BREAKING: Charges Dropped Against Albertan Restaurant Owner Who Refused to Discriminate During COVID
The crown has dropped charges against Jesse Johnson (owner of Without Papers Pizza) who was being prosecuted for not closing down his restaurant to unvaccinated people in Calgary, Alberta.
The court hearing that lasted 10 minutes ended with cheers from the crowd after an unexpected decision by the crown to withdraw charges.
“I’d love to go back and provide the love and pizza that we gave to all the people of Calgary regardless of vaccination status,” said Jesse Johnson.
“18 charges, years of taking this man who lost everything through the ringer — the process is the punishment; that’s the new game,” said Artur Pawlowski, the man who was the first in Canada to be charged with a Covid ticket for feeding the homeless.
Johnson said that he’s planning to sue the government: “These bastards they literally tried to break me — financially, mentally, and spiritually."

The sentencing of a southern Alberta man found guilty earlier this year of assaulting a police officer at the Coutts border blockade in 2022, has been adjourned.
James Edward Sowery was scheduled to be sentenced Tuesday in Lethbridge Court of Queen’s Bench on charges of assault with a weapon and dangerous driving, but the matter was adjourned until next week when a new sentencing date will be scheduled.
Jurors deliberated for about six hours following Sowery’s trial last March before they found him guilty of deliberately accelerating his hydrovac truck toward RCMP officer Const. Cory Kornicki, who had been conducting traffic stops Feb. 14, 2022 along Highway 4 near Milk River.
During trial, Sowery said he did not intentionally swerve at Const. Cory Kornicki, but the officer testified he had to jump out of the way to avoid being struck. Kornicki estimated Sowery was driving about 80 km/hr, while Sowery guessed his speed was closer to 60 km/hr.
Sowery said that as he approached the check stop, the officer waved at him, and he thought the officer was waving goodbye, not telling him to stop. He was pulled over shortly afterward and he immediately got out of his truck, knelt on the ground and put his hands in the air, the jury heard.
That, Crown Prosecutor Aaron Rankin said, is exactly how someone would act if he had just acted violently toward police. Minutes later Sowery apologized, which suggested he knew he had done something wrong, Rankin suggested.
Defence, on the other hand, said Sowery was compliant and cooperative with police when he was arrested, and while it would have been wiser for him to slow down, his actions did not constitute dangerous driving or assault with a weapon.
The 2022 blockade paralyzed the busy U.S. border crossing at Coutts for more than two weeks as protesters railed against COVID-19 vaccine mandates and broader pandemic health restrictions.
Sowery is among the first of several people arrested during the blockade to stand trial. Four men, Christopher Lysak, Anthony Olienick, Jerry Morin and Chris Carbert, are charged with conspiracy to commit murder, and were scheduled to begin their trial last June before it was adjourned so they can schedule a series of pre-trial applications before Justice David Labrenz. Defence is also expected to have the trial moved to another jurisdiction.
The accused were charged after police became aware of a small group of people who were prepared to use force against police, and officers subsequently seized from three trailers long guns, handguns, multiple sets of body armour, a machete, a large quantity of ammunition and high-capacity firearm magazines.
All four men have been denied bail, although Carbert is expected to have his detention reviewed in the coming weeks.

4 men accused of conspiring to murder RCMP officers to be tried together: prosecutors
Chris Lysak, Chris Carbert, Anthony Olienick, Jerry Morin charged after Coutts protests
Chris Lysak, Chris Carbert, Anthony Olienick and Jerry Morin each face charges of conspiracy to murder, possession of a weapon and mischief.
On Monday, the four, as well as 10 others facing less serious charges, made brief appearances in Lethbridge court as defence lawyers and prosecutors move the cases forward.
Lysak 'waiting and waiting'
Prosecutors Aaron Rankin and Matt Dalidowicz indicated the Crown's intention is to run one trial for the four facing the conspiracy charges.
Dalidowicz said the Carbert, Olienick and Morin cases were "moving quickly," and the Crown expected to join the cases "in short order."
Because of that plan, Lysak was not allowed to book a trial despite his lawyer offering dates in January 2023.
Lysak remains in custody after he was denied bail in March.
"He's waiting and waiting," said lawyer Alias Saunders on behalf of Lysak's counsel, Jim Lutz.
"Mr. Lysak is detained and Mr. Lutz would like to set dates."
Defence lawyers for the 14 men and women facing charges related to the blockades indicated they are waiting for the prosecution to hand over the documents used to justify search warrants executed as part of the investigation.
Most of the accused will be back in court on May 16.
Carbert and Morin have set bail hearings that will take place in May and June with Olienick planning to set a date for his release application in the coming weeks.
Defence lawyers James Mcleod and Balfour Der told the judge on Monday that their client wants a preliminary hearing.

In February, RCMP raided trailers near the Coutts border protest area. Those raids resulted in the seizure of a cache of weapons and body armour.
One of the arrests was tied to an incident where, according to Mounties, a protester accelerated at officers in a semi-truck as RCMP were conducting a check stop north of Milk River.
The driver swerved at the last moment, police said.
White supremacist group ties
CBC News has previously reported that Carbert and Lysak both have ties to a group with white supremacist beliefs.
Two Diagolon patches were found on body armour seized by police during the execution of the Coutts search warrants.
Diagolon has been described by University of New Brunswick professor David Hofmann as an American-style militia movement.
Members of Diagolon want to establish a white nationalist state through violence, according to Hofmann. Lysak appears in a photo with Jeremy MacKenzie, the founder of Diagolon.
Lysak also appears in a photo wearing a tank top with what appears to be the Diagolon symbol on the front.

One of four men charged with conspiracy to commit murder during the
protest in Coutts earlier this year has pleaded not guilty and will be
tried by a judge and jury in Court of Queen’s Bench with a preliminary
hearing.
The accused, Chris Carbert, entered the plea Monday in Lethbridge
provincial court, where he appeared by CCTV from the Lethbridge
Correctional Centre. He also pleaded not guilty to charges
of possession of a weapon dangerous to the public peace and mischief,
which also stem from alleged incidents during the protest.
Calgary lawyer James McLeod, who appeared as agent for Carbert’s lawyer,
Balfour Der, said Carbert is scheduled to have a bail hearing May 19 in
Court of Queen’s Bench. McLeod noted a pre-preliminary conference is
also required, and he requested an adjournment to May 20 to allow time
to schedule that meeting and possibly arrange a date for the preliminary
hearing.
Three other men face the same charges.
Earlier this month Christopher Lysak elected QB judge and jury without a
preliminary hearing, and his matter, which was spoken to briefly in
Queen’s Bench on Monday, returns to court on May 9.
Alias Sanders, acting on behalf of Lysak’s lawyer, Jim Lutz, requested
Monday that a trial date be set since Lysak remains in custody.
“He would like to set a date now,” Sanders told Justice Robert Armstrong.
But Crown prosecutor Matt Dalidowicz opposed the move, saying the plan is to try all four of the accused at the same time.
“The Crown anticipates joining Mr. Lysak with three other
co-conspirators… all three of those individuals are still at provincial
court,” he said.
The other two accused, Anthony Olienick and Jerry Morin, return to court
May 3 and May 16 respectively. They are also preparing for bail
applications, court was told.
Nine other individuals are also facing charges stemming from the border
protest. Ursula Allred, 22, Johnson Chichow Law, 39, Justin Martin, 22,
Eastin Stewart Oler, 22, Joanne Person, 62, Janx Zaremba, 18, Luke
Berk, 62, Jaclyne Martin, 39, and Evan Colenutt, 23, face charges of
mischief and possession of a weapon dangerous to the public peace.
Person is also charged with dangerous driving stemming from an
incident Feb. 1 when a pickup truck drove through the blockade and
headed toward oncoming traffic before becoming part of a head-on
collision.
Allred, Berk and Law each pleaded not guilty earlier this month and
elected to be tried by a provincial court judge. The matters for all
nine accused were in court Monday and adjourned to May 16.
RCMP arrested the 13 individuals Feb. 14 during the blockade of trucks
and vehicles at the Coutts border, after becoming aware of a cache of
firearms and ammunition. The protest against COVID-19 vaccine mandates
and other pandemic restrictions began late January and lasted until Feb.
15 when protesters began dispersing in response to the discovery of
weapons.
Mounties also charged James Edward Sowery, 36, from Flagstaff County
southeast of Edmonton. He was charged with assault with a weapon and
dangerous driving after a large commercial vehicle drove at an officer,
forcing him to run out of the way to avoid being hit. Sowery’s matter
returns to court May 3.

Joanne Person Speaks Out Following Charges Being Withdrawn Over Coutts Arrest
Joanne Person has finally spoken out out about an arrest last year which caused nationwide attention. She was charged with 1 count of Firearms Possession and 1 count of Mischief Over $5,000.00 for allegedly aiding and abetting protesters in Coutts on Feb 14, 2022. On January 16, 2023, the charges were officially withdrawn.
This stems from the a section of the Canada/U.S. border being blocked last winter during nationwide protests over martial law measures.
While there was brief coverage of her case being dropped, it was quite limited. The version told by Person in the livestream paints a very different story to what has been officially reported. This includes the conduct of, and treatment by the RCMP.
Person wasn’t actually a part of any alleged plot, but had merely been hosting protesters in Coutts at her residence.
Although released on bail, it took nearly a year to have the case withdrawn. While news of the charges being dropped is a relief, it doesn’t undo the stress and hardship which came with the arrest. Her name made national news, and no public apology has yet been offered.
Chris Carbert, Christopher Lysak, Anthony Olienick and Jerry Morin remain charged with conspiracy to murder RCMP officers. Police allege that there had been a cache of weapons found in the area. They are scheduled to go on Trial in June.

Photo by Postmedia, file While other UCP leadership candidates talk to voters, Todd Loewen says he prefers to listen. “I was able to hear a lot of people and hear their concerns,” he said of his campaign in an interview last Friday. “I always say that I’ve never learned anything while I was talking, only when I’m listening.” The Central Peace-Notley MLA hasn’t drawn the attention of the other candidates for the premier’s job, but insists reflecting the views of those who elected him is most important to him. “I plan on living in my community the rest of my life,” Loewen said. “I hope I can look people in my community in the eye and feel like I’ve done my best and they feel the same way.” What those people have told him is at the centre of his leadership effort, and what he calls a consistent set of concerns he’s heard from around Alberta. He says those he’s met with have cited the performance of Alberta Health Services, the province’s relationship with the federal government, the UCP’s response to COVID-19 and the rising cost of living as issues of note. “I’ve met a lot of really good people and was able to listen to a lot of people.” Veteran backbencher Loewen, 56, has run for office four times, first as a Wildrose Alliance candidate in 2008. He was first elected in 2015 as a Wildrose MLA and was re-elected as a UCP member four years later. Perhaps once best known for endearing himself to colleagues by making and serving waffles throughout late-night legislative debates, Loewen emerged as an unlikely catalyst that ultimately sparked the current leadership contest. After publicly criticizing the government’s COVID-19 response, he resigned as caucus chief in May of last year and posted a public letter calling on Premier Jason Kenney to resign, “so that we can begin to put the province back together.” He and fellow government MLA Drew Barnes were both expelled from the party’s caucus soon after and have since sat as independent MLAs. Seventeen months later, he says he has “not even a little bit” of regret over speaking out. “The night I got kicked out of caucus I had the best night’s sleep ever.” ‘We wait and we accept what happens’ He says Kenney’s imminent departure helps the party come together after splintering over the past year. “Him leaving alone should help a lot of the divisiveness right there.” Loewen says he has no expectations ahead of Thursday’s results and hasn’t instructed his supporters on who else to vote for on the ranked-choice ballot. “(I’m) just looking forward to hearing what the voters have said. Just like any other election, we wait and we accept what happens.” Most pollsters forecast him finishing between fourth and last place among the seven leadership candidates, though ranked ballot contests are notoriously unpredictable.
