Province won't help rotational workers put COVID-19 isolation rules to court test
Rotational workers say New Brunswick's COVID-19 isolation requirements are 'cruel and unusual'
The Higgs government has brushed off a demand by a group of rotational workers that it fast-track a constitutional test of COVID-19 isolation requirements.
The group's lawyer, Christian Michaud, wrote to Attorney-General Ted Flemming on June 9 asking the province to send a reference case to the New Brunswick Court of Appeal.
"We propose this course of action to avoid costly and adversarial proceedings in the Court of Queen's Bench of New Brunswick," Michaud wrote in the letter.
"Our objective is not to embarrass. It is to educate and avoid 'sweeping powers' from being utilized in the future in matters of the sort."
But in a two-page letter the same day, Flemming responded that the province's pandemic rules have been "carefully balanced to impose only minimally intrusive burdens."
He also argues that those burdens will soon be lifted.
Under the province's emergency order, rotational workers returning to New Brunswick have had to self-isolate for 14 days. If they chose to self-isolate with their families, all family members had to do the same.

The workers have argued that places an unfair burden on their spouses' ability to go to work and their children's ability to go to school.
"You can't insist that a human being be separated from all other human beings for an extended period of time," said Leanne Carter, who co-ordinates a group of about 400 rotational workers.
"It's cruel and unusual."
Under Phase 1 of the province's gradual lifting of restrictions, which took effect at midnight Monday night, rotational workers returning to the province will be able to leave isolation if they test negative for COVID-19 five to seven days after arriving.
The requirement would be lifted entirely under Phase 2, which Premier Blaine Higgs said could happen within days, if not hours.

In a reference case, which only the provincial cabinet can request, lawyers for various parties bypass the trial phase of a lawsuit and go straight to the province's top court. An eventual ruling would not strike down any law but carries a lot of weight.
"It allows for a forum where legal minds can get together and pose different questions and propose different avenues ... so that eventually we can obtain clarity on the law," Michaud said.
Now that Flemming has refused the reference request, Michaud says he'll ask for a judicial review of the emergency order.
Last month, Flemming said in the legislature that he didn't like having to renew the emergency order every two weeks because the restriction on rights "goes against my grain as a libertarian" and should be "sparingly used."
Michaud and his clients are citing those comments to argue the minister acknowledged the province had adopted sweeping powers.
But Flemming said in his letter that while he would have preferred no emergency order, "it would be an error for you to infer from my comments that I do not believe these orders were and are necessary.
"Be assured: I would not have signed any order I did not agree was necessary."

Rotational workers ask for rapid testing to reduce isolation time
Negative rapid test result should be option for cutting down isolation period, rotational workers say
Rotational workers are calling on the province to offer rapid COVID-19 tests to cut down on the time they have to spend self-isolating when they return home.
Last Friday the province announced it would require all rotational workers who travel outside of New Brunswick to self-isolate for 14 days upon their return to the province.
Previously, they'd been offered the chance to reduce their isolation period if they tested negative for COVID-19 partway through the two weeks.
Michael Pelletier, a Kingsclear resident who flies back and forth to work in Alberta, wants to see the province roll out a COVID-19 rapid testing program so that he can spend less time isolating, and more time with his family.
"Why not ask us [if we want to take a test] once we get off the plane? Give us the rapid testing," Pelletier said, in an interview Friday.
With the current rules, he said he's effectively separated from his wife and children, as he's required to self-isolate in a separate part of his home for the entire duration of his time in New Brunswick. Otherwise, his family would have to self-isolate with him.
"[My] kids want to see their their dad... and the government has made it absolutely impossible for us to do that. They haven't offered any sensible solution to make that happen."
In an interview about the province's fight against COVID-19 on Friday morning, Premier Blaine Higgs said New Brunswick Public Health is looking into whether rapid testing could help reduce isolation time for rotational workers.
However, he stressed his concern over the spread of the United Kingdom variant of COVID-19, which has been identified in four separate cases in New Brunswick as of Friday.
"This phase with rotational workers, yes, it's tight, but I'd like to think that — give us a couple of weeks to months so we know what's happening here, because this has to get to be a bearable process for us," Higgs said.
"But the variant is a major concern."

Amanda Baxter of Sussex also travels to Alberta to work as a first responder on a rotational basis.
She said the province should implement a regime that lets her take a COVID-19 rapid test after a few days of self-isolating when she returns, so she can spend time with family if the result is negative.
"I think an appropriate rule would be 'Come in, self-isolate for five to seven days, get tested, and then if it's negative, then you can go out in public and see your... friends and family, if you need to, on a reasonable basis," she said.
Justifying the new rule
If the province is going to implement a new restriction on rotational workers, it should at least provide the data to justify it, said Pelletier.
He said he's asked for the number of COVID-19 cases that have been traced to rotational worker travel, as well as the number of cases that have been traced to persons crossing the border on a regular basis for reasons deemed essential.
So far, he said he's received no response.
"Show us the actual data of rotational workers testing positive and also show us the data of daily commuters testing positive," Pelletier said. "Show us the data that gives you the justification to confine us or isolate us."
The Department of Justice and Public Safety did not provide those statistics by publication time Friday.
On Friday morning, Higgs said about 3,000 people have crossed into New Brunswick for purposes deemed essential. While some of those are driving through to locations in Prince Edward Island and Nova Scotia, he said New Brunswick is the destination for many.

When Adrian Cornect managed to schedule a COVID-19 vaccine appointment, he turned down shifts at his work site in northern Ontario and scrambled to book a last-minute flight to New Brunswick.
The $1,800 ticket and lost work hours meant he would soon be able to easily see his family after months of restrictions keeping them apart.
But, two days after getting the shot, the rules changed again.
"People are frustrated," Cornect said. "We're being pointed out as rotational workers."
New Brunswick had announced loosened restrictions for rotational workers and prioritized them for the vaccine, allowing them to avoid self-isolation 14 days after receiving a first dose.
Public Health reversed that decision on Friday. Now, all rotational workers, including those who are vaccinated, must self-isolate for a full two weeks, away from others.
Many rotational workers have been calling for testing to reduce self-isolation over the past few months. Truck drivers and regular cross-border commuters are under less-restrictive rules, which allow for modified isolation with their household.
Cornect goes back and forth between his home in Rothesay and work at Abitibi Canyon in northern Ontario.

Under self-isolation rules, his wife has to leave the house and move in with her parents during visits home.
"There is a breaking point and the breaking point is very near," he said.
"The government has to realize people have families. It's not everybody that has a job in New Brunswick they can go home every night to."
'We've all done our part'
Sean Hudson lives in Hampton and works as the flight operations co-ordinator at Baffin Iron Mines in Nunavut. He works three weeks on and three weeks off and called the change "disheartening."
"I thought life could go back to somewhat normal where I could see the family and now even with my vaccine, I'll have to go two weeks without seeing them," he said.
The mine site frequently tests employees and has stringent COVID-19 protocols in place.
Hudson said the vaccine was a "glimmer of hope" for being able to spend time with his three young children. He's holding off to tell them about the rule change and hoping things will change before his rotation ends.
"We've all done our part to stay safe and keep people and safe and I have no issue doing that — but I'd just like it to be fair," he said. "For some reason the rotational workers have been demonized."

Gregory Thomas is hopeful about revised restrictions for rotational workers.
But he's still waiting to hear if the province's plan will allow him to see his family without taking his daughter out of school.
The Moncton technician works 14-day rotations at a diamond mine in northern Quebec.
"They obviously know that there was a huge strain put on the out-of-province workers and their families," he said.
Rotational workers have been calling for a reversal of tighter restrictions rolled out on Jan. 30. The current rules require them to self-isolate for a full 14 days away from others.
Before the changes, they could leave isolation early following a negative test, and stay at home with family.
Premier Blaine Higgs said Friday the government is developing a plan to address travel restrictions after hearing concerns.
"I know that the tighter border restrictions have been hard on many people," Higgs said in a statement.
The plan will be developed by Public Health and presented in mid-March to the all-party cabinet committee on COVID-19. No details have been shared publicly.
'Negative stigma'
The new rules have left some rotational workers unable to see their families or forced them to change their work schedules.
When Thomas last returned home, he took his eight-year-old daughter out of school for two weeks so they could isolate together. Her teacher offered to send home assignments and work.
"There's certainly a mental health impact," he said. "I could get through because of the people that I'm surrounded with, but there are many people out there that are going to be in trouble."
Many rotational workers, including Thomas, say the specific rules have singled them out and are adding to "negative stigma" toward those who work outside New Brunswick.

His family strongly considered moving to Nova Scotia, and that remains a possibility.
"This isn't something that is easily forgettable," Thomas said. "It was a harsh decision."
Michael Pelletier goes back and forth between his home in Fredericton and Alberta, where he works two-week rotations as a quality inspector for the gas and oil industry.
Since the changes went into effect, Pelletier has returned home twice.
The first time he spent his isolation alone in the basement of his house. His wife took two weeks off work without pay for the second visit, so they could isolate together.
Pelletier hasn't seen his three children. They are staying with their grandparents for the two weeks so they can continue to attend school.
He said tight rules specifically targeting rotational workers, without providing data or evidence on the risk they pose, is resulting in mistreatment.

A spokesperson for Public Health would not say how many rotational workers have contributed to outbreaks or community spread.
Pelletier said he has heard some spouses of rotational workers have been asked to go home from work.
"Our families feel blamed, we feel blamed, our children that go to school get blamed," he said. "As soon as they hear that their parents are rotational workers they get bullied, they get mistreated."
Calls for expanded testing
New Brunswick rotational workers have been asking for rapid testing to cut down on isolation time when they return home.
The province has only used a small portion of its rapid tests received from the federal government.
Dr. Jennifer Russell, the province's chief medical officer of health, has frequently said the tests are useful for screening but need to be confirmed with a followup PCR test. Those results can take up to two days to receive.
Despite the limited use of rapid tests, Public Health is exploring using them for cross-border travellers.

A Hartland pharmacy is now offering rapid tests for people who cross the border frequently, such as daily commuters and truck drivers. Public Health hopes to expand the pilot project to other locations in the province.
Pelletier said the announcement from the premier felt like "a slap in the face" after the expansion of rapid testing for truck drivers, but not rotational workers.
He wants to see rapid testing at the airport, and work isolation with testing on the fifth and 10th days. That's what the province has in place until late January.
New Brunswick rotational workers are planning to file a lawsuit against the provincial government and have raised more than $23,000 online to cover legal fees.
A spokesperson said the province does not comment on potential legal matters.

All options are always on the table to maintain a sense of normalcy in life, which perpetual isolation is not, I'm sure you understand. We are professionals in industries that do not exist in NB, most of which to no fault of the province. We love living in the places we grew up. This had never been an issue before the complexity of the problems that arose for people everywhere because of the pandemic. We simply want the option to be tested to ensure the safety of ourselves, our familes, and the people of our province while being able to live safely under the same circumstances as everyone else at the alert level determined by the government. I understand where you are coming from but these are NOT normal times and we will return to some sense of normalcy likely before the end of the year. All of us are making sacrifices. I have grand children whom I have not seen in a year, but I am not complaining. Many have lost fathers, mothers or grandparents or dear friends to covid and in many cases the cause traces back to people who arrive from outside of NB like rotational workers. So you have to look at it from their point of view. Your hardship will last another 6 to 8 months but their loss will be with them forever.
Action From Rotational Workers, A Fight For Rights
Team fundraiserSince the beginning of the Covid-19 pandemic, Rotational Workers (RWs) have been unfairly blamed and publicly vilified by the GNB for spreading Covid-19. They’ve been unfairly targeted with restrictions and the burden imposed on these families has caused irreparable damage which continues to poison New Brunswick’s social fabric.
Even today, the language used by the GNB continues to pose unsubstantiated blame on RWs and their families even when the data(obtained thru Rights to Information Act proves their otherwise. The resulting stigma has turned communities against RWs;
Children are being bullied,
Neighbors harbor resentment,
People are being followed, harassed, plate shamed,
Families have been denied medical care, schooling, and access to private and public services,
…and the list goes on.
These families have been marginalized in the eyes of their communities and the discrimination is blatant.
The GNB has repeatedly refused to use NBs resources to help make Rotational Workers’ journey home safe. Instead, the government has opted to use these resources to ostracize and keep RWs away. The strain on these families is at a breaking point as they’re being forced apart by restrictions that make family life impossible.
To say RWs are upset at the government’s current stance is an understatement. We feel cheated, betrayed, and discriminated against by our provincial government. We believe our rights have been infringed and ignored.
Legal Action
RWs and their families have now organized and have sought legal representation from New Brunswick's leading Constitutional Lawyers, LiberSolus Law, who have agreed to defend and uphold our rights set forth in the Charter of Rights and Freedoms and the Canadian Constitution.
Legal Action will be led by Senior Counsel Christian Michaud, Q.C., a seasoned Constitutional Lawyer.

Since the beginning of the Covid-19 pandemic, Rotational Workers (RWs) have been unfairly blamed and publicly vilified by the GNB for spreading Covid-19. They’ve been unfairly targeted with restrictions and the burden imposed on these families has caused irreparable damage which continues to poison New Brunswick’s social fabric.
Even today, the language used by the GNB continues to pose unsubstantiated blame on RWs and their families even when the data(obtained thru Rights to Information Act proves their otherwise. The resulting stigma has turned communities against RWs;
Children are being bullied,
Neighbors harbor resentment,
People are being followed, harassed, plate shamed,
Families have been denied medical care, schooling, and access to private and public services,
…and the list goes on.
These families have been marginalized in the eyes of their communities and the discrimination is blatant.
The GNB has repeatedly refused to use NBs resources to help make Rotational Workers’ journey home safe. Instead, the government has opted to use these resources to ostracize and keep RWs away. The strain on these families is at a breaking point as they’re being forced apart by restrictions that make family life impossible.
To say RWs are upset at the government’s current stance is an understatement. We feel cheated, betrayed, and discriminated against by our provincial government. We believe our rights have been infringed and ignored.
Legal Action
RWs and their families have now organized and have sought legal representation from New Brunswick's leading Constitutional Lawyers, LiberSolus Law, who have agreed to defend and uphold our rights set forth in the Charter of Rights and Freedoms and the Canadian Constitution.
Legal Action will be led by Senior Counsel Christian Michaud, Q.C., a seasoned Constitutional Lawyer. The Action Group Legal Organizers are Joshua Belmore and Leanne Carter. Rotational Workers who participate in this lawsuit with a donation will gain access to our private email list and Private Facebook Group Action For New Brunswick Rotational Workers where detailed legal developments will be communicated. All individual grievances submitted by donators will be gathered and submitted. This type of Legal Action is expensive. To achieve our objective, the suggested donation amount is $100 Per Rotational Worker. Fundraising objectives will be updated at different stages of the Lawsuit; the Action Plan is updated as fundraising goals are met and as the court case develops.

PHASE 1: Opinion Letter: COMPLETED

Completed in 10-15 days after payment
The Opinion Letter is presented to a judge which opens our case in court. It is expected this will force the government to provide ALL data relating to restrictions on RW. This step will also layout where the Emergency Measures Act (EMA) has violated the fundamental rights of RWs and their families; including but not limited to denied testing, denied freedom of mobility, trespassing, and harassment.
PHASE 2: Court Application and Court Submission: FUNDING ALMOST COMPLETE!($2,668.00 away)

This gets our case in court in front of a judge.

In order to file an Injunction with the court this donation amount needs to get to $66,000. The lawyers will not be beginning to prepare the emergency injunction until paid in full. $50,000.

I feel that we are in danger from a rogue government that is severely overstepping their limits and obviously has nobody holding them accountable for their actions. The MLAs appear to be helpless. It affects all of us, it’s not isolated to a specific group or whether you are vaccinated or not. It directly or indirectly affects all of us. It is imperative that we not voluntarily surrender our charter of rights and freedoms that are very clearly being illegally violated. If we stand up and contribute, it is very evident with supporting facts that we will be successful. We don’t have a choice but to be successful. We can’t live like this and we can’t expect our kids to either. The sooner we plant our feet and push back collectively, the higher chance of success. The world won’t be ruined by those that do evil, it will be by those who sit back and watch. I am a rotational worker, I want to be tested and granted freedom with a negative test when I get home, I also want vaccinated people to be able to keep their freedom with a negative test when they get home too because that door also appears to be slowly closing as some people are getting sick anyway. It’s obvious that testing is key, no matter what situation you’re in. I’m committing to donating $200 per month for as long as I can to fund this lawsuit. Dropped isolation rule for rotational workers comes too late for N.B. family
Karine Boudreau and her family are leaving province Thursday, just as restrictions are lifted
Restrictions on rotational workers returning to New Brunswick have been dropped, but for one family, that didn't come soon enough.
Karine Boudreau said she, her husband, and their three young children will be leaving their home in Moncton on Thursday and relocating to Alberta in response to rules that had required her husband to self-isolate upon returning home from his job site in Saskatchewan.
Her husband, Christian Goguen, works as a civil engineer at a wind farm. He typically works 21 days at a time and is off for seven but had been working rotations as long as two months to be able to spend time with his family after isolating.
"It's been a lot of loneliness," Boudreau said.
"We know that we're really lucky that we haven't been affected as much as some other families, but it's been really difficult on especially my kids, not seeing their father for months and months and months at a time."
Until January, rotational workers returning to the province could leave isolation once they tested negative for COVID-19 upon their return. That changed when the government introduced a requirement that they self-isolate for 14 days upon returning home.
If their relatives were to physically spend time with them for that period, they'd also be required to self-isolate for the same period.
On Wednesday, as part of the province's "path to green" plan, Premier Blaine Higgs announced all self-isolation requirements for rotational workers would be dropped as of Thursday.
'Happy to be leaving'
For Boudreau and her husband, however, the move had already been finalized.
Boudreau said the decision was made weeks ago, when the province loosened restrictions for rotational workers who'd been vaccinated, then reversed that change within just days.
"We're a little sad. Our our whole family is here," Boudreau said.
"We grew up here, but I think for everyone's mental health at this point, we have to get out."
Aside from the isolation rules, Boudreau said, the move was prompted by hateful online messages she received, particularly after going public about the strain the new rules would have on her and her family when they were first announced.
"The stigma has been really, really difficult, too. There's been a lot of misinformation and a lot of hate towards rotational workers and that has been really taxing mentally on us and my children.
"So we're happy with the decision for now. In a few years we might re-evaluate, but for now, we're we're happy to be leaving."
Fellow rotational worker would have done the same
Victor Melanson understands the decision by Boudreau and her family and said he would have done the same had he been a bit younger.
Just shy of 52, Melanson, who works on rotation in Alberta, is part of a group of other rotational workers who demanded the New Brunswick government test the constitutional validity of those requirements in court.
"The thought [of moving away from New Brunswick] was not far from my mind at one point, but when you're in your 50s and you're a little older in life, it's not as easy as it looks," he said.
Melanson added that although isolation requirements have been dropped for rotational workers, there's no guarantee they won't be reinstated if COVID case numbers spike again.
"Rolling into the fall, if there happens to be a little outbreak somewhere in the country here, I mean, who's to say that they're not going to just, you know, flip the switch back to what they were doing for the past six months or so?"

The Gallant government has introduced legislation to merge several
legislative watchdog positions into a single job and has chosen a
retired judge to take on the newly expanded role.
Alexandre Deschênes
Alexandre Deschênes, a retired New Brunswick Court of Appeal justice,
is to be the first integrity commissioner in New Brunswick.
Retired New Brunswick Court of Appeal justice Alexandre Deschênes will
become the province's first integrity commissioner, an appointment
supported by the opposition Progressive Conservatives and Green Party
Leader David Coon.
Premier Brian Gallant introduced a bill Wednesday to create the position.
For now, Deschênes fills the vacant position of conflict-of-interest
commissioner and will also oversee legislation governing the privacy
of personal health records.
Next July, Deschênes will add responsibility for the lobbyist registry
to his duties.
The Liberals say they will proclaim legislation to set up the registry
by next July. The law was passed by the previous PC government in 2014
but not enacted.

The distinction of Queen’s Counsel is conferred upon experienced

courts or have demonstrated exceptional service to the profession.
In the fall of this year, a committee consisting of the Chief Justice
of New Brunswick, J. Ernest Drapeau, the Attorney General of New
Brunswick and the President of the Law Society of New Brunswick, will
consider candidates for the next Queen’s Counsel appointments.
The distinction of Queen’s Counsel is conferred upon experienced
lawyers in recognition of their commitment to the principles of the
legal profession and contributions to their communities. The criteria
for these appointments are:
A regular member of the Law Society of New Brunswick who:
a) has been engaged in the active practice of law in the Province of
New Brunswick for at least fifteen years, with extensive experience
before the courts;
b) in the opinion of the Committee, merits the appointment by reason
of exceptional service to the legal profession.
It should be noted that past practice indicates that Queen’s Counsel
appointments typically have more than seventeen years at the Bar.
The Law Society encourages members to forward a letter and a resume in
order to be considered as a candidate for a Queen’s Counsel

A Progressive Conservative MLA has taken the unusual step of naming
names — including that of a sitting provincial court judge — in his
attack on a proposed law on how Court of Queen's Bench judges are
transferred.
Kirk MacDonald told the legislature last week that he believes the
government bill was drafted to help the spouse and the brother-in-law
of federal Liberal MP Dominic LeBlanc, a close ally of Premier Brian
Gallant.

"I will give you two names. I will give you Jolène Richard and André
Richard, two people I believe are looking for judicial appointments
here in New Brunswick," MacDonald said during second-reading debate on
the bill.
In fact, Jolène Richard is already a provincial court judge. André
Richard is her brother and a senior lawyer at Stewart McKelvey.
Province names new judge, wife of MP Dominic LeBlanc
"Dominic LeBlanc has some judges that he wants to appoint in New
Brunswick, and the framework as it currently exists does not allow for
that to happen," MacDonald said.
André Richard stated Thursday he "had no involvement in the
government's decision to propose changes to the Judicature Act."
"As you know, my sister is already a judge who sits in Moncton. I fail
to understand why our names are being brought into this debate."
Bill gives veto to minister
The Liberal bill would amend the Judicature Act, which governs how
courts operate, to give the justice minister a veto over Chief Justice
David Smith of the Court of Queen's Bench transferring judges from one
court to another.

PC MLAs have hinted in the past about who they believe the bill was
designed to help. But until now, no one was willing to name them.
It's rare for politicians to draw sitting judges into partisan
debates, and the veteran Tory MLA did not offer any evidence to back
up his allegations. He turned down a request to explain his views in
an interview.
Parliamentary privilege
Parliamentary privilege protects members of the legislature from being
sued for defamation or held in contempt of court for comments they
make during proceedings. No such protection exists for things they say
outside the legislature.
Provincial court judges such as Richard are appointed by the province,
but Court of Queen's Bench justices are named by Ottawa. Both courts
are administered by the province, but the current law gives Smith the
power to move judges on his court on his own.
Smith has argued the bill would threaten the independence of the
courts, which could make it unconstitutional.
Bill brought back
The Liberals introduced the bill during the last session, but it
didn't pass before the session ended. They brought it back last week.
Justice Minister Denis Landry said last week the bill was designed to
bring "best practices" to court administration and end the pattern of
justices being named to smaller courthouses and then being transferred
soon after.

"This is what we want to correct," he said. "If we name a judge, they
should reside there, for a long period of time, not just two or three
months then move them where they want to go."
Asked whether he'd veto such a transfer, Landry said, "This is what we'll see."
Landry's department said Thursday it would not comment on MacDonald's
accusation.
Larger locations favoured
MacDonald said during last week's debate that it's true Court of
Queen's Bench justices are often appointed to smaller locations and
are then moved to one of the three largest cities.

He said that court postings in Moncton, Fredericton, and Saint John
are "The positions that everyone seems to want."
And he said the current system for moving judges, "which is controlled
by the chief justice, does not work for Dominic LeBlanc and the
Liberal Party of New Brunswick," MacDonald said.

In June, Smith transferred Justice Tracey DeWare from Woodstock to

DeWare was moved to fill a vacancy after Justice Brigitte Robichaud
switched to supernumerary, or part-time, status.
Jolène Richard did not respond to interview requests.

Little David Amos’ “True History Of War” Canadian Airstrikes And
Stupid Justin Trudeau
Canada’s and Canadians free ride is over. Canada can no longer hide
behind Amerka’s and NATO’s skirts.
When I was still in Canadian Forces then Prime Minister Jean Chretien
actually committed the Canadian Army to deploy in the second campaign
in Iraq, the Coalition of the Willing. This was against or contrary to
the wisdom or advice of those of us Canadian officers that were
involved in the initial planning phases of that operation. There were
significant concern in our planning cell, and NDHQ about of the dearth
of concern for operational guidance, direction, and forces for
operations after the initial occupation of Iraq. At the “last minute”
Prime Minister Chretien and the Liberal government changed its mind.
The Canadian government told our amerkan cousins that we would not
deploy combat troops for the Iraq campaign, but would deploy a
Canadian Battle Group to Afghanistan, enabling our amerkan cousins to
redeploy troops from there to Iraq. The PMO’s thinking that it was
less costly to deploy Canadian Forces to Afghanistan than Iraq. But
alas no one seems to remind the Liberals of Prime Minister Chretien’s
then grossly incorrect assumption. Notwithstanding Jean Chretien’s
incompetence and stupidity, the Canadian Army was heroic,
professional, punched well above it’s weight, and the PPCLI Battle
Group, is credited with “saving Afghanistan” during the Panjway
campaign of 2006.
What Justin Trudeau and the Liberals don’t tell you now, is that then
Liberal Prime Minister Jean Chretien committed, and deployed the
Canadian army to Canada’s longest “war” without the advice, consent,
support, or vote of the Canadian Parliament.
What David Amos and the rest of the ignorant, uneducated, and babbling
chattering classes are too addled to understand is the deployment of
less than 75 special operations troops, and what is known by planners
as a “six pac cell” of fighter aircraft is NOT the same as a
deployment of a Battle Group, nor a “war” make.
The Canadian Government or The Crown unlike our amerkan cousins have
the “constitutional authority” to commit the Canadian nation to war.
That has been recently clearly articulated to the Canadian public by
constitutional scholar Phillippe Legasse. What Parliament can do is
remove “confidence” in The Crown’s Government in a “vote of
non-confidence.” That could not happen to the Chretien Government
regarding deployment to Afghanistan, and it won’t happen in this
instance with the conservative majority in The Commons regarding a
limited Canadian deployment to the Middle East.
President George Bush was quite correct after 911 and the terror
attacks in New York; that the Taliban “occupied” and “failed state”
Afghanistan was the source of logistical support, command and control,
and training for the Al Quaeda war of terror against the world. The
initial defeat, and removal from control of Afghanistan was vital and
essential for the security and tranquility of the developed world. An
ISIS “caliphate,” in the Middle East, no matter how small, is a clear
and present danger to the entire world. This “occupied state,”
or“failed state” will prosecute an unending Islamic inspired war of
terror against not only the “western world,” but Arab states
“moderate” or not, as well. The security, safety, and tranquility of
Canada and Canadians are just at risk now with the emergence of an
ISIS“caliphate” no matter how large or small, as it was with the
Taliban and Al Quaeda “marriage” in Afghanistan.
One of the everlasting “legacies” of the “Trudeau the Elder’s dynasty
was Canada and successive Liberal governments cowering behind the
amerkan’s nuclear and conventional military shield, at the same time
denigrating, insulting them, opposing them, and at the same time
self-aggrandizing ourselves as “peace keepers,” and progenitors of
“world peace.” Canada failed. The United States of Amerka, NATO, the
G7 and or G20 will no longer permit that sort of sanctimonious
behavior from Canada or its government any longer. And Prime Minister
Stephen Harper, Foreign Minister John Baird , and Cabinet are fully
cognizant of that reality. Even if some editorial boards, and pundits
are not.
Justin, Trudeau “the younger” is reprising the time “honoured” liberal
mantra, and tradition of expecting the amerkans or the rest of the
world to do “the heavy lifting.” Justin Trudeau and his “butt buddy”
David Amos are telling Canadians that we can guarantee our security
and safety by expecting other nations to fight for us. That Canada can
and should attempt to guarantee Canadians safety by providing
“humanitarian aid” somewhere, and call a sitting US president a “war
criminal.” This morning Australia announced they too, were sending
tactical aircraft to eliminate the menace of an ISIS “caliphate.”
In one sense Prime Minister Harper is every bit the scoundrel Trudeau
“the elder” and Jean ‘the crook” Chretien was. Just As Trudeau, and
successive Liberal governments delighted in diminishing,
marginalizing, under funding Canadian Forces, and sending Canadian
military men and women to die with inadequate kit and modern
equipment; so too is Prime Minister Stephen Harper. Canada’s F-18s are
antiquated, poorly equipped, and ought to have been replaced five
years ago. But alas, there won’t be single RCAF fighter jock that
won’t go, or won’t want to go, to make Canada safe or safer.
My Grandfather served this country. My father served this country. My
Uncle served this country. And I have served this country. Justin
Trudeau has not served Canada in any way. Thomas Mulcair has not
served this country in any way. Liberals and so called social
democrats haven’t served this country in any way. David Amos, and
other drooling fools have not served this great nation in any way. Yet
these fools are more than prepared to ensure their, our safety to
other nations, and then criticize them for doing so.
Canada must again, now, “do our bit” to guarantee our own security,
and tranquility, but also that of the world. Canada has never before
shirked its responsibility to its citizens and that of the world.
Prime Minister Harper will not permit this country to do so now

"I remember years ago when the debate was on in Canada, about there
being weapons of mass destruction in Iraq. Our American 'friends"
demanded that Canada join into "the Coalition of the Willing. American
"veterans" and sportscasters loudly denounced Canada for NOT buying
into the US policy.
At the time I was serving as a planner at NDHQ and with 24 other of my
colleagues we went to Tampa SOUCOM HQ to be involved in the planning
in the planning stages of the op....and to report to NDHQ, that would
report to the PMO upon the merits of the proposed operation. There was
never at anytime an existing target list of verified sites where there
were deployed WMD.
Coalition assets were more than sufficient for the initial strike and
invasion phase but even at that point in the planning, we were
concerned about the number of "boots on the ground" for the occupation
(and end game) stage of an operation in Iraq. We were also concerned
about the American plans for occupation plans of Iraq because they at
that stage included no contingency for a handing over of civil
authority to a vetted Iraqi government and bureaucracy.
There was no detailed plan for Iraq being "liberated" and returned to
its people...nor a thought to an eventual exit plan. This was contrary
to the lessons of Vietnam but also to current military thought, that
folks like Colin Powell and "Stuffy" Leighton and others elucidated
upon. "What's the mission" how long is the mission, what conditions
are to met before US troop can redeploy? Prime Minister Jean Chretien
and the PMO were even at the very preliminary planning stages wary of
Canadian involvement in an Iraq operation....History would prove them
correct. The political pressure being applied on the PMO from the
George W Bush administration was onerous
American military assets were extremely overstretched, and Canadian
military assets even more so It was proposed by the PMO that Canadian
naval platforms would deploy to assist in naval quarantine operations
in the Gulf and that Canadian army assets would deploy in Afghanistan
thus permitting US army assets to redeploy for an Iraqi
operation....The PMO thought that "compromise would save Canadian
lives and liberal political capital.. and the priority of which
....not necessarily in that order. "

North American Palladium and Impala Platinum Announce Completion of Arrangement and Creation of Impala Canada
TORONTO, Dec. 13, 2019 (GLOBE NEWSWIRE) -- North American Palladium Ltd. ("NAP" or the "Company")
(TSX:PDL) (OTC PINK:PALDF) is pleased to announce the successful
completion of its previously announced plan of arrangement under the Canada Business Corporations Act (the “Arrangement”) with Impala Platinum Holdings Limited (“Implats”).
Pursuant to the Arrangement, Implats has acquired 100% of the
outstanding common shares of the Company for a total cash consideration
of approximately C$1.0 billion.
Upon completion of the Arrangement, NAP became a wholly-owned subsidiary of Implats. With the acquisition of NAP, Implats has strengthened its competitive position by adding the Lac des Iles Mine to its asset portfolio. The low-cost Lac des Iles Mine immediately boosts Implats’ value and strengthens cash flow to advance its journey toward delivering sustainable shareholder returns. It also diversifies the group’s production base with a palladium-rich operation in an established, low-risk mining jurisdiction. Going forward, NAP will operate in Canada under the name Impala Canada Ltd. (“Impala Canada”).

The former Chief Financial Officer of NAP, Tim Hill, has been appointed Chief Executive Officer of Impala Canada. The NAP corporate office in Toronto will become the regional office for Implats, while NAP’s finance and exploration offices will remain in Thunder Bay, Ontario.

The Arrangement was approved by NAP’s shareholders at a special meeting held on December 4, 2019, and by the Ontario Superior Court of Justice (Commercial List) on December 9, 2019. Under the terms of the Arrangement, shareholders of NAP, other than Brookfield Business Partners L.P. (together with its institutional partners), will receive C$19.74 per NAP common share in cash, and Brookfield Business Partners L.P., as the majority shareholder of NAP, will receive C$16.00 per NAP common share in cash.
The Company expects that its common shares will be delisted from the Toronto Stock Exchange on or about December 16, 2019, and the Company intends to promptly apply to cease to be a reporting issuer in each of the provinces and territories of Canada. Implats trades on the JSE Limited (JSE: IMP). Implats shares may also be traded via sponsored level 1 ADR programme (IMPUY) (IMPUF) (U.S.:OTC).
