For weeks, Hungary has been welcoming Ukrainian refugees — a marked
difference from its response in 2015 when officials closed the border
with Serbia to keep migrants out. 2:30

Inside a sports hall in Budapest, Hungary, dozens of volunteers and
aid workers stand ready to help the hundreds of Ukrainian refugees who
pass through every day.

After they unload from the shuttle buses and register, they can get a
meal, a free SIM Card and, if they want, a train or bus ticket to take
them to their next destination.

If they stay, they can be put up in accommodation, like a school, a
rented hotel room or a private home offered up by a Hungarian host.

"I saw these children flooding from Ukraine with their mothers … and I
really felt I [had] to do something," said Eszter Zombory-Balogh, 38,
who is currently hosting eight Ukrainian refugees in a vacant
apartment owned by her father.

"Hungary is not internationally seen as a refugee welcoming country
because of our government. But this case is, I think, is different
because …they are like us."

There is wide support among the public and politicians to open the
doors to the Ukrainian refugees streaming in since Russia's invasion,
even as there are reports that Hungary continues to push other
migrants back over its heavily fortified southern border with Serbia.

The country's hardline prime minister, Viktor Orbán, has been
criticized by the EU and the United Nations Refugee agency for the
government's anti-immigration policy toward would-be asylum seekers
from countries like Syria and Afghanistan, but with a war just beyond
its eastern border, Hungary's government, aid groups and private
citizens have mobilized to help.

So when Zombory-Balogh's father, Imre Balogh, agreed to offer up his
vacant apartment, his daughter started collecting donations to furnish
it and provide refugees with the essentials like clothes and food.

She then went down to the train station looking for those who needed a
place to stay.

As Eszter Zombory-Balogh saw Ukrainian children flooding into

She connected with Iuliia Sergeieva, 38, who works as a human rights
advocate and lawyer. Sergeieva fled Kyiv, Ukraine, with her
six-year-old son and was later joined by her mother and 93-year-old
grandmother.

"It was my hardest decision in my life to cross the border … my heart
was tearing," Sergeieva said.

"It's a great luck meeting good people like Eszter and her family,
which we are super grateful for."
A question of who will stay

More than 350,000 Ukrainian refugees have registered in Hungary,
according to the United Nations Refugee Agency.

The majority have moved through the country, with fewer than 10,000
applying for temporary protection — a designation that would ensure
children are eligible for school and families could access the
health-care system.

But András Léderer doesn't think temporary protection applications are
a good indicator of how many refugees have stayed in Hungary.

He is an advocacy officer for the human rights organization Hungarian
Helsinki Committee, and he says when he and his colleagues visited
shelters where refugees were staying, most weren't aware they could
apply for the program.

"I think there is this calculation that if you don't allow people to
be channelled into the temporary protection scheme, they will move on
to other EU member states and ask for protection there," he said.

Still, he says the government's response to this crisis is much
different than in 2015, when Hungary shut down its border and stranded
hundreds of migrants on the Serbian side of the fence.

In the years that followed, the government ran anti-immigration
advertisements, but now officials are asking Hungarian citizens to do
their part to help the Ukrainian refugees.

The difference in messaging is stark.

But András Kováts, director of the Menedék Hungarian Association for
Migrants, says it's understandable, given that Ukraine is a
neighbouring country and Hungary is one of its first safe havens.

While Syrians are also fleeing war, Kováts said there is a debate In
Hungary about whether they were legitimate asylum seekers, because
they could have applied for protection in other countries they had to
travel through, like Serbia.

He admits, however, that race and religion were obvious factors too.

"The closer you are in terms of how you look, how you behave, how you
dress, the easier it is to feel sympathy, to feel empathy," he said.

"This is how people work everywhere."
Election on the horizon

The language used by Hungary's prime minister, meanwhile, was much
more controversial than nuanced identity politics.

In 2018, he told a German newspaper that the migrants gathered near
the border fence were "Muslim invaders."

Orbán, who faces an election on April 3 and is trying to seek his
fourth consecutive term, has insisted that Hungary will remain neutral
when it comes to the war next door but will help the refugees.

That offer of help has also been extended to the Roma refugees fleeing
Ukraine. Though the cultural group has faced longstanding
discrimination, Hungarian social worker Tamás Szűts says no one is
asking about the ethnicity of the refugees when they drop off
donations at the home where he is working.

In this sprawling yard in a neighbourhood in Budapest, dozens of
children run on the grass while others ride scooters and tricycles.

Until a few weeks ago, this was the site of a seniors home, but in
February the 16 residents were moved out and seven families from
Western Ukraine were moved in.

All of the people staying in the home are Roma and, while they speak
Hungarian, they face a series of other challenges as many are
illiterate, come from poverty and are discriminated against.

Of the 53 people living there, 32 of them are children and have just
started attending a school next door that is being run by a Lutheran

Szűts has been hired to help mothers and children adjust to life in
Hungary and is working on everything from filling out government
paperwork to getting them dental care.

All of the shelves are lined with donations including medicine and
food. All the toys in the yard were dropped off as well.

He says the public's response has been heartwarming, especially
considering that refugees haven't received a lot of support in the
past.

"They don't care," he said of the donors. "They just come here and
help and that's it. So it's a very, very nice moment."

Despite Putin ties, Hungarian PM Orbán leads election field

Veteran leader has been called out by Ukrainian president ahead of
Sunday’s vote.

BUDAPEST — Russia’s war in Ukraine has upended Hungary’s election
campaign for Moscow-friendly Prime Minister Viktor Orbán — just not in
the way one might think.

Orbán’s close relationship with President Vladimir Putin has been
under renewed scrutiny since the revanchist Russian leader decided to
attack Ukraine, Hungary’s neighbor. And Ukrainian President Volodymyr
Zelenskyy has called out Orbán for not offering stronger support to
his embattled country.

In many European countries, the prime minister’s stance might mean the
end of a political career.

Not so in Hungary.

Ahead of Sunday’s parliamentary election, Orbán has avoided the
campaign becoming a referendum on his history with Moscow. Instead,
his message comes down to one simple idea: He’ll keep Hungary out of
the war, his opponents won’t.

It doesn’t matter that the Hungarian opposition isn’t advocating for
Hungary to send troops into Ukraine, Orbán has used state resources
and a friendly media echo chamber to suggest the opposite.

His team has tapped a government coronavirus email database to blast
out talking points and plastered the country with taxpayer-funded
posters that proclaim, “Let’s preserve Hungary’s peace and security!”
next to Orbán’s image. Pro-government outlets and Orbán’s own foreign
minister are even accusing the government in Kyiv of supporting
Hungary’s opposition alliance.

Polls suggest the tactics are working: Orbán is in the lead in terms
of popular support.

“I’m not accountable before the Lord for the people of Ukraine, but
for the people of Hungary,” the prime minister said in a radio
interview last weekend. “Hungarian policy,” Orbán declared, “is
neither Ukrainian-friendly nor Russian-friendly: It’s
Hungarian-friendly.”

An Orbán win would resonate across the EU.

While the bloc responded with alacrity and solidarity in the war’s
early weeks, imposing sanctions and approving funds to shuttle arms to
Ukraine, fissures are starting to show and Orbán has staunchly opposed
more stringent sanctions on Russian energy. Another Orbán term would
also force the EU to finally confront a fraught question: whether to
slash budget funds to Budapest over findings of democratic
backsliding.

Orbán’s opponents have responded by redoubling efforts to highlight
the prime minister’s relationship with Putin.

“The war in Ukraine and the Russian aggression changed a lot of
things,” said Klára Dobrev, a member of the left-liberal Democratic
Coalition who is running as the No. 2 candidate on the united
opposition’s list.

Dobrev, a member of the European Parliament, told POLITICO that the
war “increased the feeling of insecurity” among Hungarians.

Now, she said, Sunday’s election came down to a choice between “Orbán
or Europe — that’s the vote.”
A different campaign

Hungarians on Sunday will choose between Orbán’s right-wing populist
Fidesz party — which has been in power for the past 12 years — and a
diverse alliance of six opposition parties and its candidate for prime
minister, provincial conservative mayor Péter Márki-Zay.

While the campaign initially focused on issues such as corruption, the
economy and an anti-LGBTQ+ referendum also scheduled by the government
for this weekend, the conflict next door changed the conversation.

“The war has cast a shadow over the whole Hungarian campaign,” Orbán
said in his radio interview.

“The question of peace and security is now also part of what’s at
stake in the election. And our message is clear: Only Fidesz can
create peace in Hungary, only we can guarantee the security of the
Hungarian people,” the prime minister said.

Despite this rhetoric, Orbán has thus far gone along with Western
allies as they boost their military presence in the region and fund
arms shipments to Ukraine. Budapest allowed NATO to deploy troops in
western Hungary and did not oppose an EU move to provide €500 million
for arms and other aid to the Ukrainian military. Hungary has also
supported multiple rounds of EU sanctions meant to sever much of
Russia’s economy from the bloc.

But back home, Orbán’s message to voters is that Hungary itself should
not provide weapons to Ukraine and that Budapest will oppose further
steps that might harm the country’s economy, such as stricter energy
sanctions. The government is also not allowing the direct transit of
weapons across the Hungarian-Ukrainian border.

“We’re giving the Ukrainians everything we can, perhaps even beyond
our capacity,” the prime minister said. “But we will not comply with
any demands of theirs which would destroy our national community —
either in a biological sense, with our sons dying in someone else’s
war, or with the ruination of Hungary’s economy.”

The conflict is on voters’ minds: During a campaign event this week in
Budaörs, a town outside Budapest, one voter asked about Hungary’s
defenses and relationship with NATO — a question that would have been
highly unusual in other recent campaigns, when local gatherings tended
to focus on matters such as health care and pensions.
Polarized society

Hungarians are deeply divided over how they assess Orbán’s foreign policy.

Sixty-four percent of Hungarians say the invasion of Ukraine was more
“aggression” than “defense” by Moscow, according to a poll conducted
by the Publicus Institute between March 7 and March 11.

But that feeling is heavily weighted by Orbán’s opponents. Ninety-one
percent of opposition voters felt Moscow was the aggressor, compared
to merely 44 percent among Fidesz voters.

Similarly, while 90 percent of opposition voters said Orbán should
condemn Russia more harshly for attacking Ukraine, only 8 percent of
government supporters said the prime minister should escalate his
tone, according to the poll.

A separate study conducted by pollster Medián found that 43 percent of
Fidesz supporters say Russia acted justly in Ukraine.

Experts argue that Fidesz voters’ support for Orbán’s policies —
despite a February visit he made to Moscow to boast about his cordial
approach next to Putin — is due in part to the government’s tight
control of much of the information landscape.

For weeks, state-owned and pro-government media outlets have been
promoting Russian narratives about the war. Róbert László, an analyst
at the Political Capital Institute in Budapest, called it the
government’s “media empire.”

Orbán’s supporters “are in such a massive opinion bubble,” he said,
that “it simply doesn’t matter what he said six weeks ago or three
days ago.”

It’s a bubble reinforced by Orbán’s use of state resources, like the
publicly funded posters or the email database used to canvas people
with this message: An Orbán government “will not allow that Hungarian
families pay the price of war.”
War of words with Kyiv

Before the war, Budapest and Kyiv maintained an uneasy relationship,
tussling over the language rights of Hungarian speakers living in
western Ukraine.

Those tensions surged back to the fore in recent days after Zelenskyy
chided Orbán publicly, telling the Hungarian leader, “You have to
decide for yourself who you are with.”

In response, Hungarian pro-government outlets and social media
accounts unleashed a torrent of personal attacks against the Ukrainian
leader. Some Orbán-supporting outlets even accused the government in
Kyiv of helping boost Hungary’s opposition in the campaign, presenting
Zelenskyy as a puppet who is trying to force Budapest into war.

On Wednesday, tensions rose as Hungarian Foreign Minister Péter
Szijjártó publicly accused the Ukrainian government of essentially
interfering in Hungary’s election. The minister claimed, without
proof, that the opposition had promised Kyiv it would provide Ukraine
with weapons and back further energy sanctions if it came to power.

Dmytro Kuleba, Ukraine’s foreign minister, rejected Szijjártó’s
claims, declaring that Ukraine doesn’t meddle in Hungary’s domestic
affairs. Kuleba then added a pointed barb: If Szijjártó feels an award
he received from Russia is more important than his relationship with
Ukraine, he should simply say so.
The opposition’s plan

Márki-Zay, the opposition’s candidate for prime minister, acknowledged
that Russia’s invasion initially appeared to create a rallying effect
for Orbán.

“At first,” he said, “we noticed that people want security and they
expect Orbán to be able to protect them.”

Now, however, the opposition is making the case that Orbán is unable
to defend Hungary.

“Only NATO can protect Hungary, not Orbán,” Márki-Zay told POLITICO
during a campaign stop in the town of Szolnok on Monday. “Orbán always
wanted to stop Brussels, the EU. Now we all have to stop Putin in
order to live in peace.”

Hungarian Minister Gergely Gulyás, who serves as Orbán’s chief of
staff, pushed back against the criticism.

“We are a loyal member of the European Union and NATO,” Gulyás told
POLITICO on Tuesday, noting that Budapest “condemned the Russian
aggression” and supported sanctions.

The difference in opinion, according to the minister, comes down to
the Hungarian government’s view that sanctions should penalize “the
Russians and not Europe.”

For Gulyás, the government’s foreign policy could help in the upcoming election.

“I think the decision of the Hungarian government is popular,” Gulyás
said. “I think that if it will influence the election, it will be good
for the government.”

Supreme Court of Canada accepts 'less than 10 per cent' of applications for appeals, says lawyer

The case of a Newfoundland lawyer whose name remains shielded under a publication ban as he faces sexual assault charges has caught the attention of media law experts across the country.

Nancy Rubin, a lawyer and partner with Stewart McKelvey in Halifax, says publication bans protecting someone accused of sexual assault are extremely rare and usually granted only when revealing the identity of the accused would also identify the complainant.

"If this is granted by the court, then it creates a real slippery slope for any high-profile accused who claims that their reputation is going to be tarnished by being outed in a criminal charge," Rubin said in a recent interview.

The lawyer at the centre of the unusual case was charged last year with four counts of sexual assault and one count of sexual interference. The charges involve the same complainant, with one incident alleged to have occurred when she was 12, according to court documents.

The lawyer's defence team applied for a publication ban last July, and an interim ban was granted that month by provincial Supreme Court Justice Donald Burrage, who prohibited the publication of the lawyer's name or any details that may identify him.

CBC and CTV went to court to have the ban removed, and hearings were held on Feb. 24 and 25 of this year.

A month later, on March 25, provincial Supreme Court Justice James Adams ruled that the ban preventing publication of the lawyer's name should be lifted. But two days later, he granted a stay of that decision while the lawyer's defence team applies to have that ruling appealed with the Supreme Court of Canada.

The ban remains in place.

Win unlikely, say lawyers

Anyone can ask a judge to shield their identity from publication, Rubin noted, but few have the financial resources to hire a lawyer to argue on their behalf.

Adams released the reasons for his stay Wednesday, saying he agreed that the application for appeal would be rendered moot if the lawyer's name were published. He said he also agreed the case raises a "serious issue" that could be deemed by the Supreme Court of Canada to be of public interest and worthy of adjudication.

Rubin said that's unlikely.

"When you're dealing specifically on a ban that's grounded in personal and professional reputation interests, or embarrassment, or loss of business, that's not enough," she said. "You could make that argument every time."

Iain MacKinnon, a lawyer with Toronto-based firm Linden & Associates, agrees the chances are slim that the country's highest court will hear the appeal.

The Supreme Court of Canada accepts "less than 10 per cent" of the applications it receives for appeals, he said.

MacKinnon said he understands why the judge granted a stay on his own ruling, but he said he can't understand why an interim publication ban was granted in the first place.

He said the publication ban can't stay in place forever, adding that at some point, the public is going to find out who the lawyer is.

But in the meantime, the lawyer — who was first charged in May of 2021 — has bought himself many months of protection from public scrutiny, MacKinnon said, "which is a lot more than any other person charged with sexual assault, who almost never gets this kind of protection unless it's for purposes of protecting the victim."

MacKinnon, who sits on the board of the Canadian Media Lawyers Association, said he's planning to bring the case up with the group on Friday, as he feels media lawyers across the country should be watching.

Publication ban continues on name of N.L. lawyer charged with sexual assault

Identity to remain secret pending request to have nation’s top court consider anonymity arguments

A Newfoundland and Labrador lawyer facing charges of sexual assault and sexual interference has secured an extension of a publication ban shielding his name from being reported in relation to those criminal proceedings.

Justice James Adams issued the order at Newfoundland and Labrador Supreme Court in St. John's on Friday.

Earlier in the week, Adams ruled the ban would be lifted.

"His engaged interests amounted to no more than personal and professional embarrassment and possible loss of business," the judge wrote in his decision.

"These concerns did not meet the high bar of constituting an important public interest to which court openness would pose a serious risk."

The man immediately filed for a stay of that order, while he seeks leave to appeal the decision to the Supreme Court of Canada — a process that could take weeks or months.

Scott Hutchison — a partner with Toronto-based Henein Hutchison LLP who is representing the Newfoundland lawyer — said maintaining the ban for now is a "modest imposition" so the "machinery of justice can finish its work."

He said publication of the man's name now would do irreparable harm.

"It will be impossible to put the genie back in the bottle," Hutchison told the court.

The high-profile legal team representing the accused lawyer includes local lawyers Jerome Kennedy and Rosellen Sullivan.

CBC News and CTV News intervened in the case, successfully arguing the ban would interfere with the open-court principle, and freedom of the press.

The media outlets contested the application to extend the publication ban.

Pippa Leslie — a lawyer with McCarthy Tetrault LLP in Toronto representing CBC and CTV — reiterated that personal embarrassment can't outweigh charter rights to report on court proceedings.

Leslie called the accused lawyer's request a "significant impairment" of those rights.

Newfoundland and Labrador director of public prosecutions Lloyd Strickland said keeping the ban in place could cause "substantive harms to the public interest."

In a ruling from the bench, Adams granted a stay on his original decision, which means the publication ban will continue, at least for now.

However, the judge unsealed a raft of previously secret court documents related to the case that reveal more details about the pending criminal charges.

According to an affidavit the lawyer filed in court, he is accused of assaulting a 12-year-old girl in her mother's car while it was outside his law office in 2001. 

In 2008, when she was 19, he is alleged to have assaulted her in his law office.

"I unequivocally deny each of these allegations in their entirety," the lawyer said in his affidavit.

He also claims that he hired a private investigator, who he says found information helpful to his defence. 

The criminal proceedings are ongoing.

Two more charges of sexual assault have subsequently been filed involving the same alleged victim, for incidents alleged to have happened in 2012 and 2013.

'Prominent' N.L. lawyer facing sex charges can't shield name from publication, judge rules

CBC, CTV win case over open-court principle, freedom of the press

A Newfoundland and Labrador Supreme Court judge has ruled against a lawyer who wanted his identity shielded from public disclosure because ongoing charges of sexual assault against him could hurt his reputation.

But the lawyer is arguing that the publication ban on his identity be maintained while he attempts to take the case to the Supreme Court of Canada. 

The matter is due back at court in St. John's on Friday, for a hearing about whether the publication ban will continue, pending the appeal bid to the nation's highest court.

Justice James Adams issued his decision on the main case Wednesday.

"The applicant relied on the assertion that he is a prominent lawyer in Newfoundland and Labrador," Adams wrote.

"To grant the publication ban on this basis on the facts of this case would put lawyers in a special category of accused persons which would seriously undermine the public's confidence in the administration of justice."

The man is facing charges of sexual assault and sexual touching of a female, who was 12 at the time of the earliest alleged offences.

Three charges were laid in May. Two more charges were filed in December.

Last year, he won an interim publication ban on his name in relation to those criminal proceedings.

CBC News and CTV News went to court, arguing the ban would interfere with the open-court principle and freedom of the press.

The judge sided with the media outlets and the Crown, which also opposed the application.

"Justice done in secrecy is contrary to the tenets of a democratic society," Adams wrote in his decision.

The judge noted that the lawyer was asking the court "to make a significant change in the law."

The lawyer had argued that revealing his identity would deprive him of the presumption of innocence, negatively affect his reputation, and undermine his dignity. 

Adams decided that the presumption of innocence would not be at risk, if no publication ban was granted. 

He then turned to the other arguments raised.

"In protecting the applicant's reputation by issuing a ban on his identity, the court would be seriously impacting the public interest in encouraging persons with relevant information about similar allegations from coming forward," Adams wrote.

"It would also negatively impact the public's interest in seeing that all individuals charged with criminal offences are treated fairly and equally."

Publication bans are common in sexual assault cases, but to protect the identity of the alleged victim, not the accused.

A two-day hearing on the matter was held last month, with high-profile legal representation on both sides.

The applicant is being represented by former provincial justice minister Jerome Kennedy, longtime St. John's criminal defence lawyer Rosellen Sullivan and Scott Hutchison, a partner with Toronto-based Henein Hutchison LLP.

CBC and CTV were represented by Christine Lonsdale, a Toronto-based partner at McCarthy Tetrault LLP.
