NEW: the People's Alliance isn't dead yet. Party board president Rudy Walters says supporters are following the Elections NB process to re-register the party in time to run candidates in two Miramichi-area by-elections June 20.

Elections New Brunswick says a de-registered party can be re-registered 60 days later as long as it meets the same requirements as a newly formed party, such as having riding associations in at least 10 ridings.

So maybe Higg's gambit to block a PANB candidate in the byelection didn't quite pay off?
 

He has denied this was the motive but this could indeed scramble the electoral math on June 20.

People's Alliance supporters push to resurrect party ahead of June byelections

Party's only 2 MLAs crossed floor to PCs in March, seemingly bringing its run to an end

Supporters of the party, which seemingly dissolved less than a month ago, are seeking to re-register it with Elections New Brunswick in time to field candidates in two provincial byelections in June. 

Board of directors president Rudy Walters says there was unanimous support on the board for trying to carry on, despite the defection of the party's only two MLAs to the Progressive Conservatives.

"I've received a lot of support, a lot of phone calls and emails from people who were very upset by the move and who truly want to continue building on what we've developed so far," he said.

Leader Kris Austin and MLA Michelle Conroy made the stunning announcement March 30 that they were joining the PCs.

Only leader's signature needed

Austin said at the time that he had de-registered the party, a move that under provincial law requires only the signature of a party leader.

The provincial Elections Act allows a party to be re-registered after 60 days.

"We didn't stop existing as a party," Walters said. "We just simply were de-registered with Elections New Brunswick."

Chief electoral officer Kim Poffenroth said in a statement that a party can re-register if it follows the same requirements as a newly formed party, such as having riding associations in at least 10 ridings. 

Former Fredericton-York Alliance MLA Rick DeSaulniers is acting as interim leader until party members choose a leader May 28.

Austin, who founded the Alliance in 2010 and led it to its breakthrough win of three seats in the 2018 election, turned down a request for comment on the party's potential revival.

Last month he said he de-registered the party after consulting "several" board members because some members had quit the board and the internal structure of the party was "eroding" along with its public support.

Skepticism about revival

On a Facebook discussion of the effort to re-register the Alliance, some supporters questioned what it could accomplish without Austin in charge.

"The People's Alliance was Kris Austin," wrote Chris-Elisabeth Paisley, adding the party "won't be able to do anything without a strong voice."

Walters said he understands that sentiment, given "how big a personality" Austin was.

But he added, "the party had already grown bigger than Kris Austin and we've proven that with the work that we've accomplished over the past couple of weeks and where we expect to be in time for the byelections later in June." 

Voters in Southwest Miramichi-Bay du Vin and Miramichi Bay-Neguac will elect new MLAs June 20.

Walters calls both of them "very winnable" ridings.

The Alliance came within 35 votes of winning Southwest Miramichi-Bay du Vin in 2018, and its 11 per cent of the vote in Miramichi Bay-Neguac in 2020 would have allowed the PC candidate to beat the Liberal winner.

Walters said the Alliance had already chosen Thomas L'Huillier as its candidate in Miramichi Bay-Neguac before the de-registration on March 30 and he will be on the ballot in June.

Another candidate who had planned to run in Southwest Miramichi-Bay du Vin will soon be approved to run there.

Party supporters see a purpose

Walters said there's still a need for the Alliance.

"It's a rotating cycle of Liberal and Conservative governments that do nothing to further the cause of everyday New Brunswickers," he says.

"If people truly want change, then supporting parties like ours is how you effect that change." 

One challenge for the party is fundraising.

When the party was de-registered, $150,000 in cash and equipment was turned over to the provincial supervisor of political financing, who after paying off any debts must hand it over to the provincial treasury.

"We have to start from scratch," Walters said.

The party is looking at legal options to get the money and assets back, but he said even if successful, it won't have it in time for the byelections so the focus is now on raising money for those campaigns.

Poffenroth said in a statement that the provincial election law "does not provide for returning any of the funds forfeited to a party or its district associations."

The following people listed in alphabetical order have let their names stand for the Board of Directors positions.  Please review their bios.  The virtual AGM to beheld on November 20th and instructions about participating will soon be communicated.

Sharon Buchanan

Sharon lives in Riverview where she and her husband Mark have raised two amazing daughters and countless fur-children and are now enjoying being grandparents to an amazing little boy for whom they have many hopes and dreams. Sharon has worked for many years as an Operations Supervisor for Asurion, and for the past ten years has had the opportunity to enter early into the virtual world and support a team of experts across North America.

Sharon believes strongly in balanced policies and practices that unite, foster cooperation and accountability, and improve the quality of life for citizens. She has been fortunate enough to find these values reflected in the People’s Alliance and has been proud to support the party in many ways. Sharon is honored to have served as President of the Provincial Board for the past two years.

Craig Dykeman

Craig Dykeman is a 2 time PANB candidate and a current PANB board member. He returned from Alberta after 20 years in firefighting, industrial and natural disaster emergency response, wild well control specialist, and business management. As a full time single father, he understands the struggles families have in new Brunswick day to day from family doctors to finding affordable daycare, and the massive increases in daily living costs.

The fact that the current government has led NB to the highest inflation rate in the nation under a cloak of secrecy while writing letters for refineries and massive tax discounts for sawmills while the citizens are going doctorless, homeless, and hungry just doesn’t sit well with Craig. This province has lost its connection with the people and no longer serves the best interest of the people Kris Austin has a vision and a plan to return this province back to the people and I plan on standing with Kris in this fight.

Barbara (Laurie) Higgins

Laurie has always lived in New Brunswick, she is married with a multi-generational family. Laurie has enjoyed a nursing career spanning a 30 plus year time frame, as a staff nurse, manager and educator, retiring in 2017. Currently she is assisting Public Health with the role out of vaccines for COVID Clinics, as well as influenza vaccines for the staff within the Horizon Health Network. For ten years from 2008 until 2018, Laurie was involved in medical missions to the Dominican Republic. Laurie believes in fair education for all New Brunswick students with a focus on equal standards of curriculum both for francophone and anglophone students. She believes that cursive writing, shop and home economics should be re-introduced in the school system to help support adults for tomorrow. Laurie wants a decrease to elimination of glyphosate spraying in our forests and under power lines. She would like a decrease to elimination of clear cutting in our forests to mitigate climate change and increase the diversity of our forests, while moving towards selective cutting and forest management. Laurie believes in fair taxation, not only elimination of double taxation, but fairness in home ownership. Finally, Laurie believes that people only value something if they invest themselves and work hard.

Jason Innes

Jason lives in Saint John with his wife and two children. He is a graduate of NBCC’s business administration program with a focus in accounting and is Lean Six Sigma Black Belt certified. Jason is a data analyst with CGS Inc and has volunteered with the Red Cross, Junior Achievement, Home and School, and PSSC. Jason has a long history in political involvement. He was the policy committee chair for the Calgary Centre PC Association and a member of several PC campaigns in both Alberta and New Brunswick. Jason won the Jim Dunning Award as the top PC youth activist in Alberta in 2000. Jason has been heavily involved with the PANB. He has held executive roles on the board of directors including Vice President and President. Jason ran as a candidate for the PANB in 2014 in the Saint John East riding and has helped with several PANB campaigns.

Randall Leavitt

Randall and his family reside in Fredericton, NB. He has been a member of the party since 2010. Randall has been a past board member of the People’s Alliance, holding the Secretary chair and a couple others over the span of 5 years. His past duties and roles included setting up Riding Associations, Master of Ceremonies at AGMs, Town Halls and various events. He was part of the team to develop and plan for elections, meetings and contributed to debate panels and overall strategy and goal setting. He ran as a candidate in the 2015 Bi election for Carleton, and helped several candidates with door knocking, phone calls, fund raising and riding engagement.

Randall works in the non profit housing industry and has past experience working as an EA in the education system as well as business ownership and management. He is passionate about political change to ensure the betterment of New Brunswick drew him to the People’s Alliance and continues to be something he is committed to.

Tom L’Hullier

Tom lives in Beaverbrook with his wife. Tom has worked in many fields, but carpentry has always been his passion and hobby. Tom has also taken a course in PSW2 nursing so he understands the concerns with what we are facing today and will be facing tomorrow. Tom believes that Covid is not going away it's here to stay and our new norm. Tom and his wife host a full-time therapeutic foster home. They understand the challenges of our children of today and the increasing drug addiction in our community. They also have a small farm with chickens and ducks. Tom has been involved with the PANB since it was founded and is very passionate about his community. Tom is looking forward to helping move this province forward.

Larry Lynch

Larry lives in Miramichi where he has been an entrepreneur with a background in online media. Larry is the treasurer for the Miramichi RDA and has been on the provincial board of directors for two terms. He has been the campaign manager for both of Michelle Conroy’s successful campaigns.

Frank Mullin

Frank Mullin graduated from Millerton Rural High School in 1965. He is happily married with three children. Frank is currently retired but worked with NBTel for over thirty years before working with Social Development. Frank is an active volunteer and currently a member of the Luxor Shriners.

Frank has served the party as its executive director in the past, during the largest expansion the party has seen. He has been the past secretary and president of the Southwest Miramichi Bay du Vin riding association.

Gerry Redmond

Gerry is currently retired but served as the Executive-Director at Maritime College of Forest Technology. He lives on Keswick Ridge and operates a Christmas Tree Farm and maple sugar bush. Gerry has held several roles relating to forestry, wildlife, and biology. Gerry is bilingual but his French is a bit rusty.

Gerry has been involved with several political paties both provincially and federally but has been committed to the PANB since joining. Gerry believes in reduced government, proper planning, and that fear is the thief of dreams.

Aaron Richter

Aaron was born in Ontario in the late 1980s and moved to the Hopewell Cape area of Southern New Brunswick at age 7, where he graduated with Honors at Caledonia Regional High School. From there Aaron intended to pursue a career in criminal law and was going to start that journey at Saint Mary's University in Halifax via their 'pre-law' philosophy program. Aaron fell in love with Academic Philosophy, which is the pursuit of truth via analytic logic. His focus at the bachelor level was the study of Ethics and he minored in Political Science until he graduated again with a Bachelor of Arts - Philosophy in that discipline. Thereafter Aaron pursued a Master's Degree in Philosophy one day intending to be a professor.

Aaron currently lives in Albert County, where he has recently been fortunate enough to buy a house which he has made his home. He feels he has been exceptionally fortunate to find a good career in Moncton, but knows this is a challenge for man. Aaron believes that the government should be supportive of the free market, guiding it only where necessary to afford New Brunswickers opportunities to apply themselves and improve their quality of life.

Bob Vautour

Bob Vautour is a status first nations Mi'kmaq from Ugpi'Ganjig in northern NB. he currently lives on his beautiful country property in Lewis mountain just outside Salisbury with his wife and their dogs. Bob is very passionate about the outdoors and human rights. Bob has been involved with the PANB as an active member of the board of directors.

Rudy Walters

Rudy Walters is a family man who resides in Riverview, NB. He is a veteran of the Royal Canadian Navy and is currently the director of sales for an HVAC wholesaler that specializes in energy efficient solutions. Rudy is an active member of the community and volunteers with several important organizations.

Rudy has been a member of the PANB since 2014. Since then, he has organized the campaigns of two candidates, he is the President of the Riverview Riding Association, he is the Vice President of the current board of directors, he organized the platform release press conference in 2018, he organized the policy convention in 2019, and he represented the PANB on CTV's panel of political pundits in 2020 as the election results came in. Rudy Walters is committed to growing the party membership back to 2018 numbers before the next election and is excited at the opportunity to continue expanding this important movement.

 I just watched the interview The Miramichi Police and Fredericton
 Police had with the only witness. My God? It's disgusting!!!! They
 even called the idiot so-called Poet the victim!!!! I'm the victim and
 not him!!! Something IS VERY Wrong with our Justice System!!!

 I'm going to hand deliver my complaint the next 24 hours!!!!

     Im not from New Brunswick but its not hard to tell there are no
 rules for police in your province. The more I read your blog the more
 I understand why that police shooting happened in your province, even
 the Chinese communist party punishes wrong -doers but in New Brunswick
 it seems like there arent any rules for public officials so its not
 surprising people have taken the law into their own hands and will
 continue to do so...

Good evening friends,

Apparently Mr. Amos has spoofed my email address (bigshine92@gmail.com) and
is making it look like we've been in correspondence.  I have not, and am
not in correspondence with him, though he did send me all those articles
which I simply deleted.

He did call me today (as he did throughout the last election to which I
filed an RCMP complaint) and I politely asked him not to contact me again.
This must be his way of 'having fun' as he claimed he was going to have.

>>>> 60        In Canadian law, one standard has now emerged as the
>>>> criterion for disqualification. The criterion, as expressed by de

>>>> disqualifying conflict of interest in this case. In my view, there are
>>>> two significant factors that justify the trial judge's decision not to
>>>> recuse himself. The first is his statement, which all parties accept,
>>>> that he knew nothing of the case when it was in his former firm and
>>>> that he had nothing to do with it. The second is the long passage of

>>>> Patterson Law, nor does Mr. Amos suggest that he did. Mr. Amos made it
>>>> clear during the hearing of this matter that the only reason for the
>>>> alleged conflict for Justice Webb was that he was a member of
>>>> Patterson Law and Patterson Palmer. This is simply not enough for
>>>> Justice Webb to be disqualified. Any involvement of Mr. Amos with
>>>> Patterson Law while Justice Webb was a member of that firm would have
>>>> had to occur over 10 years ago and even longer for the time when he
>>>> was a member of Patterson Palmer. In addition to the lack of any
>>>> involvement on his part with any matter or dispute that Mr. Amos had
>>>> with Patterson Law or Patterson Palmer (which in and of itself is

>>>> [20]           Similarly in R. v. Bagot, 2000 MBCA 30, 145 Man. R.
>>>> (2d) 260, the Manitoba Court of Appeal found that there was no
>>>> reasonable apprehension of bias when a judge, who had been a member of
>>>> the law firm that had been retained by the accused, had no involvement
>>>> with the accused while he was a lawyer with that firm.
>>>>
>>>> [21]           In Del Zotto v. Minister of National Revenue, [2000] 4
>>>> F.C. 321, 257 N.R. 96, this court did find that there would be a
>>>> reasonable apprehension of bias where a judge, who while he was a
>>>> lawyer, had recorded time on a matter involving the same person who
>>>> was before that judge. However, this case can be distinguished as
>>>> Justice Webb did not have any time recorded on any files involving Mr.
>>>> Amos while he was a lawyer with Patterson Palmer or Patterson Law.
>>>>
>>>> [22]           Mr. Amos also included with his submissions a CD. He
>>>> stated in his affidavit dated June 26, 2017 that there is a “true copy
>>>> of an American police surveillance wiretap entitled 139” on this CD.
>>>> He has also indicated that he has “provided a true copy of the CD
>>>> entitled 139 to many American and Canadian law enforcement authorities
>>>> and not one of the police forces or officers of the court are willing
>>>> to investigate it”. Since he has indicated that this is an “American
>>>> police surveillance wiretap”, this is a matter for the American law
>>>> enforcement authorities and cannot create, as Mr. Amos suggests, a
>>>> conflict of interest for any judge to whom he provides a copy.
>>>>
>>>> [23]           As a result, there is no conflict or reasonable
>>>> apprehension of bias for Justice Webb and therefore, no reason for him
>>>> to recuse himself.
>>>>
>>>> [24]           Mr. Amos alleged that Justice Near’s past professional
>>>> experience with the government created a “quasi-conflict” in deciding
>>>> the cross-appeal. Mr. Amos provided no details and Justice Near
>>>> confirmed that he had no prior knowledge of the matters alleged in the
>>>> Claim. Justice Near sees no reason to recuse himself.
>>>>
>>>> [25]           Insofar as it is possible to glean the basis for Mr.
>>>> Amos’ allegations against Justice Gleason, it appears that he alleges
>>>> that she is incapable of hearing this appeal because he says he wrote
>>>> a letter to Brian Mulroney and Jean Chrétien in 2004. At that time,
>>>> both Justice Gleason and Mr. Mulroney were partners in the law firm
>>>> Ogilvy Renault, LLP. The letter in question, which is rude and angry,
>>>> begins with “Hey you two Evil Old Smiling Bastards” and “Re: me suing
>>>> you and your little dogs too”. There is no indication that the letter
>>>> was ever responded to or that a law suit was ever commenced by Mr.
>>>> Amos against Mr. Mulroney. In the circumstances, there is no reason
>>>> for Justice Gleason to recuse herself as the letter in question does
>>>> not give rise to a reasonable apprehension of bias.

>>>> [27]           Following the Judge’s decision to set aside the
>>>> Prothonotary’s Order, this Court revisited the standard of review to
>>>> be applied to discretionary decisions of prothonotaries and decisions
>>>> made by judges on appeals of prothonotaries’ decisions in Hospira
>>>> Healthcare Corp. v. Kennedy Institute of Rheumatology, 2016 FCA 215,
