Imperial Tobacco Canada and two businesses are suing the New Brunswick
government over the province's ban on menthol-flavoured tobacco
products, which they allege is unconstitutional.

The legislation, passed in 2015, came into effect Jan. 1 and it
prohibits the sale of flavoured tobacco products, including menthol
cigarettes.

Steven Vasseur, the owner of Keating's Speciality and Convenience Inc.
in Moncton, and Wajid Mohamad, the operator of Aulac Tobacco Shop in
Aulac, are listed as plaintiffs alongside tobacco giant Imperial
Tobacco Canada in a statement of claim filed against the province on
March 15 at the Court of Queen's Bench in Fredericton.

In their statement of claim, the plaintiffs argue the province is
overstepping its bounds by prohibiting the sale and use of flavoured
tobacco products including menthol products, because menthol is
specifically exempted from the list of prohibited flavour additives in
the federal Tobacco Act.

"Imperial Tobacco Canada filed its challenge because it believes the
provincial government has overstepped its legislative authority by
banning menthol and we do not see how this can be resolved outside a
courtroom unless the government reverses its decision," said Jeffrey
Guiler, Corporate Affairs Manager at Imperial Tobacco Canada in an
email to CBC News.

Robert Cunningham, a lawyer representing the Canadian Cancer Society,
said the organization supports the province's ban on menthol products
wholeheartedly, because flavoured tobacco is especially attractive to
teens.

"In New Brunswick, among high school students, the data shows that
among those who use tobacco 52 per cent use flavoured tobacco," said
Cunningham.

"Among those who smoke 38 per cent use menthol."

The data is from the Youth Smoking Survey from the Propel Centre for
Population Impact at the University of Waterloo. The findings are from
the 2012-2013 school year.

Cunningham calls the tobacco company's efforts "a public relations effort."

"This is an industry that cannot be trusted. This legislation is
extremely important. We need to protect kids and there's no way that
the tobacco industry should have it's way."
Provincial ban is 'overbroad'

In their statement of claim, the companies state "the menthol ban is
overbroad insofar as at least some of its effects bear no relationship
to its purpose of protecting the health of young persons.

"The menthol ban overreaches in its effects on both adult smokers and
individuals engaged in the sale of menthol tobacco products, as
prohibiting these individuals from buying and selling menthol products
significantly impacts their rights and legitimate interests without
advancing the purpose of the law."

They say the ban will increase the use of contraband cigarettes and
illegal drugs, but not reduce the the use of tobacco in the province.

Health Minister Victor Boudreau calls the lawsuit a "typical reaction"
that the tobacco industry is having in every province that has
forbidden the sale of flavoured tobacco.

"We feel confident in the approach that we're taking," said Boudreau.

"We want to reduce the number of, particularly children, but New
Brunswickers in general that are smoking.  And we're being consistent
with what's happening in other jurisdictions across the country."

Imperial tobacco has issued similar lawsuits in Nova Scotia, Quebec
and Alberta, which, along with New Brunswick and Ontario, have banned
flavoured tobacco.

A legal showdown is looming as Ottawa moves ahead with plans to put
tobacco products in plain packaging.

"An official with Imperial Tobacco says the government is exposing
itself to a legal challenge. Eric Gagnon, Imperial Tobacco’s Director
of Corporate and Regulatory Affairs also says the Federal Liberals are
being hypocritical with plans to legalize marijuana while further
restricting tobacco.

Canadian Cancer Society policy analyst Rob Cunningham says big tobacco
will fail if it goes to court noting unsuccessful challenges in
Australia and other countries.

Health Canada says it wants to protect young people and others from
inducements to tobacco adding the plain packaging proposal is  not
intended to infringe on the rights of companies to register and
protect their trademarks."


It's Time for Government to End the Hypocrisy Around its Health Agenda

"What's the government's end game when it comes to tobacco? Nobody
disagrees with the virtues of regulating tobacco and yes, even the
tobacco industry believes young people should not smoke. There are
proven means to ensuring that young people do not smoke, take
education programs for example," said Eric Gagnon, Imperial Tobacco
Canada's Director of Corporate and Regulatory Affairs. "Yet, the
government continues to concede to a small yet vocal group of health
lobbyists who are more anti-industry than pro-health."

The theme of this year's World No Tobacco Day is 'Get Ready for Plain
Packaging'. The Trudeau government has made it clear that they intend
to follow Australia, the UK and France's lead by implementing plain
packaging in Canada at some point in its mandate.

"Announcing more tobacco regulations is an easy political win that
will generate headlines, but do nothing to further reduce smoking
rates," continued Gagnon. "Unsurprisingly, evidence from Australia
shows plain packaging has not achieved any of its stated objectives.
Canada will be no different. With products already hidden from view in
stores and 75% of the pack covered with health warnings, nobody starts
smoking because of the pack."

MONTREAL, March 24, 2016 /CNW/ - Imperial Tobacco Canada, the
country's leading legal tobacco company, has filed a legal challenge
against New Brunswick's menthol ban, which took effect on January 1,
2016.

"By prohibiting the sale of menthol cigarettes, the Government of New
Brunswick has stepped beyond its legislative authority, which leaves
us with no other choice than to bring this matter before the courts,"
said Tamara Gitto, Vice President, Legal and External Affairs at
Imperial Tobacco Canada.  "Legal action is not something we want to
undertake, nor something we enter lightly, however the New Brunswick
government has left us with no choice in the matter."

Banning menthol tobacco products will not eliminate these products
from the New Brunswick market as consumers turn to the
well-established illegal tobacco market. The RCMP has stated in a
recent Telegraph Journal article that there "has been little change in
the steady stream of contraband tobacco products smuggled into New
Brunswick from other provinces, notably Quebec and Ontario."

"Imperial Tobacco Canada recognizes the health risks associated with
smoking, and that is why we support responsible, fact-based
regulation, especially when it comes to protecting young people," said
Ms. Gitto. "However, we will continue to oppose excessive regulation
that will not achieve any of the government's stated-objectives and
that could actually prove counter-productive."

The tobacco industry is one of the most regulated industries in
Canada, at both the Federal and Provincial levels. The industry must
comply with over 200 laws and regulations including those that require
the 75 per cent graphic health warnings on cigarette packs and laws
that see tobacco products hidden from public view at retail outlets
all while an illegal traffickers continue to operate with complete
disregard for such regulation.
