Judge orders CBC to pay nearly $1.7M in defamation case

Manitoba judge finds broadcaster failed to prove stories about investment adviser weren’t defamatory

A Manitoba judge has ordered the CBC to pay nearly $1.7 million in damages to an investment adviser after finding its coverage about the man was defamatory.

In a judgment delivered on Dec. 15, Court of Queen's Bench Justice Herbert Rempel said a television and online story about Kenneth Wayne Muzik negatively affected the adviser's personal life and ability to earn income.

It involves a June 2012 television broadcast that focused on a former client of Muzik's, William Worthington, who "expressed profound regret" about relying on Muzik's advice to commute the value of his $675,000 Canadian Pacific Railway pension to an investment portfolio, the decision said.

That story included Worthington's observations that the value of his pension was "more than half gone" since his retirement and implied he and his wife would be forced to sell their house and go back to work to make ends meet, Rempel wrote.

It also reported Muzik had inflated Worthington's income level in his file to justify higher-risk investments, the decision said. The report also said the adviser was under strict supervision by the Manitoba Securities Commission and had previously been ordered to pay a $15,000 fine for actions contrary to the public interest.

The decision names the public broadcaster and former reporter Gosia Sawicka as defendants. Muzik discontinued action against Worthington and two other CBC employees before the judge-only trial began in 2019.

Rempel's decision noted Muzik and Worthington gave differing recollections at trial about what was said at their meetings, but the judge said he found Muzik's evidence more reliable and Worthington at times untruthful.

The judge said he believed Worthington and his wife, Leslie Worthington, went public with their story to inflict negative publicity in the hopes of getting a settlement from National Bank Financial, where Muzik worked at the time of Worthington's investment.

Secret recording

The couple had earlier devised a plan to have Muzik admit to unethical conduct on a secret audio recording of a two-hour meeting with him, the decision said.

Snippets of that conversation — but not the full recording — were later shared with Sawicka and used in coverage of the story involving Worthington. The couple later said the recording device had been lost when they moved houses.

Rempel said the evidence the couple offered about that device "defies belief" and that in his view it's likely "the disclosure of the entirety of the audio recording would have been damaging to the Worthingtons' narrative" that Muzik deceived them.

The stories about Muzik didn't mention that the couple withheld most of the secret audio recording, or that the Worthingtons later said it had been lost, the judge said.

"This constituted not only a breach of … [CBC's] own journalistic standards but also represented the height of irresponsibility when the professional reputation of Mr. Muzik was hanging in the balance," Rempel wrote.

The stories also didn't mention that the couple's decision to sell their house was because they were moving in with Leslie Worthington's mother as caregivers, or that William Worthington had not gone back to work at the time the first story aired, the decision said.

The decision also said Worthington's stock portfolio was negatively affected by the 2011 bear market. But overall, he also took out more than $290,000 from the portfolio. 

The judge found that Worthington had deviated from the investment plan devised by Muzik by taking out larger than expected monthly withdrawals, along with some additional funds for a vacation, a loan for a relative and house repairs.

Sawicka described the focus of the stories as cautionary tales about the risks of commuting pensions, but Rempel wrote that he was satisfied an objective member of the public would understand them to be an attack on Muzik's integrity.

Previous investigations

The decision said while Sawicka reported that the Manitoba Securities Commission reprimanded Muzik in 2011 as part of a settlement agreement in which he had to pay $15,000, that amount was described as a "voluntary payment to the Minister of Finance" and not a fine.

Rempel said the broadcaster also did not report on the results of a Mutual Fund Dealers Association of Canada investigation that resulted in a warning letter.

That letter notes that while Muzik had misrepresented or failed to explain the risks and features of commuting a pension and failed to individually assess risk tolerance and investment knowledge for 17 clients — including the Worthingtons — the association said it would not begin formal disciplinary proceedings against the adviser.

The judge found Muzik proved the words in the news stories about him were defamatory. That shifted the onus to the CBC to raise a defence — either fair comment, justification, qualified privilege or public interest responsible communication — to escape liability, the decision said.

The broadcaster withdrew its defence of qualified privilege at the start of the trial and was unable to prove any of the other available defences, Rempel wrote.

Damages awarded

Rempel awarded Muzik $400,000 in both general and aggravated damages. 

The aggravated damages were partly informed by CBC's initial expert opinion during the litigation process that Muzik was engaged in churning, a term used to describe excessive sales or mutual fund transfers that maximize fees paid to a financial planner at a client's expense, Rempel wrote.

CBC later withdrew that expert opinion but the judge said it was still relevant to the case, as it amounted to a threat to play that card during settlement talks and in the lead-up to the trial.

"In the context of a professional adviser, this kind of statement is akin to saying Mr. Muzik was a thief," the judge said.

That strategy, which the judge described as "egregious and outrageous," was not mentioned again after the first day of trial, the decision said.

It also "constitutes unquestionable evidence that the CBC was motivated by actual malice in this case and this aggravated the injury caused to Mr. Muzik by the defamatory expression," Rempel said.

The judge also awarded Muzik $250,000 in punitive damages and $609,403 in special damages for estimated lost income, for a total of $1,659,403.

CBC plans to appeal the decision.

​​"While we respect the judicial process, we are very disappointed with the decision and our intention is to appeal. We have no further comment at this time," said Chuck Thompson, CBC's head of public affairs.

Muzik's lawyer, Bill Gange, said he was expecting the decision the judge came to, and he and his client were both largely satisfied with the outcome.

"We would have liked a little bit more in terms of the loss of income, but that's the way that cases go. Judges listen to the evidence and come up with their own conclusions, and that's what Justice Rempel did," Gange said.

The active cases by zone are:

12 in the Moncton region, Zone 1
42 in the Saint John region, Zone 2
17 in the Fredericton region, Zone 3
8 in the Edmundston region, Zone 4
3 in the Bathurst region, Zone 6
A total of 134,518 tests have been completed, with 650 of those done
since this time on Monday.

Fredericton is up by 4, the others remained the same. So at least four
were Fredericton region (not sure on number 5). It was not announced,
however, I asked the same question.

Reply to @Marc Martin: they’ve stopped the breakdowns because people
are figuring out where the cases are. For example Fredericton High
School announced a new case but didn’t say if it was staff or student.
There was one case in Fredericton yesterday (40-49). Unless it is the
oldest high school student at FHS, it was a staff member.

COVID-19 roundup: 1 new case in N.B. as Edmundston enters orange recovery phase

The Edmundson region, or Zone 4, returned to orange level restrictions
on Saturday. (Radio-Canada)

New Brunswick reported one new case of COVID-19 on Saturday.

The new case is an individual in their 20s in the Saint John region
(Zone 2). The person is self-isolating.

There are now 72 active cases, a drop of six.

The province has recorded 555 total cases and 475 recoveries since the
pandemic began.

On Friday, the province conducted 887 COVID-19 tests, bringing the
total number to 138,121.

There are four people in hospital with the virus, three in intensive care.

Eight people have died of COVID-19 in the province since the start of
the pandemic.
Edmundston returns to orange

On Saturday, the Edmundston region, or Zone 4, entered its first day
in the orange phase of COVID-19 restrictions since the early days of
the pandemic.

Public Health made the recommendation to put the zone in the more
restrictive phase after an outbreak at the Edmundston Regional
Hospital.

"We have seen a rapid increase in the number of cases over the past
week, a doubling of case counts within five days and a positivity rate
from testing that is well above the provincial average," said Dr.
Jennifer Russell, the province's chief medical officer of health.

Seven workers at the Edmundston hospital have been diagnosed with
COVID-19, and 24 workers are self-isolating.

Fourteen of the province's active cases are in Zone 4.

The Saint John region remains the province's hot zone with 33 active cases.
Exposure notification

Public Health added three new flights Friday to its list of possible
exposures. A person who has tested positive may have been infectious
while travelling on Dec. 4 on the following flights:

    Air Canada Flight 8372 from Fort McMurray to Calgary.
    Air Canada Flight 144 from Calgary to Toronto.
    Air Canada Flight 8918 from Toronto to Moncton.

Anyone who travelled on these flights should "continue to follow the
directives given to them during the travel registration process and
when they entered New Brunswick," the advisory said.
What to do if you have a symptom

People concerned they might have COVID-19 symptoms can take a
self-assessment test online.

Public Health says symptoms shown by people with COVID-19 have included:

    A fever above 38 C.

    A new cough or worsening chronic cough.

    Sore throat.

    Runny nose.

    Headache.

    New onset of fatigue, muscle pain, diarrhea, loss of sense of
taste or smell.

    Difficulty breathing.

In children, symptoms have also included purple markings on the
fingers and toes.

People with one of those symptoms should:

    Stay at home.

    Call Tele-Care 811 or their doctor.

    Describe symptoms and travel history.

    Follow instructions.

Manitoba judge finds broadcaster failed to prove stories about
investment adviser weren’t defamatory

A Manitoba judge has ordered the CBC to pay nearly $1.7 million in
damages to an investment adviser after finding its coverage about the
man was defamatory.

In a judgment delivered on Dec. 15, Court of Queen's Bench Justice
Herbert Rempel said a television and online story about Kenneth Wayne
Muzik negatively affected the adviser's personal life and ability to
earn income.

It involves a June 2012 television broadcast that focused on a former
client of Muzik's, William Worthington, who "expressed profound
regret" about relying on Muzik's advice to commute the value of his
$675,000 Canadian Pacific Railway pension to an investment portfolio,
the decision said.

That story included Worthington's observations that the value of his
pension was "more than half gone" since his retirement and implied he
and his wife would be forced to sell their house and go back to work
to make ends meet, Rempel wrote.

It also reported Muzik had inflated Worthington's income level in his
file to justify higher-risk investments, the decision said. The report
also said the adviser was under strict supervision by the Manitoba
Securities Commission and had previously been ordered to pay a $15,000
fine for actions contrary to the public interest.

The decision names the public broadcaster and former reporter Gosia
Sawicka as defendants. Muzik discontinued action against Worthington
and two other CBC employees before the judge-only trial began in 2019.

Rempel's decision noted Muzik and Worthington gave differing
recollections at trial about what was said at their meetings, but the
judge said he found Muzik's evidence more reliable and Worthington at
times untruthful.

The judge said he believed Worthington and his wife, Leslie
Worthington, went public with their story to inflict negative
publicity in the hopes of getting a settlement from National Bank
Financial, where Muzik worked at the time of Worthington's investment.
Secret recording

The couple had earlier devised a plan to have Muzik admit to unethical
conduct on a secret audio recording of a two-hour meeting with him,
the decision said.

Snippets of that conversation — but not the full recording — were
later shared with Sawicka and used in coverage of the story involving
Worthington. The couple later said the recording device had been lost
when they moved houses.

Rempel said the evidence the couple offered about that device "defies
belief" and that in his view it's likely "the disclosure of the
entirety of the audio recording would have been damaging to the
Worthingtons' narrative" that Muzik deceived them.

The stories about Muzik didn't mention that the couple withheld most
of the secret audio recording, or that the Worthingtons later said it
had been lost, the judge said.

"This constituted not only a breach of … [CBC's] own journalistic
standards but also represented the height of irresponsibility when the
professional reputation of Mr. Muzik was hanging in the balance,"
Rempel wrote.

The stories also didn't mention that the couple's decision to sell
their house was because they were moving in with Leslie Worthington's
mother as caregivers, or that William Worthington had not gone back to
work at the time the first story aired, the decision said.

The decision also said Worthington's stock portfolio was negatively
affected by the 2011 bear market. But overall, he also took out more
than $290,000 from the portfolio.

The judge found that Worthington had deviated from the investment plan
devised by Muzik by taking out larger than expected monthly
withdrawals, along with some additional funds for a vacation, a loan
for a relative and house repairs.

Sawicka described the focus of the stories as cautionary tales about
the risks of commuting pensions, but Rempel wrote that he was
satisfied an objective member of the public would understand them to
be an attack on Muzik's integrity.
Previous investigations

The decision said while Sawicka reported that the Manitoba Securities
Commission reprimanded Muzik in 2011 as part of a settlement agreement
in which he had to pay $15,000, that amount was described as a
"voluntary payment to the Minister of Finance" and not a fine.

Rempel said the broadcaster also did not report on the results of a
Mutual Fund Dealers Association of Canada investigation that resulted
in a warning letter.

That letter notes that while Muzik had misrepresented or failed to
explain the risks and features of commuting a pension and failed to
individually assess risk tolerance and investment knowledge for 17
clients — including the Worthingtons — the association said it would
not begin formal disciplinary proceedings against the adviser.

    Reprimanded financial adviser can't sell mutual funds: commission

The judge found Muzik proved the words in the news stories about him
were defamatory. That shifted the onus to the CBC to raise a defence —
either fair comment, justification, qualified privilege or public
interest responsible communication — to escape liability, the decision
said.

The broadcaster withdrew its defence of qualified privilege at the
start of the trial and was unable to prove any of the other available
defences, Rempel wrote.
Damages awarded

Rempel awarded Muzik $400,000 in both general and aggravated damages.

The aggravated damages were partly informed by CBC's initial expert
opinion during the litigation process that Muzik was engaged in
churning, a term used to describe excessive sales or mutual fund
transfers that maximize fees paid to a financial planner at a client's
expense, Rempel wrote.

CBC later withdrew that expert opinion but the judge said it was still
relevant to the case, as it amounted to a threat to play that card
during settlement talks and in the lead-up to the trial.

"In the context of a professional adviser, this kind of statement is
akin to saying Mr. Muzik was a thief," the judge said.

That strategy, which the judge described as "egregious and
outrageous," was not mentioned again after the first day of trial, the
decision said.

It also "constitutes unquestionable evidence that the CBC was
motivated by actual malice in this case and this aggravated the injury
caused to Mr. Muzik by the defamatory expression," Rempel said.

The judge also awarded Muzik $250,000 in punitive damages and $609,403
in special damages for estimated lost income, for a total of
$1,659,403.

CBC plans to appeal the decision.

​​"While we respect the judicial process, we are very disappointed
with the decision and our intention is to appeal. We have no further
comment at this time," said Chuck Thompson, CBC's head of public
affairs.

Muzik's lawyer, Bill Gange, said he was expecting the decision the
judge came to, and he and his client were both largely satisfied with
the outcome.

"We would have liked a little bit more in terms of the loss of income,
but that's the way that cases go. Judges listen to the evidence and
come up with their own conclusions, and that's what Justice Rempel
did," Gange said.

A Winnipeg financial adviser who was previously reprimanded by the
Manitoba Securities Commission (MSC) has been refused permission to
sell mutual funds for the local branch of an Ontario-based company.

The decision by the MSC found Kenneth Wayne Muzik “not suitable for
registration” in refusing to allow his application to become a
representative with Sterling Mutuals Inc.

Muzik has not been registered under the Securities Act for the past
year since his previous company, National Bank Financial Ltd.,
terminated his sponsorship.

In a written decision, MSC director Doug Brown said Muzik continued to
advise people about investments even after his loss of registration a
year ago.

“This continued conduct by Muzik following the loss of his
registration calls into question his suitability for registration,”
Brown wrote.
Reprimanded in 2011

In December 2011, the securities commission reprimanded Muzik for
recommending investments that were outside the risk tolerance of
clients.

In a settlement, Muzik was ordered to pay $5,000 toward the costs of
the investigation and to make a $15,000 payment to the minister of
finance.

He acknowledged that he acted "contrary to the public interest" by
recommending investments that were outside the risk tolerance of
clients.

In this month’s ruling, the MSC said Muzik had a history of failing to
comply with the terms and conditions of registrations, and called his
decision to remain in contact with clients of his former firm
“self-serving.”

Muzik said he would not comment because the decision is under appeal.
Conditions imposed on registration

The written decision said Muzik’s registration history with the
securities commission began in 1990.

It said in 2004, the MSC imposed conditions on Muzik’s registration as
a result of complaints by clients as well as concerns raised by a
former sponsoring company, Assante Financial Management Ltd.

Assante had terminated its sponsorship of Muzik in 2004 in part
because he had clients sign blank forms, the MSC decision states.

After Assante, Muzik was registered as a representative with
Wellington West Financial Services. The securities commission imposed
conditions requiring Wellington to conduct increased supervision of
his activities.

The decision document states most of the monthly supervision reports
showed no concerns, but there were a few exceptions. In 2009, there
were concerns that client files contained incomplete and undated
documents.

After Wellington, Muzik was approved in 2012 as a representative with
National Bank Financial, until National terminated its sponsorship of
him related to an incomplete “Know Your Client” form.

“While not denying there was an incompleted form, Muzik took the
position that a single piece of information on the form had been
inadvertently missed and that the remainder of the form had been
completed,” Brown wrote.

“In effect, Muzik took the position the missing piece of information
on the form was not sufficient to justify his termination by
National."
'More than a minor mistake'

Brown added, “What is clear is the omissions on this form represent
more than a minor mistake or error. For a registrant with the
experience and background of Muzik to allow a form to be signed which
failed to disclose the most basic elements of investment objectives
and risk tolerance is clearly unacceptable."

The MSC decision concluded, “When questioned of these repeated
instances of what he acknowledged to be unacceptable conduct Muzik
could provide no insight into his conduct except that it was a mistake
and in some instances done for some perceived benefit to the client.”

The commission's decision also raised the issue of whether Sterling
Mutuals conducted proper due diligence before sponsoring Muzik’s
application.

Brown wrote, “Much of the information that had been provided in
written materials assembled by staff, as well as during the review by
the Director, was not known to Sterling.

"Whether this lack of knowledge was caused by a lack of due diligence
on the part of Sterling, or by a failure of Muzik to fully disclose
all of the information related to his registration does not need to be
decided."

Nelson Cheng, chief executive officer of Sterling, told CBC News he
was unaware of some of the issues raised during the hearing.

However, Cheng added that it is difficult to do thorough due diligence
on a prospective employee because some information is not readily
available from regulators.

CBC forced to pay $1.95 million in libel case as court finds it
“failed in its duty to be fair, balanced and responsible”

The Canadian Broadcasting Corporation (CBC) has been found liable in
Manitoba’s largest defamation case since 1998.

The state-funded Canadian media has been ordered to pay $295,017 in
legal fees, as well as $1,659,403 in damages for libel.

In 2012, the CBC ran stories on a Winnipeg investment advisor, Kenneth
Muzik, who had won the Wealth Management Practice of the Year award in
the prior year.

The state-funded media ran a story depicting Muzik with the headline:
“Is your money safe?”, and an announcer’s script that read: “Our top
story tonight has to do with your hard-earned savings.”

The CBC’s stories detailed an investor unhappy with the performance of
his investment, and who alleged unethical behaviour on the part of
Muzik.

The CBC aired snippets of a secretly recorded audio conversation with
Muzik, taken from a two-hour-long file. The state-funded media failed
to provide the full original recording.

“This constituted not only a breach of … [CBC’s] own journalistic
standards but also represented the height of irresponsibility when the
professional reputation of Mr. Muzik was hanging in the balance,”
Rempel wrote.

Justice Rempel, who wrote the decision against the state-funded media,
said the CBC “failed in its “obligation to report the facts in a fair,
balanced and responsible manner”.

“The CBC took very strong positions during the course of the trial
that were not supported by the facts as I found them”, Rempel added.

“The CBC has considerable resources and a wide audience as a national
broadcaster […] It also has a large footprint on the internet through
its website.”

“It will be something that lives on forever even if the CBC removes
the news stories from its website […] Anyone with a web browser will
be able to find or stumble across the defamatory expression and in
that sense Mr. Muzik will never be able to escape the reach of the
defamatory expression.”

The CBC costs Canadians over one billion dollars annually. In recent
years, the state-funded media’s coverage has become ideologically
oriented, with some audiences pointing out what they say is a liberal
bias.

The CBC had to retract stories regarding the freedom convoy in which
the broadcaster said the funding was largely foreign. This was proved
false in testimony before the House of Commons.

The CBC went so far as to claim the freedom convoy was funded by
Russia as a means to destabilize the government. In reality, the
convoy proved to be a grassroots movement with strong support amongst
Canadians. The protestors requested an end to all COVID-19 mandates
and restrictions.

The state-funded broadcaster plans to appeal the decision.
