Ottawa's chief medical officer to quit

The doctor in charge of public health in the city of Ottawa is resigning. Medical officer of health Dr. David Salisbury will leave his current job on May 5, the city announced Wednesday in a news release.

Salisbury has accepted a job with Transport Canada, where he will be director of civil aviation medicine, returning to an area of medicine "that has long been a professional passion," Salisbury said in the release.

During the past year, Salisbury clashed with city council over programs intended to curb the spread of HIV and hepatitis among drug users.

Last week, he was asked by councillors to review the city's needle-exchange policy and look into the possibility of requiring drug users to turn in a dirty needle in order to get a clean one. Right now, most of the city's needle exchanges collect and distribute needles separately.

Salisbury said he would conduct the review, even though he believed switching to a one-on-one exchange would boost HIV rates.

Last July, city council cancelled its funding for a program that provided free, clean crack pipes to drug addicts even though Salisbury said the program was reducing the spread of disease.

The public aspect of his job, including dealing with the media, hasn't always been easy, he said.

"Living in a bubble or in a glass house all the time is very difficult when you have some extremely difficult and often controversial decisions to make," he said. "Someone has to do it and I'm glad that I had the opportunity to do it and I think I did a tolerably good job at that over the last four years."

But he added that he is ready to move on to other challenges.

Salisbury said he doesn't blame councillors for the conflicts that arose over city health policies.

"They are asked to be too many things to too many people," he said. "A board of health has particular responsibilities that need to be exercised and they often conflict with the political reality that exists in this city."

Salisbury was appointed the city's medical officer of health in 2005.

Before joining Ottawa Public Health in June 2004 as the associate medical officer of health and manager of the infectious disease control division, Salisbury was the deputy chief of staff for Force health protection with the Canadian Forces medical group at National Defence headquarters.

Salisbury is past president of the Canadian Aerospace Medicine and Aeromedical Transport Association and the International Association of Military Flight Surgeon Pilots.

Study reveals Monsanto manipulated glyphosate approval process

A new study details how Monsanto, a company that manufactures
glyphosate-based products, used deceit and manipulation to have the
chemical herbicide declared safe.

The scientific article, published in the August 2018 edition of the
Journal of Public Health Policy, documents how Monsanto attempted to
manipulate scientific evidence for its own business interests.

The study, by Dr. Sheldon Krimsky and Carey Gilliam, uses documents
from 3,500 lawsuits against Monsanto and information obtained through
the American Freedom of Information Act. Krimsky and Gilliam show that
Monsanto engaged in the “ghost writing” of scientific articles,
interfered in the reporting of test data by a scientific journal,
prepared presentations for supposedly “independent” scientists, and
exercised “undue influence on [the American] regulatory agency” that
approved the use of glyphosate.

New Brunswick government and forest industry spokespersons, despite
compelling evidence to the contrary, continue to say that glyphosate
is no threat to public health.

The best-known glyphosate product is the herbicide, Roundup, which is
used in agriculture. VisionMax, Forza and Weedmaster are
glyphosate-based products used in forestry.

Roundup is also the central issue in the 3,500 lawsuits against
Monsanto. Krimsky and Gilliam note that, in every case, the
individuals suing Monsanto say that “she or he, or their loved ones,
developed non-Hodgkin lymphoma due to Roundup exposure. Moreover, the
plaintiffs allege that Monsanto had long covered up the risks of the
glyphosate-based herbicide.”

The glyphosate scandal erupted in March 2015 when the World Health
Organization’s International Agency for Research on Cancer (IARC)
determined that glyphosate was a probable cause of cancer and reported
“strong” evidence that glyphosate caused DNA and chromosomal damage in
human cells.

The glyphosate-cancer link was brought to the attention of the New
Brunswick Legislative Assembly by Green Party leader David Coon.
Coon’s opposition to dangerous herbicides and defoliants dates back to
the mid-1980s when he was opposing the provincial government’s use of
the cancer-causing Agent Orange.

Monsanto feared the IARC would link glyphosate to cancer, even before
the IARC report was published. Krimsky and Gilliam note a February
2015 internal email by Monsanto scientist William Heydens that
“discussed with colleagues various papers the company wanted to see
published to counter what the company expected the IARC to find.”

The fact that Monsanto was clearly convinced well ahead of time that
the IARC would find glyphosate to be a cause of cancer raises
questions about what internal data Monsanto had, and whether it knew
that the chemical caused cancer.

In his e-mail, Monsanto’s Heydens suggests that they “ghostwrite”
sections of a scientific paper that was being prepared by other
researchers, and adds, “we would be keeping the cost down by us doing
the writing and they would just edit and sign their names.” That
deception worked, and Krimsky and Gilliam note that this
Monsanto-ghostwritten paper “has been cited hundreds of times” and was
“referenced by the [American] Environmental Protection Agency (EPA) in
its finding… that glyphosate was ‘not likely’ carcinogenic.”

As well, in an internal memo by Monsanto scientist David Saltmiras, he
admits that he “ghost wrote cancer review paper Greim et al. (2015),”
a document also cited by the EPA in its 2016 decision that glyphosate
was safe for human use.

In 2016, Monsanto hired the firm Intertek Scientific & Regulatory
Consultancy to write articles discrediting the World Health
Organization’s research linking glyphosate to cancer. Intertek
initially denied contact by Monsanto, but court documents cited by
Krimsky and Gilliam show those denials were lies. In fact, as Krimsky
and Gilliam note, “the documents demonstrate Monsanto was engaged in
organizing, reviewing, and editing the drafts, even arguing with one
of the authors and overruling him about language in the manuscript.”

The Krimsky-Gilliam article cites “internal Monsanto documents [that]
show that Monsanto officials directed and organized a campaign to
pressure” another journal into withdrawing a peer-reviewed paper
showing harmful effects to animals exposed to Roundup.

Monsanto also gave Wallace Hayes, the editor-in-chief 0f scientific
journal Food and Chemical Toxicology, a secret $400 an hour consulting
contract. Hayes never declared the conflict of interest.

The Krimsky-Gilliam article details how “Monsanto officials developed
presentations for academic scientists to deliver at seminars and other
public forums,” despite the fact that “scientists who present their
findings at scientific meetings are generally expected to disclose any
conflicts of interest, as well as any collaborators.” Monsanto did
this “in multiple instances involving multiple professors.”

Not content with using tame scientists, Monsanto also worked closely
with at least three EPA officials in the United States “to derail a
review of glyphosate by the Agency for Toxic Substances and Disease
Registry (ATSDR) that was underway in 2015.” Monsanto’s fear was that
ATSDR review “would find carcinogenecity concerns with glyphosate just
as IARC had.”

“Coon has been fighting glyphosate spraying for many years”: Glyphosate opponent

Cocagne resident and long-time anti-glyphosate activist Serge
Robichaud, said Coon “was the only party leader seriously opposed to
it during the last provincial election in 2014, and he has shown his
commitment to banning glyphosate during his time in office.”

In December 2016, Coon proposed legislation to amend the Crown Lands
and Forests Act. Coon proposed to replace clear-cutting and glyphosate
spraying with ecological sustainability, fairness for private woodlot
owners and independent sawmill operators, and acknowledgment of
Aboriginal rights. The Liberals and Conservatives did not support the
bill.

Robichaud notes that “Coon has been fighting glyphosate spraying for
many years,” and adds he doesn’t trust the other parties to support a
glyphosate ban. He said, “What is needed now to stop the use of
glyphosate is a class action lawsuit against the federal government
based on the very flawed Canadian approval process.”

Rod Cumberland is a wildlife biologist concerned about the presence of
glyphosate in food. He is not satisfied with the provincial
government’s approach to the potential dangers of a chemical the World
Health Organization says probably causes cancer.

“The people of New Brunswick … should care enough about their health
and welfare that they demand the New Brunswick government–specifically
the Office of Chief Medical Officer of Health–begin to test for
glyphosate residues in our foods, as well as test for its presence in
the wildlife we consume and the farm products and meats sold to [New
Brunswickers] as healthy products, rather than” allowing them “to take
a ‘wait and see’ approach,” Cumberland said.

“The health and safety of New Brunswick residents should be important
enough that we are offered a proactive, rather than a reactive,
approach by our elected officials,” Cumberland added.

A former Gagetown soldier who's seeking an independent public inquiry into the use of Agent Orange at the New Brunswick military base decades ago has renewed hope, thanks to meetings being held by the Commons committee on national defence.

The committee has undertaken a study into "current and legacy contamination sites" and will hear from government officials, occupational health experts, academics and researchers.

It's also hearing from people affected by Agent Orange in New Brunswick, trichloroethylene, or TCE, a cancer-causing industrial degreasing agent and other contaminants in Valcartier, Que., burn pits in Iraq and Afghanistan, the Veterans With Cancer group, and others "impacted by contaminated DND sites."

"Our hopes are high," said Gary Goode, 75, who was an infantry soldier at Base Gagetown from 1967 to 1971, and is chair of Brats In the Battlefield, a Canadian Gagetown veterans advocacy group. He was among those invited to speak recently to the committee about Agent Orange.

Goode says with all of the political parties represented, he has hope there will be changes as a result of the committee's work.

"It has to be more than just a smoke and mirrors show to, you know, appease. I believe that they're serious about this," Goode said of the committee during an interview from his home in Fernie, B.C.

The meetings, which began in November and are scheduled to continue into the new year, come after a Maine commission called in March for a new probe of the historical use of Agent Orange and other herbicides at 5th Canadian Division Support Base Gagetown in Oromocto, where Maine National Guard members train.

Former Gagetown soldier has renewed hope for an independent public inquiry into use of Agent Orange

Gary Goode, who served at Base Gagetown from 1967 to 1971, spoke to the Commons committee on national defence.

The Gagetown Harmful Chemical Study Commission determined the data and analysis used in a Canadian report that found most people at or near the base were not at risk for long-term health effects was "incorrect" and "biased."

That Canadian fact-finding report, released more than 15 years ago, concluded only specific populations, including those directly involved with herbicide applications and brush clearings soon after application, were at a greater risk for developing adverse health outcomes.

Compensation payments in Canada were limited to $20,000 for veterans and civilians who worked on or lived within five kilometres of the base between 1966 and 1967, and only those with illnesses associated with Agent Orange exposure. exposure, including Hodgkin's disease, lymphoma, respiratory cancers, prostate cancer and type 2 diabetes.

Goode believes the Maine commission played a "huge role" in the national defence standing committee's decision to study the issue and file a report with recommendations to the House of Commons.

He has been lobbying for an inquiry for nearly 20 years, since he lost his right lung to cancer, and received the one-time ex gratia payment of $20,000 from Ottawa.

"We dug and lived in trenches, sometimes for days" at Gagetown, inhaling dust, Goode told the committee in Ottawa last week via video conference. "And we crawled on our bellies through the chemically saturated training area."

The training area and ranges were "repeatedly sprayed" with chemical mixtures commonly known as Agent Orange, Agent Purple and Agent White, according to Goode.

The Canadian government allowed the U.S. military to test herbicides, including Agent Orange and Agent Purple, at Base Gagetown in 1966 and 1967. The U.S. sprayed Agent Orange during the Vietnam War to remove trees and dense tropical foliage that provided enemy cover.

The International Agency for Research on Cancer, which is part of the World Health Organization, has since classified one of the chemicals in Agent Orange, sometimes referred to as dioxin, as "known to be carcinogenic to humans."

The Department of National Defence maintains only two barrels of Agent Orange and Agent Purple were tested over seven days in 1966-67 and that spraying was limited to a remote 56-hectare area, under strictly controlled conditions, with little to no wind.

Seeking full compensation

But Goode contends more than 6,500 barrels were "vastly distributed" over 73,000 hectares between 1956 and 1984, based on military documents obtained through access to information.

"The truth is successive federal governments and DND sprayed more of these highly toxic chemicals per acre at CFB Gagetown than the U.S. military sprayed per acre in Vietnam during that entire war," he told the committee.

Goode wants to see full compensation for those harmed by the use of these chemicals at Gagetown. It's about "truth, honesty, accountability and justice," he said.

Woman says family got sick living at base

Eileen Beauchamp of Ottawa agrees. Her late father served in the Canadian Armed Forces from 1951 to 1975, including seven years at Gagetown in the 1960s, when she was a young girl.

Beauchamp told the committee her family regularly had picnics on the base, picked blueberries, fished and drank spring water.

Over the years, she and several family members have been diagnosed with cancers, respiratory diseases and other serious health issues with no familial history, leading them to believe Agent Orange and other chemicals that were sprayed are to blame.

"This experience is not unique. Countless other military personnel, veterans, families and civilians with ties to CFB Gagetown have faced similar struggles and illnesses," she said.

Although the 2007 ex-gratia payment program included family members and civilians, it had a sunset clause that ended claims in December 2011, which precludes compensation for people like her, who developed illnesses later on.

"Currently, there's really no recourse for any civilian member, whether it be an employee of National Defence, whether it be a family member of a veteran, or a community member that may have been affected," said Beauchamp.

Doctor urges 'presumptive' diagnosis approach

A former military doctor says it is time for Ottawa to take a "presumptive" approach to diagnosis so that anyone with health issues who was exposed to Agent Orange or other hazards would not have to prove a causal connection for compensation.

Dr. David Salisbury, who served in the military's medical services for more than 28 years before retiring in 2004 to become the medical officer of health for the City of Ottawa, urged the committee to "formally recognize that veterans can and do develop occupation diseases long after their service."

"Historically, disease and environmental hazards have caused more casualties and impaired military operations more than combat itself," according to Salisbury.

He wants to see Canada follow the lead of the U.S. with the Promise to Address Comprehensive Toxics Act, or PACT Act.

Passed in 2022, it expanded health-care coverage and benefits for veterans exposed to substances like Agent Orange, as well as to their survivors. As Salisbury put it: "You got this diagnosis. We know you were in such and such an area. We're going to put those two together and we're just going to presume that it was caused by that."

The argument has to move on from causation to "concentrating on care for people who are sick and not have them battle the bureaucracy about compensation and owning up to some responsibility," said Salisbury.

In an interview with CBC News following the meeting, committee chair John McKay, the Liberal MP for Scarborough-Guildwood in Ontario, described Salisbury's suggestion of presumptive diagnosis as "an interesting idea."

"I just don't know where we'll go with it," he said.

Concerns of ongoing exposure

Meanwhile, James Bezan, the Conservative MP for Selkirk-Interlake-Eastman in Manitoba and vice-chair of the committee, expressed concerns that the soil at Gagetown and other sites might still be contaminated, when there are soldiers still out there training.

The chair voiced similar concerns to CBC News.

"It's one thing, you know, to have soldiers and personnel exposed in times past, but to knowingly expose people currently would require a bit of an explanation, to say the least," said McKay.

Goode said he wants to see more testing at Gagetown.

"The only way to prevent sickness and disease is to get at the root cause," he said. "That is a treatment in itself and we have to approach it that way."

'This is not a panacea'

The committee chair said the testimony to date has been "quite compelling and quite tragic." McKay said he expects the committee may request more time to delve deeper.

"It's turning out to be kind of a much larger problem than I suppose any of us had anticipated to be."

As it stands, McKay believes it will be at least May before the committee files its report and recommendations.

"It's a formidable task ahead, with a time pressure that is unrealistic," he said, tempering the expectations of veterans and their families. "This is not a panacea."

Once the report is tabled, the federal government will have 60 days to respond.

Everyone knows that Base Gagetown became a toxic training area with the indiscriminate use of Agent Orange and other herbicides, especially so in the 60's and early 70's. These defoliants have been proven to be lethal and debilitating.

DND has purposely avoided acknowledging and/or dealing openly with the issue for more than 50 years now.

Hopefully the Commons committee will continue to set politics aside and come with recommendations that will include some type of compensation for all individuals who were exposed, regardless of whether they're military or civilians.

Then the federal government will have to (hopefully) do the right thing.

Accepting the $20,000 payment does not preclude court action, but Chisholm said he is skeptical of the chances in a court of law.

"The thing is, how do you prove it?" he said.

"Even with these diseases, there's no conceivable way you can prove these chemicals actually caused the diseases because there's no link. There's a very strong association that these here chemicals caused these diseases, but there's no positive link. That's the problem."

My team was exposed to agent orange, purple and white at the Shirley Road dump site at CFB Gagetown. We were working as independent consultants. We were not told of the contaminates till years later. DND never told us of the 486 barrels dumped in the Shirley Road dump where we were working.

Bottom line nobody cares, they will wait us out, as DND will not talk to us.

The government made ex-gratia payments as hush money; they never admitted to cause. The only proof you needed was to have been living within a specified area within the specified time periods in 1966 & 1967, and a doctor diagnosing one of the illnesses. There was no effort to determine cause and effect.

Highly unlikely; this is a federal issue on federal property. The study will compile a whole bunch of poor environmental practices within the department at all the bases across Canada. The province has more than a thousand contaminated sites that will keep them busy for years.
 
 
 
 

Agent Orange continues to haunt lives of U.S. veterans trained in New Brunswick

Maine commission will study whether U.S. veterans were exposed to Agent Orange at CFB Gagetown

Legislators in Maine are reopening a New Brunswick controversy many thought had already been consigned to the history books.  

They have established a commission to study whether U.S. military veterans may have been exposed to Agent Orange and other toxic defoliants while on training exercises in the province.  

The action, signed into law last week by Democratic Gov. Janet Mills, mandates a commission to "study the impacts of exposure to harmful chemicals on veterans who served at the Canadian military support base in Gagetown, New Brunswick, Canada."

Maine Senate president Troy Jackson is the man behind the new law. He took up the cause on behalf of veterans in his Aroostook constituency who claimed they weren't getting a fair hearing from their own government.

Thousands of U.S. National Guard volunteers travelled to CFB Gagetown for training beginning in the early 1970s.

"The idea was that, at minimum, we should start a commission so that all these people get a chance to come and talk about it and bring light to what has been a seemingly very challenging issue for Maine servicemen and women," Jackson said.

"And that's why we went forward now."

Defoliant used at base

The most notorious of the "harmful chemicals" was Agent Orange, a toxic defoliant sprayed from the air during the conflict in Vietnam and Cambodia to eliminate the jungle canopy that provided cover to Vietnamese fighters.  

The U.S. government has already acknowledged the harm caused to its servicemen and women who came into contact with the herbicide while serving in Southeast Asia. 

U.S. veterans claiming ill health effects, including a variety of cancers and even death, from exposure to Agent Orange have already been able to claim federal financial assistance if the exposure occurred while they served in that war.

But members of the National Guard, a state-based military reserve force, are not able to do the same. 

They are excluded from federal compensation because they did not serve in Vietnam and because service in the National Guard does not confer veteran status.  

U.S. military veterans point to the acknowledgement of the Canadian government as compelling proof that they, too, deserve compensation.  

In 2007, the Canadian government established a $95.6 million fund to compensate Canadian military members who may have been exposed to Agent Orange during limited test spraying of the U.S.-supplied herbicide at the New Brunswick base in 1966 and 1967.

The Department of National Defence maintains it only received two barrels of Agent Orange and another chemical, Agent Purple, for testing during those two years. The Defence Department also admitted it sprayed for three days in 1966 and four days in 1967 over a limited and remote area.

Agent Orange has been linked to several ailments according to Jim Gehring, a U.S. veteran and service officer with the Aroostook Veterans' Alliance.

"You are talking about Type 2 diabetes. You are talking about probably 12 to 15 types of cancer. Prostate cancer, leukemia, lung cancer, liver cancer, kidney cancer, go right down the list. It's the same list that the United States uses to award veterans who served in Vietnam," said Gehring.

Gehring said many of his members recall widespread use of herbicides while training in Gagetown. 

"They would spray to kill the grass, and then the gentlemen that were there training would sleep on the grass. And they also noted a lot of dead animals."

Different approaches

National Guard veterans have since registered a wide variety of medical complaints, from Type 2 diabetes to at least a dozen forms of cancer. Their appeal is not for compensatory payments, said Gehring, but for the U.S. government to cover the cost of their medical care as it has for other military veterans.

Senator Jackson is at a loss to explain the differing approaches.

"If the Canadian government made that admission ... why isn't the U.S. government making the very same admission and actually put it in a very public light to where they're going to have to decide if they want to continue to stonewall our servicemen and women, and I just think that that is an unbelievable disgrace."

While Jackson credits Canada with owning up to its responsibilities, he doesn't expect any compensation from Ottawa for U.S. claims. But co-operation would be welcome.

"I'm hoping the Canadian government can, you know, at least give us the truth about what was there in Gagetown and why Maine's servicemen and women were exposed to the very same chemicals that the Canadian servicemen and women were."

The newly established commission has until Dec. 6 to report its findings and recommendations.

People living in Fredericton in and around the fall of 1967 may remember being told to not go outside on one particular day when the wind had blown an application of something from Gagetown over the city. I like to collect these anecdotes from those who have recollections. In these years there were clusters of abnormal birth defect in the population that we do not seem to see as much of today despite the larger population. Needless to say, when you cannot prove something you are told to not suggest it. This we get from our presumption of innocence's bias from our courts. If you move down to Centracare in Saint John you will also encounter examples of humans being exposed to damaging practices who we never compensated.

In July 1964 over 50,000 Imperial gallons of a 50:50 mixture of 2,4-D+2,4,5-T was aerially sprayed on Gagetown during a temperature inversion. Market farmers for miles around the Base lost their entire crops, the Crown paid out $250,000 in damages.

That same blend was sprayed on Vietnam as a Crop Destruction weapon.

Health and Welfare Canada later announced the crops ruined around Gagetown were safe to consume. This isn't an anecdote; I'm reading this from old Daily Gleaner newspaper clippings. Now for the anecdote - yes there were birth defects but only the years 1966 and 1967 were investigated, not the heavy spray years like 1956-1964.

2,4-D is a synthetic version of a naturally occurring plant hormone isn't it? A possible worry with it was the toxicity of the formulation is was delivered in. It typically causes the affected plan to "age" to its end of life stage all at once, so crops would have died rather quickly. 2,4,5-T was the broadleaf defoliant. Their known persistence makes them still be present 2 months after application is some detectable levels. 2,4-D is considered safe to ingest as it is naturally occurring in plants. 2,4,7-T is chlorinated. Chlorinate organic molecules are more problematic to us, but this one is considered generally nontoxic. We'd have to know what was considered "safe" at the time. To have declared the crops safe for consumption may have met the standard of the day. It might still meet that standard today. With plant plant hormones there is always the possibility of effect on humans on account of the genetic commonality we have with plants. 2,4-D is suspected to encourage cell destruction and is considered a possible carcinogenic agent in humans.

Invented is the wrong word, I think. Synthesized is the better one. It's a synthetic version form of a natural hormone. Many prizes have been given to chemists who have first synthesized natural products for industry. It's a big part of what drives chemists in the field of organic chemistry. 
 
 
 

Military accused of lying about Agent Orange

An angry crowd accused military officials of a coverup during a hearing into the spraying of Agent Orange and other defoliants at a New Brunswick military base in the 1950s and 1960s.

Officials from the Department of National Defence, Veterans Affairs Canada and Canadian Forces Base Gagetown tried to downplay health hazards on Thursday, at the first public briefing on the issue in more than 30 years.

The hearing at the base followed a CBC News report that revealed Agent Purple, considered three times more toxic than the cancer-linked Agent Orange, was also sprayed on the base in 1966.

The reassurances did little to calm the audience of more than 100 people, which included civilians and veterans who believe their health was damaged by the spraying.

'Don't try to shove that down our throats'

The military's most controversial comment was that Agent Orange and Agent Purple were only sprayed on a small area of the base and only for a total of seven days in 1966 and 1967.

Many people who stood up to ask questions accused officials of lying about the extent of the testing, as well as its effects.

At one point, a man shouted, "Don't try to shove that down our throats, we're not going to take it."

John Chisholm said he knew that claim was false because he worked as a member of the ground crew on the spray program.

"This wasn't just a few days. And it wasn't just one helicopter, either. It was fixed-wing aircraft and it went on for years, covering a very big area," Chisholm said.

'We were coloured yellow from the spray'

He and other veterans and civilians who worked on the base described being exposed to the spraying and blamed it for illnesses they later developed.

"[The] first few times that we were out there, we came in, we were coloured orange, we were coloured yellow from the spray that came down on top of us," Chisholm said.

Chisholm, who is being treated for cancer and other health problems, said his wife died of cancer in 1996 and virtually all of his friends who worked with him in the spray program are also dead.

Kenneth Dobbie said he joined other men to clear sprayed brush on the base without wearing any protective gear, gloves or face masks.

"We cut it, we ingested the fumes, we burned it, therefore we inhaled the smoke ... and when it came time to eat, we sat down among all the toxins and we ate lunch with our bare hands."

A woman recounted her father's memories of becoming coated with the spray after being asked to watch the spraying operation from a hill. She blamed the spraying for problems with pregnancies in her family, including her mother's 13 miscarriages.

'It's time that you stood up and admitted that there is a problem'

"It's time that you stood up and admitted that there is a problem, that there wasn't only two or three barrels of this stuff sprayed at Base Gagetown," said Glen Stewart, the executive director of the provincial branch of the Royal Canadian Legion.

Like many in the audience, Stewart expressed fear that rates of cancer and other illnesses were abnormally high around the base.

"I am very confident that you will find that the death rate from various types of illnesses, including cancer, is higher in this area than it is in any other place in Canada," Stewart said.

At the meeting, both Defence and Veterans Affairs officials promised to do everything they could to investigate potential health hazards and help people who might have been affected.

Spraying was 'small scale,' DND says

Karen Ellis, a Defence spokeswoman, said Agent Orange was sprayed over seven days on a "small scale" under strict controls that prevented the spray from drifting more than about 15 metres.

She said it was very unlikely that civilians living near Gagetown were exposed to Agent Orange, which contains the carcinogen dioxin.

Ellis said health studies in the 1980s showed no ill effects, but promised a new investigation in response to community complaints.

"We will review the issue again now in light of concerns about the persistence of dioxins in the environment," Ellis said.

She said the Defence Department is studying soil and water on and around the base for evidence of dioxin poisoning. It will also consult with the U.S. military to find out the exact levels of carcinogens used.

The Defence Department is already paying compensation in two cases connected to the spraying. It has now received 300 compensation claims and more than 400 inquiries.

Ellis said each one would be evaluated fairly, with soldiers getting "the benefit of the doubt."

At the time of the spray program, it was believed the chemicals were harmless to human health and virtually no precautions were taken to minimize human contact.

U.S. forces sprayed Agent Orange to defoliate large areas of forest in Vietnam from 1961 until 1971, when it was discovered to contain dioxin.

FREDERICTON – People angry with Ottawa's compensation package for Agent Orange exposure at Canadian Forces Base Gagetown are turning to a class-action lawsuit for satisfaction, says the lawyer handling the case.

Tony Merchant of the Merchant Law Group said Thursday his law offices across the country have been flooded with calls from people furious at the federal government's offer of a one-time, $20,000 payment for those who meet strict eligibility requirements.

"It is ridiculously inadequate," Merchant said in an interview from his Regina law office.

"It's enough money to buy a used truck in exchange for what for many is daily pain and suffering. It's not solving the problem for the government. It's really drawing attention to the problem and making things worse."

Merchant said hundreds of people have added their names to the class-action lawsuit, swelling its ranks to about 3,000 veterans and civilians. The law firm is seeking court approval for the case to go ahead in Manitoba and Newfoundland and Labrador.

Veterans Affairs Minister Greg Thompson said earlier this week the compensation will apply only to those who worked on or lived near the huge New Brunswick training base in 1966 and 1967 – the two years the U.S. military tested Agent Orange and several other combat defoliants for use in the Vietnam War.

Qualifying applicants also must have one of 12 disorders associated with Agent Orange exposure, including prostate cancer and type 2 diabetes.

Thompson said the payments are "ex gratia" meaning the government is not admitting liability. He said people can accept the $20,000 and still join a lawsuit.

Merchant said the government's actions are helping the court case.

"It amounts to an admission of wrongdoing," Merchant said of the compensation package. "They say there is no legal admission, and we understand that, but in effect it is an admission of wrongdoing. So it is helpful."

The lawsuit encompasses a much broader period of time at CFB Gagetown. It is seeking compensation for people who claim they were harmed by spray programs beginning in the 1950s, when the base opened, and continuing until recent years.

Merchant said the formulations of herbicides used during annual spray programs at the base were the same as those brought to the base by the U.S. military in 1966 and 1967 for testing.

Defoliants used around the world in the 1950s, '60s and '70s contained a highly toxic byproduct called dioxin, which has been linked to human health problems.

Merchant said that although the herbicides were used across Canada and around the world by utility companies, railways and forestry operations, the lawsuit is restricted to Gagetown because the chemicals were used improperly on the base.

"At Gagetown they caused problems because they were used in such huge concentrations," he said.

"They also caused problems because of the way in which they then used the land. People were out in the fields, they were in the training areas, in the hunting areas. They even had people burning the brush. It's the use at Gagetown that was serious."

Nevertheless, proving cause and effect in court is not going to be easy.

Several studies of health impacts from Gagetown spraying were unable to conclusively establish a link between the sprays and health problems, although there were elevated risks for those involved directly in the spray programs.

Dr. Joel Michalek, who is with the department of epidemiology and biostatistics at the University of Texas, said hard evidence of exposure at Gagetown is gone because dioxin leaves the body after a few years.

"The idea is to measure the contaminant in a person's body and then ask whether those contaminant levels correlate with disease," said Michalek, who helped peer review studies at Gagetown.

"That would be the traditional approach. However, a person's body burden of dioxin is eliminated over time. It's very unlikely anyone would find elevated levels in those people."

Michalek said that despite the fact court cases are difficult, many are currently underway around the world. He said they often involve complaints about dioxin-laced herbicides.

"These are issues faced by all industrialized countries as they deal with the fallout from exposure to persistent pollutants."

And now nearly four years later we because of Ottawa's legal tactics in courts across Canada, are still awaiting judicial permission to proceed on this class action against the two Chemical Industry Giants (Dow and what used to known as Monsanto) which the Canadian Government insisted on having as co-defendants against its own Veterans and Civilians the victims of Ottawa's 28 years of indiscriminate use of toxic chemicals at CFB Gagetown.

Today we find ourselves on the brink of plunging Canada another $85 billion into deficit and surprise, surprise it is the same two Political parties responsible who couldn't find two cents for the victims which through the years they themselves created at CFB Gagetown, when Canada was experiencing $10-$12 billion dollars budget surpluses, the same two parties who claw back the merger CPP Pensions of Veterans when they turn 65, who will with the stroke of the pen condemn us to yet another 20 or so years of deficit payments.

When all is said and done Ottawa will have spent more money on the continued cover-up and the thwarting of the courts then if they would have dealt honestly with the Victims but then again they just might have had to say, "SORRY."

I wonder what Ottawa is hiding after all this was a better kept secrete and is now a harder fought court battle then the atomic bomb was?

        Former MLA Frank Branch is defended by a reader!!!!

        This is a first for me, writing to your Blog, which I find very
        interesting by the way. Keep up the good ones.

        In regard to the criminal charges against Frank Branch, I have a very
        different story to tell, which I hope you will publish. Is Branch a
        crook? See for yourself.

        Here is the story that I am aware of.

        In 2003, Premier Bernard Lord is struggling to keep a majority in his
        Govt. He offers Liberal MLA Frank Branch to be the Speaker of the
        House at the Legislature, taking a vote away from the Liberals. Branch
        refused. Lord would not have been pleased with Branch refusal. We need
        a majority at any cost.

        During that time, Branch has a part time job, being Chairman of the
        North Shore Forest Marketing Production Board. A not much paying job,
        but a challenging and interesting job for someone from the North
        Shore.

        Lord offers Branch something much more interesting to Branch. Lord
        wants to create the new position of the Forest Products Commissioner
        of NB,a salary which would add up to 1.2 millions of $s for ten years
        for Branch. Branch refuses the offer. (I believe Bernie Valcourt took
        the new created Commissioner's job) Of course if Branch accepted the
        job, he would have had to resign as MLA and leave his seat open to a
        partial election which Lord hoped to win.

        This is where it gets nasty.

        Around 2004/2005, rumours started that Branch had misappropriated
        funds from his office at the NSFMPB in Bathurst. Tim Quigley Private
        Investigator was hired by the Board to investigate. (Quigley was the
        Commanding Officer of The RCMP NB Division until he retired sometimes
        in 2004) Branch requested to be interviewed by Quigley, but never was.
        Quigley went directly to the NSFMPB and reported that there was enough
        stuff in this case to have Branch charged in Criminal Court for fraud.

        Then the media took over and the reputation of Branch went down.

        Shawn Graham at the end of 2005 asked Frank Branch to step out until
        this matter was clarified and Branch sat as Independent at the
        Legislature, probably much humiliated and betrayed.

        The RCMP investigated Branch, although they didn't interview Branch,
        they concluded that there wasn't enough evidence to charge him. I
        don't know what happened then. For some reason, the Bathurst City
        Police took over again the investigation and charged ex MLA Frank
        Branch for Breach of Trust, Fraud and extortion.

        I'll make a one looney bet that Frank Branch will never be convicted
        of any of those accusations, but unfortunately his reputation is
        tarnished.

        I would normally think that after a thorough investigation done by the
        RCMP, Mr Branch would have been cleared of those allegations, the
        matter would be closed.

        The problem is that Mr Branch has civil actions against some
        individuals in this matter.

        The problem I believe for ex MLA Branch is the fact that the NB
        Department of Justice is a brotherhood of Free Masons.

        Yes, Brad Green (now Mr Justice) is a Free Mason and T.J. Burke as
        well. they are Brothers first, irrelevant of who you are. (Don't
        believe me? Go to the Masons of NB, you may find some interesting
        pictures or names)
        The pressure Bathurst Police got from the Department of Justice must
        have been quite strong. Now, will there be a Crown Prosecutor willing
        to pursue Branch in Court?

        I bet you it will be a hired no name lawyer to prosecute if this ever
        goes to Court.

        If I were Frank Branch, I would go immediately to the Bathurst Police
        and request the evidence they have against him and I would also go to
        the RCMP to get their file they have on him. As a Canadian citizen he
        has every right to get those files.

        People who are keeping a distance from Frank Branch, I suggest you
        don't go to conclusions and get more informtions before letting the
        man down.

        I remember talking to you on the phone while you were in a motel room
        in Edmonston not long after I ran in the election of the 39th
        Parliament. I did so because after your client Frank Branch was
        compelled to sit as an Independent  he had began making a lot of
        interesting statements into the parliamentry public record so that he
        could not be sued for his words.

        Later in June of 2006 while the Sgt at Arms and the Fredericton Police
        Force were outside on the gounds and busy illegally attempting to
        banish me from the Legislative properties a friend of mine was inside
        the Legislative building talking to many people iincluding the current
        Premier Shawn Graham and your client Frank Branch. Perhaps Werner Bock
        should remind you and your client and the Crown what your client told
        him in a very public forum?

        Perhaps as you review some of my emails once again I should remind you
        of the Law Society Act and that of the fact that you are an officer of
        the court and are required by law and your licence to practice law for
        a fee to report your knowledge of crimes. Correct? if nothing else you
        should at least affirm for me that the The Crown and it servants in
        the RCMP cannot pick and choose which law to uphold in a partisan
        fashion. Just because all the smiling corrupt bastards do not
        appreciate my style of hard ball politicking in an ethical fashion it
        does not make me a criminal or mentally unstable. Correct?

        I believe we may become friends if only because we have a similiar
        aproach to dealing with obvious matters and the Art of Motorcycle

        As the young fella tried to sound like sort of big cheese and insulted
        me about the emails I had sent earlier, I merely dismissed him as the
        arsehole he is and told him I want to talk to Mr. Zell. Later I after
        making my way past some very dippy and rude women I also managed to
        speak to some man who was purportedly was the station manger at KTLA
        but he would not say his name. When that dumb bastard challenged me I
        did not mince words with him.

        Lets just say these minor men of the media mean less than nothing to
        me Check my work and you will see why. Now I only wish to speak to Sam
        Zell as I forward this email and someof the  others to some serious
