Calgary mayoral candidate Kevin J. Johnston has been sentenced to 40 days in jail to be served on weekends for what the judge has previously described as "out of control" behaviour.
For months, Johnston has incited followers to defy public health measures in place to control the spread of COVID-19.
Court of Queen's Bench Justice Adam Germain accepted the joint sentence recommendation, which includes paying Alberta Health Services' legal fees of $20,000 and obeying public health orders going forward.
"If Mr. Johnston had used his considerable powers of persuasion to get people to wear masks, socially distance, take vaccines, Alberta would not now be in its fourth crisis wave of this pandemic," said Germain.
"People in Alberta are dying, some are dying alone, some are dying gasping for breath, some are dying crying for opportunities lost and loved ones missed."
AHS in 'death struggle'
Johnston was sentenced for breaching three judges' orders aimed at controlling the behaviours of pandemic-denying, anti-mask leaders in Alberta.
Not only did Johnston defy the public health orders, he took to various social media channels to post angry, hateful videos encouraging others to do the same.
Johnston was sentenced Wednesday, one day after Alberta announced nearly 5,000 new cases of COVID-19 over the long weekend with more than 600 people in hospital.
"AHS is frankly in a death struggle trying to keep people alive," said the judge.

Johnston's weekend sentence means he will show up at jail on Friday and be released Monday morning. That means come municipal election day, Johnston will not be behind bars.
In Calgary, few rules bar someone from running for mayor. Mayoral candidates cannot owe the city money and cannot have violated election laws. Criminal convictions and pending charges do not preclude a candidate from entering the race.
More court troubles for Johnston
This is the latest in Johnston's months-long court dealings in three provinces.
In May and June, Johnston spent the equivalent of seven weeks in jail for harassing and threatening an AHS inspector as well as causing a disturbance at a downtown Calgary shopping mall when he berated shop staff who demanded he wear a mask.
Last week, Johnston pleaded guilty to a hate crime in Ontario for numerous anti-Muslim online posts in 2017.
After Johnston targeted a Muslim restaurant owner in 2019, a judge ruled in favour of the Toronto businessman, awarding him $2.5 million in the defamation lawsuit for Johnston's "loathsome example of hate speech at its worst."
Johnston was found in contempt in Ontario for continuing to post hateful, harassing comments online and has not yet been sentenced for that crime.
He also has yet to be sentenced for the hate crime conviction.
Johnston also faces a charge of assault in B.C. and has yet to go to trial.

Kevin J. Johnston gets probation after pleading guilty to harassment, disturbance charges in Calgary

Controversial mayoral candidate and far-right social media personality Kevin J. Johnston pleaded guilty to a pair of recent criminal charges in a Calgary court Monday morning.
Johnston faced charges of harassing an Alberta Health Services employee and causing a disturbance at a downtown Calgary shopping centre.
“We were able to resolve them in a way that was fair,” Balfour Der, Johnston’s lawyer, told Global News.
“My client admits these offences were committed. In terms of that, he was probably over-enthusiastic in the message he was trying to send.'
On Monday, the court heard an impact statement from the AHS employee saying she was afraid for her and her children’s safety and didn’t feel safe leaving her home.
A joint submission from the Crown and defence agreed to have Johnston serve two concurrent nine-month probation periods — one in relation to the harassment charge and one for the disturbance charge.
Johnston is not to enter the CORE Shopping Centre as part of his probation terms. He’s also not allowed to be within 200 metres of the AHS employee or her family. Johnston was ordered not to post pictures or videos of her or any AHS employee.
He is also not to leave the province during his probation but was given an exemption to return to visit his family in Ontario for three weeks starting July 16.

On June 30, Calgary police said the harassment incident took place between April 24 and May 22 and included “threatening conduct directed at the victim in person, on social media and online.”
He was originally arrested on May 26 on a Criminal Code warrant for causing a disturbance and being part of an illegal gathering on May 22 at the CORE Shopping Centre.
At the time, police said Johnston entered stores without wearing a face mask — then a requirement under provincial and municipal mandates — and allegedly verbally abused employees who requested he don a mask. Johnston left the stores only to return with others joining in on the verbal harassment, police said.

Johnston has been in police custody since the May arrest, amounting to 48 days in custody.
“The amount of time that he was in custody — 48 days — is a long period of time, especially for these types of offences,” Der said. “Nevertheless, he was detained by two different judges.”
Johnston is due to be released from police custody later on Monday.
Der said Johnston faces one more set of criminal charges stemming from the Drumheller area, a matter that has been adjourned until September. Der said he hopes those are resolved in a similar matter.
AHS has filed a defamation lawsuit against Johnston, seeking $1.3 million in damages for allegations that have yet to be proven in court.
In May 2019, Johnston was ordered by an Ontario judge to pay the owner of a prominent Middle Eastern restaurant chain $2.5 million after publicly accusing him of funding terrorism.
Alberta’s Local Authorities Election Act does not preclude anyone with a criminal record from running for municipal office. Convictions under election acts from the past decade or owing the city money would disqualify an individual from running.

The definitive history of Kevin J. Johnston: Hateful Ontario loser
Kevin “Jackal” Johnston is in pre-trial custody until his trial on July 12 following a series of anti-lockdown stunts in Calgary, Edmonton and Dawson Creek, BC. He’s been in the news recently as a mayoral candidate in Calgary, but what you might not know is that he has a storied history out east, too.
Johnston
can be difficult to pin down. Much of his most controversial commentary
and behaviour has been removed, altered or unpublished from social
media—sometimes by court order or as a result of his victims’
complaints.
Johnston
cuts a figure somewhere between an overly entitled suburban dad and an
AM radio shock-jock. After going around the horn a bit on whether it is
journalistically acceptable to call Johnston a loser, I have settled on
this fact: he has made losing—prolifically—into a personal passion. He
consistently loses nearly every single court case he finds himself in,
often representing himself. Johnston seems to believe fervently that
there’s no such thing as bad press and wears his many losses with pride,
referring to himself as “Canada’s most censored man.”

A 2008 obituary for father David Johnston
indicates that Kevin Johnston was once a family man with a wife and
children. He lived with them in the upper-middle class Meadowvale
neighborhood of Mississauga, Ontario.
Prior to 2014 Johnston seems to have been a quasi-public figure in the city of Mississauga. His website advertised him as a court process server
in 2010. He was known as a disc jockey debuting as the somewhat
prophetic “DJ Asshole,” eventually settling on “DJ Jackal.” Johnston was
known as a comedian, lacrosse coach, comic book artist and for his annual ‘haunted house’ that he seems to have spent a substantial amount of time and resources on organizing. In 2014 Johnston described his primary vocation to Toronto.com as “talk-training” in which he “instills confidence in men who have trouble talking to women.”

His Meadowvale family home is mentioned in a 2014 Toronto.com article in relation to a dispute Johnston had with a city bylaw officer
over a backyard roller-rink. It appears this dispute was something of
an inflection point in Johnston’s life, which he claims inspired him to
pursue a life in municipal politics.
Foreshadowing
much of what was to come, Toronto.com’s John Stuart also reported that
in 2014 Johnston sent a photograph of himself, naked and in blackface, performing a Nazi salute with a picture of Nelson Mandela taped to his genitals, to members of the Peel Region school board, including former board Education Director Tony Pontes.
“I
did not keep any record of my dealings with Mr. Johnston,” said Mr.
Pontes, pointedly, in response to an inquiry about the communication.
In 2014, Johnston became one of 15
candidates to put their names forward in the race to replace the
venerable Hazel McCallion as mayor of Mississauga.
Foreshadowing
a pattern of personal intimidations and abuse of court process, Ward 8
Councillor Katie Mahoney called Peel Regional Police after Johnston
attended her residence to serve her in connection with a $5 million
lawsuit against her husband (and Johnston’s mayoral rival) Steve
Mahoney. Also named in that lawsuit was Bonnie Crombie, who wound up
winning the election and becoming mayor of Mississauga in 2014.
Mahoney told Mississauga.com that she saw a photo on Johnston's Twitter account which was taken at the front door to her home.
Ultimately, Johnston received 741 votes in the 2014 Mississauga election, finishing third to last, only a few dozen votes behind Neo-Nazi candidate Paul Fromm.
Of course the weirdness didn’t stop
there. In 2016 Kevin made a series of videos targeting, of all things,
the Ontario Lacrosse Association. The OLA issued a statement distancing itself from an ‘unsanctioned’ “full contact” ‘Kevin J. Johnston Cup’.
The OLA also expressed grave concern that its staff and volunteers had been “subjected to unkind, unfair and deceitful commentary” and formally sanctioned Mr. Johnston for misconduct.
Johnston sued the OLA but a civil court judge rejected Johnston’s statement of claim on the grounds that it was “frivolous and vexatious.”
Hate Activities

In October 2016, Mississauga Mayor
Bonnie Crombie filed a hate-crime complaint with Peel Police after
Johnston published an article on his now defunct blog, the Mississauga
Gazette.
The
article was titled “Bonnie’s Muslims Are Molesting Teenage Girls in
Mississauga Highschools,” and it claimed that Crombie favoured
integration of Muslims in Mississauga so that “they could kill her son
just for being gay.”
Johnston also called federal liberal MP Iqra Khalid a “terrorist scumbag” and expressed a desire that she be “shot by a Canadian patriot.’”
In March 2017, Johnston offered a $1,000 bounty for video recordings of Muslim students praying in Mississauga Schools, Ontario.
In July of the same year, the Peel Regional Police arrested and charged Johnston with wilfully promoting hatred against an identifiable group, citing “multiple incidents” over five months across many online platforms.
In July 2017, following his arrest, Rebel Media founder Ezra Levant interviewed Johnston who claimed Canada would “fall apart if I go to prison.” This is a theory which has been disproven. At the time of this writing, Johnston is presently in custody and previously spent time behind bars in 2020, at Ontario’s Maplehurst prison in relation to a contempt charge.

In July 2017, Johnston and Canadian
anti-Muslim activist Ranendra (Ron) Banerjee recorded themselves during a
protest by the anti-Muslim group PEGIDA at Paramount Fine Foods, where a
Liberal Party fundraiser was being held. Johnston suggested the
Arab-owned business was a front for terrorism and that Prime Minister
Justin Trudeau supported this.
The owner of the chain, Mohamad Fakih, filed a claim in July 2017 and sued for defamation. In 2019, Johnston was ordered to pay a $2.5 million dollar judgement to Fakih after being found guilty of defaming the restauranteur.
Also
in 2017, Johnston brought a $500,000 statement of claim against a
numbered corporation and numerous individuals associated with it,
alleging psychological distress and depression as a result of an alleged
trespassing incident. Johnston was ordered to pay a $1,000,000 Ontario
Superior Court judgment in the lawsuit with the property owners (Poulie
et. al). While the lawyer for the property owners did not respond to a
request for comment, court records indicate that the Poulie et. al
matter was in an Ontario court for a contempt hearing on May 25, 2021.
Johnston ran again for the Mississauga Mayoralty in 2018. A campaign filing shows Johnston spent $8965 on his campaign, and lists no donors or contributors. While
he lost again, a surprisingly large number of Mississauga voters
(16,079, or roughly 13.5%) voted for him, putting him in second place.
Look out, Calgary. It could happen to you.
Kevin vs. Kevin
I first crossed paths with Kevin J.
Johnston at the ‘Million Canadian March’ a far right protest held June
3, 2017 at Parliament Hill in Ottawa. Attendance for the event was not
quite as advertised—about 996,000 short.
I
had been assaulted in Toronto while filming at an anti-Muslim protest
three weeks prior. I was in Ottawa to document the protest, but also to discuss the assault with CBC.
As Canadaland noted in their initial coverage of events,
Johnston tweeted nine invitations to local antifascist activists to
come find him on Friday June 2, He also explicitly ‘dared’ them to come
out and fight him.

The morning of June 3, prior to the CBC interview on Parliament Hill, myself and a colleague (Evan Balgord, who would go on to found antihate.ca) entered a diner on Elgin Street for breakfast. As we were paying our bill, I noticed a group had just been seated in a back booth. I approached them, recognizing Kevin J. Johnston, Faith Goldy (failed Rebel Media employee turned failed Toronto mayoral candidate) and others at the table. I greeted them, captured a quick video and left the restaurant. We then headed up Elgin Street to the CBC interview.
Per his own account, Johnston left the diner and attended Confederation Park where he got stuck in with a group of antifascists who were gathering to oppose the far right rally. Johnston and his cameraman Michael McCormick sustained cuts and bruises and allegedly lost a camera. Johnston called the police and reported a knife attack, also claiming that someone had pulled a gun on him, and demanded that the antifascists be arrested.
Ottawa Police obliged him and arrested multiple antifascists for the alleged ‘assault’. Bizarrely, that night, Johnston began a series of livestreamed videos alleging that I had been present for the assault, that I had filmed it, that I was an ‘antifa domestic terrorist,’ a ‘stalker of women,’ a ‘loser’ and that I was somehow involved in an assault on him—which occurred while I was miles away at the CBC studio.
Having become the subject of some
weird disinformation simply because I’d become known to him as an
opponent, I felt it pretty important to protect my reputation. I sued
Johnston for defamation in small claims court with the help of Stephen
Ellis, of Ellis Law.
Almost
two years later, in 2020, after many delays related to Kevin and his
paralegal parting ways and subsequent self-representation, we won a $25,000 default judgement at trial. A bitter Johnston chose not to attend the trial but rather, livestreamed his reaction on Facebook.
Now here it is, 2021 and he’s running for Mayor of Calgary, from inside a cell, no less. In keeping with what I now consider to be my civic duty, I am trying to collect from Mr. Johnston. Once I have acquired a lawyer in Alberta I intend to secure the garnishment of his racist coffee, hats signed by jailbirds, livestream donations and whatever other revenue streams he has in his name.
He just keeps losing
Despite his multiple arrests, detention and near-universal condemnation Johnston is still running for mayor in Calgary, often referring to himself as the mayor-elect. The threats he’s made to Alberta Health Services employees have resulted in Elections Calgary revising its policy about sharing the names and addresses of voters with candidates and AHS has launched a $1.3 million defamation suit against Johnston.
Johnston revels in negative attention and he’s certainly been successful in attracting it. But don’t assume that his unpopularity makes him irrelevant. Remember more than 16,000 Mississaugans voted for this man in 2018. Take it from me, someone who has had to deal with all the unpleasantness this man can muster, up close: the good people of Calgary need to send a message to this loser at the ballot box this fall that Kevin J. Johnston is not welcome in their city.

'Belligerent' Calgary mayoral candidate pleads guilty to criminal charges on Day 1 of trial
Kevin J. Johnston has been in custody since May 26
Kevin J. Johnston pleaded guilty to criminal harassment of an Alberta Health Services employee whose family photos he posted online along with threatening messages.
Johnston was also convicted of causing a disturbance at the Core shopping centre when he became belligerent with employees after being asked to wear a mask.
Arrested on May 26, Johnston has served about 10 weeks, when enhanced credit is considered, and will be released later Monday. He'll be subject to probation conditions for nine months.
'Belligerent and aggressive'
Provincial court Judge Harry Van Harten accepted the facts agreed upon by defence lawyer Balfour Der, his client and prosecutor Peter Mackenzie.
According to the facts, Johnston became "belligerent and aggressive" at the mall and caused employees to fear for their safety, believing they "were about to be assaulted."
Johnston also admitted to harassing an AHS inspector over a month-long period during which he posted threats and images of the woman and her family.
Johnston threatened to show up at the woman's home and throw her in jail. He encouraged his followers to find her address.
Johnston's victim feared for children's safety
In a May 13 post, Johnston said he would make the inspector's life miserable and suggested she leave the province.
In a victim impact statement read by Mackenzie, the inspector wrote that the experience had been "overwhelming" and she constantly feared for her safety when she left her home.
The woman called the harassment "extremely distressing" and said she had to explain a safety plan to her children.
Johnston's "hatred and bullying" caused the victim to have to miss work and consult psychologists.
Johnston plans to move family to Calgary
Johnston is married and has two children, 18- and 19-years-old, who are in Ontario.
The judge has allowed Johnston three weeks to leave Alberta to go back to Ontario for the purposes of moving his family to Calgary, where he still plans to run for mayor.
Mayoral candidates with a criminal record or facing charges are not precluded from running for office in Calgary. They simply can't have broken any election laws or owe money to the city.
"My client's research led him, at times, to have a contrary position to that taken by AHS," said Der in his submissions.
"His approach was overly enthusiastic."
'Venomous, hateful and threatening'
Johnston is in a host of legal trouble in Calgary after arriving seven months ago from Ontario to run for mayor and to help lead a pandemic-denying, anti-mask movement.
Earlier this month, an Alberta judge described Johnston as "frightening" and "venomous."
Ten days ago, Johnston was found guilty on three counts of civil contempt for defying judges' orders aimed at controlling frequent rule-breakers who incited others to defy public health restrictions.
Until he was taken into custody on May 26, Johnston hosted web broadcasts and online video streams where he would post angry, threatening rants, with much of his rage directed at AHS employees.
'A dangerous, out-of-control individual'
Some of those videos were presented as evidence at Johnston's civil contempt hearing.
In a scathing 20-page decision, Court of Queen's Bench Justice Adam Germain did not mince words, calling Johnston's behaviour "venomous, hateful and threatening."
"Most people who have the misfortune of listening to Mr. Johnston would be terrified by the extent of his animus, his frightening facial features and his threats expressed in certain terms," wrote Germain.
Johnston has said several times on video posted to his social media accounts that he is prepared to arm himself and go to the homes of health officials to arrest those who have taken enforcement actions.
"He presents as a dangerous, out-of-control individual," said Germain after watching the videos. "The malice that Mr. Johnston expresses is simply beyond the pale of normal social discourse."
Criminal charges in 3 provinces
Following months of threats, AHS filed a $1.3-million defamation lawsuit against Johnston.
Since his arrest, Johnston has twice been denied bail, deemed too high a risk to reoffend.
Johnston is also facing assault charges in British Columbia and hate crime charges in Ontario.
In 2017, Johnston posted a video to YouTube offering a $1,000 reward for recordings of Muslim students in southern Ontario "spewing hate speech during Friday prayers."
In the video, Johnston urges people to conceal cameras to get footage to him. "Whatever it takes, get that to me," he said.
Later that year, Peel Regional Police charged Johnston with one count of willful promotion of hatred against an identifiable group under the Criminal Code Section 319 (2).
Police said at the time that the charge wasn't tied to one specific incident, but rather "multiple incidents that the investigators were looking at."

Located in southwest Alberta, this rural riding stretches from Waterton Lakes National Park in the south to the western and southern half of Calgary in the north. Communities include High River, Okotoks, Vulcan, Pincher Creek, Fort Macleod and Claresholm, as well as the southern tip of Banff. Several First Nations reserves are also here: the Blood reserve in the southeast corner, the Tsuu T'ina Nation west of Calgary, the Peigan reserve in the south and the Siksika reserve in the northeast corner.

Alt-right vs. Antifa: How a political clash is turning the Internet into battleground
The four men charged after a self-styled “Canadian patriot” and far right provocateur was allegedly beaten and robbed in Ottawa on Saturday will appear in court later this month, but that’s not enough for Kevin J. Johnston.
“We need a name. We need an address. We need a phone number,” Johnston urges his followers after posting video on his Freedom Report website that shows a photo of a man Johnston claimed instigated the attack.
The call for online action is a nasty tactic of the increasingly volatile conflict between the far right and the far left that’s playing out in Canadian cities. Opponents on the left (the ‘Antifa’ for anti-Fascist movement) say they’ve received death threats and been the victims of “doxxing” — having personal information published online — as retribution from the far right or “alt-right.”
One man Johnston targeted is Kevin Metcalf, a member of Canadian Journalists for Free Expression, who says he was at the Hill protest as an observer, shooting pictures and video of people at what was billed the “Million Canadian March.”
Johnston posted a video Tuesday showing Metcalf’s picture and called him “a coward, domestic terrorist and stalker of women.”“If you see this man, you have to assume he is armed,” Johnston told his followers. “We have to get this guy behind bars, people. Get him behind bars now.”
Metcalf says he was on Parliament Hill conducting interviews around 11:30 a.m., the time it’s alleged Johnston was assaulted in Confederation Park. He says he’s considering legal action against Johnston over the online video.
“It’s concerning. I’m certainly taking precautions,” Metcalf said Wednesday. “I’ve received death threats before but since he published the video it’s increased exponentially.”
As an advocate for free expression, Metcalf has attended a number of rallies like Saturday’s march on Parliament Hill, which drew an eclectic mix of about 300 to 400 people, including groups such as the far right Soldiers of Odin and Jewish Defence League of Canada. Though billed as a pro-Trump rally by the American alt-right website Breitbart, the Ottawa demonstrators’ wrath was aimed at the Canadian government’s anti-islamophobia motion, M-103, as well as issues such as carbon taxes and Liberal spending.
“It’s a tough landscape to negotiate,” said Metcalf, who describes himself as being left-leaning personally. “There’s a protective right in Canada for free expression. At the same time, we recognize the important role that counter speech plays in fostering public discourse. So when people show up and say ‘Hey, you’re a bunch of racists. We don’t want you in our community, that’s also free expression. That needs to be supported and protected.”
Like the Million Canadian March demonstrators, Saturday’s counter-protest drew a mix of social justice advocates, including black-clad, balaclava-wearing members of a group calling itself Anti-Fascist Action. Metcalf said many of the counter demonstrators are “college-age, white and of relative social privilege” who track right-wing groups’ activities. They’ve taken to wearing masks to protect themselves from “doxxing” and online attacks, he said.
“It’s almost like these are government-sanctioned street fights.”
Freelance journalist Evan Balgord has been covering the clashes between the left and right for the online news site Canadaland. Balgord, a friend of Metcalf’s, said in his view the left typically employs less aggressive tactics than the right — linking arms to form a barrier or making noise to drown out the other side’s speeches, for example.
“You’ll see a group of anti-Islam and anti-Muslim groups that are demonstrating, then a group of anti-fascist anti-racists will show up and they’ll yell at each other and police will usually separate them,” Balgord said.
Violent protest is nothing new to Canada, says Christo Aivalis, a professor of history at Queen’s University in Kingston. The anti-war protests of the 1960s and ’70s, and even the Winnipeg General Strike of 1919 were also bloody. But the Internet and social media have sped things up and given voice to even small groups of like-minded individuals.
“It can embolden people that traditional forms couldn’t,” Aivalis said. “These kinds of gathering can grow very intense. You couldn’t do it every day. But on the Internet you can go home and post memes and articles calling out the other side.
The election of U.S. President Donald Trump and the rise of the alt-right in the U.S. has had an effect in Canada, he said.
“Those feeling didn’t start with Trump. But his victory has emboldened people.”
Metcalf says he began documenting rallies about a year ago and, like Balgord, says the far right is the more violent of the two sides.
“Three times at these rallies I’ve seen violence and all three times they’ve been the initiators of the violence. That’s decreased my sympathy to their claim that free expression protects their right to assemble,” he said. “At a certain point, it becomes a public order concern. It’s a serious issue for democracy when dissent and organized opposition is being threatened online (and) threatened offline.CJFE: Statement on the assault of an employee by right wing extremists
On May 6, 2017, an employee of Canadian Journalists for Free Expression (CJFE) was assaulted by cultural supremacists at a “free speech” rally against Motion 103 (M-103) at Nathan Phillips Square in Toronto. Kevin Metcalf is the Promotions and Communications Coordinator for CJFE, and was filming and reporting on the demonstration activities. Metcalf wrote an article in March that explicitly outlined CJFE’s position on M-103 and debunked its status as a ‘free expression’ issue. CJFE is horrified by this gross breach of free expression rights and the clear impunity from justice which the perpetrators enjoyed in their aggressive assault on a member of the media.
At the rally, Metcalf witnessed the arrival of around two dozen individuals dressed in body armor, face masks, helmets and paramilitary-style fatigues, carrying metal flagpoles draped with the Canadian flag. Metcalf was greeted by name as the group entered the square; he was known by the cultural supremacists in attendance and had been subject to threats of violence online in the past as a result of both his professional and personal writings and advocacy.
Early in the rally, a senior member of the Jewish Defence League (JDL) is caught on video pointing out Metcalf to another JDL member. Both individuals participated in the later assault. The JDL is a banned extremist organization in the US but remains active in Canada. Canadian group members recently brutally beat an elderly demonstrator at a rally in Washington, DC.

A scuffle ensued between the arriving group and counterdemonstrators who were already assembled. This was broken up quickly by police but lead to the hospitalization of an anti-racist demonstrator with a serious head injury. The injured demonstrator had previously been threatened by the JDL at a rally on April 1, who screamed ‘smash her face.’
As Metcalf continued to peacefully film the interactions between protesting groups, two individuals initiated an aggressive confrontation. One of the two individuals was the subject of a previous CJFE alert.

The harassers pushed his handheld DSLR camera and used overt physical contact to try to prevent him filming while taunting him with profanity. One offered to “visit [you] at home.” When this proved unsuccessful as a deterrent they demanded that police ask Metcalf to leave. Police refused as there is no prohibition on filming an event in public, and advised the cultural supremacists to ‘walk away.’ CJFE continues to advocate for the rights of reporters to cover public events safely and freely.
Moments later, a demonstrator walked purposely and directly into Metcalf, shoved him backwards and managed to disable his camera.

As this happened, the police officer commanding the police line that separated the two groups of demonstrators called nearby officers away. An individual with black safety glasses then sprinted across the square and body-checked Metcalf, following this up with a deliberate headbutt.
A freelance photographer captured the most serious moment of the assault.
Metcalf stumbled backwards and was pushed again, jabbed with a flagpole and threatened explicitly and repeatedly with death. The situation continued to escalate until rally organizer Sandra Solomon approached with a megaphone and instructed the assailants to “let him go.” Following the event, an edited image of Metcalf, bloodied and bruised, was circulated on social media.
CJFE is horrified by the organized and seemingly
premeditated efforts to assault someone reporting on a demonstration. In
a deliberate attack on free expression, the assailants identified a
reporter who disagreed with them and then took steps to harm him and
inhibit his right to record the activities. The victim’s body-mounted
camera was damaged by both an assailant and a police officer, and police
officers were ordered away as the assault unfolded, raising concerns
about the relationship between police and the demonstrating group.
Death threats, physical assault and online hate campaigns directed
against persons exercising their right to film in public and publish
their opinions must be condemned in the strongest of terms. Further,
there is a responsibility for police to identify and prosecute not just
the individuals but the criminal apparatuses that facilitated this act
of violence in a public square. The City of Toronto bears responsibility
for playing host to a violent group that claims “freedom of speech” as a
shield for their activities while assaulting and threatening their
peaceful critics for their published opinions.
Metcalf
says he is shocked by the assault but undeterred. “It is really
shocking. I spend my days reading about this sort of thing happening in
other countries. To have it happen here? The only words I can think of
are shock and disbelief.” He continued, “I’m taking more precautions in
public now, but my experiences shouldn’t scare others off. [Cultural
supremacists] seem to be afraid of having their actions filmed and
published. There are groups using this tactic to fight extremists like
ISIS at great personal cost. Do you want to fight back against hate and
extremism? Point it out, film it, report on it, call it out for what it
is. Encourage people to get involved in opposing it. Don’t let fear get
in the way of the truth.”
Around the world, reporters,
journalists and correspondents face reprisals, threats and death for
their work. CJFE has reported on similar instances in countries around
the world, including Bangladesh, Honduras and Pakistan.
When governments and law enforcers fail to protect the fundamental
rights to free expression and press freedom, they reinforce a culture of
impunity. If the city of Toronto and the Toronto Police Service fail to
act according to the law in instances like this, they are unwilling or
unable to defend the Charter rights and freedoms of Canadians. We
sincerely hope this is not the case.

What Happens When An Anti-Muslim Internet Personality Begins To Face Consequences
Outside the Toronto Zionist Centre on Sunday, July 30, members of the far-right Jewish Defence League (JDL) wore helmets and kevlar vests; some guarded the premises with bats and batons. They were on high alert after someone on the page of their Facebook event had warned that members of Antifa (an “anti-fascist” left-wing movement) were planning to crash the meeting.
The JDL’s guest of honour that night: alt-right provocateur and anti-Islam vlogger Kevin J. Johnston, who days before had been arrested and charged under section 319(2) of the Criminal Code for “wilful promotion of hatred.”
JDL Canada’s national director Meir Weinstein introduced Johnston to the audience of about 50 people that included Rebel commentator David Menzies (who hosts a YouTube show with Johnston), a member of Gavin McInnes’s Proud Boys, and an organizer with the anti-Islam group Rise Canada.
“It was my evidence that led to charges being laid against Ernst Zundel,” said Weinstein about the infamous Holocaust denier, who would die later in the week. “He was the world’s largest purveyor and distributor of Nazi propaganda… I was fairly involved in the prosecution… But what’s going on with Kevin Johnston is outrageous.”
Weinstein asked supporters to come out and fill the room for Johnston’s court appearances.
“Hopefully the judge will not be biased, hopefully. But we have to be there, all of us, in good moral conscience, to show our support for Kevin’s right to stand against real hate — real hate, not this made-up, fictitious nonsense they’re throwing at him,” he concluded.
After the warm introduction, Johnston took the stage — but before discussing his run-in the with the hate-speech law, he had other news to announce.
“I just wanted to let you all know that in the parking lot, a gentleman came over pretending to be a fan of mine and handed over this lawsuit.”
Johnston, 45 and married with two kids, is the founder of one-man far-right media outfit Freedom Report, where he posts video rants, many of which are about what he sees as the Islamification of Mississauga (his hometown) and Canada at large. Johnston first made national headlines back at the end of March, when he offered a $1,000 reward to anyone who could provide him with recordings of Muslims in a Peel Region public school “spewing hate speech during Friday prayers.” He is also a fan of notorious conspiracy theorist Alex Jones and mimics his incendiary and hyperbolic rhetoric and mannerisms. Before getting into politics and political commentary, Johnston worked in the comedy/entertainment business.
The lawsuit was just the latest in a growing list of troubles for a man who, three days before, had told Rebel Media’s Ezra Levant that “every Muslim” would be hated by “every Canadian” if he ends up in jail for the hate-speech charge — and that that would lead to Muslims being “assaulted, beat up, perhaps even killed country-wide.”
It was an eventful week.
The Defamation Suit
“You should know that I’m under attack from every angle,” Johnston told the crowd at the JDL meeting, “and this particular lawsuit is from Kevin Metcalf, who” — he claimed — “is the unofficial photographer of the domestic terrorist organization Antifa.”
Metcalf, who works as the promotions and communications coordinator at Canadian Journalists for Free Expression (CJFE), had just had Johnston served with a small-claims suit seeking $25,000 for defamation.
Here is a representative excerpt from the statement of claim, provided to CANADALAND by Metcalf’s lawyer, Stephen Ellis:
On June 27, 2017, you published an 18-minute video devoted exclusively to Mr. Metcalf entitled “Kevin Metcalf of Antifa Behaves like a Left Wing Nazi SJW Lost Child.”
For the entirety of the video, you prominently featured Mr. Metcalf’s face below a Nazi symbol and a statement which read “Antifa loves Hitler.”
During the video, you stated categorically that he is a “communist,” “a Nazi,” “an evil person,” who had “no respect.” You also stated that he is “anti-white,” “anti-Canadian,” and “supports terrorism.” Next, you stated twice that he is “a loser,” and that “the whole world knows it.”

Metcalf had been in Ottawa to cover the poorly attended “Million Canadian March” in early June on the same day that Johnston was allegedly assaulted by Antifa in a nearby park — although, as CANADALAND previously reported, the circumstances of how the altercation began are still in question. Four people were charged, and three face trial in the fall. However, Johnston believes Metcalf was at the scene documenting the assault and that he has withheld evidence.
Metcalf maintains he was on Parliament Hill at the time, covering the march, as well as doing an interview with the CBC.
“He knows we were in Ottawa,” Metcalf says in a phone interview with CANADALAND. “He knows he saw us, or someone saw us, with a group of individuals [earlier] who were involved [in the altercation], and so everything else that has been stated about the incident has fallen into the realm of a weird political fantasy in which he is the protagonist.”
The statement of claim cites several of Johnston’s videos in which he refers to Metcalf as a “domestic terrorist,” “fascist,” and “criminal.” The lawsuit also says Johnston falsely “stated that Mr. Metcalf is ‘extremely dangerous’ and was ‘armed’ when he and his friends ‘attacked you’ in Ottawa.” In addition to monetary damages, the suit seeks the removal of relevant videos and a retraction.
At the Zionist Centre, Johnston told the crowd his own version of events, claiming that in Ottawa, Metcalf “followed me for about 28, 30 city blocks, from my really sleazy motel down to a restaurant to meet the staff of rebel.media. [Rebel host] Faith Goldy was there with another cameraman. Kevin Metcalf walks in and says, ‘Hi, racist,’ puts his camera up, films us, and runs out the door. That’s kind of strange behaviour.”
To laughter from the crowd, Johnston noted that the suit cited his calling Metcalf a “loser.”
“Simple fact-checking, I think, could’ve saved this entire hassle,” Metcalf says.
“Yeah, sure. I lost my debit card this morning. I think I lost my wallet last week. I lost a pair of eyeglasses three months ago. If he wants to call me a loser, that could be factually accurate, but that’s not why he’s being sued,” he says. “The lawsuit is about the words ‘domestic terrorist,’ the false statement of facts that I had participated and held material evidence or was party to a crime in which criminal charges were laid… the calls to attack and his supporters to call the police if they see me, reading out my work address… it’s a grab bag.”
Johnston told the crowd that he would not settle the suit but instead would “demand” a trial, “so that I can ask every single question that I wish to ask. And most of it is going to be, ‘Please name every single member of Antifa that you know.’”
Asked about the Ottawa altercation, Johnston asserted to CANADALAND that he was attacked by “46 members of Antifa,” “at least 25” of whom “were kicking at” him, and that he “got hit with three flag poles that I can remember, at least.”
“And I had to turtle, get down and protect my head, protect my genitals, but they just kept on me.”
CANADALAND asked Johnston for pictures he said he had received from a photographer also covering Antifa, which he claims corroborate his story about Metcalf being a witness to the assault, but he didn’t answer our follow-up queries — except to say he encouraged us to get a copy of the suit and “spread it around.” (Johnston’s cameraman’s camera, which apparently had recordings leading up to the attack in the park, was stolen during the fight.)
The Growing List of Troubles
Johnston told the crowd at the JDL meeting that on the preceding Friday, he’d been served with yet another “document.”
“I’ve received two death threats from two very interesting individuals. They were Arab, you could tell. The beards were long hair at the bottom, nothing here,” he said, pointing above his upper lip. “Both were on bikes, both told me I was a dead man, both sped off the street. Fifteen minutes later, a processor worker shows up, telling me I’m in big trouble, hands me over a letter… and the processor takes off, but I couldn’t get a picture of his licence plate because it was covered in cardboard.”
He explained that it was a cease-and-desist notice but didn’t elaborate on the nature of the demand.
On top of being charged with hate speech, given an apparent cease-and-desist letter, and served a lawsuit by Metcalf all in a week’s time, Johnston is also — according to his website — facing a $1 million countersuit filed “by child molesters” earlier this year. Johnston’s Twitter account, @KevinTheJackal (which he said had “about 16,000 followers”), was recently banned, his Facebook account was suspended for the sixth time, and earlier in the month his YouTube account was disabled. (It’s back up for now, but he believes he’ll soon be permanently banned from that platform, too.) Johnston blames the suspensions and bans on the supposed left-wing bias of social-media sites. He also claims to be receiving death threats on a regular basis.
“[My] family is the only thing I’m worried about; I’m never worried about me,” he said.
Metcalf tells CANADALAND he hopes that his lawsuit will be a lesson to other right-wing organizations that he believes play fast and loose with the truth.
“There’s a general collection of right-wing groups that are emboldened by success… They don’t think twice about what they’re saying, what the consequences of what they are saying are, because there have not been any consequences,” says Metcalf. “And so winning court judgments against them for defamation, it demonstrates that these things are unacceptable. You can’t do this.”
Ellis, Metcalf’s lawyer, took on the suit on a contingency basis.
“I took this case on because we have to be creative when tackling the problem of the rise of the racist right,” says Ellis in an email. “Johnston, and others like Sandra Solomon, the Soldiers of Odin, the Proud Boys, Pegida, the Jewish Defence League, and the myriad other racist outfits naturally have to be confronted directly — on the streets. Another tool we have can be the legal one.
“We have to throw ourselves wholeheartedly against this phenomenon. It threatens our collective safety and well-being.”
The Hate-Speech Charge
Two weeks ago, upon being released from police custody after questioning, Johnston took to his camera to record a video titled “Kevin J Johnston Arrested Under Motion M103,” in which he asked for donations to help pay for an estimated $25,000 to $35,000 in legal fees and claimed he was being charged under House of Commons motion M-103.
“Yes, all the left-wing media could not wait to tell you all that I was arrested today under the future proviso of M-103. That is correct. The anti-blasphemy law, the anti-Islamophobia law is coming to Canada next year. I am the first Canadian to suffer arrest under its tenure.”
The statement was incorrect. M-103 is not a law, but a motion that condemned Islamophobia and called for the Canadian government to review ways to fight hatred towards Islam and Muslims through a parliamentary committee. Johnston was in fact charged by Peel Regional Police under a longstanding and unrelated provision of the Criminal Code concerning hate speech, following a “lengthy investigation” into videos he posted on social media.
CANADALAND asked Johnston to clarify his false statement.
“I said it was a precursor to what’s coming. It’s not actually M-103 but an M-103-esque law that’s in place. The point I’m going to make with that is when M-103 becomes a law under Justin [Trudeau next year], which we know he’ll push for… there will be at least 10,000 arrests every month — I’m sure — countrywide because they’re going to go to town on this. The only way to defeat it, at that point when it’s law, is to point out that the courthouses and jails are full of people who just have opinions.”
Some right-wing pundits have come to the defence of Johnston over his hate-speech charge, which, if prosecuted as an indictable offence, carries a maximum penalty of two years imprisonment.
Rebel Media founder Ezra Levant interviewed Johnston on his paywalled show, and afterwards said some of Johnston’s comments were an example of “solipsism.” However, Levant still defended Johnston’s right to free speech but is reserving judgment about the case until the details are disclosed. (While there has been speculation that the charge may have stemmed from Johnston’s bounty for a video of Muslim students in Peel schools, police have yet to elaborate on their basis for laying it.)
National Post columnist Christie Blatchford also came to Johnston’s defence, writing that he was “just the latest poor sap to come to government attention,” and raised the concern that there is an “overt sheen of politicization to a prosecution which is inherently politicized by the unusual requirement that the [Attorney General] must first consent.”
The Perceived Political Vendetta
As a political candidate, Johnston had finished a distant 11th in the 2014 Mississauga mayoral race ultimately won by city councillor and former Liberal MP Bonnie Crombie. In her Post column, Blatchford pointed out that Crombie filed a hate-crime complaint against Johnston last year — which Blatchford believes could’ve been the “catalyst” for his arrest — after he published a “bizarre” article titled “Bonnie’s Muslims Are Molesting Teenage Girls in Mississauga Highschools.”
Furthering their impression that the charge was political, some of Johnston’s supporters have pointed to the fact that Ontario attorney general Yasir Naqvi is both Muslim and a Liberal.
Johnston himself told the JDL crowd that he thinks the charge was brought to hinder his second run for the Mississauga mayoralty, which he wholeheartedly believes he will win next year.
“The Liberal Party is in panic mode right now,” he said, adding that “when I win the mayorship of the city, I’m kowtowing to nobody.”
“I know for a fact that the Liberal Party does not want me to be mayor of Mississauga next year because they know how far I’ll take the changes in my hometown.”
The Ontario Civil Liberties Association — unaffiliated with the better-known Canadian Civil Liberties Association — has also backed Johnston, starting a petition to get Naqvi to reverse his decision to allow the “systemically political” proceedings to go ahead.
OCLA researcher Denis Rancourt told The Mississauga News, “Democratic societies should not have … criminal code provisions where the state is not ever having to prove actual harm, physical or psychological, to any actual person that they bring forth as a person that was harmed.”
CJFE, however, supports the government’s decision to allow hate-crime proceedings to commence against Johnston.
“You have a full right to free expression in this country, up until the point where you are inciting hatred against someone,” says CJFE executive director Tom Henheffer, who notes that Canadian law has “strict criteria” for what constitutes incitement.
Henheffer also addressed the “apparent irony” of a CJFE staff member suing someone for libel, although CJFE is not involved with Metcalf’s lawsuit.
“You have a right to free expression in this country, but that has limits, and one of those limits is that you can’t libel people, you can’t defame people, you can’t intentionally, maliciously, and publicly harm someone’s reputation, which is exactly what [Johnston] did.”
Levant, in his defence of Johnston, mocked a Global News report that quoted a Muslim activist claiming Johnston was inciting violence in his videos.
Yet some of Johnston’s videos appear to show him doing just that.
In a video denouncing Liberal MP Iqra Khalid for putting forth M-103, Johnston appears to say he would be glad to see her shot:
It sickens me that she holds a seat in Parliament Hill as a terrorist scumbag … I believe that you are a terrorist. I believe that you are here to kill me, and kill my children, and kill the entire future of this entire nation… The only thing that your actions can do is cause a civil war within these borders… Because I can tell you this, there are a lot of gun nuts in this country, and you’re pissing them off. You don’t want to do that. There is a select kind of Canadian that even I’m afraid of. And those are not the guys you want to try and bring Sharia law to. But hey, if you think that is the right way to go, go ahead. I’m a journalist, and I’ll be there to see you on the ground crying and complaining about the fact that someone shot you because they disagreed with Sharia law and the rape of children. And I’ll be there with a big fat smile on my face, saying, “Heh, heh, Iqra Khalid gets shot by a Canadian patriot who didn’t want to wrap his daughter up in a bandage, and who did not want to take on or adopt Sharia, where he has to pin his daughter down on the ground and cut her labia and clitoris off with a razor blade.”
The Endgame
Johnston craves media attention to get his message across, embracing stunt-right tactics, something The Rebel does regularly to attract mainstream media’s attention. In his speech to the crowd, he explained how the mainstream media helps him and other alt-right media spread their messages.
“This tells me that everybody who is of a liberal mindset, everybody who is a left-wing nutjob, is afraid of not me, but of what I — and all of you — represent,” he said. “We represent the truth, and we represent Canada.”
“The more they try and silence us, the more attention they give us. Because, we can always count on the Toronto Star, CBC, and CTV to be unwitting accomplices in getting our message out there.”
Following his talk, CANADALAND asked Johnston about his statement on The Ezra Levant Show that Muslims would be attacked and killed if he gets sent to prison.
While emphasizing that he doesn’t want “the average Muslim individual” attacked, he said he feels it would be inevitable.
“I don’t want them assaulted, I don’t want them stabbed, I don’t want them to be run over by cars because people are angry about what the government is doing, but we know it is going to happen,” he said. “We know that. I’m saying this clear: I. Don’t. Want. That. I don’t want civil war in my country because of what our government is doing. I don’t want division in our society.”
So what does he want?
“I want the whole country working together as a unified nation. The best example that I can give you — you weren’t there for this, unfortunately — but when the Blue Jays won the World Series, to be [in] downtown Toronto and high-fiving and hugging everybody, didn’t matter what colour or race they were, it didn’t make a difference. Nobody cared if the guy beside you had a turban on, it was high fives, it was hugs, ‘Blue Jays!’ Everybody had the Canadian flag regardless of their background. That’s the country I want.”
Johnston is set to make his next court appearance for the hate-speech charge on September 8.

‘Antifa’ Knife Attack Claim By Anti-Muslim Internet Personality Challenged By Witnesses, Police
An alleged assault covered by the Ottawa Citizen and National Post may not have happened as reported. Kevin J. Johnston, an online media personality of Canada’s anti-Muslim right, claims he and his cameraman were assaulted by ‘Antifa’ members, resulting in the arrests of four individuals who are facing several charges. The incident took place last Saturday, before the “Million Canadian March” on Parliament Hill that was erroneously reported by Breitbart as a rally of 5000 Trump supporters. In reality, a generous estimate of attendees would place the crowd size at 200.
Both the National Post and the Ottawa Police Service treated Johnston’s version of events as credible, despite contradictions in his account. Ottawa Police arrested individuals pointed out by Johnston, despite being told by others present that Johnston initiated the violence by assaulting a young woman. Charges, including assault with a weapon, were laid against individuals identified by Johnston.
Audrey, a demonstrator who witnessed the incident, is critical of how the police handled things. “It’s about who the police listen to and trust, says Audrey. ”So many people told the police [Johnston] assaulted a woman, but Kevin just points at people and they get arrested.”
Kevin J. Johnston publishes anti-Muslim and anti-government videos on his Freedom Report website, and for his 13,500 followers on Twitter. Johnston, who has said Islam isn’t a religion, is offering a bounty of $2500 for anybody who will record Muslim children praying in schools. In one of his videos, he calls MP Iqra Khalid a terrorist and says he would be happy to see her get shot.
According to Blair Crawford, the Ottawa Citizen reporter who covered the incident, protests are common in Ottawa, and the Million Canadian March — which Johnston was associated with — flew under their radar. Crawford responded to a letter to the editor penned by this reporter and is conducting interviews to better understand the context of the anti-Muslim vs. anti-racist rallies for subsequent pieces.
Crawford also received several phone calls critical of the piece. He says he was skeptical of Johnston, given what he’s published in the past, but decided to treat Johnston like any other victim of a crime. He also indicated that he omitted Johnston’s anti-Muslim comments from his reporting. But Crawford did give Johnston a platform for one of his political views — that Justin Trudeau is “a child” and the country is falling apart. No other witnesses to the incident or any of the anti-fascist activists charged were interviewed for the published article.
Johnston’s own account of the incident is contradictory.
Johnston originally reported on Twitter that he was the victim of a knife attack. But Sergeant Hrabchak of the Ottawa Police Service tells CANADALAND that there was no knife attack. “We don’t have any information of that,” says Hrabchak. “None whatsoever. We’ve got one victim, and he’s not even being cooperative with us now.”
Witnesses who were getting ready to demonstrate against the Million Canadian March — who are anti-racist and anti-fascist activists, but not members of ‘Antifa’ — tell a different story. They say the altercation in the park all started with a verbal argument between Johnston and members of the group and that it only turned violent when Johnston attacked a young woman.
After first claiming that there was an ‘Antifa’ knife attack, Johnston changed his story, tweeting that there was no knife attack but that knives had been pulled out after his attack and recovered by the police. Multiple witnesses tell CANADALAND that isn’t true. Johnston also claimed his cameraman was hit in the head, causing a concussion.
The Ottawa Police Service arrived shortly after the violence, responding to a 911 call by Johnston in which he told the police that ‘Antifa’ had a gun. The police arrived 10 minutes later. Witnesses say no gun was recovered. In a video he published on Sunday, Johnston tells a different story, saying it was a fake gun. One of the accused is charged with a firearms-related offence.
Several tweets from Friday suggest that Johnston was seeking out violence or confrontation in Ottawa.
Confronting ideological opponents — usually Muslims or anti-racist activists — arguing with them, and filming their reactions is the modus operandi for several extreme right-wing Canadian YouTubers, including Johnston.
Johnston says he ran over to Confederation Park because ‘Antifa’ members were harassing women on the corner.
“I stuck the microphone up to the kid,” says Johnston in his retelling of events. “Hey guys, how does it feel to pick on women? Does it make you feel very masculine and manly to scream at ladies on the street?”
Two anti-fascists were handing out pamphlets on the corner and warning people about the racist Million Canadian March. According to one of the pamphleteers, one group stopped and said they were going to the Million Canadian March. The pamphleteers called them racist. A couple ran over and started yelling that the pamphleteers were sexist. There was a shouting match and the pamphleteers left, only to be followed down the street by Johnston who was yelling at them over and over again, “Why do you want to kill all white people?”
“I assume he was just trying to get a response and then edit it,” says one of the pamphleteers. “He’s a provocateur.”
According to both Johnston and the anti-fascists, he followed those individuals into Confederation Park. Witnesses then say he confronted individuals and stuck cameras into their faces, but the violence only started when Johnston punched at the head of a young woman and pulled her to the ground. He then fell to the ground and the group separated the two of them. Johnston was then beaten, suffering a cut to the ear. A few seconds later, he got to his feet and he stayed in the park asking for his camera back, which was allegedly taken during the fight. It was not returned. Witnesses say the woman suffered cuts to her face and was shaken up. She left the park.
I found the anti-fascist demonstrators doing “jail solidarity” at the police station at the bottom of Elgin Street. The police station was on lockdown while a group of 10 demonstrators played Uno and shared snacks, waiting for their friends inside to be released.
“When I called the police, the police arrived,” Johnston says in a video, “. . . I couldn’t believe the amount of fear that these Antifa kids had when I was standing there with uniformed police officers.”
Johnston has announced plans to “doxx” the anti-fascists who were arrested. Doxxing often begins campaigns of harassment, death threats, and worse.
“If I have access to your name and your home address and your parents’ names and your parents’ places of business — I’m posting all of that stuff,” says Johnston. “You’re going to have me at your front doors showing the world where you live and who you are.”
“Even though Antifa are kids,” he says, “they’re no longer human being to me . . . I will defend myself properly from now on in. I’m going to defend myself to be best of my ability. You’re not going to like it. I’m bringing martial artists with me at all times.”
Kevin J. Johnston did not respond to CANADALAND’s requests for comment.
