New Brunswick Power FY 2024 General Rate Application:   Matter 541

Written Argument of the Public Intervener

February 23, 2023 

 

1.       Good morning Mr. Chairman and members of the panel.   In this proceeding, NB Power has requested an 8.9 percent across-the-board rate increase, which will produce an increase in rate revenues of $135 million.   In the concurrent Matter 545, NB Power proposes a $15 million rate reduction, or about 0.9 percent.  This reduction would essentially be assigned to rate classes on a per-kWh basis, resulting in higher percentage rate decreases for larger industrial customers.  As updated, the Company’s proposed increase would produce a minimal budget net income of $16 million.

Despite some strong language and a clear signal in the Board’s Matter 458 decision, the Company’s budgeted costs show little sign of an aggressive cost reduction effort, save for the retention of PwC and the associated draft charters.  Moreover, the Company’s generation costs have increased as a result of world fuel price changes.  In short, the Company’s costs appear to bear little relation to the Board’s expressed desires in the last proceeding.  The Public Intervener respectfully submits that these facts validate a long-standing truth about the regulation of NB Power.   That is, the Board has very little ability to dictate how much will be demanded from ratepayers, while having much more control over when costs will be demanded from ratepayers and from whom the costs will be demanded through the rate design process.

The PI respectfully submits that the primary issues in this proceeding involve what costs should be recovered in FY 2024, and what costs should be deferred for future recovery through the rate rider, capitalization, deferral accounts and the like.   In the PI’s view, this requires a balancing of the interests of current day ratepayers with future day ratepayers.   I will attempt to do so in this submission.

2.       Updating the Gross Margin Forecast/Single Issue Ratemaking

I‘m going to turn first to the most contentious issue in this proceeding, namely whether the budget should be updated for known changes since it was prepared, most particularly with respect to gross margin.   By gross margin, I am referring to the difference between revenues and fuel/purchased power costs, for both domestic sales and out-of-province sales.  The Company provided an update to the margins in Undertaking #22.   That undertaking indicates that, compared to the filed case, the Company’s overall gross margin for FY 2023 will be $261.4 million worse than what was expected in the filing, and the gross margin for FY 2024 will be $106.5 million better than what was expected.   The under-performance in FY 2023 is reflected in the Company’s December 31, 2022 debt/equity ratio of 93/7, provided in Undertaking #9.  In contrast to the mandate letter from the government which requires that NB Power plan to meet a 80/20 debt/equity ratio by 2027, the Company is moving in the opposite direction.

Much of the terrible performance in FY 2023 is related to unplanned and extended outages at the Point Lepreau and the Bayside generating units, forcing the Company to purchase replacement power at high prices.   Looking back at the PI’s evidence in earlier NB Power proceedings, I would have to conclude that these events were exactly the concerns raised by Mr. Knecht in referring to what he called “asymmetric risk” in the Company’s longer-term forecasts.[1]  A couple unfortunate events can wipe out years of progress toward financial stability.

The improvement in the FY 2024 margins compared to budget are due in part to lower than budget fuel prices, although much of that effect is offset by the Company’s hedging policies.   As shown in Undertaking #22, the improvement in domestic sales margin is only $21.4 of the $106.5 million.   The primary improvements are related to export margins, where the Company has successfully entered into a number of “standard offer service” contracts on which it expects to earn margins.   Regarding these contracts, as Mr. Church explained, the timing of market prices means that the Company will show a negative margin on sales in the first three calendar months of FY 2023, which is NB Power’s FY 2023, more than offset by positive margin for the rest of the calendar year 2023 which is NB Power’s FY 2024.[2]   So these contracts exacerbate the reduced-performance in FY 2023 and the improved-performance in FY 2024.   I would also observe that while the Company assumes it will earn a solid margin on these contracts, this margin does not come without some substantial risk, as detailed by Mr. Church at page xx of the transcript.  It’s simply too good to be true to think that NB Power can enter into profitable buy-sell contracts without assuming some risk.

Turning to the issue of whether updated information should be considered in this proceeding, the PI takes the position that this would not be a textbook case of single-issue ratemaking, because it involves revenues and costs that are subject to a regulatory deferral account, specifically the new Energy Supply Cost Variance Account and Electricity Sales and Margin Variance Account (which I’ll call the margin variance accounts).  However, as Mr. Knecht explained in cross-examination, the regulatory benefit to updating the revenues and costs that are reflected in variance accounts is to minimize the size of those accounts.    As Mr. Knecht also explained, the update for FY 2023 suggests that the balance in those accounts at March 31. 2023 will be some $300 million, some $260 million worse than that anticipated in the budget.    If the Company’s filed budget for gross margin is retained, the current expectation would be that this amount will be drawn down somewhat over FY 2024, as the Company outperforms its filed budget with additional export sales margin.   If the Board updates the FY 2024 revenue requirement for the new information, that $300 million will need to be entirely recovered from ratepayers through the rate rider, which will take many years.[3]

The Public Intervener therefore submits that the Board should take a case-by-case approach to evaluating whether gross margin should be updated in the annual (or triennial) GRAs.  In so doing, the Board should consider whether the update serves its purpose, namely to reduce the magnitude of the regulatory deferral accounts.  

In this case, due to the poor performance in FY 2023, the Public Intervener respectfully submits that the FY 2024 budget should not be updated for the revised assumptions.  The PI submits that not updating the forecast will give the Company an opportunity to claw back some of its enormous under-recoveries in FY 2023 in FY 2024, thereby reducing the balances in the margin variance accounts at October 31, 2023 (for the FY 2025 rate rider) and at October 31, 2024 (for the FY 2026 rate rider).

Finally, I’d just like to make a common-sense argument regarding this issue.   As shown in Undertaking #22, the Company’s update indicates that the combined gross margin for FY 2023 and FY 2024 is about $155 million worse than the Company’s expectations at the time of filing.   This amount must eventually be recovered from ratepayers.  I respectfully submit that it would be difficult to explain to the public why an increase in the total amount required of ratepayers should result in a reduction in rates for FY 2024.

3.       Export Margin

It may seem duplicative, but if the Board does not update the gross margin, there remains an issue of whether the export margins in the original budget should be updated.  Both Mr. Madsen and Mr. Knecht opined on the export margin amounts as posited in the budget filing.

Regarding export net earnings, the positions of the parties are as follows.  NB Power argues that its $63 million forecast is based on the best information available when the budget was developed, and that it was conservative regarding forecasts for repeat margins on some standard offer sales.   Both Mr. Knecht and Mr. Madsen recognize that the forecast is a little pessimistic compared to historical averages, and that the Company has exhibited a tendency to under-forecast.   Mr. Madsen recommends reducing the revenue requirement by $26.8 million to reflect higher export margins.   Mr. Musco takes no exception to the Company’s budget claim, other than to argue for updating all the gross margin forecasts.

To be clear, for this proceeding, the PI takes the position that the Company’s original budget estimate should be retained.   The PI acknowledges that the Company has generally been conservative in its export margin budget forecasts, as recognized by both Mr. Knecht and Mr. Madsen, and as further evidenced by the update in this proceeding.   Nevertheless, the budget forecast in this proceeding also included a $44 million unfavorable variance in the margin variance accounts at March 31, 2022.   In the interest of rate stability, the PI concludes that it would be best to retain the conservative export margin forecast as an offset to the unfavorable margin variance account balance, as suggested by Mr. Knecht in his evidence.[4]

4.       Renewable Portfolio Standard

On a related subject, the Province of New Brunswick adopted a renewable portfolio standard at Regulation 2015-060, which requires:

“On December 31, 2020, and for each subsequent fiscal year, the Corporation shall ensure that 40% of the total in-province electricity sales in kilowatt-hours is electricity from renewable resources.”  

NB Power’s filed budget in this proceeding is that it will meet domestic load with only 35% renewable generation, and it estimates that it would increase the revenue requirement by $14.2 million to achieve the 40 percent standard.[5] 

I respectfully submit that the RPS was established by the government to promote the development of renewable generating resources, and that complying with that standard is in the public interest.  It is, to put it mildly, disconcerting that while the rest of the world is increasing its use of renewable resources, NB Power appears to be moving in the other direction.   I also respectfully submit that the Company’s statements on the record that “we’re working hard to find the other 5 percent” (Transcript at 374-5) simply does not meet the legal standard that the Company “ensure” compliance.  

In the context of the margin variance accounts, the Board must approve a monthly budget for revenues and variable costs in this proceeding.  The PI takes the position that the Company’s revenue requirement and the associated approved monthly budgets should be based on a scenario that is consistent with the law.  

If the Board accepts the PI’s position that the gross margins are not updated for new information, those budgets should be based on the Company’s analysis with the additional $14.2 million in costs.  

If the Board determines that an update of the forecast is appropriate, the PI respectfully submits that NB Power should be required to develop an updated simulation of its revenues and costs with the revised information, but which is compliant with Regulation 2015-060.  As Mr. Church confessed, the updated information results in performance that is materially worse than the budget, with the Company only meeting 31 percent of the domestic load with renewable energy.[6] 

As Mr. Knecht suggested, it is not clear how a budget of 35% or a revised budget of 31% that is blatantly inconsistent with the regulation would survive an appeal to the courts.

5.       O&M Costs

In the last case, the Board strongly expressed its concerns about a lack of cost control at NB Power with respect to O&M costs.   However, for this case, NB Power has followed its historical policy of forecasting large increases in O&M spending, and then applying a “continuous improvement savings” item to make it look like costs are being driven down.   Even with the $27.5 million in continuous improvement savings, and setting aside the DSM costs caused by the Regulation, NB Power’s O&M costs have risen sharply from 2021 to 2024.  

Both Mr. Knecht and Mr. Madsen expressed concern about this cost growth.   The PI acknowledges Mr. Knecht’s observation that NB Power does not have a history of over-forecasting O&M costs, and that the reverse is somewhat true.  Nevertheless, the Company’s delay in undertaking a detailed cost review following the Board’s decision in Matter 458 is worrisome.

Mr. Madsen offers various specific proposals for reducing the claimed O&M cost requirement, at Table 7 of his evidence.   As best I can determine from the transcript, these include the following:

·         Salaries and positions:  $18.5 mm

·         Vacancy rates:  $12.0 mmm

·         Hired services:  $16.3 million (putting aside the double-counted $8.8 million Mactaquac writedown for a moment);

·         IT costs:  $3.2 million

·         $ Insurance premiums:  $0.2     

So, if my math is right, those reductions total to $50.2 million, which is then offset by the $27.5 million in unidentified continuous improvement savings that NB Power included in its budget.   This is a net savings of $22.7 million relative to the Company’s budget.

In light of the Board’s strongly worded opinion in Matter 458 regarding the need for cost control, the Public Intervener finds Mr. Madsen’s recommendations regarding salaries, vacancies, hired services, insurance and IT costs to be credible.   The PI recommends that this $22.7 million be disallowed.

Turning to the issue of the $8.8 million expensing of previously capitalized costs related to the Mactaquac project, the Public Intervener notes that rejecting the Company’s accounting treatment produces no overall savings for ratepayers, but shifts costs from FY 2024 to future ratepayers relative to the Company’s budget.   In general, the PI is averse to changes to the FY 2024 revenue requirement that do not involve actual cost reductions but simply shift costs to future ratepayers.   However, in this particular case, the Public Intervener finds Mr. Madsen’s logic regarding accounting practices to be credible, and recommends that Mr. Madsen’s modification be adopted.  This would increase the net reduction in the disallowance from $22.7 million to $31.5 million.    

In supporting these adjustments, however, the PI observes that the Board needs to have a follow-up evaluation, probably for the FY 2026 GRA, to ensure that NB Power has taken this disallowance seriously, and has taken the steps necessary to comply.   Otherwise, NB Power can simply thumb its nose at the Board and spend whatever it wants, and finance the cost under-recovery it with more debt.   Thus, some kind of ex post evaluation of the Company’s actual FY 2024 costs will be necessary to ensure that actual spending reflects the Board’s concerns.   The PI encourages the Board to give thought to how that might be accomplished.

6.       O&M Capitalization

Mr. Madsen’s evidence regarding capitalization is a little unclear at this time.   He observes that the Company’s capitalization rate is significantly lower than that of other Canada electric utilities, and he argues in favor of an independent benchmarking analysis.  Mr. Knecht supports conducting such an evaluation.   Moreover, the Company’s rebuttal evidence provided no explanation for these apparent differences.  As such, the Public Intervener respectfully submits that the Board should direct NB Power to commission such a review, for submission in the next GRA.

Mr. Madsen appears to retain a suggestion that the revenue requirement should maybe be adjusted for some $32.8 million in O&M capitalization (Madsen Table 1).  The Public Intervener does not support this proposal, because (a) the alleged under-capitalization compared to other utilities is not supported by a careful external review, and (b) increasing the capitalization will serve to simply shift costs from current ratepayers to future ratepayers.   Rather than make a quantitative adjustment in this proceeding, the PI recommends that this issue be deferred to the next case when a more robust analysis is available.   

7.       PLNGS Deferral Account

Mr. Madsen recommends that the Company adopt a regulatory variance account to stabilize the fluctuations in costs associated with the Point Lepreau station.   While the Public Intervener sees potential merit in alternative mechanisms that would stabilize costs associated with PLNGS, the PI respectfully submits that in the context of this proceeding, this change would have the effect of once again shifting more costs from current to future ratepayers.  

The PI would not oppose a Board order directing NB Power to evaluate the advantages and disadvantages of such an account for the next GRA.  However, the PI opposes adopting such a mechanism in this proceeding as being unfair to future ratepayers.

8.       Net Income

Regarding net income, Mr. Madsen did not offer a specific recommendation in his evidence.   Mr. Knecht’s evaluation is that the net income claim of $16 million, is far short of that necessary to make reasonable progress toward an equity to capital ratio of 20 percent by FY 2027.   Mr. Knecht took the position that any reduction to the allowed costs (or increases to export margins) should be reflected in a higher income allowance, such that the Company should be awarded its full claimed increase.

The PI retains its very significant concerns that NB Power may need to make extreme demands on future ratepayers, and that its filing in this proceeding is actually making the problem worse by proposing little or no net income for FY 2024.     Consider the following problems:

·         The Company is going to need to recover the unfavorable margin variance account balances for FY 2023 from the rate rider, plus the $15 million it is foolishly giving back in 2024.

·         As detailed in Mr. Knecht’s evidence, the Company’s longer-term budgeting continues to include optimistic assumptions regarding operating performance for its generation fleet, as well as continuous improvement in costs for which it has as yet failed to demonstrate capability.

·         The Company plans to spend up to $3.2 billion on Mactaquac, which will require some $640 million in book equity to keep a 20% equity thickness. 

·         The Company will need to either write off Belledune, or make significant investments into it for alternate fuel capability, all by 2030, and yet it continues to depreciate it through 2040 as if nothing is wrong. 

·         The Company is probably going to have to make significant investments to replace or modify Coleson Cove to be net carbon neutral by 2035, and it similarly continues to depreciate it through all of the next decade as if nothing is wrong.  

It is most unclear how NB Power plans to finance these efforts, and it is even more unclear how it will recover the costs for those investments from ratepayers.

As such, the PI acknowledges that Mr. Knecht’s proposal to convert any disallowances to the FY 2024 costs into a net income allowance for the FY 2024 test year has some merit, as it would provide some additional protection for future ratepayers.

However, the Public Intervener declines to support Mr. Knecht’s recommendation in this respect in this proceeding. 

First, I note that Mr. Knecht advanced a similar proposal in Matter 458, and it was rejected by the Board (albeit with a dissent from Mr. Herron).  Thus, Board policy appears to reject that approach. 

More importantly, though, the Public Intervener is taking the position that it is not the Public Intervener’s job, the Board’s job, or the independent experts’ job to tell the Company that its claimed net income is inadequate.   It is the Company’s responsibility to ask for the net income it requires to meet its obligations.  And that obligation is particularly important for this case.   The Public Intervener respectfully submits that all of the concerns that parties have raised about an inadequate income target for NB Power are problems caused by the Company.

The concern about NB Power’s yo-yo accounting for the rate rider is real, but it is a problem of the Company’s own making – the Company chose to do its accounting that way, knowing full well what the implications would be.  

Regarding the lifespan for fossil units, Mr. Knecht raised the issue of depreciating Belledune and Coleson Cove years ago, and the Company has simply declined to make any changes.  In fact the Company continues to defend those policies, in defiance of common sense.  

As for fixing Mactaquac, and addressing the transition away from burning coal and heavy oil at Belledune and Coleson Cove, the Company has failed to submit any planning document that addresses these critical issues.   There is no IRP on file that addresses the issue, there is no relevant Strategic Plan, the Company is no longer required to file a 10-year Plan, and there is little or nothing in the Three-Year Plan regarding those issues.   So, for all we know, NB Power is going to solve these problems by becoming a wires utility, buying all of its power from its neighbors, and thereby needing no generation capital at all.  Alternatively, perhaps the Company knows that the government will step in and subsidize the transition. 

If the Company cannot reasonably meet its financing requirements because it has made inadequate net income claims, or because it has failed to meet its approved budget targets, the Public Intervener respectfully submits that the government should provide the funding, and not force the Board to demand it from ratepayers in future GRAs.  While this is a matter for the government to decide, the Board can at least send a signal that if the Company believes it needs net income, it must apply for it in its filings.

The PI therefore takes the position that NB Power should be granted the net income it has requested, approximately $16 million.   If the Company believes it needs more to meet its obligations, it should be required to ask for it and defend it.

Thus, overall, the Public Intervener recommends that some $31.5 million in budgeted O&M costs be disallowed in this proceeding, and that the Company’s gross margin be updated to reflect a scenario that is compliant with the renewable portfolio standard, with an associated cost increase of $14.2 million.   On net, the revenue requirement should be reduced by $17.3 million, or about 1 percent.    

9.       Cost Allocation  

While Mr. Knecht developed an alternative cost allocation study, his revenue allocation and rate design recommendations apply to both studies.   The PI therefore recommends that the technical cost allocation issues can be resolved in Matter 529.  

Mr. Knecht did offer a recommendation for what he called a “tweak” to the way revenue-cost ratios are calculated, which may not come up in Matter 529.   The PI acknowledges the Company’s response that this approach is included in the model’s functionality.  While the PI respectfully disagrees with the Company’s rationale for the approach it uses, the PI agrees that this issue can reasonably be addressed in the next GRA.

10.     Revenue Allocation: 

Mr. Knecht made a proposal for assigning differentiated increases among the various rate classes, designed to move class revenues more into line with allocated costs.  This proposal generally assigns lower increases to classes with high revenue-cost ratios, specifically the GS-1, Small Industrial and Street Lighting classes.  

As Mr. Knecht explained, this approach is consistent with NB Power’s proposals in Matter 529, and it is consistent with the basic principles for utility rate design.   The PI also respectfully submits that the Board required NB Power to update its load research analysis (at a material cost) to support a more accurate cost allocation study, and it would be a shame not to use it. 

Finally, the PI notes that with the PI’s overall proposed reduction to the revenue requirement in this case, the slightly higher rate impacts of Mr. Knecht’s revenue allocation recommendations for some classes would be mitigated by the reduced overall increase.

11.   Rate Design

Finally, Mr. Knecht also made a series of recommendations regarding rate design for individual classes, generally designed to move class rates more into line with allocated costs.   In general, Mr. Knecht’s recommendations stand on their own, and are unrebutted.  Nevertheless, let me highlight an aspect of the residential rate class design.   Mr. Knecht proposes that no increase be applied to the monthly customer charge for that class, and that the entire increase be recovered from the energy usage charge.  

I respectfully submit that this approach will result in modestly smaller increases for customers with smaller houses and customers who use electricity more efficiently.   Thus, Mr. Knecht’s changes are both consistent with allocated costs and with achieving desirable social goals.  Thus, in particular, the PI finds that Mr. Knecht’s rate design recommendations for the residential class are in the public interest.

Downward turn in N.B. Power finances stuns the utility's rate hearing

'When I saw it I did not believe it,' said Robert Knecht, utility expert from Massachusetts

Robert Knecht was called to testify Tuesday afternoon, but prior to his testimony N.B. Power filed updated financial information for the current year that showed a quarter-billion-dollar deterioration in the company's fortunes just since September. 

The decline is so sharp, Knecht told N.B. Power lawyer John Furey, he initially thought it was a mistake when the amount first began to emerge last week.

"That's a pretty significant change in three months, isn't it?" asked Furey.

"Yes, when I saw it I did not believe it," said Knecht.

Doing quick calculations on the fly as he testified, Knecht estimated that N.B. Power is $260 million worse off since the fall, due to higher than expected fuel costs and untimely outages at the Bayside natural gas and Point Lepreau nuclear generating stations.

"I see a variance $260 million worse than what was in the filing, which was based on the budget, if I understand this correctly,"  he said.

Knecht is a senior consultant with Industrial Economics in Cambridge, Mass. 

He has appeared at multiple N.B. Power rate hearings over several years and has consistently, and for the most part correctly, predicted the utility was courting financial trouble by being too optimistic in its company forecasts. 

In 2017 he raised doubts the utility's long-term plan to pay down $1 billion in debt by raising rates 2 per cent per year would work. He believed it relied too much on good things happening — such as the Point Lepreau nuclear generating station operating without trouble — and bad things not happening, such as damaging major storm events.

"I have concerns that the N.B. Power 10-year plan may be more of an optimistic rather than an expected value forecast," he said at the time.

Since then, instead of N.B. Power's net debt falling to $4.5 billion this year as the utility was predicting in 2017, it has surged past $5 billion as Knecht feared it might.

He was hired to give his opinion on N.B. Power's proposed rate increase this year by acting public intervenor Rick Williams and has expressed concerns again the utility is still underestimating what it needs to do to move to a more stable financial footing.

"I have had a longstanding concern with respect to this utility that it is simply not making any progress towards [debt reduction]." said Knecht.

He pointed out N.B. Power is budgeting for Point Lepreau to operate trouble free next year and said that tells him the utility is still using too much wishful thinking in its planning.

"As you know, I have expressed these concerns in a number of proceedings," he said.

"That [budgeted] level is higher than anything that the plant has achieved since it was refurbished."

Knecht said he thinks there are opportunities to cut costs inside N.B. Power, but that its stubbornly high debt levels and recent financial setbacks require more revenue from customers, and he endorsed the rate increase request in full.

"I recommended that the board accept the company's proposed rate increase of 8.9 percent," said Knecht.

We had a chance to dump this junk company to Hydro-Québec and people in NB went in panic mode. I bet they are now second guessing their protests at the time. We will need to pay more, and more, and more. Point Lepreau seems to always break down at the most inopportune times.

All of a southern NB was against it, most of northern NB were for it for obvious reasons : about 1/2 the cost of electricity unde Hydro Quebec. This balance of power to southern NB has costed the province multi million of dollars in revenue and opportunities: buildings and scrapping the toll highway in the Sussex area, building the 200km double lane highway Route 2 between St Stephen and Sussex only to serve American and the NS economy , the lack of leadership to impose a provincial corporate tax and revenue earned in the province which would have taken care of aggressive tax scheme by the Irving’s.

How much do the sweet heart deals with industry in NB play into these financial problems? That and investing in schemes that defy physics (in Florida).

And it is noted here that Lepreau is down a lot. NB Power and the Higgs and Trudeau governments are in the process of wasting even more money on unproven small nuclear reactors. Another financial fiasco in the making.

How is that the executives and the board of NB Power are never held accountable for these messes? This article states that in 2017 they made what has turned out to be a nearly $10 billion mistake in their projections. That is just 6 years ago. Is that not a firing offense? It sure as heck should be.

I've known guys that work at NBP. The amount of company property they have in their houses is crazy. I knew a guy who wired his whole camp from "scraps". Even used a scrap to run the line from the pole. Probably a scrap pole he installed too. I used to go get stuff from BAP in the industrial park and buddy told me every time a NBP employee would come to pick up supplies they would buy themselves a new Leatherman and Axe. I seen a guy with 3 chainsaws with NBP marked on the in his garage. We have all seen this at some point. NBP needs to be audited.

NB Power debt claim to MLAs appears to be untrue

Utility can't say who made the statement its president referenced

NB Power president Gaetan Thomas's claim to MLAs that the Energy and
Utilities Board once told the utility profits should be kept below $80
million, despite its need to pay off debt, appears to be untrue.

The EUB has never issued a directive to NB Power to keep earnings
below $80 million and the utility has been unable to explain who made
the statement Thomas is referring to or when, if ever, it was said.

Thomas, chairman Ed Barrett and other NB Power executives made a
presentation on Jan. 5 to the legislature's Crown corporations
committee to discuss the utility's latest financial results and MLAs
questioned them about NB Power's debt problems.

Both Barrett and Thomas told the committee the Energy and Utilities
Board has stood in the way of the utility earning sufficient profits
to substantially reduce its $4.9 billion debt load, instead forcing it
to keep rates low.

Thomas said even modest profit targets are frowned on by the EUB.

"Every time we're confronted with a low rate," Thomas told MLAs.

"That is the dominant factor for the regulator. Even if we can show,
lets say, we can make say $80 million earnings the point is they say
you don't really need that much earnings."

However, all profit requests NB Power management has made to the EUB
in the last four years have been approved, three for more than $80
million, the amount Thomas claims the EUB has said is too much.

Heather Black has represented the public at NB Power's last four rate
hearings and says the utility has set its own profit target each year
and has never had any part of the amounts rejected by the EUB.

"In each case, the board has approved NB Power's proposed earnings in
the full amount NB Power requested," Black wrote in an email to CBC
News.

Marc Belliveau, a spokesman for NB Power, said in an email the comment
Thomas made about the EUB telling the utility an $80 million profit is
too high should not be taken literally.

"I don't have a transcript of the (MLA) proceedings but this was a
general statement/example not a specific one," he wrote.

It's the second statement Thomas has made in the last month that has
needed clarification, and both were in relation to the utility's debt
problem.

In January, Thomas told CBC News that NB Power is applying for a $36
million rate increase for the next fiscal year to help generate a
profit and "most of it would go to debt reduction".

But NB Power figures show the utility is planning no debt reduction
next year, even with a rate increase. Expected profits at the utility
are budgeted to be spent on capital projects with none applied to its
$4.9 billion debt.

It is scheduled to increase by $6 million.

NB Power has failed to meet  earnings targets in each of the last four
years, mostly because expenses have been higher than anticipated, but
the EUB has never opposed the targets themselves.

The board approved a combined $329.5 million in profit over the
four-year period but NB Power expects to generate less than 25 percent
of that — just $71.3 million - once the current year is factored in.

Black says NB Power's failure to pay down its debt is not a problem
with the EUB.

"While the board cuts NB Power's proposed spending where it determines
that the spending is imprudent, this has not been the cause of NB
Power's failure to meet its earnings targets," said Black, citing
performance problems at Lepreau, unbudgeted storm damage and other
issues.

"NB Power's earnings erode when its costs are over budget or when it
fails to earn its budgeted revenue."

The EUB is declining to comment but the organization has openly
expressed concerns about NB Power's debt in the past.

At hearings last April, Ellen Desmond, the EUB's lawyer, questioned
Darren Murphy, NB Power vice-president, in detail about whether the
utility's profits are too low and its debt retirement schedule too
slow.

She suggested the utility consider reducing its spending to generate
higher profits in years its financial projections are coming up short.

"Why not perhaps delay spending where necessary to meet other
objectives, including your reduction in net debt which we have heard a
lot about in the last three years," said Desmond.

"I mean if that is a priority, if that is a target, why not perhaps
adjust the plan? Why not adjust that so that we can see reduction --
larger reductions on the net debt?"

NB Power' Belliveau said in an email the utility believes rate
hearings focus too much on questioning spending and not enough on the
bottom line.

"The underlying tone of recent rate hearings has been focused on low
and stable rates as opposed to a more balanced view," said Belliveau.

6 From a financial perspective, I note that understating depreciation expense is

7 somewhat less dangerous than understating cash operating expenses or even

8 capital expenditures, because depreciation expenses are not cash. If

9 depreciation expenses prove to be higher than those forecast, it will not affect

10 the Company’s cash flow or its interest coverage ratios. Nevertheless, incurring

11 write-offs for these plants would reduce the Company’s equity to capital ratio,

12 which would both increase the perception of the Company’s risk in the capital

13 markets and make it that much harder to achieve and maintain the 20 percent

I presume byway of your statements that you studied the exhibits of NB Power

NBPO1.47 (pages 56 though to 62 in particular)

and

NBPO1.49 (pages 51 though to 118 in particular)

Do you know who the auditors working for KPMG were and how much did they bill NB Power for their work?

Responses:

As part of my assignment, I reviewed the Company’s Annual Reports, but I did not study them in detail. Based on the references to those Annual Reports in the interrogatory, I have a few observations related to the substance of my evidence.

First, I observe that the referenced Annual Reports indicate that the “useful lives are reviewed annually, external studies are performed every five years and rates are updated as required.” The Annual Reports appear to indicate that these studies are prepared for all assets. Exhibit NBP 1.47 at 38 and NBP 1.49 at 32. I do not know (not being a chartered accountant) whether the KPMG auditors validate those policies as part of their audit responsibilities. Also, it has been my understanding that NB Power conducts an external review for Transmission and Distribution assets, but not generation, based on my interpretation of Exhibit NBP 7.03 pages 110 to 113.

I would add that Exhibit NBP 1.03 at Matter 458 (pages 93-94) recognized that uncertainties existed regarding the depreciable life for the coal-fired Belledune generating station, but that text did not reappear in Exhibit NBP 7.03 in the current proceeding.

The referenced Annual Reports also appear to indicate that an assessment of asset impairment is made by management, rather than by an external reviewer. See Exhibit NBP 1.47 at 69 and NBP 1.49 at 64, as well as NBP(NBEUB) IR-38(f). I also do not know whether the KPMG auditors validate that assessment.

I have no knowledge as to the identity of the specific individuals who participated in the KPMG audits.

        Je vous écrit ce matin pour faire valoir mon indignation vis-à-vis
les propos de NB Power concernant M. Amos le 6 février 2019.  Plus
spécifiquement les paroles suivantes: « He might be dead before me. »

        M. Amos est très habile lorsque vient le temps d’argumenter.  En
plus, il connait très bien les lois et ses responsabilités sociales.
M. Amos est bien plus efficace en Cour que dans une sombre ruelle…
Jamais il aurait dit de pareils choses!

        J’étais présent la soirée du 7 février 2018.  C’était une très longue
journée avec le début de l’audience #375 le matin et l’intervention
publique le soir en plus de la pluie verglaçante.  Tout le monde était
fatigué.

        Je n’ai pas entendu M. Amos dire de telles paroles.  Il est vrai
qu’il parlait vite ce soir là.  C’était pour profiter le plus possible
de son temps de paroles.  Après avoir reçu la transcription de la
soirée, il a essayé à mainte reprises d’avoir une copie de
l’enregistrement mais sans succès.

        Les erreurs de transcriptions sont possibles car cela m’est arrivé à
quelques reprises.  C’est pourquoi, quand j’ai la possibilité, je
fournis un document écrit pour limiter les erreurs.  L’erreur est
humaine et je ne m’en fait pas d’histoires.  Mais maintenant je
réalise que c’est très dangereux.

        C’est pourquoi je doute de l’intégrité de NB Power lorsqu’elle
utilise cette technique pour faire valoir son point.  Selon moi, c’est
un coup bas!

        Je prie donc à la commission de prendre ceci en considération pour
aider M. Amos à devenir intervenant.

EUB hearing intervener questions fairness of NB Power energy efficiency programs

The fairness of NB Power’s energy efficiency programs is being brought into question.

The utility is before the New Brunswick Energy and Utilities Board seeking approval to move forward with a $122 million “smart meter” program for more than 300,000 homes in the province, as well as to undertake in a number of new energy conservation initiatives to go along with a two per cent rate hike.

The group New Clear Free Solutions says that it is concerned the programs will a small minority of customers. “When I asked about participants versus nonparticipants, it’s less than one per cent of ratepayers are benefiting from it,” said Chris Rouse who appeared before the EUB on behalf of the organization.

Rouse says New Brunswick’s most disadvantaged can’t even take part in many of these energy programs because they can’t afford it. “Fundamentally, what’s going on is, we’re asking the poorest of the population to help insulate a rich guy’s basement so he can save 40 per cent on his bill,” Rouse says.

That issue made it to the floor of the hearing.

“Do you think it’s fair that a single mom (is) getting a rate increase to pay for such a program?” Rouse asked a group of NB Power executives.

NB Power’s Chief Financial Officer responded. “I think it’s misleading to say suggest that any one customer is paying for another customer’s programs,” said Darren Murphy, CFO. “I think what we’ve done is ensure that there is access to programs for all customer classes. I would suggest that that’s how we’re ensuring fairness.”

Methinks the EUB's lawyer Ellen Desmond needs to explain to me how Mr
Jones got a tape of a hearing and play it on the radio while I have
been denied the right to have a tape of my own words that have been

"At hearings last April, Ellen Desmond, the EUB's lawyer, questioned
Darren Murphy, NB Power vice-president, in detail about whether the
utility's profits are too low and its debt retirement schedule too
slow.

She suggested the utility consider reducing its spending to generate
higher profits in years its financial projections are coming up short.

"Why not perhaps delay spending where necessary to meet other
objectives, including your reduction in net debt which we have heard a
lot about in the last three years," said Desmond.

"I mean if that is a priority, if that is a target, why not perhaps
adjust the plan? Why not adjust that so that we can see reduction --
larger reductions on the net debt?

NB Power debt claim to MLAs appears to be untrue

Utility can't say who made the statement its president referenced


NB Power President Gaetan Thomas said even modest profit targets are frowned on by the Energy and Utilities Board. (CBC)

NB Power president Gaetan Thomas's claim to MLAs that the Energy and Utilities Board once told the utility profits should be kept below $80 million, despite its need to pay off debt, appears to be untrue.

The EUB has never issued a directive to NB Power to keep earnings below $80 million and the utility has been unable to explain who made the statement Thomas is referring to or when, if ever, it was said.

Thomas, chairman Ed Barrett and other NB Power executives made a presentation on Jan. 5 to the legislature's Crown corporations committee to discuss the utility's latest financial results and MLAs questioned them about NB Power's debt problems.

Both Barrett and Thomas told the committee the Energy and Utilities Board has stood in the way of the utility earning sufficient profits to substantially reduce its $4.9 billion debt load, instead forcing it to keep rates low.
Thomas said even modest profit targets are frowned on by the EUB.

"Every time we're confronted with a low rate," Thomas told MLAs.

"That is the dominant factor for the regulator. Even if we can show, lets say, we can make say $80 million earnings the point is they say you don't really need that much earnings."

However, all profit requests NB Power management has made to the EUB in the last four years have been approved, three for more than $80 million, the amount Thomas claims the EUB has said is too much.

Heather Black has represented the public at NB Power's last four rate hearings and says the utility has set its own profit target each year and has never had any part of the amounts rejected by the EUB.

"In each case, the board has approved NB Power's proposed earnings in the full amount NB Power requested," Black wrote in an email to CBC News. 

Marc Belliveau, a spokesman for NB Power, said in an email the comment Thomas made about the EUB telling the utility an $80 million profit is too high should not be taken literally.

"I don't have a transcript of the (MLA) proceedings but this was a general statement/example not a specific one," he wrote.
It's the second statement Thomas has made in the last month that has needed clarification, and both were in relation to the utility's debt problem.

In January, Thomas told CBC News that NB Power is applying for a $36 million rate increase for the next fiscal year to help generate a profit and "most of it would go to debt reduction".

But NB Power figures show the utility is planning no debt reduction next year, even with a rate increase. Expected profits at the utility are budgeted to be spent on capital projects with none applied to its $4.9 billion debt.

It is scheduled to increase by $6 million.

NB Power has failed to meet  earnings targets in each of the last four years, mostly because expenses have been higher than anticipated, but the EUB has never opposed the targets themselves.
The board approved a combined $329.5 million in profit over the four-year period but NB Power expects to generate less than 25 percent of that — just $71.3 million - once the current year is factored in.

Black says NB Power's failure to pay down its debt is not a problem with the EUB.

"While the board cuts NB Power's proposed spending where it determines that the spending is imprudent, this has not been the cause of NB Power's failure to meet its earnings targets," said Black, citing performance problems at Lepreau, unbudgeted storm damage and other issues.

"NB Power's earnings erode when its costs are over budget or when it fails to earn its budgeted revenue."

The EUB is declining to comment but the organization has openly expressed concerns about NB Power's debt in the past.

"Several self-represented participants have been taking turns questioning NB Power's plans on an equal footing with lawyers hired by companies, like J.D. Irving Ltd. and Enbridge Gas New Brunswick, and municipal utilities like Saint John Energy.

It's been 35 years since the regulator ordered NB Power to bring all of its customer categories in line with the true cost of providing power. In other words the regulator wanted NB Power to end the practice where they charge some customers high rates so that other customers can be subsidized.

35 years later, not much headway has been made. This proves to me that NB Power can flagrantly disobey the regulator without any consequences. This has to stop now! What is the point of having a regulator if the regulator's orders can be ignored?

The Concerned Citizens Coalition is now the Community of Creative Citizens

The CCC Board of Directors has finalized a new name in the fall of
2022: the “Community of Creative Citizens”. This new name was selected
in an effort to emphasize the positive outlook and constructive advice
provided by CCC members and outside experts.

“Community” was chosen to highlight the collaborative goals of CCC –
only by working together can we find solutions to the challenges
facing our province. We believe in the empowerment of communities, to
be more engaged in the decision-making process in all the major
disciplines, including economic development, education, health and
long-term care, energy, and more.

“Creative” denotes an emphasis on ideas, innovation, and
problem-solving. We cannot stick only to “business as usual” as we try
to effect improvements – we need bold ideas and an openness to
solutions from people in all walks of life.

“Citizens” remains as before, to show that CCC encompasses and
welcomes all New Brunswickers, whatever their region, language, or
political stances.

President of the Board Daryl Branscombe said of the name change, “We
are endeavoring to create a paradigm shift of the way we do business.
Governments can’t do it alone. Public consultation must be the third
leg of the stool.”

The new name is the first step as CCC kicks off its first-ever capital
campaign, in an effort to build upon the work the group has already
accomplished over the past several years. More information about CCC

to be Doctor of Letters

In Shakespeare's play King John, he notes that "Strong reasons make
strong actions". In many respects, this literary observation sums up
much that underlies Daryl Branscombe's success as a business
visionary, property developer, socially-conscious public volunteer,
and community leader.

Born and raised in Chipman, New Brunswick, Daryl Branscombe graduated
from Chipman Regional High School, the New Brunswick Institute of
Technology in Moncton, and the University of New Brunswick (where he
earned a Bachelor's degree in Teaching). Having taught in Chipman,
Saint John and Summerside, PEI, he turned in the mid 1970s to a career
in business. Beginning with co-owning and managing a hardware store in
Summerside, PEI, he had moved to Fredericton by the late 1970s where
he variously became leasing manager for Ross Ventures; founding
director of the Fredericton Downtown Development Corporation; the
developer of a brokerage division of Greenarm Commercial Realty Inc.;
and eventually, through his own company, Dad's Enterprises N.B., the
owner and developer of commercial and residential property throughout
the province. The first president of the Business New Brunswick
Association, his effective influence can be traced in the evolution of
Carleton Place in downtown Fredericton, in the visionary planning of
the Knowledge Park as an information technology cluster in
Fredericton, and in the development of the TD Centre in Saint John.

A major turning point in the life of Daryl Branscombe came with the
heartbreaking death of his sons from a rare autoimmune disease while
they were still in their early twenties. In Walking With a Limp, the
autobiographical book dedicated to his sons and published after their
deaths, Daryl Branscombe explores the impact of such a tragedy on
one's life, at the same time developing a message of healing and
social outreach to others in grief that has proven inspirational to a
wide range of readers. This moving "coming to terms with loss" has
included Branscombe's establishing two memorial scholarships at UNB,
one the Michael Christian Branscombe Memorial Scholarship for
Fredericton campus students in the Faculty of Science majoring in
Biology (especially favouring students whose career plans have the
potential to ease human suffering), and the other the Anthony Watson
Branscombe Memorial Scholarship for students on the Fredericton campus
who have completed at least first year in the Bachelor of Arts
programme and have indicated interest in a major or honours in
English, particularly in creative writing. An annual Branscombe Golf
Tournament, now in its 15th year, adds to the endowment of the
scholarships and helps to perpetuate the memory of the two Branscombe
boys.

Daryl Branscombe's personal experience of death and loss--as well as
his history as a successful community volunteer, developer, and
businessman--inevitably drew him into roles as President of
Fredericton Hospice Inc. and as Chair of the Fredericton Hospice
Fundraising Campaign. Noting in a news release on the Hospice
Fredericton initiative that by 2036 twenty-five per cent of the local
New Brunswick population will be senior citizens, Branscombe
articulated at the beginning of the hospice campaign Fredericton's
need "to have infrastructure in place to deliver the most effective,
most compassionate care that we can for both patients and their
families." Overseeing successful funding approaches to government,
business, and the private sector while chairing the Hospice Palliative
Care capital campaign, Branscombe (and his committee) raised millions
of dollars to convert the former Rosary Hall in downtown Fredericton
into a peaceful palliative-care site for end-of-life patients
surrounded by caring friends and families.

throughout his career, Daryl Branscombe has consistently demonstrated
qualities of both dynamic corporate leadership and compassionate
caring for his fellow citizens. It is with pleasure that the
University of New Brunswick now bestows upon him an Honorary Doctor of
Letters, honoris causa.
