In 2010, Nathan Michael Smith enlisted in the U.S. Army. Smith grew up
in a military family and believes that the U.S. military is a force
for good in the world.
Today, 28-year-old Captain Nathan Smith is an intelligence officer
serving in the Kuwait headquarters of the Combined Joint Task Force
that oversees the U.S. and coalition campaign against ISIS. He
believes the mission he is taking part in is morally justified, but he
also believes it is illegal.
Because of that belief, he is suing his own Commander in Chief, U.S.
President Barack Obama, over his failure to secure a new Congressional
authorization to wage war against ISIS in Syria and Iraq.

Counsel to justify the war against ISIS. He has instead left it to

The lawsuit springs from a 2015 article in The Atlantic by Yale law
professor Bruce Ackerman, who argued a soldier would have standing to
challenge the legality of the mission in court. Captain Smith
contacted Ackerman after reading the article, and Ackerman is now
advising his legal challenge.
This is a turning point. If we have a liberated presidency
asserting the Obama precdent...as a foundation for unilateral
war-making [by] what is, after all, by far the most powerful military
power in the world, this is very, very serious.

White House lawyers argue the authorizations for the use of force
against Al-Qaeda and Saddam Hussein in the wake of 9-11 apply to the
current conflict, but Ackerman argues that sets a dangerous precedent
for "open-ending war-making by the Commander-in-Chief." The lawsuit
asks the court to tell President Obama he must secure Congressional
authorization, or end the mission.
Michael Enright spoke to Bruce Ackerman about the lawsuit and the
growing power of the U.S. presidency.
The constitution has this peace commitment, and it wants a
deadlock. It doesn't want the president to go in and say, "There's a
war, and let's do it." He has to convince the American people that
this is necessary.

As far as lawsuits go, you know I have filed and argued two
lawsuits thus far that were very illegally delayed and doctored by the
US Attorney in Beantown until the politicking was just right. Then
they were dismissed after Ashcroft fly to Canada to have a long talk
with Wayne Easter and they struck a dirty backroom deal. Any crooked
lawyer or corrupt politician or even a wise old mechanic will tell you
there is true magic in the timing of things. Get it spot on and
justice may be served sometimes and even an old worn out truck may run
pretty damned good. I sent out the Yankee Sheriffs to serve my
previous two complaints in the USA in August of 2002 so that we could
have oral arguments about motions to dismiss while an important
federal election was going down. The politicaly appointed US Attorney
Mikey J. Sullivan delayed that matter exactly one year and tried hard
to falsely imprison me many times in the time between. Talk of Yankee
lawyer denying his oath before the Bar about lucre or malice EH?
MacKinnon and Arar's crooked lawyers should confirm that
everything is a matter of politcal will. Look at the deal Arar's
lawyers struck with Harper yesterday and then consider the politcal
atmoshere. What I like best about you teasing of me is the personal
challenge to prove who you are and more importantly your poor sense of
timing. Who do you think will figure it out who you are for certain
first? Me or the Feds? more important who do you think cares more
about who you are? I admit that I would like to meet you in person
once again in order to shove you head up your arse, soap or no soap.

was having a rather intersting conversation with Bernie Lord in front
of several witnesses beside the Centenial Building where my father
used to work for many Finance Ministers in the past. Rest assured my
father's ghost was laughing at the nonsense of it all. However my son
is not.
Alas my poor father I knew him well. I have had a thousand times
more fun than he ever did. I have no doubt whatsoever that he is
impressed at how far his wild child had come in his efforts at poking
holes in the stuffed shirts he had to obey. My father toiled in an
ethical fashion for a corrupt government in order to put supper on the
table and keep a roof over our heads. I do the same but against the
public corruption. My father knew me well as well. He knew I would
never follow orders and was far too dumb to know fear yet just clever
enough to do exactly what I wished in my own personal pursuit of
happiness. On his death bed my father admitted he was jealous of my
chosen lifestyle and sometimes wished he had chosen that path as well.
I thanked him for his blessing and for being a very honourable father.
Even though my father and argued tooth and nail most of our lives, he
held a great respect for each other despite it all. My father left
this wonderful old world knowing he had the respect and love of a very
different man whom he had raised as a son and friend. All men should
be so lucky EH?
My father, Max had five sons. I have only one I named him after
my father. I know him well as well I raised him as a Mr. Mom. My son,
Max is more clever than my father and I put together. I made my son my
best friend out of the gate because that is the way it should always

Games Foundation. He has provided his time to several organizations

A former chief executive officer of NB Liquor says Moosehead Breweries
has lobbied hard for special treatment from the corporation, including
measures that may have limited beer choices for customers and cost
taxpayers money.
Daniel Allain was commenting on an internal NB Liquor document from
2013, obtained by CBC News, that lists 22 ways the publicly-owned
corporation favoured Moosehead over competitors Molson, Coors and
Labatt.
The document describes 13 of the measures as "anticompetitive,"
including a limit on store displays for non-Moosehead products, a
price increase on some non-Moosehead beers and the cancellation of a
Budweiser promotion "due to Moosehead concerns."
It says the cost to NB Liquor was $7.1 million.
'Free the beer': Opposition wants Comeau case before Supreme Court
New Brunswick appeals border booze court ruling
Andrew Oland, the chief executive officer of Moosehead Breweries,
disputed the cost estimate in an interview with CBC News, but defended
his company's pursuit of favourable treatment from NB Liquor.
"We aggressively fight tooth and nail for everything we can get from
NB Liquor, the same as we do with every other customer," he said.
'My team is doing exactly what they should be doing in terms of
fighting to sell more and more Moosehead beer.'

for doing that and I can assure you my competitors are doing the exact
same thing."
Beer policy is a hot topic in New Brunswick this spring because of an
April court ruling that said restrictions on how much alcohol people
can buy in Quebec and bring home violate free-trade guarantees in the
1867 Constitution.
The ruling acquitted Gérald Comeau, of Tracadie, who was charged after
bringing 14 cases of beer and three bottles of liquor back from
Quebec.
'Moosehead concessions'
The 2013 cabinet document, labelled "Moosehead concessions," was
leaked anonymously to CBC News. Allain confirmed it is authentic.
"I definitely recognize it," he said. Oland also said he remembers
seeing the three-page document.
Allain wouldn't identify who at NB Liquor prepared the list, which is
labelled "advice to minister."
He said it was "an opinion of an employee that [NB Liquor] favours Moosehead."
Oland said, "I'm not aware of any situation where NB Liquor is giving
a big advantage to Moosehead over any supplier."
He confirmed that Moosehead gets 25 cents per 24-pack more than other
brewers, however, and receives a better price on discount beer than
competitors because of its low-profit margins.
The document also lists examples of NB Liquor restricting some beer
pack sizes because Moosehead's plant in Saint John wasn't equipped to
produce them.
Oland said that "perhaps" Moosehead asked the corporation to restrict
some pack sizes.
"Or, [we were] questioning NB Liquor: 'Why do you need those formats?
What's the real advantage to you or your customers with those
formats?'"

NB Liquor won't comment on document
NB Liquor won't comment on the 2013 document, saying it's out of date
because it's from before Brian Harriman, the current chief executive
officer, took over with a mandate to run the Crown corporation like a
private business.
Mark Barbour, a spokesperson for the corporation, said no special
measures are in place now to favour Moosehead.
"We create a fair playing field for all suppliers," he said.
"All suppliers are treated equally in terms of opportunities to
compete for our customers' business."
He pointed to a "Mix & Match" promotion that lets customers buy two
15-packs of beer from among Moosehead, Molson, and Labatt choices for
$49.99. That shows the three companies are treated equally, he said.
The corporation supplies all breweries with a marketing guide twice a
year that lists what promotions they can do with NB Liquor.
The same guidelines apply to all of them, Barbour said.
NB Liquor
NB Liquor says its Mix & Match promotion that lets customers buy two
15-packs of beer from among Moosehead, Molson, and Labatt products

But a spokesman for Molson Coors says "a pricing advantage" remains in
place for Moosehead.
Since Molson Coors' brewery is in Moncton, "we have asked for pricing
that is equal to Moosehead," said spokesman François Lefebvre in an
email.
"We have been working with ANBL to level the playing field amongst
competitors. We are awaiting the decision on how to rectify the
current imbalance that exists," he said in an email.
He said he did not have information on the 22 measures listed in the
2013 document.
Asked if it was a consideration at NB Liquor to protect jobs at
Moosehead, Allain said "it's human nature that when you work for a
corporation in New Brunswick, you want to take care of our own."
Oland says the push for special measures from NB Liquor was due in
part by a 10-year decline in beer sales in New Brunswick, which he
attributed to an aging population and "the challenge of beer coming in
from the province of Quebec."
"It's a very, very competitive market so all brewers are very
aggressive in terms of talking to the folks at NB Liquor."
Changes proposed and rejected in 2011

Gérald Comeau was acquitted after being charged for bringing 14 cases
of beer and three bottles of liquor back from Quebec. That case has

Comeau's beer-import trial heard that NB Liquor and other provincial
alcohol corporations and regulators agreed in 2011 to raise the
personal exemption for people buying alcohol in another province and
bringing it home.
Allain said the NB Liquor board approved the change but then-Finance
minister Blaine Higgs — the minister responsible for NB Liquor at time
— failed to persuade the Progressive Conservative caucus to agree to
it.
"Unfortunately, there was a disconnect that happened there and I truly
believe it was a missed opportunity. We see the result today," he
said.
But provincial court Judge Ronald LeBlanc's ruling says it was the
Department of Public Safety, which oversees the Liquor Control Act,
that "did not actively pursue" legislation to loosen the restrictions.
Allain said the Comeau case might not have happened if the change had happened.
Higgs turned down an interview request, but said through a
spokesperson that the exemptions in the 2011 proposal wouldn't have
affected the Comeau case because "the accused had far more liquor"
than the proposed changes would have allowed.
Moosehead ready to compete
Oland said the real problem with people buying beer in Quebec is that
they bring home large amounts to resell, which is illegal.
"I've sat outside liquor stores [in Quebec] and I've seen people put
40 or 50 flats of beer in a truck and bring them across the border, so
how big an exemption do you need?"
Oland said Moosehead favours getting rid of all trade barriers,
including taxes. He said provincial tax on a dozen beer is $9.70 in
New Brunswick and only $2.50 in Quebec.
"New Brunswick beer is not competitive with Quebec beer from a tax
perspective, and until that's solved, this problem is not going to be
solved," he said.
"You can't blame the consumer, and I don't blame the consumer in this."

He estimates Moosehead lost $10 million in sales to Quebec beer runs
this year and he expects that figure to keep growing.
Oland said he agreed with a suggestion by Conservative MP Dan Albas
that the federal government refer the Comeau case directly to the
Supreme Court of Canada for a quicker ruling.
"The sooner there's some kind of decision, the better for everyone
involved," said Oland.
He said Moosehead can compete in an open market if both tax and
non-tax barriers to trade are eliminated by all provinces.
"We sell beer in all 50 states in the United States with pretty open
borders and hopefully we'll get to that point in Canada soon."

Ex-deputy premier was fired from her radio host gig after being arrested by UPAC

Quebec's former deputy premier Nathalie Normandeau is seeking $772,500
from Cogeco Media, claiming she was unfairly dismissed by the company
after she was arrested by the province's anti-corruption unit.
Normandeau worked as a radio host in Quebec City at FM93. She was
fired shortly after her March 17 arrest.
In a lawsuit filed at Quebec Superior Court, Normandeau says the
presumption of innocence must prevail.
Normandeau, who was Quebec's deputy premier under Jean Charest from
2007 to 2011, faces charges that include conspiracy, corruption,
breach of trust and bribery in relation to the awarding of a contract
to build a water-treatment plant in Boisbriand, Que.
The charges come with a maximum sentence of 12 years.
Normandeau is seeking to reclaim her salary for a contract signed
through 2019, along with punitive and moral damages totalling
$150,000.
Normandeau, a former Liberal MNA, cabinet minister and the
second-in-command under former premier Jean Charest, was arrested as
part of a series of UPAC raids in March.
She is due back in court in July.

Erin M. K. Weir, MP is the Canadian Member of Parliament for the
riding of Regina—Lewvan. Previously an economist with the United
Steelworkers union's Canadian National Office,[1] Weir was elected in
the 2015 federal election, defeating Conservative Trent Fraser and
Liberal Louis Browne. He is a member of the New Democratic Party (NDP)
and the party's critic for Public Services and Procurement Canada.
Weir has been a frequent guest on the Business News Network and other
TV channels. He has also been a member (and former Chair) of the
Progressive Economics Forum, an organization of 125 progressive
economists who comment on matters of public policy.[2] In the 2004
federal election, Weir was the NDP candidate in the riding of
Wascana[3] challenging the Liberal incumbent, then Finance Minister
Ralph Goodale. Weir also ran for the Leadership of the Saskatchewan
NDP in 2012
