USA turns 18 next
month would be wise or you will be dealing with two lawsuits in two

First I blog then I email then I blog somewhere else then I email both comments to Jacky Boy Layton and Stephy Baby Dion as a double doublecheck. Do you understand why I blog emails now Danny Boy? I tried blogging yours and Chucky Leblanc's way long before you dudes did or even before blogger existed All I got for my efforts was "Poof" so I decided to inhabit many people's blogs and use my blog to store email records. I kinda had to do so because the miserable bastards were killing my email account too. Plus i am always on the move and could access my blog anywhere to copy and paste and forward an email rather than rely on the integrity of email provider the blogs were a doublecheck. Whereas I blogged my emails in many places lots of people had a chance to read them. Plus if ya google just an email address you may stumble across some interesting reading about the person you are seeking.
I tell you this now because I am quiting emailing and blogging soon and going on with what left of the rest of my life.
That said I just had to give Garthy Baby Turner a little kick in the arse as he exits stage left from the building on the Hill in Upper Canada that he entered into from the right wing. That big talking little bastard who yaps on and on about big money knew who I was when we were both running in the election of the 39th Parliament. He and his staff have done nothing but laugh at me on the phone (I called him many times)and deleted all my comments in his blog as I tried to bust him in front of his friends. He really pissed me off when he expounded about the virtues of being an ethical Independent and buddied up with my enemy the very nasty french man Andre Arthur (Richard Côté should have listened to me if Ducceppe had let him that is) Then when he crossed the floor and joined the crooks on the other side after his little deal he was cooking with Dizzy Lizzy may fell through. That took the cake and everybody knew he was a monumental scumbag.
Since he brags that he won't be back for a couple of weeks maybe some folks will read my two bits worth this time around and I can turn the worm on that smiling Upper Canadian bastard.
I inserted two comments ahead of mine in the email to the little Neo Can lawyer Rob Moore and others because he said exactly the same words to me in front of Stevey Boy Harper and the RCMP on June 19th, 2004 as I was running against him. I wonder if he will remember them and the time he said them. I remind him of them now and then. they were as follows:
"Keep up the good work!"
I don't think the little lawyer with the proper name or the nasty lady ment the words they said.

I knew Dion’s going to kill the Liberal party and take you down with him- see my previous posts. I went out and voted for you anyway . And that’s because while we had many disagreements in the past, you were a breath of fresh air…
You lost and the morons will pay dearly. Maybe a few years from now, after the moron majority will get what they deserve – and boy, they have no clue what’s coming - our time will come.
While the temptation to succumb to resignation and cynicism is strong, I cannot afford giving-up. I have children…
