Off to court this day to stand up for myself and my rights to legally protest as outlined in the Bill of Rights, The Charter of Rights and freedoms.
Protesting is legal especially when it comes to authority and matters involving the rights of our children.
Yes this is about our parental rights to have open dialogue with what’s happening in schools. The rights for our children to have inappropriate books removed from schools, The rights for biological male and females to have their own washrooms.
Today is plea day……

All done court for this morning:)
Here’s a quick update as to my current legal situation with the abuse of power from our premier. I have not committed any crime. I have not done anything besides stand up for our children and our province.
Anyone in politics should know that when people are not happy there is a permission to lawfully, legally and peacefully gather.
Here’s a pretty big rant over what I see and what is happening in our province and across the country.
If you would like to help me my email is ravenlemonade@gmail.com
The beauty about court is a win for one for is a win for all.
It’s time for all of us to participate in the future of our families, province and country.
We have to free ourselves from the bondage of tyranny and government overreach. You all see it , you are all starting to feel it and it’s time for you to show up.
Sending love this day…

It was another terrible day in Lethbridge Court. This time, the Crown, Steven Johnston, turned his ire onto the public. Announced in Court yesterday was the allegation that the publication ban on the "crime-fraud" envelope was breached. The Crown said that "the person is in this Court now" and mentioned "contempt of Court" and "banning the person from the proceedings" for publishing the decision from the Judge. These threats to citizens and independent journalists cannot be tolerated and must be fought. It's the last shred of honesty Canada has left.

If what they say is true then why does this bastard mute me?

Dana Metcalfe court hearing set over after her lawyer, Averill Baker, hit with suspension

Metcalfe and co-accused Shane Sweeney due back in court Dec. 13

Dana Metcalfe and Shane Sweeney were back in provincial court Thursday morning on charges of harassing and disturbing Premier Andrew Furey, but there was a hiccup preventing the case from moving forward.

Metcalfe's lawyer, Averill Baker, has been suspended by the Law Society of Newfoundland and Labrador.

Metcalfe and Sweeney are facing charges of criminal harassment and causing a disturbance over a "surprise convoy" protest on July 9 outside Furey's Portugal Cove-St. Philip's home.

The court heard Sweeney is being represented by Avalon Law Group lawyer Sandra Fry.

Fry explained to Judge Pamela Goulding she was new to the case and needed more time to familiarize herself with it.

Metcalfe raised her hand to tell the judge that she had been informed by Baker on Friday that she no longer intends to practise law. As a result, Metcalfe said she was looking for a new lawyer.

Baker did not respond to requests for comment from CBC News as of publishing time.

The judge agreed to set the next court appearance for Dec. 13.

It was announced earlier that a Crown prosecutor would be brought in from Nova Scotia to handle the case in order to avoid allegations of conflict of interest, as the case involves the premier. Nova Scotia Crown lawyer Robert Kennedy appeared via teleconference on Thursday.

Baker's law society membership was suspended effective Oct. 25 because she failed to complete 15 hours of professional development, which is mandatory of all practising members of the law society.

Path forward for Baker

According to a statement from the law society, Baker's suspension can be lifted if she fulfils the course hours and then files an application to have her practising status reinstated.

"This application will be reviewed by the education committee of the Law Society who may impose certain conditions, restrictions, and/or requirements which they reasonably determine to be in the public interest," added a spokesperson.

While this was Baker's first suspension, she has been disciplined previously.

In 2014, Baker was disciplined by the law society for an explosive and profanity-laced tirade against a provincial court clerk that took place in 2011.

Also in 2014, Baker was caught sharing what was described as a "passionate kiss" with then client Philip Pynn, just moments before he was arrested in relation to a murder charge.

Her apartment had been under Royal Newfoundland Constabulary surveillance on July 11, 2011, two days after Nick Winsor was shot to death on Portugal Cove Road.

More recently, in September the law society's adjudication tribunal found Baker guilty of eight complaints.

Documents say Baker had pleaded not guilty but didn't co-operate with the investigation.

At one point Baker claimed to be too ill to attend a hearing, only to pop up on her YouTube channel where she gives tarot card readings, as first reported by the online news organization allNewfoundlandLabrador. Her channel, Prisca Theologia Tarot, has more than 8,000 subscribers.

The complaints stem from her interactions with clients and the law society, such as not co-operating with a trust audit or a disciplinary investigation.

Another complaint was that after she was evicted from her law office in November 2021, she failed to protect solicitor-client information.

The adjudication tribunal decided that Baker deserved to be sanctioned and that it was up to the law society to connect with Baker to determine what sanctions would look like.

Summer 'surprise convoy'

Thursday's court appearance stems from an incident outside the premier's home this past summer.

Videos posted to Sweeney's Facebook account show a protest filled with honking vehicles and smoke flares outside Furey's home.

The protesters claimed they were there to speak out against the "sexualization and indoctrination" of schoolchildren.

Shane Sweeney and Dana Metcalfe have been charged with criminal harassment and causing a disturbance after what they dubbed a “surprise convoy” to N.L. Premier Andrew Furey’s house in July. On Friday, Furey said political leaders don’t step up to serve to “have their children frightened.”

Talking to his camera, Sweeney said they were at Furey's home because "he doesn't listen to us when we're at Confederation Building. He sends his paid counterprotesters to city hall. So here we are."

Metcalfe, who was seen in the video at the protest, also posted Sweeney's video to Facebook and X, the platform then known as Twitter.

Dana Metcalfe to represent herself on charge of harassing premier

Metcalfe and co-accused Shane Sweeney due back in court Feb. 13

Dana Metcalfe and co-accused Shane Sweeney returned to St. John's provincial court Wednesday over a protest staged at Premier Andrew Furey's home — and this time Metcalfe said she's had to take on the role of representing herself.

Metcalfe and Sweeney are each facing charges of criminal harassment and causing a disturbance over a "surprise convoy" protest on July 9 outside Furey's Portugal Cove-St. Philip's home.

Sandra Fry, who represents Sweeney, told Judge James Walsh she had received an offer from the Crown and she needed time to review it with her client to "see if we can come to a resolution."

In order to avoid allegations of conflict of interest, as the case involves the premier, a Crown attorney from Nova Scotia, Rob Kennedy, is handling the case. Kennedy appeared via teleconference Wednesday.

Both Fry and Nova Scotia Public Prosecution Office spokesperson Melissa Noonan declined to comment.

Metcalfe, who had previously been represented by Averill Baker, told Walsh she was now representing herself.

"I haven't been successful finding counsel here because of the high profility of the case," said Metcalfe, adding that she was seeking assistance from a constitutional lawyer.

Metcalfe and Sweeney are due back in court Feb. 13.

"Finding a counsel in this province, because of the nature of what this involves, especially when it addresses the premier, has been quite challenging," Metcalfe told reporters outside the courtroom.

"So I am getting support from constitutional lawyers across the country because this involves my ability to have free speech and … to be able to have a voice."

She added that she believes the case involved human rights and what she called the "bill of rights," likely referring to the Canadian Charter of Rights.

A twitter post of Dana Metcalfe replying to Elon Musk for legal support.                                           In November, Dana Metcalfe appealed to Elon Musk over her legal problems, saying she couldn't get a lawyer because they had been 'bought.' (X)

When asked about a post she made in late November on X, formerly known as Twitter, where she alleged she couldn't retain a lawyer because they had been "bought," Metcalfe responded, "Well, when you have a situation where the courts have retained counsel for multiple different reasons, it's a conflict of interest. So it's not bought, it's called being retained."

Metcalfe made the online comments in a response to an Elon Musk post offering resources to anyone who lost their job because of comments made about their employer.

Metcalfe then walked away without answering other questions from reporters.

In the post on X, Metcalfe told Musk she wanted to "charge [Furey] with an abuse of power and have him removed."

During a Nov. 2 court appearance, Metcalfe said she had been informed by her then lawyer, Averill Baker, that Baker no longer intended to practise law. As a result, Metcalfe said, she's looking for a new lawyer.

Baker's law society membership was suspended effective Oct. 25 because she failed to complete 15 hours of professional development, which is mandatory for all practising members of the law society.

N.L. law society disbars Averill Baker, calling her 'ungovernable'

Baker had previously been suspended by the law society

St. John's lawyer Averill Baker has been disbarred by the Law Society of Newfoundland and Labrador after it found her deserving of sanctions over eight complaints.

In its Nov. 27 decision, the law society's adjudication tribunal called Baker "ungovernable" and ordered her to pay $9,350 to the law society.

"Averill Baker has been struck from the Roll of Barristers in the Province of Newfoundland and Labrador and all her rights and privileges as a member of the Law Society of Newfoundland and Labrador have ceased," said the notice, which was posted Wednesday on the law society website.

Baker did not respond to requests for comment by publication time.

In September, the law society's adjudication tribunal found Baker guilty of eight complaints following hearings between May and July.

Those complaints alleged Baker didn't respond to a trust audit report, failed to reply to law society communications, failed to move a client's matter forward or respond to client quickly enough, wasn't honest or candid with a client, didn't return a client's file, and used an unprofessional tone and misled a client.

The tribunal also found that she didn't protect solicitor-client information related to an eviction from her law office in November 2021. The landlord put Baker's property, which included clients' files, into storage. Baker didn't make any move to retrieve the property and the landlord contacted the law society, who took possession of the materials.

"When the law society took possession in accordance with a custodianship order on Dec. 20, 2021, it was discovered that the office space, in which the filing cabinets and boxes with client files were stored, was not locked. The filing cabinets were not locked and client information was visible when the door to the space was opened," the tribunal wrote in its decision.

According to those documents, one client referred to as Mr. M testified at the hearing that he tried to get his files from Baker so he could go to another lawyer after years with no movement on his case relating to a slip and fall accident.

Mr. M received text messages from Baker that indicated she would "check [herself] into a mental institution" and she was "ready to kill herself so stop texting me please."

During a visit to Baker's office to talk to her about a $3,000 Seahold loan she had him take out for her services, that client also alleged she was drinking out of a "ridiculously big" wine glass.

Baker had pleaded not guilty to all the allegations but didn't co-operate with the investigation.

At one point Baker claimed to be too ill to attend a hearing, only to pop up on her YouTube channel, Prisca Theologia Tarot, for a live tarot card reading.

Law society spokesperson Amelia White told CBC News the law society will not be doing interviews on the matter but said the organization is going through the Supreme Court of Newfoundland and Labrador for custodianship of Baker's files.

"This is customary where a disbarment is ordered, as the member is 'inactive' as defined by s. 56 of the Act. The application will be heard next week," she wrote. White later clarified her response was based on advice from the society's executive director, Brenda B. Grimes.

Suspended already

Even before being disbarred, Baker's law society membership has been suspended since Oct. 25 because she failed to complete 15 hours of professional development, which is mandatory of all practising members of the law society.

Baker had recently represented Dana Metcalfe, who is facing charges of criminal harassment and causing a disturbance over a "surprise convoy" protest on July 9 outside Premier Andrew Furey's Portugal Cove-St. Philip's home.

In early November Metcalfe was in provincial court — days after Baker had been suspended —  and told a judge she was without a lawyer after being informed that Baker no longer intended to practice law.

Baker has found herself in hot water before.

In 2013, Baker was disciplined for an explosive and profanity-laced tirade against a provincial court clerk that took place in 2011.

In 2014, Baker was caught sharing what was described as a "passionate kiss" with then-client Philip Pynn, just moments before he was arrested in relation to a murder charge. Her apartment had been under Royal Newfoundland Constabulary surveillance on July 11, 2011, two days after Nick Winsor was shot to death on Portugal Cove Road.

Baker was called to the bar in 1998.

2 charged with harassment and causing a disturbance after protest at N.L. premier's home

Dana Metcalfe and Shane Sweeney due back in court to enter plea in November

Two people are facing charges of criminal harassment and causing a disturbance in relation to a "surprise convoy" protest outside the home of Newfoundland and Labrador Premier Andrew Furey this summer.

Dana Metcalfe, 47, of Portugal Cove-St. Philip's, and Shane Sweeney, 34, of Carbonear had their first appearance at provincial court in St. John's on Thursday. The charges were officially filed Wednesday.

Metcalfe and Sweeney are on court conditions to stay away from the premier's home and not have any contact with him and a family member.

They are due back in court on Nov. 2 for election and plea.

St. John's lawyer Averill Baker is listed in court filings as representing Metcalfe. She did not respond to requests for comment Friday.

Newfoundland and Labrador director of public prosecutions Lisa Stead told CBC News that a Crown attorney will be brought in from Nova Scotia to handle the case.

According to Stead, that's being done to avoid allegations of conflict of interest, given that one of the alleged victims is the premier.

When asked about the charges by CBC News, Furey said he would not have any formal comment on anything before the courts.

"I will say this: when people step up to serve, they don't step up to have protests in their home, to have their children frightened, to have their family frightened," the premier said after an unrelated announcement in Labrador City on Friday.

"While I will not comment on any specifics of any legal matter, I will say that I found it — as a father, as a husband, as a homeowner — troubling and concerning. I think regardless of political stripe, the people of the province deserve leaders, deserve representatives, that don't have to put up with that abuse."

The incident outside Furey's home that led to the charges occurred on July 9.

Video posted on Sweeney's Facebook feed shows a line of honking cars and smoke flares as the narrator describes a "surprise convoy" to the premier's residence. Someone off camera appears to be speaking through a megaphone.

The same video is posted on Metcalfe's Facebook and X (previously known as Twitter) accounts.

Metcalfe is a former People's Party of Canada candidate who helped organize Newfoundland participation in the so-called "Freedom Convoy" to Ottawa last year.

She described herself as "East Coast convoy leader" in a "Hug A Trucker" press conference after the invocation of the federal Emergencies Act in February 2022.

Metcalfe was also part of a 2021 protest in St. John's against vaccine mandates.

>>> STATEMENT OF CLAIM
>>>
>>> The Parties
>>>
>>> 1.      HER MAJESTY THE QUEEN (Crown) is Elizabeth II, the Queen of
>>> England, the Protector of the Faith of the Church of England, the
>>> longest reigning monarch of the United Kingdom and one of the
>>> wealthiest persons in the world. Canada pays homage to the Queen
>>> because she remained the Head of State and the Chief Executive Officer
>>> of Canada after the Canada Act 1982 (U.K.) 1982, c. 11 came into force
>>> on April 17, 1982. The standing of the Queen in Canada was explained
>>> within the 2002 Annual Report FORM 18-K filed by Canada with the
>>> United States Securities and Exchange Commission (SEC). It states as
>>> follows:
>>>
>>>     “The executive power of the federal Government is vested in the
>>> Queen, represented by the Governor General, whose powers are exercised
>>> on the advice of the federal Cabinet, which is responsible to the
>>> House of Commons. The legislative branch at the federal level,
>>> Parliament, consists of the Crown, the Senate and the House of
>>> Commons.”
>>>
>>>     “The executive power in each province is vested in the Lieutenant
>>> Governor, appointed by the Governor General on the advice of the
>>> federal Cabinet. The Lieutenant Governor’s powers are exercised on the
>>> advice of the provincial cabinet, which is responsible to the
>>> legislative assembly. Each provincial legislature is composed of a
>>> Lieutenant Governor and a legislative assembly made up of members
>>> elected for a period of five years.”
>>>
>>> 2.      Her Majesty the Queen is the named defendant pursuant to
>>> sections 23(1) and 36 of the Crown Liability and Proceedings Act. Some
>>> of the state actors whose duties and actions are at issue in this
>>> action are the Prime Minister, Premiers, Governor General, Lieutenant
>>> Governors, members of the Canadian Forces (CF), and Royal Canadian
>>> Mounted Police (RCMP), federal and provincial Ministers of Public
>>> Safety, Ministers of Justice, Ministers of Finance, Speakers, Clerks,
>>> Sergeants-at-Arms and any other person acting as Aide-de-Camp
>>> providing security within and around the House of Commons, the
>>> legislative assemblies or acting as security for other federal,
>>> provincial and municipal properties.
>>>
>>> 3.      Her Majesty the Queen’s servants the RCMP whose mandate is to
>>> serve and protect Canadian citizens and assist in the security of
>>> parliamentary properties and the protection of public officials should
>>> not deny a correspondence from a former Deputy Prime Minister who was
>>> appointed to be Canada’s first Minister of Public Safety in order to
>>> oversee the RCMP and their cohorts. The letter that helped to raise
>>> the ire of a fellow Canadian citizen who had never voted in his life
>>> to run for public office four times thus far is quoted as follows:
>>>
>>>  “Mr. David R. Amos
>>>            Jan 3rd, 2004

>>>
>>> 4.      DAVID RAYMOND AMOS (Plaintiff), a Canadian Citizen and the
>>> first Chief of the Amos Clan, was born in Sackville, New Brunswick
>>> (NB) on July 17th, 1952.
>>>
>>> 5.      The Plaintiff claims standing in this action as a citizen
>>> whose human rights and democratic interests are to be protected by due
>>> performance of the obligations of Canada’s public officials who are
>>> either elected or appointed and all servants of the Crown whose
>>> mandate is to secure the public safety, protect public interests and
>>> to uphold and enforce the rule of law. The Crown affirms his right to
>>> seek relief for offences to his rights under section 24(1) of the
>>> Canadian Charter of Rights and Freedoms (Charter). Paragraphs 6 to 13
>>> explain the delay in bringing this action before Federal Court and
>>> paragraphs 25 to 88 explain this matter.
>>>
>>> 6.      The Plaintiff states that pursuant to the democratic rights
>>> found in Section 3 of the Charter he was a candidate in the elections
>>> of the membership of the 38th and 39th Parliaments in the House of
>>> Commons and a candidate in the elections of the memberships of the
>>> legislative assemblies in Nova Scotia (NS) and NB in 2006.
>>>
>>> 7.      The Plaintiff states that if he is successful in finding a
>>> Chartered Accountant to audit his records as per the rules of
>>> Elections Canada, he will attempt to become a candidate in the
>>> election of the membership of the 42nd Parliament.
>>>
>>> 8.      The Plaintiff states that beginning in January of 2002, he
>>> made many members of the RCMP and many members of the corporate media
>>> including employees of a Crown Corporation, the Canadian Broadcasting
>>> Corporation (CBC) well aware of the reason why he planned to return to
>>> Canada and become a candidate in the next federal election. In May of
>>> 2004, all members seated in the 37th Parliament before the writ was
>>> dropped for the election of the 38th Parliament and several members of
>>> the legislative assemblies of NB and Newfoundland and Labrador (NL)
>>> knew the reason is the ongoing rampant public corruption. Evidence of
>>> the Plaintiff’s concerns can be found within his documents that the
>>> Office of the Governor General acknowledged were in its possession ten
>>> years ago before the Speech from the Throne in 2004. The Governor
>>> General’s letter is as follows:
>>>
>>>
>>>  “September 11th, 2004
>>>          Dear Mr. Amos,
>>>
>>>           On behalf of Her Excellency the Right Honourable Adrienne
>>> Clarkson,
>>>           I acknowledge receipt of two sets of documents and CD
>>> regarding corruption,
>>>           one received from you directly, and the other forwarded to
>>> us by the Office of
>>>           the Lieutenant Governor of New Brunswick.
>>>
>>>                       I regret to inform you that the Governor
>>> General cannot intervene in
>>>           matters that are the responsibility of elected officials
>>> and courts of Justice of
>>>           Canada. You already contacted the various provincial
>>> authorities regarding
>>>           your concerns, and these were the appropriate steps to take.
>>>
>>>                                                  Yours sincerely.
>>>                                                              Renee
>>> Blanchet
>>>                                                              Office
>>> of the Secretary
>>>                                                              to the
>>> Governor General”
>>>
>>> 9.      The Plaintiff states that the documents contain proof that the
>>> Crown by way of the RCMP and the Minister of Public Safety/Deputy
>>> Prime Minister knew that he was the whistleblower offering his
>>> assistance to Maher Arar and his lawyers in the USA. The Governor
>>> General acknowledged his concerns about the subject of this complaint
>>> and affirmed that the proper provincial authorities were contacted but
>>> ignored the Plaintiff’s faxes and email to the RCMP and the Solicitor
>>> General in November of 2003 and his tracked US Mail to the Solicitor
>>> General and the Commissioner of the RCMP by way of the Department of
>>> Foreign Affairs and International Trade (DFAIT) in December of 2003
>>> and the response he received from the Minister of Public Safety/Deputy
>>> Prime Minister in early 2004. One document was irrefutable proof that
>>> there was no need whatsoever to create a Commission of Inquiry into
>>> Maher Arar concerns at about the same point in time. That document is
>>> a letter from the US Department of Homeland Security (DHS) Office
>>> Inspector General (OIG complaint no. C04-01448) admitting contact with
>>> his office on November 21, 2003 within days of the Plaintiff talking
>>> to the office of Canada’s Solicitor General while he met with the US
>>> Attorney General and one day after the former Attorney General of New
>>> York (NY) and the former General Counsel of the SEC testified at a
>>> public hearing before the US Senate Banking Committee about
>>> investigations of the mutual fund industry.
>>>
>>> 10.  The Plaintiff states that another document that the Plaintiff
>>> received during the election of the 39th Parliament further supported
>>> the fact he was a whistleblower about financial crimes. In December of
>>> 2006 a member of the RCMP was ethical enough to admit that he
>>> understood the Plaintiff’s concerns and forwarded his response to the
>>> acting Commissioner of the RCMP and others including a NB Cabinet
>>> Minister Michael B. Murphy QC. The Crown is well aware that any member
>>> sitting in the last days of the 37th Parliament through to the end of
>>> the 41st Parliament could have stood in the House of Commons and asked
>>> the Speaker if the Crown was aware of the Plaintiff’s actions. All
>>> parliamentarians should have wondered why his concerns and that of Mr.
>>> Arar’s were not heard by a committee within the House of Commons in
>>> early 2004. Instead, the Crown created an expensive Commission to
>>> delay the Arar matter while he sued the governments of Canada and the
>>> USA and his wife ran in the election of the 38th Parliament. In 2007,
>>> Arar received a $10-million settlement from the Crown and the Prime
>>> Minister gave him an official apology yet the US government has never
>>> admitted fault. A month after the writ was dropped for the election of
>>> the 42nd Parliament and CBC is reporting Syrian concerns constantly,
>>> Mr. Arar’s lawyer announced that the RCMP will attempt to extradite a
>>> Syrian intelligence officer because it had laid a charge in absentia
>>> and a Canada-wide warrant and Interpol notice were issued. The
>>> Plaintiff considers such news to be politicking practiced by the
>>> Minister of Public Safety. He noticed the usually outspoken Mr. Arar
>>> made no comment but his politically active wife had lots to say on
>>> CBC. Meanwhile, the RCMP continues to bar a fellow citizen from
>>> parliamentary properties because he exercised the same democratic
>>> rights after he had offered his support to Arar by way of his American
>>> lawyers. The aforementioned letter about financial crimes was from the
>>> Inspector General for Tax Administration in the US Department of the
>>> Treasury. Mr Arar’s lawyers, the RCMP, the Canadian Revenue Agency and
>>> the US Internal Revenue Service still refuse to even admit TIGTA
>>> complaint no. 071-0512-0055-C exists. However, the Commissioner of
>>> Federal Court, the Queen’s Privy Council Office and other agencies
>>> were made well aware of it before the Speech from the Throne in 2006.
>>>
>>> 11.  The Plaintiff states that from June 24, 2004 until the day he
>>> signed this complaint he has diligently tried to resolve the breach of
>>> his rights under the Charter that are the subject of this complaint
>>> with any public official in Canada whom he believed had the mandate or
>>> the ability to request that the Crown investigate and correct the
>>> malicious actions and inactions of the RCMP, Sergeants-at-Arms and
>>> Aides-de-Camp in all jurisdictions. Until June 16, 2006 the Plaintiff
>>> did not have irrefutable proof to support this complaint. Time did not
>>> permit him to address it immediately in Federal Court in 2006 because
>>> his slate was full. For instance on June 16, 2006 while dealing with
>>> deeply troubling private family matters, he was running against the
>>> Attorney General for his seat in the NS provincial election while
>>> arguing members of the RCMP about strange calls he got from someone in
>>> Ottawa who claimed the Department of Public Safety as her client,
>>> dealing with many liberal party members who were about to witness in
>>> Moncton NB the first debate of all those who wished to become their
>>> new leader, assisting a farmer in his attempt to get some authority to
>>> properly investigate the demise of his cattle and discussing with
>>> members of the Saint John NB City Council the actions of a sergeant in
>>> the Saint John Police Force who was calling friends of the Plaintiff
>>> and claiming that he was drug dealing member of a bike gang that they
>>> should stay away from while he was preparing to intervene in pipeline
>>> matter that was about to heard by the National Energy Board in Saint
>>> John .
>>>
>>> 12.  The Plaintiff states that in April of 2007 he wrote a complaint
>>> about this matter and returned to the Capital District of NB in order
>>> to file it and argue the Crown before the Federal Court if it did not
>>> wish to settle. A clerk of this court informed him that his complaint
>>> was not composed correctly, so he began to rewrite this complaint.
>>> However, as soon as it was known what the Plaintiff was about to file
>>> he was subject to further police harassment and his family began to
>>> suffer from constant slander, sexual harassment and death threats on
>>> the Internet and on the telephone that continues to this very day
>>> while the RCMP, the FBI and many other law enforcement authorities
>>> continue to ignored the obvious evidence of cybercrime practiced
>>> against many people including his minor children.
>>>
>>> 13.  The Plaintiff states that the Crown’s only response has been
>>> further harassment by the RCMP including false arrest and imprisonment
>>> and theft of his property by the Fredericton Police Force supported by
>>> other law enforcement authorities in Canada and the USA. The Governor
>>> General has had the Plaintiff’s documents for over ten years to study.
>>> The Crown now has one of the complaints that the RCMP has been
>>> delaying since 2003. It is as follows:
>>>
>>> The Complaint
>>>
>>> 14.  The Plaintiff states that on June 24, 2004 during the election of
>>> the membership of the 38th Parliament the Crown breached his right to
>>> peaceful assembly and association under Section 2(c) and (d) of the
>>> Charter. The Sergeant-at-Arms of the Legislative Assembly of NB (a
>>> former member of the RCMP) supported by the Fredericton Police Force
>>> (FPF), the Corps of Commissionaires (COC) and at least one RCMP
>>> officer acting as Aide-de-Camp to the NB Lieutenant Governor barred
>>> the Plaintiff under threat of arrest from the legislative properties
>>> in NB.
>>>
>>> 15.  The Plaintiff states that whereas the Crown refused to put
>>> anything in writing to either confirm or deny that he was in fact
>>> barred from the legislative properties in NB, he returned to the
>>> public property whenever he deemed it necessary to do so as he ran for
>>> public office three more times. For example, when the Plaintiff was a
>>> candidate in the election of the 39th Parliament for the riding of
>>> Fredericton, he was asked to come into the legislative building of NB
>>> to record a live interview for an Atlantic Television (ATV) news cast
>>> shortly before polling day. On that occasion, the Sergeant-at-Arms and
>>> his Aides-de-Camp did not attempt to bar the Plaintiff from access to
>>> legislative property quite possibly because they did not wish their
>>> actions to be recorded by ATV. However, the Crown made matters worse
>>> in short order. CBC barred the Plaintiff from an all-candidates’
>>> debate on the University of New Brunswick (UNB) campus and on polling
>>> day two District Returning Officers on the UNB campus after viewing
>>> identification threatened to have the Plaintiff arrested stating that
>>> they did not believe he was on the ballot.
>>>
>>> 16.  The Plaintiff states that the NB Sergeant-at-Arms continued with
>>> his threat of arrest after the election 39th Parliament. In response,
>>> the Plaintiff challenged the Sergeant-at-Arms to either put his threat
>>> in writing or arrest him so he could at least argue the Crown about
>>> the offences against his rights under the Charter.

>>> An international expert on democracy has flown all the way from Egypt
>>> to help NDP candidate John Carty campaign in Fredericton.
>>>
>>> Dominic Cardy is with a group called The National Democratic
>>> Institute. Its members include such people as former U.S. President
>>> Jimmy Carter. The group's mission is to teach democratic values and
>>> spread democracy around the world.
>>>
>>> Cardy has taught about democracy in Algeria, Bangladesh, and Cambodia
>>> during the past few years. When he heard his friend John Carty was
>>> running for office back in his home town of Fredericton, he hopped on
>>> a plane.
>>>
>>> "It was a strange experience," Cardy said. "One evening I was watching
>>> the sun go down over the pyramids, and the next evening watched it go
>>> down over Fredericton airport as I came into land."
>>>
>>> Cardy is no relation to the NDP candidate. But he loves elections and
>>> loves getting people pumped up about democracy.
>>>
>>> Carty the candidate is running against federal Indian Affairs Minister
>>> Andy Scott, Conservative Pat Lynch, Green candidate Philip Duchastel
>>> and independent David Amos. The riding has sent Scott to Ottawa for
>>> the last four elections, despite the best efforts of the other
>>> parties.
>>>
>>> Cardy says he doesn't care how tough the race his – he just wants
>>> people to participate in the process. "People have forgotten how
>>> incredibly precious these gifts that our ancestors fought for are and
>>> were just giving them away. It makes me furious when I talk to people
>>> and people just say 'ah there's no point in voting.'"
>>>
>>> After election day, Dominic Cardy is flying back home to his wife in

Lawyer faces 2 criminal charges after having Manitoba judge followed
during churches' COVID-19 court challenge

A 'prime example of professional misconduct,' human rights lawyer says
after police charge John Carpay
Caitlyn Gowriluk · CBC News · Posted: Jan 02, 2023 3:05 PM CT

The Alberta-based Justice Centre for Constitutional Freedoms says its
president, John Carpay, turned himself in to Calgary police after
learning police in Winnipeg had issued a warrant for his arrest.

A lawyer who represented a number of churches across Canada fighting
COVID-19 restrictions in court has been charged by police in Winnipeg
after admitting in 2021 he hired a private investigator to follow
senior government officials and the Manitoba judge who presided over
one of the organization's cases.

The Winnipeg Police Service said it has charged John Carpay, 55, with
intimidation of a justice system participant and the attempt to
obstruct justice.

The Justice Centre for Constitutional Freedoms, which employed Carpay,
said it learned on Friday of the warrant issued by Winnipeg police for
Carpay's arrest.

"This warrant was apparently issued in connection with the events that
took place in 2021 and alleges obstruction of justice," the
Alberta-based organization said in a statement posted on its website
on Sunday.

Carpay immediately turned himself in to the Calgary Police Service
after learning of the warrant, the statement said.

It also indicated Carpay has been released on bail, with the sole
condition that he not contact Glenn Joyal, chief justice of what is
now Manitoba's Court of King's Bench. It said the Calgary-based lawyer
has not had any communication with the judge since an apology he made
for having Joyal followed in 2021.

leave after having Manitoba judge followed

A Calgary Police Service spokesperson said it assisted in Carpay's
arrest but deferred other questions to Winnipeg police.

Carpay's decision to hire a private investigator to follow Glenn
Joyal, chief justice of what was then Manitoba's Court of Queen's
Bench, came to light in July 2021 during a hearing for a case against
pandemic rules brought forward by seven rural Manitoba churches who
were represented by Carpay's organization.

Glenn Joyal, chief justice of what is now Manitoba's Court of King's
Bench, pictured here. (Gary Solilak/CBC)

Joyal told the hearing he had been tailed by a private investigator in
an attempt to catch him breaking COVID-19 rules in order to embarrass
him while he presided over the court challenge.

At the time, Carpay's organization also apologized to Joyal and said
it condemned the lawyer's actions.

Joyal said the surveillance would not influence his decision in the
case — in which he later ruled Manitoba's pandemic restrictions were
not a violation of charter rights — but noted the intrusion of privacy
raised serious concerns about the safety of judges generally.

Joyal also said that this type of activity could be seen as
obstruction of justice and that Winnipeg police were investigating.

In its statement on Sunday, the Justice Centre for Constitutional
Freedoms called the charge against the lawyer "unexpected and without
explanation."

7 Manitoba churches appeal court ruling on COVID-19 religious
service restrictions

It also said it was "deeply disappointed" in the decision to charge
Carpay over a year after the events in question, which the
organization said "are already being dealt with appropriately."

After Carpay apologized for hiring the private investigators — which
he said was to hold government officials accountable, not to influence
the decision in the Manitoba case — the board of his organization said
he would take an indefinite leave as its president.

The organization said on Sunday that leave of absence lasted seven
weeks, during which time its board "took appropriate steps to
strengthen governance and oversight."

It also said Carpay co-operated with an investigation conducted by the
Law Society of Manitoba, which is separate from the police matter.
Professional misconduct charges

A spokesperson for the Law Society of Manitoba said its investigation
is complete and charges of professional misconduct have been
authorized against Carpay.

The Law Society of Manitoba's website says the three-day hearing for
Carpay's case is scheduled to begin Feb. 8. Carpay is accused of
breach of integrity, undermining public respect for the administration
of justice and failing to treat court with candour, fairness, courtesy
and respect, the website says.

A lawyer found guilty of professional misconduct can face consequences
including being fined, suspended or disbarred, Manitoba's Legal
Profession Act says.

Lawyer files misconduct complaint after private investigator hired
to follow Manitoba chief justice

Ottawa human rights lawyer Richard Warman, who filed complaints with
the law societies of Manitoba and Alberta, said he thinks the case is
unprecedented in terms of professional misconduct by a lawyer.

"I'm unable to remember any lawyer going so far off the rails as to
hire a private investigator to stalk the chief justice who's presiding
over a case that they're appearing in," he said on Monday.

"I have no doubt that it will be studied for years to come as a prime
example of professional misconduct. And when you have extreme conduct,
it calls for extreme sanction."

Warman said he's relieved to hear Carpay would also be charged
criminally, but wondered by it took so long — especially since the
case involved an admission of guilt in open court.

Given that factor, he said it comes off as "naive in the extreme" that
Carpay's organization says the charge against the lawyer was
unexpected.

'Freedom Convoy 2.0' in jeopardy as top organizer announces cancellation

Confusion and contradiction among supporters following press release

Jan. 31, 2022. Several key figures in the self-styled Freedom Convoy
movement have said they will attend a revival protest in Winnipeg,
even though an organizer announced Tuesday that it's cancelled.

Organizers and supporters of the "Freedom Convoy 2.0" are divided over
whether another event inspired by last year's disruptive protest in
the capital will take place in Ottawa and Winnipeg next month.

Several key figures from last February's protest, which occupied the
capital's downtown streets for nearly a month, insist people will
gather in Manitoba in mid-February despite a press release from a main
organizer claiming otherwise.

James Bauder, co-founder of the anti-government group Canada Unity and
a co-organizer of last February's protest in Ottawa, said in a
Facebook post on Monday he was cancelling "Freedom Convoy 2.0" for
unspecified security reasons.

"I have had several security breaches, and personal character attacks
made against me and others on Team Canada Unity," Bauder said in the
post.

Federal government already preparing for what organizers call
'Freedom Convoy 2.0'

Convoy organizers set sights for Winnipeg

"As a result of these security breaches that are beyond our control, I
cannot in good conscience guarantee public safety as I promised."

In a text to CBC, Bauder wrote: "There will be no convoy anywhere in
Canada be it Ottawa or Winnipeg with my name, with the Canada Unity
Freedom Convoy brand."

Bauder had originally called for protests to return to Ottawa for a
three-day demonstration starting Feb. 17. He later said that Ottawa
would be a stop on the way to a protest in Winnipeg.

James Bauder appears as a witness at the Public Order Emergency
Commission in Ottawa, on Nov. 3, 2022. Bauder, co-founder of
anti-government group Canada Unity, said in a Facebook post Monday
that a revival of the self-styled Freedom Convoy set for February 2023
is cancelled. (Sean Kilpatrick/The Canadian Press)

Other supporters, meanwhile, contradicted Bauder's assertions. Another
organizer who announced the convoy 2.0 plan for Winnipeg alongside
Bauder claimed the event will move ahead.

"Multiple people and groups are involved. The world unity convoy 2023
is not cancelled," Ron Clark wrote in an email to CBC.

Likewise, Tyson Billings — also known as "Freedom George" — said he
still plans to attend a convoy gathering in Winnipeg next month.

"I don't know if there's something still going to Ottawa or not," he
said. "But the main convoy — the World Unity Convoy — is about unity
and it's about bringing the people together."

Fractures emerge in movement

The mixed messaging comes as the Freedom Convoy movement, which began
as protests against COVID-19 vaccination passports, masks and other
health mandates, appears to be losing steam.

Infighting between members has led to a fracturing of the movement,
resulting in disagreements over details ranging from the name of the
event to its main goals.

Bauder is among the dozens of protesters and supporters facing charges
for their involvement in the original convoy protest.

Bail conditions prevent him and many other familiar names from
returning to Ottawa.

Lawyer faces 2 criminal charges after having Manitoba judge
followed during churches' COVID-19 court challenge

    Analysis
9 months later, convoy organizers express little sympathy for
downtown dwellers

Thousands of people in trucks and cars occupied the capital in early
2022 to protest health mandates and other government policies. It came
to an end after the Trudeau government invoked the Emergencies Act.

The federal government suspended mandatory vaccination for federal
employees, domestic travellers and transportation workers in June
2022.

In a statement to CBC News, the Winnipeg Police Service said it's
"aware of online dialogue from a group regarding an event in February
in Winnipeg."

"We are assessing information but do not have any further comment to
make at this time," a Winnipeg police spokesperson said in an email.

Subject: Automatic reply: Hey Higgy Methinks Mr Jones knows why CBC
did an early shut down of the comment section about my neighbours and
their support of the truckers Nesy Pas?
To: David Amos <david.raymond.amos333@gmail.com>

On behalf of the Honourable Michelle Rempel Garner, P.C., M.P. thank
you for your email. Our office appreciates the time you took to get in
touch with the MP. Due to the high volume of email correspondence our
office receives, below is a guide on how your email will be responded
to:

If you are a constituent of Calgary Nose Hill:

Queries regarding government programs, policies and operations take
time to research, contact appropriate departments and collate
information for dissemination to you. If you have provided your full
contact details on your query, your email will be responded to as
necessary.

If your query is case related (i.e. immigration, CPP, EI, tax issues,
etc.), consent forms will need to be filled out before your file can
be activated. If you have not yet filled out our office’s consent
form, a staff member will be in contact with you.

If you are not a constituent of Calgary Nose Hill:

If you are not a Calgary Nose Hill resident, given the high volume of
emails we receive, your email will be reviewed and filed as
INFORMATION. If the email is Critic portfolio in nature, it will be
responded to as necessary.
If you are contacting MP Rempel Garner to review your case work,
please first contact your local MP for assistance.
If your email is a form letter:

Thank you for submitting this form letter. Due to the high volume of
emails M.P. Rempel Garner’s office receives, we are unable to
individually reply to form letters, particularly from non
constituents. Form letters are template letters generated by
organizations, webforms and other sources on a given issue. However,
M.P. Rempel Garner does review and consider information received from
all form letters.

If you are a constituent and would like a response regarding the
specific issue raised in your form letter, please email M.P. Rempel
Garner’s office individually at this email address with “Constituent -
(Insert subject)” in the subject of your email. This helps us to
identify constituents who wish to receive a response among the
hundreds of form letter responses our office receives on any given
day.

Again, thank you for reaching out to our office.

Invites:
If you have invited MP Rempel Garner to your event, please note that
decisions on what events to attend are completed on a bi-monthly
basis. As our office receives hundreds of invitations each week, our
office will only contact you if MP Rempel Garner will be attending.
Updates on MP Rempel Garner’s Work:
If you wish to know what is happening in Calgary Nose Hill and the job
MP Rempel Garner is doing for you in Ottawa, please sign up for her
e-newsletter on her website: https://mprempel.ca/

*M.P. Rempel Garner's office has a zero tolerance policy for
threatening, abusive, or aggressive language or behaviour towards the
Member and their staff. Phone calls, voicemails and emails containing
threatening or abusive language will result in the termination of
communications.

Thank you again.

Sincerely,
Office of The Honourable Michelle Rempel Garner, P.C., M.P.

N.B. business owner says he donated $75,000 to Freedom Convoy
A database released publicly lists Brad Howland's donation as the
second-highest amount

A business owner from the southern New Brunswick village of Sussex
Corner has confirmed he made what appears to be one of the largest
donations to the Freedom Convoy that has gridlocked the streets of
Ottawa around Parliament Hill.

In a written statement Monday afternoon, Brad Howland called the
protest "a beautiful, legal, peaceful protest" that he visited on the
weekend.

"To see the love, peace, and unity that many of us have longed for,
for a long time — It was an experience of a lifetime," he wrote.

"This will go down in the history books of our nation."

In fact, the protest has forced many downtown businesses to close and
violates several laws.

What injunction? Questions arise around disregard for court order

It's now the subject of the federal Emergencies Act, which Prime
Minister Justin Trudeau invoked on Monday.

CBC News has reviewed information that appears to identify tens of
thousands of Freedom Convoy donors to the website GiveSendGo.

The data, hacked and released briefly on its front page, includes
names, locations, dollar amounts, personal email addresses, even the
credit card companies used for each transaction.

CBC has not been able to independently confirm if the people on the
list did in fact donate to the Freedom Convoy.

CBC INVESTIGATES: Hacked convoy data shows more than half of
donations came from U.S.

Howland confirmed to CBC News that his donation was $75,000.

A database from GiveSendGo released publicly lists that as the
second-highest amount of all donations.

A sign supporting truckers was visible at Easy Kleen's property near a
Highway 1 off-ramp earlier this month.

Howland said in his statement that Easy Kleen has been in business for
more than 40 years and has relied on truckers for deliveries to and
from the factory.

He called truckers "salt of the earth people with the biggest hearts"
and said the convoy is a rare opportunity to thank them.

"We are thankful to be blessed enough to support their efforts to do
what they have to do in a peaceful way until the government removes
the mandates to restore all our freedom as pre-COVID," he said.

Records from the federal government show that Easy Kleen has received
funding from the Canada Emergency Wage Subsidy program, set up to help
employers who have "seen a drop in revenue during the COVID-19
pandemic."

It's not clear how much the company received, but when asked about the
subsidy, Howland said it was spent on wages at the beginning of the
pandemic in 2020.

Howland has also donated thousands of dollars to the provincial
Progressive Conservatives and the federal Conservative Party since
2018, according to public records.
Distrust of vaccines

On Facebook, Howland has posted support for former U.S. president
Donald Trump and about his distrust of vaccines.

"They say the Democrats are worried about outside interference in USA
elections," he wrote in August 2020, in a post that was no longer
public as of Monday afternoon. "They should be, from the country of
Lowest of Kars we are doing just that."

On Feb. 11, Howland posted that "a truck load of us" from Kars, a
community about 50 kilometres from Sussex, would be heading to Ottawa.

"It is about time we act like we own it and show them who calls the
shoots [sic] and determines mandates," Howland wrote on Jan. 25, in a
post that is also no longer public. "That is the people. Governments
got people in fear."

In 2009, Howland received a conditional discharge after he threatened
the principal of a New Brunswick elementary school when they stopped
daily singing of O Canada.

CBC reported at the time that Howland threatened to beat the principal
senseless, but Howland said he meant it as a figure of speech rather
than a threat.

"Other provinces adopted playing the anthem because of this situation
in my life arose, which worked out very well in the end for thousands
for children playing the anthem in their schools," Howland wrote to
CBC when asked about the court case this week.

In total, the database shows donations from more than 500 people who
used New Brunswick postal codes, but CBC cannot verify whether those
individuals actually live in the province.

O Canada threat case results in discharge

CBC News · Posted: Aug 28, 2009 11:07 AM AT

A New Brunswick man has received a conditional discharge for
threatening a school principal who scaled back the daily singing of O
Canada at his daughter's school.

Bradley Howland, 43, of Hatfield Point was also ordered Friday to stay
away from Erik Millett and Millett's partner, and not to go near the
school for eight months unless accompanied by his wife.

"Educators have a tough enough job without being subjected to this
type of harangue," provincial court Judge Henrik Tonning said during
sentencing in Sussex.

Howland, who had about a dozen supporters with him in the courtroom,
showed little reaction to the sentence. But he did apologize to
Millett and asked for his forgiveness.

Millett told reporters outside the courthouse that he was satisfied
with the sentence.

He also announced plans to file a lawsuit against two people for
public comments they made about him during the storm of controversy.
One of them is Minister of Veterans Affairs Greg Thompson, who is also
MP for New Brunswick Southwest.

"If he fails to hold a press conference and apologize for his
statements, which were defamatory towards me, if he fails to do that,
I call upon the Prime Minister to fire him from cabinet," said
Millett.

He also wants a letter of apology from Susan Boyd, the Belleisle
parent who initially raised concerns about the anthem, he said.

Neither Thompson nor Boyd were available for comment Friday.
Guilty of uttering threats

Howland was found guilty last month of uttering threats to cause
serious bodily harm to Millet, who was at the time the principal of
Belleisle Elementary School, and causing Millett to fear personal
injury.

Millett, who has since left his post, told the court Howland
threatened to "beat [him] senseless."

Millett stepped down as principal after a countrywide controversy
erupted in January over his decision to reserve the singing of the
national anthem for monthly assemblies. Two families had complained
for religious reasons about O Canada being sung daily over the
school's PA system.

Tonning said it was "regrettable" the case had to come this far. The
judge described the case as "serious," but said he didn't think
Howland’s comments were "malicious." The judge noted that Howland’s
friends, in letters of support to the court, said he "often becomes
disengaged with his mouth" and that his passion for this issue
"misguided his words."

Tonning said he believes Howland, who owns several businesses, is an
upstanding citizen who "now understands the principle of keeping one's
mouth shut."

But he had to consider the principle of deterrence in sentencing, he
said. People need to know it’s not acceptable to threaten educators.
Howland was also ordered to pay Millett $500 toward the cost of
counselling that he and his partner have received since the threat.

NBer who gave $75K to 'freedom convoy' speaks out

EXCLUSIVE: NBer who gave $75K to 'freedom convoy' speaks out | TJ.news
The New Brunswick businessman who donated $75,000 to the "freedom
convoy" in Ottawa says he doesn't think there will be ramifications
from what he did, and that business has never been better.

On Thursday, Brad Howland, president of Sussex Corner-based Easy-Kleen
Pressure Systems Ltd., told Brunswick News that his bank accounts were
never frozen by the federal government, and that he
doesn't expect to be among the people left with a permanent "mark" on
their bank accounts for donating to the convoy.

He says that's because he donated before the feds invoked the
Emergencies Act, which gave Ottawa sweeping powers to end the convoy.

Howland said as far as he knows, the money he donated is still in the
GiveSendGo account frozen by the federal government.
Earlier this week, according to Blacklock's Reporter, the Canadian
Bankers Association said that convoy supporters who had their accounts
frozen will permanently have their files marked. “We primarily relied
upon the names provided by the RCMP, but there were obligations under
the order separate that required banks to make their own
determinations. We did not rely on external information,” Angelina
Mason, general counsel for the Bankers Association, said at the
Commons finance committee, according to Blacklock's.

Mason also confirmed that the names of frozen accounts were given by
the banks to the RCMP.

Asked whether he's worried, Howland shrugged it off, accusing the
ruling federal Liberals of being "small" people "casting big shadows."
"I'm quite shocked, as a Canadian citizen, that they would talk like
this, or even consider it," he said. "You hear the words 'cancel
culture,' or 'disinformation,' or 'misinformation' ... [the threat of
permanent marks on bank accounts] is according to who?

"It's a serious thing that these fellas are infringing upon."

According to the federal online registry, Easy-Kleen received pandemic
relief funds through Ottawa’s Canada Emergency Wage Subsidy.

Howland, a self-professed champion of "freedom" and a fan of former
U.S. president Donald Trump, then compared the idea of permanent marks
being put on convoy supporters' bank accounts to policies used by the
Chinese government.

He added that he's been tracking what "the government" has said during
the pandemic, and believes the promises that were made to
Canadians if they followed the rules were never fulfilled. "Not much
of [what was said] was true ... the government is not always right,"
Howland said. "Just because the government says something doesn't mean
it's true, or correct."

Howland said since he made the donation and visited the convoy – which
he said was misrepresented after "one person" carried a flag with a
swastika, and a few flew confederate flags – he's received calls and
letters of support from across Canada and the U.S. – and donations.
And some companies want to do business with Easy-Kleen because of his
participation in the convoy, Howland added.

"Our business has never been better," he said.

"People that buy our kind of equipment, they're all industry people
and we're [all] of like minds.

"Some people said, 'Oh my goodness, Easy-Kleen is gonna go down the
tubes because of this,' but listen, we're on the right side. When
you're for freedom, you're on the right side of it. And if you're on
the right side, it's gonna come around to you."
Howland said Easy-Kleen's business is "way up."

"We have people buying machines just to buy machines. We have oil
companies out West calling us and saying, 'We're buying from you guys,
because you guys are supporting freedom.'"

He also said he's received what he jokingly calls "love mail":
donations, and gift cards.

So no worries about what he did?

"I'll never regret it," Howland said.
