Chucky Leblanc, Andre Faust and two members of the RCMP witnessed me argue the Crown in Federal Court On May 24th, exactly one month ago and a week or so before his old blogging buddy Barry Winters ' latest blogs went "Poof" as he was arrested and being charged. 

Yet still these wacko Trolls playing evil games within Encyclopedia Dramatica and YoutTbe etc don't believe that I am serious about getting even byway of a lawsuit about being libeled all over the Internet since 2005???

It appears that I may be the "Lone Ranger" in Canada that Justice Paulette Garnett was referring to (How could she not know of my lawsuit by now?) .However I see that on May 24th another Trolll who is an obvious fan of Encyclopedia Dramatica informs us  that others are sick and tired of the Evil Trolls.

Perhaps the Yankee lawyers do not know that Encyclopedia Dramatica's actions are criminal in nature in Canada however the RCMP certainly do and have done nothing thus far with regards to my Clan's rights and interests for very obvious political reasons involving my litigation in the USA back in 2002.

Court of Queen's Bench Justice Paulette Garnett says defamation laws will eventually tame "the Wild West" of the internet.

Garnett makes the statement in her March 16 decision that dismissed a claim by blogger Charles LeBlanc that the City of Fredericton breached his rights under the Charter of Rights and Freedoms.

Acrimonious history


LeBlanc has an acrimonious history with the Fredericton Police Force that culminated in a charge of criminal libel under Section 301 of the Criminal Code being laid against LeBlanc for posting on his blog at various times that a Fredericton constable was a "fascist cop" and "sexual pervert."

LeBlanc also used a bullhorn outside the Fredericton police station to state the force employs "sexual perverts" and that the constable who issued him a ticket in 2011 for bicycling without a helmet in the city's downtown was a "faggot."

​New Brunswick's Attorney General eventually directed in 2012 that the criminal libel charge against LeBlanc be dropped because several other provinces had found Section 301 of the Criminal Code to be unconstitutional.

In November 2016, LeBlanc was informed by two members of the Edmundston Police Force that he was being investigated for defamatory libel under Section 300 of the Criminal Code following a complaint lodged with the Fredericton force.

Because of its contentious history with LeBlanc, the Fredericton force asked Edmundston police to investigate the complaint.

Child sexual exploitation cited


Meanwhile, LeBlanc initiated the lawsuit against the City of Fredericton and its police force because in the initial criminal libel investigation, Det. Robb Costello made an official request for information about LeBlanc's internet usage by stating he was carrying out a criminal investigation related to child sexual exploitation.

Following a two-day hearing last week, Garnett dismissed LeBlanc's lawsuit, noting that the city filed 17 affidavits in the case and LeBlanc did not file any, so the only evidence before the court was the city's.

"This evidence leads to the conclusion that the actions of the City were done in good faith, that the procedures were in keeping with the policies of the police department, that Mr. LeBlanc was treated in the same way as any other citizen in similar circumstances and that his [Charter] rights were not infringed," Garnett says in her ruling.​


Garnett ordered that LeBlanc pay $2,925 to the city in court costs.

However, in her decision Garnett comments on defamation in the internet age.

"Although Mr. LeBlanc clings to his rights under the Charter, it does not appear that he has any concern for the rights of others," Garnett writes. "He believes that his right to free speech includes the right to defame others with impunity.

"One commentator has compared the internet to the Wild West and although the common-law action for defamation may take time to tame it, it will eventually do so. Those who carelessly or viciously attack their neighbours should beware of the Lone Ranger."

When you look at all the incidents involving the Fredericton City Police and Mr. LeBlanc ; then it is obvious that the police has abused its authority on several occasions when dealing with Mr. LeBlanc . This includes such instances as raiding his home , and seizing his computer equipment ; petty charges such as riding a bicycle without a helmet , etc . As this current case proves , it is difficult for a man like Mr. LeBlanc who has limited funds to fight the City of Fredericton who is funded by the taxpayers . It is truly an injustice .

@Matt Steele Ask yourself an obvious question. If you go to Chucky's Leblanc"s blog you will see that last evening he was reading this CBC article and no doubt all the comments as well. I would bet dimes to dollars all the cops and politicians in Fredericton are reading them too.

If Chucky were truly an honest dude then why does he not defend himself in this comment section instead of allowing people like you to comment on his behalf in his defense?

After all you and Chucky cannot deny that this domain controlled by the Crown is supported by taxpayers who also pay for Chucky's welfare and health care. I know why Chucky does not speak up in a public domain which he can do for free. It quite simply is because he cannot control the comment section and delete his responses if he becomes embarrassed by his own published words. More importantly Chucky cannot block folks he calls "Coward Jerk faces" because in fact that is just exactly what he is.

There's a big difference in making these claims when one side admits 17 affidavits and the other side doesn't know what an affidavit is. He represented himself, and all anybody has to do is read Bernard Richard's report on the matter to know that he was not 'treated like any other citizen'.

Even Bernard Richard said that it was pretty specious for an officer to ticket Charles for riding a bicycle without a helmet immediately after Charles had videotaped fredericton police officers beating a guy on the ground.

The incident of the form couldn't be proven to be fraudulant, which doesn't make it not so. The police maintained it was 'an error' that they somehow used the child exploitation form to get the IP address rather than the criminal libel form, which is pretty ludicrous on the face of it.

And even the fredericton police force admitted that they made a mistake in taking Charles computer to read through all his correspondence for a charge which was ultimately dropped.

While I agree that Charles was irresponsible with his comments, the fact is that nobody in their right mind would take such comments seriously, and had Charles the money for a lawyer this case would have turned out far differently. For one thing, Charles comments have ZERO to do with whether the police force infringed on his rights, its interesting that the judge spends more time talking about what HE did rather than what the police did. But its hardly surprising.

Mr. LeBlanc's case is special in that regard. Trump's been slandering and defaming non stop. How typical is it that try and make examples of poor people who can't make things go away with their money. Court looks foolish here thinking it has more power than it does.

A New Brunswick Court of Queen's Bench trial judge who was criticized three years ago for taking too long to issue judgements has been meeting time limits she originally agreed to — but records show, just barely.
Earlier this month Justice Paulette Garnett released a decision in the case of fired civil servant and

Progressive Conservative partisan, Stephen Smith, finally clearing the way for the New Brunswick Human Rights Commission to investigate his claim of political discrimination.

But Smith had to wait five months and 30 days for that decision after Garnett heard the matter in a single day last December. That decision just beat a six-month deadline she agreed to abide by following an intervention by the Canadian Judicial Council in 2014 over her long running tardiness.

"The judge has acknowledged she needs to do better in the future," the council wrote in a press release following a review of Garnett's slow decision making at the time.

"She is working to ensure that this situation does not happen again."

According to the council, judges are expected to issue decisions in cases, "as soon as reasonably possible" with six months following the end of a hearing established as the longest a judge should take unless a case is unusually complex, workload is excessive or a judge suffers an unexpected illness.

But Sebastien Grammond, a University of Ottawa constitutional law professor, says that a six month period is set well beyond what is required in most cases.

"Six months is kind of an upper limit for normal cases," said Grammond.

"Usually judges render decisions much quicker than that."

But records show Garnett has been making full use of the six month limit since her brush with discipline, managing to retain her status as New Brunswick's slowest judicial decision maker despite adhering to the agreement she made to increase the pace of her work.

According to judgements compiled by the Canadian Legal Information Institute (CanLii) there have been more than 270 major and minor decisions issued by New Brunswick Court of Queen's Bench trial judges in the last two years.  In just 14 of those cases, have rulings taken longer than 175 days to produce. However, seven of those rulings have come from Garnett alone, even though she issued only 11 judgements during that period.

One of those drawn out cases involved Darryl Demerchant, who has been fighting the property tax bill on his Fredericton office building since 2009.

The case ended in front of Garnett last October, who eventually ruled against Demerchant in April, 178 days after his one-day hearing.

But Demerchant said he barely noticed how long Garnett took after being stuck inside the slow-motion appeal procedures operated by Service New Brunswick and the Assessment and Planning Appeal Board for seven years before reaching her courtroom.

He laughs heartily while talking about it.

"What else can you do?" said Demerchant from his home on Monday.

"It's good for the lawyers."

No response from judicial council

In Garnett's case, the judicial council made the point that it preferred judgements to be issued as quickly as possible but it did not immediately respond this week to a question about whether consistently running up against — but not crossing — the six month deadline was acceptable.

"Undue delays in rendering decisions can lessen public confidence in our justice system," the council wrote in its original release concerning Garnett.

But although still consistently the slowest judge in New Brunswick to issue decisions, Garnett is also much faster than she used to be.

According to CanLii in 2013 Garnett issued a judgement related to the cancellation of women's hockey at UNB more than 600 days following a one day hearing on the matter. In 2007 she took nearly 800 days to issue a ruling on a dispute involving Elm City Chrysler

No thank you, we just have to see the wingnuts that get elected to these positions in the US to take a pass on that. Now renewable contracts based on performance might be an alternative to look at, but again it has it's drawbacks.

Sadly , this is what happens when people are hired based on WHO they know ; and not WHAT they know . Politicians , and government in general , never seem to understand that if they make a bad appointment based on political connections ; then that hire will be around for 30 to 35 years . It is true not just in this case , but in many cases where government employees are not suited for their positions , but they slide along doing very little work while receiving big salaries on the taxpayers dime.

If you have a hard time making a decision maybe you should make at least one decision for the good of judicial system. Resign your post and allow somebody who's expedient to take your place. The right to speediness is essential in the judicial system.

A rush to judgement in many of these cases would not be a same day ruling. If you are poor that is what you get. If you can afford to challenge you need to max out on the clock.

Canadian Judicial Council says Justice Paulette Garnett will not face discliplinary action

A New Brunswick judge, who routinely kept parties waiting months, sometimes years, for decisions, has been mildly chastised by the Canadian Judicial Council for her conduct, 15 years after the lengthy delays first surfaced.

Court of Queen's Bench Justice Paulette Garnett was the subject of a complaint by an unknown person to the judicial council last spring, a year after CBC News reported on several of her overdue decisions.

But she will face no disciplinary action for bogging down the judicial system, according to a decision released on Tuesday.

"The judge had been very late in issuing reasons in a number of cases," the council said in a press release.
"Undue delays in rendering decisions can lessen public confidence in our justice system. ... The judge has acknowledged that she needs to do better in future, She is working to ensure that this situation does not happen again."

Garnett was appointed in 1998 and almost immediately began violating judicial council guidelines, which call for delivering judgments within six months of the conclusion of a hearing.

One of her first cases, a claim for back rent at the Bathurst Supermall made in August of 1998 wasn't decided on for nearly 13 months.

That became a familiar pattern to lawyers and parties in her courtroom for years to come.
In 2005, she presided over a one-day hearing between Fredericton's old Elm City Chrysler dealership, its owners and their bank to resolve questionable transactions. She delivered a decision two years and two months later.

In 2012, she took so long to decide whether employees of Fredericton's Jones Masonry had properly unionized, Gordon Petrie, the company's lawyer, eventually died.

Garnett's decision approving the union was eventually made a month after Petrie's funeral and 15 months after the original hearing, by which time the workers who had voted for the union had all left the company.

New Brunswick Chief Justice David Smith finally intervened early in 2013, restricting cases going to Garnett until she brought outstanding decisions up to date.

One of those cases involved an attempt by former University of New Brunswick women's hockey players to challenge the cancellation of their varsity team in 2008.

It landed in Garnett`s courtroom in the summer of 2011 and she took nearly two years to decide part of the case could continue.

The decision took so long it became an issue at the next hearing when the university unsuccessfully tried to use it to argue former players were now too old to get a team back.

But even after the chief justice's interventions and publicity surrounding delays in her courtroom, Garnett continued to deliver slow rulings.

In August 2013, the dispute over who should win an NB Liquor agency store in Hanwell landed in front of her, a case she took more than seven months to rule on. That case apparently triggered the complaint which the judicial council finally acted on.

Garnett will work 'very diligently' to get decisions done


Robert Pidgeon, the senior associate chief justice of the Superior Court of Quebec, dealt with the complaint about Garnett's tardiness and a second complaint by Fredericton resident Andre Murray about Garnett's "attitude and demeanour" during his time in her court.

Norman Sabourin, the judicial council`s executive director, said Garnett had satisfied Pidgeon that she has improved and noted she had apologized to Murray for being "abrupt" with Murray.

'We shouldn't have to wait for a citizen to make a complaint before inquiring into the conduct of a judge.' - Norman Sabourin, Canadian Judicial Council 

"There was an undertaking by the judge to get some coaching and to work very diligently to get her decisions done," said Sabourin.

"The judge acknowledged that her conduct had been at issue. She made an undertaking it would not happen again. Chief Justice Pidgeon decided it was not a case that needed to go further."

Natalie LeBlanc, the registrar of New Brunswick's Court of Queen's Bench, said neither Garnett nor Smith would speak about the council's decision.

"I am advised that no further comment will be offered," LeBlanc told CBC News in an email.

Garnett`s extreme tardiness has been a sore spot in New Brunswick legal circles for 15 years and Sabourin says the case shows the need for the judicial council to respond to problem judges more quickly than it has in the past.

"We shouldn't have to wait for a citizen to make a complaint before inquiring into the conduct of a judge," said Sabourin.

"We think there should be the ability of a council member or the executive director to say, 'There's a concern here, there seems to be something happening and we`re going to initiate a review of that judge's conduct."
