Jose Serrano, 47, said he was on the phone with a CRA agent in his driveway around 2 p.m. on Aug. 26 when he told the agent that repeated calls for money could lead them to suicide.
Moments later Fredericton police officers pulled him from his parked car at gun-point and arrested him.
"I thought they were going to kill me," said Serrano, who was very emotional when describing his encounter with police.
"The first thing I saw was an assault rifle through the glass pointed right at me."
Serrano said he was then pulled from his car parked front of his home, shoved into the ground, handcuffed, arrested and taken to hospital for evaluation.
He said his cellphone was broken and his home searched during the ordeal.
"I am not suicidal, I did not say I was suicidal," said Serrano.
"That was embarrassing to be arrested by police for something I didn't do, like a criminal."

On Sept. 1, Serrano received a letter from the chief of police stating an investigation into the incident has been completed and closed.
Fredericton Police Chief Leanne Fitch said in the letter that officers handled the incident appropriately and "in accordance with policy and procedure."
The letter from Fitch to Serrano details information from the report passed onto responding police officers from CRA.
The letter alleges that Serrano had been threatening suicide because of a custody battle.
"He has already spoken to a pastor and made peace with himself," the letter said.
"He stated if he becomes aware that police are en route he will kill himself before police show up. He stated he has all the steps in place to do it. He states if he smells police coming he will do it. He has training to do it."
Serrano denies stating of what was included in the police report.

Fredericton Police Chief Leanne Fitch said in a letter to Serrano that officers handled the situation according to policy. (CBC)
CBC News requested details on how Serrano could go about obtaining an audio recording of the exchange between himself and the CRA agent, but were told they did not exist.
"These telephone conversations are not recorded," said Jeffrey Lansing, spokesperson for the CRA.
"Consequently, a taxpayer cannot obtain an audio recording of a conversation that occurred with a Canada Revenue Agency collection agent."
Serrano said he pays $230 a month to the CRA and owes around $4,000 in total.
He said he cannot pay the entire bill at once, which is what he said the federal agency was demanding.
"They wanted me to go to the bank, they wanted me to make a loan and they wanted me to do anything else, to loan money and I say I cannot do that."
Serrano said he would not kill himself over the dispute over his taxes.
"If I was suicidal, like they say, I would let them kill me right there," said Serrano.
"That's not the way to approach somebody that is suicidal."
Armed approach, wrong approach
Mental health experts are firmly against any use of weapons, or show of force, by police when dealing with those threatening suicide.Steve Lurie, the executive director of the Canadian Mental Health Association in Toronto, said he doesn't think the Fredericton police used the proper response in dealing with Serrano.
"There are a number of inquests in this province where police have not used de-escalation techniques to provide a proper response," he said.
Lurie said he believes responses to suicide threats and those in crisis should be handled by mobile crisis teams instead of police in many cases.
Fredericton does have mobile crisis services provided by Horizon Heath, but they were not used in this case.
Mark Henick, a mental health advocate, said he agrees with Lurie's assessment that the Fredericton police mishandled the Serrano incident.
"It is absolutely the wrong way to go about responding to this type of thing," Henick said.
"If somebody is in crisis, the last thing you want to do is escalate the crisis. And I can't possibly think of anything more escalating then having a gun drawn on you."
Henick himself dealt with his own suicide attempts as a teenager. He now travels the country working on policies and prevention programs.
"If you're already thinking about death, then what the heck is a gun going to do?" said Henick.
"It's going to actually bring you closer to that point. It's going to isolate you more. It's going to make you more afraid. When people are suicidal, they are usually scared and people don't often know that. They are already feeling vulnerable and hurt. So it certainly doesn't help."
Alycia Bartlett, a spokesperson for the Fredericton police, said officers, including those who responded to Serrano's house, have had several training courses on mental health.
"For 2017, we have flagged de-escalation technique advance training in the budget for all members," wrote Bartlett.

Thanx for defending me in chucky's blog.
And Thanx for blogging about my false imprisoment once again but this time it was the corrupt smiling bastards in my native land that did it to me. Why not call the number and find out Charles? You may not be a 'fan', but you two have a lot in common. There was a post at Spinks last night that could be him, it was posted anonymously, but he's the only guy who calls people 'boy'.
You are always offering conspiracy stories about people out to get you, his actually make even more sense as he keeps evidence and talks about using the court system-even runs for parliament. By that token he's more 'dangerous' than you, and doesn't have a popular blog to keep him in the limelight enough to protect him.

The media is certainly not going to cover it, you are far better known and like you say, the media wouldn't cover your arrest at all. Fighting for people's rights is never 'done'. There are some people who did work for residential tenants acts and about YOUR ban. Ironically Mr. Amos' last blog was a link to www.charlesin thehouse.com asking why YOU got all the attention.
I seem to recall lots of blogs with pictures about the clown who was banned, but maybe past posters are right, and its only people who are nice to you that get any attention. Let's just hope people don't have the same attitude if it does happen that YOU get arrested. Whether you like somebody or not is irrelevant.
I don't know what Mr. Amos' story is and have never been able to follow it, but we certainly know from Charles' treatment and Bonnie O'dea's case that just about anything is possible.

Charles, don't mean to be contrary but virtually everything you've said about him has been said numerous times HERE about YOU. On numerous issues people have posted saying 'you just can't reason with the guy'. I don't particularly like being called 'mikey boy' and was often a target of Mr. Amos' criticism myself.
And like I said, if YOU were arrested there are lots who would say exactly the same thing as the above-'he needs help, I hope he gets it' and then move on.
The issue is not the PERSON, in order to raise the ire of lawyers, police, etc., you HAVE to be a bit of a malcontent. Most of us would just cry in our coffee and try to move on. The only reason Mr. Amos (and you I dare say) continue to tilt at windmills is BECAUSE you are belligerent, somewhat cantankerous SOB's.

It is simply NOT TRUE, as Mikel suggests, that a person can be commited to a mental health facility on the basis of a phone call to hospital or police. That may have been true in 1950, but not today! If Mr. Amos has been hospitalized, it's on the basis of reliable evidence.
btw, I've had dealings with Mr. Amos. For the record whatever happened between me and Doctors was intensely private and Chucky Baby had no right to blog about it whatsoever particularly while I was locked and could not respond.

What if I were truly nuts or suicidal as Chucky claimed? Could that bullshit have tipped me over the edge? For the record I have a strong feeling the nasty bastard that talked of dealing with me and of my fear of the CIA is none other than T.J. Burke but I can't prove it. That said I have had no dealings with the CIA whatsoever. It was the US Secert Service, the US Marshalls, the FBI, The RCMP, National Security and the Department of Homeland Security the US Treasury and a host of others whom i have fought tooth and nail with over the years. Not once did I cross paths with the CIA except if you count when I was dealing with the 911 Commission just before Paul Martin flew down to Washington and met with a couple of them right after they left the oval office early. The Obama and McCain file or the Elections Canada files were both timely and wicked yet you didn't say boo about them. How Come? A bunch of kids in the computer access place right next door to Allen's office watched me do it after I explained some shit to them and they had told me that the new Neo Con government had cut the funding and they were about to be shut down. I tried blogging yours and Chucky Leblanc's way long before you dudes did or even before blogger existed All I got for my efforts was "Poof" so I decided to inhabit many people's blogs and use my blog to store email records. I kinda had to do so because the miserable bastards were killing my email account too. Plus i am always on the move and could access my blog anywhere to copy and paste and forward an email rather than rely on the integrity of email provider the blogs were a doublecheck. Whereas I blogged my emails in many places lots of people had a chance to read them. Plus if ya google just an email address you may stumble across some interesting reading about the person you are seeking.
I tell you this now because I am quiting emailing and blogging soon and going on with what left of the rest of my life.
That said I just had to give Garthy Baby Turner a little kick in the arse as he exits stage left from the building on the Hill in Upper Canada that he entered into from the right wing. That big talking little bastard who yaps on and on about big money knew who I was when we were both running in the election of the 39th Parliament. He and his staff have done nothing but laugh at me on the phone (I called him many times)and deleted all my comments in his blog as I tried to bust him in front of his friends. He really pissed me off when he expounded about the virtues of being an ethical Independent and buddied up with my enemy the very nasty french man Andre Arthur (Richard Côté should have listened to me if Ducceppe had let him that is) Then when he crossed the floor and joined the crooks on the other side after his little deal he was cooking with Dizzy Lizzy may fell through. That took the cake and everybody knew he was a monumental scumbag.
Since he brags that he won't be back for a couple of weeks maybe some folks will read my two bits worth this time around and I can turn the worm on that smiling Upper Canadian bastard.

Blogger’s second lawsuit against city put on hold
Charles LeBlanc contends members of the Fredericton Police Force have unfairly targeted him

A blogger with a contentious history with police and public officials agreed on Wednesday to a court order to have the second of two lawsuits he’s filed against the city put on hold.
Charles LeBlanc, best known in Fredericton for his social activism and community blog, had previously filed two notices of action in the Court of Queen’s Bench against the City of Fredericton.
In those lawsuits, the blogger contends members of the Fredericton Police Force have unfairly targeted him.
LeBlanc was in court on Wednesday, as the city’s legal counsel had filed a motion with the Court of Queen’s Bench seeking to have the second of the two lawsuits stayed or dismissed.
Lawyer Leanne Murray argued the two lawsuits basically make the same allegations, and the second one ought to be set aside.
But before Justice Judy Clendening could address that issue, LeBlanc put another matter before her: her recusal.
He asked the judge to recuse herself, arguing that based on his past dealings with her, he feels he won’t get a fair hearing.
“There’s no reason for me to recuse myself from the matter,” Clendening said.“We don’t have any personal history.”
LeBlanc asked for an adjournment, saying he wanted the city’s motion to be heard by an unbiased judge.
Clendening explained a recusal motion is premature, because it’s not known which judge will hear his lawsuit. She said Wednesday’s proceedings were simply designed to deal with the city’s motion.
When the judge made it clear she wouldn’t be stepping down, LeBlanc said,“Of course not.”
Murray also brought up another issue before the city’s motion was heard. She noted LeBlanc’s affidavit, filed in response to the dismissal/ stay motion, didn’t follow the rules of court.
She said the 55-paragraph document was replete with argument, opinion and irrelevant information, and noted all but two paragraphs and a few select sentences actually stuck to factual information, as an affidavit should.
“They should be struck, as they are improper,” Murray said.
“Did you understand the argument?” the judge asked LeBlanc, who’s representing himself in the matter.
“Of course not,” LeBlanc said again.
Clendening noted the affidavit was filled with innuendo and comments from other people, elements that shouldn’t be in such a sworn document.
“Why are we here?” the blogger asked the court.
The judge explained the city contends his two lawsuits are the same, and Murray was asking the court to either dispose of the second one or to stay it.
Clendening suggested she was considering a stay, which she explained to LeBlanc would mean it wouldn’t go away, just that it would be set aside until the first lawsuit is fully addressed and completed.
“It’s not dispensing of the (second) lawsuit,” she said. “And that’s not unreasonable.”
Murray noted her client would prefer if the second lawsuit were dismissed, as the city would likely still incur legal costs later.
Clendening said the city could bring a dismissal motion on the second lawsuit after the first is dealt with, and her client would be saving money now by agreeing to stay the second notice of action instead of arguing for its dismissal.
The judge told LeBlanc focusing on a single court action now would simplify things for him and the City of Fredericton.
She also noted it appeared the first lawsuit would be ready to be set down for trial within a few months.
Murray said a stay would be satisfactory, and LeBlanc agreed to the stay as well.
That eliminated a need for the court to rule on the propriety of his affidavit.
In his original lawsuit, LeBlanc contends the city police force started having it in for him after he video-recorded Const. Stephen Stafford’s use of force in the arrest of a soldier in Fredericton’s downtown bar zone in July 2009.
That video was used as evidence at the officer’s assault trial, at the end of which Stafford was acquitted.
After that trial, LeBlanc claims, members of the city police started targeting him and issuing bylaw tickets to him while ignoring similar infractions by others.
The blogger protested what he perceived to be unfair conduct using a bullhorn in front of police headquarters on Queen Street, which led to an arrest and prosecution for causing a disturbance.
LeBlanc pleaded guilty to that charge and was placed on probation in January 2012, and three days later, the city raided his home as part of a criminal libel investigation.
The city police alleged LeBlanc libelled a member of the force on his blog by alleging the officer touched him inappropriately and referred to him as a sexual pervert.
That libel probe didn’t proceed after the provincial Attorney General’s Office determined the relevant section of the Criminal Code of Canada was potentially unconstitutional.
LeBlanc has since received a document used to obtain a warrant in that case that referred to its being part of a child-sex exploitation investigation.
The police force has explained that was a copy-and-paste error, as the document in question, used to get information on online activity, was normally used in child exploitation probes.
LeBlanc rejected that explanation, and for a time, he started alleging members of the police force were pedophiles.
That led to a city complaint to his free hosting service about the blog, and the service took the blog down. LeBlanc launched a new blog shortly thereafter.
