Westhaver is familiar with record requests and FOIPOP. Within the past two years, he has submitted requests every couple of weeks. He relies on the system to get information that is otherwise not disclosed to the public.

Westhaver was on the ground at protests outside Dr. Strang’s house. He started making FOIPOP requests in relation to JM & Morgan Guptill in Summer 2022. This was prompted by inconsistencies observed in the prosecution of their cases.

Foda asks Westhaver to identify documents included in RF’s affidavit. He says nothing appears to be added, subtracted, modified, or forged. Westhaver retained the original emails received from Information Access and Privacy Services and could compare the two if needed.

Westhaver initially kept the documents to himself, then decided to share them with Morgan Guptill because he thought it might have bearing on her case. He did not distribute the results widely.

Cross-examination of by Crown. Apparently, Westhaver refused to be interviewed during the lunch break. Crown: “I wanted to ask you some questions, and you said ‘Absolutely not.’” (There is no legal obligation for a witness to consent to be interviewed.)

Westhaver said he was more of an observer outside Dr. Strang’s house. He was concerned about the treatment of protesters, and wanted to make sure things were okay. He found out about the protest from his wife, since he does not participate in social media at all.

Crown asks about the FOIPOP, and Westhaver confirms that he started filing requests in Summer 2022. He agrees that some of the documents he received in the course of his searches are before the court. No further questions.

Defence counsel Foda’s submissions. There are two prongs to consider: 1) Disclosure required to make full answer and defence on the merits. 2) Disclosure that may support the abuse of process motion. Foda points out the Crown hasn’t addressed the first issue at all.

There are subjective and objective elements to the charge of criminal harassment, requiring an inquiry into the complainant’s state of mind: Was Dr. Strang afraid of the protesters? Why was he afraid? Was he reasonably afraid?

JM’s former counsel was alive to the possibility of police influence on Dr. Strang’s state of mind from the outset. And yet, the Crown failed to provide documents that showed up in the FOIPOP. Foda: “My client cannot have a fair trial without this disclosure.”
