Oh My the very Corrupt Crown Corp known as CBC decided to ban me again until Canada Day EH?

After I read this notice I got on the phone and called CBC, VIAFOURA and 3 lawyers. Then I began to build this blog while waiting for one of the 3 lawyers to call me back before I send out the email I promised then publish it here before Canada Day.

For the record the people in CBC and VIAFOURA played dumb as usual.  However one of the lawyers listened closely and answered me honestly. He seemed to be an OK dude but he was also busy with his kids in the backgroud. So I figured I would give him a chance to check my work. I hope he get backs to me. On the other hand I have no doubt one the other two local lawyers knew exactly who I was and will never return my calls or answer me in writing. His assistant made fun of me then hung up. All she cared about was how I knew her name and got her number. Need I say that call was to the office of the Fed lawyers in Halifax I have been arguing since 2015?





 

Methinks the Crown's mindless minions picked a very bad day to pick another fight with me. I may explain it later. Anyway as far as comment sections in CBC go  I can always register again pretending to be somebody  I am not just like the Trolls they support do but what would be the point? I have the right to free speech in a website support by my taxpaying dimes. Furthermore if somebody thinks I libeled them within CBC they have the right to sue me or better yet make a complaint to the RCMP in order to have the Crown try to prosecute me under Section 300 of the Canadian Criminal Code  CORRECT?

 

So what the Hell I gave it a shot. Perhaps the third time is the charm? NOPE my third ID lasted only 7 hours or so. It did not survive until the closing time for 3 news items of the day about the USA.

On October 17th, 2015 I registered in my true name with CBC in order to make comments while running in the election of the 42nd Parliament and arguing the Crown in the Federal Court of Canada. The comment section of this CBC "News" article speaks for itself particularly in light of the election results two days later. However I will only post her what CBC allowed me to publish in the Crown's domain before polling day.

 








That said lets just say that I have no doubt whatsoever what spawned CBC's latest malevolent actions against me. Methinks it had everything to do with my spit and chews yesterday about Mitt Romney and Justin Trudeau N'esy Pas?

The records within 3 of my blogs published yesterday versus that of CBC's should speak volumes to anyone with half a clue between their ears.

Court brushes aside arguments in criminal appeal of unilateral power

Last year, the Liberals amended the Judicature Act to take away the unilateral power to transfer judges

New Brunswick's top court has suggested it's fine with the unilateral power that Court of Queen's Bench Justice David Smith used to have — before the Liberals took it away last year.

The court brushed aside arguments Tuesday in a criminal appeal that Smith's former power to transfer judges had compromised the independence of two judges who heard three of the Operation J-Tornado drug trials.

The lawyers were trying to overturn the convictions of Shane Williams, Anthony Edison and Joshua Kindred.

The Court of Queen's Bench judges in the trials, William Grant and Thomas Christie, both admitted wiretap evidence obtained through warrants signed by Smith in 2014.

Grant and Christie lacked the independence to rule on Smith's warrants because, in theory, Smith had the power to punish them by transferring them, the two lawyers argued.

But Chief Justice Marc Richard, in one of his first cases as head of the appeal court, clearly didn't buy that.

"Do we know of one example where a justice was moved by a chief justice against their will as a punishment for them doing their job?" he asked.

Nathan Gorham, the lawyer for Williams and Kindred, did not offer an example.

Instead, he argued that Smith's unilateral power created the possibility of such punishment — and that undermined public faith in the judge's independence.

"It's about looking at the objective structure of the court to determine if there are sufficient guarantees of independence," he said.

Richard was not convinced, saying the argument would mean any warrant signed by Smith could not be reviewed by a trial judge.

"You're saying no judge in New Brunswick can rule on a warrant … issued by the chief justice of the Court of Queen's Bench," he said. "That's got to be your position."

Amended Judicature Act


Last year, the Liberal government of Premier Brian Gallant amended the Judicature Act to take away Smith's unilateral power to transfer judges on his court. Now, Smith must seek the consent of the provincial justice minister.

Smith complained that was a violation of his court's independence.

The drug trials took place before the Liberal amendments, when Smith could move judges on his own.
Gorham and Charles Bryant, the lawyer for Edison, argued judges must also be independent of their own chief justice.

Operation J-Tornado 


In 2014, Smith authorized three warrants that allowed police to monitor private e-mails and ultimately convict Williams, Kindred and Edison, along with several others. The police investigation was part of a major Saint John-area drug probe named Operation J-Tornado.

The three men were convicted on separate trials but police relied on the same evidence. The information gathered from the wiretaps approved by Smith was key to the convictions.
Richard said there has never been an issue with a chief justice's administrative powers before.
"Nobody has raised this. This has not been a concern for anybody."

Bryant argued that because of the controversy over the curtailing of Smith's powers, including a private exchange of letters between judges on the issue that became public, the perception of the issue is now more important.

But Richard was again having none of it.

"The argument you're putting forward is that your client could not be tried the moment the chief justice signed the warrants," he said.

Richard and the two other justices hearing the appeal, Margaret Larlee and Kathleen Quigg, avoided wading into the debate over the Liberal amendments to the Judicature Act.

The Liberal government argued it needed to curtail Smith's powers because his frequent transfers were creating a "revolving door" in smaller communities, with judges appointed there and then soon transferred to larger centres.

Richard mused at one point that maybe the solution would be for governments and the courts to avoid the issue altogether.

"What about no transfers at all?" he asked. "You accept the appointment you accepted and you stay there."

After the hearing's afternoon break, Richard signalled that the three justices were dismissing the Judicature Act arguments.

He told the federal lawyer arguing against the appeal, Michael Taylor, that he did not have to bother responding to the independence issue.

The three justices were more interested in arguments from Gorham and Bryant about the affidavits used to admit the warrants at the trial. The lawyers argued they lacked required certification from an oaths commissioner and did not include a date when they would expire.

Larlee said she found the lack of a duration on the warrants "troubling."

Bryant said that kind of sloppiness was unacceptable for affidavits that allowed police to eavesdrop on citizens. That kind of intrusive investigation has to meet a high standard, he said.

The appeal court will rule on those arguments at a later date.

"Bill 21 would give the provincial justice minister the right to veto
Smith transferring Court of Queen's Bench justices from court to
court.

Smith has called that a potential violation of the independence of his court.

The legislature resumes sitting next week and is expected to pass the
bill before breaking for the summer."



"Most bills can take months or even years of work before coming to the
legislature, but this one "dropped out of the sky" with no advance
discussion with judges and lawyers, Bray says. "That seems to be a
remarkably precipitous birth of legislation."

That's why Smith considers it important to see the documents and find
out what prompted the quick drafting of Bill 21, Bray says. "There
didn't seem to be any problem motivating it."

Bray still won't say what "further action" Smith is considering beyond
the right-to-information review.

He says any court action would be heard by the same court Smith
administers, which could also harm the public's perception of the
justice system.

And a decision on the documents could be appealed to the New Brunswick
Court of Appeal, whose chief justice, Ernest Drapeau, has reportedly
endorsed Bill 21.

"We have to be very careful how we deal with this," Bray said. "We are
in somewhat of a quandary."

Whiteway-Brown, says the association is also concerned about how the
courts could deal with a legal challenge to the bill. "We're really at
a loss," she said."

Bevan-Baker escorted from chamber after referring to 'farcical' debate over legislation


Green Leader Peter Bevan-Baker was removed from the legislature on Wednesday after refusing to withdraw the word 'farce' from the public record. (P.E.I. Legislature)

The fall sitting of the P.E.I. Legislature came to a dramatic close Wednesday with Green party Leader Peter Bevan-Baker ordered removed from the legislative chamber for refusing to withdraw the word "farce."

In the final minutes of the fall sitting, the Public Interest Disclosure and Whistleblower Protection Act came up for third reading. Bevan-Baker introduced a motion to have it sent back to the legislature for further debate.

"In the last few days I have witnessed some of the most discouraging debates on legislation since I was elected two-and-a-half years ago," he told the house.

"We were given the sacred trust to bring forth strong and meaningful legislation that will enhance government transparency and accountability .... And we turned that debate Mr. Speaker, at times into a farce."

Government House leader Richard Brown rose on a point of order, taking issue with Bevan-Baker's statement, and in particular his use of the word "farce."

Unparliamentary word

Speaker Buck Watts ruled the word unparliamentary, and asked Bevan-Baker to withdraw the word from the public record.

"I used the word intently and I used the word consciously," Bevan-Baker said, accusing government MLAs of voting down opposition amendments to bills before they'd been provided with written copies of the amendments.

"If the purpose of this house is to carefully consider legislation that is going to affect each and every Islander, then surely we have to do that with the information in front of us, and we cannot do that if we are prejudging something … before we even see it. So I will not withdraw my remark. I think at times yesterday the display of the government side was indeed farcical."

Watts provided Bevan-Baker with one more chance to withdraw his remark before ordering the sergeant-at-arms to remove the Green party leader.
The Whistleblower Protection Act was one of three key pieces of legislation, debate over which kept the house sitting for 22 days — the second-longest fall sitting of the P.E.I. legislature since fall sittings began 20 years ago.

Numerous amendments to the act were introduced by both opposition parties, only to be voted down by government MLAs. Opposition attempts to amend another important bill, the Lobbyist Registration Act, were similarly defeated.

 

Water Act amended


However, both opposition parties were able to exert some influence over the most important piece of legislation passed during the sitting, the province's Water Act.
So I will not withdraw my remark. I think at times yesterday the display of the government side was indeed farcical.— Peter Bevan-Baker
The government introduced its own amendment to the act that mirrored an amendment circulated by the Green party. The amendment removed what opposition parties were calling a "loophole" allowing cabinet to overrule a ban on fracking in the province.

Meanwhile, the PCs were able to pass an amendment which requires government to send new or amended regulations to the act to a provincial standing committee a minimum of 90 days before the regulations are enacted.

All told, government passed 17 of its bills in the fall sitting, while the Opposition saw one of its private member's bills pass, providing more protection under Workers' Compensation for Island workers suffering from PTSD.

David Amos asked me to contact you. I met him last June after he became an
independent (not representing any political party) candidate in our federal election
that was held June 28.

He was a candidate in our constituency of Fundy (now called Fundy-Royal).
I wrote a profile story about him, as I did all other candidates. That story appeared
in the Kings County Record June 22.

A second story, written by one of my reporters, appeared on the same date, which
was a report on the candidates' debate held June 18.

As I recall David Amos came last of four candidates in the election.

The winner got 14,997 votes, while Amos got 358.

 I have attached the two stories that appeared, as well as a photo taken by reporter
Erin Hatfield during the debate. I couldn't find the photo that ran, but this one is
very similar.

Raising a Little Hell- Lively Debate Provokes Crowd

"If you don't like what you got, why don't you change it? If your world is all screwed up, rearrange it."

The 1979 Trooper song Raise a Little Hell blared on the speakers at the 8th Hussars Sports Center Friday evening as people filed in to watch the Fundy candidates debate the issues. It was an accurate, if unofficial, theme song for the debate.

The crowd of over 200 spectators was dwarfed by the huge arena, but as they chose their seats, it was clear the battle lines were drawn. Supporters of Conservative candidate Rob Moore naturally took the blue chairs on the right of the rink floor while John Herron's Liberalswent left. There were splashes of orange, supporters of NDP Pat Hanratty, mixed throughout. Perhaps the loudest applause came from a row towards the back, where supporters of independent candidate David Amos sat.

The debate was moderated by Leo Melanson of CJCW Radio and was organized by the Sussex Valley Jaycees. Candidates wereasked a barrage of questions bypanelists Gisele McKnight of the Kings County Record and Lisa Spencer of CJCW.

Staying true to party platforms for the most part, candidates responded to questions about the gun registry, same sex marriage, the exodus of young people from the Maritimes and regulated gas prices. Herron and Moore were clear competitors,constantly challenging each other on their answers and criticizing eachothers’ party leaders. Hanratty flew under the radar, giving short, concise responses to the questions while Amos provided some food for thought and a bit of comic relief with quirky answers. "I was raised with a gun," Amos said in response to the question of thenational gun registry. "Nobody's getting mine and I'm not paying 10 cents for it."

Herron, a Progressive Conservative MP turned Liberal, veered from his party'splatform with regard to gun control. "It was ill advised but well intentioned," Herron said. "No matter what side of the house I am on, I'm voting against it." Pat Hanratty agreed there were better places for the gun registry dollars to be spent.Recreational hunters shouldn't have been penalized by this gun registry," he said.

The gun registry issues provoked the tempers of Herron and Moore. At one point Herron got out of his seat and threw a piece of paper in front of Moore. "Read that," Herron said to Moore, referring to the voting record of Conservative Party leader Steven Harper. According to Herron, Harper voted in favour of the registry on the first and second readings of the bill in 1995. "He voted against it when it counted, at final count," Moore said. "We needa government with courage to register sex offenders rather than register the property of law abiding citizens."

The crowd was vocal throughout the evening, with white haired men and women heckling from the Conservative side. "Shut up John," one woman yelled. "How can you talk about selling out?" a man yelled whenHerron spoke about his fear that the Conservatives are selling farmers out.

Although the Liberal side was less vocal, Kings East MLA Leroy Armstrong weighed in at one point. "You’re out of touch," Armstrong yelled to Moore from the crowd when the debate turned to the cost of post-secondary education. Later in the evening Amos challenged Armstrong to a public debate of their own. "Talk is cheap. Any time, anyplace," Armstrong responded.

As the crowd made its way out of the building following the debate, candidates worked the room. They shook hands with well-wishers and fielded questions from spectators-all part of the decision-making process for the June 28 vote.

David Amos Isn’t Campaigning For Your Vote, But….

FUNDY—He has a pack of cigarettes in his shirt pocket, a chain on his wallet, a beard at least a foot long, 60 motorcycles and a cell phone that rings to the tune of "Yankee Doodle."

Meet the latest addition to the Fundy ballot—David Amos.

The independent candidate lives in Milton, Massachusetts with his wife and two children, but his place of residence does not stop him from running for office in Canada.

One has only to be at least 18, a Canadian citizen and not be in jail to meet Elections Canada requirements.

When it came time to launch his political crusade, Amos chose his favourite place to do so—Fundy.

Amos, 52, is running for political office because of his dissatisfaction with politicians.

"I’ve become aware of much corruption involving our two countries," he said. "The only way to fix corruption is in the political forum."

The journey that eventually led Amos to politics began in Sussex in 1987. He woke up one morning disillusioned with life and decided he needed to change his life.

"I lost my faith in mankind," he said. "People go through that sometimes in midlife."

So Amos, who’d lived in Sussex since 1973, closed his Four Corners motorcycle shop, paid his bills and hit the road with Annie, his 1952 Panhead motorcycle.

"Annie and I rode around for awhile (three years, to be exact) experiencing the milk of human kindness," he said. "This is how you renew your faith in mankind – you help anyone you can, you never ask for anything, but you take what they offer."

For those three years, they offered food, a place to sleep, odd jobs and conversation all over North America.

Since he and Annie stopped wandering, he has married, fathered a son and a daughter and become a house-husband – Mr. Mom, as he calls himself.

He also describes himself in far more colourful terms—a motorcyclist rather than a biker, a "fun-loving, free-thinking, pig-headed individual," a "pissed-off Maritimer" rather than an activist, a proud Canadian and a "wild colonial boy."

Ironically, the man who is running for office has never voted in his life.

"But I have no right to criticize unless I offer my name," he said. "It’s alright to bitch in the kitchen, but can you walk the walk?"

Amos has no intention of actively campaigning.

"I didn’t appreciate it when they (politicians) pounded on my door interrupting my dinner," he said. "If people are interested, they can call me. I’m not going to drive my opinions down their throats."

And he has no campaign budget, nor does he want one.

"I won’t take any donations," he said. "Just try to give me some. It’s not about money. It goes against what I’m fighting about."

What he’s fighting for is the discussion of issues – tainted blood, the exploitation of the Maritimes’ gas and oil reserves and NAFTA, to name a few.

"The political issues in the Maritimes involve the three Fs – fishing, farming and forestry, but they forget foreign issues," he said. "I’m death on NAFTA, the back room deals and free trade. I say chuck it (NAFTA) out the window.

NAFTA is the North American Free Trade Agreement which allows an easier flow of goods between Canada, the United States and Mexico.

Amos disagrees with the idea that a vote for him is a wasted vote.

"There are no wasted votes," he said. "I want people like me, especially young people, to pay attention and exercise their right. Don’t necessarily vote for me, but vote."

Although…if you’re going to vote anyway, Amos would be happy to have your X by his name.

"I want people to go into that voting booth, see my name, laugh and say, ‘what the hell.’"










Province’s only independent candidate says he’s never voted

SUSSEX • One of the province’s most colourful characters this federal election says he knows a lot about politics, but he has never checked a ballot.

“I never voted in my life,” David Amos, the province’s only Independent candidate, said in a meet-and-greet of candidates held in Sussex Tuesday night.

“Understand the game, never played, never voted.”

The mechanic used to run a motorcycle shop in Four Corners near Sussex, and added a lively component to the gathering that gave candidates of Fundy Royal a forum to speak to issues important to the riding, lead by the Sussex & District Chamber of Commerce.

Incumbent Rob Moore, who is seeking re-election for the Conservatives, faced off with Amos at the polls before in 2004. At that time Moore took the riding by a landslide.

Amos told the crowd he offers as an independent because there is no democracy with towing a party line, as he feels the other candidates do.

“You know how they stand and you must say what they say,” Amos said of party lines. “I speak for the people. You’re my boss. I would make a deal with the devil if it behooves what the people want.”

When someone in the crowd referred to a member of parliament as a leader, Amos objected.

“The parliamentarian is your servant,” he said. “He works for you – he’s not your leader. If he re-offers, check his work.”

The issue of representation came up when Patricia McKay asked from the audience whether parties would consider a better way for the electoral system to function. Last election, she pointed out, the majority of people did not vote for the Conservatives yet that party formed government.

Simply put, said Moore, every riding chooses their representative which he sees as a fair way to choose a government.

“The person with the most votes goes to Ottawa,” he said. The party with the most representatives become government.

Amos said the system isn’t about to change.

“Someone like Elizabeth May would have to be prime minister to change it,” the Independent candidate said, referring to the Green party leader.

Alaina Lockhart believes there could be a new way of creating governments, and other countries can be looked at for examples in ensuring the best representation of all people.

“This would be the last first-past-the-post election system,” she said. “We believe we can do better.”

Green party candidate Stephanie Coburn said her party believes there needs to be democratic renewal, which allows for a system where the interests of each riding can be spoken through their MP without recourse. As it is, she said, the party whip tells members how they need to vote on issues.

“And we’re very interested in proportional representation,” Coburn said, which would reflect all of the voters who elect them in proportion to their number instead of the winner-take-all system in place now.

During the debate Moore went under fire by a member of the audience who asked why, after five opportunities to speak, he never once mentioned his leader Stephen Harper’s name.

“I’m running to be member of parliament for this area,” Moore said. “You have to be able to stand on your own two feet.”

He said he respects his leader and feels he has lead the country through considerable economic challenges. Through Harper’s leadership Moore is convinced Canada is an envied nation.

He said he won’t, however, “ride on somebody’s coat tails” as he seeks re-election in Fundy Royal. His hope, he said, is people vote for what he has done the past 10 years in the riding based on his record.

“Each of us here have to get elected – it’s our name on the ballot,” Moore said.

Lockhart said she is proud to use her leader Justin Trudeau’s name.

“I’m standing on my own two feet to be a representative of this area,” he said, “but you have to be proud of your leader as well.”

Jennifer McKenzie, the candidate for the NDP, feels the Harper government failed in finding opportunities to improve the economic condition of the country.

“And the Liberal plan is not much better,” she said. She believes like New Brunswick Liberal Premier Brian Gallant, Trudeau is “likely to do the opposite of what he said he would do during his campaign.”

Amos laughed at the question directed at Moore.

“He won’t say his boss’s name,” the Independent candidate said.

He said, however, he is not only critical of Harper as the other parties tended to be during the evening.

“I don’t like all the leaders,” he said to a chuckling crowd.

Fundy Royal campaign targets middle class with focus on jobs

Fundy Royal voters have elected Conservatives all but 1 time in 28 elections over 101 years

Candidates running in Fundy Royal are appealing to the middle class in the typically Tory-dominant riding, with a focus on jobs and the economy.

The Conservatives have strong roots in the southern New Brunswick riding — this area has given its support to the Conservatives in every election for the past century, save for 1993, when Liberal Paul Zed won office.

In 2011, Conservative incumbent Rob Moore captured nearly 60 per cent of the vote.

Moore said he hopes the party's record, with its focus on the economy and direct benefits to people, will earn him another term in office.



The Tory incumbent pointed to programs, such as the Universal Childcare Benefit, as well as family income splitting and pension income splitting, that has left more money in the pockets of Canadians.
But, he said, he has also delivered on bringing federal cash to his ridinng.

Moore says the biggest question he's heard at the door is how the next government will move the regions's economy forward.

He says the answer lies in TransCanada Corp.'s proposed Energy East pipeline.

"The [Irving Oil] refinery is employing many people in our region, there's a lot of spinoff benefits, and if we can bring that resource from Alberta to New Brunswick to be refined and sold from our port, that is a great economic opportunity," said Moore.

Liberals focus on seniors, middle class

 The Liberals are trying hard to knock off the Tories. Liberal Leader Justin Trudeau has already appeared in Sussex, the largest community in the riding.
Liberal candidate Alaina Lockhart said she is trying to appeal her campaign to the middle class.

"That's the majority of Fundy Royal," said Lockhart, who has owned Lockhart's Weddings and Special Occasions Inc. since 2004.

"People working everyday to make ends meet and the fact that we have a national campaign focused on strengthening the middle class to put more money in their pockets to then stimulate the economy, I'm encouraged by that," she said.

Lockhart says her party's focus on seniors through initiatives like affordable housing, strengthening the Canada Pension Plan and guaranteed income supplement would benefit the region.

"They worked hard their whole lives and we need to make sure they have secure retirements," she said.

Hopeful for change


NDP candidate Jennifer McKenzie says she's sensing an eagerness for change in the large riding.
McKenzie, an electrical engineer living in St. Martins, threw her name in after becoming "discouraged and disillusioned by the current government."

The region has lost a lot of its youth because of the Harper government's lack of focus on the economy, she said.

" be part of the economy and have jobs," she asid.

"The current government's focus on the prairie provinces in the oil and gas industry left New Brunswick and the Atlantic provinces neglected, and we actually had a three year recession here."
McKenzie says the NDP's focus on small business would better serve the area's economy.

"Our agricultural industry should be flourishing, we have to make sure we protect the family farm, there's fishing, forestry, I'm proud of our tourism initiatives, so much is a good fit to the NDP," she said.

 The proposed Energy East pipeline is popular in many parts of the southern New Brunswick riding, but the Green candidate said it is the wrong way to attract investment.
Stephanie Coburn, the Green Party candidate for Fundy Royal, says the promise of 14,000 direct and indirect full-time jobs across Canada is "hugely exaggerated."

"The pipeline is a bad idea for people locally and we heard about the pipeline spills in northern Alberta and Michigan, and that ... oil they hope to bring in through the pipeline is impossible to cleanup," Coburn said.

"It's a bad idea nationally because it's all going to be exported … And it's going to contribute so much to the greenhouse gases we're trying to avoid to the globe, and exacerbate global warming terribly."
Coburn says she has heard encouragement for her party at the door, a big turnaround from when she first stepped into the political arena in 2010.

"Now I feel I'm finally not talking into the wind as I have been a long time about environmental issues," said Coburn.

"People are aware of the environmental problems we experience, and we're going to experience if we don't make some changes. That's a positive change from when I first ran."

Fundy Royal contains parts of the counties of Albert, Kings, Queens, Saint John and Westmorland and includes St. Martins, Salisbury, Sussex and Petitcodiac, as well as part of Quispamsis.

CBC writes lots about people who BS a lot then don't bother to put their name on a ballot. Yet I have done so FIVE times and they have never said a peep other than bar me from the airwaves and try to have their pals in the other CROWN Corp known as the RCMP arrest me. Page 14 of this old pdf file of mine is the reason why.

I must Say I am rather impressed at CBC's sudden fit of Integrity to allow my posts to stand the test of time for a few hours at least. (: Rest assured that I have been saving digital snapshots just in case they delete and block me as usual :)

In return here is an old scoop about CTV that CBC and everybody else and his dog has been ignoring for 11 very long years after I ran in the election of the 38th Parliament against the aptly named lawyer Rob Moore.

Seems you forgot the Independent candidate, David Amos is running, heard him on the radio and has a u tube following, Funny how u tube has become become more accurate than the CBC. Shame on you, CBC.
