Fired Horizon CEO's grievance decision offers behind-the-scenes glimpse of health changes
Dr. John Dornan testified he 'became very much aware of the potentially precarious nature of [his] job'
Dr. John Dornan won his unjust dismissal case against the province earlier this week.
Adjudicator George Filliter accepted Dornan was fired four months into his five-year contract in a "public, disingenuous and callous manner" and awarded him about $2 million.
Premier Blaine Higgs announced Dornan's firing during a news conference July 15, following the death of a Fredericton patient in the waiting room of the Dr. Everett Chalmers Regional Hospital's emergency department.
'Potentially precarious nature of job'
According to the decision, Dornan "became very much aware of the potentially precarious nature of [his] job" while he was still working as the interim CEO.
He testified at the adjudication hearing that at one point during those seven months, he was "encouraged to consider" ending the obstetric and gynecological services at the Upper River Valley Hospital in Waterville.
The decision does not indicate who encouraged him. Dornan declined Friday to provide any additional information.
But according to his undisputed testimony, he "considered this option and because it was in line with previous plans, he made the decision to cancel these services and made an announcement accordingly," the decision says.
Higgs told him he had been 'thrown under the bus'
The next day, he was told by the Horizon board to reverse his announcement, and "later he received a call from the Premier in which the grievor was told during this conversation that he had been 'thrown under the bus,'" it says.
The province did not cross-examine Dornan during the adjudication hearing, leaving his testimony unchallenged.
Heidi Liston, the deputy health minister at the time, testified at the hearing. Former health minister Dorothy Shephard also testified briefly, but the parties agreed she "was not able to offer relevant evidence" about Dornan's case.
There is no other information about the Upper River Valley obstetrics in the 34-page decision.
Shortage of nurses, doctors cited
On Nov. 5, 2021, Horizon warned expectant mothers in the Waterville area to plan on delivering their babies at the Dr. Everett Chalmers Hospital in Fredericton, which is about 100 kilometres away.
The Upper River Valley Hospital was facing a shortage of nurses and doctors amid a pressing need to care for COVID-19 patients, it said in the Friday evening news release.
"Persistent, temporary closures of the Labour and Birth service at Horizon's URVH due to nursing and physician shortages and to care for COVID-19 patients have created uncertainties for obstetrics patients and their care teams," the news release said.
Horizon was "implementing a long-term solution to ensure expectant mothers from the Upper River Valley area [had] access to reliable, safe and quality care during labour and birth."
That solution, it said, was to transition labour and birth services from Waterville to Fredericton.

"This is the safest alternative for their care and that of their baby and will provide stability and certainty around where they will be delivering."
Horizon did not say how long the diversion would last, but Woodstock Mayor Arthur Slipp said area residents were "very, very concerned" it might close permanently.
The next day, Horizon issued another news release.
"Further to yesterday's statement, Horizon Health Network will continue to provide labour and birth services at Horizon's Upper River Valley Hospital (URVH) in Waterville."
No one from Horizon was available at the time to explain the flip-flop.
Horizon CEO fired by Higgs feels vindicated but still 'in the dark' after $2M labour board decision

Seven months after New Brunswick Premier Blaine Higgs fired Dr. John Dornan, the former president and CEO of Horizon Health Network, says he feels vindicated by a labour board decision, but still "in the dark" about what happened.
"I think that my employer, Premier Higgs, would be the only one that knows that. And aside from a press release, he has not shared that with me," Dornan told CBC Thursday during a telephone interview from his Saint John-area home.
It's the first time he has spoken publicly about the incident.
Dornan broke his silence after he won his unjust dismissal case against the province.
A labour board adjudicator awarded Dornan about $2 million, which his lawyers say is the largest employment compensation award in the province's history. It includes $200,000 in aggravated damages.
"I accept the position of the grievor that his dismissal was done in a 'public, disingenuous and callous manner,'" the adjudicator wrote in his 34-page decision.
Was about to get haircut for news conference
Higgs announced Dornan's termination during a news conference July 15 in a major shakeup of New Brunswick's health-care leadership. Dornan had served only four months of his five-year contract.
Higgs also replaced Dorothy Shephard as health minister and removed the boards of both Horizon and Vitalité, New Brunswick's two health authorities, citing a growing health-care crisis that included the "traumatizing" death of a Fredericton patient July 12 in the waiting room of the Dr. Everett Chalmers Regional Hospital's emergency department.
Although some people have suggested Dornan was made a "political scapegoat," he said he doesn't know if that's true.
He does know "it happened very abruptly" — during a phone call that lasted less than a minute.
The evidence of the grievor was that the new Minister of Health said that the 'CEO serves at the pleasure of the Minister' and 'you are no longer employed.'

When Higgs called, Dornan was in his parked car, about to get his hair cut for the Fredericton news conference Higgs had invited him and the head of Vitalité Health Network to attend the night before, following a meeting about the ER patient's death.
He said Higgs informed him Bruce Fitch had replaced Shephard as health minister. Then Fitch got on the phone, according to the arbitrator's decision.
"The evidence of the grievor was that the new Minister of Health said that the 'CEO serves at the pleasure of the Minister' and 'you are no longer employed,'" the decision states.
Had received 'good feedback'
Dornan, who previously served as the interim president and CEO of Horizon for about seven months, was "shocked."
Up to that point, he had received "good feedback" from the minister of health and "other people" he had worked with, he said.
"I felt that I was on a positive track. I had initiated many changes in Horizon and was planning on initiating other changes that I thought would help New Brunswickers."
He cites as examples increasing the number of "capable" managers and divvying up some "heavy" portfolios, "better managing" physicians and nurses by being "more respectful," and switching to Horizon-wide programs for surgery, psychiatry and emergency services.
Had plan to address shortage of primary caregivers
In addition, Dornan said he had a plan to address the province's shortage of primary health-care providers, by bringing organizations together to facilitate collaborative care team models.
As it stands, Horizon doesn't control the rules around a collaborative practice or the funds associated with that, the New Brunswick Medical Society doesn't control who is accepted and credentialed into primary care in the province, and the Nurses Association of New Brunswick deals almost exclusively with the nursing part, according to Dornan.
"My plan moving forward was to bring together people that could make decisions to say, 'Here are the new rules governing credentialing and payment and collaboration amongst primary care people.'"

Instead, without any warning, and without any constructive criticism of any possible shortcomings, or any opportunity to to improve, he was fired during that brief phone call, he said.
"I acknowledged that I had been terminated and there was no other conversation after that."
According to the arbitrator's decision, Dornan was also advised during the call he would receive one year's salary in lieu of notice.
Higgs told reporters Thursday he was awaiting legal advice on the arbitrator's decision, but said he stands by decisions he made at the time, pointing to what he described as improvements in the health-care system.
'Difficult to get my head around'
The days and weeks after the firing were "difficult," said Dornan.
He had to relay the news to his wife and family, friends and colleagues, and said he had no reason to give them.
He felt he had done a "good job for health care" during his 35-year career and has received "many accolades."
"So it was difficult to get my head around."
Dornan said he had initiated many changes during his short stint at the helm of Horizon, one of New Brunswick's two health authorities, and had plans for more when he was terminated. (S_L/Shutterstock)
Dornan, 63, decided to seek legal advice because he believed he had been terminated inappropriately and that his reputation had been ruined. He filed his grievance with the labour board within days.
He tried to look for other work. He had given up his role as regional chief of staff for Horizon in Saint John and reduced his endocrinology practice to one day a week when he became the president and CEO and those positions were already filled, he said.
Not having any luck locally, he interviewed for positions in other provinces. Those always seemed to start out "quite well," but fell through, he said.
Local reputation affected national employability
"Headhunters indicated that when they had spoken to people in New Brunswick, that I did not receive a positive reference," said Dornan, unable to say to whom they had spoken.
"I became aware that my reputation locally influenced my employability nationally."
Dornan said he has since asked if Horizon would consider allowing him to increase his clinical time with endocrinology patients and "they have indicated that that's a possibility.
"So I'm looking forward to a clinical practice — really what I was doing when I started in New Brunswick," he said.
"I'm glad to be back at work doing what I was trained to do as a physician and I have lots of energy and years ahead of me and I'm looking forward to that."
He admits he "would love to be leading" some of the changes in the health-care system, such as facilitating getting more primary caregivers into collaborative care team models.
But "health care in New Brunswick is not dependent on one person," he stressed.
"I think people that are in positions of authority and power could do this and, you know, I'm hopeful that over time, they will."

Meanwhile, opposition leaders say Higgs's lack of appreciation for the consequences of his actions has cost taxpayers money they can't afford.
On Wednesday, Dr. John Dornan, who served as president and CEO of Horizon for only four months, won his unjust dismissal case against the province.
Labour board adjudicator George Filliter awarded him special damages of about $1.8 million — the amount Dornan would have earned if he had completed his five-year contract, plus $200,000 in aggravated damages.
"I haven't heard the report from the legal side yet of next steps," Higgs said Thursday.
"I guess the only point I would make to that is we've recently — and we're continuing to see — improvements in the health-care system."
Dismissal done in 'public, disingenuous and callous manner'
Higgs announced Dornan's firing at a news conference July 15, citing a growing health-care crisis that included the "traumatizing" death of a patient July 12 in the waiting room of the Dr. Everett Chalmers Regional Hospital's emergency department. He also announced he was dropping Dorothy Shephard as health minister and removing the boards of both Horizon and Vitalité.
"When I made decisions back in July, it was to bring a sense of urgency into the health-care system that, you know, we have a crisis all across the country and we need to find a streamlined way to make it happen," he told reporters Thursday during an unrelated news conference in Fredericton.

"If I had to go back in July, I would be doing the same thing."
When asked to clarify, given the adjudicator's decision to accept Dornan's position that his dismissal "was done in a 'public, disingenuous and callous manner,'" Higgs said he "wasn't talking about what the adjudicator said, and whether that was right or wrong. I was referring to the overall situation and the changes that were made."
Consequences to 'throwing people under the bus'
In a statement, Susan Holt, leader of the New Brunswick Liberals, said, "There are consequences to disrespecting your team, dismissing employees like it's no big deal and throwing people under the bus.
"The Premier's lack of appreciation for the consequences of his actions has just cost the people of [New Brunswick] more than $2 million," she wrote.
Green Party Leader David Coon said "that's exactly what happens when a premier or any leader makes poor decisions."
Dornan, he said, took on the position of president and CEO because he "wanted to make a difference in the health care for New Brunswickers.
"He really was looking at how to transform the system to better serve people of this province and for his troubles, he got fired."
Coon contends Higgs "responded irrationally" to the death of the patient in the ER waiting room.
"When he gets riled, the premier has the tendency to shoot from the hip and that's never a good plan," he said.
2nd high-profile dispute with a doctor
This is the second high-profile dispute Higgs has been involved in.
A former Campbellton doctor who says he faced racism and threats after he was accused in 2020 of breaking COVID-19 rules by failing to isolate and of being the source of a deadly outbreak is suing the province, the RCMP and Facebook.
Dr. Jean-Robert Ngola, 52, filed the lawsuit in January 2022.
During a May 27, 2020, news conference, Higgs said a medical professional in their 50s had travelled to Quebec for personal reasons, "was not forthcoming about their reasons for travel upon returning to New Brunswick and they did not self-isolate as a result."
Higgs never referred to Ngola by name, but blamed what was then a cluster of COVID-19 cases in the Campbellton region and a resurgence of the coronavirus in the province on the "irresponsible individual" who returned to work at the Campbellton Regional Hospital and treated patients for two weeks.

Asked Thursday if he's concerned his comments in the two cases could affect the province's ability to recruit much-needed physicians, Higgs said he always strives to do what's best for New Brunswickers.
"Let's put aside the personalities and the personal conflicts and say, 'How do we deliver better results?' I just stick with that principle and so it does involve sometimes some tough discussions."
Pressed for specifics of how the sudden firing of Dornan helped health care when it appears many of Horizon's successes since then were already underway under Dornan, Higgs said there have been programs "under study, under review, coming soon," being looked at or thought about for years.
"There's a sense of urgency now more so than ever to make sure that these projects get across the line," he said. "What we're trying to achieve is the results that people can feel."
He cited a 70 per cent reduction in wait times for cataract surgery in Bathurst and the number of New Brunswickers without access to primary care being reduced to 55,000 from 75,000 as examples.

No public debate disappoints mayoral candidate
James Risdon disappointed in incumbent Bathurst mayor's decision
The mayoral race in Bathurst is beginning to heat up, but there will be no public debates between the only two candidates.
Incumbent Mayor Stephen Brunet has declined a request for a public debate, a decision his challenger James Risdon calls "a sad day for democracy."
This is the second time Risdon has run for mayor of Bathurst.
"I wanted to get the mayor, to step forward with me, and in a public debate tell people what it is we're going to do. What we stand for," Risdon said.
Brunet said he's never participated in one before and wants to stick with the campaign style he's used to doing.
He also said debates are best left to university clubs.
Risdon disagreed. "In my mind, I'm very disappointed that the mayor would try to dismiss this and make it seem like it's not important. Certainly for me, if it's good enough for our prime minister, and it's good enough for our national leaders, it's certainly good enough for me as a candidate."
Many voters in Bathurst would like to know more about their candidates, and some feel a debate would have helped.
"I don't find it's right. Because they want to hear about what both sides have to say about it," said Gulie Guignard. "So I really think he should have stepped up and represented himself more than just turn himself down."
"I would be interested to see if they'll have a public forum even without his participation. Because I think it's also a value," said Dayna Debenedet. "We're not just voting for the mayor, we're voting for counsellors as well. So I think there's still a value even if some candidates aren't comfortable with the process."
"Oh. I think there should be a debate. We know Stephen … he's well liked and everything. But I'd still like to hear what the other fella has to say. That's the only way you can decide on something," said Raymond Stever.
Brunet declined comment to CBC News, saying he's already said everything he needs to about debating.

Continued improvements in the healthcare system? But still no continuous glucose monitors for insulin-dependent diabetics over the age of 25 -- a simple device that can reduce severe complications and save many lives. Higgs has full medical insurance paid for by taxpayers. He doesn't care about those who suffer because they can't adequately monitor their blood glucose levels to even know how much insulin to take from one meal to another. Now $2 million has gone down the drain. That alone would have provided all insulin-dependent diabetics with the resources they need. I don't know how this man can sleep at night.

Fired Horizon CEO awarded record-breaking $2M in unjust dismissal case against province
Dr. John Dornan was publicly fired by Premier Blaine Higgs in July after death of patient in ER waiting room
The former head of Horizon Health Network has been awarded more than $2 million in his unjust dismissal case against the province after he was publicly fired by the premier last summer following the death of a patient in a Fredericton emergency department waiting room.
Dr. John Dornan's lawyers say it's the largest employment compensation award in the province's history and accurately reflects the losses suffered by their client.
It includes about $385,000 a year for the balance of his five-year contract, plus $200,000 in aggravated damages, which is unprecedented under the Public Service Labour Relations Act, according to his lawyers.
No punitive damages or costs were awarded in the decision the adjudicator issued Wednesday.
Dornan served as president and CEO of Horizon for only four months when Premier Blaine Higgs announced his termination during a news conference July 15 in a major shakeup of New Brunswick's health-care leadership.
"If we don't get better management results in our hospitals, we won't get better health care," Higgs said at the time.
Grievance not just about money
Dornan's grievance wasn't just about the money, said his Toronto-based lawyer Howard Levitt.
"What he was interested in … was reputation protection and vindication," Levitt said in an interview.
Dornan, who had served as interim Horizon president and CEO for about seven months, agreed to take on the role permanently to serve the public and to advance health care in New Brunswick — and took a pay cut to do so, Levitt said.
He gave up his previous positions as regional chief of staff and internal medicine specialist at the Saint John Regional Hospital.
"And then he had his reputation essentially assailed by the government for something he had nothing to do with," Levitt said.

During the news conference, when Higgs also dropped Dorothy Shephard as health minister and removed the boards of both Horizon and Vitalité, he cited a growing health-care crisis that included the "traumatizing" death of a patient July 12 in the waiting room of the Dr. Everett Chalmers Regional Hospital's emergency department.
Witness John Staples told CBC News the man, a senior, had been waiting alone in a wheelchair, in visible discomfort, for hours when he appeared to fall asleep. It was only during a routine check of people in the waiting room that a hospital employee realized the man had stopped breathing, he said.
Levitt alleged that Higgs's comments made "it look as if somehow, John Dornan, who of course had nothing to do with what happened in those few hours in that hospital ward, four months after taking the job permanently, was somehow responsible.
"That was the impression given, in any event."

Adjudicator George Filliter found Dornan "had nothing to do with it at all," according to Levitt.
"I think what we now know, in very explicit, clear terms, is that problems in our health-care system, and problems in our emergency rooms, are not isolated," said Dornan's other lawyer, Saint John-based Kelly VanBuskirk.
"Those are unfortunately much more frequent than anyone had hoped, and certainly have been repeated since Dr. Dornan's departure," VanBuskirk said when interviewed with Levitt.
35-year reputation ruined within 40 minutes
Still, in the span of a 40-minute news conference, the reputation of Dornan, an endocrinologist and internal medicine specialist, who has practised medicine in New Brunswick for 35 years, was ruined, his lawyers argue.
In the aftermath, Dornan was interviewed twice for a similar job in another province, but negotiations suddenly ended "because they heard from New Brunswick some negative commentary about the circumstances of his termination," Levitt said.
That's why the adjudicator took the unprecedented step of not only awarding aggravated damages, but such a high amount, he said.
He "looked at all the facts and said [the province] really muddied [Dornan's] reputation when he's a guy who's operated with pure integrity, and was untouched in cross-examination of the case, acted in good faith, and was badly treated," Levitt said.
Dornan did not immediately respond to a request for comment.
Province is reviewing the decision
CBC has also requested a comment from the Premier's Office.
The province is "aware of the decision," said Department of Health spokesperson Adam Bowie.
"We are reviewing it and have no other comment," he said in an emailed statement.

The province could seek a judicial review of the decision, but Levitt contends it's unlikely.
"The test for judicial review [is] you have to show no reasonable adjudicator could have come to this decision," he said. "It's an extraordinarily hard test."
Verbal agreement overrides later contract
The province had Dornan sign a contract after he had already accepted the job and started working that stipulated he could be terminated with one year's pay. The adjudicator found this was unenforceable.
Dornan agreed to sign it, according to Levitt, because he had already given up his previous positions and arranged replacements for himself.
"And he thought, 'Well, geez, what am I going to do now? I've taken this job, I can't go back to my old jobs. If I don't sign this contract, I'll have nothing.'"
The government had argued if Dornan signed it, he was bound by it.

But the adjudicator found Dornan wasn't asked to get independent legal advice, and the contract didn't override the verbal five-year agreement he already had since he received nothing in return for the punitive one-year termination provision.
The arbitrator reached his decision following a Saint John hearing held Dec. 20-21 and written arguments that extended into February.
Dornan filed his grievance within 25 days of termination, as required under the act that governs relationships between the New Brunswick government and government employees.
Pushed for tighter COVID rules leading up to firing
Just days before his ouster, Dornan had pushed to move the province's hospitals back to the "red phase" of COVID-19 measures, an internal email obtained by CBC News revealed.
"A seventh COVID wave is amongst us," with hospitalizations and staff outbreaks increasing, he wrote on July 11.
A Horizon infectious disease and infection protection control committee was "recommending moving to Hospital Red phase next week if numbers continue to deteriorate," according to the email.
Dornan wrote that officials "could make that call collectively on Monday or Tuesday next week," referring to July 18 and 19.
He was fired on July 15, and the move to the red phase never happened, even though the numbers did continue to deteriorate.
In a COVID update July 19, Horizon and Vitalité reported an increase in COVID hospital admissions, active hospitalizations, hospital outbreaks and staff infections between July 10 and July 16.
Three days after his email, and one day before his firing, Dornan encouraged Horizon staff to "consider showing an example" by masking in indoor public spaces because of "escalating" COVID-19 transmission, an internal memo obtained by CBC said.
Masking has not been required in New Brunswick since March 14, when all COVID-19 restrictions were lifted.
Dornan's firing was "not related" to the July 14 memo, a Department of Health spokesperson told CBC on July 18.
When Dornan was appointed president and CEO last March, then-health minister Shephard noted he had held "several positions in leadership, educational and front-line activities."
"His skills, abilities and competencies will ensure the Horizon Health Network will continue to deliver high-quality health-care services to residents," she said in a statement at the time.

The Gallant government has introduced legislation to merge several
legislative watchdog positions into a single job and has chosen a
retired judge to take on the newly expanded role.
Alexandre Deschênes
Alexandre Deschênes, a retired New Brunswick Court of Appeal justice,
is to be the first integrity commissioner in New Brunswick.
Retired New Brunswick Court of Appeal justice Alexandre Deschênes will
become the province's first integrity commissioner, an appointment
supported by the opposition Progressive Conservatives and Green Party
Leader David Coon.
Premier Brian Gallant introduced a bill Wednesday to create the position.
For now, Deschênes fills the vacant position of conflict-of-interest
commissioner and will also oversee legislation governing the privacy
of personal health records.
Next July, Deschênes will add responsibility for the lobbyist registry
to his duties.
The Liberals say they will proclaim legislation to set up the registry
by next July. The law was passed by the previous PC government in 2014
but not enacted.

The distinction of Queen’s Counsel is conferred upon experienced
lawyers in recognition of their commitment to the principles of the
legal profession and contributions to their communities. Eligible
lawyers include those who have been members of the Law Society of New
Brunswick and have been engaged in the active practice of law in the
province for at least 15 years with extensive experience before the
courts or have demonstrated exceptional service to the profession.
In the fall of this year, a committee consisting of the Chief Justice
of New Brunswick, J. Ernest Drapeau, the Attorney General of New
Brunswick and the President of the Law Society of New Brunswick, will
consider candidates for the next Queen’s Counsel appointments.
The distinction of Queen’s Counsel is conferred upon experienced
lawyers in recognition of their commitment to the principles of the
legal profession and contributions to their communities. The criteria
for these appointments are:
A regular member of the Law Society of New Brunswick who:
a) has been engaged in the active practice of law in the Province of
New Brunswick for at least fifteen years, with extensive experience
before the courts;
b) in the opinion of the Committee, merits the appointment by reason
of exceptional service to the legal profession.
It should be noted that past practice indicates that Queen’s Counsel
appointments typically have more than seventeen years at the Bar.
The Law Society encourages members to forward a letter and a resume in
order to be considered as a candidate for a Queen’s Counsel
appointment. Persons may either apply personally or may nominate a
member of the Law Society. All applicants will be treated equally by
the Committee whether they are nominated, or whether they apply
personally.
In your letter, you may wish to identify two individuals, either
within or outside the Law Society who might provide additional
information to assist the Committee in considering this matter. If
letters of reference are provided, they may be identified for this
purpose.
Your application or nomination should be received by Chief Justice J.
Ernest Drapeau no later than Friday, June 24, 2016, at 4:00 p.m.

A Progressive Conservative MLA has taken the unusual step of naming
names — including that of a sitting provincial court judge — in his
attack on a proposed law on how Court of Queen's Bench judges are
transferred.
Kirk MacDonald told the legislature last week that he believes the
government bill was drafted to help the spouse and the brother-in-law
of federal Liberal MP Dominic LeBlanc, a close ally of Premier Brian
Gallant.

"I will give you two names. I will give you Jolène Richard and André
Richard, two people I believe are looking for judicial appointments
here in New Brunswick," MacDonald said during second-reading debate on
the bill.
In fact, Jolène Richard is already a provincial court judge. André
Richard is her brother and a senior lawyer at Stewart McKelvey.
Province names new judge, wife of MP Dominic LeBlanc
"Dominic LeBlanc has some judges that he wants to appoint in New
Brunswick, and the framework as it currently exists does not allow for
that to happen," MacDonald said.
André Richard stated Thursday he "had no involvement in the
government's decision to propose changes to the Judicature Act."
"As you know, my sister is already a judge who sits in Moncton. I fail
to understand why our names are being brought into this debate."
Bill gives veto to minister
The Liberal bill would amend the Judicature Act, which governs how
courts operate, to give the justice minister a veto over Chief Justice
David Smith of the Court of Queen's Bench transferring judges from one
court to another.

PC MLAs have hinted in the past about who they believe the bill was
designed to help. But until now, no one was willing to name them.
It's rare for politicians to draw sitting judges into partisan
debates, and the veteran Tory MLA did not offer any evidence to back
up his allegations. He turned down a request to explain his views in
an interview.
Parliamentary privilege
Parliamentary privilege protects members of the legislature from being
sued for defamation or held in contempt of court for comments they
make during proceedings. No such protection exists for things they say
outside the legislature.
Provincial court judges such as Richard are appointed by the province,
but Court of Queen's Bench justices are named by Ottawa. Both courts
are administered by the province, but the current law gives Smith the
power to move judges on his court on his own.
Smith has argued the bill would threaten the independence of the
courts, which could make it unconstitutional.
Bill brought back
The Liberals introduced the bill during the last session, but it
didn't pass before the session ended. They brought it back last week.
Justice Minister Denis Landry said last week the bill was designed to
bring "best practices" to court administration and end the pattern of
justices being named to smaller courthouses and then being transferred
soon after.

"This is what we want to correct," he said. "If we name a judge, they
should reside there, for a long period of time, not just two or three
months then move them where they want to go."
Asked whether he'd veto such a transfer, Landry said, "This is what we'll see."
Landry's department said Thursday it would not comment on MacDonald's
accusation.
Larger locations favoured
MacDonald said during last week's debate that it's true Court of
Queen's Bench justices are often appointed to smaller locations and
are then moved to one of the three largest cities.

He said that court postings in Moncton, Fredericton, and Saint John
are "The positions that everyone seems to want."
And he said the current system for moving judges, "which is controlled
by the chief justice, does not work for Dominic LeBlanc and the
Liberal Party of New Brunswick," MacDonald said.

In June, Smith transferred Justice Tracey DeWare from Woodstock to

DeWare was moved to fill a vacancy after Justice Brigitte Robichaud
switched to supernumerary, or part-time, status.
Jolène Richard did not respond to interview requests.

Little David Amos’ “True History Of War” Canadian Airstrikes And
Stupid Justin Trudeau
Canada’s and Canadians free ride is over. Canada can no longer hide
behind Amerka’s and NATO’s skirts.
When I was still in Canadian Forces then Prime Minister Jean Chretien
actually committed the Canadian Army to deploy in the second campaign
in Iraq, the Coalition of the Willing. This was against or contrary to
the wisdom or advice of those of us Canadian officers that were
involved in the initial planning phases of that operation. There were
significant concern in our planning cell, and NDHQ about of the dearth
of concern for operational guidance, direction, and forces for
operations after the initial occupation of Iraq. At the “last minute”
Prime Minister Chretien and the Liberal government changed its mind.
The Canadian government told our amerkan cousins that we would not
deploy combat troops for the Iraq campaign, but would deploy a
Canadian Battle Group to Afghanistan, enabling our amerkan cousins to
redeploy troops from there to Iraq. The PMO’s thinking that it was
less costly to deploy Canadian Forces to Afghanistan than Iraq. But
alas no one seems to remind the Liberals of Prime Minister Chretien’s
then grossly incorrect assumption. Notwithstanding Jean Chretien’s
incompetence and stupidity, the Canadian Army was heroic,
professional, punched well above it’s weight, and the PPCLI Battle
Group, is credited with “saving Afghanistan” during the Panjway
campaign of 2006.
What Justin Trudeau and the Liberals don’t tell you now, is that then
Liberal Prime Minister Jean Chretien committed, and deployed the
Canadian army to Canada’s longest “war” without the advice, consent,
support, or vote of the Canadian Parliament.
What David Amos and the rest of the ignorant, uneducated, and babbling
chattering classes are too addled to understand is the deployment of
less than 75 special operations troops, and what is known by planners
as a “six pac cell” of fighter aircraft is NOT the same as a
deployment of a Battle Group, nor a “war” make.
The Canadian Government or The Crown unlike our amerkan cousins have
the “constitutional authority” to commit the Canadian nation to war.
That has been recently clearly articulated to the Canadian public by
constitutional scholar Phillippe Legasse. What Parliament can do is
remove “confidence” in The Crown’s Government in a “vote of
non-confidence.” That could not happen to the Chretien Government
regarding deployment to Afghanistan, and it won’t happen in this
instance with the conservative majority in The Commons regarding a
limited Canadian deployment to the Middle East.
President George Bush was quite correct after 911 and the terror
attacks in New York; that the Taliban “occupied” and “failed state”
Afghanistan was the source of logistical support, command and control,
and training for the Al Quaeda war of terror against the world. The
initial defeat, and removal from control of Afghanistan was vital and
essential for the security and tranquility of the developed world. An
ISIS “caliphate,” in the Middle East, no matter how small, is a clear
and present danger to the entire world. This “occupied state,”
or“failed state” will prosecute an unending Islamic inspired war of
terror against not only the “western world,” but Arab states
“moderate” or not, as well. The security, safety, and tranquility of
Canada and Canadians are just at risk now with the emergence of an
ISIS“caliphate” no matter how large or small, as it was with the
Taliban and Al Quaeda “marriage” in Afghanistan.
One of the everlasting “legacies” of the “Trudeau the Elder’s dynasty
was Canada and successive Liberal governments cowering behind the
amerkan’s nuclear and conventional military shield, at the same time
denigrating, insulting them, opposing them, and at the same time
self-aggrandizing ourselves as “peace keepers,” and progenitors of
“world peace.” Canada failed. The United States of Amerka, NATO, the
G7 and or G20 will no longer permit that sort of sanctimonious
behavior from Canada or its government any longer. And Prime Minister
Stephen Harper, Foreign Minister John Baird , and Cabinet are fully
cognizant of that reality. Even if some editorial boards, and pundits
are not.
Justin, Trudeau “the younger” is reprising the time “honoured” liberal
mantra, and tradition of expecting the amerkans or the rest of the
world to do “the heavy lifting.” Justin Trudeau and his “butt buddy”
David Amos are telling Canadians that we can guarantee our security
and safety by expecting other nations to fight for us. That Canada can
and should attempt to guarantee Canadians safety by providing
“humanitarian aid” somewhere, and call a sitting US president a “war
criminal.” This morning Australia announced they too, were sending
tactical aircraft to eliminate the menace of an ISIS “caliphate.”
In one sense Prime Minister Harper is every bit the scoundrel Trudeau
“the elder” and Jean ‘the crook” Chretien was. Just As Trudeau, and
successive Liberal governments delighted in diminishing,
marginalizing, under funding Canadian Forces, and sending Canadian
military men and women to die with inadequate kit and modern
equipment; so too is Prime Minister Stephen Harper. Canada’s F-18s are
antiquated, poorly equipped, and ought to have been replaced five
years ago. But alas, there won’t be single RCAF fighter jock that
won’t go, or won’t want to go, to make Canada safe or safer.
My Grandfather served this country. My father served this country. My
Uncle served this country. And I have served this country. Justin
Trudeau has not served Canada in any way. Thomas Mulcair has not
served this country in any way. Liberals and so called social
democrats haven’t served this country in any way. David Amos, and
other drooling fools have not served this great nation in any way. Yet
these fools are more than prepared to ensure their, our safety to
other nations, and then criticize them for doing so.
Canada must again, now, “do our bit” to guarantee our own security,
and tranquility, but also that of the world. Canada has never before
shirked its responsibility to its citizens and that of the world.
Prime Minister Harper will not permit this country to do so now

"I remember years ago when the debate was on in Canada, about there
being weapons of mass destruction in Iraq. Our American 'friends"
demanded that Canada join into "the Coalition of the Willing. American
"veterans" and sportscasters loudly denounced Canada for NOT buying
into the US policy.
At the time I was serving as a planner at NDHQ and with 24 other of my
colleagues we went to Tampa SOUCOM HQ to be involved in the planning
in the planning stages of the op....and to report to NDHQ, that would
report to the PMO upon the merits of the proposed operation. There was
never at anytime an existing target list of verified sites where there
were deployed WMD.
Coalition assets were more than sufficient for the initial strike and
invasion phase but even at that point in the planning, we were
concerned about the number of "boots on the ground" for the occupation
(and end game) stage of an operation in Iraq. We were also concerned
about the American plans for occupation plans of Iraq because they at
that stage included no contingency for a handing over of civil
authority to a vetted Iraqi government and bureaucracy.
There was no detailed plan for Iraq being "liberated" and returned to
its people...nor a thought to an eventual exit plan. This was contrary
to the lessons of Vietnam but also to current military thought, that
folks like Colin Powell and "Stuffy" Leighton and others elucidated
upon. "What's the mission" how long is the mission, what conditions
are to met before US troop can redeploy? Prime Minister Jean Chretien
and the PMO were even at the very preliminary planning stages wary of
Canadian involvement in an Iraq operation....History would prove them
correct. The political pressure being applied on the PMO from the
George W Bush administration was onerous
American military assets were extremely overstretched, and Canadian
military assets even more so It was proposed by the PMO that Canadian
naval platforms would deploy to assist in naval quarantine operations
in the Gulf and that Canadian army assets would deploy in Afghanistan
thus permitting US army assets to redeploy for an Iraqi
operation....The PMO thought that "compromise would save Canadian
lives and liberal political capital.. and the priority of which
....not necessarily in that order. "

(independent of any Government Department) under the Legislative
Assembly. In accordance with the Child, Youth and Senior Advocate
Act, we conduct independent and confidential reviews and
investigations into complaints received by members of the public. Our
office considers every legitimate complaint, on a case-by-case basis.

contacted the Medicare section of the Department of Health and has
been informed that the last record on file for your Medicare renewal
date is 1992. For that reason, they request that you fill out a

The four Atlantic premiers held their first in-person meeting since
before the pandemic on Monday, where they discussed a regional
approach to health care and other key regional issues.
At the meeting, held in Halifax and chaired by Nova Scotia Premier Tim
Houston, the premiers talked about a unified effort to recruit and
retain health-care professionals and using potential "excesses" to
assist patients in neighbouring provinces.
New Brunswick Premier Blaine Higgs said the four provinces are not in
competition with each other and will be working together to attract
health-care workers to the region.
Higgs also said they discussed how provinces can share existing
resources. For example, if one area has an "excess" of some service,
it could be used by patients from other provinces.
"If we have excess capability and we can utilize that, let's not get
hung up on where it is," Higgs said at a wrap-up briefing with the
media following the Council of Atlantic Premiers meeting.
He said the patient's home province would pay for the service, but the
patient would have to travel to where the service is being offered.
Nova Scotia Premier Tim Houston hosted the first in-person meeting of
the Atlantic premiers since before the pandemic. (Robert Short/CBC)
Houston said all four Atlantic provinces are experiencing similar
challenges when it comes to health care.
"It's safe to say that health care remains top of mind for each of our
provinces and our populations. The shortage of health-care workers is
not exclusive to Atlantic Canada, certainly not exclusive to Nova
Scotia. It's felt everywhere."
Making it easier for health-care workers to travel between provinces
is part of the solution, he said.
Currently, licensing criteria and fees structures are unique to each
province and complicate mobility between provinces.
Making it easier for health-care workers to travel between provinces
means they could "move around and help each other out," Houston said.
"We are one region and there's lots of family ties between them," he
said. "And so those are the opportunities that I'm looking forward
to."
Houston said there was a "high degree of interest in harmonizing that stuff."
Newfoundland Premier Andrew Furey said the ultimate goal would be for
one licensing system for health-care professionals like doctors.

Newfoundland and Labrador Premier Andrew Furey said "one of the
lessons learned from COVID … [is] that health-care mobility is
important."
Furey, who has worked as a doctor around the world, said Canada is
fortunate to have "a robust licensing system that could be applied
blanket-statement to the whole country."
"We are very well trained in Canada," he said. "Once you're licensed
in any jurisdiction, there's no reason to think that you shouldn't be
able to practice medicine somewhere else."
Furey said the "exact model and instrument" still has to be
determined, but that a single entity controlling the licensing of
health-care professionals would be the goal.
Health care was just one of the issues on the agenda. They also
discussed a regional approach to economic recovery, cost of living,
immigration and energy.
Daylight saving time
The premiers also talked about the movement in other areas to
establish daylight saving time year-round.
Prince Edward Island Premier Dennis King said islanders support the
idea of getting rid of the twice-yearly time change — as long as
they're not the only ones doing it.
In the United States, one of the two chambers of Congress passed a
bill that would make daylight time permanent instead of the current
March-through-November schedule.
The U.S. Senate passed the bill last week with support from both
parties. If it becomes law, it would mean an extra hour of daylight in
the evenings year-round.
In Canada, Ontario has a law passed and ready to be implemented if New
York and Quebec do the same.
"I think if that were to happen, we would have to react collectively
here in some way, shape or form," King said on Monday.
"Essentially, we've all sort of decided that this doesn't make sense
for one of us to do this. If we are to proceed with something, it
would be … on a regional basis in response to what might be done in
other places."
Higgs said there's also interest in New Brunswick in eliminating the
twice-yearly time change.
But until other regions make a move, Higgs said, the Atlantic
provinces won't pursue it.

COVID-19 is "not over in hospitals," says the president and CEO of the
Vitalité Health Network.
Dr. France Desrosiers made the comments during an update to the board
of directors Tuesday.
New Brunswick lifted all of its COVID-19 restrictions Monday, but
Vitalité remains at the red alert level due to the number of
hospitalizations and absent health-care workers, Desrosiers said
during the public meeting.
"The number of hospitalizations has remained stable I would say over
the last month. The number of absenteeism is also stable, but it is
still present.
"So as soon as we are able to resume service, we resume it. Sometimes,
we have to revise downwards and we go back up as soon as possible
again."
As of Saturday, the most recent figures available, there were 99
people with COVID-19 hospitalized across both the Vitalité and Horizon
health networks, down from 103 on Friday, including three people aged
19 or under.
Thirteen people required intensive care, down from 14, and seven of
them were on ventilators, unchanged.
Of those in hospital, 46 were admitted for COVID-19, and 53 were
initially admitted for something else when they tested positive for
the virus. Of the 13 in an ICU, 11 are "for COVID" patients.
The seven-day average of COVID-related hospitalizations increased to
98 Saturday, from 96, while the seven-day average of COVID-related ICU
bed occupancies was 13, up from 12.
As of Saturday, 154 Vitalité health-care workers were off isolating

There were 513 health-care workers off Saturday after testing positive
for COVID-19, down from 577. That includes 154 from Vitalité, 300 from
Horizon and 59 from Extra-Mural and Ambulance New Brunswick.
As of last Thursday, another 76 Vitalité health-care workers were
isolating because they had been a close contact of a positive case.
Hospital capacity provincewide was listed at 90 per cent, up from 89
per cent on Friday, while ICU occupancy decreased to 71 per cent, from
77 per cent.
Vitalité and Horizon both announced last week that their hospitals and
health-care facilities would remain at the red level, despite the
province lifting all mandatory measures in the community.
Vitalité is adjusting on a daily basis and services are gradually
resuming, said Desrosiers.
Pandemic-related costs for 2021-22 reach $26M
But she noted the regional health authority recorded an operating
deficit of $24 million for the first nine months of the fiscal year,
largely due to additional expenses related to the pandemic.
Desrosiers highlighted the challenges faced by human resources.
"The network took into account that a significant number of
health-care workers had to be taken off the job due to the virus at
one time or another. The quick and efficient redeployment of resources
has made it possible to provide essential services and to cope with
the rapid increase in the number of hospitalized patients with
COVID-19," she said.
Pandemic-related costs between April 1 and Dec. 31, 2021, totalled
$26.2 million, the board heard.
"Through careful and responsible management of the pandemic's fifth
wave, we have emerged from this crisis with the sense that we did what
needed to be done," Desrosiers said in a statement.

Blood test and radiography services are almost completely restored,
with some backlog to be cleared up.
Surgical services vary "from 75 to 80 per cent" of normal capacity,
depending on the location, said Desrosiers.
"Sometimes there are areas that are 100 per cent, others are 50 per
cent. It really varies on a daily basis," she said.
The province has passed the peak of the Omicron variant, according to
Dr. Jennifer Russell, the province's chief medical officer of health.
"Yes, we do have a continued level of hospitalizations, but we're
managing," she told CBC on Monday.
With the lifting of restrictions, some increases in hospitalizations
and cases are expected, said Russell.
But they won't be overwhelming, she said, citing modelling, which has
not been made public.

Is it me? Am I the only one hearing generalities, but no specifics?
We have to note, just the other day, both Scheer and Trudeau promised
big bucks in transfers for health care. So would it be prudent to
assume "business as usual" in the health care file until the money
fairy stops by? If the money fairy stops by?
We must remember too, you need a referral from a GP (typically your
family doctor) to see a mental health professional. So maybe the first
order of business would be addressing the shortage of GPs?
Whatever rabbit Mr Higgs pulls out of his hat, rebuilding a very
broken system will take time and money.

placed in a mental facility then it was most certainly for just cause.
This is not done randomly. Furthermore, the physicians who attempted
to treat you were certainly paid by Medicare and if you think doctors
remember every single patient and document they may have signed while
on call or otherwise then i would suggest that you treatment was
unsuccessful.

might be prudent to think that is the source of all the new found

the Grim Reaper knocking at my door. Whereas I have no Medicare Card I
paid a doctor to have look at me and he sent me straight to the
emergency room I have there twice this month and have been scheduled

entitled to the same service every other Canadian Citizen receives.

Indeed those suffering from mental health problems need more help so
they can become productive members of society. If someone has a broken
leg, we don't write them off for life, we fix the leg. Why do people
not understand that mental health is the same as any part of the body,
fixable. When placed under immense stress and strain, it too can break
and because it's the hard rive of the body, it's essential we have the
best treatment for it. We also need to ban marijuana and make sure New
Brunswick is a drug free zone so that fewer people end up with mental
health issues that marijuana and other drugs are known to cause, and
so that more money is then available for those who have mental health
issues not self inflicted by drugs. It's an outrage that we are
subsidizing fancy stores for marijuana drug users while mental health
service suffers.

The Restigouche region's only walk-in clinic will not reopen this week
as expected.
The clinic at the St. Joseph Community Health Centre in Dalhousie
closed its doors at the end of January in response to a staffing
shortage. At the time, the Vitalité Health Network said the temporary
closure would only last a month.
But this week, it remained closed with no clear timeline on if or when
the clinic will start taking patients again.
Dalhousie Mayor Normand Pelletier said residents without a primary
care provider or facing long waits for an appointment don't know where
to turn to.
"They're extremely disappointed, they're scared," he said. "They don't
know where they're going to go for medical help in Restigouche County
anymore."
Dalhousie residents demand improved doctor recruitment after
clinic temporarily closes
Residents held a protest last month calling on the health authority to
improve recruitment of health care providers. At the time of the
clinic's closure, only two out of six physician positions were filled
– with one doctor on leave.
The Vitalité Health Network has not announced a new reopening date.
Dalhousie Mayor Normand Pelletier said residents are worried about the
temporary closure of the walk-in clinic at the St. Joseph Community

Spokesperson Thomas Lizotte said all other services at the community
health centre, including a collaborative practice and ambulatory
services, remain available to patients.
"Discussions are still ongoing with the Department of Health to ensure
strategic alignment with the new Health Plan," Thomas wrote in an
email.
There are 4,200 patients with a regular primary care provider at the
collaborative practice.
In an interview last month, Jacques Duclos, vice-president of
community services and mental health, said family physicians found the
workload of the walk-in clinic "unsustainable" because it took away
from the collaborative practice.
He said discussions are focused on rethinking the primary care model,
spurred by the province's new health plan and improvements to virtual
care.

Residents are calling on the Vitalité Health Network to improve
recruitment of doctors and nurses for the Restigouche region. 3:03
Restigouche County has one of the province's oldest populations and is
facing a significant shortage of 13 primary care providers. Without
the clinic, residents have been waiting at the emergency room at the
Campbellton Regional Hospital, or driving an hour south to Bathurst.
Pelletier said town council and the regional service commission have
heard no updates on recruitment since the demonstration. Now, he's
requesting a meeting with Health Minister Dorothy Shepard to ask for
increased control locally.
"Probably we'd be better served under Horizon," he said.
During the pandemic, the clinic had shifted to an appointment-only
model. Patients could no longer just show up and instead needed to
call in to get a spot.

Le premier ministre du Nouveau-Brunswick Blaine Higgs a publiquement
mis au défi le Dr Jean-Robert Ngola en lui demandant de l'autoriser à
révéler des informations privées potentiellement incriminantes. Un
geste qui n’est pas passé inaperçu par l’opposition, mardi.
Le Dr Ngola faisait face, jusqu'à tout récemment, à des accusations
pour avoir enfreint la loi sur les mesures d’urgence durant la
pandémie. Ces accusations ont été abandonnées vendredi.
Blaine Higgs, qui refuse toujours de s’excuser, dit maintenant détenir
des informations possiblement compromettantes, mais qu’il ne peut
divulguer en vertu de la Loi sur la protection de la vie privée.
"J’ai de l’information qui n’a jamais été révélée publiquement",
a-t-il lancé mardi.

L'équipe de défense du Dr Ngola a vivement dénoncé les propos de
Blaine Higgs. Elle se demande à quelles informations il fait
référence.
"Si M. Higgs a d’autres preuves, rien ne l'empêche de nous les envoyer
à nous, les avocats du Dr Jean-Robert Ngola. De cette façon, Dr Ngola
n’aura pas à renoncer à son droit à la vie privée comme le demande M.
Higgs", écrivent dans une déclaration les avocats Christian Michaud et
Joël Étienne.

Ils rappellent que le médecin a fait l'objet de "l’enquête la plus
complète à laquelle un citoyen ait jamais été confronté dans
l'histoire du Nouveau-Brunswick" et qu'il a été entièrement disculpé
vendredi.
"Le premier ministre Higgs a utilisé son titre et son privilège
parlementaire pour attaquer un citoyen racialisé et un homme
innocent", déclarent-ils.
Les avocats ont donné sept jours au premier ministre pour s'excuser à
la suite de l'abandon des accusations. Ils envisagent des actions
supplémentaires s'ils n'en obtiennent pas d'ici la fin de la semaine.

Le député libéral de Moncton-Centre, Rob Mckee, a pour sa part ajouté
qu’il était "inquiétant" que le premier ministre détienne de
l’information personnelle liée au Dr Ngola.
"Ça veut dire qu’il est en possession d’information privée que
seulement le bureau du procureur devrait avoir, en ce qui concerne la
poursuite publique contre le docteur, donc pourquoi est-ce que le
premier ministre est en possession de ces informations", a-t-il
demandé.
