Moncton council confirms it will keep RCMP, votes down public consultation
Tense exchanges mark final vote on policing study launched in 2021
Moncton council on Monday ratified keeping the Codiac Regional RCMP and rejected delaying that decision to consult the public first.
The 6-5 votes came after an hour of at times tense debate that capped a policing review launched in 2021.
The vote tally was the same as when councillors debated the issue Feb. 26 at a committee meeting. Committee votes must be ratified at later council meetings, which led to a resumption of the debate Monday.
Coun. Daniel Bourgeois questioned why fellow council members wouldn't want to hold off on a decision while more information is gathered, including input from the public.
He moved a motion Monday that would have delayed a final decision by holding consultations. He called on councillors to explain their votes. Coun. Marty Kingston — one of six votes — bristled at the questioning.
"I'm a little taken aback that we would all get asked how to explain ourselves on a yay vote," Kingston said, suggesting Bourgeois should re-read the council code of conduct.
It was among a series of tense exchanges among councillors.
Coun. Bryan Butler, one of the five votes, said he still felt council needed more information.
"If six votes vote to say, 'Hey, listen, we don't want no more information, we're satisfied with it,' that's democracy, and I'm happy with that," Butler said. "All I'm saying is, is that we have to give answers to the public."
Coun. Paulette Theriault, one of the six votes, interrupted him as he spoke. They spoke over each other as Butler called out "point of order" repeatedly.
"You know, if you're getting tired, please leave," Butler said to Theriault. "But we're here because this is a very important issue."
Mayor Dawn Arnold spoke, saying Riverview and Dieppe had already voted to stay with Codiac RCMP and were waiting for Moncton's final vote.

The mayor and councillors Theriault, Kingston, Susan Edgett, Monique LeBlanc and Dave Steeves were the six votes to continue with the RCMP without consultations.
Deputy Mayor Shawn Crossman and councillors Bourgeois, Charles Léger, Butler and Paul Richard voted the other way.
Councillors unanimously voted to meet with RCMP leaders, the Codiac Regional Policing Authority board and councils from Dieppe and Riverview to discuss how to improve public safety and implement the policing study recommendations.
The details of when and where that meeting will take place have yet to be determined.
The study by consulting firm Perivale + Taylor released last fall recommended improved data collection, a community feedback process on policing issues and governance improvements at the policing authority.
Policing authority chair Don Moore told reporters the board will work with the municipalities to implement the recommendations this year.
The study was launched by a council vote in 2021 to review policing services in light of rising policing costs, crime and concerns about local control.
The study estimated staying with the RCMP could save $132 million over 15 years compared to launching a new municipal force.

About Pat Bouchard
Pat joined the Mounties in 2002. He had previously worked as a casino dealer, a jail guard and a protection officer for the Royal Canadian Mint. His 18-year RCMP career has been entirely (minus a few secondments) in GD frontline policing. He has served in large Municipal Detachments, small rural towns and in isolated posts above the Arctic circle.
Having been involved in the labor movement prior to joining the RCMP, Pat always believed there were ways to improve employee relations within the RCMP. He had the advantage of joining the RCMP at a time when salaries were competitive. Never shy about speaking his mind, he often spoke out about the issues that affected him and his fellow Members. Throughout the years, those issues grew in magnitude and scope (dwindling pay, resource levels, equipment and training, inconsistent application of policy, lack of policy). Tragedy struck in 2014 and Pat was closely involved in the Moncton shootings. This was the “straw that broke the camel’s back” for him. It was clear that change was needed, and it was not going to come from within the RCMP. Pat was very pleased when he was afforded the opportunity to join the NPF to help the RCMP become the best version of itself.
Key Accomplishments:
- Served as a front-line RCMP Member with the Codiac and Bathurst RCMP, Cpl. Team leader in Taloyoak and Iqaluit Nunavut and finally, OPS/NCO in Blackville, NB.
- During the Moncton labor code trial of the RCMP, Pat was vocal on Member issues and spoke to the media in favor of the Membership. Having lived through the RCMP Moncton shootings of June 2014, this was a personal issue for him.
- Prior to being elected, Pat always had a strong desire to assist Members in obtaining better working conditions. Pat could be found providing advice and assisting Members from all over the Division with all manner of labor relation issues.
- Pat is the Divisional Health and Safety Committee Co-Chair as an elected employee representative to advance Member concerns over Canada Labour Code violations and general workplace safety.
- National Policy Health and Safety Committee member as an elected employee representative to advance Member concerns over Canada Labour Code violations and general workplace safety.
- Joined the NPF in April 2017 after serving on the board of another association; NPF was fully certified in July 2019; Pat was elected Atlantic Region Director in November 2019.
- Pat speaks English and French fluently.
- Part of the NPF’s collective bargaining team, negotiating the first ever collective agreement for RCMP Members.
- Part of the NPF’s Member Services committee.

Moncton council questions whether city actually needs more Mounties
Codiac Regional Policing Authority requesting 4 more RCMP on top of 5 recently added
Moncton councillors are critical of a request to add four more Codiac RCMP officers next year without evidence whether five added this year made a difference.
"Did we get our money's worth?" Coun. Daniel Bourgeois asked Tuesday.
"Because if it hasn't made a difference to have additional members, why would we not try and save a little bit of money for taxpayers?"
Bourgeois posed the question as council debated the city's $212-million operating budget for 2024 and amid ongoing discussions about whether to keep the RCMP or move to a municipal force.

Moncton covers more than two thirds of the Codiac Regional Policing Authority budget.
The authority's proposed 2024 budget is $46.7 million, up by $3.9 million from this year. It is seeking four more officers, to bring the force to 156, and three more civilian staff.
Council was told some of the data sought would be made public at a policing authority board meeting Thursday evening. But, that's hours after Moncton is scheduled to approve its budget.
Bourgeois said it's a lot of money and he would have expected to see data before being asked to approve another increase.
"So we have to go by people's perceptions. My perception, for example, based on what citizens tell me and I'm seeing, it doesn't make a big difference," he said.
Bourgeois made the comments as part of an exchange with Charles Savoie, Moncton's interim general manager of protective services, who said the five officers added this year effectively meant only one more person per shift.
"If you think of the effect on the resolution rate, it might not be as high as expected," Savoie said, referring to the number of crimes officers solve.
Savoie also said the police are busy.
"If there's an issue, people turn to them," Savoie said. "Are they the best people to call? Well, that's not a question because right now they're the only option. They're the only people to call."
Other councillors also questioned the lack of data.
"I had the same concerns I guess related to adding more police officers and then not really having anything concrete to indicate where we are and if we're really making a difference," Coun. Charles Léger, who previously chaired the policing authority board, said.

"At this stage, this is just a wild goose chase right now," Deputy Mayor Shawn Crossman said. "We don't know where this is going to end up. We don't know a true outcome of adding police officers to making Moncton feel safe."
Codiac RCMP polices Moncton, Dieppe and Riverview. Moncton covers 70 per cent of the policing authority budget, while Dieppe pays 18.5 per cent and Riverview covers the remainder.
Riverview councillors questioned whether they had enough information as they considered the town's budget last week.
"Our concern is that they're asking for increases without adequately justifying where that increase will go and the impact of our current investment," Riverview Mayor Andrew LeBlanc said on Facebook about the town's deliberations.
"We agreed that the policing services have shown notable improvement, but the [Codiac Regional Policing Authority] needs to provide better outcome measurement."

Riverview ultimately agreed to proceed, but with a condition that it will withhold releasing the extra money if the policing authority doesn't present the information it wants by the end of January.
"We are prepared to withhold funding," LeBlanc wrote.
In Moncton this week, councillors also questioned the changing number of officers the policing authority says are needed.
Last year, it released a strategic plan calling for 25 more officers this year. The authority said it needed the officers to make the Codiac RCMP an adequate police force.
But then it reduced the request to five for 2023, followed by 10 more in 2024 and 2025. However, that changed again by this fall to four officers next year.
Coun. Bryan Butler pressed policing authority vice-chair Nagesh Jammula whether four would make the police force adequate.
"No," Jammula said, telling councillors that now the Codiac RCMP will prepare an operational plan that will look at how many officers are required. In the meantime, Jammula said four more are needed to keep up with population growth.

Paid board positions and a staff position were recommended as part of a policing study released last month.
The discussion led to a motion, which will be considered Thursday prior to final budget approval, to increase the policing authority budget to hire a staff member.

December 14, 2015)
The Plaintiff seeks an appeal de novo, by way of motion pursuant to
the Federal Courts Rules (SOR/98-106), from an Order made on November
12, 2015, in which Prothonotary Morneau struck the Statement of Claim
in its entirety.
At the outset of the hearing, the Plaintiff brought to my attention a
letter dated September 10, 2004, which he sent to me, in my then
capacity as Past President of the New Brunswick Branch of the Canadian
Bar Association, and the then President of the Branch, Kathleen Quigg,
(now a Justice of the New Brunswick Court of Appeal). In that letter
he stated:
As for your past President, Mr. Bell, may I suggest that you check the
work of Frank McKenna before I sue your entire law firm including you.
You are your brother’s keeper.
Frank McKenna is the former Premier of New Brunswick and a former
colleague of mine at the law firm of McInnes Cooper. In addition to
expressing an intention to sue me, the Plaintiff refers to a number of
people in his Motion Record who he appears to contend may be witnesses
or potential parties to be added. Those individuals who are known to
me personally, include, but are not limited to the former Prime
Minister of Canada, The Right Honourable Stephen Harper; former
Attorney General of Canada and now a Justice of the Manitoba Court of
Queen’s Bench, Vic Toews; former member of Parliament Rob Moore;
former Director of Policing Services, the late Grant Garneau; former
Chief of the Fredericton Police Force, Barry McKnight; former Staff
Sergeant Danny Copp; my former colleagues on the New Brunswick Court
of Appeal, Justices Bradley V. Green and Kathleen Quigg, and, retired
Assistant Commissioner Wayne Lang of the Royal Canadian Mounted
Police.
In the circumstances, given the threat in 2004 to sue me in my
personal capacity and my past and present relationship with many
potential witnesses and/or potential parties to the litigation, I am
of the view there would be a reasonable apprehension of bias should I
hear this motion. See Justice de Grandpré’s dissenting judgment in
Committee for Justice and Liberty et al v National Energy Board et al,
[1978] 1 SCR 369 at p 394 for the applicable test regarding
allegations of bias. In the circumstances, although neither party has
requested I recuse myself, I consider it appropriate that I do so.
AS A RESULT OF MY RECUSAL, THIS COURT ORDERS that the Administrator of
the Court schedule another date for the hearing of the motion. There
is no order as to costs.

is clear on your dead calf issue: Our forensic labs do not process
testing on animals in cases such as yours, they are referred to the
Atlantic Veterinary College in Charlottetown who can provide these
services. If you do not choose to utilize their expertise in this
instance, then that is your decision and nothing more can be done.
As for your other concerns regarding the US Government, false
imprisonment and Federal Court Dates in the US, etc... it is clear
that Federal authorities are aware of your concerns both in Canada
the US. These issues do not fall into the purvue of Detachment
and policing in Petitcodiac, NB.
It was indeed an interesting and informative conversation we had on

Well folks, once again the Sackville RCMP and the Town of Sackville
are partnering up to offer another exciting event during Sackville’s
Winterfest. This time, we’re focussing on exposing our community to
new sports and cultures in the hopes of sparking the interest for new
hobbies and interests. This year, we will be highlighting the
following sports: Powerlifting, Tae Kwon Do, Yoga, Gumbo, Karate,
boxing and more!
These sports are practiced for a variety of reasons: self-defense,
competition, fitness and entertainment as well as mental, physical,
and spiritual development. Having roots as far back as 3400 BC, these
arts come from centuries-old history laced with fascinating cultures,
legends, traditions and rituals. When we come to understand this, the
practice of these sports become much more than sport; it becomes a
rich learning environment where training sessions offer a series of
life lessons that transfer into life far beyond the training room.
The Winterfest Kickoff 2015 will feature exciting demonstrations from
each club. They will also host an information kiosk to talk about the
culture, history and specific organizations. There will be a raffle
with chances to win training equipment and more! With the addition of
free tasty samples from multicultural dishes and various teas, we are
hoping to offer everyone an experience for the senses - one they can
see, hear and taste!
We are hoping that community members of all ages will come together to
help create what will surely be an inspiring and enlightening event.
Let’s bring young and old together to experience culture, history,
discipline, strength, power and respect in unison.

statement. He calls it "a tough pill to swallow."

The Plaintiff seeks an appeal de novo, by way of motion pursuant to
the Federal Courts Rules (SOR/98-106), from an Order made on November
12, 2015, in which Prothonotary Morneau struck the Statement of Claim
in its entirety.
At the outset of the hearing, the Plaintiff brought to my attention a
letter dated September 10, 2004, which he sent to me, in my then
capacity as Past President of the New Brunswick Branch of the Canadian
Bar Association, and the then President of the Branch, Kathleen Quigg,
(now a Justice of the New Brunswick Court of Appeal). In that letter
he stated:
As for your past President, Mr. Bell, may I suggest that you check the
work of Frank McKenna before I sue your entire law firm including you.
You are your brother’s keeper.
Frank McKenna is the former Premier of New Brunswick and a former
colleague of mine at the law firm of McInnes Cooper. In addition to
expressing an intention to sue me, the Plaintiff refers to a number of
people in his Motion Record who he appears to contend may be witnesses
or potential parties to be added. Those individuals who are known to
me personally, include, but are not limited to the former Prime
Minister of Canada, The Right Honourable Stephen Harper; former
Attorney General of Canada and now a Justice of the Manitoba Court of
Queen’s Bench, Vic Toews; former member of Parliament Rob Moore;
former Director of Policing Services, the late Grant Garneau; former
Chief of the Fredericton Police Force, Barry McKnight; former Staff
Sergeant Danny Copp; my former colleagues on the New Brunswick Court
of Appeal, Justices Bradley V. Green and Kathleen Quigg, and, retired
Assistant Commissioner Wayne Lang of the Royal Canadian Mounted
Police.
In the circumstances, given the threat in 2004 to sue me in my
personal capacity and my past and present relationship with many
potential witnesses and/or potential parties to the litigation, I am
of the view there would be a reasonable apprehension of bias should I
hear this motion. See Justice de Grandpré’s dissenting judgment in
Committee for Justice and Liberty et al v National Energy Board et al,
[1978] 1 SCR 369 at p 394 for the applicable test regarding
allegations of bias. In the circumstances, although neither party has
requested I recuse myself, I consider it appropriate that I do so.
AS A RESULT OF MY RECUSAL, THIS COURT ORDERS that the Administrator of
the Court schedule another date for the hearing of the motion. There
is no order as to costs.

is clear on your dead calf issue: Our forensic labs do not process
testing on animals in cases such as yours, they are referred to the
Atlantic Veterinary College in Charlottetown who can provide these
services. If you do not choose to utilize their expertise in this
instance, then that is your decision and nothing more can be done.
As for your other concerns regarding the US Government, false
imprisonment and Federal Court Dates in the US, etc... it is clear
that Federal authorities are aware of your concerns both in Canada
the US. These issues do not fall into the purvue of Detachment
and policing in Petitcodiac, NB.
