Provincial enforcement officers handed out more than $20,000 worth of tickets for alleged violations of the province's Emergency Measures Act between the beginning of April and the end of May.

The data, obtained by CBC News through access to information, includes the date the ticket was issued and the "area of offence," but doesn't provide any information on what the person allegedly did to warrant a ticket with a $292.50 fine.

"The specific reason for violating the emergency order is documented in each ticket but is not collected for statistical analysis," Department of Public Safety spokesperson Coreen Enos wrote in an email. No one from the department was made available for an interview.

The figures show that provincial ticketing has been concentrated near New Brunswick's border with Quebec and in rural communities with small populations. For example, tiny communities like Hoyt, Cornhill and McKees Mills appear on the list of communities where tickets were given out.

Meanwhile, two of the province's three largest cities — Saint John and Moncton — saw only one ticket each during the nearly two-month span. No tickets were given out in three counties clustered in the western part of the province: in York County, where Fredericton is located, as well as Carleton and Victoria counties.

The two most-ticketed communities are both near the border with Quebec. In Saint-Jacques 12 tickets were issued and in the city of Campbellton, ten were issued. The tiny village of St. Martins was the third most-ticketed community, with five tickets all handed out on April 19.

The 70 tickets were all issued by provincial enforcement officers and don't include tickets that have been written by police.

The data indicates that only two of the 70 cases have resulted in convictions, while the rest are listed as "not completed." The province confirmed that means only two of the 70 fines have been paid, for a total of $585 collected by the province.

McClelland would like to see the tickets withdrawn across the country, saying that people aren't clear on what recourse they have when they receive a ticket.

Unclear how many tickets issued by police

Most police forces contacted by CBC News would not reveal how many tickets they've handed out, noting that fines are a last resort.

"The New Brunswick RCMP is not releasing the number of tickets that have been issued as issuing tickets is only one part of our enforcement efforts and does not reflect all of the work that is being done collaboratively with communities, our policing partners and the province," New Brunswick RCMP spokesperson Cpl. Jullie Rogers-Marsh wrote in an email.


An example of a $292.50 ticket handed to New Brunswicker Keith Gagnon in April for allegedly not following physical distancing rules. At least one researcher says the tickets should be withdrawn across the country. (Submitted by Keith Gagnon.)

The Saint John Police Force, Fredericton Police Force, Grand Falls Police Force and Bathurst Police Force also refused to say how many tickets they've issued.

"In all cases, from the information received from members, they were blatant cases of disregard for the mandatory order that put the public health safety of others at risk," Bathurst police chief Ernie Boudreau wrote in an email.

BNPP Regional Police Force, which patrols several small communities on the Bay of Chaleur, has not issued any tickets, according to Chief Charles Comeau, while the Woodstock Police Force has only issued one.

McClelland believes it's crucial for police to be open about how they're enforcing emergency rules and who is being ticketed.

"In the context of the pandemic, this is something that has never been tested before," he said.

"We don't know if ticketing people for [not] social distancing or physical distancing actually even works. So I think police need to be transparent about how they've been mobilizing this so that we can kind of hold it to account and measure it and ask questions about it."

In any other province I would not ticket them, because the reality is to let them get covid and the survivors would not be able to infect others later, however in the maritimes where premiers' election platforms will be how they micromanaged Covid, repeat offenders should be sent to prison or at least workhouses if they can't pay for the tickets.

Because we had the lock down and people stopped moving, the virus could not find other hosts to pass itself along to others, and the chains of transmission were stopped.

These public health measures were and are necessary to counter a virus in a global pandemic - if people followed guidelines then they wouldn't have to be mandatory - but if too many people put themselves before the greater good - and we're seeing too many people wanting to make exemptions for themselves - then we lose the battle against this virus. If everyone makes exemptions for themselves, then the measures mean nothing because no one will be following them.

"Everything we do before a pandemic will seem alarmist. Everything we do after a pandemic will seem inadequate. This is the dilemma we face."

If we do everything right, it will look like we overreacted. We're victims of our own success in a way, because it appears that we did too much, appearing as if there was no threat to us at all and that all the measures were overkill, but they are not and we did not, because it was what was needed at the time to keep outbreaks under control.

Now as cases pop up we need to continue to quickly isolate and contact trace to contain the spread and eradicate outbreaks while the outbreak is small.

We used to quarantine on islands. Now we're proactively quarantining in the privacy of our homes. It's either those coming in quarantine proactively, or we all have to quarantine and be sick afterwards if the person was sick and did not quarantine as they should have and instead spread it around. It's better, wiser, more prudent to be proactive than reactive. It's upfront pain for long term gain.

It seems counter intuitive that as we start to open up here, for other measures to remain or even be stepped up, like mask wearing inside or out in public when maintaining distance from others isn't possible. Reply to @Mary Smith: If we drop all the public health measures, and return to the old normal instead of the new normal, the virus could be spreading like a silent tsunami through the entire population, and by the time we realize we're in serious trouble it'll be too late. This is not some hypothetical scenario, this is what will happen if we all do not be careful and keep up with the public health guidelines.

We have seen just a tiny sliver of the population fall ill to this virus, and with the Spanish Flu it was the second wave that proved most deadly and damaging in scope and scale of those who fell ill to it - the healthy and the young alike. If we do not learn from history we are doomed to repeat it.

Will Covid-19 follow a similar path? We don't know, only time will tell. But we should prepare for the worst, and assume that it's possible - because it very much is - and pretending that it's not possible for a terrible second wave is burying your head in the sand and denying the very real possibility that it is.

Be alert, not anxious, follow public health guidelines and the emergency act, because it shows respect to the severity of the situation we find ourselves in and respect for our fellow NB'ers.

Assume the worst is possible, but hope for the best, but it is through all of our individual actions and by following of the public health guidelines and the emergency act that we can respond to this global pandemic and come out on top, appearing like we did too much but then it will have been exactly what was needed to keep us healthy and well. To be proactive, not reactive.

The war measures (now emergencies act) declared federally is the only way charter Rights are temporarily suspended. At the moment all of these states of emergency are declared at the provincial level, leaving charter rights intact, hence the proposed challenges by the CCLA. Who was sleeping now?

So you were correct that the federal act does not apply here, but I was correct in that your charter rights have been legally put on hold, so those rights are NOT being violated. Today, I am going to tell you the absolutely insane story of Walter Matheson. Matheson was finishing his muffin and coffee alone in his car in a New Brunswick Tim Hortons parking lot before he carried on with his day. A pretty normal Canadian thing to do amidst the coronavirus lockdown that has been anything but normal.

Walter was doing the safe thing: eating THEN driving. However, he was given a $300 ticket for violating the province’s coronavirus regulations. Why? The cop who wrote the ticket told Walter his presence might attract teenagers to loiter in the same parking lot!

Solitary retirees eating muffins in parking lots might bring all the youngsters to the streets to spread the coronavirus has to be the one of the silliest things I have heard lately — and I watch those Trudeau daily press conferences from outside his Rideau mansion, so I know silliness.

Even crazier, Walter did try to leave the coffee shop parking lot when the police officer first asked him to. He even joked a little with the cop. However, the police officer prevented Walter from driving away when Walter politely questioned the ridiculous reason he had to leave before he finished his muffin - that he was some sort of strange magnet for high schoolers. Then the officer ticketed Walter for not leaving when he was first directed to!

This whole story is utterly unbelievable. I wouldn’t believe it if someone told me the story without proof. But I know it happened because Walter, very wisely, recorded the entire interaction he had with the cop.

2. Each Party shall adopt or maintain codes or standards of conduct
for the correct, honourable and proper performance of public
functions, and measures providing for disciplinary or other measures,
if warranted, against a public official who violates the codes or
standards established in accordance with this paragraph.
3. Each Party shall, to the extent consistent with the fundamental
principles of its legal system, establish procedures through which a
public official accused of an offence described in Article 27.3.1
(Measures to Combat Corruption) may, as considered appropriate by that
Party, be removed, suspended, or reassigned by the appropriate
authority, bearing in mind respect for the principle of the
presumption of innocence.
4. Each Party shall, in accordance with the fundamental principles of
its legal system and without prejudice to judicial independence, adopt
or maintain measures to strengthen integrity, and to prevent
opportunities for corruption, AMONG MEMBERS OF THE JUDICIARY in
matters that affect international trade or investment. These measures
may include rules with respect to the conduct of members of the
judiciary.
